भारताचे संविधान.

क्र. मविसे. १०१६/प्र.क्र. १९/२०१६/आस्था-३.----भारताच्या संविधानाच्या अनुच्छेद ३०९ खालील परंतुकान्वये प्रदान करण्यात आलेल्या शक्तींचा वापर करुन आणि या नियमात अंतभर्ूत असलेल्या पदांवर कार्यरत व्यक्तींशी संबंधित पदांच्या सेवा प्रवेशासंबंधी अस्तित्वात असलेले संबंधित सर्व विद्यमान नियम, आदेश किंवा अनुदेश अधिक्रमीत करुन महाराष्ट्राचे राज्यपाल याद्वारे महाराष्ट्र शासनाच्या ग्रामविकास विभागाच्या प्रशासकीय अधिपत्याखालील निवडश्रेणी अतिरिक्त मुख्य कार्यकारी अधिकारी, उप आयुक्त (आस्थापना), उप आयुक्त (विकास), अतिरिक्त मुख्य कार्यकारी अधिकारी, प्रकल्प संचालक, उप मुख्य कार्यकारी अधिकारी (सामान्य), उप मुख्य कार्यकारी अधिकारी (ग्राम पंचायत), सहायक आयुक्त (विकास), सहायक आयुक्त (चौकशी), सहायक आयुक्त (तपासणी), प्राचार्य ग्राम सेवक प्रशिक्षण केंद्र, निवडश्रेणी गट विकास अधिकारी, गट विकास अधिकारी आणि महाराष्ट्र विकास सेवा गट अ (राजपत्रित) मधील इतर समकक्ष पदांच्या सेवा भरतीचे विनियमन करणारे पुढील नियम करीत आहेत, जसे :----

१. या नियमांना निवडश्रेणी अतिरिक्त मुख्य कार्यकारी अधिकारी, उप आयुक्त (आस्थापना), उप आयुक्त (विकास), अतिरिक्त मुख्य कार्यकारी अधिकारी, प्रकल्प संचालक, उप मुख्य कार्यकारी अधिकारी (सामान्य), उप मुख्य कार्यकारी अधिकारी (ग्राम पंचायत), सहायक आयुक्त (विकास), सहायक आयुक्त (चौकशी), सहायक आयुक्त (तपासणी), प्राचार्य ग्राम सेवक प्रशिक्षण केंद्र, निवडश्रेणी गट विकास अधिकारी, गट विकास अधिकारी आणि महाराष्ट्र विकास सेवा गट-अ मधील इतर समकक्ष पदांचे महाराष्ट्र विकास सेवा, गट-अ (राजपत्रित) (सेवा प्रवेश) नियम, २०१८ असे संबोधण्यात यावे.

२. या नियमांमध्ये संदर्भानुसार दुसरा अर्थ अभिप्रेत नसेल तर,----

(क) '' अतिरिक्त मुख्य कार्यकारी अधिकारी, गट-अ '' याचा अर्थ जिल्हा परिषदेचे अतिरिक्त मुख्य कार्यकारी अधिकारी आणि यात जिल्हा ग्रामीण विकास यंत्रणेचे प्रकल्प संचालक यांचा समावेश होतो ;

(ख) '' सहायक गट विकास अधिकारी, गट-ब '' याचा अर्थ पंचायत समितीमधील सहायक गट विकास अधिकारी आणि यात विभागीय आयुक्त कार्यालयामधील सहायक गट विकास अधिकारी (प्रशासन), जिल्हा ग्रामीण विकास यंत्रणेमधील सहायक प्रकल्प अधिकारी (रोजगार), जिल्हा ग्रामीण विकास यंत्रणेमधील सहायक प्रकल्प अधिकारी (संनियंत्रण), ग्राम सेवक प्रशिक्षण केंद्रामधील व्याख्याता आणि जिल्हा परिषदेतील गट विकास अधिकारी (मनरेगा) या पदांचा समावेश होतो ;

(१)

