भारताचे संविधान.
क्रमांक सेप्रनि-२०१९/शुश्रृषा/प्र.क्र. १४०/सेवा-५.---भारताच्या संविधानाच्या अनुच्छेद ३०९ च्या परंतुकाद्वारे प्रदान के लेल्या अधिकारांचा वापर करून आणि याबाबतीत के लेले सर्व विद्यमान नियम, आदेश, शासन निर्णय किंवा अनुदेश अधिक्रमित करून, महाराष्ट्राचे राज्यपाल, याद्वारे, शासनाच्या सार्वजनिक आरोग्य विभागाच्या अधिपत्याखालील आरोग्य सेवा आयुक्तालयातील व राज्य कामगार विमा योजनेतील महाराष्ट्र परिचर्या सेवेतील "सहायक अधिसेविका, पाठ्यनिर्देशिका, सार्वजनिक आरोग्य परिचारिका निर्देशिका, सार्वजनिक आरोग्य परिचारिका, मनोरुग्ण तज्ञ परिचारिका, बालरुग्ण तज्ञ परिचारिका, परिसेविका, अधिपरिचारिका" (गट-क) या पदांच्या सेवाप्रवेशाचे विनियमन करणारे पुढील नियम करीत आहेत. जसे :---
१. या नियमांस, शासनाच्या सार्वजनिक आरोग्य विभागाच्या अधिपत्याखालील आरोग्य सेवा आयुक्तालयातील व राज्य कामगार विमा योजनेतील महाराष्ट्र परिचर्या सेवेतील "सहायक अधिसेविका, पाठ्यनिर्देशिका, सार्वजनिक आरोग्य परिचारिका निर्देशिका, सार्वजनिक आरोग्य परिचारिका, मनोरुग्णतज्ञ परिचारिका, बालरुग्णतज्ञ परिचारिका, परिसेविका, अधिपरिचारिका" (गट-क) महाराष्ट्र परिचर्या सेवा (सेवाप्रवेश) नियम, २०२१" असे संबोधण्यात यावे.
२. या नियमांमध्ये संदर्भानुसार दुसरा अर्थ आवश्यक नसेल तर, -
(क) "बेसीक बॅचलर ऑफ सायन्स-नसिग" याचा अर्थ, भारतीय परिचर्या परिषदेने व इतर कोणत्याही संविधिक विद्यापीठाने दिलेली बेसीक बॅचलर ऑफ सायन्स-नसिग पदवी, असा आहे ;
(ख) "परिचर्या महाविद्यालय" याचा अर्थ, आरोग्य सेवा आयुक्तालय, मु ंबई यांच्या अधिपत्याखालील परिचर्यामधील पदविका, पदवी व पदव्युत्तर पदवी प्रमाणपत्र देणारे महाविद्यालय, असा आहे ;
(ग) "आयुक्त" याचा अर्थ, आयुक्त, आरोग्य सेवा तथा अभियान संचालक, राष्ट्रीय आरोग्य अभियान, महाराष्ट्र राज्य असा आहे ;
(घ) "आयुक्तालय" याचा अर्थ, आरोग्य सेवा आयुक्तालय व राज्य कामगार विमा योजना आयुक्तालय, महाराष्ट्र राज्य, असा आहे ;
(ङ) "विभाग" याचा अर्थ, महाराष्ट्र शासनाच्या अधिपत्याखालील सार्वजनिक आरोग्य विभाग, असा आहे ;
भाग चार-अ---३५-१ (१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च ८, २०२१/फाल्गुन १७, शके १९४२ (च) "जनरल नसिग ॲण्ड मिडवायफरी पदविका" याचा अर्थ भारतीय परिचर्या परिषदेच्या व महाराष्ट्र परिचर्या परिषदेच्या मान्यतेनुसार परिचर्या क्षेत्रातील शासकीय संस्थेतून मिळवलेले जनरल नसिग ॲण्ड मिडवायफरी पदविका प्रमाणपत्र, असा आहे ;
(छ) "शासन" याचा अर्थ, महाराष्ट्र शासन, असा आहे ;
ज) "भारतीय परिचर्या परिषद" याचा अर्थ, भारतीय परिचर्या परिषद अधिनियम, १९४७ (१९४७ चा ४८) याच्या कलम ३ च्या पोट-कलम (१) अन्वये गठित के लेली परिषद, असा आहे ;
(झ) "मास्टर ऑफ सायन्स-नसिग" याचा अर्थ, भारतीय परिचर्या परिषदेने किंवा इतर कोणत्याही संविधिक विद्यापिठाने दिलेली मास्टर ऑफ सायन्स-नसिग पदवी, असा आहे ;
(ट) "महाराष्ट्र परिचर्या परिषद" याचा अर्थ, महाराष्ट्र परिचारिका अधिनियम, १९६६ (१९६६ चा महा. ४०) याच्या कलम ३ च्या पोट- कलम (१) अन्वये गठित के लेली परिषद, असा आहे ;
(ठ) "मान्यता प्राप्त संस्था" याचा अर्थ, भारतीय परिचर्या परिषदेने, महाराष्ट्र परिचर्या परिषदेने, महाराष्ट्र राज्य शुश्रुषा व परावैद्यक शिक्षण मंडळाने, आरोग्य विज्ञान विद्यापीठाने व शासकीय व शासनमान्यताप्राप्त विद्यापीठाने मान्यता दिलेली संस्था, असा आहे.
