MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

NOTICE

No. TPS-2718-1837-CR-167-2018-E.P.-Notice-UD-30.—

Whereas, Arni Municipal Council is established vide Govt. Notification No. GEN-2001-04-CR-10-UD-18-2001, dated 16 August 2011.

And whereas, the Arni Municipal Council, Dist. Yavatmal (hereinafter referred to as " the said Planning Authority") being the Planning Authority within its's jurisdiction vide its Resolution No. 03, dated 15 February, 2012 declared its intention under Section 21 & Section 23(1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to " the Said Act") to prepare Draft Development Plan of Arni for the area within the limits of the Arni Municipal Council (hereinafter referred to as " the said Development Plan ") and notice of such declaration was published in the Maharashtra Government Gazette, Part 1-A Amravati Division Supplement, Dated the 7th March, 2013 ;

And whereas, the Town Planning Officer appointed by the said Planning Authority, has submitted the Existing Land Use Map to the said Planning Authority within prescribed time limit, after carrying out survey of the entire land within the jurisdiction of the said Planning Authority as required under Section 25 of the said Act ;

And whereas, the Director of Town Planning, Maharashtra State, Pune has granted extension of time limit up to 3rd April, 2016, for publishing the said Development Plan for inviting suggestions/objections from the general public under Section 26(1) of the said Act ;

And whereas, the said Planning Authority published the said Development Plan under Section 26(1) of the said Act and accordingly published a notice in Official Gazette, Part-1-A, Amravati Division Supplement Dated the 24-30 March, 2016 for inviting objection or suggestions from the general public to the said Draft Development Plan of Arni prepared by it under sub-section (1) of Section 26 of the said Act ;

And whereas, after considering the suggestions and objections received on the said Development Plan, the Planning Committee, set up under Section 28(2) of the said Act (hereinafter referred to as " the said planning commit- tee "), has submitted its report to the said Planning Authority ;

And whereas, Joint Director of Town Planning, Amravati Division, Amravati under Section 30 of the said Act, has granted the extension of time limit up to 13th June, 2017, for submitting the said Development Plan to the Government for sanction ;

And whereas, as the said Planning Authority, did not follow the procedure laid down in the provision under Section 28(4) of the said Act, and the said Planning Authority did not submit the said Development Plan to the Government under Section 30 of the said Act on or before the extended time limit i. e. 13th June, 2017, the said Planning Authority failed to perform its duty imposed upon it under Section 28(4) and Section 30 of the said Act ;

And whereas, as per the provision under Section 21 (4A) of the said Act, the Joint Director of Town Planning, Amravati Division, Amravati vide its order dated 6th July, 2017, nominated Assistant Director of Town Planning, Yavatmal Branch, Yavatmal as an " Officer " from 14 June, 2017, to exercise all the powers and perform all the duties of Planning Authority as per the provisions of Section 28(4) to 30 of the said Act, and to submit the said Development Plan to the Government for sanction (hereinafter referred to as " the said Officer ") ;

And whereas, the said Officer, and after taking into consideration of the report submitted by the said Planning Committee, suggested certain modifications in the said Development Plan under Section 28(4) of the said Act, and published the said modified Draft Development Plan (hereinafter referred to as " the Development Plan ") for information of the general public, under Section 28(4) of the said Act, by Notice published in Maharashtra Government Gazette, Part 1-A, Amravati Division Supplement, Dated 22nd November, 2017 ;

And whereas, Joint Director of Town Planning, Amravati Division, Amravati, vide its order dated 12th January, 2018, has fixed the period from 13th June, 2017 to 13th June, 2018, to submit the said Development Plan to the Government under Section 30 of the said Act, for sanction, by the said Officer ;

And whereas, as per the provision of Section 21(1) of the said Act, the said Planning Authority has not submitted the said Development Plan to the Government under Section 30 of the said Act, within a period of three years from the date of establishment of Arni Municipal Council i. e. 16th August, 2011, the Joint Director of Town Planning, Amravati Division, Amravati, vide its order dated 6th July, 2018, has granted extension of time limit up to 7th June, 2018, under Section 21(3) of the said Act, for submission of the said Development Plan to the Government under Section 30 of the said Act ; +.-ॅ-+-२ (२०७०).

६ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, द्ध ३१-ह्य ६, २०२२/ १०-१६, ॅ १९४४

And whereas, in accordance with the provisions of Section of 30(1) of the said Act, the said officer has submitted the said Development Plan to the Government of Maharashtra for sanction vide its letter No. 789, dated 7th June, 2018 ;

And whereas, in accordance with the provisions of Section 31(1) of the said Act, considering the period of six months from the date of submission under Section 30 of the said Act or within extended period of twelve months, State Government is required to sanction the said Development Plan on or before 10th December, 2019 ;

And whereas, in accordance with the provisions of Section 148-A of the said Act, vide the Maharashtra Regional and Town Planning (Amendment) Act, 2020 (Mah. XIX of 2020), in computing the period, in relation to any Development Plan, Regional Plan or Scheme under the provisions of Chapter II, III, IV and V of the said Act, the period or periods during which any action could not be completed under the said chapters, due to enforcement of any Code of Conduct by the Election Commission or due to enforcement of any Guidelines or lockdown measures by the Government of India or the State Government, as the case may be, to prevent the spread of any pandemic or epidemic or disaster situation arising in the Country or State, shall be excluded ;

And whereas, in accordance with the sub-section (1) of Section 31 of the said Act, after consulting the Director of Town Planning. Maharashtra State, the State Government has sanctioned a part of the said Development Plan with modifications as specified in SCHEDULE-A vide notification No. TPS-2718-1837-C.R. 167-2018-Part Sanction-UD-30, dated-02 December, 2021 excluding proposals involving substantial modifications as specified in SCHEDULE-B, ap- pended herewith;

And whereas, the substantial modifications proposed by the Government are excluded from the aforesaid sanc- tioned plan and are shown on the plan verged in Pink colour and marked as excluded part i. e. as EP-1 to EP-4 Now, therefore, in exercise of the powers conferred under Section 31(1) of the said Act and all other powers enabling it on that behalf, the Government of Maharashtra hereby ;—

(A) Gives notice inviting suggestions and objections from any person in respect of the proposed substantial modifications as specified in the SCHEDULE-B appended hereto, within a period of 30 days from the date of publication of this notice in the Official Gazette.

(B) Appoints the Joint Director of Town Planning, Amaravati Division, Amaravati as the " Officer " under Section 31 (2) of the said Act, to hear all suggestions and objections as stated in (a) above and to submit his report thereupon to the Government for further necessary action.

(2) Suggestions or objections regarding substantial modifications mentioned in SCHEDULE-B should be submitted to the Joint Director of Town Planning, Amaravati Division, Amaravati, having his office on following address :—

NOTIFICATION

No. TPS-2718-1763-CR-165-2018-Part Sanction-UD-30.—

Whereas, Government vide order bearing No. GEN-2009-02-CR-06-09-UD-2018, dated 31 August 2009 has ex- tended the limit of Umarkhed Municipal Council;

And whereas, the Umarkhed Municipal Council, Dist. Yavatmal (hereinafter referred to as " the said Planning Authority") being the Planning Authority within its's jurisdiction vide its Resolution No. 03, dated 27 December, 2012 declared its intention under Section 23(1) & Section 34 of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to " the Said Act") to prepare Draft Development Plan of Umarkhed (Extended limit) for the area within the limits of the Umarkhed Municipal Council (hereinafter referred to as " the said Development Plan ") and notice of such declaration was published in the Maharashtra Government Gazette, Part 1-A Amravati Division Supplement dated the 14th February, 2013 ;

And whereas, the said Planning Authority published the said Development Plan under Section 26(1) of the said Act and accordingly published a notice in Official Gazette, Part-1-A, Amravati Division Supplement dated the 24-30 March, 2016 for inviting objection or suggestions from the general public to the said Draft Development Plan of Umarkhed (Extended limit) prepared by it under sub-section (1) of Section 26 of the said Act ;

And whereas, as the said Planning Authority, did not follow the procedure laid down in the provision under Section 28(4) of the said Act, and the said Planning Authority did not submit the said Development Plan to the Government under Section 30 of the said Act on or before the extended time limt i. e. 13th June, 2017, the said Planning Authority failed to perform its duty imposed upon it under Section 28(4) and Section 30 of the said Act ;

And whereas, Joint Director of Town Planning, Amravati Division, Amravati, vide its order dated 24th January, 2018, has fixed the period from 13th June, 2017 to 13th June, 2018, to submit the said Development Plan to the Government under Section 30 of the said Act, for sanction, by the said Officer ;

And whereas, as per the provision of Section 21(1) of the said Act, the said Planning Authority has not submitted the said Development Plan to the Government under Section 30 of the said Act, within a period of three years from the date of establishment of Umarkhed Municipal Council i. e. 16th August, 2011, the Joint Director of Town Planning, Amravati Division, Amravati, vide its Order dated 5th July, 2018, has granted extension of time limit up to 7th June, 2018, under Section 21(3) of the said Act, for submission of the said Development Plan to the Government under Section 30 of the said Act ;

