आदिण ज्याअर्थी सारा असांरादिता कामंगीारांनांा दिमंळीणाऱ्या फायद्यांांर्ची तापोासाणी केल्यानांतारा मंहाराष्ट्र ासानांार्चे असाे मंता आहाे की, सारा अंसारादिता कामंगीारा ज्या सांदिांर्चा फायद्यांांर्चा लाभो घेता आहाेता त्या सांदिा सारा अदिदिनांयमं योनांेद्वाराे ेण्याता येणाऱ्या सांदिा फायद्यांांपोेा कमंी अनांकूल नांाहाीता.

१. साूट दिलेल्या आस्र्थीापोनांेनांे त्याच्या मंालकानांे साूट ेण्याता आलेल्या कामंगीारांनांा मंार्थीाडी अदिदिनांयमंाच्या त्या अंतागीचता तायारा केलेल्या योनांेद्वाराे दिल्या ाणाराे कल्याणकाराी फायद्यांांपोेा कमंी कल्याणकाराी फाये ेण्याता येऊ नांयेता.
२. उक्ता मंालक / आस्र्थीापोनांा यांनांी साूट दिलेल्या कामंगीारांच्या सांभोाचता दिलेल्या ेतानांार्चा तापोील, राेर्चा तापोील तासाेर्च उक्ता आस्र्थीापोनांेसा लागीू असालेल्या इतारा कामंगीारा कायद्यांांतागीचता ेण्याता येणाराे कल्याणकाराी फाये तासाेर्च सालताी यांर्चे स्ताऐ अदिभोलेखं म्हाणूनां तानां कराेता सारा अदिभोलेखं मंडळीाच्या सामं प्रादिकराणानांे मंादिगीताल्यानांतारा सारा कराेता.
३. उक्ता आस्र्थीापोनांानांे साूट दिलेल्या कामंगीारांनांा दिकमंानां ेतानां अदिदिनांयमं, १९४८, ेतानां प्रानां अदिदिनांयमं, १९३६, उपोानां प्रानां चलनां) अदिदिनांयमं, १९७० अदिदिनांयमं, १९७२, भोदिष्य दिनांाचहा दिनांी अदिदिनांयमं, १९५२ आदिण कंत्राटी कामंगीारा अदिदिनांयमं (दिनांयमंनां दिनांमंू मंील लागीू असालेल्या तारातांीर्ची पोूताचता कराी.

६. पोलीस तपासणी.– साूट दिलेल्या आस्र्थीापोनांेच्या मंालकानांे त्यांच्याकडे कामं कराीता असालेल्या मंार्थीाडी कामंगीारांनांी भोाराताीय ंड दिानां सांहाीता, १८६० अन्ये पोूच इदिताहासाबाबता पोलीसा पोडताळीणी ाखंला सारा अदिसाूर्चनांा ाहाीरा केल्यापोासाूनां ताीनां मंदिहान्याच्या आता सांबंदिता पोलीसा प्रादिकाऱ्यांकडूनां मंडळीासा सारा केला असाल्यार्ची खंात्राी करूनां घेणे आश्यक असाेल.
७. वेतन व इतरा कायेदेशाीरा सवलती.– उक्ता मंालक आस्र्थीापोनांेनांे साूट दिलेल्या मंार्थीाडी कामंगीारांर्चे राष्ट्रीयकृता बँकेमंध्ये खंाताे उघेडाे साूट दिलेल्या कामंगीारांच्या ेय ेतानांाच्या राकमंेइताका राेखंांदिकता नांाे अर्थीा बँक ट्रान्साफाराद्वाराे रा मंदिहान्याच्या ७ ताराखंेपोयंता मंार्थीाडी कामंगीारांनांा ेतानां द्यांाे. मंार्थीाडी कामंगीारांनांा दिलेल्या ेतानांाबाबतार्चे सादिस्तारा तापोील पोरिरादिष्ट-अ मंील दिराणपोत्रामंध्ये भोरुनां मंार्थीाडी मंडळीासा रा मंदिहान्याच्या १० ताराखंेपोयंता पोाठाे. मंालकानांे खंाली चदिल्यापोेा कमंी नांाहाी असाे लाभो मंार्थीाडी कामंगीारांनांा द्यांाेता :-

