भाराताचाे संप्रिवधान.

क्रमांकु एमईडीडी-५०२३(१)/८६/२०२५-एमएमडी(वाैसेवा-४)११९६१०६.— भारतेाच्या संटिवाधानांाच्या अनांच्छेदा ३०९ च्या पारंतेंकुाद्वारे दानां कुेलेल्या अटिधाकुारांचा वापार कुरूनां आटिणा याबाबतेीते यापाूवाी कुाढलेले सवाग टिवाद्यमानां टिनांयम, आदाेश टिकुंवा संलेख हे अटिधाक्रटिमते कुरूनां, महेाराष्ट्राचे राज्यपाल, याद्वारे, महेाराष्ट्रा शासनांाच्या वाैद्यकुीय टिशक्षणा वा औषधाीद्रव्ये टिवाभागाच्या शासकुीय टिनांयंत्रणाखालील, वाैद्यकुीय टिशक्षणा वा संशोधानां संचालनांालयाच्या आस्थापानांेवारील शासकुीय वाैद्यकुीय महेाटिवाद्यालय वा रुग्णालय यामधाील दांतेशास्त्र टिवाभागातेील ाध्यापाकु दांतेशास्त्र (ग अ) (राजपाटित्रते), सहेयोगी ाध्यापाकु दांतेशास्त्र (ग अ) (राजपाटित्रते), सहेायकु ाध्यापाकु दांतेशास्त्र (ग ब) (राजपाटित्रते) या पादांच्या सेवावाेशांचे टिवाटिनांयमनां कुरणारे पांढील टिनांयम कुरीते आहे :—

१. या टिनांयमांस, शासनांाच्या वाैद्यकुीय टिशक्षणा वा औषधाीद्रव्ये टिवाभागाच्या शासकुीय टिनांयंत्रणाखालील, वाैद्यकुीय टिशक्षणा वा संशोधानां संचालनांालयाच्या आस्थापानांेवारील शासकुीय वाैद्यकुीय महेाटिवाद्यालय वा रुग्णालय यामधाील दांतेशास्त्र टिवाभागातेील ाध्यापाकु दांतेशास्त्र (ग अ) (राजपाटित्रते), सहेयोगी ाध्यापाकु दांतेशास्त्र (ग अ) (राजपाटित्रते), सहेायकु ाध्यापाकु दांतेशास्त्र (ग ब) (राजपाटित्रते) (सेवावाेश) टिनांयम, २०२६, असे म्हेणावाे.

२. या टिनांयमांते, संदाभागनांसार दांसरा अथाग, आवाश्यकु नांसेल तेर,—

(कु) "टिनांयंक्तेी ाटिधाकुारी" याचा अथाग,—

(एकु) ग -अ या पादाकुरिरतेा मानांनांीय मंख्यमंत्री, महेाराष्ट्रा राज्य हे टिनांयंक्तेी ाटिधाकुारी असतेील;

(१)

भाग चार-अ-१६३–१२ महाराष्ट्र शासन राजपत्र असाधाराण भाग चारा-अ, एप्रिल ७, २०२६ / चाैत्र १७, शाके १९४८ (दाोनां) ग-ब या पादाकुरिरतेा संबंटिधाते टिवाभागाचे मानांनांीय मंत्री हे टिनांयंक्तेी ाटिधाकुारी असतेील;

असा आहे;

(ख) "सहेायकु ाध्यापाकु दांतेशास्त्र (ग-ब)" याचा अथाग, वाैद्यकुीय टिशक्षणा वा संशोधानां संचालनांालयाच्या शासकुीय टिनांयंत्रणाखालील शासकुीय वाैद्यकुीय महेाटिवाद्यालय वा रुग्णालयातेील दांतेशास्त्र टिवाभागातेील सहेायकु ाध्यापाकु असा आहे;

(ग) "सहेयोगी ाध्यापाकु दांतेशास्त्र (ग-अ)" याचा अथाग, वाैद्यकुीय टिशक्षणा वा संशोधानां संचालनांालयाच्या शासकुीय टिनांयंत्रणाखालील शासकुीय वाैद्यकुीय महेाटिवाद्यालय वा रुग्णालयातेील दांतेशास्त्र टिवाभागातेील सहेयोगी ाध्यापाकु असा आहे;

(घ) "आयोग" याचा अथाग, महेाराष्ट्रा लोकुसेवा आयोग असा आहे;

(ङ) "टिवाभाग" याचा अथाग, महेाराष्ट्रा शासनांाचा वाैद्यकुीय टिशक्षणा वा औषधाीद्रव्ये टिवाभाग, असा आहे;

(च) "संचालनांालय" याचा अथाग, वाैद्यकुीय टिशक्षणा वा औषधाीद्रव्ये टिवाभागाच्या शासकुीय टिनांयंत्रणाखालील, वाैद्यकुीय टिशक्षणा वा संशोधानां संचालनांालय, असा आहे;

(छे) "शासनां" याचा अथाग, महेाराष्ट्रा शासनां, असा आहे;