३. (१) सहायक अधिसेविका/सहायक अधिसेवक या पदावरील नियुक्ती, परिसेविका किंवा सार्वजनिक आरोग्य परिचारिका किंवा मनोरुग्णतज्ञ परिचारिका किंवा बालरुग्णतज्ञ परिचारिका हे पद धारण करणाऱ्या व या पदावर किमान ३ वर्षांपेक्षा कमी नाही इतकी नियमित सेवा पूर्ण के लेल्या व्यक्तींमधून, योग्यतेस अधीन राहून, सेवा जेष्ठतेच्या आधारे योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल.
(२) पोट-नियम (१) मध्ये नमूद के लेल्या पदावरील नियुक्ती, परिसेविका, सार्वजनिक आरोग्य परिचारिका, मनोरुग्णतज्ञ परिचारिका व बालरुग्णतज्ञ परिचारिका यांच्यामधून अनुक्रमे ६०:१०:१५:१५ या प्रमाणात पदोन्नतीने करण्यात येईल.
४. (१) पाठ्यनिर्देशिका/पाठ्यनिर्देशक या पदावरील नियुक्ती, एकतर, -
(क) आयुक्तालयाच्या अखत्यारीतील परिसेविका, सार्वजनिक आरोग्य परिचारिका, मनोरुग्णतज्ञ परिचारिका व बालरुग्णतज्ञ परिचारिका हे पद धारण करणाऱ्या व या पदावर किमान ३ वर्षांपेक्षा कमी नाही इतकी नियमित सेवा असणाऱ्या आणि मास्टर ऑफ सायन्स-नसिग धारण करणाऱ्या व्यक्तींमधून, योग्यतेस अधीन राहून, सेवाजेष्ठतेच्या आधारे योग्य व्यक्तीच्या पदोन्नतीने नियुक्ती करण्यात येईल, किंवा
(ख) अधिपरिचारिका/अधिपरिचारक या पदावर किमान ३ वर्षांपेक्षा कमी नाही इतकी नियमित सेवा पूर्ण असणाऱ्या व मास्टर ऑफ सायन्स-नसिग धारण करणाऱ्या आणि पाठ्यनिर्देशिका/पाठ्यनिर्देशक या पदाच्या विभागीय परीक्षेद्वारे (विभागीय परिक्षेमध्ये रुग्णसेवा व अध्यापन कौशल्ये यांचा अंतर्भाव असेल) गुणवत्तेच्या आधारे नियुक्ती करण्यात येईल, किंवा
(ग) जे उमेदवार,-
(एक) अठरा वर्षांपेक्षा कमी आणि अडतीस वर्षापेक्षा अधिक वयाचे नाहीत; परंतु राखीव प्रवर्गातील उमेदवारांच्या बाबतीत, उच्च वयोमर्यादा पाच वर्षापयत शिथिल करण्यात येईल;
परंतु असे की, अगोदरच शासनाच्या नियमित सेवेत असलेल्या उमेदवारांच्या बाबतीत उच्च वयोमर्यादा पाच वर्षापयत शिथिल करण्यात येईल;
(दोन) मास्टर ऑफ सायन्स-नसिग धारण करतात; आणि
(तीन) शासकीय किंवा खाजगी रुग्णालयातील रुग्णांची सेवा किंवा शुश्रुषा करण्याचा किमान तीन वर्षांचा अनुभव धारण करतात अशा उमेदवारांमधून नामनिर्देशनाने करण्यात येईल.
(२ ) पोट-नियम (१) मध्ये नमूद के लेल्या पदावरील नियुक्ती, पदोन्नतीने, विभागीय परीक्षेद्वारे व नामनिर्देशनाद्वारे ५०:२५:२५ या प्रमाणात करण्यात येईल.
