राज्य शासन , एतद्वारा , उपचारिका, प्रसाविका, सहायी उपचारिका -प्रसाविका तथा स्वास्थ्य परिदर्शक रजिस्ट्रीकरण अधिनियम, 1972 (क्रमांक 46 सन् 1973) की धारा 24 के साथ पठित धारा 33 की उप धारा (1 ) द्वारा प्रदत्त शक्तियों और उसके निमित्त उसे समर्थ बनाने वाली समस्त शक्तियों को प्रयोग में लाते हुए 'मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल ' के लिए सेवा में भर्ती तथा सेवा शर्तों से संबंधित निम्नलिखित नियम बनाते है , अर्थात्ः-

नियम

1. संक्षिप्त नाम तथा प्रारंभ-

(1) इन नियमों का संक्षिप्त नाम मध्यप्रदेश चिकित्सा शिक्षा विभाग मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल राजपत्रित सेवा भर्ती नियम, 2023 है ।

(2) ये नियम " मध्यप्रदेश राजपत्र" में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. परिभाषाएं- इन नियमों में , जब तक संदर्भ से अन्यथा अपेक्षित न हो, -

(क) सेवा या पद के संबंध में "नियुक्ति प्राधिकारी" से अभिप्रेत है , शासन या ऐसा अधिकारी जिसे इस सेवा या पद पर नियुक्ति करने की शक्ति है;

(ख) " मण्डल" से अभिप्रेत है, मध्यप्रदेश कर्मचारी चयन मण्डल ;

(ग) " अध्यक्ष" से अभिप्रेत है , अध्यक्ष , मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल (पदेन संचालक, चिकित्सा शिक्षा) ;

(घ) " समिति" से अभिप्रेत है , चयन समिति / विभागीय पदोन्नति समिति / छानबीन समिति;

(ड. ) ' आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस. ) " से अभिप्रेत है , जो संविधान के अनुच्छेद -341 एवं 342 के अन्तर्गत मध्यप्रदेश राज्य के लिए अधिसूचित अनुसूचित जाति एवं अनुसूचित जनजाति को प्रदत्त आरक्षण की परिधि में नहीं आते हैं;

(च) " परीक्षा" से अभिप्रेत है प्रतियोगी परीक्षा जो कि सेवा में भर्ती के लिए नियम 11 के अधीन ली जाती है;

(छ) "भूतपूर्व सैनिक" से अभिप्रेत है, ऐसा व्यक्ति, जो निम्नलिखित प्रवर्गों में से किसी एक प्रवर्ग में रहा हो तथा जो भारत सरकार के अधीन कम से कम छह माह की निरन्तर कालावधि तक सेवा में नियोजित रहा हो तथा जिसकी किसी भी रोजगार कार्यालय में अपना पंजीयन कराने अथवा शासकीय सेवा में नियुक्ति हेतु अन्यथा आवेदन देने की तारीख से अधिक से अधिक 3 वर्ष पूर्व मितव्ययिता इकाई की सिफारिशों के फलस्वरूप या अथवा स्थापना में सामान्य रूप से कमी किए जाने के कारण छंटनी की गयी हो अथवा जो अतिशेष (सरप्लस ) घोषित किया गया हो, -

(1 ) ऐसे भूतपूर्व सैनिक जिन्हें सेवा निवृत्ति रियायतों (मस्टरिंग आउट कन्सेशन) के अधीन निर्मुक्त कर दिया गया हो,

(2) ऐसे भूतपूर्व सैनिक, जो देश की सेना में लगातार छह माह से अधिक नियोजित रहे हो और जिन्हें कदाचरण के आधार पर सेवोन्मुक्त न किया गया हो,

(3) ऐसे भूतपूर्व सैनिक, जिन्हें दूसरी बार नामांकित किया गया हो , और

(क) अल्पकालीन वचनबंध अवधि पूर्ण होने पर;

(ख) नामांकन संबंधी शर्तें पूर्ण होने पर

सेवोन्मुक्त किया गया हो,

(4) मद्रास सिविल ईकाई (यूनिट) के भूतपूर्व कार्मिक,

(5) ऐसे अधिकारी , जिन्हें अवकाश रिक्तियों पर छह मास से अधिक समय तक निरन्तर कार्य करने के पश्चात् सेवोन्मुक्त किया गया हो,

(6) ऐसे भूतपूर्व सैनिक जिन्हें अशक्त होने के कारण या गोली लगने तथा घाव आदि के कारण चिकित्सीय आधार पर सेवा से पृथक् किया गया हो, अथवा अब वे दक्ष सैनिक बनने के योग्य नहीं होने के कारण सेवोन्मुक्त किया गया हो;

(ज) "शासन" से अभिप्रेत है, चिकित्सा शिक्षा विभाग मध्यप्रदेश शासन;

(झ) 'राज्यपाल से अभिप्रेत है, मध्यप्रदेश के राज्यपाल;

(ञ) " अन्य पिछडा वर्ग " से अभिप्रेत है, राज्य सरकार द्वारा समय - समय पर यथा संशोधित अधिसूचना क्रमांक एफ- 8-5- पच्चीस- 4-84 , दिनांक 26 दिसम्बर, 1984 द्वारा यथा संशोधित नागरिकों के अन्य पिछडे वर्ग;

(ट) "निर्धारित संस्था " से अभिप्रेत है कि मध्यप्रदेश शासन के अधीन ऐसी संस्था जिसके माध्यम से प्रतियोगी परीक्षा आयोजित की जाती है;

(ठ) "दिव्यांगजन और महिलाओं के लिए आरक्षण" से अभिप्रेत है ऐसा आरक्षण जो सामान्य प्रशासन विभाग द्वारा समय समय पर जारी परिपत्र के अनुसार दिया जाए;

(ड) " अनुसूची" से अभिप्रेत है इन नियमों से संलग्न अनुसूची;

(ढ) " अनुसूचित जाति से अभिप्रेत है कोई जाति मूलवंश या जनजाति अथवा कोई जाति, मूलवंश या जनजातिं का भाग या उसमें का यूथ, जिसे भारत के संविधान के अनुच्छेद 341 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जाति के रूप में विनिर्दिष्ट किया गया है;

(ण ) " अनुसूचित जनजाति से अभिप्रेत है, कोई जनजाति मूलवंश या जनजाति समुदाय या ऐसी जनजाति समुदाय का भाग या उसमें का यूथ, जिसे भारत के संविधान के अनुच्छेद 342 के अधीन मध्यप्रदेश राज्य के संबंध अनुसूचित जनजाति रूप में विनिर्दिष्ट किया गया है;

(त ) " सेवा" से अभिप्रेत है मध्यप्रदेश चिकित्सा शिक्षा विभाग , मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल अराजपत्रित सेवा ।

3. विस्तार तथा लागू होना.- मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्ते) नियम, 1961 में अंतविष्ट उपबंधनों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना ये नियम सेवा के प्रत्येक सदस्य पर लागू होंगे ।

4. सेवा का गठन- सेवा में निम्नलिखित व्यक्ति होंगे , अर्थात्ः-

(1 ) वे व्यक्ति जो इन नियमों के प्रारम्भ होने के समय अन्तर्गत अनुसूची - एक में विर्निदिष्ट किसी भी पद को मूलतः या स्थानापन्न रूप में धारण कर रहें हो ;

(2) वे व्यक्ति जो मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल सेवा राजपत्रित सेवा भर्ती नियम , 2023 के उपबंधो के अनुसार सेवा में भर्ती किए गए हो ।

5. वर्गीकरण, वेतनमान आदि.-

(1 ) सेवा का वर्गीकरण , वेतनमान तथा सेवा में सम्मिलित पदों की संख्या अनुसूची- एक में अंतर्विष्ट उपबंधों के अनुसार होगीः

परन्तु शासन सेवा में सम्मिलित पदों की संख्या में समय - समय पर या तो स्थायी रूप से या अस्थायी रूप से वृद्धि या कमी कर सकेगी ।

(2) सेवा का कोई भी सदस्य सेवा की संरचना में किसी भी परिवर्तन के परिणाम स्वरूप या शासन द्वारा संवर्ग में किसी रिक्त पद को भरा नहीं जाने या उसे प्रास्थगित रखने की दशा में प्रतिकर का पात्र नहीं होगा ।

6. भर्ती का तरीका.-

(1 ) इन नियमों के लागू होने के पश्चात् सेवा में भर्ती निम्नलिखित तरीकों से की जाएगी, अर्थात्ः-

(क) सीधी भर्ती द्वारा, चयन या प्रतियोगिता परीक्षा द्वारा या दोनों द्वारा;

(ख ) सेवा के सदस्यों की पदोन्नति द्वारा ;

(ग ) अन्य पदों या सेवाओं से व्यक्तियों के स्थानांतरण / संविलियन / प्रतिनियुक्ति द्वारा जैसा कि राज्य शासन समय - समय पर अवधारित करे ।

(2) मध्यप्रदेश शासन, चिकित्सा शिक्षा विभाग के अंतर्गत संचालित स्वशासी / शासकीय चिकित्सा महाविद्यालयों में कार्यरत राजपत्रित संवर्ग के नर्सिंग , सह- चिकित्सीय , अलिपिकीय संवर्ग के पदों पर सीधी भर्ती में इनके अनुभवों का लाभ दिया जाएगा;

(3) उपनियम ( 1 ) के खण्ड (ख ) के अधीन भर्ती किए गए व्यक्तियों की संख्या किसी भी समय (अनुसूची - एक में यथा विर्निदिष्ट ) कर्तव्य पदों की संख्या की अनुसूची- दो में अंतर्विष्ट उपबंधों के अनुसार होगी;

(4 ) मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल राजपत्रित सेवा भर्ती नियम, 2023 के उपबंधों के अध्यधीन रहते हुए भर्ती की किसी भी विशेष कालावधि के दौरान भरे जाने के लिए अपेक्षित सेवा में की किसी भी विशेष रिक्ति या रिक्तियों को भरने के प्रयोजन के लिए अपनाया जाने वाला भर्ती का तरीका या तरीके तथा प्रत्येक तरीके द्वारा भर्ती किए जाने वाले व्यक्तियों की संख्या प्रत्येक अवसर पर शासन द्वारा अवधारित की जाएगी;

(5) उपनियम (1 ) में अन्तर्विष्ट किसी बात के होते हुए भी यदि शासन की राय में सेवा की आवश्यकताओं को देखते हुए यदि आवश्यक हो तो सामान्य प्रशासन विभाग की पूर्व सहमति से उक्त उप नियम में विनिर्दिष्ट सेवा में ऐसे पदों की भर्ती के तरीकों से भिन्न ऐसे अन्य तरीके अपना सकेगी, जो वह इस निमित जारी किए गए आदेश द्वारा विहित किए गए हों ।

7. सेवा में नियुक्ति.-

इन नियमों के प्रारंभ होने के पश्चात् सेवा में समस्त नियुक्तियां, नियुक्ति प्राधिकारी द्वारा की जाएंगी और ऐसी कोई भी नियुक्ति नियम 6 में विनिर्दिष्ट भर्ती के तरीकों में से किसी एक तरीके द्वारा चयन किए जाने के बाद ही की जायेगी अन्यथा नहीं ।

