क्रमांक टीपीएस-३५२३/१८६५/प्र.क्र. १८७/२०२३/नवि-९.--- ज्याअर्थी, जळगाव शहराची वाढीव हद्दीची विकास योजना महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (सन १९६६ चा महाराष्ट्र अधिनियम क्रमांक ३७) (यात यापुढे "उक्त अधिनियम" असे संबोधिले आहे) चे कलम ३१ चे उप-कलम (१) अन्वये शासनाच्या नगर विकास विभागाने निर्णय क्रमांक टीपीएस-३५९९/७३८/सीआर-१४२ (ए)/नवि-९, दिनांक ११ ेब्रुवारी २००२ अन्वये मंजूर केली असून ती दिनांक ७ एप्रिल २००२ पासून अंमलात आली आहे (यात यापुढे "उक्त विकास योजना" असे संबोधिले आहे)े ;

आणि ज्याअर्थी, उक्त विकास योजनेमध्ये सोबतच्या परिशिष्टामध्ये वर्णन केलेली मौजे असोदा, तालुका व जिल्हा जळगाव येथील गट क्रमांक ११९९ पै., १२१४ ते १२१६, १२१७ व १२१९ ह्या जागा (यात यापुढे "उक्त जागा" असे संबोधिले आहे) आरक्षण क्रमांक २२७, "ट्रक टर्मिनस" करिता (यात यापुढे "उक्त आरक्षण" असे संबोधिले आहे) आरक्षित असून उक्त आरक्षणाकरिता समुचित प्राधिकरण, जळगाव महानगरपालिका, जळगाव (यात यापुढे "उक्त प्राधिकरण" असे संबोधिले आहे) आहे ;

आणि ज्याअर्थी, उक्त प्राधिकरणाने उक्त जागा, उक्त विकास योजना अंमलात आल्याच्या दिनांकापासून दहा वषाच्या कालावधीमध्ये संपादन केली नाही ;

आणि ज्याअर्थी, उक्त जागेपैकी गट क्रमांक १२१४/१ (यात यापुढे "उक्त सूचनेंतर्गत जागा" असे संबोधिले आहे) च्या मालकाने उक्त अधिनियमाचे कलम १२७ चे उप-कलम (१) नुसार समुचित प्राधिकरण असलेल्या उक्त प्राधिकरणावर दिनांक २५ जुलै २०१९ रोजी सूचना (यात यापुढे "उक्त सूचना" असे संबोधिले आहे) बजावून उक्त सूचनेंतर्गत जागा, उक्त प्राधिकरणाने विहित कालावधीत संपादन केली नसल्याचे कळविले होते ;

(१)२ महाराष्ट्र शासन राजपत्र, भाग एक - नाशिक विभागीय पुरवणी, गुरुवार ते बुधवार, मार्च २८ ते एप्रिल ३, २०२४ / चैत्र ८ - १४, शके १९४६ आणि ज्याअर्थी, वरीलप्रमाणे उक्त अधिनियमाचे कलम १२७ चे उप-कलम (१) नुसार उक्त सूचना बजावल्यानंतरही, उक्त प्राधिकरणाने विहित कालावधीत उक्त आरक्षणाखालील जागा संपादन केली नाही ;

आणि ज्याअर्थी, उच्च न्यायालयाने उक्त सूचनेंतर्गत जागेच्या मालकांनी दाखल केलेल्या रिट याचिका क्रमांक ७२७२/२०२२ मध्ये दिनांक १३ जून २०२३ रोजीच्या आदेशान्वये उक्त विकास योजनेतील उक्त सूचनेंतर्गत जागेवरील उक्त आरक्षण, उक्त अधिनियमाचे कलम १२७ मधील तरतुदींनुसार व्यपगत झाल्याचे जाहीर केले आहे व तदनुषंगाने आरक्षण व्यपगत झालेबाबत आदेशाचे प्रसिद्धीकरण निकालाचे दिनांकापासून ४ महिन्यांचे कालावधीत करण्यात यावे, असा आदेश पारित केलेला आहे ;