(ज) "पादाोन्नांतेीसाठी पात्रतेा" याचा अथाग, शासनांाच्या सामान्य शासनां टिवाभागानांे, वाेळोवाेळी कुाढलेले टिनांयम, शासनां टिनांणागय टिकुंवा आदाेश यांद्वारे पादाोन्नांतेीसाठी टिवाटिनांटिदागष् कुेलेल्या अी वा शतेीनांसार असलेली पादाोन्नांतेीची पात्रतेा, असा आहे;

(झ) "दांतेशल्यटिचटिकुत्सा पादाव्यंत्तर पादावाी (एम.डी.एस)" याचा अथाग, दांतेशल्यटिचटिकुत्सा टिवाषयातेील पादाव्यंत्तर पादावाी, असा आहे;

(ञ) "राष्ट्राीय वाैद्यकुीय आयोग" याचा अथाग, राष्ट्राीय वाैद्यकुीय आयोग अटिधाटिनांयम, २०१९ (२०१९ चा ३०) याच्या कुलम ३ द्वारे स्थापानां कुेलेला राष्ट्राीय वाैद्यकुीय आयोग, असा आहे;

() "ाध्यापाकु दांतेशास्त्र (ग-अ)" याचा अथाग, वाैद्यकुीय टिशक्षणा वा संशोधानां संचालनांालयाच्या शासकुीय टिनांयंत्रणाखालील शासकुीय वाैद्यकुीय महेाटिवाद्यालय वा रुग्णालयातेील दांतेशास्त्र टिवाभागातेील ाध्यापाकु, असा आहे;

(ठी) "मान्यतेाप्ते दांते महेाटिवाद्यालय" याचा अथाग, राष्ट्राीय दांते आयोगाद्वारे टिकुंवा भारते सरकुारनांे राष्ट्राीय दांते आयोगाऐवाजी टिनांयंक्ते कुेलेल्या इतेर कुोणात्याहेी समकुक्ष ाटिधाकुृते मंडीळाद्वारे मान्यतेा टिदालेले दांते महेाटिवाद्यालय , असा आहे;

(डी) "मान्यतेाप्ते वाैद्यकुीय महेाटिवाद्यालय" याचा अथाग, राष्ट्राीय वाैद्यकुीय आयोगाद्वारे टिकुंवा भारते सरकुारनांे राष्ट्राीय वाैद्यकुीय आयोगाऐवाजी टिनांयंक्ते कुेलेल्या इतेर कुोणात्याहेी समकुक्ष ाटिधाकुृते मंडीळाद्वारे मान्यतेा टिदालेले वाैद्यकुीय महेाटिवाद्यालय , असा आहे;

(ढ) "अनांसूची-एकु" याचा अथाग, या टिनांयमांसोबते जोडीलेली अनांसूची-एकु, असा आहे;

(णा) "अनांसूची-दाोनां" याचा अथाग, या टिनांयमांसोबते जोडीलेली अनांसूची-दाोनां, असा आहे;

३. ाध्यापाकु दांतेशास्त्र,(ग-अ) पादावारील टिनांयंक्तेी एकुतेर,–

(कु) सहेयोगी ाध्यापाकु दांतेशास्त्र (ग-अ) टिकुंवा अनांसूची -एकु मध्ये नांमूदा कुेलेल्या कुोणात्याहेी दांते ज्ञानांशाखेतेील सहेयोगी ाध्यापाकु, शासकुीय दांते महेाटिवाद्यालय वा रुग्णालय (ग-अ) हे पादा आटिणा अनांसूची -दाोनां च्या अनांक्रमांकु १ च्या नांदाी समोरील, अनांक्रमे, स्तेंभ ३ वा ४ मध्ये, नांमूदा कुेलेली शैक्षटिणाकु अहेगतेा वा अनांभवा धारणा कुरणाऱ्या व्यक्तेंमधाूनां ज्येष्ठीतेच्या आधारे, पादाोन्नांतेीसाठी पात्र असणाऱ्या योग्य व्यक्तेीच्या पादाोन्नांतेीनांे कुरण्याते येईल; टिकुंवा

(ख) टिनांयंक्तेी ाटिधाकुाऱ्याच्या मान्यतेनांे, आयोगामार्फते घेण्याते आलेल्या स्पाधाग पारीक्षेच्या टिनांकुालाच्या आधारे, टिशर्फारस कुेलेल्या उमेदावारांमधाूनां नांामटिनांदाेशानांाद्वारे, पांढील टिनांकुष पाूणाग कुरणाऱ्या उमेदावारांमधाूनां कुरण्याते येईल :—

(एक) वयेोमयेाषदेा.—

(कु) टिकुमानां वायोमयागदा.— उक्ते पादाच्या भरतेीसाठी जाटिहेरातेीते नांमूदा कुेलेल्या अजग स्वाीकुृतेीच्या अंटितेम टिदानांांकुास अठीरा वाषे पाूणाग कुेलेले.