8. सीधी भर्ती की पात्रता की शर्ते.-

सीधी भर्ती से चयन किए जाने / प्रतियोगिता परीक्षा में भाग लेने के लिए पात्र होने हेतु अभ्यर्थी को निम्नलिखित शर्ते पूरी करनी होंगी अर्थात्ः-

(1) आयुः-

न्यूनतम आयु , अधिकतम आयु एवं अधिकतम आयु सीमा में छूट ऐसी होगी जैसा कि राज्य शासन द्वारा समय - समय पर सामान्य प्रशासन विभाग द्वारा जारी दिशा निर्देशों के अनुसार अवधारित किया जाए ।

(2) शैक्षणिक अर्हताएं: -

अभ्यर्थी के पास सेवा के लिए विहित की गई ऐसी शैक्षणिक अर्हताएं एवं अन्य अर्हताएं होनी चाहिये जो कि अनुसूची- तीन में अंतर्विष्ट उपबंधों के अनुसार होंगीः

परन्तु आयोग / नियुक्ति प्राधिकारी अपने विवेकाधिकार पर ऐसे अभ्यर्थियों को जो अन्यथा अर्ह हैं किन्तु जिन्होंने ऐसी अन्य संस्थाओं से जो सरकार द्वारा विनिर्दिष्ट रूप से मान्यता प्राप्त नहीं है , या विदेशी विद्यालयों से उपाधियां धारण करते हैं और जिसे परीक्षा / चयन में प्रवेश के लिए योग्य समझा जाता हो , पर भी विचार कर सकेगा ।

(3) फीस.-

अभ्यर्थी को नियुक्ति प्राधिकारी / आयोग / शासन द्वारा समय - समय पर यथा पुनरीक्षित फीस का संदाय करना होगा ।

9. निरहर्ता.-

(1 ) अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिए किसी भी साधन से समर्थन प्राप्त करने के किसी भी प्रयास को नियुक्ति प्राधिकारी / आयोग / शासन द्वारा परीक्षा / चयन के लिए निरर्हता के रूप में माना जाएगा ।

(2) कोई भी अभ्यर्थी, जिसने विवाह के लिए नियत की गई न्यूनतम आयु से पूर्व विवाह किया हो किसी सेवा या पद पर नियुक्ति के लिए पात्र नहीं होगा ।

(3 ) कोई भी अभ्यर्थी , जिसकी 2 से अधिक संतान हों, जिसमें से 1 का जन्म 26 जनवरी , 2001 को अथवा उसके पश्चात् हुआ हो, किसी सेवा या पद पर नियुक्ति के लिए पात्र नहीं होगा, बशर्ते कि दूसरी संतान जुड़वां न हो ।

(4) कोई भी अभ्यर्थी, जिसे महिलाओं के विरूद्ध किसी अपराध का सिद्धदोष ठहराया गया हो सेवा के लिए पात्र नहीं होगाः

परन्तु जहां किसी व्यक्ति के विरूद्ध न्यायालय में आपराधिक मामला लंबित हो तो उसकी नियुक्ति आपराधिक मामले का विनिश्चय होने तक लंबित रखी जाएगी ।

(5) कोई भी अभ्यर्थी, जिसकी एक से अधिक जीवित पत्नि हो और कोई भी महिला अभ्यर्थी जिसने ऐसे व्यक्ति से विवाह किया है, जिसकी पहले से ही एक पत्नि जीवित हो, सेवा के लिए अपात्र होगा ।

(6) ऐसा कोई, कारण जो राज्य शासन द्वारा विहित किया जाए ।

10. अभ्यर्थी की पात्रता के संबंध में मण्डल का विनिश्चय अंतिम होगा. -

चयन परीक्षा में प्रवेश हेतु ग्राहय किए जाने के लिए अभ्यर्थी की पात्रता या अपात्रता संबंध में मण्डल का विनिश्चय अंतिम होगा और अभ्यर्थी को जिसे आयोग द्वारा प्रवेश प्रमाण - पत्र जारी नहीं किया गया हैं आयोग द्वारा परीक्षा हेतु उसका साक्षात्कार नहीं लिया जाएगा / उसे परीक्षा हेतु ग्राहय नहीं किया जाएगा ।

11. चयन / प्रतियोगी परीक्षा सीधी भर्ती.-

(1 ) सेवा में सीधी भर्ती के लिए आयोग द्वारा परीक्षा ऐसे आदेशों के अनुसार ली जाएगी जो कि शासन समय - समय पर जारी करे ।

(2) यदि शासन चयन से सीधी भर्ती करने का निर्णय लेती है तो आयोग चयन द्वारा सीधी भर्ती कर सकेगा ।

(3) सीधी भर्ती के लिए मध्यप्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़ा वर्ग के लिए आरक्षण ) नियम, 1998 के उपबंधों के अनुसार अनुसूचित जाति , अनुसूचित जनजाति तथा अन्य पिछड़ा वर्ग के अभ्यर्थियों के लिए पद राज्य शासन द्वारा समय - समय पर आररक्षण के संबंध में जारी दिशा- निर्देशों के अनुसार आरक्षित रखे जाएंगे । उपलब्ध रिक्तियों में से मध्यप्रदेश सिविल सेवा ( महिलाओं की नियुक्ति के लिए विशेष उपबंध) नियम, 1997 के अनुसार महिला अभ्यर्थियों के लिए भी पद आरक्षित रखे जाएंगे ।

(4) इस प्रकार रक्षित रिक्त स्थानों को भरते समय ऐसे अभ्यर्थियों की जो कि अनुसूचित जातियों, अनुसूचित जनजाति, अन्य पिछड़े वर्गो तथा आर्थिक रूप से कमजोर वर्ग के सदस्य है कि नियुक्ति के लिए उसी क्रम में विचार किया जाएगा जिसमें कि उनके नाम नियम 12 में निर्दिष्ट सूची में आए हो , चाहे उनका सापेक्षित रैंक कुछ भी क्यों न हो ।

(5 ) यदि अनुसूचित जातियों, अनुसूचित जनजातियों एवं अन्य पिछड़ा वर्ग के अभ्यर्थी, उनके लिए आरक्षित सभी रिक्तियों को भरने के लिए पर्याप्त संख्या में उपलब्ध न हों तो शेष रिक्तियां किसी भी रीति से अन्य अभ्यर्थियों से नहीं भरी जाएंगी ।

(6) शासन द्वारा भूतपूर्व सैनिक एवं शारीरिक रूप से दिव्यांगजनों / निःशक्तजनों के लिए आरक्षण के उपबंध होरीज़न्टल (क्षैतिज) एण्ड कम्पार्टमेंट वाइज होंगे ।

(7) सामान्य प्रशासन विभाग द्वारा परिपत्र क्रमांक एफ- 07-11 / 2019 / आ.प्र. / एक दिनांक 02 जुलाई , 2019 में जारी प्रावधान अनुसार सीधी भर्ती से भरे जाने वाले अपेक्षित व्यक्तियों की संख्या के दस प्रतिशत पद आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस. ) हेतु आरक्षित होंगे ।

(8) सामान्य प्रशासनं विभाग के निर्देशों के अनुसार विकलांग अभ्यर्थियों के लिए पद आरक्षित रखे जाएंगे ।

12. आयोग द्वारा अनुशंसित किए गए अभ्यर्थियों की सूची.-

(1 ) आयोग ऐसे अभ्यर्थियों की जो ऐसे स्तर से जैसा कि आयोग अवधारित करें अर्हिता रखता हों तथा अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़ा वर्ग एवं आर्थिक रूप से कमजोर वर्ग के ऐसे अभ्यर्थियों की जो यद्यपि उस स्तर से अर्हिता न हों फिर भी प्रशासन की दक्षता बनाए रखने का सम्यक् ध्यान मध्यप्रदेश राजपत्र, दिनांक 16 जून 2023

रखते हुए मण्डल द्वारा सेवा में नियुक्ति के लिए योग्य घोषित किए गए हों अभ्यर्थियों की योग्यता के क्रम से बनाई गई सूची शासन को अग्रेषित करेगा । सूची सर्वधारण की जानकारी के लिए भी प्रकाशित की जाएगी ।

(2 ) इन नियमों तथा मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्ते ) नियम, 1961 के उपबंधों के अध्यधीन रहते हुए उपलब्ध रिक्त स्थानों पर सूची में आए उनके नामों के क्रम से अभ्यर्थियों की नियुक्ति के लिए विचार किया जाएगा ।

(3) सूची में किसी अभ्यर्थी का नाम सम्मिलित किया जाना उसे नियुक्ति का कोई अधिकार तब तक प्रदान नहीं करता जब तक कि नियुक्ति प्राधिकारी का ऐसी जांच करने के पश्चात् जैसा कि वह आवश्यक समझे यह समाधान न हो जाए कि अभ्यर्थी सेवा में नियुक्ति के लिए सभी प्रकार से उपयुक्त है ।

(4) आयोग द्वारा जारी चयन सूची , जारी किए जाने की तारीख से एक वर्ष तक की कालावधि के लिए विधिमान्य रहेगी तथा जिसे आयोग की सहमति से 6 माह की कालावधि के लिए बढाया जा सकेगा ।

13. परिवीक्षा.-

राजपत्रित सेवा में भर्ती किए गए अभ्यर्थी को 02 वर्ष की कालावधि के लिए परिवीक्षा पर नियुक्त किया जाएगा ।

14. अनुशासनात्मक कार्यवाही करने के प्राधिकार.-

(1 ) राजपत्रित के लिए सामान्य प्रशासन विभाग द्वारा जारी दिशा निर्देशों के अनुसार आयुक्त चिकित्सा शिक्षा अनुशासनिक प्राधिकारी होंगे ।

(2) अपीलः-

(अ) आयुक्त चिकित्सा शिक्षा द्वारा जारी आदेश के विरूद्ध प्रथम अपीलीय प्राधिकारी प्रशासकीय विभाग के प्रमुख होंगे ।

15. पदोन्नति द्वारा नियुक्ति. -

(1) पात्र अभ्यर्थियों की पदोन्नति के लिए अनुसूची- चार में यथा उल्लिखित सदस्यों से मिलकर एक पदोन्नति समिति गठित की जाएगी ।

(2) समिति, सामान्य प्रशासन विभाग द्वारा समय - समय पर जारी किए गए निर्देशों के अनुसार अनुसूची - चार में उल्लेखित पदों के लिए समस्त व्यक्तियों के मामलों पर विचार करेगी ।

(3) समिति ऐसे अंतरालों से बैठक करेगी जैसा कि नियुक्ति प्राधिकारी निर्देश दे परन्तु समिति सामान्यतः वर्ष में कम से कम 2 बार बैठक अवश्य करेगी ।

(4) नियम 6 (5) के उपबंधों के अध्यधीन रहते हुए समिति उन सभी व्यक्तियों के मामलों पर विचार करेगी जिन्होंने उस वर्ष की 1 जनवरी को उतने वर्षों की सेवा (चाहे स्थानापन्न के रूप में या मूलरूप में) उस पद पर जिससे पदोन्नति की जाना है जैसा कि अनुसूची - चार के कॉलम (4 ) में विनिर्दिष्ट है पूर्ण कर ली हो तथा जो उप नियम (2) के उपबंधों के अनुसार विचारण के क्षेत्र (जोन ऑफ कन्सीडरेशन) के भीतर आते होंः

