मध्यप्रदेश अनुसूचित जनजाति साहूकार विनियम ( संशोधन ) विनियम, 2021
क्रमांक-एफ-20-3-2019- पच्चीस-3.- भारत के संविधान की पांचवी अनुसूची के पैरा 5 के उप - पैरा ( 2 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, मध्यप्रदेश के राज्यपाल, एतद्वारा , मध्यप्रदेश अनुसूचित जनजाति साहूकार विनियम, 1972 में निम्नलिखित संशोधन करते हैं, अर्थात्ः-
संशोधन
उक्त विनियम में,-
1. धारा 4 में, उप - धारा ( 1 ) में, खण्ड ( ख ) में शब्द " पच्चीस " के स्थान पर, शब्द " पांच हजार " स्थापित किए जाएं, 2. धारा 7 में,-
(1) उप- धारा ( 1 ) के स्थान पर, निम्नलिखित उप- धारा स्थापित की जाए, अर्थात्ः-
" ( 1 ) कोई भी साहूकार उधार दिए गए किसी ऋण पर, राज्य सरकार द्वारा समय - समय पर अधिसूचित दर से ऊंची दर पर ब्याज प्रभारित नहीं करेगा. "
(2) उप- धारा ( 2 ) का लोप किया जाए,
(3) उप- धारा ( 3 ) में, शब्द " उप - धारा (2 ) के अधीन विहित किए गए प्रभार से अधिक " का लोप किया जाए, 3. धारा 24 में,-
( 1 ) शब्द " छह मास " के स्थान पर, शब्द " दो वर्ष " स्थापित किए जाएं, और
(2) शब्द " एक हजार " के स्थान पर, शब्द " एक लाख " स्थापित किए जाएं,
4. धारा 24 के पश्चात्, निम्नलिखित धारा अंतः स्थापित की जाए, अर्थात्ः-
" 24क, अनुज्ञा प्राप्त न करने का प्रभाव-

इन विनियमों की धारा 3 के अधीन अनुज्ञप्ति प्राप्त किए बिना किसी साहूकार द्वारा उधार दिया गया कोई ऋण या उस पर प्रभारित किया गया ब्याज निष्फल तथा अप्रति- संहरणीय होगा और ऐसे ऋण तथा ब्याज के संबंध में विधि के किसी न्यायालय में कोई विधिक कार्यवाही ग्राहा नहीं होगी ."
5. धारा 25 में, उप - धारा ( 1 ) में, शब्द " एक हजार पांच सौ " के स्थान पर, शब्द " पच्चीस हजार "स्थापित किए जाए,

F-20-3-2019-XXV- 3 -In exercise of the powers conferred by sub -paragraph (2) of paragraph 5 of the Fifth Schedule to the Constitution of India, the Governor of Madhya Pradesh, hereby, makes the following amendments in the Madhya Pradesh Anusuchit Janjati Sahukar Viniyam, 1972, namely:-
AMENDMENTS
In the said Viniyam.-
1. In section 4, in sub- section (1 ) , in clause (b) , for the words " twenty - five" , the words "five thousand " shall be substituted.
2. In section 7.-
(1) for sub-section ( 1 ) , the following sub - section shallbe substituted, namely:-
"( 1) No money lender shall charge , on any loan advanced, interest at a rate higher than that notified by the State Government from time to time." .
(2) sub - section (2) shall be omitted.
(3) in sub - section (3 ) , the words " charge in excess of that prescribed under sub- section (2)" shall be omitted.
3. In section 24,-
(1) for the words " six months " , the words " two years " shall be substituted , and (2) for the words " one thousand " , the words " one lakh " shall be substituted.
4. After section 24, the following section shall be inserted , namely:-
Effect of not obtaining of Licence.
"24A. Any loan advanced or inerest charged thereon by a money lender without obtaining a license under Section 3 of these Regulations shall be infructuous and irrecoverable and no legal proceedings shallbe admissible in respect of such loan and interest in any court of law." .
5. In section 25, in sub- section ( 1 ) , for the words " one thousand five hundred" , the words " twenty five thousand " shall be substituted.
