The Maharashtra Regional and Town Planning Act, 1966.
NOTIFICATION
No.TPS-2220-865-C.R14-2021-UD-9.–
Whereas, the Revised Development Plan of Warora City, Dist. Chandrapur has been partly sanctioned by the Government of Maharashtra in Urban Development Department vide it's Notification No.TPS-2212-521 (N)-Reconstruction No.57-CR-102(A)-2012 -UD-9, dated the 28thDecember, 2012, under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Maha. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same come into force with effect from dat- ed the 27th January, 2013 (hereinafter referred to as "the said Development Plan") and the Republished Development Plan of Excluded Parts of substantial nature modifications, has been sanctioned vide Notification No.TPS-2212-521 (N)-Reconstruction No.57-CR-102-2012-UD-9, dated the 03rd January,2015 and the same come into force with effect from dated the 03rd February 2015;
And whereas, in the said Development Plan, land admeasuring 0.41 Hectare, bearing Survey No. 30/1 of Mouje Khanji is reserved as "Site No.8-Auditorium & Multipurpose Hall" (hereinafter referred to as "the said Reservation");
And whereas, the Warora Municipal Council being the Planning Authority (hereinafter referred to as 'the said Planning Authority"), vide its General Body Resolution No.12, Dated the 04th September, 2019 has resolved to delete the said Land from the said Reservations and to include the land so released in Residential Zone and to include the same in Residential Zone and after following the procedure laid down in the provisions of sub section (1) of section 37 of the said Act, submitted the proposal to the Government, for its sanction (hereinafter referred to as "the Proposed Modification");

And whereas, the Land Owner of the said land have deposited Rs. 1,09,675/- towards the 50% Government share of 5% premium amount as per the value of the said land as prescribed in the Annual Statement of Rates (ASR) for the year 2025-26 in the Government Treasury on 17th June,2025 through the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur and the remaining 50% of the 5% premium amount of Rs. 1,09,675/- payable to the Planning Authority has been deposited with the Chief Officer, Warora Municipal Council, Warora on 18th June,2025;
Now therefore, in exercise of the powers conferred on it under sub section (2) of section 37 of the said Act, the Government hereby, sanctions the Proposed Modification subject to certain conditions and for that purpose amends the aforesaid Notification dated the 28th December, 2012 as follows;
"In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry"
ENTRY
"The land admeasuring 0.41 Hectare, bearing Survey No.30/1 of Mouja Khanji is deleted from "Site No.8-Auditorium & Multipurpose Hall" and the land so released is included in Residential Zone, as shown on plan. subject to conditions specified below-
Condition No.1 - 10% Amenity Space shall be provided in the layout in addition to 10% compulsory open space, as per the prevailing Development Control Regulations for Warora.
Condition No. 2 - It is necessary to construct compound around the open space.
Condition No. 3 - It is compulsory for the land owner / developer, to provide all the Basic Amenities required for the land under modification at his own cost. The basic amenities included as road, water supply, sewerage & drainage etc.
Condition No. 4 - If the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Chief Officer, Warora Municipal Council, Warora, Dist. Chandrapur in relation to development of basic amenities as per the stages given below.
(a) After final approval of layout Sale of 25% of the total plots shall be permissible.
(b) After completion of 40% basic Amenities Sale of 50% of the total plots shall be permissible.
(c) After completion of 60% basic Amenities Sale of 75% of the total plots shall be permissible.
(d) After completion of 80% basic Amenities Sale of 90% of the total plots shall be permissible.
(e) After completion of 100% basic Amenities Sale of 100% of the total plots shall be permissible.
If Group Housing Scheme is proposed in the layout then occupation certificate shall not be given by the chief Officer, Warora Municipal Council, Warora, Dist. Chandrapur unless all the basic ameities are fully developed.

