आवणे ज्याअर्थी, उक्ती वनांयमािलीतील विवनांयम १४.८ हा " नांागरी पींनांरुत्र्थीानां योजानांा" (यापींढे या उल्लेख "URS" असा करीण्याती आलेला आहाे.) संभाती आहाे; आवणे ज्याअर्थी, विवनांयम १४.८.१(iii) मध्ये नांागरी पींनांरुत्र्थीानां योजानांेअंतीगती समाविष्टी करीतीा येणेाऱ्या इमारीती / संरीनांांच्या प्रकारीांविषयी तीरीतीू करीण्याती आली आहाे. त्यातील उपीखंड (c) नांसारी वकमानां ३० िषे जांनांी असलेली अवकृती (Authorized) बांकामे URS मध्ये समाविष्टी करीतीा येतीाती. तीसे विवनांयम १४.८.१(iii) मील उपीखंड (f) नांसारी, ३० िषापीेक्षेा कमी ियाी पीरींतीं मानांिी वनांिासासाठी अयोग्य (Unfit for human habitation) असलेली इमारीती URS मध्ये समाविष्टी करीतीा येऊ शाकतीे;
आवणे ज्याअर्थी, नांिी मं ंबई महानांगरीपीावलकेकडील (यापींढे ज्या उल्लेख "उक्ती महानांगरीपीावलका" असा करीणेती आलेला आहाे) व.०१/१०/२०२५ ि व.१९/११/२०२५ रीोजाी पीत्रा प्राप्ती झाली असूनां सरी पीत्रांमध्ये नांमू केले आहाे की, उक्ती महानांगरीपीावलकेकडे विवि सहाकारी गृहावनांमाणे संस्र्थीांकडूनां विवनांयम १४.८ अन्िये URS अंतीगती पींनांविकास प्रस्तीाि प्राप्ती झाले आहाेती. सरी प्रस्तीािांमील
(१) २ महाराष्ट्रट शासन राजपत्र असाधाराण भाग एक–मध्य उप-विभाग, जानेाराी २९, २०२६/माघ ९, शाके १९४७ सि इमारीती अवकृती असूनां त्यांे िय ३० िषापीेक्षेा कमी आहाे. सरी इमारीती CIDCO कडूनां EWS / LIG घटीकासाठी विकवसती करीण्याती आलेल्या असूनां त्यातील सवनांकांे क्षेत्राफळ ३०० ौ.फुटीांपीेक्षेा कमी आहाे असे नांमू केले आहाे;
आवणे ज्याअर्थी, असे वनांशानांास आले आहाे की, पीूिी योग्य रीाहाणेीमानांासाठी विारीाती घेतीलेले वकमानां क्षेत्राफळ प्र्थीम १८० ौ.फूटी हाोतीे, त्यानांतीरी तीे २२५ ौ.फूटी करीण्याती आले, त्यानांतीरी पींन्हा २६९ ौ.फूटी करीण्याती आले आवणे आतीा तीे िाढेिूनां ३०० ौ.फूटी (२७.८८ ौ.मी.) करीण्याती आले आहाे. हाे वकमानां क्षेत्राफळ प्रानांमंत्राी आिास योजानांा – शाहारी (PMAY-U) अंतीगती ेखील वनांारिरीती करीण्याती आले आहाे, ज्या उद्देशा "सिासाठी घरीे" उपीलब् करूनां ेणे हा आहाे. त्यामंळे, एखाी इमारीती भौवतीकृष्ट्या संरीवक्षेती स्थिस्र्थीतीती असली तीरी, जारी त्या इमारीतीतील बहांसंख्य सवनांका ३०० ौ.फूटीांपीेक्षेा कमी क्षेत्राफळाच्या असतील, तीरी अशा रीवहािाशांनांा इमारीती ३० िषे पीूणे हाोईपीयती आणेखी काहाी िषे अवनांिायपीणे प्रतीक्षेा करीण्यास सांगणे वकंिा इमारीती जाीणे अिस्र्थीेती जाईपीयती िाटी पीाहाण्यास सांगणे, संयंस्थिक्तीक ठीरीणेारी नांाहाी, जाेणेकरूनां त्यांनांा योग्य रीाहाणेीमानां वमळू शाकेल. तीसे, जारी सरी इमारीती अनांवकृती असती, तीरी ती URS अंतीगती समाविष्टी करीण्याती आली असती आवणे सि रीवहािाशांनांा ३०० ौ.फूटी क्षेत्राफळाे पीयायी वनांिासस्र्थीानां उपीलब् करूनां ेण्याती आले असतीे. त्यामंळे, शासनांाे असे मती आहाे की, ज्या अवकृती इमारीती ३० िषे जांन्या नांाहाीती तीरी त्यामील बहांसंख्य सवनांका ३०० ौ.फुटीांपीेक्षेा कमी क्षेत्राफळाच्या आहाेती, अशा इमारीतींा URS अंतीगती समािेशा करीण्याबाबती विारी करीणे आिश्यक आहाे;