परन्तु आपातकालीन कमीशन तथा अल्पकालीन सेवा कमीशन से निर्मुक्त किए गए अधिकारियों की सेवा की गणना उनकी नियुक्ति के पश्चात् से की जाएगी जिस तारीख से उन्हें सामान्य प्रशासन विभाग के ज्ञापन क्रमांक 2266-1987- एक (33) -67 तारीख 21 अक्टूबर 1967 के अनुसार सेवा में नियुक्त किया समझा गया होः

परन्तु यह और भी कि किसी कनिष्ठ व्यक्ति को उस से वरिष्ठ व्यक्ति पर अधिमानता देकर प्रवर श्रेणी / पदोन्नति के लिए केवल इस आधार पर विचार नहीं किया जाएगा कि उसने विहित सेवा पूर्ण कर ली है ।

(5) चयन के लिए विचारार्थ क्षेत्र चयन सूची में सम्मिलित किए जाने वाले अधिकारियों / कर्मचारियों की संख्या में साधारणतः तृतीय श्रेणी से द्वितीय श्रेणी, एवं द्वितीय से प्रथम श्रेणी हेतु मेरिट सह- वरिष्ठता के आधार पर सीमित होगा और चयन सूची में सम्मिलित किए जाने वाले कर्मचारियों की संख्या के साधारणतः वरिष्ठता तथा योग्यता के आधार पर भरे जाने वाले पदों के संबंध में पांच गुना तक सीमित होगाः

परन्तु इस प्रकार अवधारित किए गए क्षेत्र में यदि अपेक्षित संख्या में उपयुक्त अधिकारी उपलब्ध न हो तो उस क्षेत्र को उस सीमा तक बढ़ाया जा सकेगा जो समिति द्वारा लिखित में कारणों का उल्लेख करते हुए आवश्यक समझी जाए ।

(6) प्रत्येक नियुक्ति प्राधिकारी उसके द्वारा जारी किए जाने वाले पदोन्नति आदेश पर इस आशय के प्रमाण - पत्र का पृष्ठांकन करेगा कि उसने मध्यप्रदेश लोक सेवा (अनुसूचित जाति / अनुसूचित जनजातियों और पिछड़े वर्गों के लिए आरक्षण) अधिनियम , 1994 (क्रमांक 21 सन् 1994) तथा सामान्य प्रशासन विभाग द्वारा समय - समय पर जारी नियमों के उप खण्डों के अधीन जारी किए जाएं अनुदेशों का पालन किया है ।

16. उपयुक्त अभ्यर्थियों की सूची तैयार करना.-

(1 ) समिति ऐसे व्यक्तियों की सूची तैयार करेगी जो उपरोक्त नियम-15 में विहित शर्त को पूरा करते हों तथा जो समिति द्वारा सेवा में पदोन्नति के लिए उपयुक्त ठहरायें गए हो । यह सूची तैयार कराने की तारीख से एक वर्ष के दौरान सेवानिवृत्ति तथा पदोन्नति के कारण होने वाली प्रत्याशित रिक्तियों को भरने के लिए पर्याप्त होगी । उक्त सूची में सम्मिलित किए गए व्यक्तियों की संख्या के पच्चीस प्रतिशत व्यक्तियों की एक आरक्षित सूची उपरोक्त कालावधि के दौरान होने वाली अनवेक्षित रिक्तियों को भरने के लिए तैयार की जाएगी ।

(2) ऐसी सूची में नाम सम्मिलित करने के लिए किया जाने वाला चयन वरिष्ठता का सम्यक् ध्यान रखते हुए योग्यता तथा सभी दृष्टि से उपयुक्तता पर अवधारित होगा ।

(3) प्रत्येक चयन सूची को तैयार करते समय सूची में सम्मिलित किए जाने वाले अधिकारियों / कर्मचारियों के नाम अनुसूची चार के कॉलम (2 ) में यथा विनिर्दिष्ट पदों में वरिष्ठता के क्रम में रखे जाएंगे ।

स्पष्टीकरण.-

ऐसे किसी व्यक्ति का जिसका नाम चयन सूची में सम्मिलित किया गया हो किन्तु जो सूची की विधिमान्यता के दौरान पदोन्नत न किया गया केवल उसके पूर्वतर चयन के तथ्य से ही उन व्यक्तियों के ऊपर जिन पर पश्चात वर्ती चयन में विचार किया गया है वरिष्ठता का दावा नहीं होगा ।

(4) इस प्रकार तैयार की गई सूची का प्रतिवर्ष पुनर्विलोकन तथा पुनरीक्षण किया जाएगा ।

(5 ) यदि इस प्रकार के चयन , पुनर्विलोकन या पुनरीक्षण की प्रक्रिया के दौरान किसी सदस्य को अधिक्रमित किए जाने का प्रस्ताव किया जाता है तो समिति प्रस्तावित अधिक्रमण के संबंध में अपने कारणों को लेखबद्ध करेगी ।

17. समयमान वेतनमान.-

वित विभाग द्वारा समय - समय पर जारी दिशा निर्देशों के अनुक्रम में तीन स्तरीय समयमान वेतनमान पात्रता अनुसार देय होगा ।

18. पदोन्नति हेतु राजपत्रित द्वितीय से प्रथम श्रेणी अधिकारी के लिए गठित विभागीय पदोन्नति समिति, अध्यक्ष, लोक सेवा आयोग की अध्यक्षता में की जाएगी । संविधान के अनुच्छेद 320 के खण्ड (3 ) के उपखण्ड (ख ) के अधीन परामर्श करने संबंधी अपेक्षा का अनुपालन हो गया है ।

आयोग से परामर्श. -

विभागीय पदोन्नति समिति जिसकी अध्यक्षता आयोग के किसी सदस्य द्वारा की गई हो की सिफारिश के संबध में यह समझा जाएगा कि संविधान के अनुच्छेद 320 के खण्ड (3 ) के उपखण्ड (ख ) के अधीन आयोग के सदस्य के साथ परामर्श करने संबंधी अपेक्षा का अनुपालन हो गया है तथा आयोग के साथ पृथक परामर्श करना आवश्यक नहीं होगा ।

19. चयन सूची.-

(1 ) अध्यक्ष, मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल द्वारा अंतिम रूप से अनुमोदित की गई सूची अनुसूची- चार के कॉलम (2) में दर्शाये गए पदों से अनुसूची- चार के कॉलम (3) में दर्शाये पदों पर सेवा के सदस्यों की पदोन्नति के लिए चयन सूची होगी ।

(2) चयन सूची सामान्यतः तब तक प्रवृत्त रहेगी जब तक कि नियम 15 के उपनियम (4 ) के अनुसार उसका पुनर्विलोकन या पुनरीक्षण नहीं कर लिया जाता किन्तु उसकी विधिमान्यता ऐसी सूची तैयार किए जाने की तारीख से 18 मास की कुल कालावधि के परे नहीं बढ़ाई जाएगीः

परन्तु चयन सूची में सम्मिलित किसी व्यक्ति की ओर से आचरण या कर्तव्यों के निर्वहन में गंभीर चूक होने की दशा में शासन तथा अध्यक्ष, मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल की प्रेरणा द्वारा चयन सूची का विशेष रूप से पुनर्विलोकन किया जा सकेगा और यदि वह उचित समझे , ऐसे व्यक्ति का नाम चयन सूची से हटा सकेगा ।

20. चयन सूची से सेवा में नियुक्ति.-

(1 ) चयन सूची में सम्मिलित अधिकारी की सेवा संवर्ग के अंतर्गत आने वाले पदों पर नियुक्ति उसी क्रम से की जाएगी जिस क्रम में ऐसे अधिकारी के नाम चयन सूची में होंः

परन्तु जहां प्रशासकीय अत्यावश्यकता के कारण ऐसा करना अपेक्षित हो वहां उस व्यक्ति को जिसका नाम चयन सूची में सम्मिलित नहीं हो या जिसका नाम चयन सूची में दिये गए क्रम में ठीक नीचे न हो सेवा में नियुक्त किया जा सकेगा यदि शासन का यह समाधान हो जाए जांच कि रिक्ति के तीन मास से अधिक समय तक चलने की संभावना नहीं है ।

(2 ) ऐसे किसी व्यक्ति की जिसका नाम सेवा की चयन सूची में सम्मिलित है सेवा में नियुक्ति के पूर्व आयोग से परामर्श करना सामान्यतः तब तक आवश्यक नहीं होगा जब तक कि चयन सूची में उसका नाम सम्मिलित किए जाने तथा प्रस्तावित नियुक्ति की तारीख के बीच की कालावधि के दौरान उसके कार्य में ऐसी कोई गिरावट न आ गई हो जो शासन की राय में ऐसी हों जिससे वह सेवा में नियुक्ति के लिए अनुपयुक्त हो गया हो ।

निर्वचन.-

21.

यदि इन नियमों के निर्वचन के संबंध में कोई प्रश्न उदभूत होता है तो वह शासन को निर्दिष्ट किया जाएगा, जिसका उस पर विनिश्चय अंतिम होगा ।

22. शिथलीकरण. -

इन नियमों में किसी भी बात का यह अर्थ नहीं लगाया जाएगा कि वह किसी ऐसे व्यक्ति के मामलें में जिस पर ये नियम लागू होते हों. राज्यपाल की ऐसी रीति में कार्यवाही करने की जो उसे न्यायसंगत और साम्यापूर्ण प्रतीत होती हो शक्ति को सीमित या कम करती है:

परन्तु कोई मामला ऐसी रीति में नहीं निपटाया जाएगा जो कि इन नियमों में उपबंधित रीति की अपेक्षा उसके लिए कम अनुकूल हो ।

23. व्यावृत्ति.-

इन नियमों में की गई कोई भी बात अनुसूचित जातियों तथा अनुसूचित जनजातियों के लिए राज्य शासन द्वारा इस संबंध में समय- समय पर जारी किए गए आदेशों के अनुसार उपबंध किए जाने के लिए अपेक्षित आरक्षण तथा अनुरूप शर्तों को प्रभावित नहीं करेगी ।

निरसन.-

24.

इन नियमों के तत्स्थानी और इनके प्रारंभ होने के ठीक पूर्व प्रवृत्त सभी नियम इन नियमों के अंतर्गत आने वाले विषयों के संबंध में एतद्वारा निरसित किए जाते हैं ।

In exercise of the powers conferred by section 33 read with section 24 of the Madhya Pradesh Upcharika , Prasavika , Sahai Upcharika Prasavika Tatha Swasthya Paridarshak Registrikaran Adhiniyam , 1972 (No. 46 of 1973) , the Governor of Madhya Pradesh , hereby , makes the following rules relating to recruitment and service conditions for the Madhya Pradesh Nurses Registration Council , Gazetted , Service Recruitment Rules , 2023 , namely:

RULES

1. Short title and commencement.-

( 1) These rules may be called the Madhya Pradesh Medical Education Department , Madhya Pradesh Nurses Registration Council Gazetted Service Recruitment Rules , 2023 .

(2) These rules shall come into force from the date of their publication in the Madhya Pradesh Gazette .

