क्रमांक व्यदिअ-२०२१/प्र.क्र.१०६/व्यदि-४,— भारतीय संदिधानाच्या अनुच्छछेद ३०९ खालील परंतुकान्िये प्रदान करण्यांत आलेल्या िक्तींचा िापर करून आदि या संदभा्गत सध्या अस्ततत्िात असलेले सि्ग दिद्यमान दनयम, आदेि दकंिा अनुदेि यांचे अदधक्रमि करून, महाराष्ट्ाचे राज्यपाल याद्ारे महाराष्ट् िासनाच्या कौिल्य, रोजगार, उद्योजकता ि नािीन्यता दिभागाच्या प्रिासकीय दनयंत्िाखालील व्यिसाय दिक्षि ि प्रदिक्षि संचालनालयामधील िासकीय सं्त्थेतील आदि िासकीय काया्गलयातील कदनष्ठ सिवेक्षक-दन-कदनष्ठ प्रदिक्षिा्थथी सल्लागार (तांदत्क), अधीक्षक (तांदत्क), भांडार अधीक्षक, भांडारपाल ि सहायक भांडारपाल, गट-क (तांदत्क), महाराष्ट् दिक्षि सेिा, पदािरील सेिाप्रिेिाचे दिदनयमन करिारे पुढील दनयम करीत आहेत :—

१. या दनयमांना व्यिसाय दिक्षि ि प्रदिक्षि संचालनालयामधील कदनष्ठ सिवेक्षक-दन-कदनष्ठ प्रदिक्षिा्थथी सल्लागार (तांदत्क), अधीक्षक (तांदत्क), भांडार अधीक्षक, भांडारपाल ि सहायक भांडारपाल, गट-क (तांदत्क), महाराष्ट् दिक्षि सेिा, (सेिाप्रिेि) दनयम, २०२२ असे संबोधण्यात यािे.

२. या दनयमांत संदभा्गनुसार दुसरा अ्थ्ग अदभप्रेत नसेल तर,—

(क) "दनयुक्ती प्रादधकारी" याचा अ्थ्ग, संचालक, व्यिसाय दिक्षि ि प्रदिक्षि संचालनालय यांच्या अदधन्तत असलेल्या गट - क (तांदत्क) पदांकररता संचालक, महाराष्ट् राज्य कौिल्य, व्यिसाय दिक्षि ि प्रदिक्षि मंडळ यांच्या अदधन्तत असलेल्या गट - क (तांदत्क) पदांकररता, संबंदधत दिभागाचा सहसंचालक, व्यिसाय दिक्षि ि प्रदिक्षि यांच्या अदधन्तत असलेल्या गट - क (तांदत्क) पदांकररता ि िासन सेिेत संबंदधत पदािर उमेदिाराची दनयुक्ती करण्यास सक्षम असिारा असा आहे ;

(१)

भाग चार-अ—१२ महाराष्ट्र शासन राजपत्र, भाग चार-अ, गुरुवार ते बुिवार, नोव्हेंबर २४-३०, २०२२/अग्रहा्यण ३-९, शके १९४४ (ख) "पदिी" याचा अ्थ्ग, सांदिदधक दिद्यादप्ठाची अदभयांदत्की दकंिा तंत्िा्त्ातील पदिी दकंिा िासनाने त्याच्यािी समतुल्य म्हिून घोदित केलेली अन्य कोितीही अह्गता असा आहे ;

(ग) "पददिका" याचा अ्थ्ग, महाराष्ट् राज्य तंत् दिक्षि मंडळाने प्रदान केलेली अदभयांदत्की दकंिा तंत्िा्त्ातील पददिका दकंिा िासनाने त्याच्यािी समतुल्य म्हिून घोदित केलेली अन्य कोितीही अह्गता असा आहे ;

(घ)"संचालनालय" याचा अ्थ्ग, िासनाच्या कौिल्य, रोजगार, उद्योजकता ि नािीन्यता दिभागाच्या प्रिासकीय दनयंत्िाखालील व्यिसाय दिक्षि ि प्रदिक्षि संचालनालय असा आहे ;

(च) "पदोन्नतीसा्ठीची पात्ता" याचा अ्थ्ग, िासनाच्या सामान्य प्रिासन दिभागाने िेळोिेळी दनग्गदमत केलेल्या दनयम, िासन दनि्गय दकंिा आदेिांमध्ये पदोन्नतीसा्ठी दिदहत केलेल्या अटी ि िततींनुसार पदोन्नतीसा्ठीची पात्ता असा आहे ;

(्छ)"अदभयांदत्की व्यिसाय अभ्यासक्रम" याचा अ्थ्ग केंद्र िासनाच्या कौिल्य दिकास ि उद्योजकता मंत्ालयाच्या अखत्यारीतील प्रदिक्षि महादनदेिालय, निी ददल्ली यांनी घोदित केलेले अदभयांदत्की गटातील व्यिसाय अभ्यासक्रम असा आहे;

(ज) "िासन" याचा अ्थ्ग, महाराष्ट् िासन असा आहे;

(झ) "राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा" याचा अ्थ्ग, राष्ट्ीय व्यिसाय प्रदिक्षि पररिद, निी ददल्ली यांचेद्ारे घेण्यात येिारी दिकाऊ उमेदिारी प्रमािपत् परीक्षा असा आहे ;

(त्) "राष्ट्ीय व्यिसाय प्रमािपत् परीक्षा" याचा अ्थ्ग राष्ट्ीय व्यिसाय प्रदिक्षि पररिद, निी ददल्ली यांचेद्ारे घेण्यात येिारी व्यिसाय प्रमािपत् परीक्षा असा आहे ;

(ड) "माध्यदमक िाळा प्रमािपत् परीक्षा" याचा अ्थ्ग, महाराष्ट् राज्य माध्यदमक आदि उच्च माध्यदमक दिक्षि मंडळछे अदधदनयम, १९६५ (१९६५ चा महाराष्ट् अदधदनयम क्रमांक ४१) अन्िये ग्ठीत केलेल्या दिभागीय मंडळाकडून घेण्यात येिारी माध्यदमक िाळा प्रमािपत् परीक्षा असा आहे दकंिा िासनाने त्याच्यािी समतुल्य म्हिून घोदित केलेली अन्य कोितीही अह्गता असा आहे;

(ि) "दनिड सदमती" याचा अ्थ्ग, या सेिाप्रिेि दनयमातील पदांिरील सरळसेिा भरतीकरीता उमेदिारांच्या दनिडीच्या प्रयोजना्थ्ग कौिल्य, रोजगार, उद्योजकता ि नािीन्यता दिभाग यांचेकडून िेळोिेळी ग्ठीत करण्यात आलेली दनिड सदमती असा आहे;

३. संचालनालयामधील कदनष्ठ सिवेक्षक-दन-कदनष्ठ प्रदिक्षिा्थथी सल्लागार (तांदत्क), या पदािरील दनयुक्ती पुढील मागा्गने करण्यात येईल :—

(क) अधीक्षक (तांदत्क) दकंिा भांडार अधीक्षक, महाराष्ट् दिक्षि सेिा,गट-क (तांदत्क) हे पद धारि करिाऱ्या ि या पदािर दकमान तीन िवे दनयदमत सेिा ि सेिासातत्य पूि्ग केलेल्या व्यक्तींमधून एकदत्त ज्येष्ठतेच्या आधारे, योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल;

वकंवा

(ख) दनिड सदमतीद्ारे घेण्यात येिाऱ्या ्तपधा्गत्मक परीक्षेच्या दनकालाच्या आधारे दिफारस करण्यात आलेल्या, जे खालील दनकि पूि्ग करिाऱ्या उमेदिारांमधून नामदनदवेिनाद्ारे :—

(एक) व्योम्या्षदा.—

(एक) दकमान ियोमया्गदा.—पदभरतीच्या जादहरातीत नमूद केलेल्या अज्ग ्तिीकृतीच्या अंदतम ददनांकास अ्ठरा िवे पूि्ग.

(दोन) कमाल ियोमया्गदा.—पदभरतीच्या जादहरातीत नमूद केलेल्या अज्ग ्तिीकृतीच्या अंदतम ददनांकास मागास संिगा्गत समादिष्ट नसलेल्या व्यक्तींसा्ठी अडतीस ि्ग पूि्ग ि मागास संिगा्गत समादिष्ट असलेल्या व्यक्तींसा्ठी त्ेचाळीस िवे पूि्ग.

(दोन) वकमान शैक्षवणक अह्षता.-

अदभयांदत्की दकंिा तंत्िा्त् यामधील कोित्याही िाखेतील पददिका.

(तीन) अनुभवाची अह्षता.- सिवेक्षि दकंिा तांदत्क व्यि्त्थापन दकंिा सल्लागार दकंिा पय्गिेक्षिाचा अनुभि ;

(एक) पदिीधारक व्यक्तींकररता एक िा्गपेक्षा कमी नाही इतका,

(दोन) पददिकाधारक व्यक्तींकररता तीन िांपेक्षा कमी नाही इतका, िासकीय दकंिा दनमिासकीय दकंिा खाजगी आ्त्थापना दकंिा कोित्याही महामंडळछे दकंिा इतर कोित्याही सं्त्थांमधील.

४. संचालनालयामधील अधीक्षक (तांदत्क), या पदािरील दनयुक्ती दनिड सदमतीद्ारे घेण्यात येिाऱ्या ्तपधा्गत्मक परीक्षेच्या दनकालाच्या आधारे दिफारस करण्यात आलेल्या, जे खालील दनकि पूि्ग करिाऱ्या उमेदिारांमधून नामदनदवेिनाद्ारे :—

(एक) व्योम्या्षदा.-

(एक) दकमान ियोमया्गदा. - पदभरतीच्या जादहरातीत नमूद केलेल्या अज्ग ्तिीकृतीच्या अंदतम ददनांकास अ्ठरा िवे पूि्ग.

(दोन) कमाल ियोमया्गदा.- पदभरतीच्या जादहरातीत नमूद केलेल्या अज्ग ्तिीकृतीच्या अंदतम ददनांकास मागास संिगा्गत समादिष्ट नसलेल्या व्यक्तींसा्ठी अडतीस ि्ग पूि्ग ि मागास संिगा्गत समादिष्ट असलेल्या व्यक्तींसा्ठी त्ेचाळीस िवे पूि्ग.

(दोन) वकमान शैक्षवणक अह्षता.-

अदभयांदत्की दकंिा तंत्िा्त् यामधील कोित्याही िाखेतील पददिका.

(तीन) अनुभवाची अह्षता.- तांदत्क व्यि्त्थापन दकंिा पय्गिेक्षिाचा अनुभि;

(एक) पदिीधारक व्यक्तींकररता एक िा्गपेक्षा कमी नाही इतका,

(दोन) पददिकाधारक व्यक्तींकररता तीन िांपेक्षा कमी नाही इतका,

िासकीय दकंिा दनमिासकीय दकंिा खाजगी आ्त्थापना दकंिा कोित्याही महामंडळछे दकंिा इतर कोित्याही सं्त्थांमधील.

