क्र. मर्सामं/मुर्काअ/महर्सूल/२०२६.— महाराष्ट्र र्सागराी मंळ अडिडिनयम, १९९६ (१९९७ चेंे १५) मील र्कलम १०८ उप-र्कलम (३३), र्कलम २०, २४, ३५, ३७, ३८, ४१, १०९ चेंे उप-र्कलम (१) आडि र्कलम १११ याद्वाराे दोान र्कराण्यात आलेल्या अडिर्कारांनी आडि याबाबत शार्सनार्स र्समर्थस र्कराऱ्या इंतरा र्सर्वस अडिर्कारांचेंा र्वापरा र्करून महाराष्ट्र शार्सन याद्वाराे पुढीलमाे "महाराष्ट्र र्सागराी मंळ (जाडिहरातंच्या दोशासनाचेंे डिर्वडिनयमन) डिर्वडिनयम, २०२६" र्कराीत आहे :—

१. संप्रिप्त नाव, व्येाप्ती व ारांभा

(१) या डिर्वडिनयमांर्स "महाराष्ट्र र्सागराी मंळ (जाडिहरातंच्या दोशासनाचेंे डिर्वडिनयमन) डिर्वडिनयम, २०२६" अर्से म्हार्वे.

(२) हे डिर्वडिनयम महाराष्ट्र र्सागराी मंळाच्या अडिर्काराक्षेत्रातील र्सर्वस क्षेत्रांर्करिराता लागू राहतील.

(३) हे डिर्वडिनयम शासकीये राजपत्रात डिर्सद्ध झाल्याच्या डिदोनांर्कापार्सून अंमलात येतील.

२. व्येाख्येा

या डिनयमांमध्ये, र्संदोभासनुर्सारा अन्यर्था अपेडिक्षेत नर्सल्यार्स,—

(१) "जाप्रिहारात" म्हजे महाराष्ट्र र्सागराी मंळाच्या अडिर्काराक्षेत्रात र्कोत्याही र्काराे दोडिशासत र्कराण्यात येाराी र्कोतीही जाडिहरात होय आडि त्यात पोस्टारा, होडिंग फलर्क, बॅनरा, तात्पुरात्या र्कमानी, र्काशामान डिचेंन्हे, नामफलर्क, डिदोशादोशासर्क फलर्क, डिडिजटाल फलर्क, स्र्काय र्साइंन, प्लॅर्काड, डिडिजटाल, एलईी, एलर्सी, बॅर्कडिलटा बोड, डिनऑन डिस्प्ले, इंलेक्ट्रॉडिनर्क डिस्प्ले,

(१)

भाग दोन-४६–१२ महाराष्ट्र शासन राजपत्र असाधाराण भाग दोन, एप्रिल १०, २०२६/चैत्र २०, शाके १९४८ व्हिहडिओ डिस्प्ले, लेझारा शाो, फुगे इंत्यादोी र्कोत्याही र्सानांद्वाराे शाब्दो, अक्षेराे, नमुना, डिचेंन्ह, र्सूचेंना डिर्कंर्वा घोषा स्र्वरूपात र्सादोरा र्केलेले र्कोतेही र्सान डिर्कंर्वा डितर्कृती यांचेंा र्समार्वेशा होईल. खालीलमाे त्यांचेंी याख्या र्कराण्यात येते :–

(अ) "फुग्येांवराील जाप्रिहारात" म्हजे र्वायूने भारालेले र्व हर्वेत तरांगाराे हर्वाई फुग्यांर्वराील जाडिहरात.

(ब) "बॅनरावराील जाप्रिहारात" म्हजे र्सार्वसजडिनर्क डिर्काी दोशासनार्साी र्काप डिर्कंर्वा अन्य र्कोत्याही र्साडिहत्यार्वरा र्केलेली जाडिहरात, घोषा डिर्कंर्वा डिलडिखात मजर्कूरा.

(र्क) "प्रिडप्रिजटल/इलेक्ट्रॉप्रिनक दोशाषनावराील जाप्रिहारात" म्हजे र्संराचेंनेर्वरा बर्सडिर्वलेला इंलेक्ट्रॉडिनर्क पद्धतीने चेंालारा जाडिहरात फलर्क.

() "स्टॅण्डीवराील जाप्रिहारात" म्हजे लहान र्काक्रीटा बेर्स डिर्कंर्वा खांबार्वरा बर्सडिर्वलेल्या र्सानाद्वाराे उत्पादोन डिर्कंर्वा र्कायसक्रमाच्या र्सारार्साी दोडिशासत र्कराण्यात येाराी जाडिहरात होय. अशा जाडिहराती र्सामान्यतः डिर्करार्कोळ डिर्वक्री र्कंद्रे, खाराेदोी मॉल्र्स आडि र्कायसक्रम स्र्थळे यांर्साराख्या गदोीच्या डिर्काी लक्षे र्वेण्यार्साी र्व दोृश्यदोृष्ट्या आर्कषसर्क चेंारा र्सान म्हून लार्वण्यात येतात.

(इं) "इलेक्ट्रॉप्रिनक प्रिबॅलबॅोडडवराील जाप्रिहारात" म्हजे इंलेक्ट्रॉडिनर्क पद्धतीने चेंालाऱ्या फलर्कार्वराील जाडिहरात.

(फ) "ग्लो साइन बॅॉक्सवराील जाप्रिहारात" म्हजे ातूच्या पेटाीर्वरा बर्सडिर्वलेल्या पारादोशासर्क डिर्कंर्वा असपारादोशासर्क पत्र्यार्वरा मागील बाजूर्स डिर्वद्युत डिदोयांद्वाराे र्काडिशात र्केलेली जाडिहरात.

(ग) "हाोप्रिडंगवराील जाप्रिहारात" म्हजे जडिमनीर्वरा उभारालेल्या र्संराचेंनेच्या र्कोत्याही पृष्भागार्वरा डिर्कंर्वा इंमारातीच्या छताच्या र्कोत्याही भागार्वरा अर्थर्वा र्कागदोार्वरा अक्षेराे, शाब्दो डिर्कंर्वा डिचेंत्राे लार्वून र्कोत्याही र्काराे दोडिशासत र्कराण्यात येाराी जाडिहरात होय. अशाी जाडिहरात र्कोत्याही स्र्थळ, यक्ती, र्सार्वसजडिनर्क र्कायसक्रम डिर्कंर्वा र्कोत्याही यापाराी र्वस्तूबाबत माडिहती दोेण्यार्साी डिर्कंर्वा जनतेचेंे लक्षे र्वेण्यार्साी र्कराण्यात येते. यांना डिबलबोड अर्सेही र्संबोले जाते.

