ज्याअर्थी मौजे कुडासे, ता. दोडामार्ग, जि. सिंधुदुर्ग या गावाचे नैर्सगिकरित्या भौगोलिक परिस्थिती पाहता सदर गावातून तिलारी नदी वाहत असलेने गावाचे दोन भाग होऊन नदीच्या दक्षिणेस वानोशीवाडी, धनगरवाडी व देवमळावाडी या ३ वाडया तर नदीच्या उत्तरेस गावठाणवाडी, हरीजनवाडी, भरपालवाडी व राऊळवाडी या ४ वाडया आहेत. नदीच्या उत्तरेस कुडासे गावची ग्रामपंचायत ही गावठाणवाडीमध्ये आहे. पावसाळी हंगामात नदीच्या दक्षिणेकडील लोकांना म्हणेजच वाणोशीवाडी, धनगरवाडी व देवमळावाडी या वाडयांना सध्याची अस्तित्वात असलेली ग्रामपंचायत कार्यालयात किंवा अन्य शासकीय कार्यालयांशी संपर्क साधणेसाठी अंदाजे १५ ते १६ किमी अंतर पार करून जावे लागते ते गैरसोयीचे ठरते.

त्यामुळे या वाडयातील ग्रामस्थांना वैद्यकीय उपचार अगर अन्य दैनंदिन व्यवहारासाठी भेडशी किंवा दोडामार्ग हे अंतर ६ ते ७ किमी असल्याने ते जवळ व सोईचे आहे. वानोशीवाडी, देवमळावाडी व धनगरवाडी या वाडीतील अंदाजित २९६ कुटुंबे असून त्यांची सध्याची लोकसंख्या ८६९ एवढी आहे. या वाडयांमध्ये शैक्षणिक सुविधा, प्राथमिक शाळा, माध्यमिक व उच्च माध्यमिक शाळा, स्मशानभुमी अशा सुविधा आहेत. तसेच सदर ३ वाडयांमध्ये स्वतंत्र मतदान केंद्र आहेत. उप विभागीय अधिकारी सावंतवाडी यांनी वानोशीवाडी, देवमळावाडी व धनगरवाडी या एकूण ३ वाडयांचा समावेश करून नवीन "" वानोशी "" हे महसुली गाव निर्माण केल्यास येथील ग्रामस्थांना सोईस्कर होणार असून शैक्षणिक व आरोगयदृष्टया चांगल्या सोई सुविधा मिळणार असल्याने शिफारस केली आहे.

त्याअर्थी, शासकीय अधिसूचना महसूल व वन विभाग क्र. टीएलसी-१०७९/६३९२३/म-६, दिनांक १ जुलै १९७६ अन्वये महाराष्ट्र जमीन महसूल अधिनियम, १९६६ चे कलम ४ पोट-कलम (१) च्या परंतुखाली राज्य शासनास असलेल्या शक्ती जिल्हाधिकारी यांना प्रदान करण्यात आल्या आहेत त्याचा वापर करून मी, डॉ. दिलीप पांढरपट्टे, जिल्हाधिकारी सिंधुदुर्ग, सिंधुदुर्ग जिल्ह्यतील दोडामार्ग, तालुक्यातील खालील अनुसूचीतील स्तंभ क्र.२ मधील गावांची विभागणी करून नवीन महसूल गाव निर्माण करीत आहे आणि असा निर्देश देत आहे की,---

(१) यापूर्वी स्तंभ क्र. २ मधील गावाच्या क्षेत्रात असलेले भूमापन क्रमांक अनुसुचीतील स्तंभ क्र. ५ मध्ये र्िवनिदिष्ट केलेप्रमाणे समाविष्ट असलेले स्थानिक क्षेत्र सिंधुदुर्ग जिल्ह्यच्या दोडामार्ग तालुक्यातील अनुसुचीतील स्तंभ क्र. ४ मध्ये र्िवनिदिष्ट केलेली अ.क्र. (१) कुडासे व (२) वानोशी ही महसुली गावे होतील.

(२) सिंधुदुर्ग जिल्ह्यच्या दोडामार्ग तालुक्यातील अनुसुचीतील स्तंभ ३ मध्ये र्िवनिदिष्ट केलेल्या हद्दी असलेल्या सिंधुदुर्ग जिल्ह्यच्या दोडामार्ग तालुक्यातील अनुसूचीतील स्तंभ क्र. ४ मध्ये र्िवनिदिष्ट केलेल्या नावाने ओळखण्यात येणाया गावात रुपांतर करीत आहे.

(३) सदर अधिसूचनेचा परिणाम होण्याचा संभव असलेल्या सर्व व्यक्तीच्या माहितीसाठी याद्वारे प्रसिद्ध करणेत येत आहे की, सदर प्रारूप अधिसूचनेबाबत ज्यांना कोणाला हरकत किंवा सूचना करावयाची असेल ती दिनांक ७ ऑक्टोबर २०१९ पयर्ंत लेखी स्वरुपात तहसिलदार दोडामार्ग किंवा उप विभागीय अधिकारी, सावंतवाडी यांचे कार्यालयात सादर करावी. सदर हरकती किंवा सूचना उपरोक्त तारखेपूर्वी प्राप्त राहतील त्या विचारात घेतल्या जातील.

ज्याअर्थी, शासनाचे उद्योग, ऊर्जा व कामगार विभागाची अधिसूचना क्रमांक आय.आय.ए. पॉलिसी. २०१०/प्र.क्र.७६८/उद्योग-२, दिनांक २२ फेब्रुवारी २०१३ अन्वये महाराष्ट्र औद्योगिक धोरण-२०१३ जाहीर करणेत आले (यापुढे " उक्त धोरण " असे नमूद केले आहे.) ;

आणि ज्याअर्थी, जे क्षेत्र शासनाचे भूसंपादन कायदा, १८९४ अथवा महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ अन्वये भूसंपादित झालेले नाही, त्याचे क्षेत्रफळ हे किमान ४० हेक्टर असेल, अशा खाजगी क्षेत्रावर एकात्मिक औद्योगिक क्षेत्र विकसित करण्याची योजना राबविण्याचा निर्णय महाराष्ट्र शासनाने घेतलेला आहे, की, जी योजना उक्त औद्योगिक धोरणातील अनुसूची अ मधील परिच्छेद - ४(अ) व ४(ब) मध्ये नमूद आहे ;

आणि ज्याअर्थी, महाराष्ट्र ओद्योगिक विकास अधिनियम, १९६१ चे कलम ४३(१-ब) नुसार महामंडाळास कोणत्याही औद्योगिक क्षेत्राला राजपत्रातील अधिसुचनेद्वारे एकात्मिक औद्योगिक क्षेत्र म्हणून अधिसूचित करता येईल व सदर एकात्मिक औद्योगिक क्षेत्राला महामंडळ विशेष नियोजन प्राधिकरण म्हणून महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ च्या कलम ११५(३) अन्वये काम करू शकेल ;

आणि ज्याअर्थी, मे. महर्षी वेदिक हेल्थ प्रा. लि., यांनी अर्जान्वये प्रस्तावित मौजे वहाणगाव, ता. मावळ, जि. पुणे येथील क्षेत्राला एकात्मिक औद्योगिक क्षेत्र म्हणून घोषित करण्याची महामंडळास विनंती केली आहे ;

आणि ज्याअर्थी, दिनांक १९ ऑक्टोबर २०१८ व २८ जानेवारी २०१९ रोजी संपन्न झालेली ९७ व १०० व्या उच्चाधिकार समितीचे बैठकीत मे. महर्षी वेदिक हेल्थ प्रा. लि., यांचे प्रस्तावित मौजे वहाणगाव, ता. मावळ, जि. पुणे येथील क्षेत्राला एकात्मिक औद्योगिक क्षेत्र विकासाला सहमती दर्शविली आहे ;

आणि ज्याअर्थी, महाराष्ट्र शासनाने उद्योग, उर्जा व कामगार विभागाने त्यांची अधिसूचना क्रमांक आय.आय.आय.२०१९/प्र.क्र.४३४/ड-१४, दिनांक ६ ऑगस्ट २०१९, अन्वये मौजे वहाणगाव, ता. मावळ, जि. पुणे येथील ७४.०५.१५ हे.आर. क्षेत्र महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ चे कलम २ (खंड-ग) अन्वये औद्योगिक क्षेत्र म्हणून जाहीर केले आहे.

त्याअर्थी, शासनाचे महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ (सन २०१३ चा सुधारणा अधिनियम, १५) च्या कलम ४३ (खंड-१ब) अन्वये महामंडळास प्रदान केलेल्या शक्तीचा वापर करून, मी, डॉ. पी. अनबलगन, मुख्य कार्यकारी अधिकारी, महाराष्ट्र औद्योगिक विकास महामंडळ याद्वारे उपरोक्त अधिसूचित झालेल्या मौजे वहाणगाव, ता. मावळ, जि. पुणे येथील खालील अनुसूचित उल्लेखिलेल्या खाजगी क्षेत्रास एकात्मिक औद्योगिक क्षेत्र म्हणून घोषित करीत आहे.

MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT, 1961.

Whereas, Maharashtra Industrial Policy, 2013, has been published by Government in Industries, Energy and Labour Department vide its Notification No. III-Policy 2010/C.R.768/ Industry-2, dated 22nd February 2013 (herein referred as " the said Policy ") ;

And whereas, the Government of Maharashtra has decided to implement the scheme of developing Integrated Industrial Areas on private lands admeasuring at least 40 Hect, not acquired under the Land Acquisition Act of 1894 or Maharashtra Industrial Development Act, 1961, in accordance with para 4(a) and 4(b) of the schedule-A appended to the said policy;

And whereas, as per section 43(1B) of Maharashtra Industrial Development Act,1961, that subject to the general or specific directions of the State Government, the Corporation may, by notification in the Official Gazette, notify any industrial area as the 'Integrated Industrial Area' and upon such notification, the Corporation shall become the ' Special Planning Authority ' for such 'Integrated Industrial Area' under the Maharashtra Regional and Town Planning Act, 1966 ;

And whereas, M/s. Maharishi Vedic Health Pvt. Ltd. made an application requesting MIDC to notify their proposed project area in Village Vahangaon, Taluka Maval, District Pune as ' Integrated Industrial Area ' ;

And whereas, the High Power Committee in its 97 and 100th meeting held on 19th October 2018 and 28th January 2019 has approved the proposal of an ' Integrated Industrial Area ' proposed to be developed by, M/s. Maharishi Vedic Health Pvt. Ltd. in Village Vahangaon, Taluka Maval, District Pune ;

And whereas, vide its, Notification No. IDC-2019/ C.R. 434/Ind. 14, dated 6th August 2019 of Industries, Energy and Labour Department, Government of Maharashtra declared 74.05.15 HR area of Village Vahangaon, Taluka Maval, District Pune to be an ' Industrial Area ' under clause (g) of section 2 of Maharashtra Development Act, 1961.

Since, the Government of Maharashtra, by clause (1B) of section 43 of the Maharashtra Industrial Development Act, 1961 (Mah.XV of 2013), conferred the power to declare an 'Integrated Industrial Area', for the purpose of the said Act to the Chief Executive: Officer, MIDC, I, DR. P. Anbalagan, in exercise of the power under the said Act hereby notify the area at Village Vahangaon, Taluka Maval, District Pune as per appended schedule as ' Integrated Industrial Area ' ;

A copy of this Notification and plan showing boundaries of the proposed 'Integrated Industrial Area' shall form part of this Notification.

संदर्भ क्रमांक मौआअआविम/२०१९/३४९, दिनांक ३१ मे २०१९ अन्वये मौलाना आज़ाद अल्पसंख्याक र्आथिक विकास महामंडळाच्या कर्मचायांसाठी सेवाशर्ती विहित करण्याकरिता शासनास प्रस्ताव सादर करण्यात आला होता. शासन पत्र अल्पसंख्याक विकास विभाग क्र. मौआम/२०१९/प्र. क्र. १०७/१३/का-८, दिनांक १२ जुलै २०१९ अन्वये प्राप्त झालेल्या अनुमतीनुसार, तसेच मौलाना आजाद अल्पसंख्याक र्आथिक विकास महामंडळ मर्यादित, मुंबईच्या संस्थापन नियमावली खंडाच्या परिच्छेद क्र.१३, नियम ८५(५) नुसार महामंडळाचे अध्यक्ष व संचालक मंडळ याद्वारे महाराष्ट्र शासनाच्या अल्पसंख्याक विकास विभागाच्या प्रशासकीय नियंत्रणांतर्गत महामंडळातील कर्मचायांच्या सेवाशर्ती व भर्ती नियमित करण्यासाठी खालील नियम प्रसिद्ध करित आहे.

१. या नियमास मौलाना आज़ाद अल्पसंख्याक र्आथिक विकास महामंडळ मर्यादित, सेवाप्रवेश नियम, २०१६ असे सबोधण्यात यावे.

२. या नियमांमध्ये, संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर,---

(अ) " शासन " म्हणजे महाराष्ट्र शासन ;

(ब) " अल्पसंख्याक विकास विभाग " म्हणजे महाराष्ट्र शासनाचा अल्पसंख्याक विकास विभाग ; (क) " महामंडळ " म्हणजे मौलाना आज़ाद अल्पसंख्याक र्आथिक विकास महामंडळ मर्यादित, मुंबई ; (ख) " मंडळ " म्हणजे मौलाना आज़ाद अल्पसंख्याक र्आथिक विकास महामंडळ मर्यादित, मुंबईचे संचालक मंडळ. (ग) " व्यवस्थापकीय संचालक " म्हणजे मौलाना आज़ाद अल्पसंख्याक र्आथिक विकास महामंडळ मर्यादित, मुंबईचे व्यवस्थापकीय संचालक ;

(घ) " पदवी " म्हणजे कोणत्याही सांविधिक विद्यापीठाची पदवी ;

(ड) " मान्यताप्राप्त संस्था " म्हणजे महाराष्ट्र शासनाद्वारे मान्यताप्राप्त संस्था ;

(च) " माध्यमिक शाळा प्रमाणपत्र परीक्षा " म्हणजे महाराष्ट्र माध्यमिक व उच्च माध्यमिक शिक्षण मंडळे अधिनियम, १९६५ (सन १९६५ चा महाराष्ट्र अधिनियम क्र. ४१) अन्वये गठित केलेल्या विभागीय मंडळाद्वारे घेतलेली माध्यमिक शाळा प्रमाणपत्र परीक्षा समतूल्य असल्याचे शासनाद्वारे घोषित केलेल्या इतर कोणत्याही परीक्षेचा समावेश असेल ;

(छ) " शासकीय वाणिज्य प्रमाणपत्र " म्हणजे शासकीय परीक्षा केंद्र, शिक्षण विभाग, महाराष्ट्र शासन यांनी जारी केलेले प्रमाणपत्र आणि त्यास समतूल्य असल्याचे शासन विशेषत: घोषित करेल त्याप्रमाणे कोणत्याही इतर संस्थेद्वारे जारी केलेले प्रमाणपत्र समावेश असेल ;

३. सर्वसाधारण अटी.---

(अ) खुल्या वर्गाच्या उमेदवारांसाठी उच्च वयाची मर्यादा आणि मागासवर्गीय, शारीरिक अपंग व्यक्ती, माजी सैनिक, महिला, प्रकल्पग्रस्त व्यक्ती इत्यादीचे काही विशिष्ट प्रवर्गातील उमेदवारांची सेवा प्रवेशाच्या वेळी वयोमर्यादा ही सरळसेवेने रिक्त पदे भरण्याकरिता लागू असलेल्या शासकीय धोरणानुसार असावी. त्याचप्रमाणे, सामाजिक आरक्षण आणि समांतर आरक्षण यांच्या संदर्भात विद्यमान सरकारी धोरण रिक्त पदे भरण्यासाठी लागू असेल.

(ब) उमेदवार हा महाराष्ट्र राज्याचा रहिवासी असावा आणि त्यास मराठी भाषेचे पुरेसे ज्ञान असावे. (ई) शासकीय सेवातील कर्मचायास लागू असेल त्याप्रमाणे वैद्यकीय चाचणी, चारिय आणि पूर्वचरित्र पडताळणी, कुटुंब मर्यादा, जात वैधता, परिवीक्षाधीन कालावधी, माहिती व तंत्रज्ञान संचालनालय यांनी विहित केलेली संगणक हाताळणी मधील परीक्षा उत्तीर्ण, निवृत्तीचे वय, इत्यादी हे नामनिर्देशनाने महामंडळाच्या सेवेमध्ये नियुक्त होण्याकरिता निवड झालेल्या उमेदवारांना लागू होईल. ४. सेवाप्रवेशाच्या योग्य प्रकियेचे पालन केल्यानंतर महामंडळाद्वारे जे कर्मचारी कंत्राटी तवावर नियुक्त करण्यात आलेले आहेत आणि ज्याचे वय हे नियुक्तीच्या वेळी सरळ सेवाप्रवेशाकरिता शासनाने विहित केलेल्या उच्च वयोमर्यादेपेक्षा कमी आहे आणि जे कर्मचारी सध्या महामंडळाच्या सेवेत आहेत असे कर्मचारी ते काम करीत असलेल्या पदाच्या सरळ सेवाप्रवेशाचे नमूद पात्रता निकष पूर्ण करीत असल्यास नियमित तवावर महामंडळाच्या सेवेमध्ये नियुक्तीसाठी पात्र असतील, तथापि, सदरची तरतूद ही फक्त हे नियम प्रसिद्ध करण्यापूर्वी महामंडळात नियुक्त करण्यात आलेल्या कर्मचायांसाठीच लागू राहील.

