NCL Rules and Byelaws ( Capital Market , Futures & Options , Currency Derivatives and Commodity segment) are amended as under :
1. The name of SEBI is excluded by amending the definition of term Relevant Authority in Chapter 1 of the Byelaws and Rules of all segments of NCL as under : -

" Relevant Authority " means the Board , or such other authority as specified by the Board from time to time as relevant for a specified purpose .

2. ( i) the existing clause ( 3 ) of Byelaw 7 of Chapter XII of the Byelaws of all segments of NCL are amended as under :

In the event of usage of Core SGF during a calendar month , contributors shall , as per usage of their individual contribution , immediately replenish the Core SGF to MRC . However , such contribution towards replenishment of Core SGF by the members would be restricted to only once during a period of 30 calendar days regardless of the number of defaults during the period . The period of 30 calendar days shall commence from the date of notice of default by Clearing Corporation to market participants .

(ii) the Explanation 2 to Byelaw 8 of Chapter XII of the Byelaws of all segments of NCL are amended as under :
Quote
( i) Clearing Corporation shall call for the capped additional contribution only once during a period of 30 calendar days regardless of the number of defaults during the period . The period of 30 calendar days shall commence from the date of notice of default by Clearing Corporation to market participants .
(ii ) Clearing Corporation shall have relevant regulations/provisions for non - defaulting members to resign un - conditionally within the abovementioned period of 30 calendar days , subject to member closing out/settling any outstanding positions , paying the capped additional contribution and any outstanding dues to SEBI . No further contribution shall be called from such resigned members .
(iii) The maximum capped additional contribution by non- defaulting members shall be lower of 2 times of their primary contribution to Core SGF or 10 % of the Core SGF of the segment on the date of default in case of equity / debt segments .
(iv) The maximum capped additional contribution by non - defaulting members shall be lower of 2 times of their primary contribution to Core SGF or 20 % of the Core SGF of the segment on the date of default in case of derivatives segment .
(v) In case of shortfall in recovery of assessed amounts from non - defaulting members , further loss can be allocated to layer ' f ' with approval of SEBI .

3. The clause ( 5) of Byelaw 14 of Chapter VI of NCL Byelaws for Commodity Derivatives segment is amended as under:

Notwithstanding anything contained in the Bye - laws , the Clearing Corporation shall ensure guarantee for settlement of trades including good delivery .
Explanation : For the purpose of this clause , good delivery shall mean the delivery of goods that is in proper form to transfer title and is of the quality and quantity as per the contract specifications of the Specified Exchange .

When a complaint has been lodged by a constituent , or on its behalf by the relevant authority , against a clearing member that such clearing member has failed to satisfactorily perform in its dealings or for meeting its obligations , then such complaint shall be taken up with the clearing member and upon - the complaint remaining unresolved within 7 days or within such time as specified by SEBI from time to time , the complaint shall be placed before the Grievance Redressal Committee or such other Committee for redressal of the grievance in accordance with such procedure as specified by SEBI from time to time ;
Explanation 1 :
For the purpose of this clause , the term " Constituent " shall mean Custodial Participant or a Trading Member on whose instructions and/ or on whose account the Clearing Member clears and settles deals .
Explanation 2 :
For the purpose of this clause , the term " Custodial Participant " shall mean a direct constituent/client of a Clearing Member .

(4) A non - defaulting Clearing Member may resign unconditionally within a period of 30 calendar days in the circumstances specified in explanation 2 to Bye - Law 8 of Chapter XII of NCL Bye - Laws after making additional contribution as required by Clearing Corporation to Core Settlement Guarantee Fund. In such resignation cases , the provisions of clause (2 ) above shall not be applicable .
(5) The resignation under clause (4) above shall be subject to fulfillment of the following conditions :-
(a) The non -defaulting Clearing Member has closed out/ settled outstanding positions .
(b) The non - defaulting Clearing Member has paid the capped additional contribution to the Clearing Corporation
(c) The non - defaulting Clearing Member has paid outstanding dues to SEBI .

Any person having any observations on the proposed amendment to the said Regulations can send the same in writing to the undersigned at the Exchange Plaza , C- 1 , Block G, Bandra - Kurla Complex , Bandra ( East ) , Mumbai 400 051 within 15 days from the date of this publication in the Gazette. The observations received after the aforementioned date will not be considered when the draft amendment will be taken for consideration :-
It is proposed to insert the following new clause as Bye - Law No. 8 in " Chapter VII : Dealing by Clearing Members " of NCL Bye - Law applicable to Capital Market segment , Futures & Options segment , Currency segment and Commodity segment after the existing Bye - Law No. 7 .

8 Potential Default by Clearing Member
(1) The Clearing Corporation shall act in accordance with the circulars issued by SEBI from time to time with respect to Standard Operating Procedure in cases of Clearing Member leading to default .
(2) In accordance with the Circular( s) issued by SEBI under the above Bye - Law , the Clearing Corporation shall issue instructions to the bank( s) concerned to freeze the bank account ( s) maintained by a Clearing Member , for all debits / withdrawal by the Clearing Member in the event of potential default by such a Clearing Member in meeting its obligations to a recognised stock exchange / Clearing Member / Clearing Corporation and / or repayment of funds / securities to his / its clients .

