क्रमांक टीपीएस-१०२२/५६५/प्र. क्र. ६२/२०२२/नवि-९.-- ज्याअर्थ्ाी, दोंडाईचा-वरवाडे नगरपरिषदेच्या (जिल्हा धुळे) मूळ हद्दीसाठी, दुसरी सुधारित विकास योजना, महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (सन १९६६ चा महाराष्ट्र अधिनियम क्रमांक ३७) (यापुढे "उक्त अधिनियम" असे संबोधले आहे) चे कलम ३१ (१) अन्वये शासन अधिसूचना, नगर विकास विभाग क्रमांक टीपीएस-१०१२/५४९(न)/ पुनबाधणी क्र.६५/प्र.क्र.११३(न)/२०१२/नवि-९, दिनांक २८ डिसेंबर २०१२ अन्वये भागश: मंजूर झाली असून दिनांक १५ ेब्रुवारी २०१३ पासून अंमलात आलेली आहे. तसेच वगळलेल्या भागाची पुनर्प्रसिद्ध विकास योजना शासन अधिसूचना, नगर विकास विभाग क्रमांक टीपीएस-१०१२/ ५४९(न)/पुनबाधणी क्र.६५/प्र.क्र.११३(न)/२०१२/नवि-९, दिनांक १३ जून २०१४ अन्वये मंजूर झाली असून दिनांक २ ऑगस्ट २०१४ पासून अंमलात आलेली आहे (यापुढे "उक्त दुसरी सुधारित विकास योजना" असे संबोधले आहे) ;

आणि ज्याअर्थ्ाी, उक्त विकास योजनेसाठी मुख्याधिकारी, दोंडाईचा-वरवाडे नगरपरिषद हे नियोजन प्राधिकरण आहे (यापुढे "उक्त नियोजन प्राधिकरण" असे संबोधले आहे) ;

आणि ज्याअर्थ्ाी, उक्त विकास योजनेमध्ये मौजा दोंडाईचा-वरवाडे येथ्ाील सिटी सव्ह क्रमांक ३४१ ते ३४३ व ३४४ (पैकी) ०.३२ हेक्टर क्षेत्र (यापुढे "उक्त जागा" असे संबोधले आहे) आरक्षण क्रमांक १५- "म्युनिसिपल माकट" यासाठी आरक्षित (यापुढे "उक्त आरक्षण" असे संबोधले आहे) आहे ;

आणि ज्याअर्थ्ाी, उक्त नियोजन प्राधिकरणाने त्यांच्या सर्वसाधारण सभेचा ठराव क्रमांक ०२, दिनांक १३ डिसेंबर २०२१ अन्वये उक्त विकास योजनेत ेरबदल करून उक्त जागेवरील उक्त आरक्षण वगळून त्याखालील क्षेत्र वाणिज्य वापर विभागात समाविष्ट करण्याचे ठरवून उक्त अधिनियमाचे कलम ३७ (१) अन्वये सर्व वैधानिक कार्यवाही पूर्ण करून प्रस्ताव दिनांक २७ डिसेंबर २०२१ च्या पत्रान्वये शासनास सादर केलेला आहे ;

आणि ज्याअर्थ्ाी, आवश्यक ती चौकशी केल्यानंतर आणि संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचेशी सल्लामसलत केल्यानंतर, उक्त ेरबदलाचा प्रस्ताव नामंजूर करावा, असे शासनाचे मत झाले आहे ;

भाग १ (नावि) ३००२ महाराष्ट्र शासन राजपत्र, भाग एक -------- नाशिक विभागीय पुरवणी, गुरुवार ते बुधवार, डिसेंबर १ - ७, २०२२ / अग्रहायण १० - १६, शके १९४४ आता, त्याअर्थ्ाी, उक्त अधिनियमाच्या कलम ३७ चे पोट-कलम (२) अन्वये व त्या अनुषंगाने शासनास प्राप्त असलेल्या इतर अधिकारांचा वापर करून शासन उक्त विकास योजनेतील उक्त ेरबदल प्रस्ताव नामंजूर करीत आहे.

