क्रमांक ठामपा/शलवलव/क्िस्टरसेि/अलिसूचना/८०.— ज्याअर्थी, ठाणे शहराची सुिारीत लवकास ्योजना शासनाने महाराष्ट्र प्ादेलशक लन्योजन व नगररचना अलिलन्यम, १९६६ चे किम ३१(१) नुसार (्यापुढे ्याचा उल्िेख "उक्त अलिलन्यम" असा केिा आहे.) शासन लनण्ण्य क्र.ल्टपीएस-१२९७/१३१९/सीआर-१४८/९७/नलव- १२, लदनांक ४ ऑक्टोबर, १९९९ अन्व्ये मंजूर केिी असून, ती लदनांक २२ नोव्हेंबर १९९९ पासून अंमिात आहे. तसेच सुिारीत लवकास ्योजनेतीि वगळिेल्या क्ेत्ाची (Excluded portion) लवकास ्योजना शासन लनण्ण्य क्र. ल्टपीएस-१२०१/२७४/सीआर-२८/२००१/नलव-१२, लदनांक ३ एलप्ि, २००३ अन्व्ये शासनाने उक्त अलिलन्यमानुसार मंजूर केिी असून ती लदनांक १४ मे, २००३ पासून अंमिात आहे (्यापूढे "उक्त मंजूर लवकास ्योजना" असा उल्िेख केिा आहे.) ;

आलण ज्याअर्थी, ठाणे महानगरपालिका प्ारूप लवकास लन्यंत्ण लन्यमाविीत काही बदि करून शासनाने लनण्ण्य क्र.ल्टपीएस १२९४/१२५९/सीआर-२२२/९४/नलव- १२, लद. २८ एलप्ि १९९५ अन्व्ये उक्त अलिलन्यमाचे किम ३१(१) अन्व्ये लवकास लन्यंत्ण लन्यमाविी मंजूर केिी होती व सदर लन्यमाविी लदनांक १ जून १९९५ पासून अंमिात आिी होती ;

आलण ज्याअर्थी, तत्कािीन मंजूर लवकास लन्यंत्ण लन्यमाविीतीि तरतुदीनुसार ठाणे महानगरपालिका हद्ीमध्ये ४४ नागरी पुनरुत्र्ान आराखडे (्यु. आर. पी.) अलिसूलचत करून लदनांक ५ मे २०१८ रोजीच्या शासन राजपत्रामध्ये प्लसद्ध करण्यात आिे आहेत ;

आलण ज्याअर्थी, शासन लनण्ण्य क्र. ल्टपीएस १८१८/प्.क्र. २३६/१८/किम ३७ (१कक) (ग) व किम २०(४)/ नलव-१३, लदनांक २ लडसेंबर २०२० अन्व्ये शासनाने एकलत्कृत लवकास लन्यंत्ण व प्ोत्साहनपर लन्यमाविी, मंजूर केिी आहे आलण उक्त लवकास लन्यंत्ण लन्यमाविी लदनांक ३ लडसेंबर २०२० पासून अंमिात आिी असून सदर लन्यमाविी ठाणे महानगरपालिकेस िागू आहे. (्यापुढे "उक्त लन्यमाविी" असा उल्िेख केिा आहे);

भाग दोन-५१–१

(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, मे २५, २०२३/ज्येष्ट्ठ ४, शके १९४५ आलण ज्याअर्थी, ्योजनेच्या ्योग्य व सुलन्योलजतररत्या अंमिबजावणीकररता ्यु. आर. पी. क्र. १२ लकसननगरच्या अलिसूलचत हद्ीस संिग्न असिेिे क्ेत् उक्त लन्यमाविीतीि लवलन्यम क्र. १४.८.१ (ii)(b) मिीि तरतुदीनुसार ्यु. आर. पी. क्र. १२ च्या अलिसूलचत हद्ीमध्ये नव्याने समालवष्ट्ट करणे तसेच हद्ीपासून ४०० मी. अंतरात ्येत असिेिे महानगरपालिका / साव्णजलनक प्ालिकरण जसे महाराष्ट्र ंबई महानगरपालिका, कृषी लवभाग, कौशल्य लवकास लवभाग ्यांच्या मािकीचे भुखंड लन्यमाविीतीि औद्ोलगक लवकास महामंडळ, बृहन्मु लवलन्यम क्र. १४.८.१ (i) मिीि तरतुदीनुसार उच्चालिकार सलमतीशी सल्िामसित करून ्यु.आर.पी. क्र. १२ लकसननगरच्या ्यापूवथीच्या अलिसूलचत हद्ीमध्ये नव्याने समालवष्ट्ट करण्याचे प्स्तालवत आहे (्यापुढे "प्स्तावालिन क्ेत्" असा उल्िेख केिा आहे) ;

आलण ज्याअर्थी, उक्त लन्यमाविीतीि लवलन्यम क्र. १४.८.१.(i) च्या तरतुदीनुसार नागरी पुनरुत्र्ान ्योजनेच्या हद्ीपासन ४०० मी. अंतरात ्येत असिेल्या महानगरपालिका/साव्णजलनक प्ालिकरण इत्यादींच्या जागा ्योजना क्ेत्ात संिग्न नसल्या तरी अशा जागा ्णत करण्यास उच्चालिकार सलमतीशी सल्िामसित करून, नागरी पुनरुत्र्ान ्योजनेच्या हद्ी महापालिका आ्युक्त ्योजना क्ेत्ामध्ये अंतभू लनश्चचत करू शकतात ;

आलण ज्याअर्थी, वर नमूद केल्याप्माणे प्स्तावािीन क्ेत्, ज्याचे अंदालजत क्ेत् १९.०७ हेक्टर आहे. ते ्यु.आर.पी.क्र.१२ लकसननगरच्या ्यापूवथीच्या अलिसूलचत हद्ीत नव्याने समालवष्ट्ट करणेबाबतचा प्स्ताव सल्िामसितीकररता उच्चालिकार सलमतीच्या बैठकीत लदनांक १७ मे २०२३ रोजी ठेवण्यात आिा. उक्त बैठकीमध्ये सदरहू क्ेत् नागरी पुनरुत्र्ान आराखडा क्र.१२ लकसननगरच्या ्यापूवथीच्या अलिसूलचत हद्ीमध्ये समालवष्ट्ट करण्यास उच्चालिकार सलमतीने लशफारस केिी आहे.

