ORDER
No. D.T.P.-D.P.Risod[O(R)+E.L.]-Sec. 127(2)-Order-TPV-6-4667.—
Whereas, the Development Plan of Risod Municipal Council [Original (Revised)+Extended limit] has been partly sanctioned under the provisions of Section 31(1) of the Maharashtra Regional & Town Plan- ning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide its Notification No. TPS-4105-1353-CR-209-(A)-2005-UD-30, dated 4th August 2006 (hereinafter referred to as "the said Notification") & came into force with effect from 1st October 2006 (hereinafter referred to as "the said Sanctioned Development Plan") ;
And whereas, in the said Sanctioned Development Plan, the land bearing S. No. 49 (Part) of Mouza Risod is reserved for Site No. 56 "Play Ground" approximate area 1.93 Ha., (hereinafter referred to as "the said Reservation") for which Appropriate Authority is Municipal Council, Risod (hereinafter referred to as "the said Appropriate Authority") ;
And whereas, the land under said reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan came into force ;
And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") of the land under the said reservation in respect of area 1.84 Ha of S. No. 49 (Part) of Mouza Risod (hereinafter referred to as "the said land") had served a notice under Section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 1st November 2018 ;
And whereas, the said land under the said reservation is not acquired or no steps as required under Section 127(1) of the said Act have been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice ;
And whereas, the Chief Officer, Municipal Council, Risod vide letter No. 449/2021, dated 18th March 2021 has communicated that the Municipal Council has resolved not to acquire the said land and hence the said reservation on the said land is lapsed as per the provisions of the said Act ;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati vide letter No. 943, dated 3rd August 2021 has submitted report that area admeasuring 1.78 Ha. of the said land affected by the said Reservation and the said Appropriate Authority has not taken any action within the stipulated period under the provisions of Section 127(1) of the said Act to acquire the said land and therefore, the said Reservation on the said land has been lapsed ;
And whereas, after considering the above facts in respect of the said reservation on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127(2) of the said Act, regarding the lapsing of the said reservation on the land admeasuring 1.78 Ha. of the said land ;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December 2016 has delegated the powers exercisable by the under Section 127(2) of the said Act in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority to the Director of Town Planning , Maharashtra State, Pune ;

After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Development Plan, the following new entry shall be added :–

Note.– (1) The land so released from the said reservation shall become available to the said Land Owner for the purpose of development as otherwise permissible in the case of adjacent land under the said Sanctioned Development Plan.
(2) A copy of the part plan of the said Sanctioned Development Plan showing the area of the land which is lapsed from the said reservation is available in the office of the Chief Officer, Municipal Council, Risod, District Washim during office hours on all working days for inspection to public upto one month.
(3) This Order shall also be published on the Directorate's official website www.dtp.maharashtra.gov.in.

XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide its Notification No. TPS-2795-1267-CR-198-95-UD-13, datedद्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, +]क्ष्दन् २८-म्दन् ३, २०२१ / ॅॅ ६-१२, ॅ १९४३ ७ 26th May,1998 (hereinafter referred to as "the said Notification") & came into force with effect from dated 26th July 1998 while Republished Development Plan of Excluded Part of Pusad has been sanctioned vide Notification No.TPS-2700-4512-CR-53A-2001-UD-30, dated 6th August,2001 & came into force with effect from date 1st October, 2001 (hereinafter referred to as "the said Sanctioned Development Plan") ;
And whereas, in the said Sanctioned Development Plan, the land bearing S. No. 32/2 (Part), of Mouza Pusad is reserved for (i) Site No. 23 "Garden" approximate area 0.96 Ha., (ii) Site No.24 "Secondary School" approximate area 0.90 Ha., & (iii) Site No. 31 "Convenient Shopping" approximate area 0.30 Ha., (hereinafter referred to as "the said Reservation") for which Appropriate Authority is Municipal Council, Pusad (hereinafter referred to as "the said Appropriate Authority") ;
And whereas, the land under said reservations have not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan came into force ;
And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") of the land bearing S. No.32/2 (Part) of Mouza Pusad having an area 0.80 Ha. partly affected by the said reservations (hereinafter referred to as "the said land") had served a notice under Section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 1st June 2018 ;
And whereas, the said land under the said reservations are not acquired or no steps as required under Section 127(1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice ;
And whereas, the Chief Officer, Municipal Council, Pusad vide letter No. 12/2021, dated 28th January 2021 has communicated that the said reservations on the said land have been lapsed, since the notification for acquisition under section 126 (4) of the said Act has not been Published;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati vide letter No. 694, dated 14th June 2021 has submitted report that the said Appropriate Authority has not taken any action within the stipulated period under the provisions of Section 127(1) of the said Act to acquire the said land and therefore the said Reservations on the said land have been lapsed ;
And whereas, after considering the above facts in respect of the said reservations on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127(2) of the said Act, regarding the partly lapsing of the said reservations on the said land ;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December 2016 has delegated the pow- ers exercisable by the under Section 127(2) of the said Act in respect of Development Plans of all Munici- pal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Plan- ning Authority to the Director of Town Planning, Maharashtra State, Pune ;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said reservations Partly in respect of the land under Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows.

––––––––––––––– Note.– (1) The said land so relased from the said reservation shall become available to the said Land Owner for the purpose of development as otherwise permissible in the case of adjacent land under the said Sanctioned Development Plan.
(2) A copy of the part plan of the said Sanctioned Development Plan showing the part area of the said land which is lapsed from the said reservations is available in the office of the Chief Officer, Municipal Council, Pusad, District Yavatmal during office hours on all working days for inspection to public upto one month.
(3) This Order shall also be published on the Directorate's official website www.dtp.maharashtra.gov.in.
