DATED - 04/09/2024 NOTIFICATION The Maharashtra Regional & Town Planning Act, 1966 No. TPS -3024/231/CR-52/2024/ DP Sanction (Part) / UD - 30 :- Whereas, the Kannad Municipal Council, Dist. Chhatrapati Sambhajinagar, being the Planning Authority (hereinafter referred to as " the said Planning Authority") vide its Resolution No.02, dated the 02/02/2021, declared its intention under section 23(1), read with section 38 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Maharashtra XXXVII of 1966) ( hereinafter referred to as " the said Act"), to prepare the Draft Development Plan [Origi- nal sanction (3rd Revised ) + Extended Limit (2nd Revised)] ( hereinafter, referred to as " the said Draft Development Plan") and noice such declaration was published in the Official Gazette, Chhatrapati Sambhajinagar Division Supplement dated the18 to 24 February, 2021;

And whereas, the said Planning Authority after carrying out surveys of its Area as required under Section 25 of the said Act, decided to publish a Draft Development Plan under section 26(1) of the said Act, vide its Resolution No. 19, dated the 09/11/2022 and notice to that effect is published in the Official Gazette, Chhatrapati Sambhajinagar Divisional Supplement dated the 17 to 23 November, 2022, for inviting suggestions and / objections;

And whereas, after considering the suggestions and objections to the said Draft Development Plan received within stipulated period, the Planning Committee appointed under section 28 (2) of the said Act, has submitted its report to the said Planning Authority;

And whereas, after considering the report of Planning Committee, the Planning Authority vide its Resolution No. 37, dated the 14/03/2023, had decided to make some modifications and to publish such modifications in the said Draft Development Plan ( hereinafter referred to as " the said Modifications"), which were published in the Official Gazette, Chhatrapati Sambhajinagar Divisional Supplement, dated the 23 - 29 March under Section 28 (4) of the said Act ;

And whereas, in accordance with the provision of sub-section (1) of Section 30 of the said Act, the said Planning Authority has submitted the said Draft Development Plan, along with the said Modifications to the Government for sanction vide its Marathi letter No. 821, dated the 21/03/2023;

amended proviso to sub-section (1) (two) of section 31 of the principal Act under section 3 of the Maharashtra Regional Planning and Town Planning (Amendment) Àct, 2024, the said draft development plan is to be approved by the Government ;

Now therefore, in exercise of the powers conferred by section 31 (1) of the said Act and of all other powers enabling it on that behalf, the Government of Maharashtra hereby :-

01. A) Accords Sanction the said Draft Development Plan of the Area within Kannad Municipal Council, as specified in SCHEDULE -A (as SM-1 to SM-2) appended hereto, excluding the substantial Modifications (as EP-1 to EP-21) as specified in SCHEDULE -B appended to Notice No. TPS- 3024/231/CR-52/2024/EP- Publish/UD-30, dated 04/09/2025.

B) Extends the period prescribed under amended proviso to sub- section (1) (two) of section 31 of the principal Act under section 3 of the Maharashtra Regional Planning and Town Planning (Amendment) Act, 2024, for sanctioning the said Draft Development Plan up to and inclusive of date 04/09/2025.

C) The Said Sanctioned Development Plan, called the Final Development Plan of the Area within Kannad Municipal Council shall come into force, after 30 days from the publication of this Notification in the Official Gazette.

Note :- 1) The reservations / allocations /designations which do not appear in the Schedule-A appended to this Notification and Schedule-B appended to Notice No. TPS - 3024/231/ CR- 52/2024/EP- Publish/UD-30 dated the 04/09/2025, are hereby sanctioned for the respective purpose as designated in the Development Plan.

2) The Unified Development Control and Promotion Regulation sanctioned vide Noification No TPS-1818/CR-236/ 18/Section 37(1AA)(C) and Section 20(4)/UD-13, dated 02/12/2020, as amended from time to time , shall be applicable to the said Area of the Kannad Municipal Council, Dist. Chhatrapati Sambhajinagar,

1) The Divisional Joint Director of Town Planning, Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar.

2) The Assistant Director of Town Planning, Chhatrapati Sambhajinagar Branch, Chhatrapati Sambhajinagar.

3) The Chief Officer, Kannad Municipal Council, Dist.Chhatrapati Sambhajinagar.