भाग चार-अ--१८८-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, सप्टेंबर १८, २०१८/भाद्रपद २७, शके १९४० (ग) '' गट विकास अधिकारी, गट-अ '' याचा अर्थ पंचायत समितीचे गट विकास अधिकारी ;

(घ) '' उप मुख्य कार्यकारी अधिकारी, गट-अ '' याचा अर्थ जिल्हा परिषदेतील उप मुख्य कार्यकारी अधिकारी (सामान्य) आणि यात उप मुख्य कार्यकारी अधिकारी (ग्राम पंचायत), विभागीय आयुक्त कार्यालयामधील सहायक आयुक्त (विकास), विभागीय आयुक्त कार्यालयामधील सहायक आयुक्त (चौकशी), विभागीय आयुक्त कार्यालयामधील सहायक आयुक्त (तपासणी), ग्राम सेवक प्रशिक्षण केंद्राचे प्राचार्य आणि पंचायत समितीचे निवडश्रेणी गट विकास अधिकारी यांचा समावेश होतो ;

(ड) '' शासन '' याचा अर्थ महाराष्ट्र शासन ;

(च) '' महाराष्ट्र विकास सेवा '' याचा अर्थ महाराष्ट्र विकास सेवा (रचना, वर्गीकरण आणि भरती) नियम १९७३ मधील नियम ३ च्या पोट-नियम (१) अन्वये गठीत करण्यात आलेला महाराष्ट्र विकास सेवा संवर्ग ;

(छ) '' निवडश्रेणी अतिरिक्त मुख्य कार्यकारी अधिकारी, गट-अ '' याचा अर्थ जिल्हा परिषदेचे निवडश्रेणी अतिरिक्त मुख्य कार्यकारी अधिकारी आणि यात विभागीय आयुक्त कार्यालयामधील उप आयुक्त (आस्थापना) आणि विभागीय आयुक्त कार्यालयामधील उप आयुक्त (विकास) यांचा समावेश होतो ;

३. निवडश्रेणी अतिरिक्त मुख्य कार्यकारी अधिकारी, गट-अ पदावरील नेमणूक अतिरिक्त मुख्य कार्यकारी अधिकारी, गट अ पदावरील तीन वषार्ंपेक्षा कमी नाही इतकी नियमित सेवा केलेल्या व्यक्तींमधून गुणवत्ता व ज्येष्ठतेनुसार काटेकोरपणे निवड करुन पदोन्नतीने केली जाईल.

४. अतिरिक्त मुख्य कार्यकारी अधिकारी, गट-अ पदावरील नेमणूक उप मुख्य कार्यकारी अधिकारी, गट अ पदावरील तीन वषार्ंपेक्षा कमी नाही इतकी नियमित सेवा केलेल्या व्यक्तींमधून गुणवत्ता व ज्येष्ठतेनुसार काटेकोरपणे निवड करुन पदोन्नतीने केली जाईल.

५. उप मुख्य कार्यकारी अधिकारी, गट-अ पदावरील नेमणूक गट विकास अधिकारी, गट-अ पदावरील पाच वषार्ंपेक्षा कमी नाही इतकी नियमित सेवा केलेल्या व्यक्तींमधून गुणवत्ता व ज्येष्ठतेनुसार काटेकोरपणे निवड करुन पदोन्नतीने केली जाईल.

६. गट विकास अधिकारी, गट अ पदावरील नियुक्ती पुढील मार्गाने करण्यात येईल,----

एकतर----

(अ) सहायक गट विकास अधिकारी, गट ब पदावरील तीन वषार्ंपेक्षा कमी नाही इतकी नियमित सेवा केलेल्या व्यक्तींमधून गुणवत्ता व ज्येष्ठतेनुसार काटेकोरपणे निवड करुन पदोन्नतीने केली जाईल; किंवा

(ब) पुढील अटी व शर्ती पूर्ण करणा-या उमेदवारांमधून महाराष्ट्र लोकसेवा आयोगामार्फत घेण्यात येणा-या स्पर्धा परीक्षेच्या निकालाच्या आधारे, नामनिर्देशनाद्वारे करण्यात येईल.

