NOTICE

The Maharashtra Regional & Town Planning Act, 1966

No.TPS-2922/812/CR-108/2022/EP Publish/UD-30:- Whereas, the Government vide Urban Development Department's Notification No.TPS-2908/162/CR-75/2008/ UD-30, dated the 18.06.2008 under section 40(1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Maharashtra Act XXXVII of 1966) (hereinafter referred to as "the said Act"), had appointed City and Industrial Development Corporation (hereinafter referred to as "CIDCO") as a Special Planning Authority for the part portion of Mauje Daregaon and Mauje Nagewadi within the erstwhile Jalna Municipal Council (hereinafter referred to as "the said Area"), and as per the provisions of section 160 of the said Act, the Government also dissolved the status of CIDCO as the Special Planning Authority for the said Area and declared the erstwhile Jalna Municipal Council as a Planning Authority for the said Area vide Urban Development Department's Notification No. TPS- 2916/227/CR-250/2016/UD-30, dated the 11.04.2017;

And whereas, the Government vide Urban Development Department's Notification No.JMC-2022/CR-331(2)/UD-17, dated the 07.08.2023, has converted the erstwhile Jalna Municipal Council to the Jalna Municipal Corporation;

And whereas, the said Planning Authority has by its Resolution No.14, dated the 03.10.2017 made a declaration under section 23(1) read with section 38 of the said Act, declared its intention to prepare the development Plan (hereinafter referred to as "the said Draft Development Plan") for the said Area and notice such declaration was published at Page No.1 in the Official Gazette, Part-1A, Chhatrapati Sambhajinagar Division Supplement dated the 11- 17.01.2018; And whereas, the said Planning Authority after carrying out surveys of the said Area as required under Section 25 of the said Act, decided to publish a Draft Development Plan under section 26(1) of the said Act, vide its Resolution No.01, dated the 19.08.2020 and notice to that effect is published at Page No.59 to 60 in the Official Gazette, Chhatrapati Sambhajinagar Divisional Supplement dated the 20-26.07.2020 for inviting suggestions and/or objections;

And whereas, after considering the suggestions and objections to the said Draft Development Plan received within stipulated period, the Planning Committee appointed under section 28/2) of the said Act, has submitted its report to the said Planning Authority;

And whereas, in accordance with sub-section (1) of Section 31 of the said Act, vide Notification No. TPS-2922/ 812/CR-108/2022/DP Part Sanction/UD-30, dated the 07.11.2023, the State Government has sanctioned a part of the Draft Development Plan of the said Area within the Jalna Municipal Corporation, excluding the substantial modifica- tions (as EP-1 to EP-16) as specified in SCHEDULE appended with the Notice bearing No.TPS-2922/812/CR- 108/2022/EP Publish/UD-30, dated the 07.11.2023;

And whereas, the substantial modifications proposed by the Government are excluded from the said Draft Development Plan and shown on the plan, marked as excluded part i.e.EP-1 to EP-16;

Now, therefore, in exercise of the powers conferred under Section 31(1) of the said Act and all other powers enabling it on that behalf, the Government of Maharashtra hereby :-

A) Gives notice inviting suggestions and objections from any person in respect of the proposed substantial modifications as specified in the SCHEDULE appended hereto, within the period of 30 days from the date of publication of this notice in the Official Gazette.

B) Appoints the Divisional Joint Director of Town Plan- ning, Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar as the "Officer" under section 31(2) of the said Act, to hear all suggestions and/or objections as stated in (A) above and to submit his report thereupon to the Government for further necessary action.

02. Only the suggestions and /or objections regarding substantial modifications mentioned 'in SCHEDULE, that may be received by the Divisional Joint Director of Town Planning, Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar, having his office at M.B.C Tower, Second Floor. Near Baba petrol pump Adalat Road Chhatrapati Sambhajinagar 431001 within the stipulated period of 30 days from the date of publication of this notice in the Official Gazette, shall be considered.

03. Copy of the said notice along with SCHEDULE and the plan showing the proposed substantial modifications shall be made available for inspection to general public at the following offices during office hours on all working days.

1) The Divisional Joint Director of Town Planning, Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar.

2) The Assistant Director of Town Planning, Jalna Branch, Jalna.

NOTIFICATION

And whereas, after considering the suggestions and objections to the said Draft Development Plan received within The Maharashtra Regional & Town Planning Act, 1966 stipulated period, the Planning Committee appointed under No.TPS-2922/812/CR-108/2022/DP Part Sanction/ UD-30:- Whereas, the Government vide Urban Development Department's Notification No.TPS-2908/162/CR-75/2008/ UD-30, dated the 18.06.2008 under section 40(1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Maharashtra Act XXXVII of 1966) (hereinafter referred to as "the said Act"), had appointed City and Industrial Development Corporation (hereinafter referred to as "CIDCO") as a Special Planning Authority for the part portion of Mauje Daregaon and Mauje Nagewadi within the erstwhile Jalna Municipal Council (hereinafter referred to as "the said Area"), and as per the provisions of section 160 of the said Act, the Government also dissolved the status of CIDCO as the Special Planning Authority for the said Area and declared the erstwhile Jalna Municipal Council as a Planning Authority for the said Area vide Urban Development Department's Notification No.TPS- section 28(2) of the said Act, has submitted its report to the said Planning Authority;

