Maharashtra regional & town Planning act, 1966.
ORDER
No.D.T.P-D.P. Yavatmal (R)-Sec-127(2)-Order-TPV-VI-4850.–
Whereas, the Development Plan of Yavatmal Municipal Council (Revised) has been partly sanctioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide its Notification No.TPS-2795-1600-CR-252-95-UD-13, dated 08th July, 1998 (hereinafter referred to as "the said Notification") & came into force with effect from dated 04th September,1998 (hereinafter referred to as the "said Sanctioned Revised Development Plan");
And whereas, in the said Revised Sanctioned Development Plan, the lands bearing S. No. 12 Pt. & 13 Pt. of Mouza Yavatmal admeasuring approximate area 0.73 Ha. is affected by the Reservation No. 34, "Park", (hereinafter referred to as "the said Reservation") for which Appropriate Authority for acquisition and development of the said Reservation is Municipal Council, Yavatmal (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land under said Reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Revised Development Plan came into force;
And whereas, the concerned Land Owner (hereinafter referred to as "the said Land Owner") of the land bearing S. No. 13/4 (Part) of Mouza Yavatmal (hereinafter referred to as "the said Land") had served a notice dt. 15th March, 2004 as per the provisions of section 127(1) of the said Act in respect of the area admeasuring 2920.35 Sq. mt. affected by the said Reservation (herein- after referred to as "the said Notice") on the said Appropriate Authority and the same has received to the said Appropriate Authority on same day;
And whereas, the said Land under the said Reservation is not acquired or no steps as required as per the provisions of section 127 (1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice by the said land owner;
And whereas, the Hon'ble High Court, Mumbai of Judicature of Nagpur Bench vide its decision (hereinafter referred to as "the said Decision") dt. 23rd October, 2023 in Writ Petition No. 4002/2023 filed by the said Land Owner has declared that, the said Reservation in respect of affected area 1.07 Ha. of the said Land has lapsed in view of the provisions of section 127 of the said Act; And whereas, the Chief Officer, Municipal Council, Yavatmal has submitted the proposal for lapsing of the said Reservation on the said Land under the provisions of section 127(2) of the said Act vide it's letter No. 490/2023, dated 07th March, 2023 in respect of the said decision;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati has submitted४ महाराष्ट्र शासन राजपत्र भाग एक-अ अमरावती विभागीय पुरवणी, सप्टेंबर ११-१७, २०२५/भाद्रपद २०-२६, शके १९४७ the report vide it's letter No. 742, dated 11th June, 2024 that,there is no objection to issue an order under the provisions of section 127(2) of the said Act for lapsing of the said Reservation on the said Land by the Director of Town Planning, Maharashtra State, Pune in power delegated to him ;
And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Revised Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of section 127(2) of the said Act, regarding the lapsing of the said Reservation partly on the area admeasuring approximately 2920.35 Sq. mt. of the said Land;
And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No.TPS-1813-3211-CR-508-UD-13, dated 01st December, 2016, has delegated the powers exercisable by it under section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maha- rashtra State, Pune;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said Land as per the provisions of section 127 (2) of the said Act & for that purpose amends the said Notification of the said Revised Sanctioned Development Plan, as follows-
After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be added:-

Note:- 1. The said Land so released from the said Reservation shall become available to the said Land Owner for the purpose of development as otherwise permissible in the case of adjacent land under the said Sanctioned Revised Development Plan.
2. A copy of the part plan of the said Sanctioned Revised Development Plan showing the part area of the said Land which is lapsed from the said Reservation, is available in the office of the Chief Officer, Municipal Council, Yavatmal, District Yavatmal during office hours on all working days for inspection to public upto one month.
3. This Order shall also be published on the Directorate's official website www.dtp.maharashtra. gov.in
