टीपीबी/४३१७/६२९/सीआर-११८/२०१७/डीपी/युडी-११, दिनांक ८ मे २०१८ अन्वये महाराष्ट्र शासन राजपत्र, भाग १- कोकण विभागीय पुरवणी, गुरुवार ते बुधवार मे १७-२३, २०१८ मध्ये प्रसिद्ध करण्यात आली असून त्याअन्वये महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ च्या कलम ३१ पोट नियम (१) अन्वये (यापुढे "उक्त महाराष्ट्र अधिनियम" म्हणून संबोधिलेला) मंजूर के ली असून अधिसूचनेच्या दिनांकापासून अंमलात आलेली आहे ;

ज्याअर्थी, सोबतच्या अनुसूची एक मध्ये नमूद के लेली जमीन (यापुढे "उक्त जमीन" म्हणून संबोधिलेली) उक्त विकास योजना २०३४ मधील नियम ५५ मध्ये "मेट्रो/मोनो कोस्टल रोड एलिवेटेड कॉरीडोरमध्ये येणारे कोणतेही संरेखन बदल व सुधारित योजनेनुसार स्वयंचलनाने विकास आराख(cid:५०५)ात सुधारित के ल्या जातील" अशी तरतूद असल्याने "मु ंबई मेट्रो टप्पा-६ (स्वामी समर्थनगर-जोगेश्वरी-विक्रोळी) या जोगेश्वरी स्थानकाच्या एन्ट्री-एक्झीटच्या बांधकामासाठी" या सार्वजनिक प्रयोजनासाठी बाधित होत आहे त. (यापुढे "उक्त सार्वजनिक प्रयोजन" म्हणून संबोधिलेली) ;

ज्याअर्थी, उक्त महाराष्ट्र अधिनियमाच्या कलम ३१ चे पोट-कलम (१) अन्वये शासनाने बृहन्मु ंबईचे प्रारुप विकास योजनांना (यापुढे उक्त विकास योजना २०३४ म्हणून संबोधलेले आहे) शासन अधिसूचना क्र.४३१७/६२९/प्र.क्र.११८/२०१७/वि.नि./न.वि.११, दिनांक ८ मे २०१८ अन्वये सदर अधिसूचनेसोबत परिशिष्ट 'ब' मध्ये नमूद के लेले मंजुरीतून वगळलेले साराभूत स्वरुपाचे फे रबदल (ई.पी.) वगळून अधिसूचनेसोबत परिशिष्ट 'अ' मध्ये दर्शविलेल्या सुधारणेसह मंजुरी दिली आहे ;

ज्याअर्थी, मु ंबई महानगर विकास प्राधिकरण यांनी ( यापुढे उक्त संपादन संस्था म्हणून संबोधिलेले) उक्त महाराष्ट्र अधिनियमाच्या कलम १२६ (१) अन्वये उक्त जमीन उक्त सार्वजनिक प्रस्तावासाठी संपादन करण्याबाबत समुचित शासनाकडे अर्ज के ला आहे ;

ज्याअर्थी, महाराष्ट्र शासनाच्या नगरविकास व सार्वजनिक आरोग्य विभागाच्या उक्त महाराष्ट्र अधिनियमाच्या कलम १५१ पोट-कलम (१) खाली काढलेल्या शासन निर्णय क्र.टिपीबी २१७५-५१०६/युडी-७, दि. ३ मार्च १९७९ अन्वये मंजूर विकास योजनेत सार्वजनिक प्रयोजनासाठी निर्दिष्टीत करण्यात आलेल्या जमिनीबाबतच्या उक्त महाराष्ट्र अधिनियमाच्या कलम १२६ पोट-कलम (१) (२) व (४) खालील भूमिसंपादनाबाबत वापरावयाच्या शासनाच्या शक्ती जिल्हाधिकारी, मु ंबई उपनगर जिल्हा यांना प्रदान करण्यात आलेल्या आहेत ;

ज्याअर्थी, उक्त जमिनीच्या संपादनापोटी द्यावयाच्या नुकसानभरपाईची रक्कम संपूर्णपणे उक्त संपादन संस्था यांनी अदा करावयाची आहे ;

ज्याअर्थी, शासनाच्या नगरविकास विभागाकडील महाराष्ट्र प्रादेशिक व नगररचना (दुसरी दुरुस्ती) अध्यादेश, २०१५ शासन राजपत्र, दि. २९ ऑगस्ट २०१५ मध्ये नमूद नुसार प्रादेशिक आराखडा, विकास आराखडा किंवा नगररचना योजनेत सार्वजनिक प्रयोजनासाठी आवश्यक, आरक्षित अथवा निश्चित के लेल्या जमिनीसाठी भूमिसंपादन, पुनर्वसन व पुनस्र्थापना करताना वाजवी भरपाई मिळण्याचा व भाग एक (को.वि.पु.)---४६-१

पारदर्शकतेचा हक्क अधिनियम, २०१३ (यापुढे "उक्त संपादन अधिनियम, २०१३" म्हणून संबोधिलेला) मधील कलम ४ ते १५ मधील नमूद कार्यपद्धती लागू ठरणार नाही ;

ज्याअर्थी, उक्त जमिनी उक्त सार्वजनिक प्रस्तावासाठी आवश्यक असल्याबाबतची उप जिल्हाधिकारी, (भूसंपादन) क्र. ४, मु ंबई उपनगर जिल्हा यांची खात्री झाली आहे ;

