No. TPS-3525/183/CR-16/2025/UD-30 :- Whereas, the Development Plan of Umarga City, Dist. Dharashiv (Original Limits + Extended Limits) has been sanctioned by the +]क्ष् ॅ.६ - न् द्ध रूाह्यम्ह ह्यम्ॅरू ॅद्ध ॅन्, ॅ +ह्य रूाह्यम्ह ह्यम्ॅरू ]क्ष् +रू +न्हम्न्, ॅ ह ह्यम्ॅ्रम्न् ा्रद्ध दह न््र. द्धाह्यॅन््र, न्ह्यन्रु द्धन् ह्र रून् ददंम्न् ह्यह म् +ह्य म् +म्ॅ +.

Government, under section 31 of the Maharashtra Regional

Umarga (hereinafter referred to as "the said Land") is inclued in "Agriculture Zone" ;

Condition No.4 - It is mandatory for the concerned

landowners /developers to develop and provide all

necessary basic/infrastructure facilities for the said land at

their own expense.

Condition No.5 - It is mandatory for the landowners /

developers to properly plan the road network within the

lands covered by the said modification proposal.

And whereas, as per the provisions of section 37(1) of the said Act, the Umarga Municipal Council, Dist. Dharashiv vide its Administration Resolution No. 01, dated the 13/06/2024, has resolved to make modification in the said Development Plan, so as to delete the said Land from Agriculture Zone and to include the same in Residential Zone (hereinafter referred to as " the said Proposed Modification") and accordingly submitted the proposal to the Government for sanction vide its Marathi letter No.351/2024, dated the 13/06/2024;

Condition No.6 - While developing the above -

mentioned basic facilities in a phased manner, the applicant

will be restricted on the sale of plots from the total land as

follows. The Chief Officer, Nagar Parishad, Umarga, is

expected and required to monitor this matter.

And whereas, after making necessary enquires and consulting the Director of Town Planning Maharashtra State, Pune, the Government is of opinion that, the said Proposed Modification should be sanctioned with certain conditions;

In case of violation of the above, the layout and

non-agriculture permission will be eligible for revocation.

Now, therefore in exercise of the powers conferred on it under sub-section (2) of section 37 of the said Act, the Government of Maharashtra hereby sanctions the said Proposed Modification by deleting the said Land from Agriculture Zone and including the land so released in Residential Zone, with certain conditions, for 1.37 Hect. land bearing Survey No. 9(part) of Mauje Umarga, as shown on plan and for that purpose amends the above said Notification dated the 04/12/1992 as follows:-

If group housing is to be developed in the layout,

occupation certificate should not be issued unless all the

infrastructure facilities are developed."

"In the Schedule of Modifications appended to the

Notification sanctioning the said Development Plan, the

following new entry shall be added after the last entry:-

A copy of the part plan showing the aforesaid sanctioned modification shall be available in the office of the Chief Officer, Umarga Municipal Council, Dist. Dharashiv during

ENTRY

"The land admeasuring 1.37 Hect. land bearing Survey

No. 9(Pt.) of Mauje Umarga, is deleted from Agriculture

Zone and the land so released is included in Residential

office hours on all working days for inspection of public for Zone as shown on plan, subject to following conditions- a period of one month.

This Notification shall also be published on the Govt. website www.maharashtra.gov.in/Acts & Rules.

Condition No.1 - When developing any area of the

proposed land, as per the relevant provisions of the

sanctioned UDCPR -2020 regulations, it is mandatory to

propose minimum of 10% recreational open space, along

with a minimum of 10% amenity area. Additionally, 50% of

this amenity area must be permanently reserved for open

use, such as gardens, playgrounds, etc. The remaining ame-

nity area should be developed as per regulation no. 3.5.1 of

the sanctioned UDCPR.

(Prasad R. Shinde) Under Secretary to Government Condition No.2 - It is mandatory to properly develop the recreational open land and construct a boundary wall around it.

landowner / developer, to keep the natural water flow (nalla)

located along the southern boundary of the subject land

(ii) These regulations shall come into force on the date of publication.

2. Categories of employees to whom these

(i) Save as otherwise provided by or under these regulations, these regulations shall apply to all persons appointed to the service and holders of the posts in the office of the Maharashtra State Board of Waqf on permanent basis included in such service before or after the commencement of these regulations.