2. Definitions . In these rules , unless the context otherwise requires ,

( a) "Appointing Authority " in relation to a service or post , means the Government or an officer empowered to make appointments to that service or post ;

(b) " Chairman " means the President , Madhya Pradesh Nurses Registration Council ( ex - officio Director , Medical Education) ;

(d)

(e) " Economically weaker Section (EWS ) " means a citizen who does not come under any reserve category such as Scheduled Castes and Scheduled Tribes as per General Administration Department's circular No.F - 07- 11/2019/आ.प्र. /one dated 2nd July, 2019;

(1) "Examination " means the competitive examination conducted for recruitment to the service , as mentioned under rule 11 ;

(g ) "Ex- Serviceman " means a person who belongs to any of the following categories and who was employed under the Government of India for a continuous period of not less than six months and who was retrenched or declared surplus as a result of the recommendation of the economy unit or due to normal reduction in establishment not more than 3 years before the date of his registration at any Employment Exchange or of application made otherwise for employment in Government Service-

(1) ex - serviceman released under mustering out concession;

(2) ex - serviceman who was employed more than six months continuously in army of country and not released due to any misconduct ;

(3) ex - serviceman enrolled for the second time and discharged on-

(a) completion of short term engagement ;

(b) fulfilling the conditions of enrollment ;

ex- personnel of Madras Civil Units ; (4)

(5) officer discharged after working for more than six months continuously against leave vacancies ;

(6) ex - serviceman who are medically boarded out on account of gunshot , wounds etc. or they are unlikely to become efficient soldiers ;

(h) "Government " means the Department , Government of Madhya Pradesh; Medical Education (i) "Governor " means the Governor of Madhya Pradesh ;

(j ) "Other Backward Classes " means the Other Backward Classes of citizens as specified by the State Government vide Notification F - 8-5 -XXV - 4-84 , dated 26 December , 1984 , as amended from time to time;

(k) "Prescribed Institution " means such institution under the Government of Madhya Pradesh through which competitive examination is conducted ;

"Reservation for disabled and women" means the reservation which shall be according to the circular issued by the General Administration Department from time to time ; (1)

(m) " Schedule " means the Schedule appended to these rules ;

(n) " Scheduled Castes " means any caste , race or tribe or part of or group within a caste , race or tribe , which has been notified under article 341 of the Constitution of India in the State of Madhya Pradesh or has been specified as a Scheduled Caste in relation to the State ;

(0) " Scheduled Tribes " means any tribal origin or tribal community or part of or group within such tribal community , which has been specified as a Scheduled Tribe in relation to the State of Madhya Pradesh under article 342 of the Constitution of India ;

(p) " Service " means Madhya Pradesh Medical Education Department , Madhya Pradesh Nurses Registration Council Service Gazetted .

3. Scope and Application.- Without prejudice to the generality of the provisions contained in the Madhya Pradesh Civil Services ( General Conditions of Service) Rules , 1961 , these rules shall apply to every member of the service .

4. Constitution of the Service . The service shall consist of the following persons , namely: -

(1) Persons who , at the time of commencement of these rules , are holding any of the posts specified in Schedule- I either substantively or officiating .

(2) Persons who are recruited in service in accordance with the provisions of the Madhya Pradesh Nurses Registration Council Service Gazetted Recruitment Rules , 2023 . Service

5. Classification , the scale of pay , etc. -

(1) The classification , scale of pay and number of posts included in the service shall be in accordance with the provisions contained in Schedule - I :

Provided that the Government may from time to time either permanently or temporarily increase or decrease the number of posts included in the service .

(2) No member of the service shall be eligible for compensation as a result of any change in the composition of the service or in the event of non - filling or holding in abeyance of any vacancy in the cadre by the Government .

6. Method of recruitment.-

(1) Recruitment to the service after the coming into force of these rules shall be done in the following ways , namely: - (a) by direct recruitment , by selection or by competitive examination or by both ;

(b) by promotion of the members of the service.

(2) The benefits of their experiences shall be given in direct recruitment to the posts of gazetted cadre nursing , co- medical and non - medical cadre working in autonomous /government medical colleges operated under the Medical Education Department , Government of Madhya Pradesh .

(3) The number of persons admitted under clause (b ) of sub- rule ( 1 ) , number of duty posts ( as specified in Schedule - I ) at any point of time shall be in accordance with the provisions specified in Schedule - II .

(4) Subject to the provisions of the Madhya Pradesh Nurses Registration Council Gazetted / Associated Services Recruitment Rules , 2023 , adopted for the purpose of filling any particular vacancy or vacancies in the service required to be filled during any particular period of recruitment , the method or methods of recruitment to be made and the number of persons to be recruited by each method shall be determined by the Government on each occasion .

(5) Notwithstanding anything contained in sub - rule ( 1) , if in the opinion of the Government , keeping in view the requirements of the service , such posts in the service as may be specified in the said sub - rule , if necessary , with the prior consent of the General Administrative Department , may adopt such other methods of recruitment as may be prescribed by an order issued on this behalf.

7. Appointment to the service . All appointments to the service after the commencement of these rules shall be made by the appointing authority . No such appointment shall be made except after selection by one of the recruitment methods specified in rule 6 .

8. Eligibility conditions for direct recruitment . In order to be eligible to be selected through direct recruitment / to appear in the competitive examination , the candidate must fulfil the following conditions : -

(1) Age Relaxation in minimum age and maximum age limit shall be such as may be determined by the State Government from time to time as per the guidelines issued by the General Administration Department .

(2) Educational / Qualifications The candidate must possess such educational qualifications and other qualifications as may be prescribed for the service , which shall be in accordance with the provisions contained in Schedule - III :

Provided that the Commission /Appointing Authority may , at its discretion , appoint candidates who are otherwise qualified but hold Degrees from other Institutions not specifically recognized by the Government or from foreign schools , who are not eligible for admission to the examination / selection .

(3) Fee The candidate shall have to pay the fee as revised from time to time by the Appointing Authority / Government .

Disqualifications . 9.

(1) Support on the part of the candidate for his / her candidature , by any means or any attempt to obtain , shall be treated as a disqualification for the examination /selection by the Appointing Authority / Government .

(2) No candidate , who has married before the minimum age fixed for marriage , shall be eligible for appointment to any service or post .

(3) Any candidate who has more than 2 children , 1 of whom is born on or after January 26 , 2001 , in any service or post shall not be eligible for appointment , provided that the second child is not a twin .

(4) Any appointed candidate who has been convicted of any crime against women , shall not be eligible for service: Provided that where a criminal case is pending against a person in a court of law , his appointment shall be kept pending till the criminal case is decided .

(5) Any candidate who has more than one wife living and any female candidate who is married to a person , who already has a wife alive , shall be ineligible for service .

10. Decision of the Commission regarding the eligibility of the candidate shall be final. The decision of the Commission regarding the eligibility or ineligibility of the candidate to be accepted for admission through the selection test shall be final and the candidate to whom the admission certificate has not been issued by the Public Service Commission shall not be मध्यप्रदेश राजपत्र , दिनांक 16 जून 2023

interviewed by the Commission and shall not be admitted for the examination .

11. Direct recruitment by selection examination.- /competitive

( 1 ) The examination for direct recruitment to the service shall be conducted by the Commission in accordance with such orders as may be issued by the Government from time to time .

(2) If the Government decides to make direct recruitment by selection , the Commission shall be able to do so .

(3 ) According to the provisions of the Madhya Pradesh Public Service ( Reservation for Scheduled Castes , Scheduled Tribes , and Other Backward Classes ) Rules , 1998 for direct recruitment posts for candidates belonging to Scheduled Castes , Scheduled Tribes and Other Backward Classes by the State Government from time to time , shall be reserved as per the guidelines issued regarding reservation . According to the Madhya Pradesh Public Service (Special Provisions for the Appointment of Women) Rules , 1997 , posts shall also be reserved for women candidates out of the available vacancies .

(4) While filling the vacancy so reserved , such candidates who are members of Scheduled Castes , Scheduled Tribes , Other Backward Classes and Economically Weaker Sections shall be considered for appointment in the same order in which their names appear in the list referred to in rule 12. No matter what the relative rank may be.

(5) If candidates belonging to Scheduled Castes , Scheduled Tribes and Other Backward Classes are not available in sufficient numbers to fill all the vacancies reserved for them , the vacancies shall not be filled by other candidates in any manner .

(6) The provision of reservation for ex - servicemen and physically handicapped persons by the Government shall be horizontal and compartment - wise . In case of the non - availability of a qualified candidate of ex- servicemen , the same may be filled from a candidate available in the same category .

(7) Circular No. F - 07-11 / 2019 /A.P . / one by General Administration Department , per the provision issued on July 02 , 2019 , ten percent of the persons required to be filled by direct recruitment shall be reserved for the Economically Weaker Sections ( EWS) .

(8) According to the instructions of the General Administration Department , 20 percent of the sanctioned direct recruitment posts shall be reserved for the employees appointed on contract .

(9) According to the instructions of the General Administration Department , 6 percent posts shall be reserved for disabled candidates .

12. List of candidates recommended by the Commission.- (1) The Commission of such candidates , who qualify at such a level as determined by the Commission and belong to Scheduled Castes , Scheduled Tribes , Other Backward Classes and Economically Weaker Sections , the Government shall forward the list prepared in the order of merit of the candidates , who have been declared eligible for appointment in the service by the Commission , keeping in due care to maintain the efficiency of the administration , even if the candidates do not qualify for that level . The list shall also be published for the information of the general public .

(2) Subject to the provisions of these rules and the Madhya Pradesh Civil Services ( General Conditions of Service) Rules , 1961 , the candidates shall be considered for appointment to the available vacancies in the order of their names appearing in the list .

(3) The inclusion of the name of a candidate in the list shall not confer any right on him to appointment unless the appointing authority is satisfied after such inquiry as it may consider necessary that the candidate is suitable in all respects for appointment to the service .

(4) The selection list issued by the Commission shall remain valid for a period of one year from the date of issue and which can be extended for a period of 6 months with the consent of the Commission .

13. Probation.- The person recruited in gazetted service shall be appointed for a period of 02 years .

14. Authority to take disciplinary action.-

(1 ) The Commissioner Medical Education Shall be Displine authority for Gazetted service as per the guidelines issued by the General Administration Department .

(

2) Appealent authority is administrative head against the order issued by the Commissioner Medical Education.

15. Appointment by promotion.-

(1) For the promotion of eligible candidates , a promotion committee shall be constituted consisting of the members as mentioned in Schedule - IV .

( 2) The Committee shall consider the cases of all the persons for the posts mentioned in Schedule - IV as per the instructions issued by the General Administration Department from time to time .

(3) The Committee shall meet at such intervals as the appointing authority may direct but the Committee shall normally meet at least twice a year .

of the year from which the promotion as specified in column (4) of Schedule - IV and which fall within the zone of consideration as per the provisions of sub- rule (2) :

Provided that the service of officers released from the emergency Commission and short- term service Commission shall be counted after their appointment from the date they were appointed according to the memorandum of the General Administration Department , No. 2266-1987 - A (33 ) -67 dated October 21 , 1967 , deemed to have been appointed to the service : Provided further that a junior person shall not be considered for promotion to superior grade / promotion by giving preference to a person senior to him merely on the ground that he has completed the prescribed service .

(5) The area for consideration for selection shall be generally limited to the number of employees to be included in the selection list from Class - II to Class - I on the basis of merit cum seniority and Class - III to Class- II will be done on basis of Seniority cum merit . The number of employees to be included in the selection list in respect of posts to be filled on the basis of seniority and merit ordinarily five times the number of employees : Provided that if a suitable number of officers are not available in the area so determined , then that area may be increased to the extent that the committee may consider necessary by mentioning the reasons in writing.

