महाराष्ट्र माथािरी, हमाल व इतर श्रमजरीवरी कामगार (नोकररीचे डनयमन व कलयाण) अडधडनयम, १९६९.
क्रमांक युडब्लयुए-२०१९/प्र.क्र.२३४/कामगार-५.—महाराष्ट्र माथाडी, हमाल व इतर श्रमजीवी कामगार (नोकरीचे दनयमन व क्लयाण) अदिदनयम, १९६९ (याला " सदर अदिदनयम " महणून संबोदित केले आहे) चया कलम २२ अनवये, महाराष्ट्र शासनाकडून खालील मसुदा अदिसूचना दनग्गदमत करणयाचे प्रसतादवत आहे. जयामधये मेसस्ग दकललोसकर ब्रदस्ग दलदमटेड, दकललोसकरवाडी, ता.पलुस, दज. सांगली या आसथापनेचया, माल चढदवणे, उतरदवणे, थपपी लावणे, वाहतूक करणे, वजन करणे, मोजणी करणे, भरणे, दशवणे, दव्लहेवारी लावणे, सवच्छ करणे दकंवा अशा कामाचया पूव्ग तयारीचे दकंवा तदनुषंदगक कामाशी संबंदित असंरदषित कामगारांना सदर अदिदनयमाचया व तयाखालील सांगली दज्लहा माथाडी हमाल व इतर असंरदषित कामगार(नोकरीचे दनयमन व क्लयाण) योजना, १९८४ (यापुढे " सदर योजना " संबोिणयात येईल.) मिील सव्ग तरतूदीतून सूट दमळणयाबाबतचा प्रसताव अंतभू ्गत असून, सदर अदिदनयमातील कलम २२ चया प्रथम परंतुकानुसार यामुळे पररणामीत होणाऱया सव्ग वयकतींचया मादहतीसाठी खालील मसुदा अदिसूचना याद्ारे प्रदसद्ध करणयात येत असून, महाराष्ट्र शासन राजपत्रात सदर अदिसूचनेचा मसुदा प्रदसद्ध के्लयानंतर एक मदहनयाची मुदत संप्लयानंतर सदर मसुदा शासन दवचाराथ्ग घेईल.
२. सदर मसुदा अदिसूचनेचया अनुषंगाने एखाद्ा वयकतीकडून दवदहत मुदतीत हरकती आदण सूचना कामगार आयुकत, कामगार भवन, सी-२०, ई बललॉक, बांद्ा-कुला्ग कलॉमपलेकस, बांद्ा (पूव्ग), मु ंबई ४०० ०५१ यांचेकडे प्रापत झा्लयास शासनामार्फत तयांचा दवचार केला जाईल.

क्रमांक युडब्लयुए. २०१९/प्र.क्र.२३४/कामगार-५.—जयामधये मेसस्ग दकललोसकर ब्रदस्ग दलदमटेड, दकललोसकरवाडी, ता. पलुस, दज.सांगली या आसथापनेचया, माल चढदवणे, उतरदवणे, थपपी लावणे, वाहतूक करणे, वजन करणे, मोजणी करणे, भरणे, दशवणे, दव्लहेवारी लावणे, सवच्छ करणे दकंवा अशा कामाचया पूव्गतयारीचे दकंवा तदनुषंदगक कामाशी संबंदित असंरदषित कामगारांना जयांची नांवे यासोबत जोडले्लया अनुसूची-१ मिील सतंभ (२) मधये दश्गदवली आहेत. (यापुढे सदर असंरदषित कामगार महणून संबोदित केले आहे.) तयांना महाराष्ट्र माथाडी, हमाल व इतर श्रमजीवी कामगार (नोकरीचे दनयमन व क्लयाण) अदिदनयम, १९६९ चया कलम २२ अनवये सदर अदिदनयमाचया व तयाखालील सांगली दज्लहा माथाडी हमाल व इतर असंरदषित कामगार(नोकरीचे दनयमन व क्लयाण) योजना, १९८४ ( यापुढे सदर योजना संबोिणयात येईल.) मिील सव्ग तरतुदीतून सूट दमळणयाबाबतचा प्रसताव महाराष्ट्र शासनास प्रापत झालेला आहे.