(घो) "येुप्रिनपोलवराील जाप्रिहारात" म्हजे एर्काचें खांबार्साराख्या आारार्वरा उभाराण्यात येाऱ्या होडिंगचेंा र्कारा होय. अशार्काराच्या र्संराचेंनेला युडिनपोल अर्से र्संबोले जाते.

(चें) "राॅप्सवराील जाप्रिहारात" म्हजे र्कागदो डिर्कंर्वा इंतरा र्कोत्याही र्साडिहत्यार्वरा र्केलेली जाडिहरात, घोषा डिर्कंर्वा दोशासनार्साी अर्सलेला मजर्कूरा, जो डिर्वद्युमान पायाभाूत र्संराचेंनेच्या पृष्भागार्वरा डिचेंर्कटाडिर्वण्यात डिर्कंर्वा लार्वण्यात येतो.

(छ) "कॅन्टिटप्रिलव्हारावराील जाप्रिहारात" म्हजे एर्का टाोर्काला आारा/व्हिस्र्थरा र्केलेला आडि दोुर्सऱ्या टाोर्काला लांब अांतराी भागार्वरा भारा डिर्कंर्वा उभा आारा ारा र्करारा लांब दोांा/र्संराचेंना, जी रास्त्याच्या दोुभाजर्क डिर्कंर्वा पदोपर्थ/फुटापार्थर्वरा उभारालेल्या र्संराचेंनेचेंा (भागाचेंा) आारा राण्यार्साी तर्सेचें रास्त्यार्वराील डिदोशादोशासर्क फलर्क/स्र्थळे डिर्कंर्वा जाडिहरात दोडिशासत र्कराण्यार्साी र्वापराली जाते.

(ज) "प्रिबॅन्टिडग राॅप जाप्रिहारात" म्हजे बांर्कामाीन डिर्कंर्वा दोुरुस्तीअंतगसत इंमारातीच्या स्र्कॅफोव्हिल्गर्वरा दोडिशासत र्केलेली जाडिहरात.

(झा) "जाप्रिहारात प्रिकऑस्क" म्हजे जडिमनीर्वरा र्थेटा बर्सडिर्वण्यात येाराी स्र्वतंत्रा (फ्री-स्टाॅव्हिण्ग) जाडिहरातीचेंी र्संराचेंना होय, जी खांबार्वरा बर्सडिर्वलेली नर्सते. र्संराचेंना र्व डिनयमांनुर्सारा यांना लॉलीपॉप्र्स, डिमनी पोल्र्स इंत्यादोी डिर्वडिर्व नार्वांनी दोेखाील ओळखाले जाते.

(ञ) "वाहानावराील (उभाे/पाकक केलेले) जाप्रिहारात" म्हजे एमएमबीच्या मालर्कीच्या जागा/मालमत्तेर्वरा र्वाहन उभाे अर्सताना, जाडिहरात दोृश्यमान होईल अशार्काराे र्वाहनाच्या बाजूच्या पॅनलर्वरा डिर्कंर्वा मागील बाजूर्स व्हिस्टार्कराद्वाराे बर्सडिर्वण्यात आलेला एर्कतफी डिर्कंर्वा डिद्वातफी जाडिहरात फलर्क होय.

(टा) "बॅाजष" म्हजे र्सपाटा तळाचेंी, बहुा स्र्वतंत्रा ेराशाक्ती नर्सलेली मालर्वाहू नौर्का.

() "जाप्रिहारात साधान" म्हजे बाह्य जाडिहरात दोडिशासत र्कराण्यार्साी र्वापराले जाराे र्कोतेही माध्यम. स्पष्टाीर्करार्थस, अशा र्सानांमध्ये मोटाराीर्कृत डिर्कंर्वा अमोटाराीर्कृत र्वाहने तर्सेचें जाडिहरात दोशासनार्साी र्वापराण्यात येाराे मानर्वी र्सान यांचेंाही र्समार्वेशा अर्सेल.

() "पोल प्रिकऑस्क" म्हजे डिर्वद्युत डिर्कंर्वा र्काशा खांबांर्वरा बर्सडिर्वलेले जाडिहरात र्सान.

(ढी) "पोस्टरा" म्हजे र्सार्वसजडिनर्क डिर्काी जाडिहरातीर्साी र्वापरालेले र्कागदो डिर्कंर्वा इंतरा र्साडिहत्याचेंे पत्रार्क.

() "तात्पुराती जाप्रिहारात" म्हजे मयासडिदोत र्कालार्वीर्साी तात्पुरात्या र्संराचेंनेर्वरा (फ्रीेम), बॅनरा, र्कटा-आऊटा, गेटा इंत्यादोी) दोडिशासत र्कराण्यात येाराी जाडिहरात होय. डिनासरिरात र्कालार्वी र्समाप्त झाल्यानंतरा अशाी जाडिहरात तर्सेचें र्संबंडित र्संराचेंना र्काढीून टार्कण्याचेंा उद्देशा अर्सतो.

(२) "जाप्रिहारात संस्था प्रिकंवा एजसी" म्हजे जाडिहरात तर्सेचें यापर्क अर्थासने डिर्वपन क्षेत्रात डिर्वशाेष र्सेर्वा दोान र्कराण्यार्साी स्र्थापन र्कराण्यात आलेली स्र्वतंत्रा र्संस्र्था.

(३) "जाप्रिहारात दोशाषन पायेाभाूत सुप्रिवधा/ जाप्रिहारात फुलक व हाोप्रिडंग/ जाप्रिहारात संराचैना" म्हजे जाडिहरात र्कराे, माडिहती दोे डिर्कंर्वा र्कोतेही डिर्का, यक्ती, र्सार्वसजडिनर्क र्कायसक्रम, र्वस्तू डिर्कंर्वा यापारिरार्क मालार्के जनतेचेंे लक्षे र्वेण्यार्साी,अक्षेराे, डिचेंन्हे डिर्कंर्वा डिचेंत्राे लार्वून बाह्य डिर्काी र्कोत्याही र्काराे दोडिशासत र्केलेली र्कोतीही पृष्भाग डिर्कंर्वा र्संराचेंना; तर्सेचें अशाी पृष्भाग डिर्कंर्वा र्संराचेंना जी र्कोत्याही इंमारातीर्स जोलेली, डितचेंा भाग अर्सलेली डिर्कंर्वा र्संबंडित अर्सलेली, डिर्कंर्वा झा, जमीन, खांब, पदोा, र्कु ंप, होडिंग यांर्वरा डिनव्हिश्चेंत र्केलेली, डिर्कंर्वा मोर्कळ्या जागेत अर्थर्वा महाराष्ट्र र्सागराी मंळाच्या अडिर्काराक्षेत्रातील र्कोत्याही जलाशायात डिर्कंर्वा त्यार्वरा दोडिशासत र्केलेली अर्सेल.