५. महामंडळाच्या कार्यालय/कार्यालयामधील विविध पदांच्या नियुक्त्या ह्य खाली नमूद प्रमाणे करण्यात येतील.

(१) व्यवस्थापकीय संचालक (गट-अ).-----

अल्पसंख्याक विकास विभागांतर्गत मौलाना आज़ाद अल्पसंख्याक र्आथिक विकास महामंडळ मर्यादित, मुंबई यांच्या कार्यालयातील व्यवस्थापकीय संचालक (गट-अ) या पदावरील नियुक्ती ही मंत्रालयातील उप सचिव किंवा सहसचिव किंवा महाराष्ट्र शासनाच्या सेवेतील अन्य समकक्ष संवर्गातील अधिकायांच्या प्रतिनियुक्तीने केली जाईल. परंतु असे की, अशा अधिकायाच्या प्रतिनियुक्तीचा विहित कालावधी पूर्ण होण्याच्या अगोदर कोणत्याही वेळी प्रतिनियुक्तीने नियुक्त झालेल्या अधिकायास शासन परत बोलावू शकेल.

(२) सह व्यवस्थापकीय संचालक (गट-अ).----

महामंडाळाच्या सह व्यवस्थापकीय संचालक (गट-अ) पदावरील नियुक्ती खालीलपैकी कोणत्याही एका प्रकारे केली जाईल,-----

(अ) महामंडाळाच्या व्यवस्थापक पदावर किमान १० वर्षे अनुभव असणाया पात्र, सुयोग्य व्यक्तीची सेवाजेष्ठता तवावर पदोन्नतीने, किंवा

(ब) महाराष्ट्र शासनाच्या मंत्रालयाच्या कोणत्याही विभागामधील अवर सचिव संवर्गातून किंवा महाराष्ट्र शासनाच्या इतर कोणत्याही संवर्गातील समकक्ष अधिकायाच्या प्रतिनियुक्तीने शासनाने निश्चित केलेल्या कालावधीसाठी :

परंतु असे की, अशा अधिकायाच्या प्रतिनियुक्तीचा विहित कालावधी पूर्ण होण्याच्या अगोदर कोणत्याही वेळी प्रतिनियुक्तीने नियुक्त झालेल्या अधिकायास शासन परत बोलावू शकेल.

(३) कंपनी सचिव.---- महामंडळाच्या कार्यालयामध्ये कंपनी सचिव (गट-अ) या पदावरील नियुक्ती ही उमेदवाराचा बायोडाटा, अनुभव व मुलाखतीच्या आधारावर दोन वर्षाच्या कालावधीकरिता पूर्णवेळ किंवा अर्धवेळ तवावर केली जाईल. नियुक्तीकरिता पात्र होण्याकरिता,----

(i) उमेदवाराचे वय ५० वर्षापेक्षा जास्त नसावे. (ii) उमेदवाराकडे कंपनी सचिवाची पदवी असणे आवश्यक आहे आणि तो कंपनी सचिवाच्या (राज्यस्तरीय) संघटनेचा सदस्य असणे आवश्यक आहे ;

(iii) उप-खंड (II) मध्ये उल्लेखित पात्रता प्राप्त केल्यानंतर किमान २ वर्ष इतक्या कालावधीचा कंपनी सचिव म्हणून काम करण्याचा प्रत्यक्ष अनुभव असणे आवश्यक आहे.

अशा नियुक्त केलेला पूर्णवेळ किंवा अर्धवेळ कंपनी सचिवास निवड समिती निश्चित करेल त्याप्रमाणे असे एकरकमी पारिमाश्रिक अदा करण्यात येईल. (४) व्यवस्थापक.--- महामंडळाच्या कार्यालयातील व्यवस्थापक पदावरील नियुक्ती ही खालील पैकी कोणत्याही प्रकारे केली जाईल :-----

(अ) महामंडाळाच्या कार्यालयात उप व्यवस्थापक पद धारण करणाया व पदावर ५ वषार्ंचा किमान अनुभव असणाया

पात्र व सुयोग्य व्यक्तींमधून सेवाजेष्ठतेच्या आधारावर योग्य व्यक्तीच्या पदोन्नतीने.

किंवा,

(ब) महाराष्ट्र शासनाच्या मंत्रालयाच्या कोणत्याही विभागातील समान वेतनश्रेणीत वेतन घेणाया कक्ष अधिकारी संवर्गातून किंवा त्यास समकक्ष कोणत्याही इतर संवर्गातून योग्य अधिकायाच्या प्रतिनियुक्तीने, शासनाने निश्चित केलेल्या कालावधीसाठी :

परंतु असे की, अशा अधिकायाच्या प्रतिनियुक्तीचा विहित कालावधी पूर्ण होण्याआधी कोणत्याही वेळी शासन प्रतिनियुक्तीने नियुक्त झालेल्या अधिकायास परत बोलावू शकेल. (५) सिस्टीम अॅनालिस्ट.--- महामंडळाच्या कार्यालयातील सिस्टम अॅनालिस्ट पदाची नियुक्ती ही प्रत्येक वेळी बायोडाटा, अनुभव आणि मुलाखतीच्या आधारावर योग्य उमेदवाराच्या निवडीने दोन वर्षाच्या कालावधीकरिता पूर्ण वेळ किंवा अर्धवेळ तवावर करण्यात येईल. नियुक्तीसाठी पात्र होण्यासाठी, उमेदवार,----

(i) उमेदवाराचे वय ५० वर्षापेक्षा जास्त नसावे. (ii) कमीतकमी २ या श्रेणीतील वैधानिक विद्यापीठाची संगणक अभियांत्रिकी मधील पदवी/पदव्युत्तर असणे आवश्यक आहे ; (iii) उप-खंड (ii) मध्ये उल्लेखित पात्रता प्राप्त केल्यानंतर २ वषार्ंपेक्षा कमी नसलेल्या कालावधीसाठी डिझाइनिंग संगणक भाग दोन (संकीर्ण)---२अ१२ महाराष्ट्र शासन राजपत्र, भाग दोन-संकीर्ण सूचना व जाहिराती, गुरुवार ते बुधवार, सप्टेंबर २६-ऑक्टोबर २, २०१९/आशि्वन ४-१०, शके १९४१ सॉफ्टवेअर आणि सिस्टम अॅडमिनिस्ट्रेटर चा प्रत्यक्ष अनुभव असणे आवश्यक आहे. पूर्णवेळ किंवा अर्धवेळ म्हणून नियुक्ती झाल्यास सिस्टम अॅनालिस्ट यास निवड समितीद्वारे निश्चित केल्याप्रमाणे एक रकमी पारिश्रमिक अदा केले जाईल. (६) उप व्यवस्थापक.--महामंडळाच्या कार्यालयातील उप व्यवस्थापक पदाची नियुक्ती खालील पैकी एका प्रकारे केली जाईल -- (अ) जिल्हा स्तरीय जिल्हा व्यवस्थापक किंवा महामंडळाच्या मुख्यालयातील सहायक व्यवस्थापक पद धारण करणाया व या पदावर काम करण्याचा किमान ५ वषार्ंचा अनुभव असणाया पात्र व सुयोग्य व्यक्तीमधून सेवाजेष्ठतेच्या आधारावर पदोन्नतीने

किंवा

(ब) महाराष्ट्र शासनाच्या मंत्रालयातील समान वेतनश्रेणीत वेतन घेणाया कक्ष अधिकारी संवर्गातून किंवा त्यास समकक्ष कोणत्याही इतर संवर्गातील योग्य व्यक्तीच्या प्रतिनियुक्तीने शासनाने निश्चित केलेल्या कालावधीसाठी परंतु असे की, महामंडळाशी सल्लामसलत करून किंवा महामंडळाचा अहवाल प्राप्त झाल्यावर कोणत्याही वेळी प्रतिनियुक्तीने नियुक्त झालेल्या अशा अधिकायास शासन परत बोलावू शकेल. (७) लेखा अधिकारी.--महामंडाळाच्या कार्यालयातील लेखा अधिकारी पदावरील नियुक्ती, लेखा व कोषागार संचालनालयामधील लेखा अधिकारी संवर्गातील किमान २ वर्षे अनुभव असणाया योग्य व्यक्तीच्या बदली किंवा प्रतिनियुक्तीने केली जाईल. परंतु असे की, महामंडळाशी सल्लामसलत करून किंवा महामंडळाचा अहवाल प्राप्त झाल्यावर कोणत्याही वेळी प्रतिनियुक्तीने नियुक्त झालेल्या अशा अधिकायास शासन परत बोलावू शकेल.

