आदि ज्याअथाी, शासनांानांे उक्त अदिदिनांयमातीला कलाम ३७ मीला उपीकलाम (१कक)(क) अनांुसार प्रत्त असलाेल्या शाक्तीस अनांुसरुनां प्रस्तादित फेरबलासंभात सूचानांा क्र.दिटोपीएस-१२२४/१०१८/प्र.क्र.१५/२४/नांदि-१२, दि.१५/३/२०२४ प्रदिसद्ध केलाी आहाे, जी महाराष्ट्र शासन राजपत्र असार भाग-१ मध्ये कोक दिभागीय पीुरीमध्ये दि.१६.०३.२०२४ रोजी पीृ.क्र.१ ते ४ र प्रदिसध् झोालाी (यापीुढे ज्याचा उल्लाेख "उक्त सुचानांा" असा करण्यात आला आहाे) असूनां, सर सुचानांेखालाीला पीरिरदिशाष्टोामध्ये दिश्लाेदिषत केल्यानांुसारच्या प्रस्तादित फेरबलासंभात आम नांागरिरकांकडूनां हारकती आदि/दिकंा सुचानांा सरचाी सूचानांा शासन राजपत्रात प्रदिसद्ध झोाल्याच्या दिनांांकापीासूनां १ मदिहान्यात सार करेबाबत सुदिचात करण्यात आलाे हाोते. तसेचा उक्त मुतीत प्राप्त हाोाऱ्या हारकती आदि/दिकंा सूचानांांर संबंदितांनांा सुनांाी ेूनां त्यांचाे म्हाे ऐकूनां घेण्यासाठी पीनांेला महानांगरपीादिलाका यांचाे म्हाे दिचारात घेूनां अहाला शासनांास सार करण्याकरीता शासनांानांे सहासंचालाक, नांगररचानांा, कोक दिभाग, नांी मु ंबई यांचाी उक्त अदिदिनांयमाच्या कलाम १६२(१) अन्ये अदिकारी म्हाूनां दिनांयुक्ती करण्यात आलाी आहाे. (यापीुढे ज्याचा उल्लाेख "उक्त अदिकारी" असा करण्यात आला आहाे).

आदि ज्याअथाी, प्राप्त दिनांेनां दिचारात घेतल्यानांतर प्रस्तादित फेरबलाअंतगतचाी सुारा तात्काळ प्रभानांे लागू करे आश्यक असल्याचाी स्तुस्थिस्थाती दिचारात घेूनां शासनांानांे उक्त अदिदिनांयमाच्या कलाम १५४ मीला तरतुीनांुसार तात्काळ प्रभानांे लागू केलाेल्या सुारेस मा.उच्चा न्यायालायानांे दि.०३/०७/२०२४ दि.०८/०८/२०२४ रोजीच्या अंतरिरम आेशान्ये स्थादिगती दिलाी आहाे. (यापीुढे ज्याचा उल्लाेख "उक्त दिनांेशा" असा करण्यात आला आहाे) ;

आदि ज्याअथाी, उक्त अदिकारी यांचा अहाला दिचारात घेतल्यानांतर संचालाक, नांगररचानांा, महाराष्ट्र राज्य, पीुे यांचा सल्ला घेतल्यानांतर तसेचा आश्यक ती चाौकशाी केल्यानांतर प्रस्तादित फेरबला मंजूर करे आश्यक आहाे, असे शासनांाचाे मत झोालाे आहाे;

आदि त्याअथाी, आता उक्त अदिदिनांयमाच्या कलाम ३७(१कक)(ग) अन्ये शासनांास प्रत्त असलाेल्या अदिकारात शासनां याद्वारे दि.१५/०३/२०२४ च्या सुचानांेन्ये प्रदिसद्ध केलाेला प्रस्तादित फेरबला यासोबत जोडलाेल्या अनांुसुचाीमध्ये दिश्लाेदिषत केल्यानांुसार मंजूर करीत आहाे त्याकरीता दि.२/१२/२०२० रोजीच्या अदिसूचानांेन्ये मंजूर केलाेल्या एकदित्रात दिकास दिनांयंत्रा प्रोत्साहानां दिनांयमालाीमध्ये सुारा करण्यात येत आहाे. तसेचा शासनांानांे दि.१५/०३/२०२४ रोजी दिलाेलाे उक्त दिनांेशा मागे घेण्यात येत आहाेत;

२. उक्त मंजूर फेरबला सरचाी अदिसूचानांा शासन राजपत्रात प्रदिसद्ध झोाल्याच्या दिनांांकापीासूनां अंमलात येईला.

३. उक्त मंजूर फेरबलाबाबतचाी अदिसुचानांा खालाीला कायालायांमध्ये कायालायीनां ेळेत एक मदिहान्याच्या कालाीकरीता ससामान्य जनांतेच्या अलाोकनांाथा उपीलाब् राहाीला.