५. संचालनालयामधील भांडार अधीक्षक, या पदािरील दनयुक्ती भांडारपाल, महाराष्ट् दिक्षि सेिा, गट-क (तांदत्क) हे पद धारि करिाऱ्या ि या पदािर दकमान तीन िवे दनयदमत सेिा पूि्ग केलेल्या व्यक्तींची एकदत्त ज्येष्ठतेच्या आधारे, एकदत्त ज्येष्ठतासूचीनुसार योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल.

६. संचालनालयामधील भांडारपाल, या पदािरील दनयुक्ती पुढील मागा्गने करण्यात येईल :-

(क) सहायक भांडारपाल, महाराष्ट् दिक्षि सेिा, गट-क (तांदत्क) हे पद धारि करिाऱ्या ि या पदािर दकमान तीन िवे दनयदमत सेिा ि सेिासातत्य पूि्ग केलेल्या व्यक्तींमधून एकदत्त ज्येष्ठतेच्या आधारे, योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल;

वकंवा

(ख) दनिड सदमतीद्ारे घेण्यात येिाऱ्या ्तपधा्गत्मक परीक्षेच्या दनकालाच्या आधारे दिफारस करण्यात आलेल्या, जे खालील दनकि पूि्ग करिाऱ्या उमेदिारांमधून नामदनदवेिनाद्ारे :-

(एक) व्योम्या्षदा.—

भाग चार-अ—१अ४ महाराष्ट्र शासन राजपत्र, भाग चार-अ, गुरुवार ते बुिवार, नोव्हेंबर २४-३०, २०२२/अग्रहा्यण ३-९, शके १९४४ (दोन) दकमान िैक्षदिक अह्गता.—

(एक) माध्यदमक िालांत प्रमािपत् परीक्षा उत्ीि्ग ;

आदि

(दोन) अदभयांदत्की व्यिसाय अभ्यासक्रमातील दिदहत केलेली राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा उत्ीि्ग दकंिा राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा नसलेल्या व्यिसाय अभ्यासक्रमांकररता दिदहत केलेली राष्ट्ीय व्यिसाय प्रमािपत् परीक्षा उत्ीि्ग.

(तीन) अनुभिाची अह्गता.—भांडार हाताळण्याचा दकंिा

भांडार व्यि्त्थापन कामाचा अनुभि,-

(एक) पददिकाधारक व्यक्तींकररता दोन िांपेक्षा कमी इतका,

(दोन) राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा उत्ीि्ग व्यक्तींकररता तीन िांपेक्षा कमी नाही इतका, (तीन) राष्ट्ीय व्यिसाय प्रमािपत् परीक्षा उत्ीि्ग व्यक्तींकररता चार िांपेक्षा कमी नाही इतका, िासकीय दकंिा दनमिासकीय दकंिा खाजगी आ्त्थापना दकंिा कोित्याही महामंडळछे दकंिा इतर कोित्याही सं्त्थांमधील.

७. संचालनालयामधील सहाय्यक भांडारपाल, या पदािरील दनयुक्ती दनिड सदमतीद्ारे घेण्यात येिाऱ्या ्तपधा्गत्मक परीक्षेच्या दनकालाच्या आधारे दिफारस करण्यात आलेल्या, जे खालील दनकि पूि्ग करिाऱ्या उमेदिारांमधून नामदनदवेिनाद्ारे :-

(एक) ियोमया्गदा.-

(एक) दकमान ियोमया्गदा.- पदभरतीच्या जादहरातीत नमूद केलेल्या अज्ग ्तिीकृतीच्या अंदतम ददनांकास अ्ठरा िवे पूि्ग.

(दोन) दकमान िैक्षदिक अह्गता.-

(एक) माध्यदमक िालांत प्रमािपत् परीक्षा उत्ीि्ग ;

आदि

(तीन) अनुभिाची अह्गता.—भांडार हाताळण्याचा दकंिा

भांडार व्यि्त्थापन कामाचा अनुभि,-

(एक) पददिकाधारक व्यक्तींकररता दोन िांपेक्षा कमी नाही इतका,

८. दनयम ३ ये्थे नमूद केलेल्या पदािर पदोन्नती ि नामदनदवेिनाने कराियाच्या दनयुक्तीचे प्रमाि ५० : ५० असे राहील.

परंतु आिखी असे की, पदोन्नतीद्ारे दनयुक्ती देण्याकररता योग्य उमेदिार उपलब्ध नसतील तर दनयुक्ती प्रादधकाऱ्याच्या सहमतीने पदोन्नती ि नामदनदवेिन याद्ारे कराियाच्या दनयुक्तीकररता दिदहत करण्यात आलेले प्रमाि त्या भरती िा्गपुरते दिद्थल करून सदर पदे नामदनदवेिनाद्ारे भरता येतील.

९. दनयम ६ ये्थे नमूद केलेल्या पदािर पदोन्नती ि नामदनदवेिनाने कराियाच्या दनयुक्तीचे प्रमाि ७५ : २५ असे राहील.

१०. (क) दनयम ३, ५ दकंिा ६ ये्थे नमूद पदांिर पदोन्नतीने दनयुक्त होिाऱ्या व्यक्तीने, पदोन्नतीपूिथी दहंदी भािा परीक्षा ि मरा्ठी भािा परीक्षा या दोन्ही परीक्षांसंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दहंदी भािा ि मरा्ठी भािा परीक्षा अगोदरच उत्ीि्ग केलेली असिे अ्थिा उत्ीि्ग होण्यापासून सूट दमळदिलेली असिे आिश्यक राहील. अन्य्था या पदािर पदोन्नती अनुज्ेय ्ठरिार नाही.

(ख) दनयम ३, ४, ६ दकंिा ७ ये्थे नमूद पदांिर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, दहंदी भािा ि मरा्ठी भािा परीक्षा या दोन्ही परीक्षांसंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दहंदी भािा ि मरा्ठी भािा परीक्षा दनयुक्तीपूिथी उत्ीि्ग केलेल्या नसतील तर, दहंदी भािा ि मरा्ठी भािा परीक्षा दनयमात नमूद केलेल्या दिदहत मुदतीत दहंदी भािा ि मरा्ठी भािा परीक्षा उत्ीि्ग होिे आिश्यक राहील. त्याचप्रमािे दिदहत मुदतीत दहंदी भािा ि मरा्ठी भािा परीक्षा उत्ीि्ग न झाल्यास सदर परीक्षा उत्ीि्ग होईपयांत िादि्गक िेतनिाढ अनुज्ेय राहिार नाही. तसेच पुढील पदांिरील पदोन्नती अनुज्ेय रहािार नाही.

११. (क) दनयम ३, ५ दकंिा ६ ये्थे नमूद पदांिर पदोन्नतीने दनयुक्त होिाऱ्या व्यक्तीने, पदोन्नतीपूिथी संगिक हाताळिी ज्ान अह्गता प्रमािपत्संदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि करिे अ्थिा सदर प्रमािपत् धारि करण्यापासून सूट दमळदिलेली असिे आिश्यक राहील. अन्य्था या पदािर पदोन्नती अनुज्ेय ्ठरिार नाही.

(ख) दनयम ३, ४, ६ दकंिा ७ ये्थे नमूद पदांिर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, संगिक हाताळिी ज्ान अह्गता प्रमािपत्ासंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दनयुक्तीपूिथी संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि केलेले नसल्यास, याबाबतच्या दनयमात नमूद केलेल्या दिदहत मुदतीत सदर प्रमािपत् धारि करिे आिश्यक राहील. त्याचप्रमािे दिदहत मुदतीत प्रमािपत् धारि न केल्यास, सदर संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि करेपयांत िादि्गक िेतनिाढ अनुज्ेय राहिार नाही. तसेच पुढील पदांिरील पदोन्नती अनुज्ेय रहािार नाही.

कुटु कुटु

१२. (क) दनयम ३, ४, ६ दकंिा ७ ये्थे नमूद पदािर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, महाराष्ट् नागरी सेिा (लहान ंबाचे प्रदतज्ापन) दनयम, २००५ मधील तरतुदीनुसार ि त्याबाबत िेळोिेळी करण्यात येिाऱ्या दनयमांनुसार, दनयुक्तीच्या िेळी लहान ंबाचे प्रदतज्ापन सादर करिे आिश्यक राहील. तसेच यासंदभा्गत िेळोिेळी दनग्गदमत होिारे िासन आदेि लागू राहतील.

(ख) तसेच लहान कुटु ंबाचे प्रदतज्ापन सादर करताना त्यामध्ये दोन पेक्षा अदधक अपत्ये दनयुक्तीच्या िेळछेस हयात असल्यास संबंदधत उमेदिार िासकीय दनयुक्तीसा्ठी अपात् राहील.

(ग) िासकीय सेिेत दनयुक्ती झाल्यानंतर, दनयुक्तीच्यािेळी दकंिा त्यानंतर दोन पेक्षा अदधक अपत्ये हयात असल्यास संबंदधत उमेदिार िासकीय दनयुक्तीसा्ठी अपात् राहील.

१३. दनयम ३, ४, ५, ६ दकंिा ७ ये्थे नमूद केलेल्या दिभाग ्ततरािरील पदािर दनयुक्त केलेली व्यक्तीं संबंदधत दिभाग ्ततरािर बदलीसा्ठी पात् राहील. आदि संचालनालय ि मंडळ ्ततरािरील पदािर दनयुक्त केलेली व्यक्ती संचालनालय ते मंडळ आदि मंडळ ते संचालनालय ्ततरािर बदलीसा्ठी पात् राहील.

१४. िासनाने दिदहत केलेल्या अटी ि ितथी, िासनाने िासकीय कम्गचाऱ्यांकररता दनयुक्ती नंतरचे िेळोिेळी दनग्गदमत केलेले अन्य दनयम, आदेि दकंिा दनि्गयदेखील िासकीय कम्गचाऱ्यास लागू राहतील.

No. VEA-2021/CR.106/VE-4.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all the existing rules, orders or instruments issued in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of Junior Surveyor-cum-Junior Apprentice Adviser (Technical) and Superintendent (Technical), Store Superintendent, Store Keeper and Assistant Store Keeper, Group-C (Technical) in Maharashtra Education Services, in the Government Institute and Government Offices , in the Directorate of Vocational Education and Training under the administrative control of the Skills, Employment, Entrepreneurship and Innovation Department of the Government of Maharashtra, namely :—

1. These rules may be called the Junior Surveyor-cum-Junior Apprentice Adviser (Technical) and Superintendent (Technical), Store Superintendent, Store Keeper and Assistant Store Keeper, Group-C (Technical) in Maharashtra Education Services, in the Directorate of Vocational Education and Training (Recruitment) Rules, 2022.