(१) ज्यांचे वय ३८ वषार्ंपेक्षा जास्त नाही ;

(२) मागास प्रवर्गातील ज्या उमेदवारांचे वय ४३ वषार्ंपेक्षा जास्त नाही ;

(३) ज्यांनी सांविधिक विद्यापीठाची कोणत्याही शाखेची पदवी धारण केली आहे.

किंवा

(क) राज्य शासनाचे गट-अ (राजपत्रित) अधिकारी अथवा राज्य सामान्य सेवेतील गट-अ अधिकारी अथवा प्रशिक्षणासाठी राज्य शासनाकडील समकक्ष पदावर कार्यरत अथवा परिवीक्षाधीन (प्रशिक्षणार्थ अधिकारी) अधिकारी असलेले भारतीय प्रशासकीय सेवेमधील अधिकारी यांच्या बदलीने प्रतिनियुक्तीवर करण्यात येईल :

परंतु असे की, बदलीने प्रतिनियुक्तीवरील नियुक्ती, गट विकास अधिकारी या संवर्गाच्या मंजूर संवर्गसंख्येच्या पंधरा टक्के पेक्षा जास्त प्रमाणात करता येणार नाही.

७. नियम ६ मध्ये नमूद केलेल्या पदांवर नामनिर्देशनाने नियुक्त झालेली व्यक्ती दोन वर्षे कालावधीसाठी परिवीक्षाधीन राहील. सदर परिवीक्षाधीन कालावधी कमाल एक वर्ष कालावधीसाठी वाढविता येईल. सदर व्यक्ती परिवीक्षाधीन कालावधी समाधानकारक रीत्या पूर्ण करिल व महाराष्ट्र विकास सेवा, वर्ग १ व वर्ग २ (विभागीय परीक्षा) (नियम) १९९१ अन्वये विहीत विभागीय परीक्षा उत्तीर्ण होईल. सरळसेवेने नियुक्त व्यक्ती सामान्य प्रशासन विभागाने विहीत केलेले परिवीक्षाधीन कालीन प्रशिक्षण समाधानकारक रीत्या पूर्ण करील. जर सदर व्यक्तीने परिवीक्षाधीन कालावधी समाधानकारक रीत्या पूर्ण केला नाही किंवा विभागीय परीक्षा उत्तीर्ण केली नाही किंवा प्रशिक्षण पूर्ण केले नाही किंवा सदर पदावर काम करण्यासाठी सुयोग्य आढळून आला नाही, तर अशा व्यक्तीच्या सेवा पूर्व सूचनेशिवाय समाप्त करण्यात येतील.

८. नियम ३, ४, ५ व ६ मध्ये नमूद केलेल्या पदांवर नियुक्त झालेल्या व्यक्तीने याबाबतीत करण्यात आलेल्या नियमांनुसार मराठी व हिंदी भाषा परीक्षा उत्तीर्ण केली नसल्यास किंवा उत्तीर्ण होण्यापासून सूट मिळाली नसल्यास, मराठी व हिंदी भाषा परीक्षा उत्तीर्ण होणे आवश्यक राहील.

९. नियम क्र. ३, ४, ५ व ६ मधील पदांवर नियुक्त व्यक्तीस महाराष्ट्र शासनाच्या माहिती व तंत्रज्ञान संचालनालयाने, वेळोवेळी विहीत केलेले संगणक हाताळणीबाबतचे प्रमाणपत्र धारण करणे आवश्यक राहील.

१०. नियम क्र. ३, ४, ५ व ६ मधील पदांवरील व्यक्ती राज्यस्तरावरील बदलीस पात्र राहतील.