५. सार्वजनिक आरोग्य परिचारीका निर्देशिका/सार्वजनिक आरोग्य परिचारक निर्देशक या पदावरील नियुक्ती, आयुक्तालयाच्या अधिपत्याखालील सार्वजनिक आरोग्य परिचारिका/परिचारक या पदावर किमान तीन वर्षांपेक्षा कमी नाही इतकी नियमित सेवा पूर्ण असणाऱ्या व्यक्तींमधून योग्यतेच्या अधीन राहून सेवा जेष्ठतेच्या आधारे योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल.
६. (१) सार्वजनिक आरोग्य परिचारिका/परिचारक या पदावरील नियुक्ती, एकतर,-महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च ८, २०२१/फाल्गुन १७, शके १९४२ ३ (क) अधिपरिचारीका/अधिपरिचारक हे पद धारण करणाऱ्या व या पदावर किमान तीन वर्षांपेक्षा कमी नाही इतकी नियमित सेवा असणाऱ्या आणि
(एक) मान्यताप्राप्त संस्थेमधून कम्युनिटी हेल्थ नसिग यामधील विशेषता असलेली मास्टर ऑफ सायन्स-नसिग ; किंवा (दोन) मान्यताप्राप्त संस्थेमधून पोस्ट बेसिक डिप्लोमा इन पब्लिक हेल्थ नसिग (११ महिने) यासह मान्यताप्राप्त संस्थेमधून बेसिक बॅचलर ऑफ सायन्स-नसिग किंवा जनरल नसिग ॲण्ड मिडवायफरी धारण करणाऱ्या व्यक्तींमधून योग्यतेस अधीन राहून सेवाजेष्ठतेच्या आधारे योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल ; किंवा
(ख) जे उमेदवार,-
(एक) अठरा वर्षांपेक्षा कमी आणि अडतीस वर्षापेक्षा अधिक वयाचे नाहीत ;
परंतु, राखीव वर्गातील उमेदवारांच्या बाबतीत, उच्च वयोमर्यादा पाच वर्षापयत शिथिल करण्यात येईल ;
परंतु असे की, अगोदरच शासनाच्या नियमित सेवेत असलेल्या उमेदवारांच्या बाबतीत, उच्च वयोमर्यादा पाच वर्षापयत शिथिल करण्यात येईल ; आणि
(दोन) मान्यताप्राप्त संस्थेमधून कम्युनिटी हेल्थ नसिग यामध्ये विशेषता असलेली मास्टर ऑफ सायन्स-नसिग धारण करतात; किंवा मान्यताप्राप्त संस्थेमधून पोस्ट बेसिक डिप्लोमा इन पब्लिक हेल्थ नसिग (११ महिने) यासह मान्यताप्राप्त संस्थेमधून बेसिक बॅचलर ऑफ सायन्स-नसिग किंवा जनरल नसिग ॲण्ड मिडवायफरी धारण करतात ; आणि
(तीन) शासकीय/खाजगी रुग्णालयातील रुग्णांची सेवा किंवा शुश्रुषा करण्याचा किमान तीन वर्षांचा अनुभव असेल, अशा उमेदवारांमधून नामनिर्देशनाने करण्यात येईल.
(२) पोट - नियम (१) मध्ये नमूद के लेल्या पदावरील नियुक्ती, पदोन्नतीने व नामनिर्देशनाने, अनुक्रमे ७५:२५ या प्रमाणात करण्यात येईल.
७. (१) मनोरुग्णतज्ञ परिचारिका/परिचारक या पदावरील नियुक्ती एकतर, -
(क) आयुक्तालयाच्या अधिपत्याखालील अधिपरिचारीका/ अधिपरिचारक या पदावर किमान तीन वर्षांपेक्षा कमी नाही इतकी नियमित सेवा असणाऱ्या आणि
(एक) मान्यताप्राप्त संस्थेमधून सायकॅ ट्रीक नसिग मधील विशेषता असलेली मास्टर ऑफ सायन्स-नसिग ; किंवा (दोन) मान्यताप्राप्त संस्थेमधून पोस्ट बेसिक डिप्लोमा इन सायकॅ ट्रीक नसिग (११ महिने) यांसह मान्यताप्राप्त संस्थेमधून बेसिक बॅचलर ऑफ सायन्स-नसिग किंवा जनरल नसिग ॲण्ड मिडवायफरी अर्हता धारण करणाऱ्या व्यक्तींमधून योग्यतेस अधीन राहून जेष्ठतेच्या आधारे योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल; किंवा
(ख) जे उमेदवार, -
(एक) अठरा वर्षांपेक्षा कमी आणि अडतीस वर्षापेक्षा अधिक वयाचे नाहीत ;
परंतु, राखीव वर्गातील उमेदवारांच्या बाबतीत, उच्च वयोमर्यादा पाच वर्षापयत शिथिल करण्यात येईल ;
परंतु असे की, अगोदरच शासनाच्या नियमित सेवेत असलेल्या उमेदवारांच्या बाबतीत उच्च वयोमर्यादा पाच वर्षापयत शिथिल करण्यात येईल ; आणि
(दोन) मान्यताप्राप्त संस्थेमधून सायकॅ ट्रीक नसिग यामधील विशेषता असलेली मास्टर ऑफ सायन्स-नसिग; किंवा मान्यताप्राप्त संस्थेमधून पोस्ट बेसिक डिप्लोमा इन सायकॅ ट्रीक नसिग (११ महिने) यांसह मान्यताप्राप्त संस्थेमधून बेसिक बॅचलर ऑफ सायन्स-नसिग किंवा जनरल नसिग ॲण्ड मिडवायफरी धारण करतात ; आणि (तीन) शासकीय/खाजगी रुग्णालयातील रुग्णांची परिचर्या किंवा शुशषा करण्याचा किमान तीन वर्षांचा अनुभव आहे, अशा उमेदवारांमधून नामनिर्देशनाने करण्यात येईल.
