Whereas, the Development Plan (R+A. A.) of Umred Municipal Council has been partly sanctioned under the provisions of Section 31(1) of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as "the said Act") by Government in Urban Development Department vide Notification No. TPS-2498-287-Cr-25-98UD-9, dt. 08-07-2003 and came into force with effect from dt. 25-08-2003 & Development Plan of Excluded part is sanctioned by the Notifica- tion No. TPS-2498-CR-25-98-UD-9, dt.11-07-2005 and came into force with effect from dt.05-09-2005 (hereinafter re- ferred to as "the said Development Plan") for which Umred Municipal Council is the Planning Authority for the said Development Plan hereinafter referred to a ""the said Planning Authority");
And whereas, in the said sanctioned Development Plan Lands bearing S.No. 518 (pt.) S.No.516 & S.No.610(pt.) of Mauje Umred & S.No.1 & 3(Partly), of Mauje Belgaon are reserved for Site No. 35, "Shopping Complex & Parking" Approx Area 9200.00 sq.mt. & Site No. 36, "High School" Appoximate area-12000.00 Sq.mt. and Site No. 37, "Play Ground" Approx. area-18700.00sq.mt. (hereinafter referred to as "the said reservations") and Umred Municipal Council is the Appropriate Authority (hereinafter referred to as "the said Appropriate Authority");
And whereas, in the said Development Plan land bearing S.No. 518/1 (Partly) area 49200.00 Sq.mt. and S. No. 610 (Partly) area 3800.00Sq.mt. are reserved for Site No. 35 "Shopping complex & Parking" (Partly) & site No. 36, "Hish School" and Site No. 37, "Play Ground" (Partly) (herein after referred to us "the said reservations") and North-South 18.0 mtr. wide Development Plan road and remaining area is in residentil zone and Umred Municipal Council is the Appropri- ate Authority (herein after referred to as "the said Appropriate Authority";
And Whereas, the lands under the said reservation have not been acquired by the said Authority within ten years from the date on which the said Development Plan came into force;
And whereas, the owners of the said land Shri. Ajay Krishnrao Ladhave has issued a notice date 02-12-2016 under Section 127(1) of the said Act (hereinafter referred to as "the said notice") on the said Authority;
And whereas, as mentioned in Hon'ble High Court Order dt. 12-02-2020 that, as per the reply filed by the Umred Municipal Council, before High Court it is seen that, the Umred Municipal Council vide their General Meeting Resolution No. 17(2) on dt.23-12-2019 has resolved not to acquire the land S.No.518/1(part) & S.No.610 (part) under reservation Site No.35, "Shopping Complex & Parking" & Site No. 36, "High School" and Site No.37, Play Ground" it is seen that, Umred Municipal Council is not willing to acquire the lands under the said reservations;
And whereas, even after the serving of the said Notice as aforesaid, the said lands have not been acquired within a stipulated period from the date of service of the said notice under sub-section (1) of the Section 127 of the said Act, by the said Authority;
And whereas, the Hon'ble High Court of Judicature at Bombay, Bench at Nagpur, in its decision dated 12th February 2020, in Writ Petition No. 5270/2019 in this regard directed the Principal Secretary, Urban Development Department, Mantralaya, Mumbai-32 to issue Notification under Section 127(2) of Maharashtra Regional & Town Planning Act, 1966, within a period of eight weeks from dt. 12-02-2020 and whereas, correction order is passed by the Hon'ble High Court on dt. 25-02-2020 regarding the S.No.610 area 3800.00 Sq.mt. has been done to the original order on dt.12-02-2020;
And whereas, Government in Urban Development Department vide letter No. TPS-2420-605-2020-UD-9, dt.12-03- 2020 has communicated Directorate to take necessary action on the court order passed on dt. 12-02-2020 in Writ Petition No. 5270/2019;
And whereas, the Director of Town Planning, Maharashtra State, Pune is of the opinion that it is necessary to issue the Notification under Section 127(2) of the said Act, regarding the lapsing of the said reservations on the said lands;
And whereas, the Government in Urban Development Department, vide Resolution No. TPS-1813-3211-CR-508- UD-13, dt. 01-12-2016 has delegated the powers exercisable by it under Section 127(2) of the said Act, to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Councils/Zillha Parishad as a Planning Authority.
४ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, म्दन् १२-१८, २०२० / ॅॅ २१-२७, ॅ १९४२Now, therefore, the Director of Town Planning, Maharashtra State, Pune hereby notify the lapsing of the said reservations partly in respect of the said land under Section 127(2) of the said Act and for that purpose amends the Notification of the said Development Plan, sanctioned dated 25th August 2003 as follows :—
After the last entry in the schedule of modifications accompanying the Notification of the sanctioned Development Plan, the following new entry shall be added.—
"Site No.35, "Shopping Center & Plarking" (Partly) and Site No.36 reserved as "High School" respectively in respect of S.No. 518/1 & S.No.610 of Mauja Umred & Site No.37, "Play Ground" (Partly) is lapsed for the area contained in said notice from the above said reservations and the land so released from the reservations shall become available to the owner for the purpose of development as otherwise permissible of adjacent land under the relevant plan."
Note :----(1) A copy of the Part Plan of the said Development Plan showing the aforesaid Modification shall be made available for inspection in the office of Chief Officer, Umred Municipal Council, Umred during office hours on all working days.
(2) This order shall also be published on the Directorate website www.dtp.maharashtra.gov.in.