'A New Clause 10.16 in the Chapter 10- City Specific Regulation is included in the sanctioned Unified Development Control and Development Regulations as follows :—

10.16-AREA WITHIN PANVEL MUNICIPAL CORPORATION—

In area of panvel Municipal Corporation, 75% of the total permissible TDR component as metioned in Coloum 5 of the Table-6G in the Regulation No. 6.3, may be utiliesd on paymet of premium at the rate of 60% land rate mentioned in the Annusal Statement of Rates subject to following condition. Balance 25% to be utilised in the form of TDR only

Condition : This provison shall only be applicable till the sanction of the Development Plan of Panvel Municipal Corporation under section 31(1) of the Maharashtra Regional and Town Planning Act, ¹⁹⁶⁶'.

NOTIFICATION

The MaharashTra regional and Town Planning acT, 1966.

No. TPS-1224/1018/CR.15/24/UD-12.—Whereas, the Government of Maharashtra has sanctioned the Unified Development Control and Promotion Regulations (UDCPR) (hereinafter reffered to as 'the said UDCPR') for all the Regional Plans and Planning Authorities of the state except Municipal Corporation of Greater Mumbai, other Planning Authorities/Special Planning Authorities/ Development Authorities within the limit of Municipal Corporation of Greater Mumbai, MIDC, NAINA, Jawaharlal Nehru Port Trust, Hill Station Municipal Councils, Eco-Sensitive / Eco-Fragile region notified by MoEF & CC and Lonavala Municipal Council under the provisions of the said Act vide Notification No TPS-1818/ CR.238/18/ DP.&RP./Sec.37(IAA)(c) & sec20(4)/UD-13, dated 02/12/2020 which has come into force with effect from 3/12/2020;

And whereas, the Table-6G of Regulation 6.3 in the said UDCPR is regarding the Permissible FSI including additional FSI on payment of premium and permissible TDR loading on a plot in developable zones like residential, commercial, etc.

And whereas, the President, Credai Banm Raigad, has requested Government vide letter dated 28/4/2023 to allow TDR in lieu of premium in the CIDCO Nodes of Panvel Municipal Corporation;

And whereas, after consulting the Director of Town Planning, Maharashtra State, Pune and after making necessary enquiries, Government was of the opinion that, it is necessary to modify the said UDCPR by including a new Clause in the Chapter 10- City Specific Regulation, in respect of allowing permissible TDR loading on payment of premium in the Pancel Municipal Corporation subject to condition (hereinafter referred to as "the Proposed Modification");

And whereas, the Government, in accordance with the provisions contained in sub-section (1AA) (a) of section 37 of the said Act, published a notice bearing no. TPS-1224/1018/CR.15/24/UD-12, dated 15/3/2024 which appeared in Maharashtra Government Extraordinary official Gazette, part-I, Konkan Division dated 16/3/2024 on pages 1 to 4 (hereinafter referred to as "the said Notice") and invited objections and / or suggestions in respect of the proposed modification more specifically described in the Schedule below the said notice, from the general public within a period of 1 (one) month from the date of publication of the said notice in Maharashtra Government Gazette and the Joint Director of Town Planning, Konkan Division, Navi Mumbai was appointed as an Officer (hereinafter referred to as "the said officer") on behalf of Government under section 162(1) of the said Act, and authorised to hear the objections and /or suggestions which may be received from the general public within the aforesaid stipulated period & also the say of the Panvel Municipal Corporation and submit his report to the Government.

And whereas, considering the representation received, the Government was of the opinion that the proposed modification should be implemented by the immediate effect and hence given directions under section 154 of the said Act, vide no. TPS-1224/1018/CR.15/24/UD-12, dated 15/3/2024 (hereinafter referred to as "the said directives") which is stayed by the Hon'ble High Court vide interim order dated 3/7/2024 & dated 8/8/2024;

And whereas, after considering the report submitted by the said officer and after consulting the Director of Town Planning, Maharashtra State, Pune and also after making necessary enquiries, the Government is of the opinion that the proposed modification needs to be sanctioned.

Now therefore, in exercise of the powers conferred under section 37(1AA)(c) of the said Act, the Government hereby sanctions, the proposed modifcation publised vide the notice dated 15/3/2024, as described more speciafically in the Schedule appended hereto, and for that purpose modifies the notification dated 2/12/2020 sanctioning the Unified Development Control and Promotion Regulations. Also the said directives given by Government vide dated 15/3/2024 is hereby withdrawn;

2. The aforesaid sanctioned modification shall come into force from the date of publication of this Notification in the Maharashtra Government Gazette.

3. The aforesaid sanctioned modification is kept for inspection to the general public in the following offices for the period of one month on all working days.

(1) The Commissioner, Panvel Municipal Corporation, Panvel.

(2) The Joint Director of Town Planning, Konkan Division, Konkan Bhavan, Navi Mumbai.

(3) The Assistant Director of Town Planning, Raigad-Alibaug Branch, Raigad.

4. This notification shall also be made available on the Government website www.maharashtra. gov.in (Acts/Rules)