त्याअर्थी, शासनाने प्रदान के लेल्या शक्तीनुसार आणि उक्त महाराष्ट्र अधिनियमाच्या कलम १२६ च्या पोट-कलम (२) व (४) सह उक्त संपादन अधिनियम, २०१३ च्या कलम १९ च्या पोट-कलम (१) अन्वये उप जिल्हाधिकारी (भूसंपादन) क्र. ४, मु ंबई उपनगर जिल्हा असे घोषित करतात की, उक्त जमिनी उक्त सार्वजनिक प्रयोजनासाठी आवश्यक आहेत आणि उक्त संपादन अधिनियम, २०१३ च्या कलम ३ खंड (छ) अन्वये समुचित शासन असलेले जिल्हाधिकारी, मु ंबई उपनगर जिल्हा उक्त अधिनियमान्वये जिल्हाधिकाऱ्यांची कार्ये पार पाडण्यासाठी उप जिल्हाधिकारी (भूसंपादन) क्र. ४, मु ंबई उपनगर जिल्हा, ९ वा मजला, प्रशासकीय इमारत, शासकीय वसाहत, वांद्रे (पू), मु ंबई ४०० ०५१ यांना पदनिर्देशित करीत आहे.

NOTIFICATION

No.DCLA-4/L.A./M.S.D./LAQ/SR/281/2023.— Whereas, Urban Development Plan 2034 of Greater Mumbai Municipal Corporation (hereinafter referred to as "the said Development Plan 2034") of Urban Development Department of Government of Maharashtra under, Notification No. "T.P.B./4317/629/CR-118/2017/DP/UD-11, dated 8th May 2018 has been published in Maharashtra Government Gazette, Part One-Kokan Divisional Supplement, dated Thursday to Wednesday, May 17-23, 2018 sanctioned under sub-section (1) of section 31 of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Maharashtra Act") and come into force with effect from date of notification ;

Whereas, the land specified in the schedule 1 appended hereto (hereinafter referred to as "Said Lands") Rule No. 55 of the Development Plan 2034, "Any alignment modifications introduced in Metro/Mono/Coastal Road/Elevated Corridors/ Corridors of Mass Rapid Transport System, including BRTS, by the Appropriate Authority and sanction by Government shall stand automatically amended on the Development Plan as modified." are affected by the site reserved for the purpose of " for the Construction of Entry-Exit of Jogeshwari Station of Mumbai Metro Phase-6 (Swami Samarth Nagar-Jogeshwari-Vikhroli)" (hereinafter referred to as "the said Public Purpose") in the said Revised Development Plan ;

Whereas, Government in Urban Development department under Notification No.TPB/4317/629/CR-118/2017/DP/UD-11, dated 8th May 2018 issued under sub-section (1) of section 31 of the said Maharashtra Act has accorded sanction to Draft Development Plan 2034 (hereinafter referred as Development Plan 2034) with modifications shown in schedule 'A' appended notification excluding the substantial modification as shown in schedule 'B' appended to the notification ;

Whereas, Metropolitan Commissioner, Mumbai Metropolitan Region Development Authority (hereinafter referred to as "the said MMRDA") the (hereinafter referred to as "the said Acquiring Body") has made an application to the Appropriate Government/Collector, Mumbai Suburban District under sub-section (1) of section 126 of the said Maharashtra Act for acquiring the said land for the said Public purpose ;

Whereas, under Government Resolution, Urban Development and Public Health Department No.TPS/2175-5106/UD-7, dated 3rd March 1979 issued under sub-section (1) of section 151 of the said Maharashtra Act, the powers exercisable by the State Government in respect of sub-sections (1), (2) & (4) of section 126 of the said Maharashtra Act relating to the acquisition of the land for public purpose specified in the sanctioned Development Plan, have been delegated to the Collector, Mumbai Suburban District ;

Whereas, the compensation is to be awarded against the acquisition of the said land is to be paid wholly by the said Acquiring Body ;

Whereas, the Government in Urban Development Department under, Maharashtra Regional & Town Planning (Second Amendment) ordinance, 2015, Published Government Gazzatte, dated 29th August 2015 mentioned that the procedure specified in sections 4 to 15 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (hereinafter referred to as the "said Acquisition Act 2013") shall not be applicable in respect of any land required, reserved or designated in a Regional Plan, Development Plan or Town Planning Scheme for public purpose ;

And whereas, the Dy. Collector (Land Acquisition) No. 4, Mumbai Suburban District, is satisfied that the said land is needed for the said Public Purpose.

Therefore, in exercise of the delegated powers and under sub-sections (2) and (4) of section 126 of the said Maharashtra Act read with sub-section (1) of section 19 of the said land Acquisition Act, 2013 the Dy. Collector (Land Acquisition) No. 4, Mumbai Suburban District४ महाराष्ट्र शासन राजपत्र, असाधारण, भाग एक---कोकण विभागीय पुरवणी, मे ९, २०२३/वैशाख १९, शके १९४५ hereby declares that the said land is needed for the said public purpose and under clause (g) of section 3 of the said Acquisition Act 2013, the Collector, Mumbai Suburban District being the appropriate Government is pleased to designate Dy. Collector (Land Acquisition) No. 4, Mumbai Suburban District, 9th Floor, Administrative Bldg, Govt. Colony, Bandra (E), Mumbai 400 051 to perform the functions of a Collector under the said Act.