आलण, त्याअर्थी, उक्त लन्यमाविीतीि लवलन्यम क्र. १४.८.१ (ii) (b) अन्व्ये मिा प्दान केिेल्या अलिकारान्व्ये, ठाणे शहराच्या ्णत करून सुिारीत हद्ीचा हद्ीतीि ्यु. आर. पी. क्र. १२ लकसननगरच्या ्यापूवथीच्या अलिसूलचत हद्ीमध्ये प्स्तावालिन क्ेत् नव्याने अंतभू आराखडा ्यु. आर. पी. क्र. १२ लकसननगर (सुिारीत क्ेत् अंदाजे १५९.८८ हेक्टर) म्हणून अलिसूलचत करीत आहे.

सदर अलिसूलचत आराखड्ाची सुिारीत हद् दश्णलवणारा नकाशा जनतेच्या अविोकनार्ण खािीि लठकाणी, पुढीि तीस लदवसांकररता ठेवण्यात ्येत आहे :—

(१) उप संचािक, नगररचना, क्िस्टरसेि, ्यांचे का्या्णि्य, माजीवाडा, ठाणे.

(२) शहर लवकास लवभाग, चौर्ा मजिा, ठाणे महानगरपालिका, ठाणे.

(३) वागळे प्भाग सलमती का्या्णि्य.

NOTIFICATION

Maharashtra regional and town Planning act, 1966.

No. TMC/TDO/Cluster Cell/Notification/80.—Whereas, the Revised Development Plan of the Thane City has been sanctioned by the Government under section 31(1) of the Maharashtra Regional and Town Planning Act 1966, (hereinafter referred to as "the said Act") vide Notification No.TPS-1297/1319/CR-148/97/UD-12, dated 4th October 1999, which has come into force with effect from 22nd November 1999, and the Excluded Part (EP) of the said Development Plan has been sanctioned under the said Act vide Government Notification No. TPS/1201/274/CR-28/2001/UD-12, dated 3rd April 2003 which has come into force with effect from the 14th May 2003; (hereinafter referred to as "the said sanctioned Development Plan") ;

And whereas, the Development Control Regulations of Thane Municipal Corporation has been sanctioned by the Government after making some modifications in draft Development Control Regulations of Thane City vide Urban Development Department, vide Notification No. TPS 1294/1259/ CR-222/94/UD-12, date 28th April 1995 under section 31(1) of the said act which had come into force with effect from the 1st June 1995 ;

And whereas, in pursuant to the provisions of erstwhile sanctioned Development Control Regulations, 44 Urban Renewal Plans (hereinafter referred to as "URP") are notified in Government Gazette dated 5th May 2018 within the limits of Thane Municipal Corporation ;

And whereas, the Government has sanctioned Unified Development Control and Promotion Regulations vide resolution no.TPS-1818/CR236/18/DP&RP/sec.37 (1AA) (c) & sec. 20(4)/UD-13, dated 2nd December 2020 (hereinafter referred to as "the said Regulations") and the said Regulation are in force from dated 3rd December 2020 and are applicable to Thane Municipal Corporation ;

And whereas, for smooth implementation of the URP, areas adjacent to the notified boundary of URP No.12 are proposed to be included in the notified boundary of URP No.12 as per regulation no.14.8.1 (ii)(b) of the said Regulations and areas belonging to Municipal Corporation /any Public Authority, such as Maharashtra Industrial Development Corporation, Municipal Corporation of Greater Mumbai, Agriculture Department, Skill Development Department, situated in the periphery of 400.0 mt., which are not contiguous to the notified boundary of URP No.12, are proposed to be included in the notified boundary of URP No.12 after consultation with High Power Committee (H.P.C.) as per regulation no.14.8.1(i) of the said Regulations (hereinafter referred as "the area under proposal") ;

And whereas, as mentioned in the Regulation No. 14.8.1(i) of the said Regulations, that areas of any vacant or encroached land situated in the periphery of 400.0 mt. belonging to Municipal Corporation/any Public Authority/ Planning Authority Special Planning Authority, which is not contiguous, is proposed to be included in URS, then the boundaries of such cluster having non- contiguous area can be decided/ finalized by Municipal Commissioner, in consultation with High Power Committee (H.P.C.) ;

And whereas, the said area under proposal admeasuring approx.19.07 Hect.. to be included in the earlier notified boundary of URP No.12 Kisan Nagar is kept before High Power Committee meeting on 17th May 2023 and High Power Committee has recommended to include the said area in the earlier notified boundary of URP No.12 Kisan Nagar.

Now therefore, as per powers conferred to me vide Regulation no.14.8.1 (ii)(b) of the said Regulations, the notified boundaries of URP No.12 Kisan Nagar are changed and revised boundary of URP No.12 Kisan Nagar (Revised area approx. 159.88 Hect.) is hereby notified.
