भारताचे संविधान.

क्रमांक एमएनए. ०२१६/सी. आर. १५/उद्योग-९.---- भारताच्या संविधानाच्या अनुच्छेद-९ च्या परंतुकान्वये प्रदान करण्यात आलेल्या अधिकारांचा वापर करताना आणि राज्यात किंवा त्याच्या कोणत्याही भागात लागू असलेले व याबाबतीत निर्गमित केलेले सर्व अस्तित्वात असलेले नियम व आदेशांचे अधिक्रमण करून महाराष्ट्र राज्याचे राज्यपाल याद्वारे महाराष्ट्र राज्यातील भूविज्ञान आणि खनिकर्म संचालनालयाच्या नियंत्रणाखालील राजपत्रित अधिकायांंकरिता विभागीय परीक्षेचे विनियमन करून पुढीलप्रमाणे नियम करीत आहेत :----

१. संक्षिप्त नाव.---- या नियमांना महाराष्ट्र भूविज्ञान आणि खनिकर्म संचालनालय राजपत्रित अधिकारी विभागीय परीक्षा नियम, २०१८ असे म्हणावे. २. व्याख्या.----या नियमात, संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर----

(क) " शासन " म्हणजे महाराष्ट्र शासन. (ख) " आयोग " म्हणजे महाराष्ट्र लोक सेवा आयोग. (ग) " संचालनालय " म्हणजे भूविज्ञान आणि खनिकर्म संचालनालय, महाराष्ट्र शासन. (घ) " परिशिष्ट " म्हणजे या नियमांचे परिशिष्ट. (च) " विद्यमान नियम " म्हणजे असे आदेश व नियम जे भूविज्ञान आणि खनिकर्म संचालनालयात काम करणाया राजपत्रित अधिकायांकरिता होणाया विभागीय परीक्षांसाठी अंमलात आहेत व ते सदरचे राजपत्रात प्रकाशन होणाया तारखपूर्वी लागू आहेत.

(छ) " राजपत्रित अधिकारी " म्हणजे भूविज्ञान आणि खनिकर्म संचालनालय, नागपूर मध्ये खालील पदावर नियुक्त केलेल्या व्यक्ती----

(१) संचालक, (२) सहसंचालक, (३) वरिष्ठ उप संचालक,

भाग चार-अ----१००-१

(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, एप्रिल ११, २०१९/चैत्र २१, शके १९४१ (४) उप संचालक,

(५) वरिष्ठ भूवैज्ञानिक,

(६) भूवैज्ञानिक,

(७) मुख्य आवेधन अभियंता,

(८) आवेधन अभियंता,

(९) प्रशासन अधिकारी,

(१०) सहायक प्रशासन अधिकारी,

(११) कनिष्ठ भूवैज्ञानिक,

(१२) सहायक आवेधन अभियंता.

(ज) " तांत्रिक पदे " म्हणजे भूविज्ञान आणि खनिकर्म संचालनालय, नागपूर मध्ये खालील पदावर नियुक्त केलेल्या व्यक्ती,-----

(१) संचालक,

(२) सहसंचालक,

(३) वरिष्ठ उप संचालक,

(४) उप संचालक,

(५) वरिष्ठ भूवैज्ञानिक,

(६) भूवैज्ञानिक,

(७) मुख्य आवेधन अभियंता,

(८) आवेधन अभियंता,

(९) कनिष्ठ भूवैज्ञानिक,

(१०) सहायक आवेधन अभियंता.

(झ) " प्रशासकीय पदे " म्हणजे भूविज्ञान आणि खनिकर्म संचालनालय, नागपूर मध्ये खालील पदावर नियुुक्त केलेल्या व्यक्ती ---

(१) प्रशासन अधिकारी,

(२) सहायक प्रशासन अधिकारी.

(त) " परीक्षा " म्हणजे या नियमांतर्गत विहित करून नियम ९ अंतर्गत विहित केलेल्या अभ्यासक्रमाप्रमाणे घेण्यात आलेली विभागीय परीक्षा.