सदरची अधिसूचना नागरिकांच्या अवलोकनार्थ मुख्याधिकारी, दोंडाईचा-वरवाडे नगरपरिषद, दोंडाईचा, जिल्हा धुळे यांचे कार्यालयात, कार्यालयीन कामकाजाच्या दिवशी उपलब्ध करण्यात येत आहे.

सदर अधिसूचना शासनाच्या ... या संकेतस्थळावर उपलब्ध आहे.

Maharashtra Regional Planning and Town Planning Act, 1966

NOTIFICATION

No. TPS-1022/565/CR-62/2022/UD-09.– Whereas, the Second Revised Development Plan of Original limit of Dondaicha-Varwade City, (district Dhule) has been Partly sanctioned by the Government Vide Urban Development Department's Notification No.TPS-1012/549(N)/ Recon.No.65/ CR-113(N)/2012/UD-9, dated 28th December 2012 and came into force from 15th February 2013 and Development Plan of Excluded Part has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-1012/549(N)/Recon.No.65/CR-113(N)/2012/UD-9, dated 13th June 2014 and came into force from 2nd August 2014 (hereinafter referred to as "the said Development Plan") ;

and whereas, the Chief Officer, Dondaicha -Varwade Municipal Council is the Planning Authority for the said Development Plan (hereinafter referred to as "the said Planning Authority") ;

and whereas, in the said Development Plan, land bearing City Survey Nos. 341 to 343 and 344 (pt.) admeasuring 0.32 Hector of Mouje Dondaicha-Varwade (hereinafter referred to as "the said Land") is reserved as Site No. 15 "Municipal Market" (hereinafter referred to as "the said Reservation") ;

and whereas, the said Planning Authority vide it's General Body Resolution No. 02, dated 13th December 2021 resolved to modify the said Development Plan by deleting the said reservation on the said land and land so released to be included in Commercial Zone (hereinafter referred to as "the said Modification"), after following all the legal formalities stipulated under Section 37 (1) of the said Act, forwarded the proposal to Government for sanction vide letter dated 27th December 2021 ;

and whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the said modification needs to be refused ;

Now therefore in, exercise of powers conferred by sub-section (2) of Section 37 of the said Act the Government of Maharashtra hereby refuses to accord sanction to the said Modification.

This Notification shall be kept open for inspection by the General public during office hours in the office of the Chief Officer, Dondaicha-Varwade Municipal Council, Dondaicha, district Dhule.

This Notification shall also be available on the Government's website www.maharashtra.gov.in

त्याअर्थी, मी, जलज शर्मा, जिल्हाधिकारी, धुळे उक्त नियमाच्या कलम २ (३) (ई) अन्वये मला प्राप्त झालेल्या समुचित शासनाच्या

अधिसूचना

अधिकारान्वये असे घोषित करतो की, खालील परिशिष्ट-१ मध्ये नमूद जिल्हा धुळे

क्रमांक भूसं/कक्ष-२/एसआर-१/२०१७/सन २०२२.--------- ज्याअर्थी, उपविभागीय अधिकारी तथा भूसंपादन अधिकारी, शिरपूर भाग, शिरपूर यांनी खालील परिशिष्टामध्ये नमूद केलेल्या जमिनी भूमि संपादन, पुनर्वसन व पुनस्र्थापना करताना वाजवी भरपाई मिळण्याचा व पारदर्शकतेचा हक्क अधिनियम, २०१३ चे कलम ११ अन्वये मौजे शिरपूर खु., तालुका शिरपूर येथील ३३/११ के.व्ही. उपकेंासाठी भूसंपादन प्रस्ताव १/२०१७ अन्वये भूसंपादन क्षेत्र हे नगरपालिका हद्दीत असल्याने प्राथमिक केलेले मौजे शिरपूर खु., तालुका शिरपूर येथील ३३/११ के.व्ही.