आवणे ज्याअर्थी, उक्ती महानांगरीपीावलकेी िरील विनांती तीसे िरी नांमू िस्तींस्थिस्र्थीती विारीाती घेतीा, उक्ती वनांयमािलीे विवनांयम १४.८.१ (iii) (c) मध्ये या सूनांेसोबतीच्या पीरिरीवशाष्टीाती नांमू केल्याप्रमाणे संारीणेा करीणे आिश्यक आहाे (यापींढे ज्या उल्लेख "प्रस्तीाविती फेरीबल" असा करीण्याती आलेला आहाे) असे शासनांाे मती झाले आहाे;
आवणे त्याअर्थी, उपीरीोक्ती िस्तींस्थिस्र्थीती तीसे उक्ती अववनांयमाच्या कलम ३७ च्या पीोटी-कलम (१कक) अन्िये प्राप्ती अवकारी आवणे त्या संभातील सि शाक्तींा िापीरी करूनां, शासनां याद्वारीे प्रस्तीाविती फेरीबलाविषयी उक्ती अववनांयमाच्या कलम ३७, पीोटी-कलम (१कक) े खंड(क) नांसारी कोणेत्याहाी व्यक्तीकडूनां हारीकती/सूनांा मागविण्यासाठी तीसे संभाव्य बावती हाोणेाऱ्या व्यक्तींच्या मावहातीसाठी सरी सूनांा प्रवसध् करीती आहाे. शासनांाकडूनां अ़सेहाी कळविणेती येती आहाे की, सोबतीे पीरिरीवशाष्टीाती नांमू प्रस्तीाविती फेरीबलाविषयी कोणेत्याहाी हारीकती/ सूनांा महाराष्ट्र शासन राजपत्रात सरी सूनांा प्रवसध् झाल्याच्या वनांांकापीासूनां एक मवहान्याच्या आती संबंवती सहासंालक, नांगरीरीनांा, कोकणे/ पींणे/ नांावशाक/ नांागपीूरी/ अमरीािती/ संभाजाीनांगरी विभाग या कायालयाे पीत्त्यािरी पीाठीविण्याती याव्याती. सरी प्राप्ती हारीकती/सूनांांिरी संनांािणेी ेऊनां तीसे लागू असेल त्याप्रमाणे उक्ती महानांगरीपीावलके म्हाणेणे घेऊनां त्यािरील अहािाल शासनांास सारी करीण्यासाठी संबंवती सहासंालक, नांगरीरीनांा, कोकणे/ पींणे/ नांावशाक/ नांागपीूरी/ अमरीािती/ संभाजाीनांगरी विभाग यांनांा शासनांाे ितीनांे "अवकारी" म्हाणेूनां प्रावकृती करीण्याती येती असूनां त्यांच्याकडे सरीच्या कालािीती प्राप्ती हाोणेाऱ्या हारीकती/सूनांा यािरी उक्ती अववनांयमाच्या कलम ३७ च्या पीोटी-कलम (१कक) अन्िये कायिाहाी करीण्याती येईल;
शासनां याद्वारीे उक्ती अववनांयमाे कलम १५४(१) अन्िये वनांेशा ेती आहाे की, उक्ती अववनांयमाे कलम ३७(१कक) े उपीकलम (ग) अन्िये प्रस्तीाविती फेरीबलास शासनां मान्यतीा प्रलंवबती असेपीयती प्रस्तीाविती फेरीबल लगोलग अंमलाती येईल.
उक्ती अववनांयमाे कलम ३७(१कक) अन्िये सरी फेरीबलाी सूनांा महारीाष्ट्र शासनांाच्या www.maharashtra.gov.in (काये /वनांयम ) या िेबसाईटीिरी ेखील उपीलब् करीण्याती आले आहाे.

NOTICE
Maharashtra regional & town Planning act, 1966.