सिंधुदुर्गनगरी नवनगर विकास प्राधिकरण सिंधुदुर्गनगरी (महाराष्ट्र प्रादेशिक नगर रचना अधिनियम, १ ९ ६६ चे कलम ३७ अन्वये फेरबदलाची सूचना) क्रमांक डेस्क -८ / मशा / प्राधि/नवैशामजा/ २०२० . सिंधुदुर्ग जिल्हा मुख्यालयासाठी नेमणेत आलेल्या "सिडको " या विशेष नियोजन प्राधिकरणाने मूळ अधिसूचित ४३०.३३ हेक्टर क्षेत्रासाठी तयार केलेल्या नियोजन प्रस्तावाना शासन नगर विकास विभागाकडील अधिसूचना क्र. सीआयडी-१ ९९ २ / ४ ९ ३ / सीआर -७३ / ९ २ /युडी-१० , दिनांक १३ /११ / १ ९९ २ अन्वये महाराष्ट्र प्रादेशिक व नगर रचना अधिनियम , १ ९ ६६ (यापुढे उक्त अधिनियम असा उल्लेखिलेला ) चे कलम ४० (३ ) ( ड) चे तरतुदीनूसार मंजूरी मिळालेली असून प्रस्ताव अंमलात आहे . या अधिसूचित क्षेत्रासाठी शासन , नगर विकास विभागाकडील अधिसूचना क्र. टीपीएस -१ ९९ ७ /युओआर -६६/ सीआर ८७ ( एक) आणि ( दोन )/ ९७ / युडी-१२ , दिनांक २ / ४ / १ ९९ ८ अन्वये उक्त अधिनियमाच्या कलम ११३ ( १ ) नूसार नवनगरासाठी सिंधुदुर्गनगरी नवनगर विकास प्राधिकरण स्थापन झाले आहे. मंजूर नियोजन प्रस्तावाप्रमाणे भूखंड क्रमांक ६७ ऑरचर्ड ( ७/१२ प्रमाणे १७.६४.८९ हे.आर. ) या कारणासाठी आरक्षित आहे.
जिल्हा शल्यचिकित्सक सिंधुदुर्ग यांनी दि. २३ १०.२०२० चे प्रस्तावाने सिंधुदुर्ग येथे नवीन शासकीय वैद्यकीय महाविद्यालयाची स्थापना करण्याकरिता उपरोक्त जमिनीपैकी २५ एकर जमिन / जागा मिळणेची विनंती केलेली आहे. सद्यःस्थितीत या भूखंडाची मोजणी करून क्षेत्र निश्चित करणेची प्रक्रिया सुरू असून निश्चित होणाऱ्या क्षेत्रापैकी २५ एकर जमिनीचे आरक्षण बदलाबाबत नियोजित आहे ;
आणि ज्याअर्थी , सिंधुदुर्गनगरी नवनगर विकास प्राधिकरणाने प्राधिकरणाच्या सभेतील ठराव क्र. ७ , दि . २८.१०.२०२० ने मंजूर नियोजन प्रस्तावातील आरक्षणाच्या वरील प्रयोजनामध्ये व वापरामध्ये खालीलप्रमाणे बदल करणेसाठी कलम ३७ ( १ ) खालील फेरबदलाची कार्यवाही करण्याचे ठरविले आहे .

SINDHUDURGNAGARI NEW TOWN DEVELOPMENT AUTHORITY, SINDHUDURGNAGARI
(Notice under section 37 of the Maharashtra Regional and Town Planning Act , 1966. ) No: Desk - 8 /Masha/Pradhi/NMCP/2020.-Whereas , the Government of Maharashtra , Urban Development Department vide notification No. CID . 1992/493/CR- 73/92/UD -10 , dated 13th November , 1992 sanctioned the draft planning proposals prepared by City and Industrial Development Corporation of Maharashtra Limited as special planning Authority for the notified area admeasuring 430.33 hectors at villages Oros (BK) Ranbambuli and Anav of Kudal Tahsil from Sindhudurg District , under clause (d) of sub- section ( 3) of section 40 of the Maharashtra Regional and Town Planning Act , 1966 ( hereinafter referred to as the said Act . ) ;
And Whereas , the Government of Maharashtra vide notification No. TPS - 1997/UOR- 66/CR- 87 ( I ) & ( II ) / 97 /UD - 12 , dated 2nd April , 1998 has designated the above notified area as Sindhudurgnagari New Town Development Authority ( hereinafter referred to as the said Authority) ;
And Whereas , the sanctioned planning proposals depicts site No.67 ( 17.64.89 ha as of 7/12 ) reserved resp.
Civil Surgeon Sindhudurg has requested to Transfer 25 acres of land from the above land for setting up a new government medical college at Sindhudurg with the proposal dated 23.10.2020. At present , the process of determining the area by measuring the plots is underway and it is planned to change the reservation of 25 acres of land out of the area to be determined ;
And whereas , the said Authority has approved to modify the above purpose and as mentioned below under sub- section (1 ) of section 37 of the said Act vide it's Resolution No.7 dated 28th October 2020 .

ज्याअर्थी, तमाम जनतेस या जाहीर नोटीसीद्वारे कळविण्यात येते की, वरील न्यासाचे विश्वस्त नेमणुकीसंदर्भात कोणाचीही हरकत असल्यास सदर हरकत मे धर्मादाय उप आयुक्त , जळगाव विभाग , जळगाव यांचे कोर्टात सदरची नोटीस प्रसिद्ध झालेपासून ३० दिवसांचे आत या कार्यालयात नोंदवाव्यात किंवा या कार्यालयाचे वरील पत्त्यावर मिळेल अशा रितीने टपालाने पाठवाव्यात. सदर मुदतीत कोणाचीही हरकत न आल्यास अथवा प्राप्त न झाल्यास मुदतीनंतर आलेल्या हरकतीचा विचार केला जाणार नाही . सदर अर्जाची चौकशी/ सुनावणी पुर्ण करण्यात येऊन निर्णय दिला जाईल याची नोंद घ्यावी . कळावे ही चौकशीची जाहीर नोटीस.