(6) Every appointing authority shall endorse a certificate to the effect that he has complied with the Madhya Pradesh Public Service ( Reservation for Scheduled Castes / Scheduled Tribes and Backward Classes ) Act , 1994 (No. 21 of 1994 ) , on the promotion order issued by him . And have followed the instructions issued by the General Administration Department under sub - sections of the rules issued from time to time .

16. Preparation of list of suitable officers.-

( 1 ) The Committee shall prepare a list of such persons who fulfil the condition prescribed in rule15 and who have been declared suitable by the Committee for promotion in the service . This list shall be sufficient to fill the anticipated vacancies due to retirement and promotion during one year from the date of preparation , a reserve list of twenty - five percent of the number of persons included in the above list shall be prepared during the above period to fill the unexpired vacancies .

(2) The selection to be made for the inclusion of names in such list shall be determined on the basis of merit and suitability in all respects with due regard to seniority .

At the time of preparation of each selection list , the names of the employee to be included in the list shall be arranged in order of seniority in the posts as specified in column (2 ) of Schedule- IV . (3)

Explanation.- A person whose name is included in the selection list , but who is not promoted during the validity of the list , does not, by the mere fact of his earlier selection , claim seniority over the persons considered in the subsequent selection that shall happen.

(4) The list thus prepared shall be reviewed and revised every year .

(5) If a member is proposed to be superseded during the selection , review or revision process , the Committee shall record its reasons for the proposed supersession .

17. Time Pay Scale.- Three level time pay scale shall be payable according to the eligibility in a sequence of the guidelines issued by the Finance Department from time to time .

Registration Council , it shall be understood that the consultation under sub - clause ( b) of clause (3) of article 320 of the Constitution .

19. Selection list.-

(1) The list as finally approved by the President , of the Madhya Pradesh Nurses Registration Council for the selection of service members from the posts mentioned in column (2) of Schedule - IV to the posts mentioned in column (3) of Schedule - IV .

(2) The selection list shall ordinarily remain in force until it is reviewed or revised as per sub - rule (4 ) of rule 15 but its validity shall not be extended beyond a total period of 18 months from the date of preparation of such list : Provided that in case of a serious lapse in conduct or discharge of duties on the part of any person included in the selection list , the selection list may be specially reviewed by the recommendation of the Government and the Chairman , Madhya Pradesh Nurses Registration Council and if it deems fit , it may remove the name of the person from the selection list .

20. Appointment to service from the selection list.-

(1 ) The employee included in the selection list appointment to the posts coming under the service cadre shall be done in the same order in which the names of such employees appear in the selection list :

Provided that where it is required to do so on account of administrative exigencies , the person whose name is not included in the selection list or whose name is not placed immediately below in the order given in the selection list may be appointed to the service if the Government is satisfied on inquiry that the vacancy is not likely to continue for more than three months .

(2) Any person whose name is included in the selection list of the service . It shall not ordinarily be necessary to consult the Commission before appointment to the service unless there has been a deterioration , in his 384(27)

performance during the period between the inclusion of his name in the selection list and the date of his proposed appointment in the opinion of the Government , such as to render him unfit for appointment to the service .

21. Interpretation . If any question arises in relation to the interpretation of these rules , it shall be referred to the Government , whose decision thereon shall be final .

22. Relaxation.- Nothing in these rules shall be construed in the case of any person to whom these rules apply , limits or abridge the power of the Governor to act in such manner as may appear to him to be just and equitable :

Provided that no case shall be dealt with in a manner less favourable to him than that provided in these rules .

23. Savings.- Nothing in these rules shall affect the reservation and corresponding conditions required to be provided for the Scheduled Castes and the Scheduled Tribes in accordance with the orders issued by the State Government from time to time in this regard .

24. Repeal . All rules corresponding to these rules and in force immediately before the commencement of these rules are hereby repealed in respect of the matters covered by these rules .

राज्य शासन, एतद्द्वारा , उपचारिका, प्रसाविका, सहायी उपचारिका-प्रसाविका तथा स्वास्थ्य परिदर्शक रजिस्ट्रीकरण अधिनियम, 1972 (क्रमांक 46 सन् 1973 ) की धारा 24 के साथ पठित धारा 33 की उप धारा (1 ) द्वारा प्रदत्त शक्तियों और उसके निमित्त उसे समर्थ बनाने वाली समस्त शक्तियों को प्रयोग में लाते हुए 'मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल ' के लिए सेवा में भर्ती तथा सेवा शर्तों से संबंधित निम्नलिखित नियम बनाते है, अर्थात्ः-

नियम

1. संक्षिप्त नाम तथा प्रारंभ-

(1 ) इन नियमों का संक्षिप्त नाम मध्यप्रदेश चिकित्सा शिक्षा विभाग मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल अराजपत्रित सेवा भर्ती नियम, 2023 है ।

(2) ये नियम " मध्यप्रदेश राजपत्र" में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. परिभाषाएं- इन नियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न हो, -

(क) सेवा या पद के संबंध में " नियुक्ति प्राधिकारी से अभिप्रेत है, शासन या ऐसा अधिकारी जिसे इस सेवा या पद पर नियुक्ति करने की शक्ति है;

(ख) " मण्डल" से अभिप्रेत है, मध्यप्रदेश कर्मचारी चयन मण्डल;

(ग) "अध्यक्ष" से अभिप्रेत है, अध्यक्ष, मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल (पदेन संचालक, चिकित्सा शिक्षा) ;

(घ) " समिति" से अभिप्रेत है, चयन समिति / विभागीय पदोन्नति समिति / छानबीन समिति;

(ड. ) " आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस.)" से अभिप्रेत है, जो संविधान के अनुच्छेद-341 एवं 342 के अन्तर्गत मध्यप्रदेश राज्य के लिए अधिसूचित अनुसूचित जाति एवं अनुसूचित जनजाति को प्रदत्त आरक्षण की परिधि में नहीं आते हैं;

(च ) " परीक्षा" से अभिप्रेत है प्रतियोगी परीक्षा जो कि सेवा में भर्ती के लिए नियम 11 के अधीन ली जाती है ;

(छ) " भूतपूर्व सैनिक" से अभिप्रेत है, ऐसा व्यक्ति, जो निम्नलिखित प्रवर्गों में से किसी एक प्रवर्ग में रहा हो तथा जो भारत सरकार के अधीन कम से कम छह माह की निरन्तर कालावधि तक सेवा में नियोजित रहा हो तथा जिसकी किसी भी रोजगार कार्यालय में अपना पंजीयन कराने अथवा शासकीय सेवा में नियुक्ति हेतु अन्यथा आवेदन देने की तारीख से अधिक से अधिक 3 वर्ष पूर्व मितव्ययिता इकाई की सिफारिशों के फलस्वरूप या अथवा स्थापना में सामान्य रूप से कमी किए जाने के कारण छंटनी की गयी हो अथवा जो अतिशेष (सरप्लस ) घोषित किया गया हो, -

(1 ) ऐसे भूतपूर्व सैनिक जिन्हें सेवा निवृत्ति रियायतों (मस्टरिंग आउट कन्सेशन ) के अधीन निर्मुक्त कर दिया गया हो,

(3) ऐसे भूतपूर्व सैनिक , जिन्हें दूसरी बार नामांकित किया गया हो , और

(क) अल्पकालीन वचनबंध अवधि पूर्ण होने पर;

(ख) नामांकन संबंधी शर्तें पूर्ण होने पर

सेवोन्मुक्त किया गया हो,

(झ) "राज्यपाल" से अभिप्रेत है, मध्यप्रदेश के राज्यपाल;

(ञ) " अन्य पिछडा वर्ग " से अभिप्रेत है, राज्य सरकार द्वारा समय - समय पर यथा संशोधित अधिसूचना क्रमांक एफ- 8-5- पच्चीस-4-84 , दिनांक 26 दिसम्बर, 1984 द्वारा यथा संशोधित नागरिकों के अन्य पिछडे वर्ग;

(ट) "निर्धारित संस्था" से अभिप्रेत है कि मध्यप्रदेश शासन के अधीन ऐसी संस्था जिसके माध्यम से प्रतियोगी परीक्षा आयोजित की जाती है;

(ड) "अनुसूची" से अभिप्रेत है इन नियमों से संलग्न अनुसूची;

(ढ) " अनुसूचित जाति" से अभिप्रेत है कोई जाति मूलवंश या जनजाति अथवा कोई जाति, मूलवंश या जनजाति का भाग या उसमें का यूथ, जिसे भारत के संविधान के अनुच्छेद 341 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जाति के रूप में विनिर्दिष्ट किया गया है;

(ण ) ' अनुसूचित जनजाति से अभिप्रेत है, कोई जनजाति मूलवंश या जनजाति समुदाय या ऐसी जनजाति समुदाय का भाग या उसमें का यूथ, जिसे भारत के संविधान के अनुच्छेद 342 के अधीन मध्यप्रदेश राज्य के संबंध अनुसूचित जनजाति रूप में विनिर्दिष्ट किया गया है;

(त) "सेवा" से अभिप्रेत है मध्यप्रदेश चिकित्सा शिक्षा विभाग , मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल अराजपत्रित सेवा ।

3. विस्तार तथा लागू होना .- मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्ते) नियम, 1961 में अंतविष्ट उपबंधनों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना ये नियम सेवा के प्रत्येक सदस्य पर लागू होंगे ।

4. सेवा का गठन. - सेवा में निम्नलिखित व्यक्ति होंगे , अर्थात्ः -

(1 ) वे व्यक्ति जो इन नियमों के प्रारम्भ होने के समय अन्तर्गत अनुसूची- एक में विर्निदिष्ट किसी भी पद को मूलतः या स्थानापन्न रूप में धारण कर रहें हो;

(2) वे व्यक्ति जो मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल सेवा अराजपत्रित सेवा भर्ती नियम, 2023 के उपबंधो के अनुसार सेवा में भर्ती किए गए हो ।

5. वर्गीकरण , वेतनमान आदि. -

(1 ) सेवा का वर्गीकरण , वेतनमान तथा सेवा में सम्मिलित पदों की संख्या अनुसूची - एक में अंतर्विष्ट उपबंधों के अनुसार होगीः

6. भर्ती का तरीका.-

(क) सीधी भर्ती द्वारा, चयन या प्रतियोगिता परीक्षा द्वारा या दोनों द्वारा;

(ख ) सेवा के सदस्यों की पदोन्नति द्वारा;

(ग) अन्य पदों या सेवाओं से व्यक्तियों के स्थानांतरण / संविलियन / प्रतिनियुक्ति द्वारा जैसा कि राज्य शासन समय - समय पर अवधारित करे ।

(2) मध्यप्रदेश शासन, चिकित्सा शिक्षा विभाग के अंतर्गत संचालित स्वशासी /शासकीय चिकित्सा महाविद्यालयों में कार्यरत अराजपत्रित संवर्ग के नर्सिंग , सह- चिकित्सीय , अलिपिकीय संवर्ग के पदों पर सीधी भर्ती में इनके अनुभवों का लाभ दिया जाएगा;

(3) उपनियम (1 ) के खण्ड (ख) के अधीन भर्ती किए गए व्यक्तियों की संख्या किसी भी समय (अनुसूची - एक में यथा विर्निदिष्ट) कर्तव्य पदों की संख्या की अनुसूची- दो में अंतर्विष्ट उपबंधों के अनुसार होगी;