(४) "ाप्रिधाकराण प्रिकंवा परावानादोाता" म्हजे मुख्य र्कायसर्काराी अडिर्काराी, महाराष्ट्र र्सागराी मंळ (एमएमबी) डिर्कंर्वा त्यांच्यार्कून डिर्वडिर्वत ाडिर्कृत र्कराण्यात आलेला अडिर्काराी.

(५) "शाुक" म्हजे एजन्र्सीर्कून ाडिर्करार्स दोेय अर्सलेले ीडिमयम शाुल्र्क र्व डिर्कमान परार्वाना शाुल्र्क यांचेंी एर्कडित्रात राक्र्कम.

(६) "जाप्रिहारात परावाना प्रिकंवा परावाना" म्हजे जाडिहरात लार्वण्यार्साी ाडिर्करार्कून दोेण्यात आलेली परार्वानगी.

(७) "स्थाप्रिनक शासन" म्हजे र्संबंडित जाडिहरात स्र्थळाच्या शाहरा, डिजल्हा, तालुर्का डिर्कंर्वा गार्वाच्या शार्सनार्साी जबाबदोारा अर्सलेले, महाराष्ट्र र्सागराी मंळायडितरिराक्त इंतरा ाडिर्करा.

(८) "प्रिकमान परावाना शाुक" म्हजे या डिर्वडिनयमांच्या डिर्वडिनयम ६ अन्र्वये ाडिर्कराने डिनासरिरात र्केलेले डिर्कमान दोरा.

(९) "एमएमबॅी" म्हजे महाराष्ट्र र्सागराी मंळ.

(१०) "ीप्रिमयेम शाुक" म्हजे डिनडिर्वदोा डिक्रयेदोराम्यान एजन्र्सीने उद्धृत र्केलेले र्व ाडिर्कराने मान्य र्केलेले, डिर्कमान परार्वाना शाुल्र्कायडितरिराक्त अडितरिराक्त शाुल्र्क.

(११) "लावणे प्रिकंवा जाप्रिहारात लावणे" म्हजे र्कोतीही जाडिहरात उभाराे, दोडिशासत र्कराे, बर्सडिर्वे, डिनव्हिश्चेंत र्कराे, र्कायम ेर्वे डिर्कंर्वा र्कोत्याही र्काराे जाडिहरात दोाखाडिर्वे.

(१२) या डिनयमांमध्ये र्वापरालेले परांतु परिराभाडिषत न र्केलेले शाब्दो र्व अडिभायक्ती यांना लागू अर्सलेल्या र्कायद्युांनुर्सारा दोेण्यात आलेला अर्थस लागू राहील.

३. जाप्रिहारातंचैे कारा

(१) मोठ्या आकाराच्येा जाप्रिहाराती (Large-Format Advertisements): ज्या जाडिहरातंचेंे क्षेत्राफळ २०० चेंौ.फुटांपेक्षेा जास्त र्व १६०० चेंौ.फुटांपयंत आहे. अशार्काराच्या जाडिहरात र्सानांमध्ये ामुख्याने होडिंग र्व युडिनपोल यांचेंा र्समार्वेशा होतो.

(२) मध्येम आकाराच्येा जाप्रिहाराती (Medium-Format Advertisements): ज्या जाडिहरातंचेंे क्षेत्राफळ ५० ते २०० चेंौ.फुटांच्या दोराम्यान आहे. अशार्काराच्या जाडिहरात र्सानांमध्ये ामुख्याने होडिंग, युडिनपोल, डिडिजटाल दोशासन फलर्क र्व डिर्कऑस्र्क यांचेंा र्समार्वेशा होतो.

(३) लहान आकाराच्येा जाप्रिहाराती (Small-Format Advertisements) : ज्या जाडिहरातंचेंे क्षेत्राफळ ५० चेंौ.फुटांपेक्षेा र्कमी आहे. अशार्काराच्या जाडिहरात र्सानांमध्ये ामुख्याने डिमनी पोल, पोल डिर्कऑस्र्क र्व जाडिहरात डिर्कऑस्र्क यांचेंा र्समार्वेशा होतो.

(४) वाहानावराील जाप्रिहारात (न्टिस्थारा): महाराष्ट्र र्सागराी मंळाच्या मालमत्तेा/जडिमनीर्वरा र्वाहन पार्क अर्सताना र्वाहनाच्या बाजूर्स डिर्कंर्वा मागील भागार्वरा व्हिस्टार्कराद्वाराे लार्वलेला एर्केराी डिर्कंर्वा दोुहेराी बाजूचेंा जाडिहरात फलर्क, ज्यामुळे र्वाहन व्हिस्र्थरा अर्सताना जाडिहरात स्पष्टापे डिदोर्सून येते.

(५) नौका/बॅाजष/फ्लोटेलवराील जाप्रिहारात : चेंालू व्हिस्र्थतीत अर्सलेल्या नौर्का, बाजस डिर्कंर्वा फ्लोटाेल यांर्वरा बर्सडिर्वलेला डिर्कंर्वा राॅप्र्स स्र्वरूपात डिचेंर्कटाडिर्वलेला एर्केराी डिर्कंर्वा दोुहेराी बाजूचेंा जाडिहरात फलर्क, ज्यामुळे जलर्वाहन चेंालू अर्सताना जाडिहरात स्पष्टापे डिदोर्सून येते.

(६) स्ट्रीट फुप्रिनषचैरा जाप्रिहाराती : र्सार्वसजडिनर्क डिर्काी र्सार्वसजडिनर्क र्सुडिर्वांर्साी बर्सडिर्वण्यात आलेल्या स्ट्रीटा फडिनसचेंरा जर्से र्की र्सार्वसजडिनर्क शाौचेंालये, र्कचेंरापेट्या, बार्के इंत्यादोंर्वरा लार्वलेल्या जाडिहराती.

(७) वाहातूक पायेाभाूत सुप्रिवधांवराील जाप्रिहाराती (न्टिस्थारा): टाडिमसनल इंमारात, जेट्टी इंत्यादोी र्वाहतूर्क र्सुडिर्वांर्वरा डिर्कंर्वा र्संबंडित पायाभाूत र्संराचेंनांर्वरा डिनव्हिश्चेंत र्केलेल्या जाडिहराती.

(८) हावाई जाप्रिहाराती (Aerial Advertisements) : र्कोत्याही र्कोरा र्संराचेंनेचेंा आारा नर्सताना हर्वेत लटार्कडिर्वलेल्या डिर्कंर्वा तरांगत्या स्र्वरूपात दोडिशासत र्केल्या जाऱ्या जाडिहराती. अशार्काराच्या जाडिहरातंर्साी गराम हर्वेचेंे फुगे, ड्रोन, डिर्वमान, पतंग इंत्यादोी र्सानांचेंा र्वापरा र्कराण्यात येतो.

