आदिण ज्याअर्थी, दिक्रदिमंनांल अपील क्र. ४९१/२०२३ मंध्ये मंा. उच्चा न्यायालय, मंु ंबई यांनांी दिदानांांका १५ दिडसंबर २०२३ च्या आदाेशान्वाये, अपीलकात्यागनांे अदिभालेखावार संादार काेलेल्या हुमंच्या संदाभागता संक्षमं प्रादिधीकाऱ्यानांे आदाेशाच्या दिदानांांकापीासंूनां चार आठेवाड्याच्या आता, प्रेमं भानांू अपीाटेटमंटे, आयसंी काॉलनांी, बोरीवाली (पीश्चिचामं) या इमंारताीमंधील दाुकानां क्र. १ आदिण २, दिदानांांका २९ मंाचाग २०१६ च्या अदिधीसंूचानांेमंधीूनां वागळण्यासंाठेी पीावाले उचालण्याबाबता आदाेशीता काेले आहुे. तासंेचा संदार दिदानांांका २९ मंाचाग, २०१६ च्या अदिधीसंूचानांेमंधीूनां संरदिक्षता काेलेली संदार दाुकानांे मंुक्ता कारण्याबाबता आदाेश दिदाले आहुेता.

त्यामंुळे आता, मंहुाराष्ट्र ठेवाीदारांच्या (दिवात्तीय संस्र्थीांमंधील) दिहुतासंबंधीाचाे संरक्षण अदिधीदिनांयमं, १९९९ (मंहुा. २००० चा १६) च्या कालमं ४ चाे उपी-कालमं (१), कालमं ५ आदिण ८ अन्वाये प्रदानां काेलेले अदिधीकार यांचा वापीर कारूनां आदिण शासंकाीय अदिधीसंूचानांा, गृहु दिवाभाग क्र. एमंपीआय २०१४/प्र.क्र.५२१-अ/पीोल-११, दिदानांांका २९ मंाचाग २०१६, मंध्ये अंशता: फेरबदाल कारुनां, मंहुाराष्ट्र शासंनां, याद्वारे यासंोबता जोडलेल्या अनांुसंूचाीमंध्ये दिवादिनांदिदागष्टे काेलेल्या खालील मंालमंत्तीांनांा या अनांुसंूचाीच्या स्तांभा (४) प्रमंाणे मंुक्ता कारीता आहुे :–

Maharashtra Protection of interest of DePositors (in financial establishMents) act, 1999.

No. MPI-2014/C.R.521-A/Pol-11.– Whereas, the Government of Maharashtra has, vide Government Notification, Home Department, No. MPI 2014/C.R.521-A/Pol 11, dated the 29th March 2016 (hereinafter referred to as "the said notification"), issued in exercise of the powers conferred by sub-section (1) of section 4, sections 5 and 8 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), attached the properties of M/s. Technology Connection and Techcons Shelterettes Ltd. specified in the Schedule appended thereto ;

And whereas, the High Court of Judicature at Bombay in Criminal Appeal No. 491 of 2003, had vide Order dated the 15th December 2023, directed that in terms of the undertaking presented by the appellant on record, the Competent Authority to take steps within a period of four weeks from today to comply with the statement made by them, for deleting the Shops No. 1 and 2 in the building known as Prem Bhanu Apartment, IC Colony, Borivali (West) from the notification dated 29th March 2016 and release the said shops from the attachment made under the notification dated 29th March 2016 ;

(A) Properties situated at Borivali (West), Tal. Andheri, Dist. Mumbai.

And whereas, in view of the orders of the High Court of Judicature at Bombay, the Government considers it expedient to release the properties attached by the said notification ;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 4, sections 5 and 8 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000) and in partial modification of the Government Notification, Home Department, No. MPI 2014/C.R.521-A/Pol 11, dated the 29th March 2016, the Government of Maharashtra, hereby releases the properties specified in the Schedule appended hereto to the extent of location mentioned in column (4) of the said Schedule, as follows, namely :-