Whereas, the Development Plan (R+A. A.) of Umred Municipal Council has been partly sanctioned under the Provisions of Section 31(1) of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as "the said Act") by Government in Urban Development Department vide Notification No. TPS-2498-287-CR-25-98UD-9, dt. 08-07-2003 and came into force with effect from dt. 25-08-2003 & Development Plan of Excluded part is sanctioned by the Notifica- tion No. TPS-2498-CR-25-98-UD-9, dt.19-07-2005 and came into force with effect from dt.05-09-2005 (hereinafter referred to as "the said Development Plan") and Umred Municipal Council is the Planning Authority for the said Develop- ment Plan hereinafter referred to a ""the said Planning Authority");

६ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, म्दन् १२-१८, २०२० / ॅॅ २१-२७, ॅ १९४२And whereas, in the said sanctioned Development Plan Lands bearing S.No. 516, 517 (pt.) & 518(pt.) of village Umred & S.No.1(pt.), of village Belgaon etc. are reserved for Site No. 35, "Shopping Center & Parking" having approxi- mately area 8000.00 sq.mt. (hereinafter referred to as "the said reservations") and Umred Municipal Council is the Appropriate Authority (hereinafter referred to as "the said Appropriate Authority");
And whereas, in the said Development Plan land bearing S.No. 516 area admeasuring 4000.00 sq.mt. of Mauje Umred ((hereinafter referred to us "the said land") are reserved for Site No. 35, "Shopping Center & Parking" (herein after referred to us "the said reservations") and Umred Municipal Council, Umred is the Appropriate Authority for said reser- vation (hereinafter referred to as "the said Appropriate Authority");
And whereas, the lands under the said reservation have not been acquired by the said Authority within ten years from the date on which the said Development Plan came into force;
And whereas, the owners of the said land Shri. Kishor Ramchandra Kotamkar has issued a notice dated 2nd May 2017 under Section 127(1) of the said Act (hereinafter referred to as "the said notice") on the said Authority;
And whereas, the Umred Municipal Council General Meeting, Resolution No. 17(2) on dated 23rd December 2019 has resolved not to acquire the land under said reservation;
And whereas, even after the serving of the said Notice as aforesaid, the said lands have not been acquired within a stipulated period from the date of service of the said notice under sub-section (1) of the Section 127 of the said Act, by the said Authority;
And whereas, the Hon'ble High Court of Judicature at Bombay, Bench at Nagpur, in its decision dated 12th February 2020, Writ Petition No. 5269/2019 in this regard directed the Principal Secretary, Urban Development Depart- ment, Mantralaya, Mumbai-32 to issue Notification under Section 127(2) of Maharashtra Regional & Town Planning Act, 1966 within a period of eight weeks from dt. 12-02-2020;
And whereas, Government in Urban Development Department vide letter No. TPS-2420-607-2020-UD-9, 12-03- 2020 has communicated Directorate to take necessary action on the court order passed on dt. 12-02-2020 in Writ Petition No. 5269/2019;
And whereas, the Director of Town Planning, Maharashtra State, Pune is of the opinion that it is necessary to issue the Notification under Section 127(2) of the said Act, regarding the lapsing of the said reservations on the said lands;
And whereas, the Government in Urban Development Department, vide Resolution No. TPS-1813-3211-CR-508- UD-13, dt. 01-12-2016 has delegated the powers exercisable by it under Section 127(2) of the said Act, to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Councils/Zillha Parishad as a Planning Authority.
Now, therefore, the Director of Town Planning, Maharashtra State, Pune hereby notify the lapsing of the said reservations partly in respect of the said land under Section 127(2) of the said Act and for that purpose amends the Notification of the said Development Plans, sanctioned dated 25th August 2003 as follows :-
After the last entry in the schedule of modifications accompanying the Notification of the sanctioned Development Plan, the following new entry shall be added.—
"Site No.35, reserved as "Shopping Center & Parking" in respect of land S.No. 516 of Mauja Umred is lapsed for the area contained in said notice from the above said reservations and the land so released from the reservations shall become available to the owner for the purpose of development as otherwise permissible of adjacent land under the relevant plan."
Note :—(1) A copy of the Part Plan of the said Development Plan showing the aforesaid Modification shall be made available for inspection in the office of Chief Officer, Umred Municipal Council, Umred during office hours on all working days.
(2) This order shall also be published on the Directorate website www.dtp.maharashtra.gov.in.

Declaration of Intention to Prepare Development Plan
No.NPK-440-2020—
Whereas, by the Government Notification, dated 23rd March, 2015 Kurkheda Nagar Panchayat was newly formed in Gadchiroli district. The Kurkheda Nagar Panchayat by its General Body Resolution No. 335, dated 7th October 2020 has declared its inention to prepare Development Plan as per the provisions of Section 21(2) & Section 23 (1) of the Maharashtra Regional & Town Planning Act 1966 for the area within its Jurisdiction.
A copy of the Plan showing the area for which the Development Plan is to be prepared is kept open for inspection by the Public on the working days at the Office to the Kurkheda Nagar Panchayat as required under Section 23 (2) of the Maharashtra Regional & Town Planning Act, 1966. Suggestions or objections regarding boundaries of the said Development Plan if any should be communicated in writing to the Kurkheda Nagar Panchayat Office within 60 day's from the date of publication of declaration of the said intention in the Maharashtra Government Gazette as required under Section 23 (1) of the Maharashtra Regional and Town Planning Act, 1966. Suggestion / Objection received after the given period will not be take into consideration.