(२) पोट - कलम (१) मध्ये नमूद के लेल्या पदावरील नियुक्ती, पदोन्नतीने व नामनिर्देशनाने अनुक्रमे ७५:२५ या प्रमाणात करण्यात येईल.
भाग चार-अ---३५-२४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च ८, २०२१/फाल्गुन १७, शके १९४२ ८. (१) बालरोग तज्ञ परिचारिका/परिचारक या पदाची नियुक्ती एकतर, -
(क) आयुक्तालयाच्या अधिपत्याखालील अधिपरिचारीका/अधिपरिचारक या पदावर किमान तीन वर्षापेक्षा कमी नाही इतकी नियमित सेवा असणाऱ्या आणि, -
(एक) मान्यताप्राप्त संस्थेमधून पेडिॲट्रीक्स नसिग यामधील विशेषता असलेली मास्टर ऑफ सायन्स-नसिग; किंवा (दोन) मान्यताप्राप्त संस्थेमधून पोस्ट बेसीक डिप्लोमा इन पेडिॲट्रीक्स नसिग (११ महिने) यांसह मान्यताप्राप्त संस्थेमधून बेसिक बॅचलर ऑफ सायन्स-नसिग किंवा जनरल नसिग ॲण्ड मिडवायफरी धारण करणाऱ्या व्यक्तींमधून योग्यतेस अधीन राहून जेष्ठतेच्या आधारे योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल; किंवा
(ख) जे उमेदवार,-
(एक) अठरा वर्षांपेक्षा कमी आणि अडतीस वर्षापेक्षा अधिक वयाचे नाहीत;
परंतु राखीव वर्गातील उमेदवारांच्या बाबतीत, उच्च वयोमर्यादा पाच वर्षापयत शिथिल करण्यात येईल;
परंतु असे की, अगोदरच शासनाच्या नियमित सेवेत असलेल्या उमेदवारांच्या बाबतीत उच्च वयोमर्यादा पाच वर्षापयत शिथिल करण्यात येईल; आणि,
(दोन मान्यताप्राप्त संस्थेमधून पेडिॲट्रिक्स नसिग यामधील विशेषता असलेली मास्टर ऑफ सायन्स-नसिग; किंवा मान्यताप्राप्त संस्थेमधून पोस्ट बेसीक डिप्लोमा इन पेडिॲट्रिक्स नसिग (११ महिने) यांसह मान्यताप्राप्त संस्थेमधून बेसिक बॅचलर ऑफ सायन्स-नसिग किंवा जनरल नसिग ॲण्ड मिडवायफरी धारण करतात; आणि (तीन) शासकीय/खाजगी रुग्णालयातील रुग्णांची परिचर्या किंवा शुशषा करण्याचा किमान तीन वर्षांचा अनुभव आहे, अशा उमेदवारांमधून नामनिर्देशनाने करण्यात येईल.
(२) पोट-नियम (१) मध्ये नमूद के लेल्या पदावरील नियुक्ती, पदोन्नतीने व नामनिर्देशनाने अनुक्रमे ७५:२५ या प्रमाणात करण्यात येईल.
९. परिसेविका/परिसेवक या पदावरील नियुक्ती, आयुक्तालयातील अधिपरिचारीका/अधिपरिचारक हे पद धारण करणाऱ्या व त्या पदावर किमान तीन वर्षांची नियमित सेवा असणाऱ्या व्यक्तीमधून संबंधित परिमंडळाच्या उप संचालकाद्वारे योग्यतेच्या अधीन राहून सेवा जेष्ठतेच्या आधारे पदोन्नतीने करण्यात येईल.
