No.TPS-2423-1584-CR-49-2024-EP-Publication-Corrigendum-UD-9.-
Whereas, the Development Plan of Wadi Municipal Council, Wadi, Dist. Nagpur, has been partly sanctioned by the Government vide Urban Development Department's Notification No.TPS- 2423-1584-CR-49-2024-D.P. Sanction (Partly)/UD-9, dated the 15th October, 2024 and the Re- published Development Plan of excluded parts of substantial natures modifications, has been published by the Government vide Urban Development Department's Notice No.TPS- 2423-1584-CR- 49-2024-EP Publish-UD-9, dated the 15th October, 2024 (hereinafter referred to as "the said Notice"), under section 31(1) of the Maharashtra Regional & Town Planning Act. 1966;
And whereas, some corrections are required to be made in "Schedule-B" appended to the said Notice;

ORDER
No.TPS-2226-205-CR-104-2026-UD-9:-
Whereas, the Government of Maharashtra vide Urban Development Department's Notification No.TPS-2284-1823-C.R.105-UD-9, dated 20th December, 1988 has appointed Maharashtra Housing and Area Development Authority (MHADA) as "Special Planning Authority"६ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, जुलै ९-१५, २०२६/आषाढ १८-२४, शके १९४८ under the provision of section 40(1)(b) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") to undertake planned and orderly development of the notified area of New Chandrapur as proposed in the sanctioned Regional Plan of Chandrapur- Ballarpur Region & the Government vide Urban Development Department's Notification No. TPS-2294-471-CR-159-UD-9, dated 30th June, 1998 has sanctioned the Development Plan for the aforesaid Notified Area which has come into force with effect from the 01st September, 1998 (hereinafter referred to as "the said Development Plan");
And whereas, in the said Development Plan, the land bearing Survey No.92/2 admeasuring 0.69 Hectare of Mouja Kosara (hereinafter referred to as "the said Land") is reserved as "Site No.49- Secondary School", Site No.50-Play Ground" & "Site No.51- Primary School" (hereinafter referred to as "the said Reservations") and the Appropriate Authority and Planning Authority for the said Reservations is Nagpur Housing & Area Development Corporation, Nagpur (hereinafter referred to as "the said Special Planning Authority");
And whereas, the said Land under the said Reservations has not been acquired by the said Special Planning Authority within ten years from the date on which the said Development Plan came into force;
And whereas, the Owners of the said Land, had served a notice dated 1st September, 2023 under section 127(1) of the said Act to the said Special Planning Authority (hereinafter referred to as "the said Notice");
And whereas, even after service of the said Notice as aforesaid, the said Land had neither been acquired, within prescribed time period nor the Notification of land acquisition required under section 126(4) of the said Act, read with Section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, has been published by the said Appropriate Authority within prescribed time period from the date of the service of said Notice;
And whereas, the owners of the said Land, have filed Writ Petition No.5858/2025 before the Hon'ble Bombay High Court, Nagpur Bench, Nagpur and the final order dated 26th March, 2026 is passed by the Hon'ble High Court, Nagpur Bench, Nagpur;
And whereas, it is observed that, the said Land had neither been acquired, within prescribed time period from the date of service of Notice, nor Notification of land acquisition required under section 126(4) of the said Act, read with section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act. 2013, been published within prescribed time period by the said Appropriate Authority and in consequence thereof, the Government of Maharashtra is of the opinion that, the said Reservations on the said Land stands lapsed as per the provisions of section 127(1) of the said Act;
Now, therefore, in exercise of the powers conferred by sub-section (2) of section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra, as mentioned in the Annexure below, hereby notifies that, the said Reservations "Site No.49- Secondary School", Site No.50-Play Ground" & "Site No.51-Primary School" as specified in the said Development Plan, stands lapsed to the extent of land bearing Survey No.92/2 admeasuring 0.69 Hectare of Mouja Kosara, Tal. Dist. Chandrapur and the area so released will be available to the owner for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan.