उपकेंासाठीचा भूसंपादन प्रस्ताव आवश्यक असल्याबाबत माझी खात्री झालेली आहे.

सदर जमिनींचे नकाशे व अन्य अभिलेख कार्यालयीन वेळेत उपविभागीय अधिकारी तथा भूसंपादन अधिकारी, शिरपूर भाग, शिरपूर यांच्या कार्यालयात पाहणीसाठी उपलब्ध राहतील.

शिरपूर भाग, शिरपूर यांनी सदरचा प्रस्ताव नगरपालिका हद्दीत असल्याने प्राथमिक अधिसूचना कलम ११ ची नोटीस प्रसिद्ध करण्यात आलेली नाही, त्यामुळे हरकती प्राप्त होण्याचा प्रश्नच उदभवत नाही, तरी उक्त अधिनियमाच्या कलम १५ अन्वये समुचित शासन तथा जिल्हाधिकारी, धुळे यांना सादर करण्याची आवश्यकता नाही ;

सामाजिक परिणाम निर्धारण अभ्यासाचे निष्कर्ष

महाराष्ट्र शासन राजपत्र, दिनांक २६ एप्रिल २०१८ मध्ये प्रसिद्ध झालेल्या भूमि संपादन, पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा आणि पारदर्शकतेचा हक्क (महाराष्ट्र सुधारणा) अधिनियम, २०१८ चे कलम १०-क नुसार राज्य शासनास, लोकहितास्तव, राजपत्रातील अधिसूचनेद्वारे या अधिनियमाच्या प्रकरण २ व प्रकरण ३ यांच्या तरतुदी लागू करण्यापासून (ख) सिंचन व विुतीकरण यांच्यासह ग्रामीण पायाभूत सुविधा प्रकल्पास सूट देता येईल. सदर प्रस्ताव कलम १०-क (ख) "सिंचन व विुतीकरण यांच्यासह ग्रामीण पायाभूत सुविधा प्रकल्प" या व्याख्येमध्ये बसत असल्याने सदर प्रकरणी (५) मा. विशेष पोलीस महानिरीक्षक (सुरक्षा व सागरी सुरक्षा), राज्य गुप्तवार्ता विभाग, महाराष्ट्र राज्य, मुंबई कडील परिपत्रक क्र. (२) ज्याअर्थी, नाशिक पोलीस आयुक्तालय कार्यक्षेत्रातील दोन लष्करी आस्थापनांच्या ठिकाणी बेकायदेशीरपणे ड्रोन उाणाच्या घटना घडल्या आहेत. जसे, उपनगर पोलीस ठाणे हद्दीतील कॉम्बॅट आर्मी एव्हिएशन ट्रेनिंग स्कूल (कॅटस), गांधीनगर या प्रतिबंधित लष्करी क्षेत्रात बेकायदेशीरपणे ड्रोनचे उाण केल्याने, उपनगर पोलीस स्टेशन येथे दिनांक २७ ऑगस्ट २०२२ रोजी गुन्हा दाखल होणे व आडगाव पोलीस स्टेशनच्या हद्दीत संरक्षण संशोधन आणि विकास संस्था () या प्रतिबंधित क्षेत्राजवळ अनधिकृतपणे ड्रोन उडविलेची घटना घडणे व त्यामुळे आडगाव पोलीस स्टेशन येथे दिनांक २४ सप्टेंबर २०२२ रोजी गुन्हा दाखल होणे.