आदण, जयाअथथी, सदर असंरदषित कामगारांना दमळणाऱया रायद्ांची तपासणी के्लयानंतर व स्ललागार सदमतीशी स्ललामसलत के्लयानंतर महाराष्ट्र शासनाचे असे मत झाले आहे की, सदर अंसरदषित कामगार जया सुदविांचा/ रायद्ांचा लाभ घेत आहेत तया सुदविा सदर अदिदनयम व योजनेद्ारे देणयात येणाऱया सुदविा/रायद्ांपेषिा कमी अनुकुल नाहीत ;
सबब, तयाअथथी, उकत अदिदनयमाचया कलम-२२ अनवये प्रदान करणयात आले्लया अदिकारांचा वापर करून महाराष्ट्र शासन, सदर अदिदनयम व योजनेचया सव्ग तरतुदींपासुन यासोबतचया अनुसूची-२ मधये दवदनदद्गष्ट केले्लया अटी व शततींचया अिीन राहून सदर अदिसूचना अदिकृत राजपत्रात प्रदसद्ध झा्लयापासून तीन वषांचया कालाविीसाठी सूट देत आहे :—

अनुसूची-२
१. सूट ददले्लया आसथापनेने व तयाचया मालकाने सूट देणयात आले्लया कामगारांना माथाडी अदिदनयमाचया व तयाअंतग्गत तयार केले्लया योजनेद्ारे दद्लया जाणारे क्लयाणकारी रायद्ांपेषिा कमी क्लयाणकारी रायदे देणयात येऊ नयेत.
२. उकत मालक/आसथापना यांनी सूट ददले्लया कामगारांचया संदभा्गत ददले्लया वेतनाचा तपशील, रजेचा तपशील तसेच उकत आसथापनेस लागू असले्लया इतर कामगार कायद्ांतग्गत देणयात येणारे क्लयाणकारी रायदे तसेच सवलती यांचे दसताऐवज अदभलेख महणून जतन करावेत व सदर अदभलेख मंडळाचया सषिम प्रादिकरणाने मादगत्लयानंतर सादर करावेत.
३. उकत आसथापनाने सूट ददले्लया कामगारांना दकमान वेतन अदिदनयम, १९४८, वेतन प्रदान अदिदनयम, १९३६, उपदान ्गलन) अदिदनयम, प्रदान अदिदनयम, १९७२, भदवष्य दनवा्गह दनिी अदिदनयम, १९५२ आदण कंत्ाटी कामगार अदिदनयम (दनयमन व दनमु १९७० मिील लागू असले्लया तरतुदींची पूत्गता करावी.
४. उकत मालक/आसथापना सूट ददले्लया कामगारांना वेतन अदा करील, जे मंडळाचया नोंददत कामगारांना दद्लया जाणाऱया वेतन, इतर भत्े व इतर सेवासवलतीपेषिा कमी नसेल.
५. उकत मालक/ आसथापना यांनी प्रतयेक आदथ्गक वष्ग संप्लयानंतर ३० जून रोजी दकंवा ततपूवथी वादष्गक वैिादनक लेखापरीषिण अहवाल शासनास सादर करावा.
६. पोलीस तपासणी – सूट ददले्लया आसथापनेचया मालकाने तयांचयाकडे काम करीत असले्लया माथाडी कामगारांनी भारतीय दंडदविान संहीता, १८६० अनवये पूव्ग इदतहासाबाबत पोलीस पडताळणी दाखला सदर अदिसूचना जाहीर के्लयापासून तीन मदहनयांचया आत संबंदित पोलीस प्रादिकाऱयांकडून मंडळास सादर केला अस्लयाची खात्ी करून घेणे आवशयक असेल.