(९) तात्पुरात्येा जाप्रिहाराती (Temporary Advertisements): अल्प र्कालार्वीर्साी दोडिशासत र्केल्या जाऱ्या र्व र्कायसक्रम, र्सभा, अडिर्वेशान, डिशाखारा परिराषदो इंत्यादोंच्या र्सारार्साी र्वापराल्या जाऱ्या जाडिहराती.

(१०) महाराष्ट्र र्सागराी मंळाने र्वेळोर्वेळी डिनदोेडिशात र्केलेल्या इंतरा र्कोत्याही र्काराच्या जाडिहराती.

४. जाप्रिहारात परावाना मंजुराीचैी कायेषपद्धती

(१) महाराष्ट्र र्सागराी मंळाच्या अडिर्काराक्षेत्रात र्कोतीही जाडिहरात उभाराे, दोडिशासत र्कराे, बर्सडिर्वे, डिनव्हिश्चेंत र्कराे, र्कायम ेर्वे डिर्कंर्वा र्कोत्याही र्काराे दोडिशासत र्कराे यार्साी महाराष्ट्र र्सागराी मंळाचेंी पूर्वसपरार्वानगी घोेतल्याडिशार्वाय र्कोत्याही यक्तीर्स डिर्कंर्वा र्संस्र्थेर्स परार्वानगी राहारा नाही. र्कोतीही अनडिर्कृत र्व बेर्कायदोेशाीरा जाडिहरात स्र्थाडिपत र्केल्यार्स त्यातून उद्भार्वाऱ्या र्कोत्याही हानी, इंजा डिर्कंर्वा नुर्कर्सानीबाबत होारा र्सर्वस खाचेंस र्व परिराम यांर्साी र्संबंडित यक्ती डिर्कंर्वा र्संस्र्था पूसपे र्व एर्कट्याने जबाबदोारा राहील.

(२) महाराष्ट्र र्सागराी मंळार्स र्कोतीही अनडिर्कृत र्व बेर्कायदोेशाीरा जाडिहरात र्काढीून टार्के, तोे डिर्कंर्वा डितचेंे दोशासन डितबंडित र्कराण्याचेंा अडिर्कारा राहील.

(३) महाराष्ट्र र्सागराी मंळाच्या अडिर्काराक्षेत्रात र्कोत्याही जाडिहरातीचेंे स्र्थान डिर्कंर्वा डिर्का, र्कारा, आर्कारा र्व इंतरा र्संबंडित डिनर्कष यांर्स मान्यता दोेण्याचेंा अडिर्कारा महाराष्ट्र र्सागराी मंळार्स राहील. महाराष्ट्र र्सागराी मंळार्स र्कोत्याही जाडिहरात र्संराचेंनेत बदोल, पुनस्र्थासपन डिर्कंर्वा र्काढीून टार्कण्याबाबत डिनदोेशा दोेण्याचेंा अडिर्कारा राहील. ाडिर्कराचेंे डिनदोेशा अंडितम र्व र्सर्वस जाडिहरातदोारांर्वरा बंनर्कारार्क राहतील.

(४) महाराष्ट्र र्सागराी मंळ आपल्या अडिर्काराक्षेत्रात लार्वण्यांत येाऱ्या जाडिहरातंर्साी योग्य डिर्काे र्व जाडिहरातंचेंे र्कारा डिनव्हिश्चेंत र्कराील.

(५) डिनव्हिश्चेंत र्केलेल्या डिर्काी जाडिहरातंर्साी जाडिहरात र्संस्र्थेचेंी डिनर्व पारादोशासर्क डिनडिर्वदोा डिक्रयेद्वाराे र्कराण्यात येईल.

(६) डिनर्वलेल्या जाडिहरात र्संस्र्थेर्वरा जाडिहरात लार्वण्यार्साी आर्वश्यर्क अर्सलेल्या र्सर्वस परार्वानग्या र्व मंजुराी ाप्त र्कराण्याचेंी जबाबदोाराी राहील. आर्वश्यर्क परार्वानग्या र्व मंजुराी न घोेता जाडिहरात लार्वल्यार्स त्यार्संबंडित र्सर्वस खाचेंस र्व परिरामांर्साी र्संस्र्था पूसपे र्व एर्कट्याने जबाबदोारा राहील.

(७) डिनर्वलेल्या जाडिहरात र्संस्र्थेने र्सर्वस घोटार्कांर्साी र्संराचेंनात्मर्क राचेंना डिर्कंर्वा आराखाे तर्सेचें र्सडिर्वस्तरा र्संराचेंनात्मर्क गना परार्वानारार्क र्संराचेंनात्मर्क अडिभायंत्यार्कून तयारा र्करून घ्यायात र्व त्यार्स आयआयटाी मु ंबई डिर्कंर्वा ाडिर्कराने मान्यता डिदोलेल्या इंतरा र्कोत्याही र्संस्र्थेर्कून माीर्करा र्करून घ्यार्वे. यायडितरिराक्त, र्सुराडिक्षेतता अनुपालन मापत्राे दोरार्वषी र्सादोरा र्करून त्यार्स आयआयटाी मु ंबई डिर्कंर्वा ाडिर्कराने मान्यता डिदोलेल्या इंतरा र्संस्र्थेर्कून माीर्करा र्करून घ्यार्वे.

(८) र्संस्र्थेचेंी डिनर्व झाल्याचेंी र्सूचेंना ाप्त झाल्यानंतरा पंरा (१५) डिदोर्वर्सांच्या आत डिनर्वलेल्या र्संस्र्थेने ाडिर्करार्स खालीलमाे शाुल्र्क अदोा र्करार्वे :

(अ) र्सहा (६) मडिहन्यांर्साी दोेय अर्सलेल्या शाुल्र्काइंतर्की राक्र्कम र्सुराक्षेा ेर्व म्हून; आडि

(ब) पडिहल्या मडिहन्यार्साी दोेय अर्सलेले आगाऊ माडिर्सर्क शाुल्र्क;

(र्क) जरा र्संस्र्था पंरा (१५) डिदोर्वर्सांच्या आत र्वराीलमाे राक्र्कम अदोा र्कराण्यात अपयशाी राल्यार्स, डितचेंी डिनर्व आपोआप राद्दे होईल.

(९) त्यानंतरा, डिनव्हिश्चेंत डिर्काी जाडिहरात उभाराण्यार्साी र्संस्र्था र्व ाडिर्करा यांच्यामध्ये र्करारा र्कराण्यात येईल.

(१०) त्यानंतरा र्संस्र्था त्येर्क मडिहन्यार्साी दोेय अर्सलेले माडिर्सर्क शाुल्र्क त्या मडिहन्याच्या पाचें (५) ताराखाेपूर्वी आगाऊ स्र्वरूपात ाडिर्करार्स अदोा र्कराील.