आणि ज्याअर्थी, आता उक्त अधिनियमाच्या कलम १२७ चे उप-कलम (२) नुसार उक्त विकास योजनेमधील आरक्षण उक्त सूचनेंतर्गत जागेपुरते व्यपगत झाल्याबाबत आदेश निर्गमित करणे आवश्यक झाले आहे ;

आता, त्याअर्थी, उक्त अधिनियमाचे कलम १२७ चे उप-कलम (२) नुसार प्राप्त अधिकारात राज्य शासन उक्त सूचनेअंतर्गत जागेवरील उक्त विकास योजनेतील आरक्षण व्यपगत झाल्याचे अधिसूचित करीत आहे. अशाप्रकारे मुक्त झालेली जागा उक्त विकास योजनेतील लगतच्या अनुोय असलेल्या भूवापराप्रमाणे जमीन मालकास विकासाकरिता उपलब्ध होईल.

(१) प्रस्तुत आदेशान्वये उक्त विकास योजनेतील आरक्षणातून व्यपगत झालेले क्षेत्र दर्शविणाया भाग नकाशाची प्रत आयुक्त, जळगाव महानगरपालिका, जळगाव यांच्या कार्यालयात कार्यालयीन वेळेत नागरिकांच्या अवलोकनार्थ एक महिन्यापयत ठेवण्यात आली आहे.

(२) सदर आदेश, महाराष्ट्र शासनाच्या ... या संकेतस्थळावरदेखील उपलब्ध आहे.

ORDER

No. TPS-3523/1865/CR-187/2023/UD-9.– Whereas, the Government of Maharashtra in Urban Development Department vide Notiﬁ cation No. TPS-3599/738/CR-142 (A)/UD-9, dated 11th February 2002 has sanctioned the Development Plan of Jalgaon City (Additional Area) partly under Section 31 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Mah. Act No. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has came into force with eﬀect from 7th April 2002 (hereinafter referred to as "the said Development Plan") ;

and whereas, in the said Development Plan, as mentioned in the Schedule, land bearing Gat Nos. 1199 (Pt.), 1214 to 1216, 1217 to 1219 of mouje Asoda, taluka and district Jalgaon (hereinafter referred to as "the said Land") are reserved as Site No. 227, "Truck Terminal" (hereinafter referred to as "the said Reservation"). The Appropriate Authority for the said Reservation is Municipal Corporation, Jalgaon (hereinafter referred to as "the said Authority") ;

and whereas, the said Land has not been acquired by the said Authority within 10 (Ten) years from the date on which the said Development Plan came into force ;

and whereas, the owner of the land bearing Gat No. 1214/1 (hereinafter referred to as "the land under the said Notice") out of the said Land had, served a Notice on dated 25th July 2019 under Section 127 (1) of the said Act, (hereinafter referred to as "the said Notice") to the said Authority, informing that the said Land under the said Notice has not been acquired by the said Authority, within the stipulated period ;

and whereas, even after service of the said Notice as aforesaid, the said Land under the said Reservation has not been acquired within a stipulated time limit from the date of the service of said Notice under sub-section (1) of Section 127 of the said Act, by the said Authority ;

and whereas, Hon'ble High Court in Writ Petition No. 7272/2022 ﬁ led by the owner of the said Land vide it's Order dated 13th June 2023 held that, the said Reservation on the Land under the said Notice stands lapsed, under Section 127 of the said Act and shall notify the lapsing of reservation by an order within 4 months from the date of Order ;

and whereas, now, it becomes expedient to notify by an order under Section 127 (2) of the said Act that the said Reservation on the Land under the said Notice in the said Development Plan has been lapsed.

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and all other powers enabling it in that behalf, the Government of Maharashtra, hereby notiﬁ es that the said Reservation on the said Land under the said Notice stands lapsed from the said Development Plan. The said Land so released shall be available to the Land Owner for the purpose of Development as otherwise permissible in the case of adjacent land under the said Development Plan.

(1) A copy of the Part Plan showing the details of land released from Reservation in the said Development Plan vide this Order is available in the Oﬃ ce of the Commissioner, Jalgaon Municipal Corporation, Jalgaon during the Oﬃ ce hours on all working days for inspection of the public upto one month.

(2) This Order shall also be available on the Government website www.maharashtra.gov.in