ORDER
No. D.T.P/D.P.Gondia/Sec-127(2)/Order/TPV-II/4940.----
Whereas, the Development Plan of Gondia Municipal Council has been sanctioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Maha. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide Notification No. TPS- 2311/2186/CR-249B/2011/UD-9, dt. 04th April, 2012 (hereinafter referred to as "the said Notification) & has come into force with effect from dt. 15th May, 2012, (hereinafter referred to as "the said Sanctioned Development Plan");
And whereas, as per the said Sanctioned Development Plan, out of the 6900 sq. mt. area of the land in Gat No. 298/1A at Mouja Gondia (Khurd), 6063 sq. m. area is affected by the reservation No. S/223 "Garden" and 12 mt. wide Development Plan Road (hereinafter referred to as "the said Reservations") and the Planning and Appropriate Authority for the land acquisition and development of the said reserva- tions is the Municipal Council, Gondia (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land affected by the said Reservation have not been acquired by the said Appro- priate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan come into force;
And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") of the Land bearing Gat No. 298/1/A, admeasuring area approximately 6900 sq.mt., out of which 6063 sq.mt, is affected by the said Reservations (hereinafter referred to as "the said Land") had served a notice as per the provisions of section 127(1) of the said Act. (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 17th May, 2022 and same has been received by the Appropriate Authority on 17th May, 2022;
And whereas, the said Land under the said Reservation is not acquired or no steps as required as per the provisions of section 127 (1) of the said Act have been taken by the Planning Authority within the stipulated period from the date of service of the said notice by the said land owner as per the provisions of section 127 of the said Act;
And whereas, the Assistant Director of Town Planning, Gondia Branch, Gondia vide letter No. 355, dt. 28th May, 2025 has submitted report and finally stating that. 'However, since the said land has not been acquired by the Municipal Council, the reservation has lapsed. As per Section 127(2) of the Maharashtra Regional and Town Planning Act, 1966, there is a provision for the Government to issue a notification regarding the lapsing of land under reservation. Therefore, it has been submitted for further action';

"In the said case, the Municipal Council has not taken action to acquire the land) belonging to the applicant in Gat No. 298/1/A of Mauja Gondia (Khurd) in respect of the reservation No. S/223 "Garden" and 12.0 mt. wide development plan within 24 months. Therefore, the said reservation and 12.0 mt. wide development plan road have been lapsed. As the said road is not limited to that place. considering its connectivity, even though the reservation of road on the land is being lapsed, it will be made a condition that the connectivity of the said road will remain binding at the time of development permission. Therefore, there is no objection to taking a decision at the head office level regarding the issuance of a notification under Section 127(2) of the Maharashtra Regional and Town Planning Act, 1966 with the said condition,";
And whereas, as per the land measurement document No. 2161/2019, dated 12nd July 2019 received from the Chief Officer. Municipal Council, Gondia, it appears that 5601 sq.mt. area of land in Gat No. 298/1A at Gondia (Khurd) is affected by the reservation of "Garden" and 462 sq.mt. area is affected by the reservation of "12 m. wide Development Plan Road":
And whereas, after considering the above facts in respect of the said Reservation on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of section 127(2) of the said Act, regarding the lapsing of the said Reservation on the said land admeasuring area 2994 sq.mt.; And whereas, the Government in Urban Development Department as per the provisions of sec- tion 151 of the said Act, vide Resolution No.TPS-1813/3211/CR- 508/UD-13, dt. 01st December, 2016, has delegated the powers exercisable by it as per the provisions of section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said land as per the provisions of section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows-
After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added:-

2. Contiguity of the road is broken due to partial area of the Land getting released from the said Road. Therefore, from transportation & connectivity point of view said road is required to be retained on the same area as proposed in the said Sanctioned Revised Development Plan. In this regard, the Chief Officer, Municipal Council. Gondia as a Planning Authority should take appropriate action in the framework of law by offering any other alternative to the said Land owner with his consent.
3. A copy of the part plan of the said sanctioned Development Plan showing the areas of the said Land which are lapsed from the said Reservation is available in the office of the Chief Officer, Municipal Council, Gondia, District Gondia during office hours on all working days for inspec- tion to public upto one month.

28(4) of Maharashtra Regional & Town Planning Act, 1966
NOTICE
No. WS-MCD-TP-646-2025.-
Whereas, Desaiganj Municipal Council, being Planning Authority, has published the Draft Development Plan of Desaiganj u/s 26(1) of the Maharashtra Regional and Town Planning Act, 1966, vide notice dated 18th September, 2023 for inviting suggestions/objections from public. The said Notice is published in Maharashtra Government Gazzette of Nagpur Division, Supplement Part 1-A, dated 28th September, 2023 to 4th October, 2023;
And whereas, after considering the suggestions/objections to the said plan received within stipulated period, the Planning committee constituted u/s 28(4) of the said Act, has submitted its report to the said Planning Authority on 15th May, 2024;
And whereas, the said Planning Authority after considering the report submitted by Planning committee, partly accepted it in it and passed Resolution No. 291(6), dated 06th June, 2024 to make modifications/changed to the said Plan and to submit the said Plan for sanction to the Government u/s 30 of the said Act;
And whereas, it is necessary to publish the said modifications/changes made in the said Plan for inspection of the public as per section 28(4) of the said Act;
Now, therefore, the list of modifications/changes made u/s 28(4) of the Act, by the said Planning Authority is hereby published as Appendix-A as per the provisions of said Act for information of the public.