2. In these rules, unless the context requires otherwise,—

(a) "Appointing Authority" means the Director, Directorate of Vocational Education and Training, Mumbai, in respect of Group-C (Technical) posts in the office of Directorate: Director, Maharashtra State Board of Skill, Vocational Education and Training, in respect of Group-C (Technical) posts in the office of Board and the Joint Director, Vocational Education and Training of the concerned region in respect of Group-C (Technical) posts in that region who shall be competent to appoint the candidate to the concerned post in the Government service ;

(b) "Degree" means a Degree in Engineering or Technology of a statutory university or any other qualification declared by the Government to be equivalent thereto ;

(c) "Diploma" means a Diploma awarded by the Maharashtra State Board of Technical Education or equivalent educational qualification declared by the Government to be equivalent thereto ;

(d) "Directorate" means the Directorate of Vocational Education and Training under the administrative control of the Skills, Employment, Entrepreneurship and Innovation Department of the Government ;

(e) "Eligibility for promotion" means the eligibility for promotion in accordance with the terms and conditions specified for promotion in rules, resolutions or orders issued by the General Administration Department of the Government, from time to time ;

(f) "Engineering Trade" means trades in engineering group declared by the Directorate General of Training, New Delhi under the Ministry of Skill Development and Entrepreneurship ;

(g) "Government" means the Government of Maharashtra ;

(h) "National Apprenticeship Certificate Examination" means Apprenticeship Certificate Examination conducted by the National Council for Vocational Training, New Delhi ;

(i) "National Trade Certificate Examination" means the Trade Certificate Examination conducted by the National Council for Vocational Training, New Delhi ;

(j) "Secondary School Certificate Examination" means the Secondary School Certificate Examination conducted by the Divisional Boards constituted under the Maharashtra Secondary and Higher Secondary Education Boards Act, 1965 (XLI of Maharashtra 1965) and includes any other equivalent examination declared by the Government to be equivalent thereto ;

(k) "Selection Committee" means a Selection Committee constituted, from time to time, by the Skills, Employment, Entrepreneurship and Innovation Department of the Government for the purpose of selection of candidates for direct recruitment to the posts mentioned in these rules.

3. Appointment to the post of Junior Surveyor-cum-Junior Apprentice Adviser (Technical), in the Directorate shall be made either,–

(a) by promotion of a suitable person having eligibility for promotion and having not less than three years continuous service on the post of Superintendent (Technical) or Store Superintendent, in Maharashtra Education Service, Group-C (Technical) on the basis of common seniority, as per the common seniority list of persons holding the said posts; or

(b) by nomination from amongst the candidates recommended by the Selection Committee on the basis of result of Competitive Examination conducted therefor, who fulfils the following criteria, namely:—

(i) Age limit.–

(A) Lower Age Limit.—Eighteen years of age completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B) Upper Age Limit.—Thirty-eight years of age completed for the persons not belonging to reserved categories and forty three years completed for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.—Diploma in Engineering or Technology of any Branch.

(iii) Experience.—An experience of work of survey or technical management or consultancy or supervisory level of,—

(A) not less than one year after possessing a Degree,

(B) not less than three years after possessing a Diploma,

in the Government or Semi-Government or private establishments or any Corporation or any other institute.

4. Appointment to the post of Superintendent (Technical), in the Directorate shall be made by nomination from amongst the candidates recommended by the Selection Committee on the basis of result of Competitive Examination conducted therefor, who fulfils the following criteria, namely:-

(i) Age limit.—

(A) Lower Age Limit.—Eighteen years of age completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.—Diploma in Engineering or Technology of any Branch.

(iii) Experience.—An experience of work of technical management or supervisory level of,—

(A) not less than one year after possessing a Degree,

(B) not less than three years after possessing a Diploma,

in the Government or Semi-Government or private establishments or any Corporation or any other institute.

5. Appointment to the post of Store Superintendent, in the Directorate shall be made by promotion of a suitable person having eligibility for promotion and having not less than three years continuous service on the post of Store Keeper, in Maharashtra Education Service, Group-C (Technical) on the basis of seniority, as per the common seniority list of persons holding the said posts.

6. Appointment to the post of Store Keeper, in the Directorate shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion and having not less than three years continuous service on the post of Assistant Store Keeper, in Maharashtra Education Service, Group-C (Technical) on the basis of seniority, as per the common seniority list of persons holding the said posts; or

(b) by nomination from amongst the candidates recommended by the Selection Committee on the basis of result of Competitive Examination conducted therefor, who fulfils the following criteria, namely:-

(i) Age limit.—

(A) Lower Age Limit.—Eighteen years of age completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.—

(A) passing of Secondary School Certificate Examination; and

(B) passing of the National Apprenticeship Certificate Examination in engineering trade or passing of the National Trade Certificate Examination for those engineering trades where the National Apprenticeship Certificate Examination is not held.

(iii) Experience.—An experience of work of Store handling or Store management of ,- (A) not less than two years after possessing a Diploma,

(B) not less than three years after passing the National Apprenticeship Certificate Examination,

in the Government or Semi-Government or private establishments or any Corporation or any other institute.

7. Appointment to the post of Assistant Store Keeper, in the Directorate shall be made by nomination from amongst the candidates recommended by the Selection Committee on the basis of result of Competitive Examination conducted therefor, who fulfils the following criteria, namely:—

(i) Age limit.—

(A) Lower Age Limit.—Eighteen years of age completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.—

(A) Passing of Secondary School Certificate Examination; and

(B) Passing of the National Apprenticeship Certificate Examination in engineeringमहाराष्ट्र शासन राजपत्र, भाग चार-अ, गुरुवार ते बुिवार, नोव्हेंबर २४-३०, २०२२/अग्रहा्यण ३-९, शके १९४४ ९ trade or passing of the National Trade Certificate Examination for those engineering trades where the National Apprenticeship Certificate Examination is not held.

(iii) Experience.—An experience of work of Store handling or Store management or Store Assistant,-

(A) not less than two years after possessing a Diploma,

(B) not less than three years after passing the National Apprenticeship Certificate Examination,

(C) not less than four years after passing the National Trade Certificate Examination, in the Government or Semi-Government or private establishments or any Corporation or any other institute.

8. Appointment to the post mentioned in rule 3 shall be made by promotion and nomination, in the ratio of 50:50, respectively:

Provided that, if exigencies of service so required, the Appointing Authority may make appointment by promotion or nomination, as the case may be, by relaxing the ratio prescribed for appointment by promotion or nomination.

9. Appointment to the post mentioned in rule 6 shall be made by promotion and nomination, in the ratio of 75:25, respectively:

10. (1) A person to be appointed to the post mentioned in rule 3, 5 or 6 by promotion shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, unless he has already passed or has been exempted from passing those examinations before getting promoted to the said post.

(2) A person appointed to the post mentioned in rule 3, 4, 6 or 7 by nomination shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.

11. (1) A person to be appointed to the post mentioned in rule 3, 5 or 6 by promotion shall possess a certificate of Computer Operations prescribed by rules or orders issued in that behalf by the Government, from time to time, unless he has been exempted therefrom before getting promoted to the said post.

(2) A person appointed to the post mentioned in rule 3, 4, 6 or 7 by nomination shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.

12. (1) A person recommended for appointment by nomination to the post mentioned in rule 3, 4, 6 or 7 shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in Government Service.

(3) After appointment of a person in the Government service, if it is proved that he has more than two children at the time of appointment or thereafter, then he shall be disqualified for continuing on the said post in Government service. भाग चार-अ—२१० महाराष्ट्र शासन राजपत्र, भाग चार-अ, गुरुवार ते बुिवार, नोव्हेंबर २४-३०, २०२२/अग्रहा्यण ३-९, शके १९४४ 13. A person appointed to the post mentioned in rules 3, 4, 5, 6 and 7 at Divisional level shall be liable for transfer within the division in which he is appointed and in the Directorate shall be liable for transfer in Directorate to Board and vice versa.

14. The terms and conditions specified by the Government, subsequent to the appointment of any Government Servant in any rules, orders or resolutions issued by the Government, from time to time, shall also be applicable to the Government Servant.

१. या दनयमांना व्यिसाय दिक्षि ि प्रदिक्षि संचालनालयामधील कॉम्पयुटर प्रोग्ामर, गट-क, महाराष्ट् दिक्षि सेिा, (सेिाप्रिेि) दनयम, २०२२ असे संबोधण्यात यािे.

२. या दनयमांत संदभा्गनुसार दुसरा अ्थ्ग अदभप्रेत नसेल तर,-

(क) "संचालनालय" याचा अ्थ्ग िासनाच्या कौिल्य, रोजगार, उद्योजकता ि नािीन्यता दिभागाच्या प्रिासकीय दनयंत्िाखालील व्यिसाय दिक्षि ि प्रदिक्षि संचालनालय असा आहे ;

(ख) "िासन" याचा अ्थ्ग महाराष्ट् िासन असा आहे ;

(ग) "पदिी" याचा अ्थ्ग सांदिदधक दिद्यादप्ठाची पदिी दकंिा िासनाने त्याच्यािी समतुल्य म्हिून घोदित केलेली अन्य कोितीही अह्गता असा आहे ;

(घ) "दनिड सदमती" याचा अ्थ्ग या सेिाप्रिेि दनयमातील पदांिरील सरळसेिा भरतीकररता उमेदिारांच्या दनिडीच्या प्रयोजना्थ्ग कौिल्य, रोजगार, उद्योजकता ि नािीन्यता दिभाग यांचेकडून िेळोिेळी ग्ठीत करण्यात आलेली दनिड सदमती असा आहे ;

३. संचालनालयामधील कॉम्पयुटर प्रोग्ामर, या पदािरील दनयुक्ती दनिड सदमतीद्ारे घेण्यात येिाऱ्या ्तपधा्गत्मक परीक्षेच्या दनकालाच्या आधारे दिफारस करण्यात आलेल्या, ि खालील दनकि पूि्ग करिाऱ्या उमेदिारांमधून नामदनदवेिनाद्ारे :—

(एक) ियोमया्गदा.-

(एक) दकमान ियोमया्गदा.- पदभरतीच्या जादहरातीत नमूद केलेल्या अज्ग ्तिीकृतीच्या अंदतम ददनांकास अ्ठरा िवे पूि्ग.

(दोन) दकमान िैक्षदिक अह्गता.-

४. दनयम ३ ये्थे नमूद पदांिर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, संगिक हाताळिी ज्ान अह्गता प्रमािपत्ासंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दनयुक्तीपूिथी संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि केलेले नसल्यास, याबाबतच्या दनयमात नमूद केलेल्या दिदहत मुदतीत सदर प्रमािपत् धारि करिे आिश्यक राहील. त्याचप्रमािे दिदहत मुदतीत प्रमािपत् धारि न केल्यास, भाग चार-अ—२अ१२ महाराष्ट्र शासन राजपत्र, भाग चार-अ, गुरुवार ते बुिवार, नोव्हेंबर २४-३०, २०२२/अग्रहा्यण ३-९, शके १९४४ सदर संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि करेपयांत िादि्गक िेतनिाढ अनुज्ेय राहिार नाही. तसेच पुढील पदांिरील पदोन्नती अनुज्ेय राहिार नाही.