३. परीक्षा उत्तीर्ण करण्याची आवश्यकता .--- जी व्यक्ती नामनिर्देशनाने किंवा पदोन्नतीने राजपत्रित पदावर नियुक्त झाली आहे अशा व्यक्तीला सेवेत अखंड राहण्याकरिता किंवा कायम होण्याकरिता, जर त्यांना नियम ८ अंतर्गत सूट दिली नसेल तर सदर विभागीय परीक्षा उत्तीर्ण होणे आवश्यक आहे.

४. परीक्षा उत्तीर्ण होण्यासाठी कालावधी आणि संधी.----

(१) या नियमांतील तरतुदींच्या अधीन राहून ज्या व्यक्तीची संबंंधित राजपत्रित पदावर नामनिर्देशनाने नियुक्ती झालेली असेल त्यांना संबंधित सेवा प्रवेश नियमांतर्गत विहित केलेल्या परिवीक्षा कालावधीत विभागीय परीक्षा उत्तीर्ण होणे आवश्यक राहील.

(२) या नियमांतील तरतुदींच्या अधीन राहून ज्या व्यक्तीची संबंंधित राजपत्रित पदावर पदोन्नतीने नियुक्ती झालेली असेल त्यांना तीन वर्षात दोन संधीमध्ये विभागीय परीक्षा उत्तीर्ण होणे आवश्यक राहील.

तथापि, या नियमांमध्ये विहित केलेल्या कालावधीमध्ये जर कोणत्याही कारणाने विभागीय परीक्षा घेण्यात आली नसेल तर तो कालावधी परीक्षा उत्तीर्ण होण्याकरिता गणन्यात आलेल्या पूर्ण कालावधीमधून वगळण्यात येईल.

(३) आणखी असेही नमूद करण्यात येते की, जर पात्र उमेदवाराने विशिष्ट वर्षात परीक्षेकरिता आवेदन पत्र भरून दिलेले नसेल किंवा आवेदन पत्र भरुन दिल्यानंतर परीक्षेस उपस्थित झाले नसतील तरीही सदरील परीक्षेकरिता त्या उमेदवाराची एक संधी परिगणीत करण्यात येईल.

५. परीक्षा उत्तीर्ण न झाल्यास अपयशाचे परिणाम -----

(१) जर एखादी व्यक्ती नामनिर्देशनाने राजपत्रित पदावर नियुक्त झाली असेल आणि नियम ४ मधील उप नियम (१) नुसार दिलेल्या कालावधीत विभागीय परीक्षा उत्तीर्ण होण्यास अपयशी ठरली असेल तर त्यास सेवामुक्त किंवा बडतर्फ करण्यात येईल.

(२) जर एखादी व्यक्ती पदोन्नतीने राजपत्रित पदावर नियुक्त झाली असेल आणि नियम ४ मधील उप नियम (२) नुसार विर्िनदिष्ट केलेल्या कालावधीत व संधीमध्ये परीक्षा उत्तीर्ण होण्यास अपयशी ठरली असेल तर त्याला ---

(क) त्यांच्या आधी परीक्षा उत्तीर्ण होणाया सर्व अधिकायांशी, उच्च पदावर पदोन्नतीच्या कारणासाठी, सेवाज्येष्ठता गमवावी लागेल. या प्रकरणात अशा अधिकायांची सेवाज्येष्ठता परीक्षा उत्तीर्ण केलेल्या तारखेला निश्चित केल्या जाईल किंवा नियम ८ च्या अंतर्गत त्याला परीक्षा देण्यापासून वगळले जाईल ; आणि