१०. (१) अधिपरिचारिका/अधिपरिचारक पदावरील नियुक्ती, जे उमेदवार,-
(एक) अठरा वर्षांपेक्षा कमी आणि अडतीस वर्षापेक्षा अधिक वयाचे नाहीत;
परंतु राखीव वर्गातील उमेदवारांच्या बाबतीत, उच्च वयोमर्यादा पाच वर्षापयत शिथिल करण्यात येईल;
(दोन) मान्यताप्राप्त संस्थेतील बेसिक बॅचलर ऑफ सायन्स-नसिग किंवा जनरल नसिग ॲण्ड मिडवायफरी धारण करतात, अशा उमेदवारांमधून, नामनिर्देशनाद्वारे करण्यात येईल.
(२) पोट-नियम (१) मध्ये नमूद के लेल्या पदावरील नियुक्ती, शासकीय परिचर्या महाविद्यालयामधून व खाजगी परिचर्या महाविद्यालयामधून, अनुक्रमे ५०:५० या प्रमाणात करण्यात येईल.
११. नियम ४, ६, ७, ८ व १० मध्ये नमूद के लेल्या पदांपैकी कोणत्याही पदावर सरळसेवेने नियुक्तीसाठी स्र्ती व पुरुष यांचे प्रमाण अनुक्रमे ९०:१० इतके असेल.
१२. नियम ३ ते १० मध्ये नमूद के लेल्या पदांपैकी कोणत्याही पदावर नियुक्त के लेल्या व्यक्तीने महाराष्ट्र परिचारीका अधिनियम, १९६६ (१९६६ चा महा. ४०) अन्वये त्याची स्वत:ची किंवा तिची स्वत:ची नियुक्तीपूर्वी नोंदणी के ली नसेल तर, पदासाठी अर्ज करण्यापूर्वी नोंदणी करणे आवश्यक असेल. उक्त अधिनियमात विनिर्दिष्ट के लेला कालावधी पूर्ण होण्यापूर्वी त्याने/तिने वेळोवेळी अशा नोंदणीचे नूतनीकरण करणे आवश्यक असेल.
१३. भारतीय परिचर्या परिषदेच्या निकषानुसार, दुरस्थ शिक्षणाद्वारे कोणत्याही मुक्त विद्यापीठातून यात विनिर्दिष्ट के लेली परिचर्येमधील अर्हता धारण करणारा तसेच दूरस्थ शिक्षणाद्वारे कोणत्याही मुक्त विद्यापिठातून परिचर्येमधील अशी अर्हता प्राप्त के ल्यानंतर ज्याने मान्यता प्राप्त विद्यापीठाची पदव्युत्तर पदवी धारण के ली आहे असा उमेदवार, नियम ३ ते १० मध्ये नमूद के लेल्या अशा पदांकरितामहाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च ८, २०२१/फाल्गुन १७, शके १९४२ ५ नियुक्तीसाठी पात्र असणार नाही.
१४. (१) नियम ४, ६, ७, ८ व १० मध्ये नमूद के लेल्या पदांपैकी कोणत्याही पदावर सरळसेवेने नियुक्त के लेली व्यक्ती, एक वर्षाच्या कालावधीसाठी परिवीक्षेवर असेल. परिवीक्षा कालावधी, जास्तीत जास्त एक वर्षापयत वाढविता येईल. सदर पदावर नियुक्ती के लेल्या व्यक्तीने, परिवीक्षा कालावधी समाधानकारकरित्या पूर्ण करणे आवश्यक असेल. परिवीक्षा कालावधी पूर्ण होण्यासाठी, रुग्णसेवेसाठी ६० गुण व लेखी परीक्षेसाठी ४० गुण यांचा समावेश असणारी जिल्हा रुग्णालयाने घेतलेली विभागीय परीक्षा उत्तीर्ण होणे अनिवार्य असेल. जर त्याने/तिने परिवीक्षा कालावधी समाधानकारकरित्या पूर्ण न के ल्यास अथवा विहित परिवीक्षा कालावधीत तो/ती, त्या पदासाठी योग्य असल्याचे आढळून न आल्यास, तो/ती सेवा समाप्त करण्यास पात्र असेल.
(२) नियम ४, ६, ७, ८ व १० मध्ये नमूद के लेल्या पदांपैकी कोणत्याही पदावर सरळसेवेने नियुक्त के लेली व्यक्ती, परिवीक्षाधीन कालावधी, जिल्हा रुग्णालयात सहा महिने रुग्णसेवा करून पूर्ण करील.
