क्रमांाक विडी/े-५/एलएक्यु-एसआर- ५२/२०२२.— ज्युाअर्थी, भाूविमांसपुादन, पुनवसन पुनर्स्थार्थीावपुना करताना ाजी भारपुाई विमांळण्युाचा आवि पुारदर्शवकताेचा हक्क अविविनयुमां, २०१३ (२०१३ चा ३०) (ज्युाचा उल्लेख पुढे उक्ता अविविनयुमां असा करण्युाता आला आहे) च्युा कलमां ३ च्युा खडी (इ) च्युा द्वारे प्रदान करण्युाता आलेल्युा अविकाराचा ापुर करून काढेण्युाता आलेली अविसूचाना, मांहसूल न विभाग क्र. सकीव ११/२०१४/प्र.क्र.७७(भाग)/अ-२, विदनाक ११ सप्ंबर, २०१५ (युाता युापुढे विजचा विनदेर्श उक्ता अविसूचाना असा करण्युाता आला आहे) युाद्वारे असे अविसूविचाता केले आहे की, उक्ता अविविनयुमांाच्युा कलमां ३ च्युा खडी (झेडी अ) मांध्युे व्युाख्युा केलेल्युा एखाद्या सावजविनक प्रयुोजनासाठी, एखाद्या विजल्ह्याताील १०,००० हेक्रपुेक्षा अविक नसेल इताक्युा क्षाेत्राकरिरता जमांीन सपुादन करण्युाच्युा सबाता, अर्शा विजल्ह्याचा विजल्हाविकारी हा उक्ता अविविनयुमांाच्युा प्रयुोजनासाठी समांुविचाता र्शासन असल्युाचाे मांानण्युाता युेईल;

आवि ज्युाअर्थी, उक्ता अविसूचानेनुसार समांुविचाता र्शासन असलेल्युा, ठीाे विजल्ह्याच्युा विजल्हाविकाऱ्युास युासोबता जोडीलेल्युा अनुसूची एकमध्ये दर्शवविलेली जमांीन (युापुढे विजचा विनदेर्श "उक्ता जमांीन" असा करण्युाता आला आहे.) आश्युक आहे अर्थीा विताचाी आश्युकता भासण्युाचाी र्शक्युता आहे, असे ाताे (ज्युाच्युा र्स्थारूपुाचाे विर युासोबता जोडीलेल्युा अनुसूची दोनमध्ये विदलेले आहे). आवि म्हून उक्ता अविविनयुमांाच्युा कलमां ११ च्युा पुो-कलमां (१) च्युा तारताुदीन्युे युाद्वारे असे अविसूविचाता करण्युाता युेताे की, उक्ता जविमांनीचाी मांु बई मांेट्रो प्पुा -४, ४अ, १० ११ युा मांेट्रो मांाविगवकेच्युा कारडीेपुोच्युा पुोहोचा मांागव युा सावजविनक प्रयुोजनासाठी मांौजे- मांोघरपुाडीा, ता.विज.ठीाे, युेर्थील अनुसूची एकमध्ये दर्शवविलेल्युा जविमांनीचाी आश्युकता आहे;

आवि ज्युाअर्थी, महाराष्ट्र शासन राजपत्र, असार भाग क्र. चार-अ, क्रमांाक एसआयुए-२०२५/प्र.क्र.९१/अ-२, विदनाक ०६ ऑगर्स्था, २०२५ अन्युे लोकविहतार्स्थाता उक्ता अविविनयुमांाच्युा प्रकर दोनच्युा आवि प्रकर ताीनच्युा तारताुदी लागू करण्युापुासून उक्ता प्रकल्पुाला सू देण्युाता आली असल्युामांुळे युा प्रकल्पुासाठी सामांाविजक प्रभा विनावर करण्युाचाी आश्युकता उरलेली नाही.

त्युाअर्थी आता, असे घोविता करण्युाता युेताे की, उक्ता अविविनयुमांाच्युा कलमां ११ च्युा पुो-कलमां ४ अनुसार कोताीही व्युक्ताी, ही अविसूचाना प्रविसध्द झेाल्युाच्युा विदनाकापुासून ताे उक्ता अविविनयुमांाच्युा प्रकर चार खालील कायुवाही पुूव होईल त्युा कालाीपुयुंता उक्ता जविमांनीचा अर्थीा विताच्युा भागाचा कोताही व्युहार करार नाही विकंा उक्ता जविमांनीर कोताही भार विनमांाव करार नाही :

पुरताु, उक्ता जविमांनीच्युा अर्थीा विताच्युा भागाच्युा मांालकाने अजव केल्युार, विजल्हाविकाऱ्युास विर्शे पुरिरस्थिर्स्थार्थीताीता, लेखी कारे नमांूद करून अर्शा मांालकास उपुरोक्ता तारताुदीच्युा प्रतावनाताून सू देता युेईल :

पुरताु आखी असे की, जर कोत्युाही व्युक्ताीने युा तारताुदीचाे जाीपुूवक उल्लघन केल्युामांुळे विताला झेालेल्युा कोत्युाही हानीचाी विकंा क्षाताीचाी विजल्हाविकाऱ्युाकडीून भारपुाई विदली जार नाही ;

तासेचा, उक्ता अविविनयुमांाच्युा कलमां ११ च्युा पुो-कलमां (५) अनुसार, उपुविभागीयु अविकारी, भाूविमांसपुादन, पुनवसन पुनर्स्थार्थीावपुना करताना उविचाता भारपुाई विमांळण्युाचा आवि पुारदर्शवकताेचा हक्क (मांहाराष्ट्रो) विनयुमां, २०१४ (युाता युापुढे त्युाचा विनदेर्श उक्ता विनयुमां असा करण्युाता आला आहे) उक्ता विनयुमां १०च्युा उपुविनयुमां ३ व्दारे विविहता केल्युाप्रमांाे भाूविमां अविभालेखाच्युा अद्याताीकराचाे कामां हाताी घेार असल्युाचाे पुूव करार असल्युाचाे देखील घोविता करीता आहे;

तासेचा उक्ता अवि विनयुमांाच्युा कलमां ३ च्युा खडी (छ) अन्युे, समांुविचाता र्शासन असलेले विजल्हाविकारी, ठीाे युानी उक्ता अविविनयुमांाखालील विजल्हाविकाऱ्युाचाी कायुे पुार पुाडीण्युासाठी उपुविभागीयु अविकारी, ठीाे, उपुविभाग, ठीाे युास पुदविनदेविर्शता केले आहे.