(ख) अशा अधिकायाला जोपयर्ंत तो परीक्षा उत्तीर्ण होत नाही तोपयर्ंत त्याच्या पदावर कायम करण्यात येणार नाही आणि ज्या पदावर तो आहे त्या पदाच्या वेतन श्रेणीमध्ये त्याला लगत नंतरची वर्ाषिक वेतनवाढ मिळणार नाही. अशी रोखून धरलेली वेतन- वाढ त्या तारखेपासून जेव्हा तो परीक्षा उत्तीर्ण होईल किंवा त्याला परीक्षा उत्तीर्ण होण्यापासून नियम ८ च्या अंतर्गत सूट दिली असेल, त्याला देय राहील. पुढच्या सर्व वेतनवाढी कोणतीही वेतनवाढ रोखून धरली नाही असे मानून, उपर्ाजित होतील. मागील कालावधीतील थकबाकी अनुज्ञेय राहणार नाहीत.

६. नमूद केलेल्या भाषांमध्ये महाराष्ट्र लोकसेवा आयोगामार्फत परीक्षा घेतली जाईल ----

(१) परीक्षा महाराष्ट्र लोकसेवा आयोगाकडून वर्षातून एकदा प्राधान्याने माहे ऑक्टोबर किंवा नोव्हेंबर मध्ये घेण्यात येईल.

(२) प्रश्नपत्रिका मराठी आणि इंग्रजी भाषेतून राहतील.

७. अतिरिक्त संधी देणे.---- शासनास अपवादात्मक परिस्थितीमध्ये, विवेकाधिकाराने अशा उमेदवाराला, जो नियम ४ मध्ये विर्िनदिष्ट केलेल्या कालावधीमध्ये परीक्षा उत्तीर्ण होण्यास अयशस्वी ठरला, एक पेक्षा अधिक नसलेली एक अतिरिक्त संधी, जर त्याने असा अर्ज केला असेल तर, परीक्षेत बसण्यासाठी देऊ शकते आणि त्याचा परिविक्षा कालावधी कमाल एक वर्षाने, नियम ४ मध्ये दिलेल्या २ वषार्ंच्या कालावधीच्या पुढे, तद्नुसार वाढवू शकते.

जर अधिकायाने परीक्षेत बसण्यासाठी मिळालेल्या संधीचा उपयोग आयोगाने घेतलेल्या लगतच्या सलग परीक्षेत केला असेल.

८. सूट.---- हे नियम त्या अधिकायाला लागू होतात ज्याला परीक्षा उत्तीर्ण होण्यापासून सूट मिळेल जर ----

(क) तो हे नियम प्रारंभ होण्यापूर्वी वर्तमान विभागीय परीक्षा नियमांप्रमाणे आधिच परीक्षा उत्तीर्ण झाला असेल ;

(ख) जर त्याला वर्तमान नियमांतर्गत अशी परीक्षा उत्तीर्ण होण्यापासून सूट असेल ;

(ग) जर एखाद्या अधिकायाने नियम २ च्या उप नियम (छ) अंतर्गत नमूद केलेल्या एखाद्या पदावर असतांना परीक्षा उत्तीर्ण केली असेल तर त्याला उच्च पदावर झालेल्या पदोन्नती नंतर ही परीक्षा उत्तीर्ण करण्याची गरज नाही.

(घ) त्याने हे नियम निर्गमित होण्याच्या दिनांकास आणि त्यानंतर, कोणत्याही दिवशी वयाची पन्नास वर्षे पूर्ण केली असतील.

परंतु, या नियमातील नियम ४ च्या उप नियम (१) मध्ये नमूद केलेल्या अधिकायांंना या कारणाअंतर्गत सूट मिळणार नाही.

९. अभ्यासक्रम :-----

(१) परीक्षेसाठी अभ्यासक्रम परिशिष्ट " अ " मध्ये नमूद केलेल्याप्रमाणे राहील ;

(२) सर्व प्रश्नपत्रिका प्रत्येकी १०० गुणांची व तीन तासांच्या कालावधीची राहील. पहिल्या तीन प्रश्नपत्रिका, या नियमातील नियम २ च्या उप नियम (छ) मध्ये नमूद केलेल्या सर्व अधिकायांना सामाईक राहतील ;

(३) चौथ्या प्रश्नपत्रिकेत ३ भाग राहतील ; भाग क्र. १, भाग क्र. २ आणि भाग क्र. ३ ;

(क) भाग क्र. १ मध्ये सामान्य प्रशासन (प्रवर्तन व व्यवस्थापन) आणि संचालनालयाचे सर्वसाधारण उपक्रम यांचा अंतर्भाव राहील आणि हे सर्व अधिकायांसाठी ज्यांचा उल्लेख नियम (२) च्या अंतर्गत उप नियम (छ) मध्ये केला आहे, अनिवार्य राहील.

