And whereas, in the Writ Petition No. 1724/2024 filed by the said Land Owner in the Hon'ble High Court, Mumbai, BY DIRECTORATE OFTOWN PLANNING PUNE ORDER

Aurangabad Bench, the Hon'ble Court has passed on order Maharashtra Regional & Town Planning Act, 1966.

Kannad (Ext Limit)/Site No.18/S.No.25/4/ A/ Sec-127(2)/Order/ TPV-V/1511, Date :- 26/03/2025. : - Whereas, the Development Plan of Kannad Municipal Council, ( Ext Limit) has been partly sanctioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966 ) ( hereinafter referred to as " the said Act") by the Government of Maharashtra in Urban Development Department vide Notification No. TPS-3005/1352/C.R.- 205(A)/2005/UD-30, dated 29/06/2006 ( hereinafter referred to as " the said Sanctioned Development Plan") and the same has come into force with effect from 15/08/2006 Also the Excluded Part of the Development Plan of Kannad Municipal Council ( Ext Limit) has been partly sanctioned by the Government of Maharashtra in Urban Development Department vide Notification No. TPS-3007/1165/C.R.-228(B)/ 2007/UD-30, dated 25/07/2008 ;

And whereas, as per the said sanctioned Development Plan, the land bearig S.No 25/4/A (Part) of Mauje Kannad, Tal.

Kannad, Dist. Chhatrapati Sambhajinagar is affected by Reservation Site No.18 - 'Play Ground' ( hereinafter referred to as " the said Reservation") and the Appropriate Authority for acquisition and development of the said Reservation is Municipal Council, Kannad ( hereinafter referred to as " the said Appropriate Authority");

And whereas, the land under the said Reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Development Plan come into force ;

And whereas, the concerned land owner ( hereinafter referred to as "the said land Owners") of the land bearing S. No 25/4/A (part) ( hereinafter referred to as "the said land") had served notice for the said Reservation on the said lands as per the provisions of section 127 (1) of the said Act dated 25/06/2020 ( hereinafter referred to as "the said notice") on the said Appropriate Authority which was received by the said Appropriate Authority on 06/08/2020;

And whereas, the said land under the said Reservation is not acquired or no steps as required as per the provisions of section 127 (1) of the said Act have been taken by the said Appropriate Authority, within a stipulated period of 24 months after receipt of the said notice ;

dated 27/08/2024 (hereinafter referred to as "the said Order") stating that, the said Reservation on the land of the petitioners stand lapsed and directed the Respondents to issue notification under section 127 (2) of the MRTP Act; And whereas, the Chief Officer, Municipal Council, Kannad vide letter No. 3535, dt. 18/11/2024 and letter No. 150, dt. 16/01/2025 has submitted a report.

And whereas, the Assistant Director of Town Planning, Chhatrapati Sambhajinagar Branch, Chhatrapati Sambhajinagar vide letter No. 1025, dt. 08/10/2024 and the Joint Director of Town Planning,Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar vide letter No.219, dt. 05/02/2025 has stated that, in regards with the said notice, the said Reservations on the said land has been lapsed and accordingly has submitted a report for issuance of notification as per the provisions of section 127 (2) of the said Act;

And whereas, after considering the above facts in respect of the said Reservation on the said land in the said sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of section 127 (2) of the said Act, regarding the lapsing of the said Reservation on the said land;

And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No. TPS-1813/3211/C.R.-508/UD-13, dated 01/12/2016 has delegated the powers exercisable by it as per the provisions of section 127 (2) of the said Act in respect of Development Plans of all Municipal Councils / Nagar Panchayat / Zilla Parishad as a Planning Authority to the Director of Town Planning Maharashtra State, Pune;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune by this order and as mentioned in the Schedule hereinafter hereby notifies the lapsing of the said Reservation in respect of the said land as per the provisions of section 127 (2) of the said Act and for that purpose amends the said Notification of the said sanctioned Development Plan, as follows :-

After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added :-

And whereas, the Assistant Director of Town Planning, Chhatrapati Sambhajinagar Branch, Chhatrapati Sambhajinagar vide letter No. 1026, dt. 08/10/2024 and the Joint Director of Town Planning, Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar vide letter No.221, dt. 05/02/2025 has stated that, in regards with the said notice, the said Reservations on the said land has been lapsed and accordingly has submitted a report for issuance of notification as per the provisions of section 127 (2) of the said Act;

And whereas, after considering the above facts in respect of the said Reservation on the said land in the said sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of section 127 (2) of the said Act, regarding the lapsing of the said Reservation on the said land;

And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No. TPS-1813/3211/C.R.-508/UD-13, dated 01/12/2016 has delegated the powers exercisable by it as per the provisions of section 127 (2) of the said Act in respect of Development Plans of all Municipal Councils / Nagar Panchayat / Zilla Parishad as a Planning Authority to the Director of Town Planning Maharashtra State, Pune;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune by this order and as mentioned in the Schedule hereinafter hereby notifies the lapsing of the said Reservation in respect of the said land as per the provisions of section 127 (2) of the said Act and for that purpose amends the said Notification of the said sanctioned Development Plan, as follows :-