(ii) These regulations shall not apply to the employees appointed by transfer on tenure basis or on deputation who shall be governed by rules applicable to their cadre in the parent departments.

3. Definitions :- In these regulations, unless the context requires otherwise:-

a. "Act" means the Unified Waqf Management, Empowerment, Efficiencyand Development Act, 1995 ;

b. "Appointing Authority" in relation to any posts sanctioned for the Maharashtra State Board of Waqf other than posts filled through deputation means the Chief Executive Officer of Maharashtra State Board of Waqf;

c. "Appointment" means appointments to the services in accordance with these regulations or with the regulations applicable at the time of appointment, as the case may be, to discharge duties in the Maharashtra State Board of Waqf;

d. "Board" means the Maharashtra State Board of Waqfs;

e. "Chairperson" means the Chairperson appointed under sections 14(1) (a) of the Act;

f. "Chief Executive Officer" means the Chief Executive Officer appointed under subsection (1) of section 23 of the Act or the officer holding the charge for the time being;

m. "Hindi language and Marathi language examination" means an examination prescribed by the Government in this behalf;

n. "Promotion" means appointment of any employee from a post of feeder grade or class of service to the next higher grade or class or service under the Board as per prescribed procedure;

o. "Recognized Institution" means an Institution recognized by the Government of Maharashtra;

p. "Secondary School Certificate Examination" means the Secondary School Certificate Examination conducted by a Divisional Board under the Maharashtra Secondary and Higher Secondary Education Board Act, 1965 (Mah.XLI of 1965) and includes any other examination declared by the Government to be equivalent thereto;

q. "Selection Committee" means the Selection Committee constituted under Regulation no.5 of these regulations.

r. "Staffing pattern" means staff sanctioned by the Board with prior consultation with the Government as per section 24(1) of the Act;

4. General conditions:-

g. "Degree" means a degree of a statutory university recognized by the University Grants Commission, Government of India;

h. "Department" means "Minorities Development Department" of the Government of Maharashtra;

i. "Employee" means the person working on regalar basis or on probation basis in the office of the Board:

(i) Performing the duties of the post borne on the establishment of the Board on regular basis or on probation;

(ii) Availing joining time as per applicable regulations;

(iii) Availing authorized holidays;

j. "Government" means the Government of Maharashtra;

k. "Government Commercial Certificate" means a certificate issued by the Maharashtra State Commercial Examination Board, Department of Skill Development & Entrepreneurship, Government of Maharashtra and includes a certificate issued by any other institution as may be specifically declared by the Government to be equivalent thereto;

l. "Higher Secondary School Certificate Examination" means the Higher Secondary School Certificate Examination conducted by a Divisional Board under the Maharashtra Secondary and Higher Secondary Education Board Act, 1965 (Mah. 41 of 1965) and includes any other examination declared by the Government to be equivalent thereto;

(i) Upper age limit for candidates of all categories shall be applicable as per the State Government policy at the time of recruitment by nominations;

(ii) Candidates must be domiciled in Maharashtra state and should have adequate knowledge of Marathi and Urdu languages.

(iii) It shall be mandatory for the person who is appointed by nomination to the posts mentioned in these regulations, to submit a Declaration of Small Family as provided by the Maharashtra Civil Services (Declaration of Small Family) Regulations, 2005 and the Regulations made thereunder from time to time, at the time of appointment to the concerned post.

A person having more than 2 children on the date of submission of Declaration of Small Family, shall be disqualified for fresh appointment. Moreover, a person shall be governed by Government Orders issued from time to time, in this behalf.

(iv) Government policy in respect of medical test, character and antecedents verification, limit on the family size, probationary period, passing of examination in Computer Operation prescribed by the Directorate of Information and Technology, age of retirement, etc. as prescribed by Government shall be applicable to the candidates who are appointed by nomination.

13. Appointments by Nominations :-

(ii) The Board may in consultation with the Government, remove the names of persons from the Select List if they have subsequently proved themselves to be unfit for continuance on the Select List. The removal of the name from the Select List shall entail the reversion of the person concerned if he is already officiating in a higher post.

Appointments by nominations to the posts in the offices of the Board shall be made by the Chief Executive Officer, in accordance with the advice of the Selection Committee constituted in this behalf as per the provisions of Regulation 5 of these Regulations.

The Committee shall prepare a Post-wise Select List of those considered by it to be fit as per the provisions of relevant Regulations, for making appointments by nomination to the concerning posts.

