Development Plan has been sanctioned by the Government

NOTIFICATION

vide Notification No. TPS-3001/1498/CR-288 (A) 2001/UD- The Maharashtra Regional & Town Planning Act. 1966 :

No. TPS-3019/685/CR-84/2019UD-30.- Whereas, the Government of Maharashtra Vide Notification No. TPS-3087/ 22/CR-1/PART-II/UD-12, dated 7th October,1991 in exercise of the powers conferred by section 40 of the Maharashtra Regional & Town Planning Act. 1966 (hereinafter referred to as the "said Act") and all other powers enabling it in this behalf, appointed City & Industrial Development Corporation (CIDCO) as Special Planning Authority (hereinafter referred to as "the said Plainning Authority" for Waluj Notified Area (hereinafter referred to as " the said Notified Area");

And whereas, the Development Plan of said Notified Area has been sanctioned partly by the Government under section 30, dated 23rd July, 2002 and has come into force with effect from 16 th September, 2002 (hereinafter referred to as "the said Development Plan);

And whereas, in the said Development Plan, the land admeasuring area 0.38 Hect., 0.565 Hect. and 0.65 Hect. of Gut No. 18 (part), 19 (part) and 20 (part) respectively of Mouja Golwadi, (hereinafter to as "the said land"), are the part of Reservations "Site No. 4/109 - Play Ground" and "Site No. 4/ 110- Primary and Secondary School" as specified in the Schedule (hereinafter referred to as the said Reservations);

And whereas, the said land has not been acquired by the said Planning Authority within ten years from the date on which the said Development Plan come into force;

And whereas, the owners of the said land had issued a notices dated 26.12.2016 under sub-section (1) of section 127 of the said Act to the said Planning Authority, being the Appropriate Authority, informing that the said land has not been acquired by the said Planning Authority, within the stipulated period;

And whereas even after service of the said notice as aforesaid, the said land has not been acquired within a period of twenty four months from the date of the service of such notice by the said Appropriate Authority;

And whereas, said owner has requested the Government to issue notification to the effect that the said reservation on the said land under the provisions of section 127 (2) of the said Act, Since, the Appropriate Authority has not acquired the said land within two year, from the date of notice served under section 127, the said reservation on the said land have lapsed as per provisions of section 127 of the said Act; And whereas as required under sub-section (2) of section 127 of the said Act, it is necessary to issue an order that the reservations of the said land have lapsed;

Now, therefore, in exercise of the powers conferred by sub-section (2) of section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby notifies that part of the reservations "Site. No. 4/109 - Play Ground" and "Site No. 4/110 - Primary and Secondary School" to the extent of the said land, as specified in the schedule hereunder, stands lapsed and the said land shall be available to the owner for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan.

A Copy of the part plan showing the detail of area under reservation which have lapsed vide this order is available in the office of the Chief Administrator, New Town, CIDCO Aurangabad during office hours on all working days for inspection of public for one month.

And whereas, second revised Development Plan of Jalna has been partly sanctioned by the Government u/s of 31 of the said Act vide Notification No. TPS-2912/1091/CR-181/ 2012/UD-30, dated 02nd April, 2013 and it has come into force with effect from 3rd October, 2013; (hereinafter referred to as "the said Second Revised Development Plan");

And whereas, the City and Industrial Development Corporation Maharashtra Limited (hereinafter referred to as "the CIDCO") was appointed by the Government vide its Notification No. TPS-2908/162/CR-75/2008/UD-30 dated 18 June, 2008 as "Special Planning Authority" u/s 40 of the said Act for some partial area of the said Revised Development Plan;

And whereas, the Government vide Urban Development Department Notification No. TPS-2916/227/C.R.250/2016/ UD-30 dated 11 April, 2017 has ceased the function of CIDCO;

And whereas, in the said Revised Development Plan, the land bearing Survey No. 224 (part) of Mouja Nagewadi, Tq. Jalna, Dist. Jalna admeasuring area 2.42 Hect., (hereinafter द्धन्रु]क्ष् न् ह +ारून् म् हम्,

And whereas,the Municipal Council, Jalna after following all the legal formalities stipulated u/s 37 (1) of the Maharashtra GOVERNMENT OF MAHARASHTRA Regional and Town Planning Act, 1966 vide letter dated Urban Development Department

16.01.2019 has submitted to the Government for its sanction Mantralaya, Mumbai 400 032.

a proposal for modification to the said first revised Date: - 20 th September, 2019.