(३) ज्याअर्थी, संदर्भ क्रमांक ६ अन्वये नाशिक पोलीस आयुक्तालय कार्यक्षेत्रातील महत्त्वाच्या लष्करी आस्थापना, महत्त्वाची मर्मस्थळे, संवेदनशील व प्रतिबंधित क्षेत्रांच्या ठिकाणी ड्रोन उाणास "नो ड्रोन लाय झोन" ( ) घोषित करण्यात आलेले असतानाही वर नमूद केल्याप्रमाणे संवेदनशील ठिकाणी बेकायदेशीपणे तसेच वर संदर्भ क्रमांक ६ मध्ये नमूद केलेल्या आदेशाचा भंग करून बेकायदेशीरपणे ड्रोन उडविल्यामुळे महत्त्वाच्या लष्करी आस्थापना/ मर्मस्थळे यांच्या सुरक्षिततेचा प्रश्न निर्माण झाला आहे. सदरच्या घडलेल्या घटना अतिशय गंभीर असून अशा घटनांपासून भविष्यात गंभीर गुन्हा घडण्याची शक्यता नाकारता येत नाही. तसेच सदरच्या बेकायदेशीर कृत्यांमुळे राष्ट्रीय सुरक्षा, सार्वजनिक सुरक्षितता, संभाव्य घातपातील कृत्य अथवा तशा कृत्यांची पूर्वतयारी कट-कारस्थानाचा प्रश्न उदभवला आहे. उपरोक्त बेकायदेशीर उाणामुळे भविष्यात कोणत्याही प्रकारचे घातपाती कृत्ये / गुन्हे घडू नये याकरिता त्वरित प्रतिबंधात्मक उपाययोजना करणे आवश्यक आहे.

(४) त्याअर्थी, मी, जयंत नाईकनवरे, पोलीस आयुक्त, नाशिक शहर, महाराष्ट्र पोलीस अधिनियम, १९५१ चे कलम ३७ (१) (सी) अन्वये मला प्राप्त झालेल्या अधिकाराचा वापर करून, नाशिक पोलीस आयुक्तालय कार्यक्षेत्राकरिता राष्ट्रीय सुरक्षा, सार्वजनिक सुरक्षितता, महत्त्वाची मर्मस्थळे, लष्करी आस्थापने, संवेदनशील ठिकाणे, प्रतिबंधित क्षेत्र इत्यादींना धोका निर्माण झाल्याने, खालीलप्रमाणे आदेश पारीत करीत आहे.

४. (१) नाशिक पोलीस आयुक्तालय कार्यक्षेत्रातील ड्रोन मालक, चालक / ऑपरेटर यांनी ते नाशिक पोलीस आयुक्तालयातील ज्या पोलीस स्टेशन हद्दीत रहावयास आहेत अथवा व्यवसाय करतात त्या पोलीस स्टेशनला आपले ड्रोन तत्काळ जमा करावेत.

४. (२) नाशिक ड्रोन मालक, चालक, ऑपरेटर यांना कोणत्याही कार्यक्रमाकरिता त्यांच्या ड्रोनद्वारे ायाचित्रीकरण करावयाचे असल्यास, त्यांनी ड्रोन वापरण्याची पोलीस आयुक्त कार्यालयाकडून प्रथम परवानगी घ्यावी. सदर परवानगी संबंधित पोलीस स्टेशनला दाखवून जमा केलेला आपला ड्रोन घ्यावा व सशुल्क पोलीस कर्मचायाच्या देखरेखीखाली कार्यक्रमाचे चित्रीकरण करावे. ायाचित्रीकरण संपल्या- नंतर आपला ड्रोन पुन्हा संबंधित पोलीस स्टेशनला जमा करावा.

महाराष्ट्र नागरी सेवा (वेतन) नियम, १९८१ चा नियम ३९ खालील टीप-२ अन्वये प्रमाणित करण्यात येते की, श्री. दिपक लक्ष्मणराव भागवत, जिल्हा न्यायाधीश-७ व अतिरिक्त सत्र न्यायाधीश, धुळे हे वर नमूद केलेल्या कालावधीत अर्जित रजेवर गेले नसते, तर ते जिल्हा न्यायाधीश-७ व अतिरिक्त सत्र न्यायाधीश, धुळे यापदी स्थानापन्न म्हणून काम करीत राहिले असते.