१५. नियम ३ ते १० मध्ये नमूद के लेल्या पदांपैकी कोणत्याही पदावर नियुक्त झालेल्या व्यक्तीने विभागीय परीक्षा (विहीत के लेली असल्यास कोणतीही) आणि याबाबतीत के लेल्या नियमांनुसार तो किंवा ती, हिंदी व मराठी भाषा परीक्षा अगोदरच उत्तीर्ण झालेला नसेल अथवा या परीक्षा उत्तीर्ण होण्यापासून त्याला किंवा तिला सूट मिळालेली नसेल तर, या दोन्ही उत्तीर्ण होणे आवश्यक असेल.
१६. नियम ३ ते १० मध्ये नमूद के लेल्या पदांपैकी कोणत्याही पदावर नियुक्त के लेली व्यक्ती, शासनाच्या माहिती व तंत्रज्ञान संचालनालयाने वेळोवेळी विहीत के लेले संगणक चालवण्याचे प्रमाणपत्र धारण करील.
१७. नियम ३ ते ८ मध्ये नमूद के लेल्या पदांपैकी कोणत्याही पदावर नियुक्त झालेली व्यक्ती महाराष्ट्रात कोठेही बदलीस पात्र असेल, तसेच नियम ९ व १० मध्ये नमूद के लेली पदे परिमंडळात बदलीस पात्र असतील.
१८. नियम ४, ६, ७, ८ व १० मध्ये नमूद पदावर सरळसेवेने नियुक्त झालेल्या व्यक्तीने, महाराष्ट्र नागरी सेवा (लहान कु टु ंबांचे प्रतिज्ञापत्र) नियम, २००५ यानुसार शासनाने वेळोवेळी विहित के लेले लहान कु टु ंबाचे प्रमाणपत्र नियुक्तीच्या वेळी सादर करावयाचे आहे, अन्यथा ती व्यक्ती शासकीय सेवेसाठी अपात्र ठरेल.
१९. नियम ३ ते १० मध्ये नमूद के लेल्या पदांपैकी कोणत्याही पदावर नियुक्ती करण्यासाठी विहित के लेल्या शैक्षणिक अर्हता, अनुभव व अन्य शर्ती, भारतीय परिचर्या परिषदेकडून वेळोवेळी सुधारणा के ल्याप्रमाणे व मान्यता दिल्याप्रमाणे लागू होतील.
२०. नियम ३ ते १० मध्ये नमूद के लेल्या पदांपैकी कोणत्याही पदावर नियुक् त झालेली व्यक्ती, आवश्यकतेनुसार भारतीय संरक्षण सेवेअंतर्गत सेवा करण्यास पात्र असेल.

CONSTITUTION OF INDIA.
No. RR-2019/Nursing/C.R.140/Seva 5.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules, orders, Government Resolutions or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of Assistant Matron, Tutor, Public Health Nurse Instructor, Public Health Nurse, Psychiatric Nurse, Pediatric Nurse, Incharge Sister and Staff Nurse (Group C) in the Maharashtra Nursing Services in the Commissionarate of Health Services and Employees State Insurance Scheme, under the Public Health Department of the Government, namely:—
1. These rules may be called the Assistant Matron, Tutor, Public Health Nurse Instructor, Public Health Nurse, Psychiatric Nurse, Pediatric Nurse, Incharge Sister and Staff Nurse (Group C) in the Maharashtra Nursing Services in the Commissionarate of Health Services and Employees State Insurance Scheme, under the Public Health Department of the Government (Recruitment) Rules, 2021.
2. In these rules, unless the context requires otherwise,—
() "Basic Bachelor of Science (Nursing)" means a degree of Basic Bachelor of Science (Nursing) issued by the Indian Nursing Council or any other statutory university ;
() "College of Nursing" means the College of Nursing providing diploma, degree and post degree certificate in Nursing, under the Commissionerate of Health Services, Mumbai ;
() "Commissioner" means the Commissioner of Health Services Director of National Rural Health Mission, Maharashtra State ;
() "Commissionarate" means the Commissionarate of Health Services and Commissionarate of Employees State Insurance Scheme, Maharashtra State ;
() "Department" means the Public Health Department, under the Government of Maharashtra ;
() "General Nursing and Midwifery Diploma" means the General Nursing and Midwifery Diploma certificate, obtained from a Government Institution in the field of Nursing as per the approval of the Indian Nursing Council and Maharashtra Nursing Council ;
() "Government" means the Government of Maharashtra ;
() "Indian Nursing Council" means the Indian Nursing Council constituted under sub-section (१) of section 3 of the Indian Nursing Council Act, 1947 (48 of 1947) ;
() "Master of Science (Nursing)" means a degree of Master of Science (Nursing) issued by the Indian Nursing Council or any other statutory university ;
() "Maharashtra Nursing Council" means a Council constituted under sub-section (१) of section 3 of the Maharashtra Nurses Act 1966 (Mah. XL of 1966) ;
() "recognized institute" means a institute recognized by the Indian Nursing Council, Maharashtra Nursing Council, the Maharashtra State Board of Nursing and Paramedical Education, the Maharashtra University of Health Science, the Government and Government recognized University.