(क) दनयम ३ ये्थे नमूद पदािर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, महाराष्ट् नागरी सेिा (लहान कुटु ंबाचे प्रदतज्ापन) ंबाचे प्रदतज्ापन दनयम, २००५ मधील तरतुदीनुसार ि त्याबाबत िेळोिेळी करण्यात येिाऱ्या दनयमांनुसार, दनयुक्तीच्या िेळी लहान कुटु सादर करिे आिश्यक राहील. तसेच यासंदभा्गत िेळोिेळी दनग्गदमत होिारे िासन आदेि लागू राहतील.

६. दनयम ३ ये्थे नमूद केलेल्या पदािर दनयुक्त केलेली व्यक्तीं संबंदधत दिभाग ्ततरािर बदलीसा्ठी पात् राहील.

७. िासनाने दिदहत केलेल्या अटी ि ितथी, िासनाने िासकीय कम्गचाऱ्यांकररता दनयुक्ती नंतरचे िेळोिेळी दनग्गदमत केलेले अन्य दनयम, आदेि दकंिा दनि्गयदेखील िासकीय कम्गचाऱ्यास लागू राहतील.

No.VEA-2018/CR.270/18/VE-4.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules, orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of Computer Programmer, Group-C, Maharashtra Education Service, in the Directorate of Vocational Education and Training, Maharashtra State, Mumbai under the administrative control of Skills, Employment, Entrepreneurship and Innovation Department of Government of Maharashtra, namely :—

1. These rules may be called the Computer Programmer, Group-C, in the Maharashtra Education Service, in the Directorate of Vocational Education and Training, Maharashtra State, Mumbai (Recruitment) Rules, 2022.

2. In these rules, unless the context requires otherwise :—

(a) "Directorate" means the Directorate of Vocational Education and Training under the administrative control of the Skills, Employment, Entrepreneurship and Innovation Department of the Government ;

(b) "Government" means the Government of Maharashtra ;

(c) "Graduate" means Graduate of a statutory university or any other qualification declared by the Government to be equivalent thereto ;

(d) "Selection Committee" means a Selection Committee constituted, from time to time, by the Skills, Employment, Entrepreneurship and Innovation Department of the Government for the purpose of selection of candidates for direct recruitment to the posts mentioned in these rules.

3. Appointment to the post of Computer Programmer, Group C, in Maharashtra Education Service, in the Directorate, shall be made by nomination from amongst the candidates recommended by the Selection Committee on the basis of result of Competitive Examination conducted therefor, who fulfils the following criteria, namely :—

(i) Age limit.—

(A) Lower Age Limit.—Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.—Graduate in Computer Engineering or Computer Technology or Computer Science or Computer Application.

(iii) Experience.— An experience of computer programming of not less than two years after possessing an educational qualification prescribed in sub-clause (ii),

in the Government or Semi-Government or private establishments or any Corporation or any other institute.

4. A person appointed to the posts mentioned in rule 3 by nomination, shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, before appointment unless he has already passed or shall pass the said examinations within the prescribed time limit after appointment or has been exempted from passing these examinations.

(्छ) "राष्ट्ीय व्यिसाय प्रमािपत् परीक्षा" याचा अ्थ्ग राष्ट्ीय व्यिसाय प्रदिक्षि पररिद, निी ददल्ली यांचेद्ारे घेण्यात येिारी व्यिसाय प्रमािपत् परीक्षा असा आहे ;

(ज) "माध्यदमक िाळा प्रमािपत् परीक्षा" याचा अ्थ्ग महाराष्ट् राज्य माध्यदमक आदि उच्च माध्यदमक दिक्षि मंडळछे अदधदनयम, १९६५ (१९६५ चा महाराष्ट् अदधदनयम क्रमांक ४१) अन्िये ग्ठीत केलेल्या दिभागीय मंडळाकडून घेण्यात येिारी माध्यदमक िाळा प्रमािपत् परीक्षा असा आहे दकंिा िासनाने त्याच्यािी समतुल्य म्हिून घोदित केलेली अन्य कोितीही अह्गता असा आहे ;

(झ) "दनिड सदमती" याचा अ्थ्ग या सेिाप्रिेि दनयमातील पदांिरील सरळसेिा भरतीकररता उमेदिारांच्या दनिडीच्या प्रयोजना्थ्ग कौिल्य, रोजगार, उद्योजकता ि नादिन्यता दिभाग यांचेकडून िेळोिेळी ग्ठीत करण्यात आलेली दनिड सदमती असा आहे.

३. संचालनालयामधील दमलराईट मेन्टछेनन्स मेकॅदनक (मेकॅदनकल, इलेस्क्ट्कल दकंिा इलेक्ट्ॉदनक्स), या पदािरील दनयुक्ती दनिड सदमतीद्ारे घेण्यात येिाऱ्या ्तपधा्गत्मक परीक्षेच्या दनकालाच्या आधारे दिफारस करण्यात आलेल्या, ि खालील दनकि पूि्ग करिा-या उमेदिारांमधून नामदनदवेिनाद्ारे :—

(एक) व्योम्या्षदा.—

(एक) दकमान ियोमया्गदा.— पदभरतीच्या जादहरातीत नमूद केलेल्या अज्ग ्तिीकृतीच्या अंदतम ददनांकास अ्ठरा िवे पूि्ग.

(ब) दमलराईट मेन्टछेनन्स मेकॅदनक (इलेस्क्ट्कल) पदाकररता,—

(एक) माध्यदमक िालांत प्रमािपत् परीक्षा उत्ीि्ग ;

आदि

(दोन) दिजतंत्ी या व्यिसायातील राष्ट्ीय व्यिसाय प्रमािपत् दकंिा राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा उत्ीि्ग.

(क) दमलराईट मेन्टछेनन्स मेकॅदनक (इलेक्ट्ॉदनक्स) पदाकररता,—

(एक) माध्यदमक िालांत प्रमािपत् परीक्षा उत्ीि्ग ;

आदि

(दोन) इलेक्ट्ॉदनक्स मेकॅदनक दकंिा इन्त्रुमेंट मेकॅदनक या व्यिसायातील राष्ट्ीय व्यिसाय प्रमािपत् दकंिा राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा उत्ीि्ग.

(तीन) अनुभवाची अह्षता.— यंत् सामग्ी दुरु्तती ि परररक्षिाच्या कामाचा अनुभि,—

(एक) पदिीधारक व्यक्तींकररता एक िा्गपेक्षा कमी नाही इतका,

(दोन) पददिकाधारक व्यक्तींकररता तीन िांपेक्षा कमी नाही इतका,

(तीन) राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा उत्ीि्ग दकंिा राष्ट्ीय व्यिसाय प्रमािपत् परीक्षा उत्ीि्ग व्यक्तींकररता पाच िांपेक्षा कमी नाही इतका,

िासकीय दकंिा दनमिासकीय दकंिा खाजगी आ्त्थापना दकंिा कोित्याही महामंडळछे दकंिा इतर कोित्याही सं्त्थांमधील संबंदधत क्षेत्ातील.

४. दनयम ३ ये्थे नमूद केलेल्या पदािर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, दहंदी भािा परीक्षा ि मरा्ठी भािा परीक्षा या दोन्ही परीक्षांसंदभा्गत मरा्ठी भािा दिभागाने िेळोिेळी केलेल्या दनयमांनुसार, दहंदी भािा ि मरा्ठी भािा परीक्षा उत्ीि्ग केलेली नसेल अ्थिा उत्ीि्ग होण्यापासून सूट दमळदिलेली नसेल तर, दनयुक्तीनंतर संबंदधत दनयमात नमूद केलेल्या दिदहत मुदतीत दहंदी भािा ि मरा्ठी भािा परीक्षा उत्ीि्ग होिे आिश्यक राहील. त्याचप्रमािे दिदहत मुदतीत दहंदी भािा ि मरा्ठी भािा परीक्षा उत्ीि्ग न झाल्यास सदर परीक्षा उत्ीि्ग होईपयांत िादि्गक िेतनिाढ अनुज्ेय राहिार नाही. तसेच पुढील पदांिरील पदोन्नती अनुज्ेय रहािार नाही.

५. दनयम ३ ये्थील पदािर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, संगिक अह्गता प्रमािपत्ासंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दनयुक्तीपूिथी संगिक अह्गता प्रमािपत् धारि केलेले नसल्यास, याबाबतच्या दनयमात नमूद केलेल्या दिदहत मुदतीत सदर प्रमािपत् धारि करिे आिश्यक राहील. त्याचप्रमािे दिदहत मुदतीत प्रमािपत् धारि न केल्यास, सदर संगिक प्रमािपत् धारि करेपयांत िादि्गक िेतनिाढ अनुज्ेय राहिार नाही. तसेच पुढील पदांिरील पदोन्नती अनुज्ेय रहािार नाही.

६. (क) दनयम ३ ये्थे नमूद पदािर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, महाराष्ट् नागरी सेिा (लहान कुटु ंबाचे प्रदतज्ापन) ंबाचे प्रदतज्ापन दनयम, २००५ मधील तरतुदीनुसार ि त्याबाबत िेळोिेळी करण्यात येिाऱ्या दनयमांनुसार, दनयुक्तीच्या िेळी लहान कुटु सादर करिे आिश्यक राहील. तसेच यासंदभा्गत िेळोिेळी दनग्गदमत होिारे िासन आदेि लागू राहतील.

७. दनयम ३ ये्थे नमूद केलेल्या पदािर दनयुक्त केलेली व्यक्ती संबंदधत दिभाग ्ततरािर बदलीसा्ठी पात् राहील.

८. िासनाने दिदहत केलेल्या अटी ि ितथी, िासनाने िासकीय कम्गचाऱ्यांकररता दनयुक्ती नंतरचे िेळोिेळी दनग्गदमत केलेले अन्य दनयम, आदेि दकंिा दनि्गयदेखील िासकीय कम्गचाऱ्यास लागू राहतील.

No.VEA/2021/CR.104/VE-4.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all the existing rules, orders or instruments issued in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of the Millwright Maintenance Mechanic (Mechanical , Electrical or Electronics), Group-C (Technical), Maharashtra Education Services, in the Government Institute, in the Directorate of Vocational Education and Training under the administrative control of the Skills, Employment, Entrepreneurship and Innovation Department of the Government of Maharashtra, namely :—

1. These rules may be called the Millwright Maintenance Mechanic (Mechanical , Electrical or Electronics) Group-C (Technical), Maharashtra Education Service, in the Directorate of Vocational Education and Training (Recruitment) Rules, 2022.