(iii) The Select List shall ordinarily be limited to the number of vacancies already exists and those likely to occur during the following one year.

(iv) The names of the persons included in the Select List shall ordinarily be arranged in order of merit of the competitive examination held in this behalf.

(v) The Select List shall be valid for a period of one year from the date of its preparation.

(v) The period of deputation shall ordinarily be three (3) years, which may be extended for a further period not exceeding two (2) years, with the prior concurrence of the Government.

Notwithstanding anything contained herein, an officer on deputation may, prior to the completion of the deputation period, submit a written request to the Board for repatriation to their parent department. Upon receipt of such request, the Board shall forward the 16. Orders of Appointments by Nominations :-

Notwithstanding the provisions mentioned hereinabove, the department or the Chief Executive Officer, as the case may be, shall have the authority to terminate the deputation and cancel the deputation order at any time, without assigning any reason.

(iv) The Chief Executive Officer shall be competent to issue orders of appointment on deputation to the posts under the offices of the Board.

19. (i) By deputation of a suitable Muslim person from the cadre(s) of Desk Officer, Government of Maharashtra or any other equivalent cadre of any other Department of Government of Maharashtra, having minimum service of not less than 10 years in the Government.

(ii) The person appointed under clause (i) shall be entitled to draw such pay and allowances as may be admissible to him under the relevant regulations, made by the Government.

(iii) The officers/employees appointed by deputation shall be governed by appropriate provisions in the Maharashtra Civil Services (Joining Time, Foreign services and Payments during Suspension, Dismissal and Removal from service) Regulations,1981.

[3] Special Superintendent:-

20. The appointment to the post of "Special Superintendent" shall be made by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of "Superintendent/ District Waqf officer" having a regular and continuous service in the said post not less than three years.

(b) Failing which; appointment to the post of Stenographer (Lower Grade) (Marathi/English) (non- gazetted) in the office of Maharashtra State Board of [4] Stenographer (Higher Grade) (Non Gazetted) :-

21. (a) Appointment to the post of Stenographer (Higher Grade)(Marathi/English) in the office of Maharashtra State Board of Waqf, shall be made by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Stenographer (Lower Grade), in the office of the Board and having not less than three years of regular service in that cadre and possessing qualifications prescribed for appointment by nomination in sub- regulation (i) (ii) & (iii) of regulation 21(b)of these regulations;

(b) Failing which; appointment to the post of Waqf, shall be made by nomination fulfilling following criteria:-

(i) have passed a graduate degree of recognized University or an equivalent qualification, and;

(ii) possess the Government Commercial Certificate with a speed of not less than 100 words per minute in Marathi shorthand and a speed of not less than 30words per minute in Marathi Typewriting or 40words per minute in English Typewriting as the case may be.

(iii) Shall possess qualifications in computer proficiency as prescribed by the Directorate of Information Technology, Government of Maharashtra.

[6]. Junior Engineer:

Stenographer (Higher Grade) (Marathi/English) in the office of Maharashtra State Board of Waqf, shall be made by nomination fulfilling following criteria :-

(i) have passed a graduate degree of recognized University or an equivalent qualification, and;

(ii) possess the Government Commercial Certificate with a speed of not less than 120 words per minute in Marathi shorthand and a speed of not less than 30 words per minute in Marathi Typewriting or 40 words per minute in English Typewriting as the case may be.

(iii) Shall possess qualifications in computer proficiency as prescribed by the Directorate of Information Technology, Government of Maharashtra.

23. (i) Appointment to the post of Junior Engineer in the offices of the Maharashtra State Board of Waqf, shall be made by deputation of a suitable person from the cadre(s) of Junior Engineer of Public Works Department, Government of Maharashtra or any other equivalent cadre of any other Department of Government of Maharashtra having minimum service of not less than 5 years in that post/cadre.

(ii) Failing which, by nomination amongst candidates fulfilling the following eligibility criteria:

(a) Possessing a degree in Civil Engineering recognized by Government or any other qualification declared by the Government to be equivalent thereto;

[5] Stenographer (Lower Grade) :-

22. (a) Appointment to the post of Stenographer (Lower Grade)(Marathi/English) in the office of the Maharashtra State Board of Waqf, shall be made by promotion of a suitable person on the basis of seniority (b) who have minimum three years of experience of working in government offices or semi Government offices or autonomous bodies or reputed private sector construction firms on the post of Engineer.