७. वेतन व इतर कायदेशीर सवलती- उकत मालक आसथापनेने सूट ददले्लया माथाडी कामगारांचे राष्ट्रीयकृत बँकेमधये खाते उघडावे व सूट ददले्लया कामगारांचया देय वेतनाचया रकमेइतका रेखांदकत िनादेश अथवा बँक ट्रानसररद्ारे दर मदहनयाचया ७ तारखेपयांत माथाडी कामगारांना वेतन द्ावे. माथाडी कामगारांना ददले्लया वेतनाबाबतचे सदवसतर तपशील पररदशष्ट-अ मिील दववरणपत्ामधये भरुन माथाडी मंडळास दर मदहनयाचया १० तारखेपयांत पाठवावे. मालकाने खाली दश्गदव्लयापेषिा कमी नाही असे लाभ माथाडी कामगारांना द्ावेत :-
सानुग्रह अनुदान : वेतनाचया १० टकके
उपदान : वेतनाचया ४ टकके
भरपगारी रजा : वेतनाचया ६ टकके
भरपगारी सुट्ी : वेतनाचया १ टकका
मालकाने लागू असले्लया भदवष्य दनवा्गह दनिी व कामगार राजय दवमा योजना इतयादी वैिादनक लाभांचया वजाती संबंदित प्रादिकरणाकडे जमा करावयात आदण तयाचे चलन मादहतीसाठी मंडळास सादर करावे. मालकाने/ आसथापनाने पावतया माथाडी कामगारांना दनयदमतपणे देऊन तया संदभा्गतील एकदत्त तपशील शासनास, कामगार आयुकत काया्गलयास व माथाडी मंडळास प्रतयेक ६ मदहनयांनी सादर करावा. मालकाने तयांचया आसथापनेत काय्गरत असले्लया माथाडी कामगारांना योजनेतील तरतुदीनुसार कमी नाही असे वेतन व लाभ दमळत आहेत याची खात्ी करून घेणे बंिनकारक असेल, असे न के्लयास मालक आसथापनेस जबाबदार िरुन ददलेली सूट रद्द करणयात येईल. भाग एक-ल-४७–२४ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-ल, डिसेंबर १३, २०२१/अग्रहायण २२, शके १९४३ ८. अडतकाडलक भत्ा- माथाडी कामगारांना दमळणारा अदतकादलक भत्ा हा मंडळाने दनयुकत केले्लया माथाडी कामगारांचया ितथीवर तयावेळी लागू असले्लया दरानुसार वेतन दराचया दुपपट दरापेषिा कमी नसावा.
९. डववणपत्र सादर करणे-भदवष्य दनवा्गह दनिी व राजय कामगार दवमा योजनेची वग्गणी मालकाने दनयदमत भरुन संबंदित माथाडी कामगारांना तयासंबंिी वेळोवेळी पावतया द्ावयात व प्रतयेक वषथी तसे के्लयाबाबतचा अहवाल शासनास, कामगार आयुकत व माथाडी मंडळास द्ावा.
(१) यापूवथीचया भदवष्य दनवा्गह दनिीचया रकमा व राजय कामगार दवमा योजनेची वग्गणी भर्लयाबाबतचा पुरावा शासनाकडे सदर अदिसूचना दनग्गदमत झा्लयापासून तीन मदहनयांचया आत सादर करावा, अनयथा संबंदित माथाडी कामगारांना देणयात आलेली सूट रद्द करणयात येईल.
(२) वादष्गक दववरणपत्- प्रतयेक मालकाने, सनदी लेखापाल यांनी प्रमादणत केलेले वादष्गक दववरणपत् सोबत जोडले्लया पररदशष्ट-ब मधये दरवषथी ३० जून पयांत शासनास तसेच मंडळास सादर करावे, जयात मालकाने माथाडी कामगारांचा जमा केलेला भदवष्य दनवा्गह दनिी व कामगार राजय दवमयाबाबतचया चलनाचया प्रती व इतर तपशील असेल.
१०. ओळखपत्र व हजेररी काि्ड देणे – आसथापनेचया मालकाने तयांचयाकडे दनयुकती केले्लया माथाडी कामगारांना दनयुकत के्लयापासून ३० ददवसांचया आत ओळखपत् व हजेरी काड्ड देईल.
११. एखाद्ा माथाडी कामगारास तयाचया दनवाससथापासून ५० दक.मी. चया दत्जयेपेषिा अदिक अंतरावर काम करणयासाठी पाठदव्लयास मालकाने तयाचया एकूण वेतनाचया २० टकके रककम तयाला भत्ा महणून द्ावी.