(दाोनां) कुमाल वायोमयागदा.- उक्ते पादाच्या भरतेीसाठी जाटिहेरातेीते नांमूदा कुेलेल्या अजग स्वाीकुृतेीच्या अंटितेम टिदानांांकुास राखीवा वागातेील नांसलेल्या व्यक्तेंसाठी पान्नांास वाषे पाूणाग असलेले वा राखीवा वागाच्या व्यक्तेंसाठी पांचावान्नां वाषे वाय पाूणाग असलेले:

पारंतें, अगोदारच शासकुीय सेवाेते असलेल्या उमेदावारांसाठी वायोमयागदा आणाखी पाच वाषानांी टिशटिथाल कुरण्याते येईल :

पारंतें आणाखी असे कुी, अगोदारच शासकुीय सेवाेते कुाम कुरीते असलेल्या मागास वागागतेील उमेदावारांनांा एकुतेर शासकुीय सेवाेतेील कुमगचारी म्हेणाूनां टिकुंवा मागास वागागतेील कुमगचारी म्हेणाूनां वायोमयागदाेते टिशटिथालतेचा लाभ टिमळू शकुेल.

(देोन) प्रिकमान शाैक्षप्रिणक अहाषता.–.

यासोबते जोडीलेल्या अनांसूची -दाोनां मधाील अनांक्रमांकु १ च्या नांदाी समोरील स्तेंभ ३ मध्ये नांमूदा कुेलेली टिकुमानां शैक्षटिणाकु अहेगतेा धारणा कुरणारी व्यक्तेी.

(तीन) अनुभाव.– यासोबते जोडीलेल्या अनांसूची -दाोनां च्या अनांक्रमांकु १ च्या नांदाी समोरील स्तेंभ ४ मध्ये नांमूदा कुेलेला टिकुमानां अनांभवा धारणा कुरणारी व्यक्तेी.

४. सहेयोगी ाध्यापाकु दांतेशास्त्र,(ग-अ) पादावारील टिनांयंक्तेी एकुतेर,—

(कु) सहेायकु ाध्यापाकु दांतेशास्त्र (ग-ब) टिकुंवा अनांसूची -एकु मध्ये नांमूदा कुेलेल्या कुोणात्याहेी दांतेशास्त्र ज्ञानांशाखेतेील सहेायकु ाध्यापाकु, शासकुीय दांते महेाटिवाद्यालय वा रुग्णालय (ग-ब) हे पादा धारणा कुरणाऱ्या आटिणा अनांसूची -दाोनांच्या अनांक्रमांकु २ च्या समोरील नांदाी, अनांक्रमे, स्तेंभ ३ वा ४ मध्ये, नांमूदा कुेलेली शैक्षटिणाकु अहेगतेा वा अनांभवा धारणा कुरणाऱ्या व्यक्तेंमधाूनां ज्येष्ठीतेच्या आधारे, पादाोन्नांतेीसाठी पात्र असणाऱ्या योग्य व्यक्तेीच्या पादाोन्नांतेीनांे कुरण्याते येईल; टिकुंवा

(ख) टिनांयंक्तेी ाटिधाकुाऱ्याच्या मान्यतेनांे, आयोगामार्फते घेण्याते आलेल्या स्पाधाग पारीक्षेच्या टिनांकुालाच्या आधारे, टिशर्फारस कुेलेल्या उमेदावारांमधाूनां नांामटिनांदाेशानांाद्वारे, जे पांढील टिनांकुष पाूणाग कुरीते आहेते अशा उमेदावारांमधाूनां कुरण्याते येईल :—

(एक) वयेोमयेाषदेा.–

(कु) टिकुमानां वायोमयागदा.- उक्ते पादाच्या भरतेीसाठी जाटिहेरातेीते नांमूदा कुेलेल्या अजग स्वाीकुृतेीच्या अंटितेम टिदानांांकुास अठीरा वाषे पाूणाग कुेलेले.

पारंतें, अगोदारच शासकुीय सेवाेते असलेल्या उमेदावारांसाठी वायोमयागदा आणाखी पाच वाषानांी टिशटिथाल कुरण्याते येईल :

पारंतें आणाखी असे कुी, अगोदारच शासकुीय सेवाेते कुाम कुरीते असलेल्या मागास वागागतेील उमेदावारांनांा एकुतेर शासकुीय सेवाेतेील कुमगचारी म्हेणाूनां टिकुंवा मागास वागागतेील कुमगचारी म्हेणाूनां वायोमयागदाेते टिशटिथालतेचा लाभ टिमळू शकुेल.

(देोन) प्रिकमान शाैक्षप्रिणक अहाषता.–

यासोबते जोडीलेल्या अनांसूची -दाोनां मधाील अनांक्रमांकु २ च्या नांदाी समोरील स्तेंभ ३ मध्ये नांमूदा कुेलेली टिकुमानां शैक्षटिणाकु अहेगतेा धारणा कुरणारी व्यक्तेी.