(८) स्वीय सहायक (लघुलेखक-उच्च श्रेणी).--महामंडाळाच्या कार्यालयातील लघुलेखक-उच्च श्रेणी पदाची नियुक्ती ही खालील पैकी एका प्रकारे केली जाईल :---

(अ) खालील खंड (ब) चा उपखंड (ii) मध्ये विहित केलेल्या गतीचे लघुलेखन व टंकलेखनातील शासकीय वाणिज्य प्रमाणपत्र असणाया, निम्नश्रेणी लघुलेखकाचे पद धारण करणाया व किमान तीन वर्ष नियमित सेवा पूर्ण केलेल्या पात्रता व योग्यतेच्या अधीन राहून सेवाजेष्ठतेच्या आधारावर व योग्य व्यक्तीच्या पदोन्नतीने

किंवा

(ब) खालील अर्हता धारणा करणाया उमदेवाराद्वारे सरळसेवा भरतीने :-----

(i) ज्यांनी पदवी धारण केलेली आहे ;

(ii) लघुलेखन गती १२० शब्द प्रति मिनिटापेक्षा कमी नसलेल्या व इंग्रजी टंकलेखन गती ४० शब्द प्रति मिनिटापेक्षा कमी नसलेल्या किंवा मराठी टंकलेखन गती ३० शब्द प्रति मिनिट पेक्षा कमी नसलेल्या गतीने शासकीय वाणिज्य प्रमाणपत्र असणे आवश्यक आहे ; आणि

(iii) वय १८ वर्षे पूर्ण असणे आवश्यक ;

(९) उप लेखा अधिकारी.--महामंडाळाच्या कार्यालयातील उप लेखा अधिकारी पदावरील नियुक्ती ही लेखा व कोषागार संचालनालय मधील सहायक लेखा अधिकारी संवर्गातून त्या पदावर किमान २ वर्ष अनुभव असणाया योग्य व्यक्तीच्या बदलीने किंवा प्रतिनियुक्तीने करण्यात येईल. परंतु असे की, महामंडळाशी सल्लामसलत करून किंवा महामंडळाचा अहवाल प्राप्त झाल्यावर कोणत्याही वेळी प्रतिनियुक्तीने नियुक्त झालेल्या अशा अधिकायास शासन परत बोलावू शकेल.

(१०) स्वीय सहायक (लघुलेखक-निम्नश्रेणी).--महामंडळाच्या कार्यालयातील लघुलेखक-निम्न श्रेणीच्या पदाची नियुक्ती ही खालील अर्हता धारण करणाया उमेदवारामधून नामनिर्देशनाने करण्यात येईल :-----

(i) ज्यांनी पदवी धारण केलेली आहे.

(ii) लघुलेखन गती १०० शब्द प्रति मिनिटापेक्षा कमी नसलेल्या व इंग्रजी टंकलेखन गती ४० शब्द प्रति मिनिटापेक्षा कमी नसलेल्या किंवा मराठी टंकलेखन गती ३० शब्द प्रति मिनिट नसलेल्या शासकीय व्यवसायिक प्रमाणपत्र धारक, आणि,

(iii) वय वर्षे १८ पूर्ण असणे आवश्यक ;

(११) सहायक व्यवस्थापक आणि जिल्हास्तरीय जिल्हा व्यवस्थापक :-----

(i) महामंडाळाच्या मुख्य कार्यालयातील सहायक व्यवस्थापक पद आणि जिल्हा स्तरीय महामंडळाच्या कार्यालयातील जिल्हा व्यवस्थापक या पदावरील नियुक्ती खालील पैकी एका प्रकारे केली जाईल -----

(अ) जिल्हा स्तरीय महामंडाळाच्या कार्यालयामधील सहायक व्यवस्थापक किंवा प्रादेशिक वसुली अधिकारी या पदावर किमान ३ वर्षे अनुभव असणाया व खालील उपखंड (क) मधील विहित अर्हता धारण करणाया पात्र व सुयोग्य व्यक्तींमधून सेवाजेष्ठता आधारावर पदोन्नतीने,

किंवा

(ब) मंत्रालयातील कोणत्याही विभागामध्ये सहायक कक्ष अधिकारी पदावर कार्यरत असलेल्या किंवा महाराष्ट्र शासनाच्या इतर कोणत्याही विभागांतर्गत कोणत्याही इतर समकक्ष संवर्गातील त्या पदावर किमान ३ वर्षे अनुभव असलेल्या योग्य व्यक्तीच्या प्रतिनियुक्तीने.

परंतु असे की, शासन महामंडळाशी सल्लामसलत केल्यानंतर किंवा महामंडळाकडून प्राप्त अहवालावर कोणत्याही वेळी अशा प्रतिनियुक्तीवर नियुक्त केलेल्या अधिकायास शासन परत बोलावू शकेल.

किंवा

(क) महामंडळाने किंवा त्यांच्या वतीने, महामंडळाने नियुक्त कोणत्याही संस्थेने घेतलेल्या स्पर्धात्मक परीक्षेच्या निकालाच्या आधारावर खालील अर्हता धारण करणाया उमेदवारामधून नामनिर्देशनाने, :-----

(i) वय वर्षे १८ पूर्ण असणे आवश्यक ;

(ii) किमान द्वितीय श्रेणीतील वैधानिक विद्यापीठाची पदवी धारण केली असणे आवश्यक ;

(iii) नामनिर्देशन आणि पदोन्नतीने नियुक्तीसाठी गुणोत्तर प्रमाण ५०:५० असे असेल.

(१२) सहायक व्यवस्थापक आणि वसुली अधिकारी :-----

(१) जिल्हा स्तरावर महामंडाळाच्या सर्व कार्यालयांमध्ये सहायक व्यवस्थापक पदाची व आणि प्रादेशिक स्तरावर वसुली अधिकारी यांची नियुक्ती खालीलपैकी एका मार्गाने करण्यात येईल :-----

(अ) खालील खंड (ब) च्या उप-खंड (ii) मधील सरळसेवा भरतीसाठी पात्र असलेल्या लिपिक-टंकलेखक पद धारण करणाया व लिपिक-टंकलेखक पदावर किमान १० वर्षे नियमित सेवा पूर्ण केलेल्या व्यक्तींतून पात्रता व योग्यतेच्या अधीन राहून सेवाजेष्ठतेच्या आधारावर योग्य व्यक्तीच्या पदोन्नतीने

किंवा

(ब) महामंडळाने किंवा त्यांच्यावतीने महामंडळाने नियुक्त कोणत्याही संस्थेने घेतलेल्या स्पर्धात्मक परीक्षेच्या निकालाच्या आधारावर खालील अर्हता धारण करणाया उमेदवारांमधून सरळ सेवा भरतीने,----

(i) वय वर्षे १८ पूर्ण करणे आवश्यक ;

(ii) वैधानिक विद्यापीठाची पदवी धारण केली असणे आवश्यक ;

(२) पदोन्नती व नामनिर्देशनाने नियुक्तीसाठी गुणोत्तर प्रमाण २०:८० असेल.

(१३) लिपिक-टंकलेखक :-----

(i) लिपिक-टंकलेखक पदाची नियुक्ती महामंडाळाच्या सर्व कार्यालयांमध्ये उदा. मुख्य कार्यालय, जिल्हा स्तर आणि प्रादेशिक स्तरावर, खालील प्रकारे केली जाईल,---

(अ) खालील खंड (ब) मधील उपखंड (ii) मध्ये नामनिर्देशनाने नियुक्तीकरिता विहित पात्रता धारण करणाया शिपाई पदावरील किमान ८ वर्षे नियमित सेवा पूर्ण केलेल्या अर्हताप्राप्त व्यक्तींमधून पात्रता व योग्यतेच्या अधीन राहून सेवाजेष्ठतेच्या आधारावर योग्य व्यक्तीची पदोन्नतीने.

किंवा

(बी) महामंडळाने किंवा महामंडळाच्या वतीने नियुक्त कोणत्याही संस्थेने घेतलेल्या स्पर्धात्मक परीक्षेच्या निकालाच्या आधारावर नियुक्तीकरिता पात्र ठरणाया खालील पात्रता व अर्हता धारण करणाया उमेदवारांच्या सरळसेवा भरतीने :-----

(i) वय वर्ष १८ पूर्ण असणे आवश्यक ;

(ii) ज्यांनी शासन मान्य माध्यमिक शालांत प्रमाणपत्र परीक्षा उत्तीर्ण केली आहे ; आणि

(iii) आवश्यकतेनुसार मराठी टंकलेखन गती ३० शब्द प्रति मिनिट पेक्षा कमी नसलेल्या किंवा यथास्थिती इंग्रजी टंकलेखन गती ४० शब्द प्रति मिनिट गतीचे शासकीय वाणिज्य प्रमाणपत्र असणे आवश्यक आहे.

(२) पदोन्नती व नामनिर्देशनाने नियुक्तीसाठी गुणोत्तर प्रमाण १०:९० असेल.