(ख) भाग क्र. २ मध्ये खनिज समन्वेषणाचा अंतर्भाव राहील आणि हे सर्व अधिकायांसाठी ज्यांचा उल्लेख नियम (२) च्या अंतर्गत उप नियम (ज) मध्ये केला आहे, अनिवार्य राहील.

(ग) भाग क्र. (३) मध्ये कार्यालय प्रशासनाचा अंतर्भाव राहील आणि हे सर्व अधिकायांसाठी ज्यांचा उल्लेख नियम (२) च्या अंतर्गत उप नियम (झ) मध्ये केला आहे, अनिवार्य राहील.

भाग चार-अ----१००-१अ४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, एप्रिल ११, २०१९/चैत्र २१, शके १९४१ (४) प्रश्नपत्रिका क्र 1, 2 व 3 या पुस्तकांच्या मदतीने सोडविता येतील. (पुस्तंकासह) (भारत सरकारने व महाराष्ट्र सरकारने प्रकाशित केलेली पुस्तके, शासकीय अधिसूचना व शासन निर्णय)

प्रश्नपत्रिका क्र. 4 पुस्तकांच्या मदतीशिवाय सोडवावी लागेल. (पुस्तकांशिवाय)

(५) सर्व प्रश्नपत्रिका मराठी किंवा इंग्रजी मध्ये सोडविता येतील .

(६) गरजेनूसार व तांत्रिक विषय अद्यावत करणे आवश्यक असल्यास शासन या अभ्यासक्रमात वेळोवेळी शासन निर्णयान्वये बदल करू शकते. १०. परीक्षा उत्तीर्ण होण्याचे मानक.---- परीक्षेत उत्तीर्ण होण्याकरिता प्रत्येक प्रश्नपत्रिकेतील एकूण गुणांच्या ५० टक्क्यांचे मानक राहील.

उमेदवाराला परीक्षा उत्तीर्ण होण्यासाठी कोणत्याही एका पेपरसाठी ५ टक्क्यांपयर्ंत सूट मिळू शकेल, जर उमेदवार एकाच वेळी सर्व पेपर्ससाठी बसला असेल व परीक्षा उत्तीर्ण होण्यास पात्र ठरत असेल.

११. श्रेय.---- जर एखादा अधिकारी पहिल्या प्रयत्नात परीक्षा उत्तीर्ण झाला असेल आणि त्याला एखाद्या पेपरमध्ये ७५ टक्के किंवा जास्त गुण प्राप्त झाले असतील तर त्या अधिकायाने परीक्षा गुणवत्ता श्रेणीने उत्तीर्ण केल्याचे समजले जाईल आणि त्याच्या या कामगिरीची नोंद त्याच्या गोपनिय अहवालामध्ये केली जाईल.

१२. विषयांमध्ये सूट.---- एखादा अधिकारी जो परीक्षेमध्ये अनुत्तीर्ण झाला असेल परंतु कोणत्याही प्रश्नपत्रिकेत ५५ टक्के किंवा जास्त गुण प्राप्त केलेले असतील, तर त्याला त्याच्या पुढील संधी मध्ये त्या प्रश्नपत्रिकेत पुन्हा उपस्थित राहण्याची व उत्तीर्ण होण्यापासून सूट राहील.