(तीन) अनुभाव.— यासोबते जोडीलेल्या अनांसूची -दाोनां च्या अनांक्रमांकु २ नांदाी समोरील स्तेंभ ४ मध्ये नांमूदा कुेलेला टिकुमानां अनांभवा धारणा कुरणारी व्यक्तेी.

५. सहेायकु ाध्यापाकु दांतेशास्त्र, (ग-ब) पादावारील टिनांयंक्तेी एकुतेर,—

(कु) दांतेशल्यटिचटिकुत्सकु (ग-ब) हे पादा धारणा कुरणाऱ्या आटिणा अनांसूची -दाोनां मधाील अनांक्रमांकु ३ च्या नांदाी समोरील, अनांक्रमे, स्तेंभ ३ वा ४ मध्ये, नांमूदा कुेलेली शैक्षटिणाकु अहेगतेा वा अनांभवा धारणा कुरणाऱ्या व्यक्तेंमधाूनां ज्येष्ठीतेच्या आधारे, पादाोन्नांतेीसाठी पात्र असणाऱ्या योग्य व्यक्तेीच्या पादाोन्नांतेीनांे कुरण्याते येईल; टिकुंवा४ महाराष्ट्र शासन राजपत्र असाधाराण भाग चारा-अ, एप्रिल ७, २०२६ / चाैत्र १७, शाके १९४८ (ख) टिनांयंक्तेी ाटिधाकुाऱ्याच्या मान्यतेनांे, आयोगामार्फते घेण्याते आलेल्या स्पाधाग पारीक्षेच्या टिनांकुालाच्या आधारे, टिशर्फारस कुेलेल्या उमेदावारांमधाूनां नांामटिनांदाेशानांाद्वारे, जे पांढील टिनांकुष पाूणाग कुरीते आहेते अशा उमेदावारांमधाूनां कुरण्याते येईल:-

पारंतें, अगोदारच शासकुीय सेवाेते असलेल्या उमेदावारांसाठी वायोमयागदा आणाखी पाच वाषानांी टिशटिथाल कुरण्याते येईल :

पारंतें आणाखी असे कुी, अगोदारच शासकुीय सेवाेते कुाम कुरीते असलेल्या मागास वागागतेील उमेदावारांनांा एकुतेर शासकुीय सेवाेतेील कुमगचारी म्हेणाूनां टिकुंवा मागास वागागतेील कुमगचारी म्हेणाूनां वायोमयागदाेते टिशटिथालतेचा लाभ टिमळू शकुेल.

(देोन) प्रिकमान शाैक्षप्रिणक अहाषता.–

यासोबते जोडीलेल्या अनांसूची -दाोनां मधाील अनांक्रमांकु ४ च्या नांदाी समोरील स्तेंभ ३ मध्ये नांमूदा कुेलेली टिकुमानां शैक्षटिणाकु अहेगतेा धारणा कुरणारी व्यक्तेी.

(तीन) अनुभाव.– यासोबते जोडीलेल्या अनांसूची -दाोनां मधाील अनांक्रमांकु ४ च्या नांदाी समोरील स्तेंभ ४ मध्ये नांमूदा कुेलेला टिकुमानां अनांभवा धारणा कुरणारी व्यक्तेी.

६. (१) टिनांयम ३ वा ४ मध्ये नांमूदा कुेलेल्या पादांवारील टिनांयंक्त्या, भरावायाच्या मंजूर पादांच्या एकुूणा संख्येच्या, अनांक्रमे, ५०:५० या माणाते पादाोन्नांतेीद्वारे वा नांामटिनांदाेशनांाद्वारे कुरण्याते येतेील.

(२) टिनांयम ५ मध्ये नांमूदा कुेलेल्या पादांवारील टिनांयंक्तेी, भरावायाच्या मंजूर पादांच्या एकुूणा संख्येच्या, अनांक्रमे, १५:८५ या माणाते पादाोन्नांतेीद्वारे वा नांामटिनांदाेशनांाद्वारे कुरण्याते येईल.

पारंतें, पादाोन्नांतेीद्वारे टिनांयंक्तेी कुरण्याकुरिरतेा योग्य व्यक्तेी उपालब्धा नां झाल्यास, टिनांयंक्तेी ाटिधाकुाऱ्याच्या मान्यतेनांे, त्या टिवाटिशष् टिनांयंक्तेी वाषागसाठी पादाोन्नांतेीद्वारे वा नांामटिनांदाेशनांाद्वारे कुरावायाच्या टिनांयंक्तेीच्या माणाते टिशटिथालतेा आणाण्याते येऊ शकुेल.