(११) दोेयर्क भाराण्यात डिर्वलंब झाल्यार्स, र्वाडिषसर्क १८ टाक्र्के दोराने याज आर्काराण्यात येईल.

(१२) दोेयर्क भाराण्यातील डिर्वलंब तीन (३) मडिहन्यांपेक्षेा जास्त झाल्यार्स, परार्वाना राद्दे र्कराण्यात येईल र्व र्संबंडित जाडिहरात र्संराचेंनेचेंा ताबा महाराष्ट्र र्सागराी मंळार्के येईल.

(१३) र्करारातील अटाी र्व शातंचेंे उल्लंघोन नर्सल्यार्स परार्वान्याचेंी मुदोत र्संपल्यानंतरा र्सुराक्षेा ेर्व र्कोतेही याज न दोेता परात र्कराण्यात येईल. अटाी र्व शातंचेंे उल्लंघोन झाल्यार्स महाराष्ट्र र्सागराी मंळाने डिनव्हिश्चेंत र्केलेली राक्र्कम र्सुराक्षेा ेर्वीतून जप्त र्कराण्यात येईल.

५. परावायेाचैा कालावधाी

(१) र्कोत्याही र्काराच्या जाडिहरातीर्साी र्कमाल परार्वाना र्कालार्वी दोहा (१०) र्वषांचेंा राहील.

(२) परार्वाना जाराी झाल्याच्या डिदोनांर्कापार्सून परार्वानारार्कार्स र्संबंडित ाडिर्करांर्कून आर्वश्यर्क र्सर्वस परार्वानग्या र्व मंजुराी ाप्त र्कराण्यार्साी र्सहा (६) मडिहन्यांचेंा र्कालार्वी दोेण्यात येईल.

(३) र्वराील र्सहा मडिहन्यांचेंा र्कालार्वी पूस झाल्यानंतरा, जाडिहरात र्संराचेंना पूस झाली आहे डिर्कंर्वा र्कायासव्हिन्र्वत आहे अर्थर्वा नाही याचेंा डिर्वचेंारा न र्कराता, दोहा (१०) र्वषांचेंा परार्वाना र्कालार्वी तात्र्काळ र्सुरू होईल. परार्वानारार्क लागू अर्सलेले परार्वाना शाुल्र्क र्सातया मडिहन्याच्या ारांभापार्सून भाराण्यार्स जबाबदोारा राहील.

(४) परार्वान्याचेंी मुदोत र्संपल्यानंतरा नर्वदो (९०) डिदोर्वर्सांच्या आत परार्वानारार्काने र्संबंडित जाडिहरात र्काढीून टार्के बंनर्कारार्क राहील. याबाबत खालील अटाी लागू राहतील:

(अ) जाडिहरात र्काढीून टार्केपयंत परार्वानारार्कार्स माडिर्सर्क शाुल्र्क अदोा र्कराे बंनर्कारार्क राहील.

(ब) र्वराील अटाीचेंे पालन न र्केल्यार्स, दोेय माडिर्सर्क शाुल्र्काइंतर्का दों आर्काराण्यात येईल तर्सेचें अनुपालन न र्केल्याबद्देल त्येर्क मडिहन्याच्या माडिर्सर्क शाुल्र्काच्या २५ टाक्र्के इंतर्का अडितरिराक्त अडिभारा आर्काराण्यात येईल.

(र्क) परार्वान्याचेंी मुदोत र्संपल्यानंतरा नर्वदो (९०) डिदोर्वर्सांच्या आत जाडिहरात न र्काढील्यामुळे र्कोतीही हानी, इंजा डिर्कंर्वा नुर्कर्सान झाल्यार्स, त्या र्सर्वस खाचेंस र्व परिरामांर्साी र्संस्र्था पूसपे र्व एर्कट्याने जबाबदोारा राहील.

() परार्वान्याचेंी मुदोत र्संपल्यानंतरा नर्वदो (९०) डिदोर्वर्स उलटाल्यानंतरा र्संबंडित जाडिहरात अनडिर्कृत जाडिहरात म्हून गली जाईल.

६. प्रिकमान परावाना शाुकाचैी प्रिनन्टिचैती

(१) डिर्कमान परार्वाना शाुल्र्क हे बृहन्मु ंबई महानगरापाडिलर्केद्वाराे र्वेळोर्वेळी घोडिषत र्केलेल्या "जाडिहरात परार्वाना शाुल्र्क अनुर्सूचेंी" अर्थर्वा र्कंद्रे डिर्कंर्वा राज्य र्सरार्कारा, स्र्थाडिनर्क शार्सन डिर्कंर्वा र्सरार्काराी र्संस्र्था यांद्वाराे डिनासरिरात र्केलेल्या इंतरा र्संबंडित डिनर्कष, शाुल्र्क डिर्कंर्वा दोरांच्या आाराे गना र्केले जाईल.

(२) डिनडिर्वदोा डिक्रयेत र्सहभागी होाऱ्या र्संस्र्थांनी डिर्कमान परार्वाना शाुल्र्कायडितरिराक्त ते दोेण्यार्स तयारा अर्सलेले ीडिमयम शाुल्र्क नमूदो र्करार्वे.

(३) परार्वाना र्कालार्वी दोराम्यान परार्वाना शाुल्र्कात दोरा बारा मडिहन्यानंतरा र्संचेंयी पध्दोतीने १०% र्वाढी र्कराण्यात येईल.

७. छाननी सप्रिमती

डिर्कमान परार्वाना शाुल्र्क डिनव्हिश्चेंत र्कराण्यार्साी, डिनडिर्वदोा दोस्तऐर्वज तयारा र्कराण्यार्साी र्व डिनडिर्वदोा तपार्सीर्साी महाराष्ट्र र्सागराी मंळादोाराे एर्क छाननी र्सडिमती स्र्थापन र्केली जाईल. ह्या र्सडिमती मध्ये खालील अडिर्काऱ्यांचेंा र्समार्वेशा अर्सेल :—

(अ) मुख्य बंदोरा अडिर्काराी, एमएमबी– अध्यक्षे

(आ) उप डिजल्हाडिर्काराी, एमएमबी – र्सदोस्य र्सडिचेंर्व

(इं) उपर्संचेंालर्क, नगराराचेंना, एमएमबी – र्सदोस्य

(ई) डिर्वत्तेीय डिनयंत्रार्क-डिन- मुख्य लेखा अडिर्काराी, एमएमबी– र्सदोस्य

८. तात्पुरात्येा जाप्रिहारातंबॅाबॅत तरातुदोी

(१) तात्पुरात्या जाडिहरातंचेंे दोशासन र्कराण्यार्साी महाराष्ट्र र्सागराी मंळाने डिनासरिरात र्केलेल्या स्र्वरूपात अजस र्सादोरा र्कराे आर्वश्यर्क अर्सेल.