जर अधिकायाने अशी सूट मिळण्यासाठी, जेव्हा त्याला पुढच्या प्रयत्नात परीक्षेला बसावयाचे आहे, तेव्हा लिखित स्वरूपात विशेषत्वाने मागणी केली असेल तर. जर अशी लिखित स्वरूपात सूट मिळण्यासाठी मागणी केली नसल्यास, गृहीत धरले जाईल की उमेदवाराला अशी सूट मिळविण्यात स्वारस्य नाही.

१३. परीक्षेला उपस्थित राहण्याकरिता अर्ज.---- ज्या अधिकायाची परीक्षेला बसण्याची इच्छा आहे तो/ती परिशिष्ट " ब " मध्ये विहित केलेल्या नमुन्यात संचालक, भूविज्ञान आणि खनिकर्म, नागपूर यांना अर्ज करेल.

NOTIFICATION

CONSTITUTION OF INDIA.

No. MNA. 0216/C.R.15/Ind 9.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules issued in this behalf and in force in the State or any part thereof, the Governor of Maharashtra is hereby pleased to make the following rules regulating the Departmental Examination for the posts of Gazetted Officers under the control of the Directorate of Geology and Mining under the Government of Maharashtra namely :—

1. Short title.—These rules may be called the Maharashtra Directorate of Geology and Mining Gazetted Officers departmental examination Rules, 2018.

2. Definition.—In these rules, unless the context otherwise requires :—

(a) " Government" means the Government of Maharashtra ;

(b) "Commission" means the Maharashtra Public Service Commission ;

(c) "Directorate" means The Directorate of Geology and Mining Government of Maharashtra ;

(d) " Appendix " means the Appendix to these rules ;

(e) " Existing rules " means the rules and orders in force for the Departmental Examination for Gazetted Officers in the Directorate of Geology and Mining immediately in force before the date of publication of these rules in the Gazette.

(f) " Gazetted Officers " means the person appointed in the Directorate of Geology and Mining, Nagpur to any of the following posts namely :—

(1) Director

(2) Joint Director

(3) Sr. Deputy Director

(4) Deputy Director

(5) Senior Geologist

(6) Geologist

(7) Chief Drilling Engineer

(8) Drilling Engineer

(9) Administrative Officer

(10) Assistant Administrative Officer

(11) Junior Geologist

(12) Assistant Drilling Engineer

(g) " Technical Posts " means the person appointed in the Directorate of Geology and Mining, Nagpur to any of the following posts namely :—

(1) Director

(2) Joint Director

(h) " Administrative posts " means the person appointed in the Directorate of Geology and Mining, Nagpur to any of the following posts namely :—

(1) Administrative Officer

(2) Assistant Administrative Officer

(i) " Examination" means the Departmental Examination prescribed under these rules held according to the syllabus prescribed under rule 9.

3. Necessity of passing the examination.—The person who has appointed by nomination or by promotion to the post of Gazetted Officer shall be required to pass the examination in accordance with these rules for continuation in the service and confirmation on the post unless exempted under rule 8.

4. Period and Chances for Passing the Examination :—

(1) The person who has appointed by nomination shall be required to pass the Examination within the period of probation as provided under the respective recruitment rules for the respective post of Gazetted Officers.

(2) The person who has appointed by promotion shall be required to pass the Examination within three years in two chances from the date of his appointment :

Provided that, if for any reason, the examination is not held in any particular year, that year shall be excluded in computing the total period of years mentioned in this rule. (3) It is also stated that, if an eligible candidate dose not submit an application for an exam conducted in particular year or even after the submission of application would not appear for the exam, that year will also be consider as an opportunity.