(4) मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल अराजपत्रित सेवा भर्ती नियम , 2023 के उपबंधों के अध्यधीन रहते हुए भर्ती की किसी भी विशेष कालावधि के दौरान भरे जाने के लिए अपेक्षित सेवा में की किसी भी विशेष रिक्ति या रिक्तियों को भरने के प्रयोजन के लिए अपनाया जाने वाला भर्ती का तरीका या तरीके तथा प्रत्येक तरीके द्वारा भर्ती किए जाने वाले व्यक्तियों की संख्या प्रत्येक अवसर पर शासन द्वारा अवधारित की जाएगी;

(

5) उपनियम (1 ) में अन्तर्विष्ट किसी बात के होते हुए भी यदि शासन की राय में सेवा की आवश्यकताओं को देखते हुए यदि आवश्यक हो तो सामान्य प्रशासन विभाग की पूर्व सहमति से उक्त उप नियम में विनिर्दिष्ट सेवा में ऐसे पदों की भर्ती के तरीकों से भिन्न ऐसे अन्य तरीके अपना सकेगी, जो वह इस निमित जारी किए गए आदेश द्वारा विहित किए गए हों ।

7. सेवा में नियुक्ति.-

इन नियमों के प्रारंभ होने के पश्चात् सेवा में समस्त नियुक्तियां , नियुक्ति प्राधिकारी द्वारा की जाएंगी और ऐसी कोई भी नियुक्ति नियम 6 में विनिर्दिष्ट भर्ती के तरीकों में से किसी एक तरीके द्वारा चयन किए जाने के बाद ही की जाएगी अन्यथा नहीं ।

सीधी भर्ती की पात्रता की शर्ते.-

सीधी भर्ती से चयन किए जाने / प्रतियोगिता परीक्षा में भाग लेने के लिए पात्र होने हेतु अभ्यर्थी को निम्नलिखित शर्ते पूरी करनी होंगी , अर्थात् :-

(1) आयुः-

न्यूनतम आयु, अधिकतम आयु एवं अधिकतम आयु सीमा में छूट ऐसी होगी जैसा कि राज्य शासन द्वारा समय- समय पर सामान्य प्रशासन विभाग द्वारा जारी दिशा निर्देशों के अनुसार अवधारित किया जाए ।

(2) शैक्षणिक अर्हताएं: -

अभ्यर्थी के पास सेवा के लिए विहित की गई ऐसी शैक्षणिक अर्हताएं एवं अन्य अर्हताएं होनी चाहिये जो कि अनुसूची-तीन में अंतर्विष्ट उपबंधों के अनुसार होंगीः

परन्तु आयोग / नियुक्ति प्राधिकारी अपने विवेकाधिकार पर ऐसे अभ्यर्थियों को जो अन्यथा अर्ह हैं किन्तु जिन्होंने ऐसी अन्य संस्थाओं से जो सरकार द्वारा विनिर्दिष्ट रूप से मान्यता प्राप्त नहीं है, या विदेशी विद्यालयों से मध्यप्रदेश राजपत्र, दिनांक 16 जून 2023

उपाधियां धारण करते हैं और जिसे परीक्षा / चयन के प्रवेश के लिए योग्य समझा जाता हो , पर भी विचार कर सकेगा ।

फीस.-

(3)

अभ्यर्थी को नियुक्ति प्राधिकारी / मण्डल / शासन द्वारा समय - समय पर यथा पुनरीक्षित फीस का संदाय करना होगा ।

निरहर्ता.-

(1 ) अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिए किसी भी साधन से समर्थन प्राप्त करने के किसी भी प्रयास को नियुक्ति प्राधिकारी / मण्डल / शासन द्वारा परीक्षा / चयन के लिए निरर्हता के रूप में माना जाएगा ।

(3 ) कोई भी अभ्यर्थी, जिसकी 2 से अधिक संतान हों, जिसमें से 1 का जन्म 26 जनवरी , 2001 को अथवा उसके पश्चात् हुआ हो, किसी सेवा या पद पर नियुक्ति के लिए पात्र नहीं होगा , बशर्ते कि दूसरी संतान जुड़वां न हो ।

(4) कोई भी अभ्यर्थी , जिसे महिलाओं के विरूद्ध किसी अपराध का सिद्धदोष ठहराया गया हो सेवा के लिए पात्र नहीं होगाः

(5) कोई भी अभ्यर्थी, जिसकी एक से अधिक जीवित पत्नि हो और कोई भी महिला अभ्यर्थी जिसने ऐसे व्यक्ति से विवाह किया है , जिसकी पहले से ही एक पत्नि जीवित हो, सेवा के लिए अपात्र होगा ।

(6) ऐसा कोई , कारण जो राज्य शासन द्वारा विहित किया जाए ।

अभ्यर्थी की पात्रता के संबंध में मण्डल का विनिश्चय अंतिम होगा.-

चयन परीक्षा में प्रवेश हेतु ग्राहय किए जाने के लिए अभ्यर्थी की पात्रता या अपात्रता संबंध में मण्डल का विनिश्चय अंतिम होगा और अभ्यर्थी को जिसे मण्डल द्वारा प्रवेश प्रमाण- पत्र जारी नहीं किया गया हैं मण्डल द्वारा परीक्षा हेतु उसका साक्षात्कार नहीं लिया जाएगा / उसे परीक्षा हेतु ग्राहय नहीं किया जाएगा ।

11. चयन / प्रतियोगी परीक्षा सीधी भर्ती.-

(1 ) सेवा में सीधी भर्ती के लिए मण्डल द्वारा परीक्षा ऐसे आदेशों के अनुसार ली जाएगी जो कि शासन समय - समय पर जारी करे ।

(2) यदि शासन चयन से सीधी भर्ती करने का निर्णय लेती है तो मण्डल चयन द्वारा सीधी भर्ती कर सकेगा ।

(3) सीधी भर्ती के लिए मध्यप्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़ा वर्ग के लिए आरक्षण ) नियम, 1998 के उपबंधों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति तथा अन्य पिछड़ा वर्ग के अभ्यर्थियों के लिए पद राज्य शासन द्वारा समय - समय पर आररक्षण के संबंध में जारी दिशा-निर्देशों के अनुसार आरक्षित रखे जाएंगे । उपलब्ध रिक्तियों में से मध्यप्रदेश सिविल सेवा (महिलाओं की नियुक्ति के लिए विशेष उपबंध ) नियम, 1997 के अनुसार महिला अभ्यर्थियों के लिए भी पद आरक्षित रखे जाएंगे ।

(4) इस प्रकार रक्षित रिक्त स्थानों को भरते समय ऐसे अभ्यर्थियों की जो कि अनुसूचित जातियों, अनुसूचित जनजाति, अन्य पिछड़े वर्गो तथा आर्थिक रूप से कमजोर वर्ग के सदस्य है कि नियुक्ति के लिए उसी क्रम में विचार किया जाएगा जिसमें कि उनके नाम नियम 12 में निर्दिष्ट सूची में आये हो , चाहे उनका सापेक्षित रैंक कुछ भी क्यों न हो ।

(5) यदि अनुसूचित जातियों, अनुसूचित जनजातियों एवं अन्य पिछड़ा वर्ग के अभ्यर्थी, उनके लिए आरक्षित सभी रिक्तियों को भरने के लिए पर्याप्त संख्या में उपलब्ध न हों तो शेष रिक्तियां किसी भी रीति से अन्य अभ्यर्थियों से नहीं भरी जाएंगी ।

(6) शासन द्वारा भूतपूर्व सैनिक एवं शारीरिक रूप से दिव्यांगजनों/ निःशक्तजनों के लिए आरक्षण के उपबंध होरीज़न्टल (क्षैतिज) एण्ड कम्पार्टमेंट वाइज होंगे । भूतपूर्व सैनिक के अहर्ताधारी अभ्यर्थी उपलब्ध न होने पर उसी श्रेणी में उपलब्ध अभ्यर्थी से पूर्ति की जा सकेगी ।

(7) सामान्य प्रशासन विभाग द्वारा परिपत्र क्रमांक एफ-07-11 / 2019 / आ.प्र. / एक दिनांक 02 जुलाई , 2019 में जारी प्रावधान अनुसार सीधी भर्ती से भरे जाने वाले अपेक्षित व्यक्तियों की संख्या के दस प्रतिशत पद आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस .) हेतु आरक्षित होंगे ।

(8) सामान्य प्रशासन विभाग के निर्देशानुसार संविदा पर नियुक्त कर्मचारी हेतु स्वीकृत सीधी भर्ती के पदों में से 20 प्रतिशत आरक्षित रहेंगे ।

(9) सामान्य प्रशासन विभाग के निर्देशों के अनुसार विकलांग अभ्यर्थियों के लिए पद आरक्षित रखे जाएंगे ।

12. मण्डल द्वारा अनुशंसित किए गए अभ्यर्थियों की सूची.-

(1) मण्डल ऐसे अभ्यर्थियों की जो ऐसे स्तर से जैसा कि मण्डल अवधारित करें अर्हता रखता हो तथा अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग एवं आर्थिक रूप से कमजोर वर्ग के ऐसे अभ्यर्थियों की जो यद्यपि उस स्तर से अर्हिता न हों फिर भी प्रशासन की दक्षता बनाए रखने का सम्यक ध्यान रखते हुए मण्डल द्वारा सेवा में नियुक्ति के लिए योग्य घोषित किए गए हों अभ्यर्थियों की योग्यता के क्रम से बनाई गई सूची शासन को अग्रेषित करेगा । सूची सर्वधारण की जानकारी के लिए भी प्रकाशित की जाएगी ।

(2) इन नियमों तथा मध्यप्रदेश सिविल सेवा ( सेवा की सामान्य शर्ते) नियम , 1961 के उपबंधों के अध्यधीन रहते हुए उपलब्ध रिक्त स्थानों पर सूची में आए उनके नामों के क्रम से अभ्यर्थियों की नियुक्ति के लिए विचार किया जाएगा ।

(3 ) सूची में किसी अभ्यर्थी का नाम सम्मिलित किया जाना उसे नियुक्ति का कोई अधिकार तब तक प्रदान नहीं करता जब तक कि नियुक्ति प्राधिकारी का ऐसी जांच करने के पश्चात् जैसा कि वह आवश्यक समझे यह समाधान न हो जाए कि अभ्यर्थी सेवा में नियुक्ति के लिए सभी प्रकार से उपयुक्त है ।

(4) मण्डल द्वारा जारी चयन सूची, जारी किए जाने की तारीख से एक वर्ष तक की कालावधि के लिए विधिमान्य रहेगी तथा जिसे मण्डल की सहमति से 6 माह की कालावधि के लिए बढाया जा सकेगा ।

परिवीक्षा.-

13.