No. TPB- 4325/1995/C.R.1/2026/UD-11.— Whereas, the Government of Maharashtra has sanctioned the Unified Development Control and Promotion Regulations('UDCPR')(hereinafter referred to as "the said Regulations") for the state except Municipal Corporation of Greater Mumbai, other Planning Authorities/Special Planning Authorities /Development Authorities within the limits of Municipal Corporation of Greater Mumbai, MIDC, NAINA, Jawaharlal Nehru Port Trust, Hill Station Municipal Councils, Eco-Sensitive/ Eco-Fragile region notified by MoEF & CC and Lonavala Municipal Council and Area under CIDCO's jurisdiction as Planning Authority, PCNTDA, MIHAN, MADC, MSRDC, in Maharashtra under the provisions of said Act vide Notification No.TPS-1818/ CR.238/18/DP. & RP./Sec.37 (1AA)(c) & sec.20(4)/UD-13, dated 02/12/2020) (hereinafter referred to as "the said Notification");
And whereas, Regulation 14.8 of the said Regulations is regarding 'Urban Renewal Scheme'(hereinafter referred to as "URS"); and whereas, Regulation 14.8.1 (iii) stipulates about the type of buildings / structures that may be included in Urban Renewal Scheme and whereas, sub-clause ( c) of Regulation 14.8.1(iii) stipulates that Authorized buildings which are at least 30 years of age that may be included in URS; also as per sub-clause (f) of Regulation 14.8.1 (iii), any other buildings which may be less than 30 years of age which are unfit for human habitation as stipulated in the said provision, such buildings may be included in the URS;
And whereas, the Government in Urban Development Department has received letters dated 01/10/2025 and dated 19/11/2025 from the Navi Mumbai Municipal Corporation (hereinafter referred to as "the said Municipal Corporation") wherein it is stated that the said Municipal Corporation is in receipt of redevelopment proposals under URS as per Regulation 14.8 from various Co-operative Housing Societies; it is stated that all buildings are authorised and said buildings are of age less than 30 years; these buildings were developed by CIDCO for EWS/ LIG component and having area less than 300 sq.ft.;
And whereas, it is seen that, in past minimum area that was considered for proper living was first 180 sq. ft., then it was raised to 225 sq.ft. and again to 269 sq.ft. and now it has been increased further to 300 sq.ft. (27.88 sq.mt.) which is also the minimum size under PMAY-U that purports to give housing to all. Thus, even if a building is physically in a safe condition, if it has majority of tenements of size less than 300 sq.ft., it may not be prudent to ask them to wait necessarily for further few years to become 30 years old or to wait for it to become dilapidated for them to have proper living. Again, had building been unauthorised we would include that in URS and give all occupants 300 sq.ft. alternate accommodation. Therefore, Government is of the view that inclusion of authorised buildings in the URS even if these are not 30 years old but have majority of houses less than 300 sq.ft. needs consideration;
And whereas, considering the above request of said Municipal Corporation and stated views above, the Government is of the opinion that it is necessary to modify Regulation 14.8.1(iii) (c) of the said Regulations as specifically mentioned in Schedule appended with this Notice (hereinafter referred as "the Proposed modification");
Now, therefore, after considering above stated facts and in exercise of the powers conferred by sub-section (1AA) of Section 37 of the said Act; and of all other powers enabling it in this behalf, Government hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed modification, as required by clause (a) of sub-section (1AA) of Section 37 of the said Act, for information of all persons likely to be affected thereby; The Government is further pleased to inform that any objections/ suggestions in respect of the proposed modification mentioned in the Schedule attached herewith may be forwarded, before the expiry of one month from the date of publication of this Notice in the Maharashtra Government Gazette, to the concerned Jointमहाराष्ट्रट शासन राजपत्र असाधाराण भाग एक–मध्य उप-विभाग, जानेाराी २९, २०२६/माघ ९, शाके १९४७ ५ Director of Town Planning, Konkan / Pune/ Nashik/ Nagpur/ Amaravati / Sambhajinagar Division. Any objections or suggestions, which may be received within the said period will be dealt with in accordance with the provisions of sub-section (1AA) of Section 37 of the said Act by the concerned Joint Director of Town Planning, Konkan / Pune/Nashik/Nagpur/Amaravati /Sambhajinagar Division, who is hereby authorized under the said Act as an "officer" on the behalf of Government to hear objections/suggestions which are received and say of the said Corporation, as the case may be and submit his report to the Government;
Government hereby issues directive under Section 154(1) of the said Act that, pending the sanction of the proposed modification under clause (c) of section 37(1AA) of the said Act by the Government, the proposed modification shall come into force forthwith.
This Notice under sub-section (1AA) of Section 37 of the said Act shall also be available on the Govt. of Maharashtra website: www.maharashtra.gov.in ( Acts/Rules )