Whereas, the Government of Maharashtra vide Urban Development Department's Notification No.TPS-2284-1823-C.R.105-UD-9, dated 20th December, 1988 has appointed Maharasht Housing and Area Development Authority (MHADA) to be "Special Planning Authority" under the provision of section 40(1)(b) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") to undertake planned and orderly development of the notified area of New Chandrapur as proposed in the sanctioned Regional Plan of Chandrapur- Ballarpur Region & the Government vide Urban Development Department's Notification No. TPS-2294-471-CR-159-UD-9, dated 30th June, 1998 has sanctioned the Development Plan for the aforesaid Notified Area which has come into force with effect from the 01st September, 1998 (hereinafter referred to as "the said Development Plan");
And whereas, in the said Development Plan, the land bearing Survey No.292 (Part) of Mouja Datala is reserved for "Reservation No. 112 - Primary School" and "Reservation No. 113 Garden," and the land bearing in Survey No. 293/1/A is reserved for "Reservation No. 113 Garden" (hereinafter referred to as "the said Reservations") and the Appropriate Authority for the said Reservation is Maharashtra Housing & Area Development Authority (hereinafter referred to as "the said Special Planning Authority");
And whereas, the said Lands under the said Reservations has not been acquired by the said Special Planning Authority within ten years from the date on which the said Development Plan has come into force;
And whereas, the Owners of the said Lands, had served a notice dated 31st December, 2020 under Section 127(1) of the said Act, to the said Special Planning Authority, also being the Appropriate Authority (hereinafter referred to as "the said Notice");
And whereas, even after service of the said Notice as aforesaid, the said Lands had neither been acquired, within prescribed time period nor the Notification of land acquisition required under section 126(4) of the said Act, read with Section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, has been published by the said Special Planning Authority within prescribed time period from the date of the service of said Notice;
And whereas, the owners of the said Lands, have filed Writ Petition No.3927/2025 before the Hon'ble Bombay High Court, Nagpur Bench, Nagpur and the final order dated 13th January, 2026 is passed by the Hon'ble High Court;
And whereas, it is observed that, the said Lands had neither been acquired, within prescribed time period from the date of service of Notices, nor Notification of land acquisition required under१० महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, जुलै ९-१५, २०२६/आषाढ १८-२४, शके १९४८ section 126(4) of the said Act, read with section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, been published within prescribed time period by the said Special Planning Authority and in consequence thereof, the Government of Maharashtra is of opinion that, the said Reservations on the said Lands, stands lapsed as per the provisions of section 127(1) of the said Act;
Now, therefore, in exercise of the powers conferred by sub-section (2) of section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra, as mentioned in the Annexure below, hereby notifies that, "Reservation No. 112 – Primary School" and "Reservation No. 113 - Garden" stands lapsed to the extent of land bearing Survey No.292 (Part) admeasuring 0.35 Hectare and "Reservation No. 113 - Garden" stands lapsed to the extent of land bearing Survey No. 293/1/A admeasuring 1.1453 Hectare of Mouja Datala, Tal. Dist. Chandrapur, and the area so released will be available to the owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan.