७ टिनांयम ३, ४ टिकुंवा ५ मध्ये नांमूदा कुेलेल्या पादावार नांामटिनांदाेशनांाद्वारे टिनांयंक्ते कुेलेल्या व्यक्तेीचा पारिरवाीक्षा कुालावाधाी दाोनां वाषाचा असेल. सक्षम ाटिधाकुाऱ्यास योग्य वाल्यास पारिरटिवाक्षा कुालावाधाी कुमाल एकु वाषापायते वाढटिवातेा येऊ शकुेल. तेी व्यक्तेी, शासनांाच्या पारिरवाीक्षा धाोरणानांसार पारिरवाीक्षा कुालावाधाी टिवाटिहेते कुालमयागदाेते समाधानांकुारकुरीत्या पाूणाग कुरील अन्यथा टितेची सेवा समाप्ते हेोण्यास तेी पात्र असेल.

८. (१) टिनांयम ३, ४ टिकुंवा ५ मध्ये नांमूदा कुेलेल्या पादांवार पादाोन्नांतेीनांे टिनांयंक्ते कुरावायाची व्यक्तेी, उक्ते पादावार पादाोन्नांतेी दाेण्यापाूवाी अगोदारच मराठी वा टिहेंदाी भाषा पारीक्षा उत्तीणाग नांसेल टिकुंवा त्या पारीक्षा उत्तीणाग हेोण्यापासूनां टितेला सू दाेण्याते आलेली नांसेल तेर, तेी, त्याबाबतेीते, शासनांानांे, वाेळोवाेळी कुेलेल्या टिनांयमानांसार, टिहेंदाी वा मराठी भाषा पारीक्षा उत्तीणाग कुरेल.

(२) टिनांयम ३,४ टिकुंवा ५ मध्ये नांमूदा कुेलेल्या पादावार नांामटिनांदाेशनांाद्वारे टिनांयंक्ते कुेलेली व्यक्तेी, अगोदारच मराठी वा टिहेंदाी भाषा पारीक्षा उत्तीणाग नांसेल टिकुंवा त्या पारीक्षा उत्तीणाग हेोण्यापासूनां टितेला सू दाेण्याते आलेली नांसेल तेर, तेी, त्याबाबतेीते, शासनांानांे, वाेळोवाेळी कुेलेल्या टिनांयमांनांसार, टिनांयंक्तेीनांतेर टिवाटिहेते कुालमयागदाेते मराठी वा टिहेंदाी भाषा पारीक्षा उत्तीणाग कुरील. तेी व्यक्तेी, या पारीक्षा उत्तीणाग हेोईपायते, वाटिषगकु वाेतेनांवाढीसाठी टिकुंवा पांढील पादाोन्नांतेीच्या पादावारील पादाोन्नांतेीसाठी पात्र असणार नांाहेी.

९. (१) टिनांयम ३, ४ टिकुंवा ५ मध्ये नांमूदा कुेलेल्या पादावार पादाोन्नांतेीनांे टिनांयंक्ते कुरावायाची व्यक्तेी, उक्ते पादावार पादाोन्नांतेी दाेण्यापाूवाी, अगोदारच, टितेला संगणाकु हेातेाळणाी माणापात्र धारणा कुरण्यापासूनां सू दाेण्याते आली नांसेल तेर, तेी, त्याबाबतेीते, शासनांानांे, वाेळोवाेळी कुेलेल्या टिनांयमानांसार टिवाटिहेते कुेलेले संगणाकु हेातेाळणाी माणापात्र धारणा कुरील.

(२) टिनांयम ३, ४ टिकुंवा ५ मध्ये नांमूदा कुेलेल्या पादावार नांामटिनांदाेशनांाद्वारे टिनांयंक्ते कुेलेल्या व्यक्तेीनांे, टितेला संगणाकु हेातेाळणाी माणापात्र धारणा कुरण्यापासूनां सू दाेण्याते आली नांसेल तेर, तेी, याबाबतेीते, शासनांानांे, वाेळोवाेळी टिवाटिहेते कुेलेले असे संगणाकु हेातेाळणाी माणापात्र, टिनांयंक्तेीनांतेर टिवाटिहेते कुालमयागदाेते धारणा कुरील, अशी व्यक्तेी, असे माणापात्र धारणा कुरीपायते, वाटिषगकु वाेतेनांवाढीसाठी टिकुंवा पांढील पादाोन्नांतेीच्या पादावारील पादाोन्नांतेीसाठी पात्र असणार नांाहेी.

१०. (१) टिनांयम ३, ४ टिकुंवा ५ मध्ये नांमूदा कुेलेल्या पादावार नांामटिनांदाेशनांाद्वारे टिनांयंक्ते कुेलेली व्यक्तेी, महेाराष्ट्रा नांागरी सेवा (लहेानां बाचे टितेज्ञापानां) टिनांयम, २००५ याच्या तेरतेंदांनांसार टिकुंवा याबाबते, शासनांानांे, वाेळोवाेळी कुेलेले अन्य कुोणातेहेी टिनांयम, कुाढलेले कुं आदाेश टिकुंवा कुोणातेहेी संलेख यानांसार लहेानां कुं बाचे टितेज्ञापानां सादार कुरील.

बाचे टितेज्ञापानां सादार कुरण्याच्या टिदानांांकुास, दाोनांपाेक्षा अटिधाकु अपात्ये असणारी व्यक्तेी, शासकुीय सेवाेतेील (२) लहेानां कुं टिनांयंक्तेीसाठी अपात्र असेल.