(१४) वाहनचालक.-----महामंडळाच्या कार्यालयातील मोटरकार आणि जीपच्या चालकांची नियुक्ती ही महामंडळाने नियुक्त केलेल्या निवड चाचणी आणि वाहन चालवण्याची चाचणीच्या निकालानुसार पात्रता व योग्यतेच्या आधारे नामनिर्देशनाने केली जाईल, ज्याने (i) ज्यांचे वय ३८ वषार्ंपेक्षा जास्त नाही ;

(ii) ज्यांना मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) मधील तरतुदीनुसार सक्षम अनुज्ञप्ती प्राधिकारी यांनी दिलेला हलके मोटार वाहन किंवा मध्यम प्रवासी वाहन किंवा जड प्रवासी वाहन चालविण्याचा परवाना धारण केला आहे ;

(iii) ज्यांनी शासन मान्य माध्यमिक शालांत प्रमाणपत्र परीक्षा उत्तीर्ण केली आहे ;

(iv) ज्यांनी शासकीय, निमशासकीय किंवा खाजगी संस्थेमध्ये हलके मोटार वाहन किंवा मध्यम प्रवासी वाहन किंवा जड प्रवासी वाहन चालविण्याचा परवाना धारण केला आहे ;

(v) मोटार वाहन दुरुस्तीचे जुजबी ज्ञान असणे आवश्यक ;

(vi) ज्यांचा वाहन चालविण्याचा स्वच्छ अभिलेख आहे व ज्यांचेकडे चांगली शारीरिक क्षमता आहे ;

टिप : वाहन चालविण्याचा स्वच्छ अभिलेख यामध्ये खालील बाबी येतात :-----

(१) वाहनचालक कोणतीही मादक द्रव्ये किंवा अल्कोहल सेवन करून वाहन चालविण्याचा किंवा मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) मधील कोणत्याही दखल पात्र अपराधासाठी दोषी सिद्ध झालेला नसावा.

(२) वाहनचालकाविरुद्ध अपघाताचा गुन्हा दाखल झालेला नसावा.

(vii) ज्यांना संबंंधित क्षेत्राची परिपूर्ण भौगोलिक माहिती आहे ; आणि

(viii) मराठी, हिंदी भाषा वाचता, बोलता आणि इंग्रजी भाषा वाचता येणे आवश्यक आहे ;

(ix) सदर पदावर नियुक्त होणाया व्यक्तीने नियुक्तीच्या वेळी वाहन चालविण्याची चाचणी उत्तीर्ण होणे अनिवार्य राहील ;

(x) सदर पदावर नियुक्त होणारी नियुक्ती शारीरिकदृष्टया पात्र असावी तसेच दृष्टीने चांगली असणे आवश्यक राहील. तो रातआंधळेपणा व रंग आंधळेपणा या व्याधींनी ग्रस्त नसावा. त्यांने नियुक्तीपूर्वी शारीरिकदृष्टया पात्र असल्याचे व दृष्टी चांगली असल्याचे सक्षम प्राधिकायाचे प्रमाणपत्र सादर करणे आवश्यक राहील.

(१५) शिपाई.----महामंडळाच्या कार्यालयांमध्ये शिपाई (गट-ड) पदाची नियुक्ती खालील अर्हता धारण करणाया उमेदवारांमधून सरळसेवा भरतीने केली जाईल.

(i) वय वर्षे १८ पूर्ण असणे आवश्यक ;

(ii) माध्यमिक शाळा प्रमाणपत्र परीक्षा उत्तीर्ण झाला आहे आणि मराठी लिहू, वाचू व बोलू शकतो.

६. निवड समितीची स्थापना :

(१) (i) नामनिर्देशनाने रिक्त पदे भरण्यासाठी निवड प्रक्रिया आयोजित करण्यासाठी, खाली नमूद केल्यानुसार निवड समिती-I या नावाची समिती असेल :

१. सचिव / प्रधान सचिव / अपर मुख्य सचिव, अल्पसंख्याक विकास विभाग, मंत्रालय अध्यक्ष २. सहसचिव / उप सचिव, अल्पसंख्याक विकास विभाग, मंत्रालय सदस्य ३. सहसचिव / उप सचिव, सामान्य प्रशासन विभाग, मंत्रालय सदस्य ४. अवर सचिव दर्जापेक्षा कमी दर्जाचे नसलेले सामाजिक न्याय विभागाचे प्रतिनिधी सदस्य ५. अवर सचिव दर्जापेक्षा कमी दर्जाचे नसलेले आदिवासी विकास विभागाचे प्रतिनिधी सदस्य ६. महामंडळाचे व्यवस्थापकीय संचालक

सदस्य-सचिव.

(ii) उपरोक्त समिती ही निवड राबविण्याची कार्यपद्धती निश्चित करेल तसेच उमेदवाराकडून आकारावयाचे अर्जाचे शुल्क, परीक्षा शुल्क ठरविल. समिती शासकीय सेवेमधील योग्य अधिकायांकडे उमेदवारांसाठी प्रश्नपत्रिका तयार करणे, उमेदवारांनी दिलेल्या उत्तरपत्रिकेचे मूल्यांकन करणे, उमेदवारांची मुलाखत (लागू असल्यास) इत्यादी काम सोपवू शकेल. समिती योग्य संस्थेकडे निवड प्रक्रिया आयोजित करण्याची कामाची जबाबदारी सोपविण्याचा निर्णय घेऊ शकेल.

(iv) उपरोक्त समिती ही नियम ४ प्रमाणे महामंडळाच्या सेवेमध्ये कार्यरत असलेल्या कंत्राटी कर्मचायांना नियमित सेवेत समावून घेण्याविषयी निर्णय घेईल.

(२) (i) सेवाज्येष्ठता व कामाचे मूल्यांकन अहवालाच्या आधारावर निम्न संवर्गाचे पद धारण करणाया कर्मचायांना पदोन्नती देण्याकरिता योग्य उमेदवार निवडीसाठी खाली नमूद केल्यानुसार निवड समिती- II नावाची समिती असेल :

अध्यक्ष (१) महामंडळाचे व्यवस्थापकीय संचालक सदस्य (२) सहसचिव / उप सचिव, अल्पसंख्याक विकास विभाग, मंत्रालय (३) अवर सचिव, अल्पसंख्याक विकास विभाग, मंत्रालय सदस्य (४) कक्ष अधिकारी दर्जापेक्षा कमी दर्जाचे नसलेले अनुसूचित जातीचे कोणतेही अधिकारी सदस्य (५) कक्ष अधिकारी दर्जापेक्षा कमी दर्जाचे नसलेले अनुसूचित जमातीचे कोणतेही अधिकारी सदस्य (६) महामंडळाचे सह व्यवस्थापकीय संचालक

सदस्य-सचिव.

(ii) महामंडळाचे सह व्यवस्थापकीय संचालक हे मागील ५ वर्षाच्या संबंधित कार्य मूल्यांकन अहवालाच्या श्रेणीसह सेवाज्येष्ठतेच्या आधारावर पदोन्नती देण्याकरिता ग्रा धरावयाच्या निम्न संवर्गातील कर्मचायांची यादी, तपशील तयार करतील आणि ती उपराक्त समिती समोर ठेवतील. उपराक्त समिती ही पदोन्नती देण्याकरिता योग्य उमेदवार ग्रा धरून त्याची निवड करील. सदर कार्यवाही पार पाडताना, समिती वेळोवेळी शासनाने जारी केलेले शासन निर्णय / आदेश / परिपत्रक इत्यादी विचारात घेईल.

७. पदोन्नतीकरिता सेवाज्येेष्ठता यादी अद्यावत ठेवणे :

पदोन्नतीने भरावयाची रिक्त पदे वेळेवर भरण्यात यावीत या दृष्टीने, महामंडळाने निम्न संवर्गातील कर्मचायांची सेवाज्येष्ठता सूची अद्यावत ठेवावी आणि प्रत्येक वर्षी जानेवारी महिन्यात ती प्रसिद्ध करावी. १५ दिवसांच्या आत संबंधित कर्मचायांकडून दुरुस्ती / आक्षेप मागविल्यानंतर, प्रत्येक वर्षी फेब्रुवारीच्या शेवटी अंतिम ज्येेष्ठतासूची प्रसिद्ध करावी. तीच सेवाज्येष्ठता यादी ही निवड समिती-II द्वारे विचारात घेतली जाईल. ८. या नियमांचे स्पष्टीकरण नियमांचा अर्थ करण्याबाबत कोणताही वाद झाल्यास, शासनाचा निर्णय अंतिम आणि बंधनकारक असेल. ९. वरील नियमांमध्ये काहीही अंतर्भूत असले तरी, मंडळाच्या कार्यालयातील कोणत्याही पदावर नियुक्त व्यक्तीस, मंडळाच्या राज्यांतील, कुठल्याही कार्यालयात बदली मागण्यासाठी विनंती करु शकेल.

