CIN-NO-U९३०३०MH२०११PTC२१९९५९), युदिनांटें नां. २, २ रा माळा, माेनांलॅन्डी चायनांा रेस्टेंॉरंटें जवळा, अंधेरी-मालाडी, न्यू दिलंका रोडी, अंधेरी (पी), माु ंबई- ५३ (यापीुढे उक्ता दिवत्तीय संस्र्थीा असा उल्लेख कारण्याता आला आहुे) या दिवत्तीय संस्र्थीेनांे आदिणी सदार दिवत्तीय संस्र्थीेचे अध्यक्ष, संचालका, व्यवस्र्थीापीका, प्रवतागका, भागीदार आदिणी संस्र्थीेचे कामागचारी यांनांी ठेवीदारांनांा माुदाताीअंताी लाभासहु ठेवी पीरता कारण्याचे आश्वादिसता कारूनां ठेवी स्विस्वकारल्या हुोत्या ;

आदिणी ज्याअर्थी, उक्ता दिवत्तीय संस्र्थीा आदिणी सदार संस्र्थीेचे अध्यक्ष, संचालका, व्यवस्र्थीापीका, प्रवतागका, भागीदार आदिणी संस्र्थीेचे कामागचारी यांनांी ठेवीदारांकाडीूनां स्वीकारलेल्या ठेवी माुदातापीूताीनांतार ठेवीदारांनांा पीरता कारण्यास कासूर काेला असल्यानांे त्यांचेदिवरुध्दा अंबोली पीोलीस ठेाणीे, माु ंबई येर्थीे गु.र.क्र.२४२/२०१४(आ.गु.शा.गु.र.क्र.६७/२०१४) नांुसार भारताीय दांडी संदिहुता (सनां १८६० चा ४५) कालमा ४०६, ४२०, ४६५ आदिणी ३४ सहु माहुाराष्ट्रे ठेवीदारांच्या (दिवत्तीय संस्र्थीांमाधेील) दिहुतासंबंधेांचे संरक्षणी अदिधेदिनांयमा, १९९९ (२००० चा माहुाराष्ट्रे १६) कालमा ३ व ४ अन्वये गुन्हुा दाखल कारण्याता आला आहुे ;

आदिणी ज्याअर्थी, माहुाराष्ट्रे शासनांाची अशाी खात्राी झाली आहुे काी, उक्ता दिवत्तीय संस्र्थीा आदिणी सदार संस्र्थीेचे अध्यक्ष, संचालका, व्यवस्र्थीापीका, प्रवतागका, भागीदार आदिणी संस्र्थीेचे कामागचारी हुे ठेवीदारांनांी मागणी काेल्यानांुसार ठेवी पीरता कारण्याता अपीयशाी ठेरले असूनां उक्ता दिवत्तीय संस्र्थीेद्वारे ठेवीदारांनांा ठेवी पीरता कारण्याची शाक्यता दिदासूनां येता नांाहुी ;

आदिणी ज्याअर्थी, माहुाराष्ट्रे शासनांाला, उक्ता दिवत्तीय संस्र्थीा आदिणी सदार संस्र्थीेचे अध्यक्ष, संचालका, व्यवस्र्थीापीका, प्रवतागका, भागीदार, संस्र्थीेचे कामागचारी आदिणी अन्य काोणीताीहुी व्यक्ताी यांनांी जमा काेलेल्या ठेवंमाधेूनां त्यांच्या स्वता:च्या अर्थीवा अन्य काोणीत्याहुी व्यक्ताीच्या नांावे रक्कामा व अन्य मालमात्तीा संपीादिदाता कारण्याता आली असल्याचे अदिभकादिर्थीता असल्यानांे, उक्ता दिवत्तीय संस्र्थीांमाधेील ठेवीदारांच्या दिहुताचे संरक्षणी कारण्याकारिरता अशाी रक्कामा व अन्य मालमात्तीा जप्ता कारण्याचे आदिणी अशा जप्ता रक्कामा व अन्य मालमात्तीा यावर दिनांयंत्राणी ठेवण्याकारिरता

(१)

भाग चार-ब-३२१—१२ महाराष्ट्र शासन राजपत्र असाधाराण भाग चारा-ब, सप्टेंबरा ११, २०२५/भाद्रपद २०, शाके १९४७ उपी दिजल्हुादिधेकारी (अदिता/दिनांष्का) बांद्रा, माु ंबई उपीनांगर यांची सक्षमा प्रादिधेकारी म्हुणीूनां दिनांयुक्ताी कारणीे आवश्यका वाटेंताे.