८. अकिंतकाकिंलक भात्ता .– मंार्थीाडी कामंगीारांनांा दिमंळीणारा अदिताकादिलक भोत्ता हा मंडळीानांे दिनांयंक्ता केलेल्या मंार्थीाडी कामंगीारांच्या ताीरा त्याेळी लागीू असालेल्या रानांसारा ेतानां राच्या ंप्पोट रापोेा कमंी नांसा.
९. किंववराणपत्र सादरा कराणे .– भोदिष्य दिनांाचहा दिनांी राज्य कामंगीारा दिमंा योनांेर्ची गीचणी मंालकानांे दिनांयदिमंता भोरुनां सांबंदिता मंार्थीाडी कामंगीारांनांा त्यासांबंी ेळीोेळी पोात्या द्यांाव्याता प्रत्येक षंी तासाे केल्याबाबतार्चा अहाल ासानांासा, कामंगीारा आयंक्ता मंार्थीाडी मंडळीासा द्यांा.
(१) यापोूीच्या भोदिष्य दिनांाचहा दिनांीच्या राकमंा राज्य कामंगीारा दिमंा योनांेर्ची गीचणी भोराल्याबाबतार्चा पोंरा ासानांाकडे सारा अदिसाूर्चनांा दिनांगीचदिमंता झाल्यापोासाूनां ताीनां मंदिहान्यांच्या आता सारा करा, अन्यर्थीा सांबंदिता मंार्थीाडी कामंगीारांनांा ेण्याता आलेली साूट राद्द कराण्याता येईल.
(२) वाकिंर्षक किंववराणपत्र .– प्रत्येक मंालकानांे, सानांी लेखंापोाल यांनांी प्रमंादिणता केलेले ादिषंचक दिराणपोत्रा साोबता ोडलेल्या पोरिरादिष्ट-ब मंध्ये राषंी ३० ूनां पोयंता ासानांासा तासांर्च मंडळीासा सारा कराे, ज्याता मंालकानांे मंार्थीाडी कामंगीारांर्चा मंा केलेला भोदिष्यदिनांाचहा दिनांी कामंगीारा राज्य दिम्याबाबताच्या र्चलनांाच्या प्रताी इतारा तापोील असाेल.
१०. ओळखापत्र व हाजेराी काडेड देणे .– आस्र्थीापोनांेच्या मंालकानांे त्यांच्याकडे दिनांयंक्ताी केलेल्या मंार्थीाडी कामंगीारांनांा दिनांयंक्ता केल्यापोासाूनां ३० दिसांच्या आता ओळीखंपोत्रा हाेराी काडड ेईल.
११. एखंाद्यांा मंार्थीाडी कामंगीारासा त्याच्या दिनांासास्र्थीापोासाूनां ५० दिक.मंी. च्या दित्राज्येपोेा अदिक अंतारारा कामं कराण्यासाठी पोाठदिल्यासा मंालकानांे त्याच्या एकूण ेतानांाच्या २० टक्के राक्कमं त्याला भोत्ता म्हाणूनां द्यांाी.
१२. मंार्थीाडी कामंगीारांच्या फायद्यांासांभोाचता ासानांानांे दिकंा मंडळीानांे भोदिष्यकाळीाता घेातालेल्या अटी ताीर्चे पोालनां कराणे मंालकाला बंनांकाराक राहाील.
१३. मंालकाच्या आस्र्थीापोनांेसा लागीू असालेल्या कामंगीारा कायद्यांांच्या तारातांर्चा अलंब केल्यादिाय मंालक कोणत्याहाी कामंगीाराला कामंारुनां कमंी कराणे दिकंा कामंारुनां काढू टाकणे दिकंा कामंगीाराला बडताफाफ कराणे या प्रकारार्ची कोणताीहाी काराई कराणारा नांाहाी.
१४. साूट दिलेल्या आस्र्थीापोनांेच्या मंालकानांे उक्ता अटी ताीर्चा भोंगी केल्यासा सारा मंालकासा अदिसाूर्चनांेन्ये दिलेली साूट राद्द कराण्यासा अर्थीा काढूनां घेण्यासा ताो पोात्रा राहाील.

NOTIFICATION
Maharashtra Mathadi, haMal and Other Manual WOrkers (regulatiOn Of eMplOyMent and Welfare) act, 1969.
No. UWA 2026/C.R.07/LAB-5.– Whereas M/s. Pravin Masalewale, A/P- Bholi, Taluka- Khandala, District Satara, Maharashtra 415 526 has applied for grant of exemption in respect of its establishment in respect of certain unprotected workers whose names are mentioned in column(2) of Schedule I appended hereto (hereafter referred to as "the said unprotected workers") and who are engaged in connection with loading, unloading, stacking, carrying, weighing, measuring, filling, stitching, sorting, cleaning or such other work including work preparatory or incidental to such operations carried on in it. Under section 22 of the Maharashtra Mathadi Hamal and Other Manual Workers (Regulation of Employment and Welfare) Act. 1969 (Mah. XXX of 1969) (hereinafter referred to as "the said Act") from the operation of all the provisions of the said act and the Satara Mathadi Hamal and Other Unprotected Workers (Regulations of Employment & Welfare) Scheme, 1991 (hereinafter referred to as" the said Scheme ") made thereunder.
And Whereas the Government of Maharashtra after verification of the benefits enjoyed by the said unprotected workers, is of the opinion that the said unprotected workers are in enjoyment of benefits, which are on the whole not less favourable to them than the benefits provided by and under the said Act and the said Scheme;
Now, therefore, in exercise of the powers conferred by Section 14 (1) (1A) and Section 22 of the Maharashtra Mathadi, Hamal and Other Manual Workers (Regulation of Employment and Welfare) Act, 1969, and in pursuance of Government Notification, Industry, Energy and Labour Department No. UWA 2026/CR-07/Lab-5, dated 10th February, 2026, as no objections or suggestions have been received, hereby exempts the said unprotected workers, working in M/s. Pravin Masalewale, A/P.
Bholi, Taluka Khandala, District Satara, Maharashtra 415 526 from operations of all the provisions of the said Act and the said Scheme, subject to conditions specified in Schedule II appended hereto:-