हे सेवाप्रवेश नियम शासनाच्या मान्यतेने प्रसिद्ध करण्यात येत आहेत.

THE COMPANIES ACT, 1956.

A Proposal was submitted vide the letter No. MAAAVMM/2019/349, dated. 31st May 2019 to The Minorities Development Department, Government of Maharashtra to accord the sanction the service rules for the employees of Maulana Azad Alpasankhyak Arthik Vikas Mahamandal Maryadit, Mumbai. As per the sanction accorded by. The Minorities Development Department, Government of Maharashtra, vide the letter No. MAM /2019 / C.R. 107/13/dest-8, dated 12th July 2019 and as per the para No. 13, Rules No. 85 (5) of the Memorandum of Association, the Chairman and Board of Directors here by publish the service rules for the recruitment of the employees of Maulana Azad Alpasankhyak Arthik Vikas Mahamandal Maryadit, Mumbai.

1. Short title.— These rules may be called the Maulana Azad Alpsankhyak Arthik Vikas Mahamandal Maryadit, Recruitment Rules, 2016.

2. Definitions.— In these regulations, unless the context required is otherwise, —

(a) " Government " means the Government of Maharashtra ;

(b) " Minorities Development Department" means Minorities Development Department of the Government of Maharashtra ;

(c) " Corporation " means the Maulana Azad Alpsankhyak Arthik Vikas Mahamandal Maryadit, Mumbai ;

(d) " Board " means the Board of Directors of Maulana Azad Alpasankhyak Arthik Vikas Mahamandal Maryadit, Mumbai.

(e) " Managing Director " means the Managing Director of Maulana Azad Alpsankhyak Arthik Vikas Mahamandal Maryadit, Mumbai ;

(f ) " Degree " means a degree of any statutory university ;

(g) " Recognised Institution " means an Institution recognised by the Government of Maharashtra ;

(i) " Secondary School Certificate Examination " means the Secondary School Certificate Examination conducted by a Divisional Board under the Maharashtra Secondary Education Corporation Act, 1965 (Mah. XLI of 1965) and includes any other examination declared by Government to be equivalent thereto ;

(ii) "Government Commercial Certificate" means a certificate issued by the Bureau of Government Examination, Department of Education, Government of Maharashtra and includes a certificate issued by any other institution as may be specifically declared by Government to be equivalent thereto ;

3. General Conditions.—

(a) Upper age limit for candidates of open categories and age relaxation to candidates belonging to certain categories such as backward classes, physically disabled persons, ex-servicemen, women, project affected persons etc shall be applicable as per the Government policy at the time of recruitment to be made for filling in the vacant posts by nomination. Similarly, the prevailing Government policy in respect of social reservation (vertical reservation) and horizontal reservation shall be applicable for filling in the vacant posts.

(b) Candidates must be domiciles of Maharashtra state and should have adequate knowledge of Marathi.

(c) Government policy in respect of medical test, character and antecedents verification, limit on the family size, caste validity, probationary period, passing of examinations in Computer Operation prescribed by the Directorate of Information and Technology, age of retirement, etc as applicable to an employee in Government service shall be applicable to the candidates who are selected for being appointed in the service of the Corporation by nomination.

भाग दोन (संकीर्ण)---३१८ महाराष्ट्र शासन राजपत्र, भाग दोन-संकीर्ण सूचना व जाहिराती, गुरुवार ते बुधवार, सप्टेंबर २६-ऑक्टोबर २, २०१९/आशि्वन ४-१०, शके १९४१ 4. The employee, who has been appointed on contractual basis by the Corporation after following due procedure of recruitment and whose age was less than the upper age limit prescribed by the Government for direct recruitment at the time of his appointment and is in service of the Corporation, shall be eligible for being absorbed in the service of the Corporation on regular basis, subject to condition that he fulfills the eligibility criteria prescribed here-in-below for direct recruitment to the post on which he is working.

However, this provision shall apply to only those employees who were appointed before the date of commencement of these Rules.

5. Appointments to the different posts in the office/ offices of the Corporation shall be made as mentioned in below :—

(1) Managing Director (Group-A) :—

Appointment to the post of Managing Director (Group-A) in the office of Maulana Azad Alpsankhyak Arthik Vikas Mahamandal Maryadit, Mumbai under Minorities Development Department shall be made by deputation of a suitable officer from the cadre of Deputy Secretary or Joint Secretary in Mantralaya or any other cadre equivalent thereto in the service of Government of Maharashtra :

Provided that, Government may recall the Officer who has been appointed on deputation at any time before completion of tenure of his deputation.

(2) Joint Managing Director (Group-A)

Appointment to the post of Joint Managing Director (Group-A) in the Corporation shall be made either,—

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Manager from the cadre of Manager of Corporation, having a minimum experience of 10 years on that post ;

OR

(b) by deputation of a suitable officer from the cadre of Under Secretary to the Government in any department of Mantralaya or any other cadre equivalent thereto in the service of Government of Maharashtra for a period as decided by the Government :

Provided that, Government may recall the Officer who has been appointed on deputation at any time before completion of tenure of his deputation.

(3) Company Secretary :

Appointment to the post of Company Secretary (Group-A) in the office of Corporation shall be made on full time or part time basis for a period of two years every time by selection of suitable candidate on the basis of bio-data and experience and interview. To be eligible for appointment, a candidate, —

(i) must not have attained the age of 50 years ;

(ii) must possess a degree in Company Secretary and must be a member of Association of Company Secretaries (State Level) ;

(iii) must have practical experience of working as Company Secretary, for a period of not less than 2 years after acquiring the qualification mentioned in sub-clause (ii).

A fulltime or part time Company Secretary so appointed shall be paid such lumpsum remuneration as may be fixed by the Selection Committee.

Appointment to the post of Manager in the office of Corporation shall be made either,—

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Deputy Manager having a minimum experience of 5 years on that post in the office of Corporation,

OR

(b) by deputation of a suitable officer from the cadre of Section Officer in any department of Mantralaya, who draws salary in the same pay scale, or from any other cadre equivalent thereto, in the service of Government of Maharashtra for a period as decided by the Government :

Provided that, Government may recall the Officer who has been appointed on deputation at any time before completion of tenure of his deputation.

(5) System Analyst :

Appointment to the post of System Analyst in the office of Corporation shall be made on full time or part time basis for a period of two years every time by selection of suitable candidate on the basis of bio-data and experience and interview. To be eligible for appointment, a candidate, —

(i) must not have attained the age of 50 years ;

(ii) must possess a degree / Master's degree in Computer Engineering of a Statutory University atleast in 2nd class ;

(iii) must have practical experience of designing computer software and system administration for a period of not less than 2 years after acquiring the qualification mentioned in sub-clause (ii).

A fulltime or part time System Analyst so appointed shall be paid such lump sum remuneration as may be fixed by the Selection Committee.

(6) Deputy Manager :

Appointment to the post of Deputy Manager in the office of Corporation shall be made either, —

(a) by promotion of a suitable person on the basis of seniority, subject to fitness, from amongst the persons holding the post of District Manager at district level or the persons holding the post of Assistant Manager in the Head Office of Corporation,having a minimum experience of 5 years on that post ;

OR

(b) by deputation of a suitable person from the cadre of Section Officer in Mantralaya who draws salary in the same pay scale, or from any other cadre equivalent thereto, in the service of Government of Maharashtra for a period as decided by the Government :

Provided that, Government may recall the Officer who is appointed on deputation at any time after consultation with the Corporation or upon report received from the Corporation.

(7) Accounts Officer :

Appointment to the post of Accounts Officer in the office of the Corporation shall be made by transfer or deputation of a suitable person from the cadre of Accounts Officer in Directorate of Accounts and Treasury having a minimum experience of 2 years on that post :

Provided that, Government may recall the Officer who is appointed on deputation at any time after consultation with the Corporation or upon report received from the Corporation.

(8) Personal Assistant (Stenographer-Higher Grade) :

Appointment to the post of Stenographer-Higher Grade in the office of Corporation shall be made either, ——

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Lower Grade Stenographer who possess Government Commercial२० महाराष्ट्र शासन राजपत्र, भाग दोन-संकीर्ण सूचना व जाहिराती, गुरुवार ते बुधवार, सप्टेंबर २६-ऑक्टोबर २, २०१९/आशि्वन ४-१०, शके १९४१ Certificate with the speed in shorthand and typewriting prescribed for appointment by nomination in sub-clause (ii) of clause (b) below and have completed regular service of not less than three years in the post of Lower Grade stenographer ;

OR

(b) by nomination from amongst candidates who, ——

(i) possess a degree, and,

(ii) possess the Government Commercial Certificate with a speed of not less than 120 words per minute in Shorthand and not less than 40 words per minute in English Typewriting or 30 words per minute in Marathi Typewriting; and

(iii) have completed 18 years of age ;

(9) Deputy Accounts Officer :

Appointment to the post of Deputy Accounts Officer in the office of the Corporation shall be made by transfer or deputation of a suitable person from the cadre of Assistant Accounts Officer in Directorate of Accounts and Treasury having a minimum experience of 2 years on that post.