(३) एखाद्या व्यक्तेीची शासकुीय सेवाेते टिनांयंक्तेी झाल्यानांतेर, जर टितेला, टिनांयंक्तेीच्या वाेळी टिकुंवा त्यानांतेर दाोनांपाेक्षा अटिधाकु अपात्ये असल्याचे टिसद्ध झाले तेर, तेी व्यक्तेी, शासकुीय सेवाेतेील उक्ते पादावार कुायम राहेण्यास अपात्र असेल.

११. टिनांयम ३, ४ टिकुंवा ५ मध्ये नांमूदा कुेलेल्या पादावार नांामटिनांदाेशनांाद्वारे टिकुंवा पादाोन्नांतेीद्वारे टिनांयंक्ते कुेलेली व्यक्तेी महेाराष्ट्रा राज्याते कुोठीेहेी बदालीसाठी पात्र असेल.

१२. टिनांयम ३, ४ टिकुंवा ५ मध्ये नांमूदा कुेलेल्या पादावार टिनांवाडी कुेलेल्या व्यक्तेीनांे दांतेवाैद्य अटिधाटिनांयम, १९४८, (१९४८ चा १६) ंबई यांचेकुडीे नांदाणाी कुरूनां घेणाे आवाश्यकु आहे, अशी नांदाणाी नां अन्वाये भारतेीय दांतेवाैद्यकु पारिरषदा टिकुंवा महेाराष्ट्रा दांतेवाैद्यकु पारिरषदा, मं कुेल्यास, त्यास उक्ते पादावार टिनांयंक्तेी दाेण्यापाूवाी नांदाणाी कुरूनां घेणाे बंधानांकुारकु असेल.

१३. या पादावार टिनांयंक्ते कुेलेली व्यक्तेी, आवाश्यकु असल्यास, भारते सरकुारकुडीूनां, वाेळोवाेळी, टिनांधागरिरते कुरण्याते येईल त्यामाणाे, चार वाषापाेक्षा कुमी नांसेल इतेक्या कुालावाधाीकुरिरतेा (अशा उमेदावारांच्या टिशक्षणाचा कुालावाधाीधारूनां) भारतेाते कुोठीेहेी टिकुंवा भारतेाबाहेर कुोठीेहेी भारतेाच्या कुोणात्याहेी संरक्षणा सेवाेते टिकुंवा भारतेाच्या संरक्षणाशी संबंटिधाते असणाऱ्या कुोणात्याहेी पादावार सेवा कुरण्यास पात्र असेल :

पारंतें, अशी व्यक्तेी टितेची टिनांयंक्तेी झाल्याच्या टिदानांांकुापासूनां दाहेा वाषे समाप्ते झाल्यानांतेर आटिणा सवागसाधारणापाणाे टितेनांे वायाची पांचावान्नां वाषे पाूणाग कुेल्यावार, उपारोक्तेमाणाे सेवा कुरण्याची आवाश्यकुतेा नांसेल.

१४. अनांसूची -दाोनां मध्ये नांमूदा कुेलेली शैक्षटिणाकु अहेगतेा वा अनांभवा, राष्ट्राीय वाैद्यकुीय आयोगाद्वारे टिकुंवा भारते सरकुारनांे स्थापानां कुेलेल्या त्याच्या समकुक्ष संस्थाेद्वारे, अशा शैक्षटिणाकु अहेगतेमध्ये वा अनांभवामध्ये, यथास्थिस्थाटिते, मान्यतेा टिदाल्याच्या टिकुंवा मान्यतेा रद्द कुेल्याच्या अधाीनां राहेूनां, वाेळोवाेळी, संधारिरते कुेले जातेील.

शासकुीय सेवाेते टिनांयंक्तेी झाल्यानांतेर, राज्य शासनांाच्या वातेीनांे शासनां आदाेशाद्वारे टिनांस्थिश्चते कुेलेल्या अी वा शतेी संबंटिधाते व्यक्तेीस यापांढेहेी लागू असतेील.

No. MEDD-5023(1)/86/2025-MMD(Vais-4)/ 1196106.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, and in supersession of all the existing rules, orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of Professor Dentistry (Group-A) (Gazetted), Associate Professor Dentistry (Group-A) (Gazetted) and Assistant Professor Dentistry (Group- B) (Gazetted) in the Department of Dentistry in the Government Medical College and Hospital on the establishment of Directorate of Medical Education and Research, under the administrative control of the Medical Education and Drugs Department of Government of Maharashtra, namely :-

1. These rules may be called the Professor Dentistry (Group-A) (Gazetted), Associate Professor Dentistry (Group-A) (Gazetted) and Assistant Professor Dentistry (Group- B) (Gazetted) in the Department of Dentistry in the Government Medical College and Hospital on the establishment of Directorate of Medical Education and Research under the administrative control of the Medical Education and Drugs Department (Recruitment) Rules, 2026.