(1 ) अराजपत्रित सेवा में भर्ती किए गए अभ्यर्थी को 03 वर्ष की कालावधि के लिए परिवीक्षा पर नियुक्त किया जाएगा ।

(2 ) अराजपत्रित पद पर नियुक्त व्यक्ति को परिवीक्षा अवधि में उस पद के वेतनमान के न्यूनतम का प्रथम वर्ष 70 प्रतिशत, द्वितीय वर्ष 80 प्रतिशत एवं तृतीय वर्ष में 90 प्रतिशत राशि, स्टायपेंड के रूप में देय होगी । परिवीक्षा अवधि सफलता पूर्वक पूर्ण करने पर वेतनमान में पूर्ण वेतन दिया जाना प्रारंभ किया जाएगा ।

14. अनुशासनात्मक कार्यवाही करने के प्राधिकार. -

(1 ) अराजपत्रित के लिए सामान्य प्रशासन विभाग द्वारा जारी दिशा निर्देशों के अनुसार अध्यक्ष , मध्यप्रदेश नर्सिंग कौंसिल , अनुशासनिक प्राधिकारी होंगे ।

(2) अपीलः-

(अ) अध्यक्ष , मध्यप्रदेश नर्सिंग कौंसिल द्वारा जारी आदेश के विरूद्ध प्रथम अपीलीय प्राधिकारी आयुक्त चिकित्सा शिक्षा होंगे ।

15. पदोन्नति द्वारा नियुक्ति.-

(1 ) पात्र अभ्यर्थियों की पदोन्नति के लिए अनुसूची- चार में यथा उल्लेखित सदस्यों से मिलकर एक पदोन्नति समिति गठित की जाएगी ।

(2) समिति, सामान्य प्रशासन विभाग द्वारा समय - समय पर जारी किए गए निर्देशों के अनुसार अनुसूची- चार में उल्लेखित पदों के लिए समस्त व्यक्तियों के मामलों पर विचार करेगी ।

परन्तु आपातकालीन कमीशन तथा अल्पकालीन सेवा कमीशन से निर्मुक्त किए गए अधिकारियों की सेवा की गणना उनकी नियुक्ति के पश्चात् से की जाएगी जिस तारीख से उन्हें सामान्य प्रशासन विभाग के ज्ञापन क्रमांक 2266-1987- एक (33)-67 तारीख 21 अक्टूबर 1967 के अनुसार सेवा में नियुक्त किया समझा गया होः

(5) चयन के लिय विचारार्थ क्षेत्र चयन सूची में सम्मिलित किए जाने वाले अधिकारियों / कर्मचारियों की संख्या में साधारणतः तृतीय श्रेणी से द्वितीय श्रेणी , तृतीय श्रेणी से तृतीय श्रेणी के लिए वरिष्ठता तथा सह- योग्यता के आधार पर सीमित होगा और चयन सूची में सम्मिलित किए जाने वाले कर्मचारियों की मध्यप्रदेश राजपत्र, दिनांक 16 जून 2023

संख्या के साधारणतः वरिष्ठता तथा योग्यता के आधार पर भरे जाने वाले पदों के संबंध में पांच गुना तक सीमित होगाः

(6) प्रत्येक नियुक्ति प्राधिकारी उसके द्वारा जारी किए जाने वाले पदोन्नति आदेश पर इस आशय के प्रमाण -पत्र का पृष्ठांकन करेगा कि उसने मध्यप्रदेश लोक सेवा (अनुसूचित जाति / अनुसूचित जनजातियों और पिछड़े वर्गों के लिए आरक्षण) अधिनियम, 1994 (क्रमांक 21 सन् 1994 ) तथा सामान्य प्रशासन विभाग द्वारा समय - समय पर जारी नियमों के उप खण्डों के अधीन जारी किए जाएं अनुदेशों का पालन किया है ।

16. उपयुक्त अभ्यर्थियों की सूची तैयार करना.-

(3) प्रत्येक चयन सूची को तैयार करते समय सूची में सम्मिलित किए जाने वाले कर्मचारियों के नाम अनुसूची चार के कॉलम (2) में यथा विनिर्दिष्ट पदों में वरिष्ठता के क्रम में रखे जाएंगे ।

(5) यदि इस प्रकार के चयन, पुनर्विलोकन या पुनरीक्षण की प्रक्रिया के दौरान किसी सदस्य को अधिक्रमित किए जाने का प्रस्ताव किया जाता है तो समिति प्रस्तावित अधिक्रमण के संबंध में अपने कारणों को लेखबद्ध करेगी ।

समयमान वेतनमान.-

17.

वित विभाग द्वारा समय- समय पर जारी दिशा निर्देशों के अनुक्रम में तीन स्तरीय समयमान वेतनमान पात्रता अनुसार देय होगा ।

18. पदोन्नति हेतु अराजपत्रित तृतीय एवं चतुर्थ श्रेणी कर्मचारियों के लिए गठित विभागीय पदोन्नति समिति , अध्यक्ष , मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल की अध्यक्षता में सिफारिश के संबध में यह समझा जाएगा कि संविधान के अनुच्छेद 320 के खण्ड (3 ) के उपखण्ड (ख ) के अधीन परामर्श करने संबंधी अपेक्षा का अनुपालन हो गया है ।

19. चयन सूची.-

(1 ) अध्यक्ष , मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल द्वारा अंतिम रूप से अनुमोदित की गई सूची अनुसूची- चार के कॉलम (2) में दर्शाये गए पदों से अनुसूची- चार के कॉलम (3) में दर्शाये पदों पर सेवा के सदस्यों की पदोन्नति के लिए चयन सूची होगी ।

परन्तु चयन सूची में सम्मिलित किसी व्यक्ति की ओर से आचरण या कर्तव्यों के निर्वहन में गंभीर चूक होने की दशा में शासन तथा अध्यक्ष, मध्यप्रदेश नर्सेस रजिस्ट्रेशन कौंसिल की प्रेरणा द्वारा चयन सूची का विशेष रूप से पुनर्विलोकन किया जा सकेगा और यदि वह उचित समझे, ऐसे व्यक्ति का नाम चयन सूची से हटा सकेगा ।

20. चयन सूची से सेवा में नियुक्ति. -

(1) चयन सूची में सम्मिलित कर्मचारी की सेवा संवर्ग के अंतर्गत आने वाले पदों पर नियुक्ति उसी क्रम से की जाएगी जिस क्रम में ऐसे कर्मचारी के नाम चयन सूची में होंः मध्यप्रदेश राजपत्र, दिनांक 16 जून 2023

परन्तु जहां प्रशासकीय अत्यावश्यकता के कारण ऐसा करना अपेक्षित हो वहां उस व्यक्ति को जिसका नाम चयन सूची में सम्मिलित नहीं हो या जिसका नाम चयन सूची में दिए गए क्रम में ठीक नीचे न हो सेवा में नियुक्त किया जा सकेगा यदि शासन का यह समाधान हो जांच कि रिक्ति के तीन मास से अधिक समय तक चलने की संभावना नहीं है ।

(2) ऐसे किसी व्यक्ति की जिसका नाम सेवा की चयन सूची में सम्मिलित है सेवा में नियुक्ति के पूर्व मण्डल से परामर्श करना सामान्यतः तब तक आवश्यक नहीं होगा जब तक कि चयन सूची में उसका नाम सम्मिलित किए जाने तथा प्रस्तावित नियुक्ति की तारीख के बीच की कालावधि के दौरान उसके कार्य में ऐसी कोई गिरावट न आ गई हो जो शासन की राय में ऐसी हों जिससे वह सेवा में नियुक्ति के लिए अनुपयुक्त हो गया हो ।

इन नियमों में की गई कोई भी बात अनुसूचित जातियों तथा अनुसूचित जनजातियों के लिए राज्य शासन द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार उपबंध किए जाने के लिए अपेक्षित आरक्षण तथा अनुरूप शर्तों को प्रभावित नहीं करेगी ।

In exercise of the powers conferred by section 33 read with section 24 of the Madhya Pradesh Upcharika , Prasavika , Sahai Upcharika Prasavika Tatha Swasthya Paridarshak Registrikaran Adhiniyam , 1972 ( No. 46 of 1973 ) , the Governor of Madhya Pradesh , hereby , makes the following rules relating to recruitment and service conditions for the Madhya Pradesh Nurses Registration Council , Non- Gazetted , Service Recruitment Rules , 2023 , namely: -

RULES

Short title and commencement.- 1.

( 1) These rules may be called the Madhya Pradesh Medical Education Department , ( Madhya Pradesh Nurses Registration Council , Recruitment Rules , 2023 ) . Non-Gazetted , Service (2) These rules shall come into force from the date of their publication in the Madhya Pradesh Gazette .

2. Definitions . In these rules , unless the context otherwise requires , -

( a) "Appointing Authority " in relation to a service or post , means the Government or such officer empowered to make appointments to that service or post ;

"Board" means Madhya Pradesh Staff Selection Board; (b)

(c) " Chairman " means the President , Madhya Pradesh Nurses Registration Council ( ex - officio Director , Medical Education) ;

(d) "Committee " Departmental Committee; means Selection Committee/ Promotion Committee/ Scrutiny

a (e) "Economically weaker Section ( EWS ) " means citizen who does not come under any reserve category such as Scheduled Castes and Scheduled Tribes as per General Administration Department's circular No.F - 07- 11/2019/ आ.प्र./ one dated 2nd July, 2019 ;

(f) "Examination " means the competitive examination conducted for recruitment to the service , as mentioned under rule 11 ;

(g) "Ex - Serviceman " means a person who belongs to any of the following categories and who was employed under the Government of India for a continuous period of not less than six months and who was retrenched or declared surplus as a result of the recommendation of the economy unit or due to normal reduction in establishment not more than 3 years before the date of his registration at any Employment Exchange or of application made otherwise for employment in Government Service-

(1) ex- serviceman released under mustering out concession;

(2) ex - serviceman who was employed more than six months continuously in army of country and not released due to any misconduct ;

(3) ex- serviceman enrolled for the second time and discharged on-

(a) completion of short term engagement ;

(b) fulfilling the conditions of enrollment;

(4) ex- personnel of Madras Civil Units ;

(5) officer discharged after working for more than six months continuously against leave vacancies ;

(6) ex - serviceman who are medically boarded out on account of gunshot , wounds etc. or they are unlikely to become efficient soldiers ;

(h) "Government " means the Medical Education Department , Government of Madhya Pradesh ;

(i) "Governor " means the Governor of Madhya Pradesh ;

(j ) "Other Backward Classes " means the Other Backward Classes of citizens as specified by the State Government vide Notification F - 8-5 - XXV - 4-84 , dated 26 December , 1984 , as amended from time to time ;

(k) "Prescribed Institution " means such institution under the Government of Madhya Pradesh through which competitive examination is conducted ;

(1) " Reservation for disabled and women" means the reservation which shall be according to the circular issued by the General Administration Department from time to time ;

(m) " Schedule " means the Schedule appended to these rules;

( 0 ) " Scheduled Tribes " means any tribal origin or tribal community or part of or group within such tribal community , which has been specified as a Scheduled Tribe in relation to the State of Madhya Pradesh under article 342 of the Constitution of India ;

(p) " Service " means Madhya Pradesh Medical Education Department , Madhya Pradesh Nurses Registration Council Service Non - Gazetted .

4. Constitution of the Service . The service shall consist of the following persons , namely: -

(1) Persons who , at the time of commencement of these rules , are holding any of the posts specified in Schedule- I either substantively or officiating .

(2) Persons who are recruited in service in accordance with the provisions of the Madhya Pradesh Nurses Registration Council Service Non- Gazetted Service Recruitment Rules , 2023 .

5. Classification , scale of pay , etc.-

( 1 ) The classification , scale of pay and number of posts included in the service shall be in accordance with the provisions contained in Schedule - I:

Provided that the Government may permanently or temporarily increase or decrease the number of posts included in the service from time to time .