Provided that, Government may recall the Officer who is appointed on deputation at any time after consultation with the Corporation or upon report received from the Corporation.

(10) Personal Assistant (Stenographer-Lower Grade) :

Appointment to the post of Stenographer-Lower Grade in the office of Corporation shall be made by nomination from amongst candidates who, ——

(i) possess a degree, and,

(ii) possess the Government Commercial Certificate with a speed of not less than 100 words per minute in Shorthand and not less than 40 words per minute in English typewriting or 30 words per minute in Marathi Typewriting; and

(iii) have completed 18 years of age ;

(11) Assistant Manager and District Manager :

(i) Appointment to the post of Assistant Manager in the head office of the Corporation and District Manager in the offices of the Corporation at district level shall be made either, ——

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Assistant Manager in all the offices of the Corporation at district level and Recovery Officer at Regional level having a minimum experience of 3 years on that post and possessing qualifications prescribed for appointment by nomination in sub-clause (c) below ;

OR

(b) by deputation of a suitable person working on the post of Assistant in any Department of Mantralaya or any other equivalent cadre under any other Department of Government of Maharashtra, having a minimum experience of 3 years on that post.

Provided that, Government may recall the Officer who is appointed on deputation at any time after consultation with the Corporation or upon report received from the Corporation.

OR

(c) by nomination on the basis of result of a competitive examination held by the Corporation or any agency appointed by the Corporation on its behalf. To be eligible for appointment by nomination candidate must ——

(i) have completed 18 years of age;

(ii) hold a degree of a Statutory University at least in 2nd class;

(ii) Appointment to the post by promotion and nomination shall be made in the ratio 50:50.

(12) Assistant Manager in all the offices of the Corporation at district level and Recovery

Officer at Regional level :---

(i) Appointment to the post of Assistant Manager in all the offices of the Corporation at district level and Recovery Officer at Regional level shall be made either

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Clerk-typist who possess prescribed for appointment by nomination in sub-clause (ii) of clause (b) below and have completed regular service of not less than 10 years on the post of Clerk-typist ;

OR

(b) by nomination on the basis of result of a competitive examination held by the Corporation or any agency appointed by the Corporation on its behalf. To be eligible for appointment by nomination candidate must—

(i) have completed 18 years of age ;

(ii) hold a degree of a Statutory University ;

(ii) Appointment to the post by promotion and nomination shall be made in the ratio 20:80.

(13) Clerk - typist :

(i) Appointment to the post of Clerk-typist in all the offices of the Corporation viz. at head office, district level and regional level, shall be made by either.

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of peon who possess prescribed qualification for appointment by nomination in sub-clause (ii) of clause (b) below and have completed regular service of not less than 8 years on the post of Peon ;

OR

(b) by nomination on the basis of result of a competitive examination held by the Corporation or any agency appointed by the Corporation on its behalf. To be eligible for appointment by nomination candidate must ——

(i) have completed the age of 18 years,

(ii) have passed Secondary School Certificate Examination from the Government recognized school and,

(iii) possess the Government Commercial Certificate with a speed of not less than 30 words per minute in Marathi Typewriting or 40 words per minute in English Typewriting as the case may be.

(ii) Appointment to the post by promotion and nomination shall be made in the ratio 10:90.

(14) Driver :

Appointment to the post of Drivers of motor cars and Jeeps in the office of the Corporation shall be made by nomination on the basis of result of selection test and driving test appointed by the Corporation, from amongst candidates who,

(i) are not more than thirty-eight years of age ;

(ii) possess a driving license to drive a light motor vehicle or medium passenger motor vehicle or heavy passenger motor vehicle under the Motor Vehicles Act, 1988 (59 of 1988), issued by the Competent Licensing Authority ;

(iii) have passed Secondary School Certificate Examination from the Government recognized school ; भाग दोन (संकीर्ण)---४२२ महाराष्ट्र शासन राजपत्र, भाग दोन-संकीर्ण सूचना व जाहिराती, गुरुवार ते बुधवार, सप्टेंबर २६-ऑक्टोबर २, २०१९/आशि्वन ४-१०, शके १९४१ (iv) possess not less than three years experience of driving a light motor vehicle or medium passenger motor vehicle or heavy passenger motor vehicles in government, semi-government or private institutions ;

(v) possess basic knowledge of repairing the motor vehicle ;

(vi) have a clean record of driving motor vehicle and possess good health ;

Note.— " Clean record of driving vehicle " includes the following points :—

(1) He shall not have been held guilty for the offence of driving under influence of drugs or alcohol or any cognizable offence under the Motor Vehicle Act, 1988 (59 of 1988).

(2) There shall not be any accident registered against the driver.

(vii) have complete knowledge of topography of the concerned area ; and

(viii) can read and speak Marathi, Hindi languages and can read English language (ix) The person eligible to be appointed shall pass the test of driving at the time of appointment.

(x) A person appointed shall possess physical fitness and good vision. He shall not be suffering from night blindness and colour blindness. He shall submit the certificate of physical fitness and good vision obtained from the Competent Authority, before appointment.

(15) Peon :

Appointment to the post of Peon (Group-D) in the offices of Corporation shall be made by nomination, from the persons, who, —

(ii) have completed the age of 18 years ;

(ii) have passed Secondary School Certificate Examination from the Government recognized school and can write in, read and speak Marathi.

6. Constitution of Selection Committee. —

(1) (i) For conducting selection process to fill in the vacant postsby nomination there shall be a committee called Selection Committee – I, as stated below :

(ii) The above committee shall decide the process and manner in which selection process should be conducted, and application fee, examination fee to be charged from the candidates. The Committee may entrust the work of question paper setting, evaluation of answer sheet written by the candidates, taking interview of candidates (if applicable), etc. to suitable officers in the Government Service. The Committee may decide to entrust the work of conducting selection process to an appropriate agency.

(iii) The above committee shall also take decision about absorption of contractual employees in the service of the Corporation on regular basis as per Rule 4.

(2) (i) For the purpose of selecting suitable candidates for giving promotion to the employees holding the post of a feeder cadre on the basis of seniority and work evaluation report there shall be a committee called Selection Committee–II, as stated below :

(ii) The Joint Managing Director of the Corporation shall prepare a chart showing list of employees in the feeder cadre, to be considered for giving promotion, on the basis of seniority with gradation of work evaluation report related to last 5 years and place it before the above committee. The Committee shall consider and select appropriate candidates for giving promotion. The Committee shall take into consideration the concerned Government Resolutions / Orders / Circulars etc. issued by the Government from time to time.

7. Maintenance of Seniority List for promotions.—

With a view that the vacant posts to be filled by promotion are timely filled, the corporation shall maintain seniority list of employeesin the feeder cadre and publish it in the month of January every year. After calling corrections / objections from the concerned employees within 15 days, the seniority list shall be finalized and published by the end of February every year. The same seniority list shall be taken into consideration by the Selection Committee – II.

8. In case of any dispute regarding interpretation of these rules, the decision of Government shall be final and binding.

9. Notwithstanding anything contained in any of these rules the person serving on any post of corporation, may request for the transfer in any offices of corporation of the State.

आणि ज्याअर्थी, वगळलेल्या भागाची विकास योजना " उक्त अधिनियमाचे " कलम ३१ (१) नुसार शासन अधिसूचना क्रमांक टीपीएस-१२९८/नपा/सीआर-८९/९८/युडी-१२, दिनांक २५ ऑगस्ट, २००० अन्वये मंजूर झाली असून दिनांक १५ ऑक्टोबर, २००० पासून अंमलात आलेली आहे.

आणि ज्याअर्थी, मिरा भाइर्ंदर महानगरपालिकेने सर्वसाधारण सभा ठराव क्र. ५३, प्रकरण क्रमांक ४७, दिनांक १४ ऑगस्ट, २०१९ (दिनांक ९ ऑगस्ट, २०१९ रोजीची तहकूब सभा) अन्वये उक्त अधिनियमाचे कलम ३७ नुसार मंजूर विकास योजनेमध्ये खालीलप्रमाणे फेरबदल करण्याचे ठरविले आहे. यापुढे " उक्त फेरबदल " असे संबोधण्यात येत आहे.

तद्नंतर महाराष्ट्र शासन नगरविकास विभाग अधिसूचना क्रमांप टिपीपी/४३०४/सीआर-२४६/०४/नवि-११, दिनांक २४ ऑगस्ट २००४ अन्वये महानगरपालिका क्षेत्रातील डोंगरी, तारोडी, चौक, पाली व उत्तन या गावांसाठी शासनाने विशेष नियोजन प्राधिकरण म्हणून मुंबई महानगर प्रदेश विकास प्राधिकरण (MMRDA) यांची नेमणूक केलेली होती.