M-2 Proposed 12 M. D.P. Road from Sr. No. 439,442,443 of Mauja Virshi Tukum is continued up to Sr. No. 162 to 181 of Mauja Wadsa. Remaining part of Sr. No. 439, 442, 443 and complete Sr. No. 451,450 and 449 of Mauja Virshi Tukum and complete Sr. No. 161 of Mauja Wadsa is included Residential Zone.
M-3 In Draft Development Plan beyond flood line Sr. No. 102, part of Sr. No. 103, 32, 31, 30, 28, 27, 483, 486 of Mauja Virshi Tukum and part of Sr. No. 235, 237, 238, 239, 66 and complete Sr. No. 240 of Mauja Wadsa has been included in Residential Zone is deleted and included in Agriculture Zone.
M-4 The Central Government has approved New Broad-Gauge Line from Wadsa to Gadchiroli and construction work is underway. In said Draft Development Plan, 12.0 M. Service Road on both the sides of New Railway Line is proposed. And this 12.0 M. Service Road is extended up to Sr. No. 192 of Mauja Wadsa.

M-5 In Draft Development Plan an area of Adarsh High School shown as Nazul area is renamed as Adarsh High School area. And an area of 1.61HR. out of Khasara No. 24, Nazul land as shown in part plan accompanying UDD Notification dated of March 2019 is shown for Diksha Bhoomi Purpose.
M-6 The land of Mauja Wadsa Sr. No. 570/1 is in demand for a Playground purpose and the said Forest land is permissible under Forest rights. Follow-ups is underway with Forest Department, therefore Reservation No. 47 Garden and Reservation No.48 Playground is proposed from planning point of view.
M-7 An approach road of 12.0M. width to Reservation No.01 Municipal Purposed, Reservation No. 02 Playground, Reservation No. 41,43 and 44 S.T.P. has been proposed in Draft Development Plan.
M-8 The Road link between Railway boundary and Brampuri road is maintained as per sanctioned D. P. of Mauja Virshi Tukum, Sr. No. 388/2, 385/3.
M-9 Reservation No. 32 of sanctioned D.P. is reinstated with new Reservation No. 46 for Weekly Market.
M-10 The land of Mauja Nainpur Sr. No. 319 reserved for Reservation No.28 in Draft Development Plan is deleted and included in Residential Zone.
M-11 Proposed North-South 12.00 m D. P. Road from Sr. No. 139 Mauja Virshi Tukum is deleted and the land so deleted is included in Residential Zone.
M-12 An area of 0.13 HR from Sr. No. 374, Mauja Nainpur is deleted from Reservation No. 3 Educational Purpose. The area so deleted from reservation is included in Industrial Zone. An area of 2800 sq. M. out of Sr. No. 373/2 of Mauja Nainpur as per Gunthewari Regularization order dated 09/09/2010 by Municipal Council, Desaiganj is deleted from Reservation No. 3 Educational Purpose and the land so deleted is included in Industrial Zone.
M-13 The area of 300 Sq. M. out of Sr. No. 257/2 of Mauja Virshi Tukum shown in Public Semi- Public Zone on Draft Development Plan is deleted and the land so deleted is included in Residential Zone.
M-14 1)The alignment of proposed 24.0 m wide Development Plan Road under reference is modified from Kurkheda road to Southern boundary of Sr. No. 302 and 303 of Mauja Virshi Tukum.
2) a) The junction points of proposed 24.0 m wide D. P. Road on Kurkheda road is kept intact.
b) From the Junction point of this road on the Kurkheda road the alignment is modified on the common boundary Sr. No. 310 and 259 straight up to canal.
c) From the Northern boundary of Sr. No.301, the alignment meet the existing meeting point at Southern boundary of Sr. No. 302 and 303.
M-15 An area of 130.10 Sq. M. from maintenance Khasara No. 139 Mauja Desaiganj City Nazul is deleted from Reservation No. 07 Extension to Shopping Complex and the land so deleted from reservation is included in adjacent Zone.
M-16 The alignment 18.0 M. wide D. P. Proposed Road from Sr.No. 352 is modified touching the Northern boundary of Sr.No. 352 of Mauja Wadsa.