[7] Superintendent /District Waqf Officer :-

(v) Ratio of Recruitment:

24. Method of Appointment and Eligibility Criteria

The appointments to the post of Superintendent for the Post of Superintendent / District Waqf / District Waqf Officer shall be made in the following Officer

ratio:

(i) Appointment by Nomination:

(i) Twenty-five percent (25%) by nomination; and

The appointment to the post of Superintendent / (ii) Seventy-five percent (75%) by promotion, in District Waqf Officer in the office of the Maharashtra State Board of Waqf may be made by nomination, accordance with sub-regulations (2) and (3) above.

[8] Legal Assistant :-

subject to the following conditions:

a. The candidate shall possess a graduate degree of recognized University or an equivalent qualification;

b. The candidate shall have adequate knowledge of the Urdu language, with the ability to read, write, and speak the same.

25. Appointment to the post of Legal Assistant in the office of the Maharashtra State Board of Waqf, shall be made by nomination amongst candidates fulfilling the following eligibility criteria:

(a) Shall possess a degree in Law of a Statutory University at least in 2nd class;

(ii) Appointment by Promotion:-

The appointment to the post of Superintendent / District Waqf Officer may also be made bypromotion, subject to the following conditions:

a. The candidate shall be a person holding the post of Senior Clerk in the office of the Board;

(b) Have adequate knowledge (read, write & speak) of Urdu language.

(c) Shall have an experience of at least 3 years as junior advocate to a reputed senior lawyers or law firms dealing with civil matters.

[9] Senior Clerk :-

b. The candidate shall have rendered not less than three years of regular service in the said cadre;

c. The candidate shall possess the qualifications prescribed under sub-regulation (1) (a) and (1) (b) above.

Promotion under this sub-regulation shall be made on the basis of seniority subject to fitness.

(iii) Notwithstanding anything contained in these regulations, a person holding the post of Junior Clerk in the establishment of the Board as on or before the 20th day of February, 2022, shall be eligible for appointment to the post of Superintendent / District Waqf Officer, by promotion, subject to the fulfilment of the following conditions:

a. The candidate shall have rendered not less than five years of regular service in the cadre of Junior Clerk;

b. The candidate shall possess the qualifications prescribed under sub-regulation (1)(a) and (1)(b) above.

26.

(i) Appointment to the post of Senior Clerk in the office of the Maharashtra State Board of Waqf, shall be made by nomination amongst candidates fulfilling the following eligibility criteria:

(a) Shall possess a degree/Master's degree/Doctorate/ in Arts, Science, Commerce, Law, (any other degree) of a Statutory University at least in 2nd class;

(b) Shall possess the Government Commercial Certificate with a speed of not less than 30 words per minute in Marathi Typewriting and 40 words per minute in English Typewriting as the case may be given priority.

(c) Have adequate knowledge (read, write & speak) of Urdu language.

(ii) Appointment to the post of Senior Clerk in the office of the Maharashtra State Board of Waqf, shall be made by promotion of a suitable person on the basis of seniority subject to fitness from amongst the personsळ्र रूह्रन् ह्यम्, द्धन्रु]क्ष् रू न्, ाप्म्न् दाम्न्, +रू]/रू]क्ष्दन्क्ष् २७-२, २०२६ : ५-११, ॅ १९४८ १५५५ holding the post of Junior Clerk/Accounts Clerk, in the office of the Board and having not less than three years of regular service in that cadre and possessing qualifications prescribed for appointment by nomination in sub-regulation (i)(a),(b) and (c) of regulations 26 of these regulations.

(iii) Recruitments to be made by nomination and by promotion as per these regulations shall be made in the ratio of 25:75.

(ii) Appointment to the post of Clerk-cum-Typist in the office of the Maharashtra State Board of Waqf, shall be made by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Peon, in the office of the Board and having not less than three years of regular service in that cadre and possessing qualifications prescribed for appointment by nomination in sub-regulation(i) (a),(b) and (c) of regulations 28 of these regulations.

(iii) Recruitments to be made by nomination or by [10] Cashier :-

27. Appointment to the post of Cashier in the office of the Maharashtra State Board of Waqf, shall be made by nomination amongst candidates fulfilling the following eligibility criteria:

(a) Shall possess a degree/Master's degree/Doctorate/ in Commerce or Business Administration, of a Statutory University at least in 2nd class;

promotion as per this regulation shall be made in the ratio 90:10.