महानगरपालिका क्षेत्रातील डोंगरी, तारोडी, चौक, पाली व उत्तन या अधिसूचित क्षेत्रासाठी महाराष्ट्र शासन, नगरविकास अधिसूचना क्रमांक टिपीबी/४३०७/१०८/सीआर-२९/०७/युडी-११, दिनांक ९ एप्रिल, २००७ अन्वये विशेष नियोजन प्राधिकरण म्हणून महाराष्ट्र पर्यटन विकास महामंडळ मर्यादीत यांची नेमणूक झालेली होती.

तद्नंतर दिनांक १ डिसेंबर, २००७ पासून मुंबई महानगर प्रदेश विकास प्राधिकरण यांची विशेष नियोजन प्राधिकरण (Special Planning Authority) म्हणून शासनाने नियुक्ती केली आहे व मुंबई महानगर प्रदेश विकास प्राधिकरणाने उक्त अधिसूचित क्षेत्रासाठी तयार केलेल्या विकास आराखडयास शासनाच्या नगरविकास विभागाकडील अधिसूचना क्रमांक सीएमएस/टिपीबी-४३१२/प्र.क्र.२३/२०१३/नवि-११, दिनांक १३ मे, २०१३ व दिनांक ३ जून, २०१६ अन्वये मंजूरी प्राप्त आहे.

सद्य:स्थितीत महानगरपालिका क्षेत्रातील डोंगरी, तारोडी, चौक, पाली व उत्तन या क्षेत्रासाठी मिरा-भाइर्ंदर महानगरपालिका ही नियोजन प्राधिकरण आहे.

मौजे डोंगरी, स.क्र. ४९(क), हि.क्र. १, १७८(ड)ई, १०५(२ब), २९७ या जागेपैकी स.क्र. ४३क (जुना), ४९/१ (नवीन) या जागेसाठी यु.एल.सी. विभागामार्फत क्र. यु.एल.सी./टिए /टे-६/डोंगरी/एसआर-५३, दिनांक ८ मार्च, २००७ अन्वयेचे आदेश प्राप्त झालेनंतर महानगरपालिकेने पत्र क्र.मनपा/नर/२८६६/२००७-०८, दिनांक २६ नोव्हेंबर २००७ अन्वये रहिवास व रेस्टॉरेन्ट या प्रयोजनार्थ प्राथमिक परवानगी दिलेली आहे.

तद्नंतर मा. जिल्हाधिकारी, ठाणे यांचेमार्फत क्रमांक महसूल/क-१/टे-१/एनएपी/एसआर-२६१/२००७, दिनांक २८ डिसेंबर, २००७ अन्वये अकृषिक परवानगीचे आदेश प्राप्त झाले आहे.

अकृषित आदेश प्राप्त झालेनंतर महानगरपालिकेने पत्र क्र. मनपा/नर/३९४२/२००७-०८, दिनांक २ फेब्रुवारी, २००८ अन्वये इमारत प्रकार ए व बंगला (स्टिल्ट + १) मजल्याकरिता ०.२ चटई क्षेत्र निर्देशांकानुसार ६७८.५५ चौ.मी. क्षेत्रासाठी बांधकाम परवानगी दिलेली आहे.

तद्नंतर महानगरपालिकेने पत्र क्र. मनपा/नर/६५७/२०११-१२, दिनांक २७ मे, २०११ अन्वये हॉटेल व्यवसाय या प्रयोजनार्थ भोगवटा दाखला दिलेला आहे.

सद्य:स्थितीत जागेवर शुभारंभ रिसॉर्ट प्रा.लि. या नावाने हॉटेल व्यवसाय सुरु आहे.

विद्यमान हॉटेलची जागा सन १९९७ च्या मंजूर विकास योजनेनुसार Hill Zone मध्ये सामाविष्ट असून ०.२ चटईक्षेत्र निर्देशांक अनुज्ञेय आहे.

मुंबई महानगर प्रदेश विकास प्राधिकरणाच्या मंजूर विकास योजनेनुसार मौजे डोंगरी, स.क्र. ४९(क), हि.क्र. १, २९७ या जागा Green Zone मध्ये समाविष्ट आहेत. तसेच स.क्र. १०५(२ब) व १७८(ड) ही जागा D-1 Zone मध्ये सामाविष्ट आहे.

NOTIFICATION

(Under Section 37 of Maharashtra Regional and Town Planning Act, 1966)

Whereas, the Development Plan of Mira Bhayandar Municipal Corporation has been sanctioned by the Government Under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Hereinafter referred to as " The Said Act ") vide Notification No. TPS-1296/9847/CR-162/96, UD-12, dated 14th May 1997 and came into force from the dated 15th July 1997.

And whereas excluded portion has been sanctioned U/s. 31(1) of " Said Act " by the Government vide Notification No. TPS/1298/94/CR-89/98, UD-12, dated 25th August 2000 and came into force from dated 15th October 2000.

And whereas, Mira-Bhainder Municipal Corporation has decided vide General Body Resolution No. 47, Chapter No. 53, dated 9th August 2019 (Adjourned General Body Meeting dated 9th August 2019) to modify sanctioned Development Plan U/s. 37 of " The Said Act " as described below. Herein referred as " The Said Modification ".

" Subsequently, Maharashtra Government Municipal Development Department has appointed the Mumbai Metropolitan Region Development Authority (MMRDA) as the ' Special Planning Authority ' for the Villages of Dongri, Tarodi, Chowk, Pali and Uttan in the Municipal Corporation area vide Notification No. As per TPP/4304/CR-246/04/Nov-11, dated 24th August 2004.

Maharashtra Tourism Development Corporation was appointed as 'Special Planning Authority' under Notification No. TPB/4307/108/CR-29/07/UD-11, dated 9th April 2007 of notified area of Dongri, Tarodi, Chowk, Pali and Uttan in the Municipal Corporation area.

Subsequently, the Government has appointed the Mumbai Metropolitan Region Development Authority as 'Special Planning Authority' from dated 1st December 2007 and Government have approved the development plan prepared by the Mumbai Metropolitan Region Development Authority for the said notified area under Notification No. TPB/4312 /pra.kra.23/2013/Nov-11, dated 13th May 2013 and dated 3rd June 2016 from the Urban Development Department.

At present, Mira-Bhayandar Municipal Corporation is the planning authority for the Dongri, Tarodi, Chowk, Pali and Uttan areas of the Municipal area.

After receiving the order from ULC Department for S.No. 43C (Old), 49/1 (New) out of S.No. 49 (c), H.No. 178(d)e, 105(2b), 297 of Village Dongri vide No. ULC/T-I/T-6/DONGRI/SR-53, dated 8th March 2007, the Municipal Corporation issued NANOC permission vide letter No. MNP/NR/2866/2007-08, dated 26th November 2007 to the residential and restaurant purpose.

After, that. Non-agricultural permission order has been obtained under Revenue/C-1/T-1/NAP/ SR-261/2007, dated 28th December 2007 through Collector, Thane.

After receiving Non-Agricultural order, Municipal Corporation has permitted letter No. MNP/NR/3942/ 2007-08, dated 2nd February 2008, for building type A and bungalow (stilt + 1), 0.2 FSI, area 678.55 sq.mt. Thereafter, the Municipal Corporation had issued occupation certificate for Hotel business purpose vide No. MNP/NR/657/2011-12, dated 27th May 2011.

Currently on this site Hotel business is running in the name of M/s. Shubharambha Resort Pvt. Ltd. Existing hotel accommodations are included in Hill Zone and 0.2 FSI is permissible in accordance with the approved development plan of 1997.

According to the approved development plan of Mumbai Metropolitan Region Development Authority, Village Dongri, S.No. 49(a), H.No. 1, 297 are included in Green Zone and also S.No. 105(2b) and 178(d) are included in D-1 Zone.

0.2 FSI is permissible in Village Dongri, S.No. 49(C), H.No. 1, 297 as these place lies in Green Zone. And 0.3 Actual FSI + 0.2 Primium FSI, a total of 0.5 FSI is permissible in S.No. 105(2A) and 178(D) these place lies in D-1 Zone.

As all four Survey numbers are owned by M/s. Shubham Resort Pvt. Ltd. and the owner is demanding to include all survey numbers in D-2 Zone.

1.0 FSI is permissible in D-2 Zone. However, in accordance with the letter of the Government, it is proposed to revise the land under section 37 of the Maharashtra Planning Act, 1966 in the approved development plan for inclusion of the land in the D-2 Zone."

And therefore, those who wants to submit their suggestions and objections about the "said modification", may submit in writing there suggession / objection within one month from publications of this Notification in Government gazette, to the Mira-Bhainder Municipal Corporation which may be considered before finalizing the proposal.

The plan of proposed modification is kept open for inspection, for public in the Head Office and Townplanning Department of Mira-Bhayandar Municipal Corporation during Office hours.