र्शासन, मांहसूल न विभाग, मांत्रालयु, मांु बई-३२ युानी त्युाचाेकडील अविसूचाना विदनाक २६ एविप्रल २०१८ व्दारे भाूमांीसपुादन, पुनवसन पुनर्स्थार्थीावपुना करताना ाजी भारपुाई विमांळण्युाचा आवि पुारदर्शवकताेचा हक्क अविविनयुमां, २०१३ (२०१३ चा ३०) युामांध्युे कलमां १० (क) समांाविष् केले असून, त्युामांध्युे अर्शी तारताूद केली आहे की, समांुविचाता र्शासनाला जनविहताच्युा दृष्ीने अविसूचानेव्दारे, उक्ता अविविनयुमांाच्युा प्रकर दोन प्रकर ताीन युाच्युा तारताुदी लागू करण्युापुासून सू देता युेताे. त्युानुसार महाराष्ट्र शासन राजपत्र, असार क्रमांाक भाग चार-अ, क्रमांाक एसआयुए-२०२५/प्र.क्र.९१/अ-२, विदनाक ०६ ऑगर्स्था, २०२५ नुसार उक्ता फरक प्रकल्पुाला जनविहताच्युा दृष्ीने लोकविहताकारी प्रकल्पु असल्युाकाराने प्रकर दोन आवि प्रकर ताीन च्युा तारताुदी लागू करण्युापुासून उक्ता प्रकल्पुाला सू देण्युाता आली आहे.

SUB DIVISIONAL OFFICER, THANE, SUB DIVISION THANE

NOTIFICATION

No. TD/T-5/LAQ-SR-52/2022.— Whereas, The Right to Fair Compensation and Transparency in Land Acqusition, Rehabilitation and Resettlement Act, 2013 (hereinafter referred to as the said Act.) has been enacted, under the powers conferred by clause (e) of section 3 of the said Act. Government notification, Revenue and Forest Department No. संकीर्ण 11/2014/प्र.क्र.77/(भाग)अ-2,dated 11th September 2015 (hereinafter referred to as the said notification) has been published. According to the defintion comprised in clause (Za) of Section 3 of the said Act, it is mentioned that in connection with the acquisition of land for a public purpose for an area not exceeding 10,000 hectares in a district, the Collector of such district shall be deemed to be an Appropriate Government for the purpose of the said Act;

And, whereas, the Appropriate Government i.e. Dist. Collector of Thane has come to the conclusion that the land indicated in Schedule-I attached herewith are required or likely to be required as per the said notification (hereinafter referred to as the said land) for the public purpose the details of which are given in Schedule-II attached herewith. And hence, under sub-section (1) of Section 11 of the said Act, it is hereby notified that the said lands are required for the Mumbai Metropolitan Region Development Authority, Mumbai for Mogharpada Cardepot approach road of Metro Line-4, 4A, 10 & 11 for the public purpose shown in Schedule –I ;

And, whereas, Government of Maharashtra's Extraordinary Gazette No. Part Four-A, No. SIA.2025/C.R.91/A-2, dated 6th August 2025, has resolved that Public – Private Partnership mentioned in Section 10A of the said Act with the said projects in which land ownership will be continued with the State Government. Since such projects were exempted from the provisions of chapter two and three of the said Act, there is no need to determine the social impact for this project.

Therefore, it is hereby declared that no person, in accordance with sub-section 4 of section 11 of the said Act, shall make any transaction of the said land or shall create any third party interest in the said land, or any part thereof from the date of publication of this notification till the completion of the proceedings under chapter IV of the said Act :

Provided that, upon application by the owner of the said land or part thereof, the Collector may, in special circumstances, exempt such owner from the effect of the above provision by mentioning reasons in writing ;

However, any loss or damage caused to any person in violation of this provision purposely made will not be compensated by the Collector ;

It is further declared that according to sub-section (5) of section 11 of the said Act, the Sub-Divisional Officer is going to undertake and complete the exercise of updating of land records as prescribed by sub-rule (3) of rule 10 of the Right to Fair Compensation and Transparency Land Acqusition, Rehabilitation and Resettlement (Maharashtra) Rules, 2014 (hereinafter referred as the said rules) ;

Similarly, under the provision of sub-section (g) of section 3 of the said Act, the Collector being Appropriate Goverment is empowerd to designate Sub-Divisional Officer, Thane Sub-Division, Thane to carry out the functions of the Collector.

The Government, in Revenue and Forest Department, has published a notification in Government Extraodinary Gazette, dated 26/04/2018 and amended section 10 (A), of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) which provides that the appropriate government may, by notification in the public interest, be exempted from the application of the provisions of Chapter Two and Chapter Three of the said Act. Accordingly the notification by Government of Maharashtra has been published in Extraordinary Government Gazette Number Part Four-A, No. SIA.2025/C.R.91/A-2, dated 06th August 2025, and the said project is exempted from the application of the provision of chapter Two and Three being a public interest project in terms of public interest.