(२) परार्वानगी दोेण्याचेंा डिर्कंर्वा नार्काराण्याचेंा अडिर्कारा महाराष्ट्र र्सागराी मंळार्के राखाून ेर्वण्यात येत आहे.

(३) तात्पुरात्या जाडिहरातंर्साी आर्काराले जाराे शाुल्र्क हे तात्पुरात्या जाडिहरातीच्या डिदोर्वर्सांनुर्सारा गना र्करून डिर्कमान परार्वाना शाुल्र्क अर्सेल.

(४) तात्पुरात्या जाडिहरातंर्साी आर्वश्यर्क अर्सलेले र्सर्वस परार्वाने आडि मंजुराी अजसदोाराने स्र्वतः ाप्त र्कराे बंनर्कारार्क आहे.

९. परावानाधाराकाच्येा कतषव्ये व जबॅाबॅदोाऱ्येा

(१) परार्वानारार्काने राचेंनात्मर्क र्संदोयासच्या दोृष्टाीने जाडिहरातंचेंा आराखा र्सुडिनव्हिश्चेंत र्करार्वा आडि त्या र्सदोैर्व स्र्वच्छ, नीटानेटाक्या र्व र्सुराडिक्षेत व्हिस्र्थतीत राहतील, याचेंी दोक्षेता घ्यार्वी.

(२) परार्वाना ारार्काने अश्लील, भार्क डिर्कंर्वा र्कोताही आक्षेपाहस र्संदोेशा अर्सलेली जाडिहरात दोडिशासत होऊ डिदोली जारा नाही याचेंी खात्राी र्करार्वी.

(३) जाडिहराती ह्या भारातीय जाडिहरात मानर्क परिराषदोेचेंी (Advertisement Standards Council of India) मागसदोशासर्क तत्त्र्वे तर्सेचें इंतरा लागू अर्सलेल्या र्सर्वस मागसदोशासर्क तत्त्र्वांचेंे पालन र्कराऱ्या अर्सायात.

(४) परार्वानारार्काने जाडिहरातीच्या तळाशाी र्कोपऱ्यार्वरा परार्वानारार्काचेंे नार्व र्व परार्वाना क्रमांर्क डिनव्हिश्चेंत र्केलेल्या मापात लार्वार्वा, जेर्करून परार्वानारार्काचेंी ओळखा र्सहज शाक्य होईल. तर्सेचें, परार्वान्याचेंा र्कालार्वी र्समाप्त होण्याचेंा मडिहना र्व र्वषस डिचेंन्हांत (उदोा. ९/२५ म्हजे र्सप्टांबरा २०२५, ७/२६ म्हजे जुलै २०२६) दोाखार्वार्वा. परार्वाना क्रमांर्क, परार्वानारार्काचेंे नार्व र्व र्संपर्क क्रमांर्क दोेखाील स्पष्टापे लार्वे आर्वश्यर्क आहे. परार्वानारार्काच्या नार्वाचेंा अक्षेरांचेंा आर्कारा अर्सा अर्सार्वा र्की तो जाडिहरातीच्या तळापार्सून स्पष्टापे र्वाचेंता येईल.

(५) परार्वाना र्कालार्वीत, परार्वानारार्काने ाडिर्कराने डिनासरिरात र्केलेली र्सार्वसजडिनर्क दोाडियत्र्व डिर्वमा पॉडिलर्सी घोेतली पाडिहजे, जी मृत्यू, इंजा डिर्कंर्वा मालमत्तेच्या हानीर्संबंी तृतीय पक्षेांच्या हक्र्क, डिहतर्संबं आडि जबाबदोाऱ्यांर्साी अर्सार्वी.

११. सामाये अटी

(१) परार्वाना र्कालार्वीत ाडिर्कराचेंी परार्वानगी न घोेता जाडिहरातीत र्कोतेही बदोल र्कराण्यार्स परार्वानगी नर्सेल.

(२) एजन्र्सीर्कून र्करारातील अटाी र्व शाती तर्सेचें परार्वान्याचेंे र्कोतेही उल्लंघोन झाल्यार्स, या र्संदोभासत जाराी र्केलेल्या नोटाीर्समध्ये नमूदो र्केलेल्या र्कालार्वीत एजन्र्सीने र्सदोरा उल्लंघोन दोुरुस्त र्केले नाही तरा महाराष्ट्र र्सागराी मंळार्स परार्वाना राद्दे र्कराण्याचेंा अडिर्कारा राहील.

(३) परार्वाना ारार्कार्कून र्कोत्याही परिराव्हिस्र्थतीत परार्वाना इंतरा र्कोत्याही यक्ती डिर्कंर्वा र्संस्र्थेला उपभाेपट्टीने दोे डिर्कंर्वा हस्तांतरिरात र्कराे अनुज्ञेय राहारा नाही.

(४) जाडिहरातीर्स र्कोत्याही र्कारास्तर्व होाऱ्या नुर्कर्सानार्साी डिर्कंर्वा हानीर्साी महाराष्ट्र र्सागराी मंळ जबाबदोारा राहारा नाही.

No.MMB/CEO/Revenue/2026 .—In exercise of the powers conferred by sub‑section (33) of Section 108, Sections 20, 24 and 35 read with Sections 37, 38 and 41, sub‑section (1) of Section 109 and Section 111 of the Maharashtra Maritime Board Act, 1996 (15 of 1997), and of all other powers enabling it in this behalf, the Government of Maharashtra hereby makes the Maharashtra Maritime Board (Regulation of display of Advertisements) Regulations, 2026 as follows, namely: –

1. Short title, extent and commencement

(1) These Regulations may be called the Maharashtra Maritime Board (Regulation of display of Advertisements) Regulations, 2026.

(2) These Regulations shall apply to the areas falling under the jurisdiction of the Maharashtra Maritime Board.

(3) These Regulations shall come into force from the date of publication of this regulation in the Official Gazette.