११. नियम क्र. ६(ब) मधील पदांवर नियुक्त झालेल्या व्यक्तींना सामान्य प्रशासन विभागाच्या महाराष्ट्र नागरी सेवा [महाराष्ट्र लोकसेवा आयोगामार्फत घेण्यात येणा-या राज्य नागरी सेवा परीक्षेद्वारे गट '' अ '' आणि गट '' ब ''(राजपत्रित) या पदाकरिता निवड होऊन, सरळसेवेने नियुक्त होणा-या व एकत्रित परिवीक्षाधीन प्रशिक्षण कार्यक्रमांतर्गत प्रशिक्षण घेणा-या उमेदवारांची सेवाज्येष्ठता निश्चित करणे] नियम, २०१५ मधील तरतुदी लागू राहतील.

१२. या नियमांतर्गत सरळसेवेने नियुक्त झालेल्या व्यक्तींनी महाराष्ट्र विकास सेवा (परिविक्षा) नियम, १९८४ मधील तरतुदींची आणि राज्य शासनाने वेळोवेळी परिविक्षेसंदर्भात निर्गमित केलेल्या तरतुदींची पूर्तता करणे आवश्यक आहे.

NOTIFICATION

CONSTITUTION OF INDIA.

No. MDS-1016/CR19/2016/Estt.3.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of the existing rules, orders and instruments, in so far as they relate to recruitment rules of the persons to the posts covered herein, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of the Selection Grade Additional Chief Executive Officer, Deputy Commissioner (Establishment), Deputy Commissioner (Development), Additional Chief Executive Officer, Project Director, Deputy Chief Executive Officer (General), Deputy Chief Executive Officer (Panchayat), Assistant Commissioner (Development), Assistant Commissioner (Enquiry), Assistant Commissioner (Inspection), Principal Gramsevak Training Centre, Selection Grade Block Development Officer, Block Development Officer and all other equivalent posts of the Maharashtra Development Service, Group-A (Gazetted) under the administrative control of the Rural Development Department of the Government of Maharashtra, namely :—

1. These rules may be called the Selection Grade Additional Chief Executive Officer, Deputy Commissioner (Establishment), Deputy Commissioner (Development), Additional Chief Executive Officer, Project Director, Deputy Chief Executive Officer (General), Deputy Chief Executive Officer (Panchayat), Assistant Commissioner (Development), Assistant Commissioner (Enquiry), Assistant Commissioner (Inspection), Principal Gramsevak Training Centre, Selection Grade Block Development Officer, Block Development Officer and all other equivalent posts of the Maharashtra Development Service, Group-A (Gazetted) (Recruitment) Rules, 2018.

2. In these rules, unless the context requires otherwise,—

(a) "Additional Chief Executive Officer, Group A" means Additional Chief Executive Officer of Zilla Parishad and includes the Project Director of District Rural Development Agency ;

(b) "Assistant Block Development Officer, Group B" means the Assistant Block Development Officer working in the office of Panchayat Samiti, and includes the Assistant Block Development Officer (Administration) in the Office of the Divisional Commissioner, Assistant Project Officer (Employment) in the Office of District Rural Development Agency, Assistant Project Officer (Monitoring) in the Office of District Rural Development Agency, Lecturer in the office of Gramsevek Training Centre and Block Development Officer (MGNREGA) in the office of Zilla Parishad ;

(c) "Block Development Officer, Group A" means the Block Development Officer of Panchayat Samiti ;

(d) "Deputy Chief Executive Officer, Group A" means the Deputy Chief Executive Officer, working in the office of Zilla Parishad and includes the Deputy Chief Executive Officer (General), Deputy Chief Executive Officer (Panchayat), Assistant Commissioner (Development) working in the office of Divisional Commissioner,Assistant Commissioner (Enquiry) working in the office of Divisional Commissioner, Assistant Commissioner (Inspection) working in the office of Divisional Commissioner, Principal Gramsevak Training Centre and Selection Grade Block Development Officer of Panchayat Samiti ;

(e) "Government" means the Government of Maharashtra ;

