BY MEMBER SECRETARY, ZONE CHANGE COMMITTEE AND JOINT DIRECTOR OF TOWN PLANNING NOTICE U/S 20 (3) OF MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, the Revised Regional Plan of Nagpur Region (hereinafter referred to as "the said Regional Plan") has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-1505/CR-273/ 96/UD-9, dated the 6th May 2000 under Section 15 of the Maharashtra Regional and Town Planning Act, 1966 (Mah.
XXXVII of 1966) (hereinafter referred to as "the said Act") and has come into force with effect from the 15th July 2000 ;
Whereas, the Government vide Resolution No. TPS 1815/CR-49/15/UD-13, dated 6th May 2015 issued directives under Section 154 of the Maharashtra Regional and Town Planning Act, 1966 regarding the procedure to be followed under Section 20 of the said Act for making changes in the use of land in the areas of sanctioned Regional Plans underद्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, +रू]क्ष् १२-१८, २०२१/रम् २१-२७, ॅ १९४३ ३ the said Act issued order to follow revised procedure related to above directives vide Govt. Resolution No.TPS-1815/ C. No. 49/15/UD-13, dated 04-012016; and in exercise of the powers connferred by sub-section (1) of Section 151 of the said Act, the Government vide its Notification No. TPS-1815/CR-49/15/UD-13, dated 06-05-2015, delegated the powers exercisable by it under the provisions of Section 20(3) & 20(4) of the said Act, (subject to conditions mentioned therein) to the Divisional Joint Director of Town Planning for Nagpur Administrative Division ;
And whereas, total land admeasuring approx 11.12 hectare bearing Survey No. 66 admeasuring area 2.72 HA., Survey No. 92/1 & 92/2 admeasuring area 3.14 HA. Survey Nos. 101/1 & 101/2 admeasuring area 2.94 HA., Survey No. 104 admeasuring area 2.32 HA. of Mouza-Bhojapur, Tal. Ramtek, District-Nagpur (hereinafter referred to as "the said Area") is included in 'Agriculture Zone' of proposed Land Use Plan in the sanctioned Regional Plan of Nagpur ;
And whereas, the "Proposal Scrutiny & Sanctioning Committee" established under the above mentioned Govern- ment Resolution, after consulting to the Director of town Planning, Maharashtra State, Pune, is of the opinion that the said area should be deleted from "Agriculture Zone" and to be included in "Residential Zone" in accordance with the provsions of sub-section (2) of Section 20 of the said Act, subject to following conditions :—
(1) It will be binding for the applicant to pay requisite premium and to follow conditions laid down in the above said Government Resolutions.
(2) As prescribed in affidavit of Survey No. 101 & 104 submitted by applicant, with regard to certificate issued by Revenue Department for construction of C. D. Work, it will be binding to all applicant's to construct C. D. work in such a way that it will not make obstruction to floodflow, after verification and confirmation of its location by Joint Director of Town Planning, Nagpur before issue of notification u/s 20 (4). (3) It will be binding for the applicant's to follow recommendations prescribed in letter dated 12-03-2019 issued by Senior Geologist, G.S.D.A. regarding sufficient water availability.
(4) It will be binding for the applicant's to follow conditions laid down in 'Schedule-C' of Government Resolution dated 06-05-2015.
Now, therefore, under the power delegated by the Govt. in this regard, suggestions/objections with reasons are invited from General Public in accordance with Notice u/s 20(3) of said Act in respect of proposed modification within 30 days from the date of publication of this notice in the Maharashtra Government Gazette ;
The suggestions and/or objections shall be addressed to the Assistant Director of Town Planning, Nagpur Branch, Nagpur, Administrative Buildinng, No. 1, Second Floor, Civil Lines, Nagpur ; 440 001. Assistant Director of Town Planning, Nagpur Branch, Nagpur is duly authorized to hear the suggestions/objections received within the stipulated period and to submit the report thereon ;
The plan showing the proposed modification is kept open for inspection to the public during office hours on all working days for a period of one month in the following officers :—
(1) Collector, Nagpur.
(2) Joint Director of Town Planning, Nagpur Division, Nagpur.
(3) Assistant Director of Town Planning, Nagpur Branch, Nagpur.