2. Definitions

In these regulations, unless the context otherwise specifies—

(1) "Advertisement" means the display of any advertisement in the jurisdiction of the Maharashtra Maritime Board and includes any device or representation in any manner such as announcement or direction by word, letter, model, sign by means of posters, hoarding boards, banners, temporary arches, illuminated signs, name boards, direction boards, digital boards, sky sign, placard, digital, LED, LCD, Backlit Board, Neon Display, Electronic display, Video Display, Laser Show, Balloons etc., within jurisdiction of Maharashtra Maritime Board. The same are defined as under :—

a. "Advertisement on Balloons" means advertisement on air balloons (hot), which are filled with gas and float in the air.

b. "Advertisement on Banner" means cloth or any other material that contains an advertisement or announcement, or written matter for display in a public place.

c. "Advertisement on Digital/ Electronic Display" means an electronically operated advertisement display fixed on a structure.

d. "Advertisement on a Standee" means a display used to promote a product or event mounted on a small concrete base or pole. They are commonly placed in high‑traffic areas, such as retail stores, shopping malls, and event venues, to grab attention and create a visually engaging promotional tool.

e. "Advertisement on an Electronic Billboard" means electronically operated advertisements on a Board.

f. "Advertisement on Glow Sign Box" means an advertisement displayed on a transparent or translucent sheet of any plastic or other material, mounted on a metal sheet box, illuminated from behind using electrical lamps.

g. "Advertisement on Hoarding" means any surface of a structure erected on ground or any portion of the roof of a building or on paper, with characters, letters, or illustrations applied thereto and displayed in any manner whatsoever for advertising or to give information regarding or to attract the public to any place, person, public performance, article of mercantile whatsoever. They are also referred to as Billboards.

i. "Advertisement on Wraps" means paper or any other material, which contains an advertisement or announcement, or written matter for display, that is stuck/pasted to a surface of existing infrastructure.

j. "Advertisement on a Cantilever" means a long bar supported/fixed at one end and carrying a load/vertical support at the other end of a long unsupported portion used to hold the structure (portion) erected on the divider of the road or the foot path/pavement for display of road direction/places or advertisement.

k. "Building wrap advertisement" means an advertisement displayed on the scaffolding of a building under construction or repair.

l. "Advertisement Kiosks" means a type of free‑standing advertisement which is fixed to the ground instead of a Pole. These are also known by various other names, such as Lollypops, Mini poles, etc., based on configuration and norms.

m. "Advertisement on Vehicle (Parked)" means a single or double‑sided advertisement board affixed by means of a sticker on the side panel or behind a vehicle in a manner that the advertisements draw visibility while the vehicle is parked on the MMB property/land.

n. "Barge" means a flat‑bottomed cargo transporter, often without independent propulsion.

o. "Advertisement Device" means any advertisement medium used to display an outdoor advertisement. For clarification, such Outdoor advertisement devices shall include motorised, non‑motorized vehicles and humans wherever used for the display and dissemination of advertisements.

p. "Pole Kiosks" means advertisement devices fixed to Poles – mainly electric or light poles.

q. "Poster" means a sheet of paper or any other material used to advertise in public places.

r. "Temporary Advertisement" means such advertisement which is displayed on a Temporary structure (Frame, Banner, Cut‑out, Gate, etc.) for a limited duration with the intent to discontinue such advertisement as well as structure upon the expiration of the time period.

(2) "Advertising Agency or Agency" means an independent entity established to provide specialized services in advertising and, more broadly, in marketing.

(3) "Advertising Display Infrastructure / Advertising Sign and Hoarding/ Advertisement Structure" means any surface or structure with characters, letters or illustrations applied there to and displayed in any manner whatsoever outdoors for the purpose of advertising or giving information or to attract the public to any place, person, public performance, article or merchandise, and which surface or structure is attached to, forms part of, or is connected with any building, or is fixed to a tree or to the ground or to any pole, screen, fence or hoarding or displayed in space, or in or over any water‑body included in the jurisdiction of the Maharashtra Maritime Board.

(4) "Authority or Licensor" means Chief Executive Officer, Maharashtra Maritime Board (MMB) or an Officer duly authorised by him.

(5) "Fees" means the sum of Premium Fees and the Minimum License Fees, as payable by the Agency to the Authority.

(6) "Advertisment License or License" means permission accorded by the Authority for the installation of the advertisement.

(7) "Local Administration" means the authority, other than Maharashtra Maritime Board, responsible for the administration of the city, district, taluka, or village of the place of Advertisement, as applicable.

(9) "MMB" means Maharashtra Maritime Board.

(10) "Premium Fees" means the Premium Fees quoted by the Agency and agreed by the Authority during the bidding process, over and above the Minimum License Fees.

(11) "Installation or Installation of Advertisement" means to erect, exhibit, fix, or retain any Advertisement or display any Advertisement in any manner whatsoever.

(12) The words and expressions used but not defined in these regulations shall have the meaning assigned to them in the applicable laws.

3. Types of Advertisements

(1) Large-Format Advertisements : Advertisements which are having area of more than 200 sq. ft. up to 1600 sq. ft. These types of advertisement devices are often Hoardings and Unipoles.

(2) Medium-Format Advertisements : Advertisements which are having area between 50 ‑ 200 sq. ft. These types of advertisement devices are often Hoardings, Unipole, Digital display, and Kiosks.

(3) Small-Format Advertisements : Advertisements which are having area of less than 50 Sqft. These types of advertisement devices are often Mini poles, Pole Kiosks, and Advertisement Kiosks.

(4) Advertisement on Vehicle (Parked) : Advertisements that have a single or double‑sided advertisement board affixed by means of a sticker on the side panel or behind a vehicle in a manner that the advertisements draw visibility while the vehicle is parked on the Maharashtra Maritime Board property/land.

(5) Advertisement on Vessels/Barges/Floatels : Means a single or double‑sided advertisement board affixed or Wraps on a vessel in a manner that the advertisements draw visibility while the vessel/Barges/Floatels is plying.

(6) Street Furniture Advertisements : Advertisements which are placed on street furniture installed for public conveniences in public places such as public toilets, dustbins, benches, etc. (7) Advertisements at Transit Infrastructure (Static) : These advertisements are located at transit facilities and fixed to infrastructure such as the Terminal building, Jetty, etc. (8) Aerial Advertisements : Means advertisements which are suspended/floated in the air without any means of a rigid structure. These types of advertisement devices use hot air balloons, drones, planes, kites, etc.

(9) Temporary Advertisements : Means advertisements which are displayed for shorter periods and are used for advertising events, meetings, conclaves, summits, etc.

(10) Any other Advertisement as prescribed by the Maharashtra Maritime Board.

4. Procedure for Grant of Advertising License

(1) No person or entity shall erect, exhibit, fix, or retain any Advertisement or display any Advertisement in any manner whatsoever within the jurisdiction of the Maharashtra Maritime Board without the prior permission of the Maharashtra Maritime Board. The person or entity who has done the installation of any unauthorised and illegal advertisement shall be fully and solely responsible for all the costs and consequences of any damage, injury or loss incurred due to such unauthorised and illegal advertisement.

(2) Maharashtra Maritime Board shall have the power to remove, dismantle, or prohibit the display of any unauthorised and illegal advertisement.