2. In these rules, unless the context requires otherwise,—

(a) "Degree" means a Degree in Engineering or Technology of a statutory university or any other qualification declared by the Government to be equivalent thereto ;

(b) "Diploma" means a Diploma awarded by the Maharashtra State Board of Technical Education or equivalent educational qualification declared by the Government to be equivalent thereto ;

(c) "Directorate" means the Directorate of Vocational Education and Training under the administrative control of the Skills, Employment, Entrepreneurship and Innovation Department of the Government ;

(d) "Government" means the Government of Maharashtra ;

(e) "National Apprenticeship Certificate Examination" means Apprenticeship Certificate Examination conducted by the National Council for Vocational Training, New Delhi ;

(f) "National Trade Certificate Examination" means the Trade Certificate Examination conducted by the National Council for Vocational Training, New Delhi ;

(g) "Secondary School Certificate Examination" means the Secondary School Certificate Examination conducted by the Divisional Boards constituted under the Maharashtra Secondary and Higher Secondary Education Boards Act, 1965 (XLI of Maharashtra 1965) and includes any other equivalent examination declared by the Government to be equivalent thereto ;

(h) "Selection Committee" means a Selection Committee constituted, from time to time, by the Skills, Employment, Entrepreneurship and Innovation Department of the Government for the purpose of selection of candidates for direct recruitment to the posts mentioned in these rules.

3. Appointment to the post of Millwright Maintenance Mechanic (Mechanical , Electrical or Electronics), in the Directorate shall be made by nomination from amongst the candidates recommended by the Selection Committee on the basis of result of Competitive Examination conducted therefor, who fulfils the following criteria, namely :—

(i) Age limit.—

(A) Lower Age Limit.— Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B) Upper Age Limit.— Thirty-eight years of age completed for the persons not belonging to reserved categories and forty three years completed for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.—

(I) For the post of Millwright Maintenance Mechanic (Mechanical),—

(A) passing of Secondary School Certificate Examination ;

And

(B) passing of the National Apprenticeship Certificate Examination or the National Trade Certificate Examination in Mechanic Machine Tool Maintenance trade ;

(II) For the post of Millwright Maintenance Mechanic (Electrical),—

(A) passing of Secondary School Certificate Examination;

And

(B) passing of the National Apprenticeship Certificate Examination or the National Trade Certificate Examination in Electrician trade ;

(III) For the post of Millwright Maintenance Mechanic (Electronics),—

(A) passing of Secondary School Certificate Examination;

And

(B) passing of the National Apprenticeship Certificate Examination or the National Trade Certificate Examination in Electronics Mechanic or Instrument Mechanic trade ;

(iii) Experience.— A work experience of repair and maintenance of machinery of,—

(A) not less than one year after possessing a Degree,

(B) not less than three years after possessing a Diploma,

(C) not less than five years after passing the National Apprenticeship Certificate Examination or the National Trade Certificate Examination, in the Government or Semi-Government or private establishments or any Corporation or any other institute.

4. A person appointed to the post mentioned in rule 3 by nomination shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.

5. A person appointed to the post mentioned in rule 3 by nomination shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.

6. (1) A person recommended for appointment by nomination to the post mentioned in rule 3 shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in Government Service.

7. A person appointed to the post mentioned in rule 3 shall be liable for transfer within the concerned Division.

१. या दनयमांना व्यिसाय दिक्षि ि प्रदिक्षि संचालनालयामधील काया्गलय अिीक्षक, प्मुख वलवपक, वररष्ट्ठ वलवपक, गट-क, महाराष्ट् दिक्षि सेिा, (सेिाप्रिेि) दनयम, २०२२ असे संबोधण्यात यािे.

२. या दनयमांत संदभा्गनुसार दुसरा अ्थ्ग अदभप्रेत नसेल तर,—

(क) "दनयुक्ती प्रादधकारी" याचा अ्थ्ग, संचालक, व्यिसाय दिक्षि ि प्रदिक्षि संचालनालय, मु ंबई काया्गलयाच्या अदधदन्तत असलेल्या गट - क पदांच्या संदभा्गत असा राहील: संचालक, महाराष्ट् राज्य कौिल्य, व्यिसाय दिक्षि ि प्रदिक्षि मंडळ काया्गलयाच्या अदधदन्तत असलेल्या गट - क पदांच्या संदभा्गत असा राहील, संबंदधत दिभागाचा सहसंचालक, व्यिसाय दिक्षि ि प्रदिक्षि यांच्या अदधदन्तत असलेल्या गट - क पदांच्या संदभा्गत ि िासन सेिेत संबंदधत पदािर उमेदिाराची दनयुक्ती करण्यास सक्षम असिारा असा आहे ;

(ख) "पदिी" याचा अ्थ्ग सांदिदधक दिद्यापी्ठाची पदिी दकंिा िासनाने त्याच्यािी समतुल्य म्हिून घोदित केलेली अन्य कोितीही अह्गता असा आहे ;

(ग) "संचालनालय" याचा अ्थ्ग, व्यिसाय दिक्षि ि प्रदिक्षि संचालनालय असा आहे ;

(घ) "पदोन्नतीसा्ठीची पात्ता" याचा अ्थ्ग, िासनाच्या सामान्य प्रिासन दिभागाने िेळोिेळी दनग्गदमत केलेल्या दनयम, िासन दनि्गय दकंिा आदेिांमध्ये पदोन्नतीसा्ठी दिदहत केलेल्या अटी ि िततींनुसार पदोन्नतीसा्ठीची पात्ता असा आहे ;

(च) "िासन" याचा अ्थ्ग, महाराष्ट् िासन असा आहे ;

(्छ) "दनिड सदमती" याचा अ्थ्ग, या सेिाप्रिेि दनयमातील पदांिरील सरळसेिा भरतीकररता उमेदिारांच्या दनिडीच्या प्रयोजना्थ्ग कौिल्य, रोजगार, उद्योजकता ि नादिन्यता दिभाग यांचेकडून िेळोिेळी ग्ठीत करण्यात आलेली दनिड सदमती असा आहे.

३. संचालनालयामधील काया्गलय अधीक्षक, या पदािरील दनयुक्ती प्रमुख दलदपक, हे पद धारि करिाऱ्या ि या पदािर दकमान तीन िवे दनयदमत सेिा पूि्ग केलेल्या व्यक्तींची एकदत्त ज्येष्ठतेच्या आधारे, एकदत्त ज्येष्ठता सूचीनुसार योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल.

४. संचालनालयामधील प्रमुख दलदपक, या पदािरील दनयुक्ती िररष्ठ दलदपक, हे पद धारि करिाऱ्या ि या पदािर दकमान तीन िवे दनयदमत सेिा पूि्ग केलेल्या व्यक्तींची एकदत्त ज्येष्ठतेच्या आधारे, एकदत्त ज्येष्ठता सूचीनुसार योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल.

५. संचालनालयामधील िररष्ठ दलदपक, या पदािरील दनयुक्ती पुढील मागा्गने करण्यात येईल :—

(क) दलदपक-दन-टंकलेखक, हे पद धारि करिाऱ्या ि या पदािर दकमान तीन िवे दनयदमत सेिा ि सेिासातत्य पूि्ग केलेल्या व्यक्तींमधून एकदत्त ज्येष्ठतेच्या आधारे, आदि दिभागाने दिदहत प्रदिक्षि पूि्ग केलेले आदि दिभागाने दिदहत परीक्षा२२ महाराष्ट्र शासन राजपत्र, भाग चार-अ, गुरुवार ते बुिवार, नोव्हेंबर २४-३०, २०२२/अग्रहा्यण ३-९, शके १९४४ उत्ीि्ग केलेले दकंिा या पदािर बढती दमळण्यापूिथी दिभागाने दिदहत परीक्षा उत्ीि्ग होण्यापासून सूट देण्यात आलेल्या अिा योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल ,

वकंवा

(एक) व्योम्या्षदा,—

(एक) दकमान ियोमया्गदा.— पदभरतीच्या जादहरातीत नमूद केलेल्या अज्ग ्तिीकृतीच्या अंदतम ददनांकास एकोिीस िवे पूि्ग,

(दोन) कमाल ियोमया्गदा.— पदभरतीच्या जादहरातीत नमूद केलेल्या अज्ग ्तिीकृतीच्या अंदतम ददनांकास मागास संिगा्गत समादिष्ट नसलेल्या व्यक्तींसा्ठी अडतीस ि्ग पूि्ग ि मागासिगथीय व्यक्तींसा्ठी त्ेचाळीस िवे पूि्ग.

(दोन) वकमान शैक्षवणक अह्षता,—

(एक) कला दकंिा िादिज्य दकंिा दिज्ान दकंिा कायदा या कोित्याही मान्यता प्रा्पत सांदिदधक दिद्यादप्ठाची पदिी दकंिा िासनाने त्याच्यािी समतुल्य म्हिून घोदित केलेली अन्य कोितीही अह्गता असा आहे;

(दोन) संगिक टंकलेखन प्रमािपत् दकंिा मरा्ठी टंकलेखनात दकमान ३० िब्द प्रदत दमदनट िेगमया्गदेचे आदि इंग्जी टंकलेखनात दकमान ४० िब्द प्रदत दमदनट िेगमया्गदेचे िासकीय व्यािसादयक प्रमािपत्.

(तीन) अनुभवाची अह्षता.— उपखंड दोन मध्ये नमूद केलेली दकमान िैक्षदिक अह्गता प्रा्पत केल्यानंतर कोित्याही उद्योगात दकंिा औद्योदगक उपक्रम दकंिा व्यािसादयक सं्त्था दकंिा ्त्थादनक प्रादधकरि दकंिा महामंडळछे दकंिा िासनाने ्त्थापन केलेल्या मंडळामध्ये प्रिासन दकंिा लेखा दियक कामाचा दकमान तीन िांचा प्रत्यक्ष कामाचा अनुभि :

परंतु व्यिसाय दिक्षि आदि प्रदिक्षि दकंिा तंत्दिक्षि सं्त्थांमधील प्रिासकीय कामाचा पुरेसे ज्ान असलेल्या उमेदिारांना प्राधान्य ददले जाईल :

परंतु िासनाकडून संचालनालयाच्या दिफारिीनुसार अपिादात्मक पररस्त्थतीमध्ये िैक्षदिक अह्गता दकंिा अनुभि दकंिा दोन्ही अह्गताधारक उमेदिारांकररता उच्च ियोमया्गदा पाच िा्गपयांत दिद्थलक्षम करता येईल.

६. दनयम ५ ये्थे नमूद केलेल्या पदािर पदोन्नती ि नामदनदवेिनाने कराियाच्या दनयुक्तीचे प्रमाि ७५ : २५ असे राहील.