(१) Appointment to the post of Assistant Matron shall be made by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of In- charge Sister or Public Health Nurse or Psychiatric Nurse or Pediatric Nurse having minimum three years regular service on that post.
(२) Appointment to the post mentioned in sub-rule (1) shall be made by promotion from amongst In-charge Sister, Public Health Nurses, Psychiatric Nurses and Pediatric Nurses in the ratio of 60:10:15:15, respectively.
4. (१) Appointment to the post of Tutor shall be made either,—
() by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of In-charge Sister, Public Health Nurses, Psychiatric Nurses and Pediatric Nurses under the Commissionarate, having minimum three years regular service on that post and possessing a degree in Master of Science (Nursing) ; or () by the Departmental Examination (a Departmental exam shall comprise of patient care and teaching skills) of Staff Nurses on the basis of merit and having minimum three years regular service on that post and possessing a degree in Master of Science (Nursing) ; or
() by nomination from amongst the candidates who,—
() are not less than eighteen years of age and not more than thirty-eight years of age:
Provided that, the upper age limit shall be relaxed upto five years in case of candidates belonging to reserved category :
Provided also that, the upper age limit shall be relaxed upto five years in the case of candidates who are already in the service of Government ;
() shall possess a degree in Master of Science (Nursing) ; and
() shall have minimum three years' experience of patient care or nursing care in the Government or private Hospital.
(२) Appointment to the post mentioned in sub-rule (1) by promotion, Departmental Examination and nomination shall be made in the ratio of 50:25:25, respectively.
5. Appointment to the post of Public Health Nurse Instructor shall be made by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Public Health Nurse under the Commissionarate having minimum three years regular service on that post.
6. (१) Appointment to the post of Public Health Nurse shall be made either,—
() by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Staff Nurse under the Commissionarate having minimum three years regular service on that post and possessing,—
() a degree in Master of Science (Nursing) in speciality in Community Health Nursing from recognized institute ; or
() a Basic Bachelor of Science (Nursing) degree or General Nursing and Midwifery Diploma from recognized institute along with Post Basic Diploma in Public Health Nursing (11 month) from recognized institute ; or
() by nomination from amongst the candidates who,—
() are not less than eighteen years of age and not more than thirty-eight years of age :

Provided also that, the upper age limit shall be relaxed upto five years in the case of candidates who are already in the service of Government ; and
() possesses a degree in Master of Science (Nursing) in speciality in Community Health Nursing from recognized institute ; or
possesses a Basic Bachelor of Science (Nursing) degree or General Nursing and Midwifery Diploma from recognized institute along with Post Basic Diploma in Public Health Nursing (11 months) from recognized institute ; and
() shall have minimum three years' experience of patient care or nursing care in Government or private Hospital.
(२) Appointment to the post mentioned in sub-rule (1) by promotion and nomination shall be made in the ratio of 75:25, respectively.
7. (१) Appointment to the post of Psychiatric Nurse shall be made either,—
() by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Staff Nurse under the Commissionarate, having minimum three years regular service on that post and possessing , —
() a degree in Master of Science (Nursing) in speciality in Psychiatric Nursing from recognized institute ; or
() a Basic Bachelor of Science (Nursing) degree or General Nursing and Midwifery Diploma from recognized institute along with Post Basic Diploma in Psychiatric Nursing (11 months) from recognized institute ; or
() by nomination from amongst the candidates who, —
() are not less than eighteen years of age and not more than thirty-eight years of age :
Provided that, the upper age limit shall be relaxed upto five years in case of candidates belonging to reserved category :
Provided also that, the upper age limit shall be relaxed upto five years in the case of candidates who are already in the service of Government ; and
(ii) possesses a degree in Master of Science (Nursing) in speciality in Psychiatric Nursing from recognized institute ; or
possesses a Basic Bachelor of Science (Nursing) degree or General Nursing and Midwifery Diploma from recognized institute along with Post Basic Diploma in Psychiatric Nursing (11 months) from recognized institute ; and
() shall have minimum three years' experience of patient care or nursing care in the Government or private Hospital.
(२) Appointment to the post mentioned in sub-rule (1) shall be made by promotion and nomination in the ratio of 75:25, respectively.