(3) The approval for placement or location of any advertisement under Maharashtra Maritime Board's jurisdiction, their types and sizes and any other relevant parameters, shall be provided by महाराष्ट्र शासन राजपत्र असाधाराण भाग दोन, एप्रिल १०, २०२६/चैत्र २०, शाके १९४८ ११ Maharashtra Maritime Board. Maharashtra Maritime Board can issue directions for alteration, re‑positioning or removal of any advertisement structure. The directions of the Authority are final and binding on all advertisers.

(4) Maharashtra Maritime Board will identify suitable locations for advertisements and types of advertisements to be installed under Maharashtra Maritime Board's jurisdiction.

(5) Selection of the Advertising Agency for advertisement in identified locations shall be done by a transparent bidding process.

(6) The selected Advertising Agency shall be responsible for obtaining all requisite permissions and approvals for the installation of the advertisement. The selected Advertising Agency shall be fully and solely responsible for all the costs and consequences of the installation of the advertisement without obtaining all requisite permissions and approvals.

(7) The selected Advertising Agency shall ensure that the structural design and/or plans, along with detailed structural design calculations, are prepared and approved by a licensed structural engineer, and duly vetted by IIT Mumbai or any other agency approved by the Authority, for all components. Additionally, Safety Compliance Certificates shall be submitted annually and duly vetted by IIT Mumbai or any other agency approved by the Authority.

(8) Within fifteen (15) days after receipt of intimation of the selection of the Agency, the selected Agency shall pay the following Fees to the Authority :—

a. An amount equivalent to the Fees payable for six (6) months as a Security Deposit, and b. Advance monthly fees payable for the first month.

c. If the Agency fails to pay the same within fifteen (15) days, the selection shall stand cancelled.

(9) Thereafter, an agreement shall be executed between the Agency and the Authority for putting up the advertisement at the specified location.

(10) Subsequently, the Agency shall make timely advance payments to the Authority for the monthly fees payable before the fifth (5th) of every month for which the fee is due.

(11) In the event of delayed payment, interest at the rate of 18 per cent per annum shall be levied.

(12) If the delay in payment exceeds three (3) months, the license shall be cancelled, and possession of the advertisement shall vest with the Maharashtra Maritime Board.

(13) The Security Deposit shall be refunded without interest upon expiry of the license period, subject to there being no breach of the terms and conditions of the agreement. In the event of breach of any terms and conditions, such amount as may be determined by the Maharashtra Maritime Board shall be forfeited from the Security Deposit.

5. Period of License

(1) The maximum License Period for any type of Advertisement shall be Ten (10) years.

(2) A period of six (6) months from the date of issuance of the License shall be given to the Licensee for obtaining all requisite permissions and approvals from the concerned authorities.

(3) The License Period of Ten (10) years shall commence immediately after completion of the said six‑month period, irrespective of whether the advertisement structure is completed or operational. The Licensee shall be liable to pay the applicable License Fees from the commencement of the seventh month.

(4) The Licensee shall remove the Advertisement within ninety (90) days from the date of expiry of the license. The following conditions shall apply in this regard :—

a. The Licensee shall be liable to pay the monthly fees till the removal of the Advertisement.

b. Failure to comply with the above clause shall result in a penalty equivalent to the monthly Fees payable, along with an additional charge of 25% of the monthly Fees for each month of non‑compliance.

c. In the event of any damage, injury, or loss arising due to failure in removing the Advertisement within ninety (90) days from the license expiry date, the Agency shall be fully and solely responsible for the costs and consequences of such damage, injury or loss incurred.

d. The Advertisement shall be treated as an unauthorised advertisement after the expiry of ninety (90) days from the license expiry date.

6. Fixation of Minimum License Fees

(1) Minimum License Fees will be calculated based on "The Schedule of Fees for Advertisement Permits" prescribed by the Brihanmumbai Municipal Corporation (BMC) from time to time, or any other relevant parameters or fees or rates prescribed by the Central or State Government or Local Administration or Government Entities.

(2) The participants in the bidding process should quote the Premium Fees that they are willing to pay over and above the Minimum License Fees.

(3) The license fee shall escalate by Ten percent (10%) after every 12 months cumulatively during the license period.

7. Scrutiny Committee

A Scrutiny Committee will be established by Maharashtra Maritime Board for the fixation of Minimum License Fees, preparation of Tender Document, and Scrutiny of Bids. Committee members shall include :—

a. Chief Port Officer (CPO), MMB ‑ Chairperson

b. Deputy Collector, MMB – Member Secretary

c. Deputy Director of Town Planning (DDTP), MMB ‑ Member

d. Financial Controller cum Chief Accounts Officer (CAFO), MMB ‑ Member e. Superintending Engineer (SE), MMB ‑ Member.

8. Provisions for Temporary Advertisement

(1) An application has to be submitted for the display of Temporary Advertisements in the format prescribed by the Maharashtra Maritime Board.

(2) Maharashtra Maritime Board reserves the right to permit or deny permission.

(3) The Fees for Temporary Advertisements shall be the Minimum License Fees, calculated for the number of days of Temporary Advertisement.

(4) All requisite permissions and approvals for Temporary Advertisements shall be taken by the applicant.

9. Duties and Responsibilities of Licensee

(1) The Licensee shall ensure that the Advertisements are aesthetically designed and properly maintained in a clean, tidy, and safe condition at all times.

(2) The Licensee must ensure that advertisements of obscene, ostentatious nature or any other offensive message is not allowed to be displayed.

(3) The advertisement shall adhere to the Advertisement Standards Council of India Guidelines and all other applicable guidelines.

(4) The Licensee shall display or affix his name and License number of approved size, in the place allotted at the bottom corner of the Advertisement to facilitate identification of the Licensee. He shall also display the month and year of expiry of the License in symbols (viz 9/25 for September महाराष्ट्र शासन राजपत्र असाधाराण भाग दोन, एप्रिल १०, २०२६/चैत्र २०, शाके १९४८ १३ 2025, 7/26 for July 2026 etc.), the License number, Licensee name and contact number. The font size of the name of the Licensee should be of dimensions such that it shall be easily and clearly readable from the base level of the Advertisement, or as the case may be.

(5) During the License Period, the Licensee shall obtain a Public Liability Insurance policy as prescribed by the Authority, with regard to the rights, interests, and liabilities to third parties in cases of death or injury or damage to property.

10. General Conditions

(1) No modifications to the Advertisement shall be permitted during the period of License without the permission of the Authority.

(2) On any breach of terms and conditions of the agreement and the License committed by the Agency, MMB shall have the right to cancel the License if the Agency doesn't rectify the breach within the timeframe stipulated in the notice issued in this regard.

(3) Sub‑leasing or transfer of the License by the Licensee to any other person or entity shall not be permitted under any circumstances.

(4) The Maharashtra Maritime Board shall not be responsible for any loss or damage to the Advertisement for any reason whatsoever.