७. दनयम ५ मध्ये नमूद केलेल्या पदािर नामदनदवेिनाद्ारे दनयुक्त केलेल्या व्यक्तीने दिभागाने दिदहत प्रदिक्षि पूि्ग करिे आदि दिभागाने दिदहत परीक्षा उत्ीि्ग करिे अदनिाय्ग राहील.

८. या दनयमांमध्ये नमूद असले तरी, जर दनिड सदमतीचे असे मत झाल्यास आिश्यक दकमान िैक्षदिक अह्गता दकंिा अनुभि दकंिा दोन्ही मागास प्रिगा्गतील व्यक्तींसा्ठी राखीि असलेल्या ररक्त जागा भरण्यासा्ठी पुरेिी संख्या असलेले उमेदिार उपलब्ध नाहीत, तर दनिड सदमती िैक्षदिक अह्गता दकंिा अनुभि दकंिा दोन्ही दिद्थलक्षम करून मागासप्रिगा्गतील योग्य उमेदिाराची दनिड करू िकतील.

९. या दनयमांमध्ये नमूद असले तरी, जर िासनाचे असे मत झाल्यास सेिांची आिश्यकता लक्षात घेता त्याबाबतची लेखी कारिे नोंदिून आिश्यक ते्थे पदोन्नतीने दनयुक्त होण्यासा्ठी कोितीही पात् व्यक्ती उपलब्ध नाही याची खात्ी झाल्यानंतर, दनिड सदमतीिी सल्लामसलत करून दनयम ६ मधील दिदहत प्रमाि दिद्थल करून दनयम ५ मध्ये नमूद केलेल्या पदािर नामदनदवेिनाने दनयुक्ती करू िकतील.

१०. दनयम ५ मध्ये नमूद केलेल्या पदािर नामदनदवेिनाने दनयुक्त झालेली व्यक्ती एक िा्गच्या कालािधीकररता पररिीक्षाधीन राहील. पररिीक्षाधीन कालािधी कमाल एक िा्गपयांत िाढदिता येईल. संबंदधत व्यक्तीने पररिीक्षाधीन कालािधी समाधानकारकररत्या पूि्ग करिे आिश्यक राहील. संबंदधत व्यक्तीने पररिीक्षाधीन कालािधी समाधानकारकररत्या पूि्ग न केल्यास त्यांची सेिा समा्पत करण्यांत येईल.

११. (क) दनयम ३,४ दकंिा ५ ये्थे नमूद पदांिर पदोन्नतीने दनयुक्त होिाऱ्या व्यक्तीने, पदोन्नतीपूिथी दहंदी भािा परीक्षा ि मरा्ठी भािा परीक्षा या दोन्ही परीक्षांसंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दहंदी भािा ि मरा्ठी भािा परीक्षा अगोदरच उत्ीि्ग केलेली असिे अ्थिा उत्ीि्ग होण्यापासून सूट दमळदिलेली असिे आिश्यक राहील. अन्य्था या पदािर पदोन्नती अनुज्ेय ्ठरिार नाही.

(ख) दनयम ५ ये्थे नमूद पदांिर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, दहंदी भािा ि मरा्ठी भािा परीक्षा या दोन्ही परीक्षांसंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दहंदी भािा ि मरा्ठी भािा परीक्षा दनयुक्तीपूिथी उत्ीि्ग केलेल्या नसतील तर, दहंदी भािा ि मरा्ठी भािा परीक्षा दनयमात नमूद केलेल्या दिदहत मुदतीत दहंदी भािा ि मरा्ठी भािा परीक्षा उत्ीि्ग होिे आिश्यक राहील. त्याचप्रमािे दिदहत मुदतीत दहंदी भािा ि मरा्ठी भािा परीक्षा उत्ीि्ग न झाल्यास सदर परीक्षा उत्ीि्ग होईपयांत िादि्गक िेतनिाढ अनुज्ेय राहिार नाही. तसेच पुढील पदांिरील पदोन्नती अनुज्ेय राहिार नाही.

१२. (क) दनयम ३, ४ दकंिा ५ ये्थे नमूद पदांिर पदोन्नतीने दनयुक्त होिाऱ्या व्यक्तीने, पदोन्नतीपूिथी संगिक हाताळिी ज्ान अह्गता प्रमािपत्संदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि करिे अ्थिा सदर प्रमािपत् धारि करण्यापासून सूट दमळदिलेली असिे आिश्यक राहील. अन्य्था या पदािर पदोन्नती अनुज्ेय ्ठरिार नाही.

(ख) दनयम ५ ये्थे नमूद पदांिर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, संगिक हाताळिी ज्ान अह्गता प्रमािपत्ासंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दनयुक्तीपूिथी संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि केलेले नसल्यास, याबाबतच्या दनयमात नमूद केलेल्या दिदहत मुदतीत सदर प्रमािपत् धारि करिे आिश्यक राहील. त्याचप्रमािे दिदहत मुदतीत प्रमािपत् धारि न केल्यास, सदर संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि करेपयांत िादि्गक िेतनिाढ अनुज्ेय राहिार नाही. तसेच पुढील पदांिरील पदोन्नती अनुज्ेय राहिार नाही.

ंबाचे ंबाचे १३. (क) दनयम ५ ये्थे नमूद पदािर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, महाराष्ट् नागरी सेिा (लहान कुटु प्रदतज्ापन) दनयम २००५ मधील तरतुदीनुसार ि त्याबाबत िेळोिेळी करण्यात येिाऱ्या दनयमांनुसार, दनयुक्तीच्या िेळी लहान कुटु प्रदतज्ापन सादर करिे आिश्यक राहील. तसेच यासंदभा्गत िेळोिेळी दनग्गदमत होिारे िासन आदेि लागू राहतील.

१४. दनयम ३, ४ दकंिा ५ मध्ये नमूद केलेल्या पदािर दनयुक्त केलेली व्यक्ती संबंदधत दनयुक्ती प्रादधकरिाच्या अदधकारक्षेत्ात बदलीसा्ठी पात् असेल.

१५. िासनाने दिदहत केलेल्या अटी ि ितथी, िासनाने िासकीय कम्गचाऱ्यांकररता दनयुक्ती नंतरचे िेळोिेळी दनग्गदमत केलेले अन्य दनयम, आदेि दकंिा दनि्गयदेखील िासकीय कम्गचाऱ्यास लागू राहतील.

No. VEA-2016/CR.405/16/VE-4.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all the existing rules, orders or instruments issued in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of Office Superintendent, Head Clerk, Senior Clerk in the Government Institute or Office, Group-C, in the Maharashtra Education Service, in the Directorate of Vocational Education and Training under the administrative control of the Skills, Employment, Entrepreneurship and Innovation Department of the Government of Maharashtra, namely :—

1. These rules may be called the Office Superintendent, Head Clerk, Senior Clerk in the Government Institute or Office, Group-C, in the Maharashtra Education Service, in the Directorate of Vocational Education and Training (Recruitment) Rules, 2022.

2. In these rules, unless the context requires otherwise,—

(a) "Appointing Authority" means the Director, Directorate of Vocational Education and Training, Mumbai, in respect of Group-C posts in the office of Directorate: Director, Maharashtra State Board of Skill, Vocational Education and Training, in respect of Group-C posts in the office of Board and the Joint Director, Vocational Education and Training of the concerned region in respect of Group-C posts in that region who shall be competent to appoint the candidate to the concerned post in the Government service ;

(b) "Degree" means a Degree of any faculty of a statutory University or any other essential qualification declared by the Government as equivalent thereto ;

(d) "Eligibility for promotion" means the eligibility for promotion in accordance with the terms and conditions specified for promotion in rules, resolutions or orders issued by the General Administration Department of the Government, from time to time ;

(e) "Government" means the Government of Maharashtra ;

(f) "Selection Committee" means a Selection Committee constituted, from time to time, by the Skills, Employment, Entrepreneurship and Innovation Department of the Government for the purpose of selection of candidates for direct recruitment to the posts mentioned in these rules.

3. Appointment to the post of Office Superintendent in the Directorate shall be made by promotion of a suitable person having eligibility for promotion and having not less than three years regular service on the post of Head Clerk on the basis of seniority, as per the seniority list of persons holding the said post.

4. Appointment to the post of Head Clerk, in the Directorate shall be made by promotion of a suitable person having eligibility for promotion and having not less than three years regular service on the post of Senior Clerk, on the basis of seniority, from amongst the persons holding the said post.

5. Appointment to the post of Senior Clerk in the Directorate shall be made either,---

(a) by promotion of a suitable person having eligibility for promotion and having not less than three years regular service on the post of Clerk-cum-Typist, on the basis of seniority, from amongst the persons holding the said post and has completed the departmental training and passed the departmental examination or has been exempted from passing the departmental examination before getting promoted to the said post ;

(i) Age limit.—

(A) Lower Age Limit.— Nineteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B) Upper Age Limit.— Thirty-eight years of age completed for the persons not belonging to reserved categories and forty three years completed for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.—

(A) passed Bachelor's Degree in any faculty of Arts or Commerce or Science or Law from a recognised institution approved by the statutory University or any other equivalent qualification declared by the Government in this behalf; and

(B) possess the Government Commercial Certificate or Computer Typing Certificate with a speed of not less than 30 words per minute in Marathi Typewriting and 40 words per minute in English Typewriting.

and

(iii) Experience.— Possess a practical experience for minimum period of three years in administration or accounting work in any industry or in an industrial enterprise or commercial institutes or Local Authority or Corporation or Board established by the Government, after acquiring the minimum educational qualification mentioned in sub-clause (ii) :

Provided that the preference shall be given to the candidates having adequate knowledge of administration of vocational education and Training or technical education institutions :

Provided that, the upper age limit may be relaxed upto five years in case of candidates having exceptional qualification or experience or both by the Government on the recommendation of the Directorate.

6. Appointment to the post mentioned in rule 5 shall be made by promotion and nomination, in the ratio of 75:25, respectively.

7. A person appointed to the post mentioned in rule 5 by nomination shall be required to complete the Departmental Training and pass the prescribed Departmental Examination.

8. Notwithstanding anything contained in these rules, if the Selection Committee is of the opinion that sufficient number of candidates possessing requisite minimum educational qualification or experience or both are not available to fill up the vacancies reserved for the persons belonging to reserved categories, then the Selection Committee may relax the educational qualification or experience or both and select the suitable candidate belonging to reserved categories.

9. Notwithstanding anything contained in these rules, the opinion of the Government, that the exigencies of services so requires, the Government may for reasons to be recorded in writing and after ascertaining that no qualified person is available for being appointed by promotion wherever necessary, make appointment to the post mentioned in rule 5 by nomination in relaxation of the ratio prescribed in rule 6 in consultation with the Selection Committee.

10. A person appointed to the post mentioned in rule 5 by nomination shall be on probation for a period of one years. Probation period may be extended up to a maximum of one year. A person shall be required to complete the probation period successfully. If a person does not complete the probation period successfully within the stipulated period or is not found suitable for the post, then a person shall be liable to be terminated from the service.