2. In these rules, unless the context requires otherwise,—

(a) "Appointing Authority" means,—

(i) the Hon'ble Chief Minister, State of Maharashtra who shall be the Appointing Authority for the post of Group-A;

(ii) the Hon'ble Minister of the concerned Department who shall be the Appointing Authority for the post of Group-B;

(b) "Assistant Professor Dentistry (Group-B)" means a Assistant Professor in the Department of Dentistry in the Government Medical College and Hospital under the administrative control of the Directorate of Medical Education and Research;

(c) "Associate Professor, Dentistry, (Group-A)" means a Associate Professor in the Department of Dentistry in the Government Medical College and Hospital under the administrative control of the Directorate of Medical Education and Research;

(d) "Commission" means the Maharashtra Public Service Commission;

(e) "Department" means the Department of Medical Education and Drugs Department of the Government of Maharashtra;

(f) "Directorate" means the Directorate of Medical Education and Research, under the administrative control of Medical Education and Drugs Department;

(g) "Government" means the Government of Maharashtra;

(h) "eligibility for promotion" means eligibility for promotion in accordance with the terms and conditions specified for promotion by rules, Government Resolution, or orders issued by the General Administration Department from time to time;

(i) "Master of Dental Surgery (M.D.S)" means post graduate degree in dental surgery;

(j) "National Medical Commission" means the National Medical Commission established by section 3 of the National Medical Commission Act, 2019 (30 of 2019);

(k) "Professor Dentistry (Group-A)" means a Professor in the Department of Dentistry in the Government Medical College and Hospital under the administrative control of the Directorate of Medical Education and Research;

(l) "Recognized Dental College" means a Dental College recognized by the National Dental Commission or any other equivalent authorized body appointed by Government of India, in place of the National Dental Commission;

(m) "Recognized Medical College" means a Medical College recognized by the National Medical Commission or any other equivalent authorized body appointed by Government of India, in place of the National Medical Commission;

(n) "Schedule-I" means the Schedule-I appended to these rules;

(o) "Schedule-II" means the Schedule-II appended to these rules.

3. Appointment to the post of Professor Dentistry (Group-A) shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion on the basis of seniority from amongst the persons holding the post of Associate Professor Dentistry (Group-A) or Associate Professor, Government Dental College and Hospital (Group-A) in any dental discipline mentioned in Schedule-I and possessing educational qualification and experience mentioned in columns 3 and 4, respectively, against entry at serial number 1 of Schedule-II; or (b) by nomination from amongst the candidates recommended by the Commission on the basis of the result of the competitive examination conducted by the Commission, with the approval of the Appointing Authority, who fulfills the following criteria, namely :—

(i) Age Limit.—

(a) Lower Age Limit.– Eighteen years of age completed on the last date of receipt of applications as per the advertisement for recruitment to the said post.

(b) Upper Age Limit.– Fifty years of age completed for the persons not belonging to reserved categories and fifty- five years of age for the persons belonging to reserved categories as on the last date of receipt of applications as per the advertisement for recruitment to the said post:

Provided that, the age limit for candidates who are already in government service shall be relaxed for further five years:

Provided further that, the backward class candidates who are already working in the government service can avail relaxation of age limit either for the government service employees or for backward class employees.

(ii) Minimum Educational Qualifications.– A person holding a minimum educational qualification mentioned in column 3 against entry at serial no.1 of the Schedule-II attached herewith.

(iii) Experience.– A person holding a minimum experience mentioned in column 4 against entry at serial no. 1 of the Schedule-II attached herewith.

4. Appointment to the post of Associate Professor Dentistry (Group-A) shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion, on the basis of seniority, from amongst the persons holding the post of Assistant Professor Dentistry (Group-B) or Assistant Professor, Government Dental College and Hospital (Group-B) in any dental discipline mentioned in Schedule-I and possessing educational qualification and experience in columns 3 and 4 respectively against entry at serial number 2 of Schedule-II; or

(b) by nomination from amongst the candidates recommended by the Commission on the basis of the result of the competitive examination conducted by the Commission, with the approval of the Appointing Authority, who fulfills the following criteria, namely :—

(i) Age Limit.–

(a) Lower Age Limit.– Eighteen years of age completed on the last date of receipt of applications as per the advertisement for recruitment to the said post.

भाग चार-अ-१६३–३अ१० महाराष्ट्र शासन राजपत्र असाधाराण भाग चारा-अ, एप्रिल ७, २०२६ / चाैत्र १७, शाके १९४८ (b) Upper Age Limit.— Forty-five years of age completed for the persons not belonging to reserved categories and fifty years of age for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the said post:

Provided that, the age limit for candidates who are already in government service shall be relaxed for further five years:

Provided further that, the backward class candidates who are already working in the government service can avail relaxation of age limit either for the government service employees or for backward class employees.

(ii) Minimum Educational Qualifications.– A person holding a minimum educational qualification mentioned in column 3 against entry at serial no. 2 of the Schedule-II attached herewith.