१२. माथाडी कामगारांचया रायद्ासंदभा्गत शासनाने दकंवा मंडळाने भदवष्यकाळात घातले्लया अटी व शततींचे पालन करणे मालकाला बंिनकारक राहील.
१३. मालकाचया आसथापनेस लागू असले्लया कामगार कायद्ांचया तरतुदींचा अवलंब के्लयादशवाय मालक कोणतयाही कामगाराला कामावरुन कमी करणे दकंवा कामावरुन काढून टाकणे दकंवा कामगाराला बडतर्फ करणे या प्रकारची कोणतीही कारवाई करणार नाही.
१४. सूट ददले्लया आसथापनेचया मालकाने उकत अटी व शततींचा भंग के्लयास सदर मालकास अदिसूचनेनवये ददलेली सूट रद्द करणयास अथवा काढून घेणयास तो पात् राहील.

Maharashtra Mathadi, haMal and other Manual Workers (regulation of eMployMent and Welfare) act, 1969.
No.UWA-2019/C.R.234/Labour-5.—The following draft of Notification, which the Government of Maharashtra proposes to issue in exercise of the powers conferred by section 22 of the Maharashtra Mathadi, Hamal and other Manual Workers (Regulation of Employment and Welfare) Act, 1969 (Mah. XXX of 1969) (hereinafter referred to as "the said Act"), to exempt unprotected workers employed in Scheduled employment i.e. in connection with loading, unloading, stacking, carrying, weighing, measuring, filling, stitching, sorting, cleaning or such other work including work preparatory or incidental to such operations in M/s. Kirloskar Brothers Limited, Kirloskarwadi, Taluka Palus, District Sangli, from the operation of all the provisions of the said Act and the Sangli District Mathadi, Hamal and Other Manual Workers (Regulation of Employment and Welfare) Scheme, 1984 (hereinafter referred to as " the said Scheme"), is hereby published, as required by the first proviso of said section 22, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra, after expiry of a period of one month from the date of its publication in the Maharashtra Government Gazette.
2. Any objections or suggestions which may be received by the Commissioner of Labour, Kamgar Bhavan, C-20, E-Block, Bandra-Kurla Complex, Bandra(East), Mumbai 400 051, from any person with respect to the said draft within, the aforesaid period, will be considered by the Government.

DRAFT NOTIFICATION
No.UWA-2019/C.R.234/Labour-5.—Whereas, the Government of Maharashtra has received an application for grant of exemption under section 22 of the Maharashtra Mathadi, Hamal and other Manual Workers (Regulation of Employment and Welfare) Act, 1969 (Mah. XXX of 1969) (hereinafter referred to as "the said Act") to the unprotected workers, whose names are mentioned in column (2) of Schedule-I appended hereto (hereinafter referred to as "the said unprotected workers"), employed in Scheduled employment viz employment in connection with loading, unloading, stacking, carrying, weighing, measuring, filling, stitching, sorting, cleaning or such other work including work preparatory or incidental to such operations in M/s. Kirloskar Brothers Limited, Kirloskarwadi, Taluka Palus, District Sangli, from the operation of all the provisions of the said Act and the Sangli District Mathadi, Hamal and Other Manual Workers (Regulation of Employment and Welfare) Scheme, 1984 (hereinafter referred to as " the said Scheme") ;
And whereas, the Government of Maharashtra, after consultation with the Advisory Committee and after verification of the benefits enjoyed by the said unprotected workers, is of the opinion that they are in enjoyment of benefits which are on the whole not less favourable to them than the benefits provided by or under the said Act and the said Scheme ;
Now, therefore, in exercise of the powers conferred by section 22 of the said Act the Government of Maharashtra, hereby exempts the said Act and the said Scheme, for a period of three years from the date of publication of this notification in the Official Gazette, subject to the conditions specified in Schedule-II appended hereto.

Schedule-II
I. The said establishment/employer will not extend less favourable benefits to the exempted workers than those offered by the said Act and the Scheme made thereunder.