त्याअर्थी आता, माहुाराष्ट्रे ठेवीदारांच्या (दिवत्तीय संस्र्थीांमाधेील) दिहुतासंबंधेाचे संरक्षणी अदिधेदिनांयमा, १९९९ (२००० चा माहुाराष्ट्रे १६) च्या कालमा ४चे पीोटें-कालमा (१) व कालमा ५ चे पीोटें-कालमा (१) याद्वारे प्रदानां कारण्याता आलेल्या अदिधेकारांचा वापीर कारूनां माहुाराष्ट्रे शासनां याद्वारे,—

(अ) अनांुसूचीता दिवदिनांदिदागष्टें काेल्याप्रमाणीे, माे.असेदिलया फॅरेक्स ट्रेदिडींग प्रा.दिल. कांपीनांी या दिवत्तीय संस्र्थीेच्या आदिणी सदार दिवत्तीय संस्र्थीेचे अध्यक्ष, संचालका, व्यवस्र्थीापीका, प्रवतागका, भागीदार, कामागचारी आदिणी काोणीताीहुी अन्य व्यक्ताी यांच्या नांावे असलेली रक्कामा व अन्य मालमात्तीा जप्ता कारीता आहुे, आदिणी

(ब) सदार जप्ता काेलेल्या रक्कामा व अन्य मालमात्तीा यावर दिनांयंत्राणी ठेवण्यासाठेी उपी दिजल्हुादिधेकारी (अदिता/दिनांष्का) बांद्रा, माु ंबई उपीनांगर यांची सक्षमा प्रादिधेकारी म्हुणीूनां दिनांयुक्ताी कारीता आहुे.

माे.असेदिलया फॅरेक्स ट्रेदिडींग प्रा.दिल. कांपीनांी या दिवत्तीय संस्र्थीेच्या आदिणी संस्र्थीेचे अध्यक्ष, संचालका, व्यवस्र्थीापीका, प्रवतागका, भागीदार, कामागचारी आदिणी काोणीताीहुी अन्य व्यक्ताी यांच्या जप्ता कारावयाच्या रक्कामा व अन्य मालमात्तीेची सूची खालीलप्रमाणीे आहुे:-

(अ) बँक खात्येांचा तपशाीले :-

माहुाराष्ट्रेाचे राज्यपीाल यांच्या आदाेशानांुसार व नांावानांे,

अनुप कुमारा किंसंहा, शासनांाचे प्रधेानां सदिचव (दिवशाेष).

Maharashtra Protection of interest of DePositors (in financial establishMents) act, 1999.

No. MPID-1121/C.R.No.24(A)/Pol-15.— Whereas, M/s Arcelia Farex Trading Pvt. Ltd. Company, (Register No.CIN-NO-U93030MH2011PTC219959), Unit No.2, 2nd Floor, Near Mainland China Restaurant, Andheri - Malad, New Link Road, Andheri (W), Mumbai-53 (hereinafter referred to as "the said and Financial Establishment") and its Chairman, Directors, Manager, Promoters, Partners and its employees received deposits from depositors under the scheme to repay the deposits on maturity alongwith benefits promised thereof to the depositors ;

And whereas, offence has been registered against the said Financial Establishment and its Chairman, Directors, Manager, Promoters, Partners and its employees at Amboli Police Station, Mumbai, vide Complaint Register No. 242/2014 (EOW C.R.N. 67/2014) under sections 406, 420, 465 and 34 of the Indian Penal Code (45 of 1860) and sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), that they have collected the deposits and have failed to repay the deposits after maturity ;

And whereas, the Government of Maharashtra is satisfied that the said Financial Establishment and its Chairman, Directors, Manager, Promoters, Partners and its employees have failed to repay the deposits on demand by the depositors and the said Financial Establishment is not likely to repay the deposits to the depositors ;

And whereas, the Government of Maharashtra considers it expedient to attach the monies and other properties believed to have been acquired by the said Financial Establishment and its Chairman, Directors, Manager, Promoters, Partners, its employees and any other person either in their own name or in the name of any other person from out of the deposits collected by the said Financial Establishments, in order to protect the interest of the depositors of the said Financial Establishment and to appoint Deputy Collector (Encroachment / Removal) Bandra, Mumbai Suburban as the Competent Authority to exercise control over the monies and other properties attached.

Now therefore, in exercise of the powers conferred by sub-section (1) of section 4 and sub-section (1) of section 5 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), the Government of Maharashtra hereby, -

(a) attaches the monies and other properties in the name of M/s Arcelia Farex Trading Pvt. Ltd. Company and its Chairman, Directors, Manager, Promoters, Partners, its employees and any other person, as specified in the Schedule appended hereto; and

(b) appoints the Deputy Collector (Encroachment / Removal) Bandra, Mumbai Suburban to be the Competent Authority, to exercise control over the monies and other properties attached.

The list of monies and other properties of the M/s Arcelia Farex Trading Pvt. Ltd. Company and its Chairman, Directors, Manager, Promoters, Partners, its employees and any other Person to be attached are as follows, namely:-