Whereas, the Development Plan of Hinghanghat Municipal Council has been sanctioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide Notification No. TPS- 2905-3248-CR-121-2005-UD-9, dated 26th April, 2006 (hereinafter referred to as "the said Notification") and has come into force with effect१३ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, जुलै ९-१५, २०२६/आषाढ १८-२४, शके १९४८ from dated 15th June, 2006, (hereinafter referred to as "the said Sanctioned Development Plan"); Also, Development Plan for the Excluded Part for the same has been sanctioned vide Notification No. TPS-2907-2170-CR-88-08-UD-9, dated 11th August, 2008 and has come into force with effect from 26th September, 2008.
And whereas, in the said Sanctioned Development Plan, the S.No. 72-1 (P) of Mouja Pimpalgaon is affected by proposed 12 m. and 24 m. wide Development Plan roads, and S.No. 72-2 (P) is affected by proposed 24 m. wide Development Plan road (hereinafter referred to as "the said reservation"). The Planning and Appropriate Authority for the acquisition and development of the said Reservation is Municipal Council, Hinganghat (hereinafter referred to as "the said Appropriate Authority");
And whereas, the lands affected by the said Reservations have not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan came into force;
And whereas, Shri. Niraj Vasantrao Lohakare and three others, the concerned land owners (hereinafter referred to as "the said Land Owners") of the Land bearing S.No.72/1 (P) and 72/2 (P) admeasuring area approximately 0.5494 ha. is affected by the said Reservation (hereinafter referred to as "the said Land") had served a notice as per the provisions of section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 27th December, 2022 and same has been recieved by the Appropriate Authority on 30th December, 2022;
And whereas, it is evident from the received 7/12 extract, that the area of land in the said S.No.72/1 (P) and 72/2 (P) belongs to the said land owners ;
And whereas, the said lands under the said Reservation are not acquired or no steps as required as per the provisions of section 127 (1) of the said Act have been undertaken by the Appropriate Authority within the stipulated period from the date of service of the said notice;
And whereas, Hon'ble High Court of Judicature at Mumbai, Nagpur Bench Nagpur vide its order dated 26th March, 2026 (hereinafter refered to as "the said order") in Writ Petition No. 2071/2024 filed by the said owners of the said land, directed to issue notification in official gazette within reasonable period for lapsing of the said Reservation on the said land;
And whereas, after considering the above facts and the said order in respect of the said Reservations on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of section 127(2) of the said Act, regarding the lapsing of the said reservation on the said land;
And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR- 508-UD-13, dated 1st December, 2016, has delegated the Powers Exercisable by it as per the provisions of section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;

1. The said order is being issued subject to the photocopy of occupancy (vahivat) maps of the Land Record Department submitted by the applicant. As the applicants have not submitted the updated and certified demarcation map of their land under notice, the applicants themselves will be responsible for any future dispute or complaint regarding the area mentioned in this order.
2. The said Land so released from the said Reservation shall become available to the said Land Owner for the purpose of development as otherwise permissible in the case of adjacent Land under the said sanctioned Development Plan.
3. PUBLIC NOTICE

Whereas, Development Plan of Mahadula in Nagpur District has been sanctioned by State Government vide Notificaton No. TPS- 2418-1053-C.R.321(A)-2018-UD-09, dated 31st January, 2019 and came into force with effect from 22nd March, 2019. (hereinafter referred to as "said Development Plan");
And whereas, as per the said sanctioned Development Plan of Mahadula, on the proposed 24.0 M. wide Development Plan road from National Highway No. 69 to Shrivas Nagar Sevanand School (Koradi Shiv) and the proposed 24.0 M. wide Development Plan road from National Highway No. 69, Bank of Maharashtra to Ghogali, there is a residential Settlement of about 60 to 70 houses which falls under Encroachment. (hereinafter referred to as "Development Plan roads/ D.P roads"). The Encroachers are the residents since approx, 40 years, hence in order to Regularise their Encroachment on the above said proposed D.P. Roads vide Government Resolution No. Jamin-2025-C.R.236-J-1, dated 1st August, 2025. The General Body of Mahadula Nagar Panchayat has passed Resolution No. 15(1), dated 18th March, 2026 to make modification in the said Development Plan under Section 37 of Maharashtra Regional and Town Planning Act, 1966 to delete the above mentioned proposed 24.0 M. wide Development Plan Roads, the land released from the reservation of the D.P. road on which the existing encroachment lies to be included in Residential Zone and the remaining land released from 24.0 mt. wide D.P. road to be included in the respective adjoining Zones/Reservations etc. The proposed modification is as follows -

Therefore, the document showing proposed modification is kept open for public for inspection on the Notice Board of Mahadula Nagar Panchayat on working days in working hours. Any person having suggestion/objection regarding the proposed modification may communicate to the Chief Officer, Mahadula Nagar Panchayat within one month from the date of publication of this notice in Government Gazette. The suggestions and objections received within the period of one month from the date of publication of this notice in Government Gazette will be heard by Mahadula Nagar Panchayat.
Suggestions/objections will be considered by the Mahadula Nagar Panchayat before submission of the said modification proposal to the State Government.
