Minor Modification Under Section 37 (1) of Maharashtra Regional and Town Planing Act, 1966.

The Development Plan of Mohpa Municipal Council has been sanction by ministry of Urban Devel- opment and Public Health under Resolution TPS-2412-74-CR-31(B)-2012-UD-9, dated 31st March 2012 which came in to effect from 15th May 2012 this Development Plan is final Development Plan for Mohapa Nagar Parished.

Now, the Municipal Council Mohpa, Dist. Nagpur has passed Resolution No. 7, Dated 28th June 2019 in a General Body meeting and decided to make minor modification to the sanctined Development Plan under Section 37 (1) Maharashtra Regional and Town Planing Act, 1966 as under :-

Also Nagpur Improvement Trust has been declared as "Planning Authority" for the seven Improvement Schemes being completed by the Nagpur Improvement Trust vide Government Notification No. TPS-2401-855-C.R.76-UD-9, dated 27th Februwary 2002 (hereinafter referred to as "th said Development Plan");

And whereas, in the said Development Plan, lands bearing Khasara No. 7, 8/1, 9/1, and 12/2 of Mouje Pardi are reserved for Park (Site No. E-19), Primary School (Site No. ME-14) and Dispensary (Site No. ME-15) (hereinafter referred to as "the said Reservations");

And whereas, the Nagpur Improvement Trust, Nagpur being Planning Authority for said Reservation (hereinaf- ter referred to as "the said Planning Authority"), vide its General Body Resolution No. 14/1162, dated 18th October, 2016 has resolved to delete 3.00 Mt. wide strip of land parallet to Existing layout road from said reservations and merge with existing 9.00mt. read making it 12.00mt. wide road and accordingly submitted a modification proposal to the Government, for its sanction, as per the provisions of sub-section (1) of section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned;

Now, therefore, in exercise of the powers conferred on it under sub section (2) of section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 7th January, 2000 as follows.—

"In the Schedule of Modifications appended to the Notification dated 7th January, 2000 sanctioning the said Development Plan, the following new entry shall be added after the last entry.

ENTRY

"The land bearing Khasara No. 7, 8/1, 9/1 and 12/2 Mouje Pardi are reserved for Park (Site No. E-19), Primary School (Site No. ME-14) and Dispensary (Site No. ME-15), out of these reservation 3.00 Mt. wide strip parallel to existing layout road is deleted and merged it with 9.00 Mt. wide existing road making it 12.00 Mt. road. Whereas, Revised Development Plan of Nagpur has been sanctioned by the Government vide Urban Development Departments Notification No. TPS-2496-2643-CR-300(A)-97-UD-9 dated 7th January, 2000 and 2nd Notification No. TPS-2400-1628-C.R. 200-2000-UD-9, dated 10th September, 2001 and has come into force with effect from the 1st March, 2000; and 21st September, 2001 respectively. Also Nagpur Improvement Trust has been declared as "Planning Authority" for the seven Improvement Schemes being completed by the Nagpur Improvement Trust vide Government Notification No. TPS-2401-855-C.R.76-UD-9, dated 27th Februwary 2002 (hereinafter referred to as "the said Development Plan");

And whereas, in the said Development Plan, land bearing Khasara No. 7 & 8/1, Plot No. 31 to 36 area admea- suring about 0.416 Ha. of Mouje Pardi is reserved for Site No. E-23, "Market" (hereinafter referred to as "the said Reservations");

And whereas, the Nagpur Improvement Trust, Nagpur being Planning Authority (hereinafter referred to as 'the said Planning Authority"), vide its Board of Trustee's Resolution No. 8/1108, dated 30th April, 2012 has resolved to delete the said reservation and to include the same in Commercial Zone. Accordingly after following all the legal procedure as per the provisions of sub-section (1) of section 37 of the said Act, submitted a modification proposal to the Government, for its sanction (hereinafter referred to as "the said Modification Proposal");

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification proposal should be sanctioned with some changes;

And whereas, the Land Owners of the said lands have deposited Rs. 15,89,280 towards the 50% Government share of premium amount worked out @ the rate of 5% of the rate of said land as prescribed in the Annual Statement of Rates (ASR) in the Government Treasury on 4th September, 2019 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur & the Nagpur Improvement Trust, Nagpur as a planning authority has given concession to deposit remaining 50% of the premium amount payable to the Planning Authority;

"In the Schedule of Modifications appended to the Notification dated 7th January, 2000 sanctioning the said Development Plan, the following new entry shall be added after the last entry.

"The land bearing Khasara No. 7 & 8/1, Plot No. 31 to 36 Mouje Pardi area admeasuring about 0.416 Hector is deleted from Site No. E-23 "Market" and included in Residential Zone as shown on the Plan.—