II. The said establishment/employer shall maintain registers and records of exempted workers in their employment, relating to payment of wages and leave and other facilities provided to them under the relevant labour laws applicable to the exempted establishment and the same shall be produced before the Competent Authorities of the board, when so directed by the board.
III. The said establishment/employer shall comply with the provisions of the Minimum Wages Act, 1948 (XI of 1948); the Payment of Gratuity Act, 1972 (XXXIX of 1972); the Employees of Provident Fund, Miscellaneous Provisions Act, 1952 (XIX of 1952); and the Contract Labour (Regulation and Abolition) Act, 1970 (XXXVII of 1970); or any other Act as may be applicable to them, for the time- being.
IV. The said establishment/employer shall make payment to the registered exempted workers employed by them, which shall not be less than the wages, other allowances and other benefit which are given to the registered workers of the Board.
V. The said establishment/employer shall submit its Yearly Statutory Audit Report to the Government on or before the 30th June after the end of every financial year.
VI. Police Verification.—The employer shall ensure that the Police Verification of Mathadi Workers regarding non-involvement of him in any criminal acts under Indian Penal Code, 1860, to the Board from the concern Police Authority within the period of three months from the date of Notification.
VII. Wages and other Statutory Benefits.—Employer shall ensure that exempted Mathadi Workers shall open his account in a Nationalised Bank and employer shall remit the wages by crossed cheque or bank transfer to each Exempted Mathadi worker equivalent to his earned wages by 7th of every month. Statement showing details of wages paid in Annexure "A" shall submitted to the Mathadi Board by 10th of every month. The Employer shall give not less than the benefits to the Exempted Mathadi worker given below:—
Ex-Gratia : 10% of wages Gratuity : 4% of wages Leave with wages : 6% of wages Paid Holidays : 1% of wages
Contributions to be deposited with the Competent Authorities in respect of various statues such as Provident Fund, E.S.I. etc. applicable to the Employer, shall be deposited by the Employer with such authority and challan thereof be submitted to the Board for information. The Employer should give regular receipt to the Mathadi worker and submit a consolidated report of the above said transactions to the Government, the Commissioner of Labour and the Mathadi Board every year. The Employer, in turn, shall ensure that the Mathadi workers employed at his establishmentमहाराष्ट्र शासन राजपत्र असाधारण भाग एक-ल, डिसेंबर १३, २०२१/अग्रहायण २२, शके १९४३ ९ are getting wages and benefits not less favourable than those available under the Scheme. In case of default, the Employer shall be held responsible and shall be liable for cancellation of exemption.
VIII. Overtime Allowances.—Overtime Allowance should not be less than double the rates of wages existing at that time on the analogy of the Mathadi worker employed by the Mathadi Board.
IX. Filing of Returns.—
(1) The Employer should make regular contribution of Employees' Provident Fund and ESIC (Where said act is applicable) of the concerned Mathadi workers and give regular Receipts to the Mathadi worker and submit a consolidated report of the above said transaction to the Government, the Commissioner of Labour and Mathadi Board every year.
(2) The Employer should submit proof of the previous contributions of Employees' Provident Fund and ESIC within a period of three months from the date of publication of this Notification to the Government. Otherwise the exemption given to the concerned Mathadi Workers will be cancelled.
(3) Annual return.—The Employer shall submit at Annual Return of P.F., E.S.I. duly certified by Chartered Accountant, in Annexure B on or before 30th June of every year to the Government and the Board alongwith copies of Challans and other details.
X. Issue of Identity Cards/ Attendance Card.—Every Employer shall issue identity card, to Mathadi workers engaged by them within the period of 30 days from appointment.
XI. If any Mathadi worker is asked to work beyond the radius of 50 kms. From his place of residence, the Employer shall pay an allowance @ 20% of total emoluments of such Mathadi worker.
XII. The Employer is liable to abide with any other terms and conditions, which may be imposed in favour of Mathadi worker by the Government of Maharashtra or Board in future.
XIII. No exempted Mathadi worker shall be removed/ retrenched/dismissed/terminated without following due process of labour laws applicable to the Employers Establishments.
XIV. Breach of any of above conditions by the Employer shall make Employer liable for cancellation or revocation of the exemption granted under this notification .