(iii) Experience.– A person holding a minimum experience mentioned in column 4 against entry at serial number 2 of Schedule-II attached herewith.

5. Appointment to the Post of Assistant Professor Dentistry (Group-B) shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion on the basis of seniority from amongst the persons holding the post of Dental Surgeon (Group – B) and possessing educational qualification and experience in columns 3 and 4, respectively, against entry at serial number 3 of Schedule-II; or

(b) by nomination from amongst the candidates recommended by the Commission on the basis of the result of the competitive examination conducted by the Commission, with approval of the Appointing Authority, who fulfills the following criteria, namely:-

(i) Age Limit.–

(a) Lower Age Limit.– Eighteen years of age completed on the last date of receipt of applications as per the advertisement for recruitment to the said post.

(b) Upper Age Limit.– Forty years of age completed for the persons not belonging to reserved categories and forty five years of age for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the said post :

Provided that, the age limit for candidates who are already in government service shall be relaxed for further five years :

Provided further that, the backward class candidates who are already working in the government service can avail relaxation of age limit either for the government service employees or for backward class employees.

(ii) Minimum Educational Qualifications.– A person holding a minimum educational qualification mentioned in column 3 against entry at serial no. 4 of the Schedule-II attached herewith.

(iii) Experience.– A person holding a minimum experience mentioned in column 4 against entry at serial No. 4 of the Schedule-II attached herewith.

6 (1). Appointments to the posts mentioned in rules 3 and 4 by promotion and nomination shall be made in the ratio of 50:50 respectively, for the total number of sanctioned posts to be filled.

6 (2). Appointment to the posts mentioned in rules 5 by promotion and by nomination shall be made in the ratio 15:85 respectively, for the total number of sanctioned posts to be filled;

Provided that, if the suitable person for appointment by promotion is not available, the ratio of appointment by promotion and by nomination may be relaxed for that particular appointment year with the approval of Appointing Authority.

7. A Person appointed to the post mentioned in rule 3, 4 or 5 by nomination shall be on probation for a period of two years. The probation period may be extended maximum up to one year at the discretion of the Competent Authority. A person shall be completed the probation period satisfactorilyमहाराष्ट्र शासन राजपत्र असाधाराण भाग चारा-अ, एप्रिल ७, २०२६ / चाैत्र १७, शाके १९४८ ११ within the stipulated period as per the probation policy of the Government otherwise his services shall be liable to be terminated.

8(1). A person appointed to the post mentioned in the rule 3, 4 or 5 by promotion shall pass the Marathi and Hindi Languages examinations as per the rules made in that behalf by the Government, from time to time, unless he has already passed or had been exempted from passing those examinations before getting promoted to the said post.

8(2). A person appointed to the post mentioned in rule 3, 4 or 5 by nomination shall pass the Marathi and Hindi Languages examinations as per the rules made in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed the said examinations or has been exempted from passing those examination. He shall not be eligible for annual increment or promotion to the next promotional post until he passed those examinations.

9(1). A person appointed to the post mentioned in rule 3, 4 or 5 by promotion shall possess certificate of Computer Operations prescribed by rules or orders issued in that behalf by the Government, from time to time, unless he already possesses such certificate has been exempted there from, before getting promoted to the said post.

9(2). A person appointed to the post mentioned in rule 3, 4 or 5 by nomination shall possess a certificate of computer operation prescribed by Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possesses such certificate.

10(1). A person recommended for appointment by nomination to the post mentioned in rules 3, 4 or 5 shall submit a declaration of Small Family as per the provision of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time.

10(2). A person having more than two children on the date of submission of Declaration of small family shall be disqualified for the appointment in Government Service.

10(3). After appointment of a person in the Government service, if it is proved that he has more than two children at the time of appointment or thereafter, then he shall be disqualified for continuing on the said post in the Government service.

11. A person appointed to the post mentioned in rules 3, 4 or 5 by nomination or promotion shall be liable to be transferred anywhere in the State of Maharashtra.

12. A person selected to the post mentioned in rule 3, 4 or 5 are required to get registered their professional Qualification with Indian Dental Council or Maharashtra Dental Council, Mumbai under the Dental Act, 1948 (16 of 1948), if not so registered, he must be registered before the appointment on the said posts.

13. A person appointed on the post, if so required, be liable to serve in any Defence services of India or in post connected with the Defence of India anywhere in or outside India for a period of not less than four years (including the period spent on training on such candidates) as may be determined from time to time by the Government of India :

Provided that such person shall not be required to serve as aforesaid after expiry of ten years from the date of his appointment and ordinarily after he has attended the age of Fifty-Five years.

14. Educational qualification and experience mentioned in Schedule- II shall stand amended in accordance with the recognition or de-recognition, as the case may be, of such educational qualification and experience by National Medical Commission or equivalent body established by Government of India, from time to time.

After appointment in government service, the terms and conditions fixed by the government order on behalf of the State Government will continue to be applicable to the concerned.