And whereas, in accordance with sub-section (1) of Section 31 of the said Act, after consulting the Director of Town Planning, Maharashtra State, the State Government has decided to sanction part of the said Development Plan with modifications shown in SCHEDULE-A (as SM-1 to SM-5) excluding the substantial modification shown in SCHEDULE-B (as EP-1 to EP-5) appended with Notice No. TPS-2718-1763-CR-165-2018-E.P.-Notice-UD-30, dated 2nd December, 2021 ;

And whereas, in accordance with the provisions of Section 31(1) of the said Act, considering the period of six months from the date of submission under Section 30 of the said Act and extended period of twelve months, State Government is required to sanction the said Development Plan on or before 10th December, 2019 ;

And whereas, in accordance with the provisions of Section 148-A of the said Act, due to Code of Conduct by the Election Commission of India the State Election Commission in respect of Election, the period of 110 days, shall have to be excluded ;

And whereas, in accordance with the provisions of Section 148-A of the said Act, vide the Maharashtra Regional and Town Planning (Amendment) Act, 2020 (Mah. XIX of 2020), in computing the period, in relation to any Development Plan, Regional Plan or Scheme under the provisions of Chapter II, III, IV and V of the said Act, the period or periods during which any action could not be completed under the said chapters, due to enforcement of any Guidelines or lockdown measures by the Government of India or the State Government, as the case may be, to prevent the spread of any pandemic or epidemic or disaster situation arising in the Country of State, shall be excluded ;

And whereas, in accordance with the provisions of Section 148-A, for sanctioning the said Development Plan (Partly) the period of lockdown declared by the Government from 23rd March, 2020 due to spread of Covid-19 virus in the State of Maharashtra and also the period of code of conduct of elections is excluded ;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 31 of the said Act and of all other powers enabling it on that behalf, the Government of Maharashtra hereby ;—

(A) In accordance with the provisions of Section 148-A, excludes the period of 110 days due to enforcement of code of conduct, and the period of lockdown declared by the Government from 23rd March, 2020 due to spread of Covid-19 virus in the State of Maharashtra, and accordingly the extends period prescribed under Section 31(1) of the said Act for sanctioning the said Development Plan up to and inclusive of the date of this notification ;

(B) Sanctions the said Draft Development Plan for Umarkhed Municipal Council (Extended Limit) along with modifications as specified in Schedule of Modifications namely SCHEDULE-A appended hereto, excluding the proposals under substantial modifications as specified in SCHEDULE-B appended with Notice No. TPS-2718- 1763-CR-165-2018-E.P.-Notice-UD-30,dated 2nd December, 2021 ;

(C) The date after 30 days of publication of this Notification in the Official Gazette will be the date on which the said Sanctioned Development Plan (partly), called the Final Development Plan of Umarkhed (Extended limit) shall come into force.

01. The aforesaid Part Final Development Plan Umarkhed (Extended limit) sanctioned by the State Government shall be kept open for inspection by the public during office hours on all working days for a period of one month from the date of coming into force of this Notification, in the office of the Umarkhed Municipal Council, Dist. Yavatmal.

02. The reservations/allocations/designations which do not appear in the Schedule-A and Schedule-B appended hereto, are hereby sanctioned for the respective purposes as designated in the Develop- ment Plan.

03. Areas of reserved sites mentioned in the report of the Development Plan are approximate and subject to actual measurement on site as per boundaries shown on the Final Development Plan.

04. Draftsman's errors which are required to be corrected as per actual situation on site/or as per Survey Records, sanctioned layout etc. shall be corrected by the Chief Officer, Municipal Council, Umarkhed after due verification and prior approval of Director of Town Planning, Maharashtra State, Pune.

05. On cease of existing Public-Semi Public use shown in the Development Plan on the private lands or the Public-Semi Public Zone which has been shown inadvertently due to draftsman error, the use as per adjoining land use zone shall be permitted on such lands with prior approval of Divisional Joint Director of Town Planning.

06. The Unified Development Control and Promotion Regulations for Maharashtra State as sanctioned by the Government vide Notification No. TPS-1818-C.R.-236-18-Sec.-37(1AA) (C) & Sec. 20(4)- UD-13, dated 2nd December, 2020 as amended from time to time shall be Applicable to the said Development Plan.