क्रमांक बी-१/४३१८/सन २०२२.---- श्रीमती यास्मीन गुलामगौस देशमुख, जिल्हा न्यायाधीश-३ व अतिरिक्त सत्र न्यायाधीश, धुळे यांना दिनांक २ ऑगस्ट २०२२ ते दिनांक ४ ऑगस्ट २०२२ पावेतो अशा एकूण ३ दिवसांच्या उपभोगलेल्या परिवर्तित रजेस याद्वारे कार्योत्तर मंजुरी देण्यात येत आहे.

क्रमांक बी-२/४३०६/सन २०२२.---- श्री. निखील अजितकुमार गुप्ता, सहदिवाणी न्यायाधीश, वरिष्ठ स्तर, धुळे यांना दिनांक २६ जुलै २०२२ या एक दिवसासाठी भोगलेल्या दोन दिवसांच्या अर्धवेतनी रजेस याद्वारे कार्योत्तर मंजुरी देण्यात येत आहे.

रजेवरून परत आल्यावर श्री. निखील अजितकुमार गुप्ता यांना सहदिवाणी न्यायाधीश, वरिष्ठ स्तर, धुळे यापदी पुनर्नियुक्त करणेत येत आहे. तसेच श्री. निखील अजितकुमार गुप्ता यांचे वरीलप्रमाणे अर्धवेतनी रजेच्या कालावधीत सहदिवाणी न्यायाधीश, वरिष्ठ स्तर, धुळे यापदी पर्यायी इसमाच्या नेमणुकीची आवश्यकता नसल्याने सदरचे पद रिक्त ठेवण्यात आलेले होते.

श्री. निखील अजितकुमार गुप्ता, सहदिवाणी न्यायाधीश, वरिष्ठ स्तर, धुळे यांचे उपरोक्त अनुपस्थितीचे कालावधीत त्यांचे पदाचा अतिरिक्त कार्यभार श्री. अय्युब बाबु शेख, २ रे सहदिवाणी न्यायाधीश, वरिष्ठ स्तर, धुळे यांचेकडेस सोपविण्यात आलेला होता.

महाराष्ट्र नागरी सेवा (वेतन) नियम, १९८१ चा नियम ३९ खालील टीप-२ अन्वये प्रमाणित करण्यात येते की, श्री. निखील अजितकुमार गुप्ता, सहदिवाणी न्यायाधीश, वरिष्ठ स्तर, धुळे हे वर नमूद केलेल्या कालावधीत अर्धवेतनी रजेवर गेले नसते, तर रजेवरून परत आल्यावर श्रीमती यास्मीन गुलामगौस देशमुख यांना जिल्हा न्यायाधीश-३ व अतिरिक्त सत्र न्यायाधीश, धुळे यापदी पुनर्नियुक्त करणेत येत आहे. तसेच श्रीमती यास्मीन गुलामगौस देशमुख यांचे वरीलप्रमाणे परिवर्तित रजेच्या कालावधीत जिल्हा न्यायाधीश-३ व अतिरिक्त सत्र न्यायाधीश, धुळे यापदी पर्यायी इसमाच्या नेमणुकीची आवश्यकता नसल्याने सदरचे पद रिक्त ठेवण्यात आलेले होते.

श्रीमती यास्मीन गुलामगौस देशमुख, जिल्हा न्यायाधीश-३ व अतिरिक्त सत्र न्यायाधीश, धुळे यांचे उपरोक्त अनुपस्थितीचे कालावधीत त्यांचे पदाचा अतिरिक्त कार्यभार श्री. मोहन गुलाबराव चव्हाण, जिल्हा न्यायाधीश-६ व अतिरिक्त सत्र न्यायाधीश, धुळे यांचेकडेस सोपविण्यात आलेला होता.

श्रीमती यास्मीन गुलामगौस देशमुख, जिल्हा न्यायाधीश-३ व अतिरिक्त सत्र न्यायाधीश, धुळे यांनी रजेवरून परत आल्यावर ते कामावर रूजू होण्यास पात्र असल्याबद्दलचे वैकीय अधिकायांचे स्वास्थ्य प्रमाणपत्र सादर केलेले आहे.
