MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
ORDER
No. D.T.P-D.P.Chandur bazar (R)-Sec-127 (2)-Order-TPV-VI-5274-2021.—
Whereas, the Revised Development Plan of Chandur Bazar Municipal Council has been partly sanctioned under the provisions of Section 31(1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") by the Government in Urban Development Department vide its Notification No. TPS-2899-C.R.19-99-UD-30, dated 01st March 2000 (hereinafter re- ferred to as " the said Notification ") & came into force with effect from 02nd May 2000 (hereinafter referred to as " the said Sanctioned Development Plan ") ;
And whereas, in the said Sanctioned Development Plan, the lands bearing S. No. 18 (Part), 19 (Part), 44 (Part) & 45 (Part) which having area admeasuring 3.40 Ha. of Mouza Chandur Bazar are reserved for Site No. 9 " Sports Complex " (hereinafter referred to as " the said Reservation ") for which Appropriate Authority is Municipal Council, Chandur Bazar (hereinafter referred to as "the said Appropriate Authority ");
And whereas, the land under said reservation has not been aquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan came into force ;
And whereas, the concerned land owner (hereinafter referred to as " the said land Owner ") of the land under the said Reservation in respect of part area of the land bearing S. No. 45/2 of Mouza Chandur Bazar (hereinafter referred to as " the said land ") had served a notice dated 31st December 2012 under Section 127(1) of the said Act (hereinafter referrred to as " the said Notice ") on the said Appropriate Authority which was received by the said Appropriate Authority, on 31st December 2012 ;
And whereas, the said land under the said Reservation is not acquired or no steps as required under Section 127(1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice ;
And whereas, the Hon'ble High Court, Mumbai, Bench at Nagpur in Writ Petition No. 6146 of 2018 filed by the said land owners, in its order dated 25th November 2019 has declared that the area admeasuring 1.62 Ha. of said land is lapsed from the said Reservation ;
And whereas, the Chief Officer, Municipal Council, Chandur Bazar vide its letter No. 77/2020, dated 28th May 2020 has communicated that the Hon'ble High Court, Mumbai, Bench at Nagpur vide its order dated 25th November 2019 has declared the lapsing of the said reservation in respect of the land admea- suring 1.62 Ha. of the said land ;
And whereas, after considering the above facts in respect of the said reservation on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127(2) of the said Act, regarding the partly lapsing of the said reservation on area admeasuring 1.62 Ha. of the said land ;
४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, ह्यरूदन् २-८, २०२१/+ ११-१७, ॅ १९४३And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 01st December 2016, has delegated the pow- ers exercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as speci- fied in the Schedule hereinafter hereby notify the partly lapsing of the said reservation on area admeasuring 1.62 Ha. in respect of the said land under Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows.—
After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Development Plan, the following new entry shall be added :---

Note :--1. The said land so released from the said reservation shall become available to the said land owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Sanctioned Development Plan.
2. A copy of the part plan of the said Sanctioned Development Plan showing the area of the said land which is lapsed from the said reservation, is available in the Office of the Chief Officer, Municipal Council, Chandur Bazar, District Amravati during office hours on all working days for inspection to public upto one month.
3. This Order shall also be published on the Directorate's official website www.dtp.maharashtra.gov.in