(1) A person to be appointed to the post mentioned in rule 3, 4 or 5 by promotion shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, unless he has already passed or has been exempted from passing those examinations before getting promoted to the said post.

(2) A person appointed to the post mentioned in rule 5 by nomination shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.

12. (1) A person to be appointed to the post mentioned in rule 3, 4 or 5 by promotion shall possess a certificate of Computer Operations prescribed by rules or orders issued in that behalf by the Government, from time to time, unless he has been exempted therefrom before getting promoted to the said post.

(2) A person appointed to the post mentioned in rule 5 by nomination shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.

13. (1) A person recommended for appointment by nomination to the post mentioned in rule 5 shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in Government Service.

14. A person appointed to the post mentioned in rule 3, 4 or 5 shall be liable for transfer within the jurisdiction of the Appointing Authority.

15. The terms and conditions specified by the Government, subsequent to the appointment of any Government Servant in any rules, orders or resolutions issued by the Government, from time to time, shall also be applicable to the Government Servant.

क्रमांक व्यदिअ-२०२१/प्र.क्र. ७५/व्यदि-४.—भारतीय संदिधानाच्या अनुच्छछेद ३०९ खालील परंतुकान्िये प्रदान करण्यांत आलेल्या िक्तींचा िापर करून आदि या संदभा्गत सध्या अस्ततत्िात असलेले सि्ग दिद्यमान दनयम, आदेि दकंिा अनुदेि यांचे अदधक्रमि करुन, महाराष्ट्ाचे राज्यपाल याद्ारे महाराष्ट् िासनाच्या कौिल्य, रोजगार, उद्योजकता ि नादिन्यता दिभागाच्या प्रिासकीय दनयंत्िाखालील व्यिसाय दिक्षि ि प्रदिक्षि संचालनालयामधील िासकीय सं्त्थेतील पूि्गिेळ दिक्षक, पूि्गिेळ दिक्षक (प्रात्यदक्षक), सहाय्यक अदधव्याख्याता, गट-क (तांदत्क), महाराष्ट् दिक्षि सेिा, पदािरील सेिाप्रिेिाचे दिदनयमन करिारे पुढील दनयम करीत आहेत :—

१. या दनयमांना व्यिसाय दिक्षि ि प्रदिक्षि संचालनालयामधील पूि्गिेळ दिक्षक, पूि्गिेळ दिक्षक (प्रात्यदक्षक), सहाय्यक अदधव्याख्याता गट-क (तांदत्क), महाराष्ट् दिक्षि सेिा, (सेिाप्रिेि) दनयम, २०२२ असे संबोधण्यात यािे.

२. या दनयमांत संदभा्गनुसार दुसरा अ्थ्ग अदभप्रेत नसेल तर,—

(क) "पररदिष्ट" याचा अ्थ्ग या दनयमांना जोडलेले पररदिष्ट असा आहे;

(ख) "दनयुक्ती प्रादधकारी" याचा अ्थ्ग संबंदधत दिभागाचा सहसंचालक, व्यिसाय दिक्षि ि प्रदिक्षि असा आहे;

(ग) "पदिी" याचा अ्थ्ग सांदिदधक दिद्यादप्ठाची अदभयांदत्की दकंिा तंत्िा्त् गटातील पदिी दकंिा िासनाने त्याच्यािी समतुल्य म्हिून घोदित केलेली अन्य कोितीही अह्गता असा आहे;

(घ) "पददिका" याचा अ्थ्ग महाराष्ट् राज्य तंत् दिक्षि मंडळाने प्रदान केलेली अदभयांदत्की दकंिा तंत्िा्त् गटातील पददिका दकंिा िासनाने त्याच्यािी समतुल्य म्हिून घोदित केलेली अन्य कोितीही अह्गता असा आहे;

(च) "संचालनालय" याचा अ्थ्ग िासनाच्या कौिल्य, रोजगार, उद्योजकता ि नादिन्यता दिभागाच्या प्रिासकीय दनयंत्िाखालील व्यिसाय दिक्षि ि प्रदिक्षि संचालनालय असा आहे;

(्छ) "पदोन्नतीसा्ठीची पात्ता" याचा अ्थ्ग िासनाच्या सामान्य प्रिासन दिभागाने िेळोिेळी दनग्गदमत केलेल्या दनयम, दनि्गय दकंिा आदेिांमध्ये पदोन्नतीसा्ठी दिदहत केलेल्या अटी ि िततींनुसार पदोन्नतीसा्ठीची पात्ता असा आहे ;

(ज) "िासन" याचा अ्थ्ग महाराष्ट् िासन असा आहे;

(झ) "राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा" याचा अ्थ्ग राष्ट्ीय व्यिसाय प्रदिक्षि पररिद, निी ददल्ली यांचेद्ारे घेण्यात येिारी दिकाऊ उमेदिारी प्रमािपत् परीक्षा असा आहे;

(त्) "राष्ट्ीय व्यिसाय प्रमािपत् परीक्षा" याचा अ्थ्ग, राष्ट्ीय व्यिसाय प्रदिक्षि पररिद, निी ददल्ली यांचेद्ारे घेण्यात येिारी व्यिसाय प्रमािपत् परीक्षा असा आहे;

(ट) "माध्यदमक िाळा प्रमािपत् परीक्षा" याचा अ्थ्ग, महाराष्ट् राज्य माध्यदमक आदि उच्च माध्यदमक दिक्षि मंडळछे अदधदनयम, १९६५ (१९६५ चा महाराष्ट् अदधदनयम क्रमांक ४१) अन्िये ग्ठीत केलेल्या दिभागीय मंडळाकडून घेण्यात येिारी माध्यदमक िाळा प्रमािपत् परीक्षा असा आहे दकंिा िासनाने त्याच्यािी समतुल्य म्हिून घोदित केलेली अन्य कोितीही अह्गता असा आहे;

(्ठ) "दनिड सदमती" याचा अ्थ्ग, या सेिाप्रिेि दनयमातील पदांिरील सरळसेिा भरतीकरीता उमेदिारांच्या दनिडीच्या प्रयोजना्थ्ग कौिल्य, रोजगार, उद्योजकता ि नादिन्यता दिभाग यांचे कडून िेळोिेळी ग्ठीत करण्यात आलेली दनिड सदमती असा आहे;

भाग चार-अ—५२८ महाराष्ट्र शासन राजपत्र, भाग चार-अ, गुरुवार ते बुिवार, नोव्हेंबर २४-३०, २०२२/अग्रहा्यण ३-९, शके १९४४ ३. संचालनालयामधील पूि्गिेळ दिक्षक, या पदािरील दनयुक्ती पुढील मागा्गने करण्यात येईल :—

(क) पूि्गिेळ दिक्षक (प्रात्यदक्षक) दकंिा सहाय्यक अदधव्याख्याता, गट-क (तांदत्क), महाराष्ट् दिक्षि सेिा, हे पद धारि करिाऱ्या ि या पदािर दकमान तीन िवे दनयदमत सेिा ि सेिासातत्य पूि्ग केलेल्या व्यक्तींमधून एकदत्त ज्येष्ठतेच्या आधारे, योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल;

दकंिा

(ख) दनिड सदमतीद्ारे घेण्यात येिाऱ्या ्तपधा्गत्मक परीक्षेच्या दनकालाच्या आधारे दिफारस करण्यात आलेल्या, ि खालील दनकि पूि्ग करिाऱ्या उमेदिारांमधून नामदनदवेिनाद्ारे :—

(एक) ियोमया्गदा.—

(दोन) दकमान िैक्षदिक अह्गता.—

सोबतच्या पररदिष्ट-अ मध्ये नमूद संबंदधत व्यिसाय अभ्यासक्रमासा्ठी दिदहत केलेली दद्तीय श्ेिीतील पददिका.

(तीन) अनुभिाची अह्गता.— अध्यापन कामाचा प्रत्यक्ष अनुभि,—

(एक) पदिी धारि झाल्यानंतर एक िांपेक्षा कमी नाही इतका,

(दोन) पददिका धारि झाल्यानंतर दोन िांपेक्षा कमी नाही इतका,

औद्योदगक क्षेत्ातील.

४. संचालनालयामधील पूि्गिेळ दिक्षक (प्रात्यदक्षक), या पदािरील दनयुक्ती दनिड सदमतीद्ारे घेण्यात येिाऱ्या ्तपधा्गत्मक परीक्षेच्या दनकालाच्या आधारे दिफारस करण्यात आलेल्या, ि खालील दनकि पूि्ग करिाऱ्या उमेदिारांमधून नामदनदवेिनाद्ारे :—

(एक) ियोमया्गदा.—

(दोन) दकमान िैक्षदिक अह्गता.—

(एक) माध्यदमक िालांत प्रमािपत् परीक्षा उत्ीि्ग ;

आदि

(दोन) सोबतच्या पररदिष्ट- ब मध्ये नमूद संबंदधत व्यिसाय अभ्यासक्रमासा्ठी दिदहत केलेली राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा उत्ीि्ग दकंिा राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा नसलेल्या व्यिसाय अभ्यासक्रमांकररता सोबतच्या पररदिष्ट- ब मध्ये नमूद संबंदधत व्यिसाय अभ्यासक्रमासा्ठी दिदहत केलेली राष्ट्ीय व्यिसाय प्रमािपत् परीक्षा उत्ीि्ग.

(तीन) अनुभिाची अह्गता.—औद्योदगक क्षेत्ातील कामाचा अनुभि,—

(एक) पदिी धारि झाल्यानंतर एक िांपेक्षा कमी नाही इतका,महाराष्ट्र शासन राजपत्र, भाग चार-अ, गुरुवार ते बुिवार, नोव्हेंबर २४-३०, २०२२/अग्रहा्यण ३-९, शके १९४४ २ ९ (दोन) पददिका धारि झाल्यानंतर दोन िांपेक्षा कमी नाही इतका,

(तीन) राष्ट्ीय दिकाऊ उमेदिारी प्रमािपत् परीक्षा उत्ीि्ग झाल्यानंतर तीन िांपेक्षा कमी नाही इतका, (चार) राष्ट्ीय व्यिसाय प्रमािपत् परीक्षा उत्ीि्ग झाल्यानंतर चार िांपेक्षा कमी नाही इतका.

५. संचालनालयामधील सहाय्यक अदधव्याख्याता, या पदािरील दनयुक्ती दनिड सदमतीद्ारे घेण्यात येिाऱ्या ्तपधा्गत्मक परीक्षेच्या दनकालाच्या आधारे दिफारस करण्यात आलेल्या, ि खालील दनकि पूि्ग करिाऱ्या उमेदिारांमधून नामदनदवेिनाद्ारे :—

(एक) ियोमया्गदा.—

(एक) दकमान ियोमया्गदा.— पदभरतीच्या जादहरातीत नमूद केलेल्या अज्ग ्तिीकृतीच्या अंदतम ददनांकास अ्ठरा िवे पूि्ग.