SCHEDHULE -II
i. The said establishment/employer will not extend less favourable benefits to the exempted workers than those offered by the said Act and the Scheme made thereunder.
ii. The said establishment / employer shall maintain registers and records of exempted workers in their employment, relating to payment of wages and leave and other facilities provided to them under the relevant labour laws applicable to the exempted establishment and the same shall be produced before the Competent Authorities of the board, when so directed by the board.
iii. The said establishment/employer shall comply with the provisions of the Minimum Wages Act, 1948 (XI of 1948); the Payment of Gratuity Act, 1972 (XXXIX of 1972); the Employee's of Provident Fund, Miscellaneous Provisions Act, 1952 (XIX of 1952); and the Contract Labour (Regulation and Abolition) Act, 1970 (XXXVII of 1970); or any other Act as may be applicable to them, for the time being.
iv. The said establishment/employer shall make payment to the registered exempted workers employed by them, which shall not be less than the wages, other allowances and other benefit which are given to the registered workers of the Board.
v. The said establishment/employer shall submit its Yearly Statutory Audit Report to the Government on or before the 30th June after the end of every financial year.
vi. Police Verification .–– The employer shall ensure that the Police Verification of Mathadi Workers regarding non-involvement of him in any criminal acts under Indian Penal Code,1860, to the Board from the concern Police Authority within the period of three months from the date of Notification.
vii. Wages and other Statutory Benefits.–– Employer shall ensure that exempted Mathadi Workers shall open his account in a Nationalised Bank and employer shall remit the wages by crossed Cheque or Bank transfer to each Exempted Mathadi worker equivalent to his earned wages by 7th of every month. Statement showing details of wages paid in Annexure "A" shall submitted to the Mathadi Board by 10th of every month. The Employer shall give not less than the benefits to the Exempted Mathadi worker given below:--
EX- Gratia : 10% of Wages
Gratuity : 4% of Wages
Leave With Wages : 6% of Wages
Paid Holidays : 1% of Wages
Contributions to be deposited with the Competent Authorities in respect of various statues such as Provident Fund, E.S.I. etc. applicable to the Employer, shall be deposited by the Employer with such authority and challan thereof be submitted to the Board for information. The Employer should give regular receipt to the Mathadi worker and submit a consolidated report of the above said transactions to the Government, the Commissioner of Labour and the Mathadi Board every year. The Employer, in turn, shall ensure that the Mathadi workers employed at his establishment are getting wages and benefits not less favourable than those available under the Scheme. In case of default, the Employer shall be held responsible and shall be liable for cancellation of exemption.
viii. Overtime Allowances.–– Overtime Allowance should not be less than double the rates of wages existing at that time on the analogy of the Mathadi worker employed by the Mathadi Board.
ix. Filing of Returns.––
I. The Employer should make regular contribution of Employees' Provident Fund and ESIC (Where said act is applicable) of the concerned Mathadi workers and give regular Receipts to the Mathadi worker and submit a consolidated report of the above said transaction to the Government, the Commissioner of Labour and Mathadi Board every year.

The Employer should submit proof of the previous contributions of Employees Provident Fund and ESIC within a period of three months from the date of publication of this Notification to the Government. Otherwise the exemption given to the concerned Mathadi Workers will be cancelled.
III. Annual return.–– The Employer shall submit at Annual Return of P.F., E.S.I. duly certified by Chartered Accountant, in Annexure 'B' on or before 30th June of every year to the Government and the Board alongwith copies of Challans and other details.
x. Issue of Identity Cards/ Attendance Card.–– Every Employer shall issue identity card, to Mathadi workers engaged by them within the period of 30 days from appointment.
xi. If any Mathadi worker is asked to work beyond the radius of 50 kms. From his place of residence, the Employer shall pay an allowance @ 20% of total emoluments of such Mathadi worker.
xii. The Employer is liable to abide with any other terms and conditions, which may be imposed in favour of Mathadi worker by the Government of Maharashtra or Board in future.
xiii. No exempted Mathadi worker shall be removed/retrenched/dismissed/ terminated without following due process of labour laws applicable to the Employers Establishments.
xiv. Breach of any of above conditions by the Employer shall make Employer liable for cancellation or revocation of the exemption granted under this notification.