NOTIFICATION

No. TPS-2919/138/CR-56/2019/UD-30.- Whereas, the Development Plan of Jalna, (Revised + Additional Area) had been sanctioned by the Government u/s of 31 of Maharashtra Regional & Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as "the said Act"), vide Notification No. UDD/2986/67/CR-89/UD-12, dated 04 April, 1989 (hereinafter referred to as "the said Revised Development Plan");

Zone is to be included in Residential Zone, (hereinafter referred to as "the proposed modification");

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, the Government is of opinion that the Proposed Modification in the said Development Plan should be rejected;

Now therefore, in exercise of powers conferred by sub- section (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said modification;

And whereas, after making necessary enquiries and The Maharashtra Regional & Town Planning Act. 1966 :

No. TPS-3115/284/CR-248/2015/UD-30.- Whereas, the Development Plan of Basmatnagar (Revised), Dist. Hingoli has been sanctioned by the Government vide Urban Development Department Notification No. TPS-3199/513/ C.R.81/99/UD-30, Detad 24th February, 2000 and has come into force with effect from the 30th June, 2000 ( hereinafter referred to as "the said Development Plan");

And whereas, in the said Development Plan, the land admeasuring 5.04 Hectors bearing Survey No. 160 (Pt) of Mouje Basmat, Dist.- Hingoli, (hereinafter referred to as "the said land") is included Agricultural Zone;

And whereas, the Basmatnagar Municipal Council, after following all the legal formalities stipulated under section 37 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as "the said Act") has submitted to the consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned on certain conditions;

And whereas, the Land owners of the said land has deposited Rs. 27,72,000/- towards the 50 % Government share of 5 % premium amount as per the rate of the said land as prescribed in the Annual Statement of Rates (ASR) for the year 2019-20, in the Government Treasury vide chalan dt. 02.08.2019 through the Assistant Director of Town Planner, Hingoli and the remaining 50 % of 5 % premium amount of Rs. 27,72,000/- has been deposed with the Municipal Council, Basmat;

Now therefore, in exercise of powers conferred by sub- section (2) of Section 37 of the said Act, the Government of Maharashtra hereby sanctions the proposed Modification in the said Development Plan and for that purpose amends the above said Notification dated the 24th February, 2000 as follows :-

Now, therefore in exercise of powers conferred on it under " The 12.00 M wide sanctioned Development Plan Road passing from Dr. Babasaheb Ambedkar Statue to Kamanves Dulya Maroti Mandir is modified by proposing equal 6.00 M width from Centre of existing road on both sides as 12.00 M wide D. P. Road as shown on Plan"

Condition :- It will be binding on the Municipal Council to collect Primium from concerned land owner, whose lands are now included in the Developable Zone due to the change in alignment of the said Road.

PUBLICATION

Maharashtra Reglnal & Town Planning Act 1966 (Maharashtra Act no. XXXVII Of 1966) To Prepare Development plan of Aundha Nagnath Nagar panchyat by its general body resolution No. ( 324 ) On Dated 02.03.2019 has declared his intention under provision of section 21 (2) with section 23 (1) of Maharashtra regional & Town planning Act 1966 for the area within its jurisdiction.

A copy of plan showing to area of which the Developement plan is to be prepared is kept open for the inspection by public on all working days during office hours at the Office of Aundha Nagnath Nagarpanchyat as required under section 23 (2) Maharashtra regional & Town Planning Act 1966 Suggestion or objection if any, regarding the juridisdivision of Aundha Nagnath Nagarpachyat should be communicated in writing within 60 (Sixty) Days form the day of publication of intention in Maharashtra Govt. Gazette. Shall be considered by the Nagarpachyat Aundha Nagnath as required under Section 23 (2) of the said Act.