NOTICE

Now, therefore, in exercise of the powers conferred under Section 31(1) of the said Act and all other powers enabling it on that behalf, the Government of Maharashtra hereby :-

The Maharashtra Regional & Town Planning Act, 1966

No. TPS - 3024/231/ CR-52/2024/EP Publish / UD - 30 :- Whereas, the Kannad Municipal Council, Dist. Chhatrapati Sambhajinagar, being the Planning Authority (hereinafter referred to as " the said Planning Authority") vide its Resolution No.02, dated the 02/02/2021, declared its intention under Section 23 (1), read with section 38(1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Maharashtra XXXVII of 1966) ( hereinafter referred to as "the said Act") to prepare the Draft Development Plan [Original sanction (3rd Revised) + Extended Limit (2nd Revised)] ( hereinafter referred to as " the said Draft Development Plan") and notice such declaration was published in the Official Gazette, Chhatrapati Sambhajinagar Division Supplement, dated the 18 to 24 February, 2021;

And whereas, after considering the suggestions and objections to the said Draft Development Plan received within stipulated period, the Planning Committee appointed under section 28(2) of the said Act, has submitted its report to the said Planning Authority;

Ànd whereas, in accordance with the provision of sub-section (1) of Section 30 of the said Act, the said Planning Authority has submitted the said Draft Development Plan, along with the said Modification to the Government for sanction vide its Marathi letter No. 821, dated the 21/03/2023;

A) Gives notice inviting suggestions and objections from any person in respect of the proposed substantial modifications as specified in the SCHEDULE -B appended hereto, within the period of 30 days from the date of publication of this notice in the Official Gazette.

B) Appoints the Divisional Joint Director of Town Planning, Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar as the " Officer" under section 31(2) of the said Act to hear all suggestions and/or objections as stated in (A) above and to submit his report thereupon to the Government for further necessary action.

02. Only the suggestions and/or objections regarding substantial modifications mentioned in SCHEDULE -B that may be received by the Divisional Joint Director of Town Planning, Chhatrapati Sambhajinagar Division, having his office at M.B.C. Tower, Second Floor, Near Baba Petrol Pump, Adalat Road, Chhatrapati Sambhajinagar-431001 within the stipulated period of 30 days from the date of publication of this Notice in the Official Gazette, shall be considered .

03. Copy of the said Notice along with SCHEDULE-B and the plan showing the proposed substantial modifications shall be made available for inspection to general public at the following offices during office hours on all working days.

3) Lands shown in the Industrial Zone according to the sanctioned Development Plan, as well as the lands where existing industrial use is currently present or was present earlier but is now closed, even if such lands are designated under various zones in the current Development Plan, the Planning Authority shall be bound to decide on development permissions for such lands in accordance with the provisions of Regulation No.4.8.1 of the UDCPR.

The aforesaid final Development Plan of the Kannad Municipal Council, Dist. Chhatrapati Sambhajinagar partly sanctioned by the State Government vide this Notification shall be kept open for inspection by the general public during office hours on all working days for a period on one month from the date of coming into force of this Development Plan, in the office of the Chief Officer, Kannad Municipal Council, Dist.Chhatrapati Sambhajinagar.

१८२०/६१४/.ॅ.७९/२०२१/ह्यम्-१३, dated 27.03.2025, has been delegated the powers as per the provisions of section 154 of the said Act to the respective Assistant Director of Town Planning, Branch Office, of the Concerned District, in order to carry out the process under the provisions of section 20 (3) of the said Act regarding the draft Road Network Plans for the areas within Maharashtra Region and Town Planning Act, 1966 Notice under the provisions of section 20 (3) of the said Act in pursuance with the provisions of the Regulation No. 5.1.1 (i) of the Unified Development Control & Promotion the Regional Plan area;

Whereas, the State Government has been sanctioned the Regional Plans for various Regions in Maharashtra State as per the provisions of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as 'the said Act'); And whereas, the Unified Development Control and Promotion Regulations for Maharashtra State (with some exceptions) has been sanctioned under the provisions of section 37(1AA) (c) & 20(4) of the said Act, by the Government in Urban Development Department vide Notification No. TPS- 1818/CR-236/18/DP & RP/Sec.37 (1AA)(c) & 20(4)/UD-13, dated 02.12.2020 and come into force with effect from 03.12.2020 and it is applicable for the area under Regional Plans (hereinafter referred to as 'the said Regulations');