8. (१) Appointment to the post of Pediatric Nurse shall be made by either,—
() by promotion of a suitable person on the basis of seniority subject to fitness, from amongst the persons holding the post of Staff Nurse in the Commissionarate, having minimum three years regular service on that post and possessing, —
() a degree in Master of Science (Nursing) in speciality in Pediatric Nursing from recognized institute ; or
() a Basic Bachelor of Science (Nursing) degree or General Nursing and Midwifery Diploma from recognized institute along with Post Basic Diploma in Pediatric Nursing (11महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च ८, २०२१/फाल्गुन १७, शके १९४२ ९ months) from recognized institute ; or
() by nomination from amongst the candidates who, —
() are not less than eighteen years of age and not more than thirty-eight years of age :
Provided that, the upper age limit shall be relaxed upto five years in case of candidates belonging to reserved category :
Provided also that, the upper age limit shall be relaxed upto five years in the case of candidates who are already in the service of Government ; and
() possesses a degree in Master of Science (Nursing) in speciality in Pediatric Nursing from recognized institute ; or
possess a in Bachelor of Science (Nursing) degree or General Nursing and Midwifery Diploma from recognized institute alongwith Post Basic Diploma in Pediatric Nursing (11 months) from recognized institute ; and
() shall have minimum three years' experience of patient care or nursing care in the Government or private Hospital.
(२) Appointment to the post mentioned in sub-rule (१) shall be made by promotion and nomination in the ratio of 75:25, respectively.
9. Appointment to the post of Sister Incharge shall be made by promotion of a suitable person on the basis of seniority subject to fitness, from amongst the persons holding the post of Staff Nurse in the Commissionarate, having minimum three years regular service on that post through the concerned Deputy Director of that Circle.
10. (१) Appointment to the post of Staff Nurse shall be made by nomination from amongst the candidates who, —
() are not less than eighteen years of age and not more than thirty-eight years of age:
Provided that, the upper age limit shall be relaxed upto five years in case of candidates belonging to reserved category ; and
() Possesses a Basic Bachelor of Science (Nursing) degree or General Nursing and Midwifery Diploma from recognized institute.
(२) Appointment to the post mentioned in sub-rule (१) shall be made from the Government nursing colleges and the private nursing colleges in the ratio of 50:50, respectively.
11. The ratio for female and male for the posts mentioned in rules 4, 6, 7, 8 and 10 by nomination shall be 90:10, respectively.
12. A person appointed on any of the posts mentioned in rules 3 to 10 shall be required to get himself or herself registered under the Maharashtra Nurses Act, 1966 (Mah. XL of 1966) before applying for the post, unless he/she has already registered. He/she shall be required to renew such registration, from time to time, before completion of the period specified in the said Act. 13. As per the norms of the Indian Nursing Council, candidate possessing qualification in Nursing specified herein from any Open University by Distance Education as well as those who have after obtaining such qualification in Nursing from any open University by Distance Education possess a post graduation degree from recognized university shall not be eligible for such posts mentioned in rules 3 to 10.
14. (१) A person appointed on any of the posts mentioned in rules 4, 6, 7, 8 and 10 by nomination shall be on probation for a period of one year. Probation period may be extended maximum upto one year. A person appointed to the post shall be required to complete the probation period satisfactorily. Clearance of Departmental Examination conducted at District Hospital consisting of 60 marks for patient care and 40 marks written, shall be mandatory for१० महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च ८, २०२१/फाल्गुन १७, शके १९४२ completion of the probation period. If he does not complete the probation period satisfactorily or not found suitable for the post, during the probation period, he shall be liable to be terminated from the service.
(२) A person appointed on any of the posts mentioned in rules 4, 6, 7, 8 and 10 by nomination shall complete six months patient care in District Hospital during the probation period.
15. A person appointed on any of the posts mentioned in rules 3 to 10 shall be required to pass the Departmental Examination (if any prescribed) and examinations in Marathi and Hindi languages according to the rules made in that behalf, unless he or she has already passed or has been exempted from passing those examinations.
16. A person appointed on any of the posts mentioned in rules 3 to 10 shall possess a Certificate in Computer Operations prescribed by the Directorate of Information and Technology, Government, from time to time.
17. A person appointed on any of the posts mentioned in rules 3 to 8 shall be liable for transfer anywhere in the State of Maharashtra, whereas posts mentioned in rules 9 and 10 shall be liable for transfers within the Circle.
18. A person appointed by nomination to the posts mentioned in rules 4, 6, 7, 8 and 10 has to submit the certificate of Small Family as per the Maharashtra Civil Services (Small Family Certification) Rules, 2005 by the Government from time to time, otherwise he will be disqualified for the Government service.
19. The educational qualifications, experience and other conditions prescribed for appointment to the posts mentioned in in rules 3 to 10 shall remain applicable as revised and approved by the Indian Nursing Council, from time to time.
20. A person appointed on any of the posts mentioned in rules 3 to 10 shall be liable to serve Indian Defence Services as per requirement.