5. Consequences of failure to pass the examination :—

(1) if the person appointed by nomination to the post of Gazetted Officer and fails to pass the Examination within a period specific in sub-rule (1) of rule 4, then he shall be liable to discharge or terminate from the service; or

(2) If the person appointed by promotion to the post of Gazetted Officer and fails to pass the Examination within a period and chances specified in sub-rule (2) of rule 4 then,—

(a) he shall lose seniority for the purpose of promotion to the higher post, to all the officers who pass the Examination before him. In this case the seniority of this officer should be fixed on the date of passing the Examination or he may exempted under rule 8 ; and

(b) until he passes the examination he shall not be confirmed in the post and shall not be allowed to draw his next increment in the scale of post held by him. Increment soमहाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, एप्रिल ११, २०१९/चैत्र २१, शके १९४१ ११ withheld shall become payable to him with effect from the date on which he passes the Examination or he may be exempted from passing the Examination under rule 8 of these rules. All future increments shall accrue as if no increment is withheld. The arrears for past period shall not be admissible.

6. Commission to Conduct Examination and Medium of Examination.—

(1) The examination shall be conducted by the Commission, and shall be held once in a year preferably in the month of October or November.

(2) The question paper shall be in Marathi and English languages.

7. Grant of extra chances.—The Government may, in exceptional circumstances, at its discretion, grant to a candidate failing to pass the examination within the period mentioned in the rule 4, not more than one extra chance to appear for the examination, if he applies for it, by correspondingly extending the period of probation maximum upto one year beyond the period of two years referred to in rule 4 :

Provided that, the extra chance to appear for the examination shall be availed by the Officer immediately at the next consecutive examination held by the Commission.

8. Exemptions.— An Officer to whom these rules apply shall be exempted from passing the examination if,—

(a) he has already passed the examination under the exiting Departmental Examination Rules ;

(b) he has been exempted from passing such examination under the existing rules ;

(c) any officer who passes the Examination at any of the post mentioned in clause (f) of rule 2 ; he shall not be required to pass the Examination after his promotion to the higher post again ;

(d) he has attained the age of fifty years on the day of issue of these rules and on any day thereafter :

Provided that, exemption under this clause shall not be available to the officers covered by sub-rule (1) of rule 4 of these rules.

9. Syllabus :—

(1) The syllabus for the examination shall be as mentioned in Appendix 'A'.

(2) All question papers will be 100 marks each and of three hours duration. The first three papers will be common to all the officers mentioned in the clause (f) of Rule 2 of these rules;

(3) The fourth paper shall contain three parts namely as Part No. 1, Part No. 2 and Part No. 3.

(a) Part No. 1 shall contain General Administration (Operation and Management) and General Activities of the Directorate of Geology and Mining, Nagpur and it is compulsory for all the officers mentioned in the clause (f) of Rule 2.

(b) Part No. 2 shall contain Mineral Exploration and it shall be compulsory for officers mentioned in clause (g) of rule 2 and

(c) Part No. 3 shall contain Office Administration and it shall be compulsory for officers mentioned in clause (h) of rule 2.

(with books, government notifications and government resolutions published by the Government of India and the State Government of Maharashtra), Paper No. IV shall be answered without the aid of books (without books).

(5) All the question papers may be answered either in Marathi or in English.

(6) As per change in need and technical up gradation of subjects Government may amend this syllabus by the Government Resolution from time to time.

10. Standard for passing.—The standard for passing the examination shall be 50 percent of all total marks in each paper,

Condonation upto 5% of marks in any one paper shall be granted to a candidate who is thereby able to pass the examination, provided that the candidate appears for all the papers at one and the same time.

11. Credit.– An Officers who passes the examination at first attempt and secures 75 percent or more marks in any paper, shall be considered to have passed the examination with credit and an entry regarding his performance shall be recorded in his confidential report.

12. Exemption in Subjects.—An Officer who fails in the examination but secures 55 percent or more marks in any paper, shall be exempted from appearing and passing again in that paper in his subsequent attempts :

Provided that, such exemption shall be specially claimed by the Officer in writing at the time of appearing for the examination in his subsequent attempts. In the absence of such written application claiming exemption it shall be presumed that the candidate does not wish to avail of the exemption.

13. Application for appearing in the Examination.—An Officer who desires to appear for the examination shall apply in the form prescribed in Appendix 'B' to the Directorate of Geology and Mining, Nagpur.