And whereas, after considering the Report of Planning Committee, the Planning, Authority vide its Resolution No.33, dated the 28.12.2020, had decided to make some modifications and to publish such modifications in the said Draft Development Plan (hereinafter referred to as "the said Modifications"), which were published at Page No.13 to 14 in the Official Gazette, Chhatrapati Sambhajinagar Divisional Supplement dated the 28.01.2021 to 03.02.2021 on under Section 28(4) of the said Act;

And whereas, in accordance with the provision of sub-section (1) of Section 30 of the said Act, the said Planning Authority has submitted the said Draft Development Plan, along with the said Modifications to the Government for sanction vide its Marathi letter No. /न्ह्यम्/२०२१/१५०, dated the 15.02.2021;

2916/227/CR-250/2016/UD-30, dated the 11.04.2017;

And whereas, the Government vide Urban Development Department's Notification No.JMC-2022/CR-331(2)/UD-17, dated the 07.08.2023, has converted the erstwhile Jalna Municipal Council to the Jalna Municipal Corporation;

And whereas, the said Planning Authority has by its Resolution No.14, dated the 03.10.2017 made a declaration under section 23(1) read with section 38 of the said Act, declared its intention to prepare the development Plan (herein- after referred to as "the said Draft Development Plan") for the said Area and notice such declaration was published at Page No.1 in the Official Gazette, Part-1A, Chhatrapati Sambhajinagar Division Supplement dated the 11-17.01.2018;

And whereas, in accordance with sub-section (1) of Section 31 of the said Act, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the State Government is of the opinion that the said Draft Development Plan should be sanctioned;

And whereas, in accordance with the amended provisions of section 31(1) of the said Act, the State Government is required to sanction the said Draft Development Plan within six months or within extended period as per provisions in this section from the date of receipt of the Draft Development Plan submitted by the said Planning Authority under section 31 of the said Act;

And whereas, in accordance with the amended provisions of section 148(A) of the said Act, vide the Maharashtra Regional and Town Planning (Amendment) Act, 2020 (Maharashtra Act No. XIX of 2020), in computing the period, in relation to any Development Plan, Regional Plan or Scheme under the provisions of Chapter II, III, IV and V of the said Act, the period or periods during which any action could not be completed under the said chapters, due to enforcement of any Guidelines or lockdown measures by the Government of India or the State Government, as the case may be, to prevent the spread of any pandemic or epidemic or disaster situation arising in the Country or State and the period of Code of Conduct for Loksabha and Vidhansabha Elections shall be excluded ;

Now therefore, in exercise of the powers conferred by section 31(1) of the said Act and of all other powers enabling it on that behalf, the Government of Maharashtra hereby :-

01. A) Accords Sanction the said Draft Development Plan of the said Area within Jalna Municipal Corporation, excluding the substantial Modifications (as EP-1 to EP-16) as specified in SCHEDULE appended to Notice No. TPS-2922/ 812/CR-108/2022/EP-Publish/UD-30, dated the 07.11.2023.

B) Extends the period prescribed under Section 31(1) of the said Act, for sanctioning the said Draft Development Plan up to and inclusive of dated the 07.11.2023.

C) The said Sanctioned Development Plan called the Final Development Plan of the said Area within Jalna Municipal Cor- poration shall come into force, after 30 days from the publi- cation of this Notification in the official Gazette.

4) The private or rental premises designated in Public- Semi-public Zone will continue to be in such zone as long as Public-Semi-public user exists. Otherwise, the Commissioner, Jalna Municipal Corporation, Jalna in consultation with the Divisional Joint Director of Town Planning, Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar shall allow development permission on such land considering adjoining predominant land use zone, after due verification.

After cessation of the existing public/semi-public use shown in the development plan on the privately owned land or if public/semi-public is shown in the development plan due to drafting error, the adjoining use in the development plan may be permitted on the said land with the prior permission of the Divisional Joint Director, Town Planning, Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar.

5) The Commissioner, Jalna Municipal Corporation, Jalna with the prior permission of the Director of Town Planning, Maharashtra State Pune may correct the drafting errors in respect of typographical errors in Survey No. / Gat No. / Final Plot No., errors in boundaries of land parcels, errors in showing alignment of existing High Tension Line, water bodies like river, Nalas etc. by taking into account the details as per actual position, of water bodies or as per the City Survey Records.

6) The Unified Development Control and Promotion Regulation sanctioned vide, Notification No. TPS-1818/CR-236/ 18/Section 37(1AA) (c) and Section 20(4)/UD-13, dated the the 02/12/2020, as amended from time to time, shall be applicable to the said Area of the Jalna Municipal Corporation, Jalna.

The aforesaid final Development Plan of the Jalna Municipal Corporation, Jalna partly sanctioned by the State Note :-

1) The reservations / allocations/designations which do not appear in the Schedule appended to Notice No.TPS-2922/ 812/CR-108/2022/EP-Publish/UD-30, dated the 07.11.2023, are hereby sanctioned for the respective purpose as designated in the Development Plan.

2) The existing roads whether shown or not on Development Plan shall remain existing as it exists on the actual site.

Government vide this Notification shall be kept open for inspection by the general public during office hours on all working days for a period on one month from the date of coming into force of this Development Plan, in the office of the Commissioner, Jalna Municipal Corporation, Jalna.

This Notification is available on the Government of Maharashtra website www.maharashtra.gov.in (Acts/Rules) By Order and in the name of the Governor of Maharashtra, 3) The areas of reserved sites as mentioned in Development Plan are approximate and tentative. The exact areas as measured on site as per the boundaries shown on the Development Plan shall be considered as the area of reserved site.
