No.D.T.P-D.P.Achalpur [O(R)+A]-Sec-127(2)-Order-TPV-VI,-7725.–
Whereas, the Development Plan of Achalpur Municipal Council has been sanctioned as per the provisions of section 31 (१) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXX- VII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department Notification No. TPS-2899-7639-CR-123A-99-UD-30,dt 15th January, 2003 (hereinafter referred to as "the said Notification") & has come into force with effect from dt. 1st March, 2003 (here- inafter referred to as "the said Sanctiioned Revised Development Plan");
And whereas, in the said Sanctioned Revised Development Plan, land situated at Mouza Khel Tapmali Sheet Nos.20 and 21, Survey Nos. 20 and 10, admeasuring 1.240 Ha. are affected by Res- ervation No. 62, "Garden" (hereinafter referred to as "the said Reservation") and the Planning and Appropriate Authority for the acquisition and development of the said Reservation is Municipal Council, Achalpur (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land affected by the said Reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Revised Development Plan has come into force;
And whereas, on behalf of the concerned land owner (hereinafter referred to as "the said Land Owner") of the land bearing S. No. 20/2 admeasuring area approximately 1.04 Ha. of Mouza Khel Tapmali affected by the said Reservation (hereinafter referred to as "the said Land") Adv. Shri. G. K. Mundhada had served a notice as per the provisions of section 127(१) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 9th November, 2020 and same has been received by the Achalpur Munical Council on 10th November, 2020
And whereas, the said land under the said Reservation is not acquired or no steps as required as per the provisions of section 127 (१) of the said Act have been taken by the Appropriate Authority, within the stipulated period from the date of service of the said notice by the said land owner as per the provisions of section 127 of the said Act;
And whereas, in the writ petition No. 2012/2024 filed by the said Land Owners of the said Land in the Hon'ble High Court-Mumbai, Nagpur Bench, the Hon'ble High Court has by decision dated 12th June, 2025 (hereinafter referred to as "the said Decision") the said Reservation on the said land been declared to have lapsed as per the provisions of section 127 of the said Act and has directed to pass orders in this regard;
And whereas, the Chief Officer, Municipal Council, Achalpur letter No. 3781/2025, dated 17th July, 2025, submitted the proposal to publish the order under the provisions of section 127 of the said Act that, the said Reservation on the said Land is lapsed as per the said decision; and has further stated that, an area admeasuring 3400 sq.m. from the said land is affected by the said Res- ervation, as marked on the part plan of the said Sanctioned Revised Development Plan.
And whereas, the Joint Director of Town Planning, Amravati Division Amravati letter No. 825, dated 16th September, 2025, has submitted report that, it is necessary to issue order under the provisions of section 127 of the said Act per the said decision of the Hon'ble High Court for lapsing of the said Reservation;
And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Revised Development Plan, the Director of Town Planning,७ महाराष्ट्र शासन राजपत्र भाग एक-अ अमरावती विभागीय पुरवणी, जानेवारी २२-२८, २०२६/माघ २-८ शके १९४७ Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under provisions of section 127(२) of the said Act, regarding the partial lapsing of the said Reservation on the area admeasuring approximately 3400 Sq. mt. (0.34 HA.) of the said land;
And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, Resolution No.TPS-1813-3211-CR-508-UD-13, dated 01st December, 2016, has delegated the powers exercisable by it as per the provisions of section 127 (२) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;
Now therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said land as per the provisions of section 127 (२) of the said Act & for that purpose amends the said Notification of the said Sanctioned Revised Development Plan, as follows-
After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be added:-

A copy of the part plan of the said Sanctioned Revised Development Plan showing the area of the said Land which is lapsed from the said Reservation, is available in the office of the Chief Officer, Municipal Council, Achalpur, District Amravati during office hours on all working days for inspection to public upto one month.

Act, 1966 to sanctioned develoment Plan of Amravati (Revised).

The development plan of Amravati (R) has been sanctioned by the Government in Urban Development by Notification No. TPS-2892-1180-CR-90-92 (B)-UD-13, Dated 4th December, 1992 and it has come into force with effect from 25th February, 1993. In pursuance of the letter No. TPS- 2825-677-2025-UD-30, dated 14th August, 2025 received from the Urban Development dept. of Govt. of Maharashtra, Amravati Municipal Corporation through its Administrators resolution intends to make the following modification u/s 37 (१) of Maharashtra Regional and Town Planning Act, 1966 to sanctioned Development Plan of Amravati (Revised)९ महाराष्ट्र शासन राजपत्र भाग एक-अ अमरावती विभागीय पुरवणी, जानेवारी २२-२८, २०२६/माघ २-८ शके १९४७

The copies of the plan showing there on the above said modification in the Development plan of Amravati (R) signed by Assistant Director of Town Planning, Municipal Corporation, Amravati along with the copies of the guidelines of the Government for modification were kept in the office of Amravati Municipal Corporation for inspection by public during office hours on all working days.
The suggestion and objection from any person which may be received in writing or on lineweb site .. by the Municipal Corporation, Amravati within the period of one month (30 days) from the date of publication of this notice in the shall be considered by this corporation before submitting it to Government for sanction.