(iv) Provided that, if suitable candidates for appointment by promotion are not available, the ratio of appointment by promotion and by nomination can be relaxed for that particular appointment year after the consent of the Appointing Authority.

[12] Driver:-

(b) Shall possess the Government Commercial Certificate with a speed of not less than 30 words per minute in Marathi Typewriting and 40 words per minute in English Typewriting as the case may be given priority.

(c) Have adequate knowledge (read, write & speak) of Urdu language.

29. Appointment to the post of Driver in the office of the Maharashtra State Board of Waqf, shall be made by nomination amongst candidates fulfilling the following eligibility criteria:

(i) Possess an effective driving license to drive a motor vehicle under the Motor Vehicles Act,1939;

[11]. Clerk-cum-Typist :-

28. (i) Appointment to the post of Clerk-cum-Typist in the office of the Maharashtra State Board of Waqf, shall be made by nomination amongst candidates fulfilling the following eligibility criteria:

(a) Shall possess a degree/Master's degree/ Doctorate/ in Arts, Science, Commerce, Law, (any other degree) of a Statutory University at least in 2nd class;

(b) Shall possess the Government Commercial Certificate with a speed of not less than 30 words per minute in Marathi Typewriting and 40 words per minute in English Typewriting as the case may be given priority.

(c) Have adequate knowledge (read, write & speak) of Urdu language.

(ii) Have passed at least Xth standard examination of any recognised Board and can speak the Marathi and Hindi languages;

(iii) Possess not less than three years' experience of driving motor vehicle other than a motor cycle;

(iv) Have clean record and working knowledge of repairs of a motor car or, as the case may be, of a jeep; and

(v) Possess a good physique and knowledge of topography of the concerned area;

(vi) Preference shall be given to a person who is working as a Driver in the establishment of the Board and has rendered not less than five years of service in such capacity; and possesses a certificate of good character issued by the Chief Executive Officer of the Board.

[13]. Peon :-

35. Applicability of Maharashtra State Service

Regulations:-

30. Appointment to the post of Peon in the office of the Maharashtra State Board of Waqf, shall be made by nomination amongst who have passed at least Xth standard examination of any recognised Board and can speak the Marathi and Hindi languages;

Subject to the prior approval of the Minorities Development Department, Government of Maharashtra, the following service regulations, as amended from time to time, shall be applicable to the employees of the Maharashtra State Board of Waqf, [14]. Legal Advisor :-

31. The appointment to the post of "Legal Advisor" shall be made on contractual basis for a period of 3 years from the candidates fulfilling following eligibility criteria-

(i) Possess a degree in law from a of a Statutory University

(ii) Have been an advocate in the High Court or Courts subordinate thereto, for a period not less than three years.

32. The appointment to the post of "Senior System Analyst" shall be made on contractual basis for a period of 3 years from the candidates fulfilling below criteria- (i) Possess degree in Computer Science/Information Technology/B.tech

(ii) shall possess work experience of minimum 5 years with computer hardware or software and analytical skills.

43. Interpretation :-

39. Postings :-

All employees appointed to the service of the Board shall be liable to serve in any office of the Board within the State of Maharashtra, and all postings shall be made in accordance with the approved staffing pattern of the Board.

(1) The power to interpret any of the provisions of these regulations shall vest with the Minorities Development Department, Government of Maharashtra. The decision of the Department in this regard shall be final and binding on all concerned.

40. Transfer :-

(i) All posts on the establishment of the Board shall be liable to state-wide transfers.

(ii) Chief Executive Officer or an officer authorised by him shall prepare a list of employees, in the month of February/March every year, those have completed 3 years or more on the same post.

(iii) Transfer orders shall be issued in the month of April/ May.

(iv) Notwithstanding anything contained herein, transfers may be effected at any time on administrative grounds, and the tenure condition shall not be binding in such cases.

(2) Where the Board is of the opinion that it is necessary or expedient to do so in the interest of administration, or to remove any hardship or difficulty in the implementation of these regulations, it may, with appropriate justification, make a proposal to the Minorities Development Department for relaxation of any provision of these regulations.

(3) The Minorities Development Department, if satisfied with the reasons recorded by the Board, may, by order, grant such relaxation for a specific purpose and for a limited period, subject to such conditions as it may deem fit.

41. Competent Authority to transfer :-