And whereas, as per the provisions of Regulation No. 5.1.1 of the said Regulations, the areas in Regional Plan within a belt of 2 km from the boundaries of Municipal Corporation, 1 km from the boundaries of Municipal Council and 0.50 km from the boundaries of Nagar Panchayat, where zone plans are prepared or not prepared,appropriate Road Network Plans to be prepared for such areas;

attached to the said notice to hear the suggestions and objections from the public within the prescribed period of 30 days, therefore, the said notice is being published in the Maharashtra Government Gazette under the provisions of section 20 (3) of the said Act;

The suggestions/objections received by the office of Assistant Director, Town Planning, NandedBranch, Nandedwithin 30 days from the date of publication of this notice in the Maharashtra Government Gazette will be considered;

And therefore, now, it is necessary to publish the Development Control & Promotion Regulations Whereas, the State Government has sanctioned the Regional Plans for various Regions in Maharashtra State as per the provisions of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as 'the said Act'):

And whereas, the Unified Development Control and Promotion Regulations for Maharashtra State (with some exceptions) has been sanctioned under the pro- visions of section 37(1AA) (c) & 20(4) of the said Act, by the Government in Urban Development De- partment vide Notification No. TPS-1818/CR-236/ draft Road Network Plans in the said area as per "Schedule-A' attached to the said notice to hear the suggestions and objections from the public within the prescribed period of 30 days, therefore, the said notice is being published in the Maharashtra Government Gazette under the provisions of section 20(3) of the said Act;

If any person have any suggestions/objections in accordance with the Draft Road Network Plans, they should send suggestions/objections in writing to the office of the Assistant Director of Town Planning, Branch Dharashiv, within the period of 30 days from 18/DP & RP/Sec.37 (1AA)(c) & 20(4)/UD-13, dated 02.12.2020 and come into force with effect from 03.12.2020 and it is applicable for the area under Re- gional Plans (hereinafter referred to as 'the said Regu- lations'):

And whereas, as per the provisions of Regulation No. 5.1.1 of the said Regulations, the areas in Re- gional Plan within a belt of 2 km. from the boundaries of Municipal Corporation, 1 km. from the boundaries of Municipal Council and 0.50 k.m. from the bound- aries of Nagar Panchayat, where zone plans are pre- pared or not prepared, appropriate Road Network Plans to be prepared for such areas;

And whereas, as per the provisions of Regulation No. 5.1.1 of the said Regulations, the Government in the date of publication of this Notice in Maharashtra Government Gazette. The suggestions/objections re- ceived by the office of Assistant Director. Town Plan- ning. Branch Dharashiv within 30 days from the date of publication of this notice in the Maharashtra Gov- ernment Gazette will be considered,

The draft Road Network Plans are available for the public inspection during office hours at the office of the Assistant Director of Town Planning. Dharashiv Branch, Dharashiv. The copies of the said draft Road Network plans and its particulars shall be available to the public at reasonable price in the office of the Assis- tant Director of Town Planning Branch, Dharashiv.

Also excluded part has been sanctioned vide TPS-3714/623/CR-171(A)/2014/UD-30 dated 31/08/2015 EP 1 to 45.

And whereas the Latur municipal corporation has decided the following modification under section 37 of Maharashtra Regional and town Planning act 1966 in the revised development plan of Latur municipal corporation by passing the resolution from time to time as described below.

And therefore, this notice is published for inviting sug- gestions/objections from the public to carry out "The said modification in sanctioned development plan" as per the pro- visions U/s 37(1) of Maharashtra Regional and Town Planning' Act, 1966. The Plan showing "The said modifica- tion" is displayed on the notice board in the office of Hingoli Municipal Council, Hingoli. Any person who wants to' sub- mit his suggestion or objection to the said modification may submit within one month from the date of publication /of hhiy notice in Maharashtra Government Gazette and in news- paper. Suggestions/Objections received in above said pe- riod only, will be considered by Hingoli Municipal Council.

Whereas, the second revised Development Plan of Hingoli Municipal Council has been sanctioned partly by Government vide notification no.TPS.3118/1396/CR-136/2018/ UD-30 Dt.10th February 2019 which came into force with effect from 13th June 2019. Also Government sanctioned the Excluded Part (E.P.) of Development plan vide notification no TPS.312.0/296/CR-42/202G/UD-30 Dt.5th March 2021 which came into force with effect from 23rd April 2021.