(दोन) दकमान िैक्षदिक अह्गता.—

अदभयांदत्की दकंिा तंत्िा्त् या मधील यंत् अदभयांदत्की दकंिा दिद्युत दकंिा इलेक्ट्ॉदनक्स दकंिा ऑटोमोबाईल दियातील दकमान दद्तीय श्ेिीतील पददिका.

(तीन) अनुभिाची अह्गता.— अध्यापन कामाचा प्रत्यक्ष अनुभि,—

(एक) पदिी धारि झाल्यानंतर एक िांपेक्षा कमी नाही इतका,

(दोन) पददिका धारि झाल्यानंतर दोन िांपेक्षा कमी नाही इतका,

औद्योदगक क्षेत्ातील.

६. दनयम ३ ये्थे नमूद केलेल्या पदािर पदोन्नती ि नामदनदवेिनाने कराियाच्या दनयुक्तीचे प्रमाि ५०: ५० असे राहील.

परंतु आिखी असे की, पदोन्नतीद्ारे दनयुक्ती देण्याकरीता योग्य उमेदिार उपलब्ध नसतील तर दनयुक्ती प्रादधकाऱ्याच्या सहमतीने पदोन्नती ि नामदनदवेिन याद्ारे कराियाच्या दनयुक्तीकरीता दिदहत करण्यात आलेले प्रमाि त्या भरती िा्गपुरते दिद्थल करून सदर पदे नामदनदवेिनाद्ारे भरता येतील.

७. (क) दनयम ३ ये्थे नमूद पदांिर पदोन्नतीने दनयुक्त होिाऱ्या व्यक्तीने, पदोन्नतीपूिथी दहंदी भािा परीक्षा ि मरा्ठी भािा परीक्षा या दोन्ही परीक्षांसंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दहंदी भािा ि मरा्ठी भािा परीक्षा अगोदरच उत्ीि्ग केलेली असिे अ्थिा उत्ीि्ग होण्यापासून सूट दमळदिलेली असिे आिश्यक राहील. अन्य्था या पदािर पदोन्नती अनुज्ेय ्ठरिार नाही.

(ख) दनयम ३, ४ दकंिा ५ ये्थे नमूद पदांिर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, दहंदी भािा ि मरा्ठी भािा परीक्षा या दोन्ही परीक्षांसंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दहंदी भािा ि मरा्ठी भािा परीक्षा दनयुक्तीपूिथी उत्ीि्ग केलेल्या नसतील तर, दहंदी भािा ि मरा्ठी भािा परीक्षा दनयमात नमूद केलेल्या दिदहत मुदतीत दहंदी भािा ि मरा्ठी भािा परीक्षा उत्ीि्ग होिे आिश्यक राहील. त्याचप्रमािे दिदहत मुदतीत दहंदी भािा ि मरा्ठी भािा परीक्षा उत्ीि्ग न झाल्यास सदर परीक्षा उत्ीि्ग होईपयांत िादि्गक िेतनिाढ अनुज्ेय राहिार नाही. तसेच पुढील पदांिरील पदोन्नती अनुज्ेय रहािार नाही.

८. (क) दनयम ३ ये्थे नमूद पदांिर पदोन्नतीने दनयुक्त होिाऱ्या व्यक्तीने, पदोन्नतीपूिथी संगिक हाताळिी ज्ान अह्गता प्रमािपत्संदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि करिे अ्थिा सदर प्रमािपत् धारि करण्यापासून सूट दमळदिलेली असिे आिश्यक राहील. अन्य्था या पदािर पदोन्नती अनुज्ेय ्ठरिार नाही.

(ख) दनयम ३, ४ दकंिा ५ ये्थे नमूद पदांिर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, संगिक हाताळिी ज्ान अह्गता प्रमािपत्ासंदभा्गत िासनाने िेळोिेळी केलेल्या दनयमांनुसार, दनयुक्तीपूिथी संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि केलेले नसल्यास, याबाबतच्या दनयमात नमूद केलेल्या दिदहत मुदतीत सदर प्रमािपत् धारि करिे आिश्यक राहील. त्याचप्रमािे दिदहत मुदतीत प्रमािपत् धारि न केल्यास, सदर संगिक हाताळिी ज्ान अह्गता प्रमािपत् धारि करेपयांत िादि्गक िेतनिाढ अनुज्ेय राहिार नाही. तसेच पुढील पदांिरील पदोन्नती अनुज्ेय रहािार नाही.

ंबाचे ंबाचे ९. (क) दनयम ३, ४ दकंिा ५ ये्थे नमूद पदािर नामदनदवेिनाद्ारे दनयुक्त होिाऱ्या व्यक्तीने, महाराष्ट् नागरी सेिा (लहान कुटु प्रदतज्ापन) दनयम, २००५ मधील तरतुदीनुसार ि त्याबाबत िेळोिेळी करण्यात येिाऱ्या दनयमांनुसार, दनयुक्तीच्या िेळी लहान कुटु प्रदतज्ापन सादर करिे आिश्यक राहील. तसेच यासंदभा्गत िेळोिेळी दनग्गदमत होिारे िासन आदेि लागू राहतील.

१०. दनयम ३, ४, ५ दकंिा ६ ये्थे नमूद केलेल्या पदािर दनयुक्त केलेली व्यक्तींसंबंदधत दिभाग ्ततरािर बदलीसा्ठी पात् राहील.

११. िासनाने दिदहत केलेल्या अटी ि ितथी, िासनाने िासकीय कम्गचाऱ्यांकरीता दनयुक्ती नंतरचे िेळोिेळी दनग्गदमत केलेले अन्य दनयम, आदेि दकंिा दनि्गय देखील िासकीय कम्गचाऱ्यास लागू राहतील.

No. VEA/2021/CR.75/VE-4.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all the existing rules, orders or instruments issued in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of the Full-Time Teacher, Full-Time Teacher (Practical), Assistant Lecturer, Group-C (Technical), Maharashtra Education Services, in the Government Institute, in the Directorate of Vocational Education and Training under the administrative control of the Skills, Employment, Entrepreneurship and Innovation Department of the Government of Maharashtra, namely :—

1. These rules may be called the Full-Time Teacher, Full-Time Teacher (Practical), Assistant Lecturer, Group-C (Technical), Maharashtra Education Service, in the Directorate of Vocational Education and Training (Recruitment) Rules, 2022.

2. In these rules, unless the context requires otherwise,—

(a) "Appendix" means an Appendix appended to these rules;

(b) "Appointing Authority" means the Joint Director, Vocational Education and Training of the concerned region;

(c) "Degree" means a Degree in Engineering or Technology of a statutory university or any other qualification declared by the Government to be equivalent thereto;

(d) "Diploma" means a Diploma awarded by the Maharashtra State Board of Technical Education or equivalent educational qualification declared by the Government to be equivalent thereto;

(e) "Directorate" means the Directorate of Vocational Education and Training under the administrative control of the Skills, Employment, Entrepreneurship and Innovation Department of the Government;

(f) "Eligibility for promotion" means the eligibility for promotion in accordance with the terms and conditions specified for promotion in rules, resolutions or orders issued by the General Administration Department of the Government, from time to time;

(g) "Government" means the Government of Maharashtra;

(h) "National Apprenticeship Certificate Examination" means Apprenticeship Certificate Examination conducted by the National Council for Vocational Training, New Delhi;

(i) "National Trade Certificate Examination" means the Trade Certificate Examination conducted by the National Council for Vocational Training, New Delhi;

3. Appointment to the post of Full-Time Teacher, in the Directorate shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion and having not less than three years regular and continuous service on the post of Full-Time Teacher (Practical) or Assistant Lecturer, Group-C (Technical), Maharashtra Education Service on the basis of common seniority, from amongst the persons holding the said posts; or

(i) Age limit.—

(A) Lower Age Limit.- Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B) Upper Age Limit.- Thirty-eight years of age completed for the persons not belonging to reserved categories and forty three years completed for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.- A Diploma at least in second class in the relevant vocational course prescribed in Appendix-A.

(iii) Experience.- Practical experience of teaching work of,—

(A) not less than one year after possessing a Degree,

(B) not less than two years after possessing a Diploma,

in the industrial sector.

4. Appointment to the post of Full-Time Teacher (Practical), in the Directorate shall be made by nomination from amongst the candidates recommended by the Selection Committee on the basis of result of Competitive Examination conducted therefor, who fulfils the following criteria, namely :—

(i) Age limit.—

(A) Lower Age Limit.- Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.—

(A) passing of Secondary School Certificate Examination; and

(B) passing of the National Apprenticeship Certificate Examination in relevant trade as prescribed in Appendix-B or passed the National Trade Certificate Examination for those trades where the National Apprenticeship Certificate Examination is not prescribed in Appendix –B.

(iii) Experience.—Industrial work experience of,—

(A) not less than one year after possessing a Degree,

(B) not less than two years after possessing a Diploma,

(D) not less than four years after passing the National Trade Certificate Examination.

5. Appointment to the post of Assistant Lecturer, in the Directorate shall be made by nomination from amongst the candidates recommended by the Selection Committee on the basis of result of Competitive Examination conducted therefor, who fulfils the following criteria, namely :—

(i) Age limit.—

(A) Lower Age Limit.- Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.- A Diploma at least in second class in Mechanical or Electrical or Electronics or Automobile Engineering or Technology.

(iii) Experience.- Practical experience of teaching work of,—

(A) not less than one year after possessing a Degree,

(B) not less than two years after possessing a Diploma,

in the industrial sector.

6. Appointment to the post mentioned in rule 3 shall be made by promotion and nomination, in the ratio of 50 : 50, respectively:

Provided that, if a suitable person is not available for promotion, the Appointing Authority may make appointment by nomination by relaxing the ratio prescribed for appointment by promotion.

7. (1) A person to be appointed to the post mentioned in rule 3 by promotion shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, unless he has already passed or has been exempted from passing those examinations before getting promoted to the said post.

(2) A person appointed to the post mentioned in rule 3, 4 or 5 by nomination shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.

8. (1) A person to be appointed to the post mentioned in rule 3 by promotion shall possess a Certificate of Computer Operations prescribed by rules or orders issued in that behalf by the Government, from time to time, unless he has been exempted therefrom before getting promoted to the said post.

(2) A person appointed to the post mentioned in rule 3, 4 or 5 by nomination shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.

9. (1) A person recommended for appointment by nomination to the post mentioned in rule 3, 4 or 5 shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in Government Service.

10. A person appointed to the post mentioned in rule 3, 4, 5 or 6 shall be liable for transfer within the concerned Division.

11. The terms and conditions specified by the Government, subsequent to the appointment of any Government Servant in any rules, orders or resolutions issued by the Government, from time to time, shall also be applicable to the Government Servant.
