MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.—
ORDER
No. DTP-D.P. Warud [O (R)+A]-Sec.-127(2)-Order-TPV-VI-4120-2021.—
Whereas, the Development Plan of Warud Municipal Council [Original (Revised)+Additional) has been partly sanctioned under the provisions of Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah.
XXXVII of 1966) (hereinafter referred to as " the said Act ") by the Government in Urban Development Department vide its Notification No. TPS-2803-1896-CR-8(A)-2004-UD-30, dated 15th July 2005 (hereinafter referred to as " the said Notification ") and came into force with effect from 1st September 2005, while Republished Development plan of Excluded Part of Warud has been sanctioned vide Notification No. TPS-2806-379-CR-243-2006-UD-30, dated 6th June 2007 and came into force with effect from 16th July 2007 (hereinafter referred to as " the said Sanctioned Development Plan ") ;
And whereas, in the said Sanctioned Development Plan, the land bearing S. No. 373 (Part), 374 (Part) and S. No. 375 (Part) of Mouza Warud is reserved for Site No. 9 " Town Hall " (hereinafter referred to as " the said Reservation ") for which Appropriate Authority is Municipal Council, Warud (hereinafter referred to as " the said Appropriate Authority ") ;
And whereas, the land under said reservation has not been acquired by the said Appropriate Authority within 10 (Ten) years from the date on which the said Sanctioned Revised Development Plan came into force ;
And whereas, on behalf of the concerned land owners (hereinafter referred to as " the said Land Owners ") of the lands under the said reservation in respect of S. No. 373 (Part), 374 (Part) and S. No. 375 (Part) of Mouza Warud (hereinafter referred to as " the said Land ") Adv. S. H. Chhangani had served a notice dated 16th September 2018 under Section 127(1) of the the said Act, (hereinafter referred to as " the said Notice ") which was received by the said Appropriate Authority on 27th September 2018 ;
And whereas, the said lands under the said reservation are not acquired or no steps as required under Section 127(1) of the said Act have been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice ;
And whereas, the Chief Officer, Municipal Council, Warud vide letter No. 2291/2020, dated 9th November 2020 has communicated that the said lands are not acquired within a stipulated period ;
And whereas, as per the report of the Joint Director of Town Planning, Amravati Division, Amravati vide letter No. 687, dated 14th June 2021, it is clarified that the lands bearing (i) S. No. 373 (Part) (ii) S. No. 374 (Part) and (iii) S. No. 375 (Part) of Mouza Warud, of which areas admeasuring 0.41 Ha., 0.35 Ha. and 0. 13 Ha. respectively are lapsed from the said reservation ;
And whereas, after considering the above facts in respect of the said reservation on the said lands in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127(2) of the said Act, regarding the lapsing of the said reservation on the said lands ;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813/3211/CR-508/UD-13, dated 1st December 2016, has delegated the powers exercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said reservation in respect of the said lands under Section 127(2)४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, रू]क्ष्दन् २३-२९, २०२१/+ह्य १-७, ॅ १९४३ of the said Act and for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows—

XXXVII of 1966) (hereinafter referred to as " the said Act ") by the Government in Urban Development Department vide its Notification No. TPS-2803-1896-CR-8(A)-2004-UD-30, dated 15th July 2005 (hereinafter referred to as " the said Notification ") and came into force with effect from 1st September 2005, while republished Development Plan of Excluded Part of Warud has been sanctioned vide Notification No. TPS-2806-379-CR-243-2006-UD-30, dated 6th June 2007 and came into force with effect from 16th July 2007 (hereinafter referred to as " the said Sanctioned Development Plan ") ;
And whereas, in the said Sanctioned Development Plan, the land bearing S. No. 369 (Part) and S. No. 376 (Part) of Mouza Warud is reserved for Site No. 8 " Primary School " (hereinafter referred to as " the said Reservation ") for which Appropriate Authority is Municipal Council, Warud (hereinafter referred to as " the said Appropriate Authority ") ;
And whereas, the land under said reservation has not been acquired by the said Appropriate Authority within 10 (Ten) years from the date on which the said Sanctioned Revised Development Plan came into force ;
And whereas, on behalf of the concerned land owners (hereinafter referred to as " the said Land Owners ") of the lands under the said reservation in respect of S. No. 369 (Part) S. No. 376 (Part) of Mouza Warud (hereinafter referred to as " the said Land ") Adv. S. H. Chhangani had served a notice dated 16th September 2018 under Section 127(1) of the the said Act, (hereinafter referred to as " the said Notice ") which was received by the said Appropriate Authority on 27th September 2018 ;
And whereas, the said lands under the said reservation are not acquired or no steps as required under Section 127(1) of the said Act have been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice ;
And whereas, the Chief Officer, Municipal Council, Warud vide letter No. 2290/2020, dated 9th November 2020 has communicated that the said lands are not acquired within a stipulated period ;
And whereas, as per the report of the Joint Director of Town Planning, Amravati Division, Amravati vide letter No. 686, dated 14th June 2021, it is clarified that the lands bearing (i) S. No. 369 (Part) and (ii) S. No. 376 (Part) of Mouza Warud, of which areas admeasuring 0.37 Ha., and 0.3356 Ha. respectively are lapsed from the said reserva- tion ;
द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, रू]क्ष्दन् २३-२९, २०२१/+ह्य १-७, ॅ १९४३ ७And whereas, after considering the above facts in respect of the said reservation on the said lands in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127(2) of the said Act, regarding the lapsing of the said reservation on the said lands ;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813/3211/CR-508/UD-13, dated 1st December 2016, has delegated the powers exercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said reservation in respect of the said lands under Section 127(2) of the said Act and for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows—
After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added :—

Note :–(1) The said lands so released from the said reservation shall become available to the said land owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Sanctioned Development Plan.
(2) A copy of the part plan of the said Sanctioned Development Plan showing the area of the said lands which is lapsed from the said reservation, is available in the office of the Chief Officer, Municipal Council, Warud, District Amravati during office hours on all working days for inspection to public upto one month.
(3) This Order shall also be published on the Directorate's official website www.dtp.maharashtra.gov.in. Pune :