(f) "Maharashtra Development Service" means the Maharashtra Development Service constituted under sub-rule (1) of rule 3 of the Maharashtra Development Service (Constitution, Classification and Recruitment) Rules, 1973 ;

(g) "Selection Grade Additional Chief Executive Officer, Group A" means Selection Grade Additional Chief Executive Officer of Zilla Parishad and includes the Deputy Commissioner (Establishment) working in the office of Divisional Commissioner and the Deputy Commissioner (Development) working in the office of Divisional Commissioner ;

3. Appointment to the post of Selection Grade Additional Chief Executive Officer, Group A, shall be made by promotion of a suitable person by selection on the basis of merit-cum-seniority, subject to fitness, from amongst the persons holding the post of Additional Chief Executive Officer, Group A, having not less than three years regular service in that post.

4. Appointment to the post of Additional Chief Executive Officer, Group A, shall be made by promotion of a suitable person by selection on the basis of merit-cum-seniority, subject to fitness, from amongst the persons holding the post of Deputy Chief Executive Officer, Group A, having not less than three years regular service in that post.

5. Appointment to the posts of Deputy Chief Executive Officer, Group A, shall be made by promotion of a suitable person by selection on the basis of merit-cum-seniority, subject to fitness, from amongst the persons holding the post of Block Development Officer, Group A, having not less than five years regular service in that post.

6. Appointment to the posts of Block Development Officer, Group A shall be made either—

(a) by promotion of a suitable person by selection on the basis of merit-cum-seniority, subject to fitness, from amongst the person, holding the post of Assistant Block Development Officer, Group B, having not less than three years regular service in that post ; or

(b) by nomination of a suitable person on the basis of result of competitive examination held by Commission from amongst the candidates who—

(i) are not more than 38 years of age ;

(ii) are not more than 43 years of age in the case of the persons belonging to reserve category ;

(iii) possess degree of a statutory university;or

(c) by transfer of a suitable person on deputation from the Group A (Gazetted) service of the State or the General State Service or of officers holding comparable posts under the State Government or probationer (officer trainees) of All India Service for training purposes :

Provided that, appointment by transfer on deputation shall not exceed fifteen per cent of the sanctioned cadre strength of Block Development Officer, Group A.

7. A person appointed by nomination on the posts mentioned in rule 6, shall be on probation for a period of two years. The probation period may be extended maximum up to one year. A person appointed shall be required to complete the probation period successfully and pass Departmental Examinations as prescribed by the Maharashtra Development Services, Class I and Class II (Departmental Examination) Rules, 1991. A person appointed shall also be required to undergo successful training as specified by General Administration Department of the Government of Maharashtra within the probation period. If he does not complete the probation successfully or does not pass the Departmental Examination or does not complete the training or is not found suitable for the post during the probation period, his services shall be terminated from without prior notice.

8. A person appointed to any of the posts mentioned in rule 3, 4, 5 and 6 shall be required to pass the examinations in Hindi and Marathi language according to the rules made in that behalf by the Government unless he has already passed, or is exempted from passing such examinations.

9. A person appointed to any of the post mentioned in rule 3, 4, 5 and 6 shall be required to obtain a certificate in Computer Operation prescribed by the Directorate of Information Technology of the Government of Maharashtra, from time to time.

10. A person appointed to any of the post mentioned in rules 3, 4, 5 and 6 shall be liable to transfer anywhere in the State of Maharashtra.

11. A person appointed to the post mentioned in rule 6(b) shall be required to abide by the provisions of the Maharashtra Civil Services (fixation of seniority of the candidates recruited directly by selection for the posts of Group "A" and Group "B" (Gazetted) through State Civil Service Examination conducted by the Maharashtra Public Service Commission and undergoing Combined Probationary Training Programme) Rules, 2015, issued by General Administration Department.

12. The person appointed under these rules by nomination shall comply the provisions of the Maharashtra Development Service (Probation) Rules, 1984 and other provisions regarding probation issued by the State Government, from time to time.