6 . Method of recruitment.-

(1) Recruitment to the service after these rules come into force shall be done in the following ways , namely: - (a) by direct recruitment , by selection or by competitive examination or by both ;

(b) by promotion of the members of the service .

(2) The benefits of their experiences shall be given in direct recruitment to the posts of non - gazetted cadre nursing , co - medical and non - medical cadre working in autonomous / government medical colleges operated under the Medical Education Department , Government ofMadhya Pradesh .

(3) The number of persons admitted under clause (b) of sub - rule ( 1 ) , number of duty posts ( as specified in Schedule - I ) at any point of time shall be in accordance with the provisions specified in Schedule II .

(4) Subject to the provisions of the Madhya Pradesh Nurses Registration Council Non - Gazetted / Associated Services Recruitment Rules , 2023 , adopted for the purpose of filling any particular vacancy or vacancies in the service required to be filled during any particular period of recruitment , the method or methods of recruitment to be made and the number of persons to be recruited by मध्यप्रदेश राजपत्र, दिनांक 16 जून 2023

each method shall be determined by the Government on each occasion .

(5) Notwithstanding anything contained in sub - rule ( 1 ) , if in the opinion of the Government , keeping in view the requirements of the service , such posts in the service as may be specified in the said sub - rule , if necessary , with the prior consent of the General Administrative Department , may adopt such other recruitment methods as prescribed by an order issued on this behalf.

8. Eligibility conditions for direct recruitment.- In order to be eligible to be selected through direct recruitment/ to appear in the competitive examination , the candidate must fulfil the following conditions :

( 1 ) Age- Relaxation in minimum age and maximum age limit shall be such as may be determined by the State Government from time to time as per the guidelines issued by the General Administration Department .

(2) Educational Qualifications- The candidate must possess such educational qualifications as may be prescribed for the service , which shall be in accordance with the provisions contained in Schedule - III : Provided that the Commission /Appointing Authority may , at its discretion , appoint candidates who are otherwise qualified but hold Degrees from other Institutions not specifically recognized by the Government or from foreign schools , who are not eligible for admission to the examination / selection .

(3) Fee - The candidate shall have to pay the fee as revised from time to time by the Appointing Authority / Board / Government .

9. Disqualifications.-

(1) Support on the part of the candidate for his / her candidature by any means or any attempt to obtain shall be treated as disqualification for the examination / selection by the Appointing Authority / Board / Government . a

(2) No candidate , who has married before the minimum age fixed for marriage , shall be eligible for appointment to any service or post .

(3) Any candidate who has more than 2 children , 1 of whom is born on or after January 26 , 2001 , in any service or post shall not be eligible for appointment , provided the second child is not a twin .

(4) Any appointed candidate who has been convicted of any crime against women , shall not be eligible for service : Provided that a criminal case is pending against a person in a court of law , his appointment shall be kept pending until the criminal case is decided .

(5) Any candidate who has more than one wife living and any female candidate who is married to a person who already has a wife alive , will be ineligible for service .

10. Decision of the Board regarding the eligibility of the candidate shall be final . The decision of the Board regarding the eligibility or ineligibility of the candidate to be accepted for admission through the selection test shall be final and the candidate to whom the admission certificate has not been issued by the Board shall not be interviewed by the Board for the examination / shall not be admitted for the examination .

/competitive 11. Direct recruitment by selection examination.-

(1) The examination for direct recruitment to the service shall be conducted by the Board in accordance with such orders as may be issued by the Government from time to time .

(2) If the Government decides to make direct recruitment by selection , then the division may make direct recruitment by selection .

(3) According to the provisions of the Madhya Pradesh Public Service (Reservation for Scheduled Castes , Scheduled Tribes and Other Backward Classes ) Rules , 1998 , for direct recruitment posts for candidates belonging to Scheduled Castes , Scheduled Tribes and Other Backward Classes by the State Government from time to time , shall be reserved as per the guidelines issued regarding reservation . According to the Madhya Pradesh Public Service ( Special Provisions for the Appointment of Women ) Rules , 1997 , posts shall also be reserved for women candidates out of the available vacancies .

(4) While filling the vacancy so reserved , such candidates who are members of Scheduled Castes Scheduled Tribes , Other Backward Classes , and Economically Weaker Sections shall be considered for appointment in the same order in which their names appear in the list referred to in rule 12. No matter what the relative rank may be .

(6) The provision of reservation for ex - servicemen and physically handicapped persons by the Government shall be horizontal and compartment- wise . In case of 384(57)

the non - availability of a qualified candidate of ex- servicemen , the same may be filled from a candidate available in the same category .

(7) Circular No. F - 07-11 / 2019 /Α.Ρ. / one by General Administration Department , as per the provision issued on July 02 , 2019 , ten percent of the number of persons required to be filled by direct recruitment shall be reserved for the Economically Weaker Sections (EWS) .

(8) According to the instructions of the General Administration Department , 20 percent of the sanctioned direct recruitment posts shall be reserved for the employees appointed on contract .

(9) According to the instructions of the General Administration Department , 6 percent posts shall be reserved for disabled candidates .

12. List of candidates recommended by the Commission / Board.-

(1) The Board of such candidates , who qualify at such a level as determined by the Board and belong to Scheduled Castes , Scheduled Tribes , Other Backward Classes and Economically Weaker Sections , the government shall forward the list prepared in the order of merit of the candidates who have been declared eligible for appointment in the service by the Board , keeping in due care to maintain the efficiency of the administration , even if the candidate does not qualify for that level . The list shall also be published for the information of the general public .

(2) Subject to the provisions of these rules and the Madhya Pradesh Civil Services (General Conditions of Service) Rules , 1961 , the candidates shall be considered for appointment to the available vacancies in the order of their names appearing in the list .

( 3) The inclusion of the name of a candidate in the list shall not confer any right on him to appointment unless the मध्यप्रदेश राजपत्र, दिनांक 16 जून 2023

appointing authority is satisfied after such inquiry as it may consider necessary that the candidate is suitable in all respects for appointment to the service .

(4) The selection list issued by the Board shall remain valid for a period of one year from the date of issue and which can be extended for a period of 6 months with the consent of the Board .

13. Probation.-

(1) The person recruited in non - gazetted service shall be on probation for a period of 03 years .

(2) A person appointed on a non - gazetted post shall be paid 70 percent of the minimum pay scale of that post in the first year , 80 percent in the second year , and 90 percent in the third year as a stipend during the probation period . On successful completion of the probation period full pay in the pay scale shall be started .

14. Authority to take disciplinary action.-

(1) As per the guidelines issued by the General Administration Department for non- gazetted , the President of Madhya Pradesh Nursing Council shall be the disciplinary authority .

(2) Appeal- against the order issued by the President , Madhya Pradesh Nursing Council , the first appellate authority shall be the head of the Administrative Department .

15. Appointment by promotion.-

(

1) For the promotion of eligible candidates , a promotion Committee shall be constituted consisting of the members as mentioned in Schedule - IV .

(2) The Committee shall consider the cases of all the persons for the posts mentioned in Schedule - IV as per the instructions issued by the General Administration Department from time to time .

(3) The Committee shall meet at such intervals as the appointing authority may direct but the Committee shall normally meet at least twice a year .

(4) Subject to the provisions of rule 6(5) , the Committee shall consider the cases of all persons who have put in the same number of years of service (whether officiating or substantively) in the post on the 1st day of January of the year from which the promotion as specified in column (4) of Schedule - IV and which fall within the zone of consideration as per the provisions of sub - rule (2) : Provided that the service of officers released from the emergency Commission and short - term service Commission shall be counted after their appointment from the date they were appointed according to the memorandum of the General Administration Department , No. 2266-1987-A ( 33 ) -67 dated October 21 , 1967 , deemed to have been appointed to the service : Provided further that a junior person shall not be considered for promotion to superior grade / promotion by giving preference to a person senior to him merely on the ground that he has completed the prescribed service .

( 5) The area for consideration for selection shall be generally limited to the number of employees to be included in the selection list from Class- III to Class - II on the basis of seniority and co - merit and the number of employees to be included in the selection list in respect of posts to be filled on the basis of seniority and merit ordinarily five times the number of employees : Provided that if a suitable number of officers are not available in the area so determined , then that area may be increased to the extent that the committee may consider necessary by mentioning the reasons in writing.

Pradesh Public Service ( Reservation for Scheduled Castes / Scheduled Tribes and Backward Classes ) Act , 1994 (No. 21 of 1994 ) , on the promotion order issued by him . And have followed the instructions issued by the General Administration Department under sub - sections of the rules issued from time to time .

16. Preparation of list of suitable officers.-

(1) The Committee shall prepare a list of such persons who fulfil the condition prescribed in rule15 and who have been declared suitable by the committee for promotion in the service . This list shall be sufficient to fill the anticipated vacancies due to retirement and promotion during one year from the date of preparation , a reserve list of twenty - five percent of the number of persons included in the above list shall be prepared during the above period to fill the unexpired vacancies .

(2) The selection to be made for the inclusion of names in such list shall be determined on the basis of merit and suitability in all respects with due regard to seniority.

Explanation.- A person whose name is included in the selection list but who is not promoted during the validity of the list , does not , by the mere fact of his earlier selection , claim seniority over the persons considered in the subsequent selection that shall happen .

(4) The list thus prepared shall be reviewed and revised every year .

(5) If a member is proposed to be superseded during the selection , review or revision process , the committee shall record its reasons for the proposed supersession .

17. Time pay scale.- Three level time pay scale shall be payable according to the eligibility in a sequence of the guidelines issued by the Finance Department from time to time.

18. Consultation with the Commission . In relation to the recommendation for promotion under the chairmanship of the Departmental Promotion Committee constituted for non- gazetted Class - III and Class - IV employees , Madhya Pradesh Nurses Registration Council , it shall be understood that the consultation under sub - clause (b) of clause (3 ) of article 320 ofthe Constitution .

19. Selection list.-

(1) The list finally approved by the President , the Madhya Pradesh Nurses Registration Council for the selection of service members from the posts mentioned in column (2) of Schedule -IV to the posts mentioned in column (3 ) ofSchedule IV .

Provided that in case of a serious lapse in conduct or discharge of duties on the part of any person included in the selection list , the selection list may be specially reviewed by the recommendation of the Government and the Chairman , Madhya Pradesh Nurses Registration Council and if it deems fit , it may remove the name of the person from the selection list .

20. Appointment to service from the select list.-

(1) The employee included in the selection list appointment to the posts coming under the service cadre will be done in the same order in which the names of such employees appear in the selection list :

is not placed immediately below in the order given in the selection list may be appointed to the service if the Government is satisfied on inquiry that the vacancy is not likely to continue for more than three months .

(2) Any person whose name is included in the selection list of the service . It shall not ordinarily be necessary to consult the Board before appointment to the service unless there has been a deterioration in his performance during the period between the inclusion of his name in the selection list and the date of his proposed appointment in the opinion of the Government , such as to render him unfit for appointment to the service .

21. Interpretation . If any question arises in relation to the interpretation of these rules , it shall be referred to the Government , whose decision thereon shall be final .

22. Relaxation . - Nothing in these rules shall be construed in the case of any person to whom these rules apply limits or abridge the power of the Governor to act in such manner as may appear to him to be just and equitable :

Provided that no case shall be dealt with in a manner less favourable to him than that provided in these rules .

24. Repeal . All rules corresponding to these rules and in force immediately before the commencement of these rules are hereby repealed in respect of the matters covered by these rules .
