महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६.
क्र. टीपीएस-१७१७/२७५०/प्र.क्र.९१/१९/मरारविम/नवि-१२.--- ज्याअर्थी, शहर व औद्योगिक विकास महामंडळाची (सिडको) (यापुढे ज्याचा उल्लेख " उक्त महामंडळ " असा करण्यात आला आहे.) महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ चे (यापुढे ज्यांचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे.) कलम ४०(१)(ख) मधील तरतुदीनुसार नवी मुंबई विमानतळ प्रभाव अधिसूचित क्षेत्राकरिता (यापुढे ज्याचा उल्लेख " उक्त क्षेत्र " असा करण्यात आला आहे.) शासन अधिसूचना क्र. टीपीएस-१७१२/४७५/प्र.क्र.९८/१२/नवि-१२, दि. १० जानेवारी २०१३ अन्वये विशेष नियोजन प्राधिकरण म्हणून नियुक्ती केली आहे, (यापुढे ज्याचा उल्लेख " उक्त प्राधिकरण " असा करण्यात आला आहे);
आणि ज्याअर्थी, मुंबई-पुणे द्रुुतगती महामार्ग व जुना मुंबई-पुणे राष्ट्रीय महामार्ग क्र.४ तसेच पुणे जिल्ह्यतील क्षेत्र वगळता मुंबई-पुणे द्रुुतगती महामार्गाच्या दक्षिण- पश्चिमेकडील २.०० कि.मी. अधिसूचित क्षेत्राकरिता (यापुढे ज्याचा उल्लेख " उक्त अधिसूचित क्षेत्र " असा करण्यात आला आहे.) शासनाने उक्त अधिनियमाच्या कलम ४० मधील तरतुदीनुसार शासन अधिसूचना क्रमांक टीपीएस-१८१५/अनौ.७८/ १५/ नवि-१३, दिनांक १७ फेब्रुवारी २०१६ अन्वये महाराष्ट्र राज्य रस्ते विकास महामंडळाची (यापुढे ज्याचा उल्लेख " उक्त महामंडळ " असा करण्यात आला आहे.) विशेष नियोजन प्राधिकरण म्हणून नियुक्ती करण्यात आली आहे (यापुढे ज्याचा उल्लेख " उक्त विशेष नियोजन प्राधिकरण " असा करण्यात आला आहे.);
आणि ज्याअर्थी, नियोजनाच्या दृष्टीने उक्त क्षेत्राची अखंडता विचारात घेतल्यानंतर आणि आवश्यक ती चौकशी केल्यानंतर खालापूर तालुक्यातील ३० गांवे उक्त क्षेत्रामधून वगळणे तसेच या ३० गावांकरिता सिडकोची विशेष नियोजन प्राधिकरण म्हणून नियुक्ती रद्द करणे आणि सदर ३० गावे उक्त अधिसूचित क्षेत्रात समाविष्ट करून त्याकरिता उक्त विशेष नियोजन प्राधिकरणास उक्त ३० गावांसाठी विशेष नियोजन प्राधिकरण म्हणून नियुक्त करणे उचित होईल, असे शासनाचे मत झाले आहे;
आणि त्याआर्थी, आता उक्त अधिनियमाच्या कलम ४० चे पोट-कलम (१) (बी) मधील तरतुदीनुसार शासनास प्राप्त असलेल्या व इतर सर्व शक्तीस अनुसरुन महाराष्ट्र शासन याद्वारे---
(१) सोबत जोडलेल्या अनुसुचीमध्ये नमूद नवी मुंबई विमानतळ प्रभाव अधिसूचित क्षेत्रामधील ३० गावांच्या महसुली क्षेत्राकरिताची शहर व औद्योगिक विकास महामंडळाची (सिडको) विशेष नियोजन प्राधिकरण म्हणून नियुक्ती रद्द करीत आहे.
(२) सोबत जोडलेल्या अनुसूचीमधील ह्य ३० गावांच्या महसुली क्षेत्राकरिता महाराष्ट्र राज्य रस्ते विकास महामंडळाची (एमएसआरडीसी) विशेष नियोजन प्राधिकरण म्हणून नियुक्ती करण्यात येत आहे.
(३) सदरची अधिसूचना शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून अंमलात येईल.
(४) सदरचे ३० गावांकरिता मंजूर व प्रारुप मुंबई महानगर प्रदेशाच्या प्रादेशिक योजनेमधील जमीन वापर प्रस्ताव व विकास नियंत्रण नियमावली लागू राहील.

NOTIFICATION
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-1717/2750/CR 91/19/ MSRDC /UD-12.—Whereas, the City and Industrial Development Corporation (CIDCO) (hereinafter referred to as "the said Corporation") had been appointed as a Special Planning Authority (hereinafter referred to as "the said Authority") under the provision of 40(1)(b) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") for the Navi Mumbai Airport Influence Notified Area (hereinafter referred to as " the said Area ") vide Government in Urban Development Department Notification No. TPS-1712/475/CR 98/12/UD-12, dated the 10th January 2013;
And whereas, the Government has appointed the Maharashtra State Road Development Corporation Ltd. (MSRDC) (hereinafter referred to as " the said Corporation") as a 'Special Planning Authority' (hereinafter referred to as "the said Special Planning Authority") under the provisions of section 40 of the said Act, vide Notification No. TPS-1815/UOR/78/ 15/UD-13, dated 17th February 2016 for the area between Mumbai-Pune Express Way and Mumbai-Pune Old National Highway (NH4) and for the land within the 2.00 k.m. South-West from Mumbai-Pune Express way, excluding the area of Pune-District (hereinafter referred to as "the said Notified Area.");
And whereas, considering the contiguity of the said area from the planning point of view and after making necessary enquires, the Government is of the opinion that the 30 Villages from the Khalapur Tahsil should be excluded from the said area and the appointment of the CIDCO as the Special Planning Authority is to be withdrawn for these 30 Villages and these 30 Villages are to be included in the said Notified Area and the said Special Planning Authority is to be appointed as the Special Planning Authority for the said 30 Villages.
Now therefore, in exercise of the powers conferred under clause (b) of sub-section (1) of section 40 of the said Act and all other powers enabling it in this behalf, the Government of Maharashtra hereby—
(i) Withdraw the appointment of the City and Industrial Development Corporation (CIDCO) as the Special Planning Authority for the 30 Revenue Villages of the Navi Mumbai Airport Influence Notified Area as specified in the schedule appended hereto.
(ii) Appoints the Maharashtra State Road Development Corporation Ltd. (MSRDC) to be the Special Planning Authority for these 30 Revenue Villages as specified in the schedule appended hereto.
(iii) Fixes the date of publication of this notification in the Government Gazette as the date of coming into force of this notification.
(iv) The land use proposals and the Development Control Regulations of sanctioned and Draft Regional Plan of Mumbai Metropolitan Region will be applicable for these 30 Villages.
2. Copy of the plan showing the boundaries of the aforesaid 30 Revenue Villages shall be available for inspection for the general public during office hours on all working days at the following offices for a period of one month:—
(i) The Managing Director, Maharashtra State Road Development Corporation Ltd. , Nepeance Road, Mumbai.
(ii) The Managing Director, City and Industrial Development Corporation, CIDCO Bhavan, CBD Belapur, Navi Mumbai 400 614.
(iii) The Collector, Raigad.
(iv) The Joint Director of Town Planning, Konkan Division, Konkan Bhavan, Navi Mumbai.
(v) The Assistant Director of Town Planning, Raigad Alibaug Branch, Raigad.
