No. SPP/2026/U.O.R.62/D-XIV.– Whereas, In exercise of the powers conferred by Rule 44 of the Maharashtra Law Oﬃ cers (Appointment, Conditions of Service and Remuneration) Rules, 1984 and Section 15 of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities Act, 1989); the Government of Maharashtra hereby appoints Adv. Amolkumar Duryodhan Gulale as "Special Public Prosecutor" for conducting the case/s pending before the Additional Sessions Court, Nandurbar which is/ are arising out of C.R.No. 258/2025 registered at Upnagar Police Station, district Nandurbar.

The fees of Adv. Amolkumar Duryodhan Gulale as "Special Public Prosecutor" shall be paid by the Home Department as per the fee proposal agreed by the Home Department and approved by this Department.

His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Oﬃ cers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

क्रमांक टीपीएस-३५२३/७७८/प्र.क्र. १५९/२०२६/नवि-९.---- ज्याअर्थी, जळगाव शहर महानगरपालिकेच्या मूळ हद्दीची विकास योजना, महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (सन १९६६ चा महाराष्ट्र अधिनियम क्रमांक ३७) (यात यापुढे "उक्त अधिनियमˮ असे संबोधिले आहे) चे कलम ३१ चे उप-कलम (१) अन्वये शासनाच्या नगर विकास विभागाने अधिसूचना क्रमांक टीपीएस-३५८८/१९४/ प्र.क्र. ९७/नवि-९, दिनांक ६ जानेवारी १९९३ अन्वये मंजूर केली असून ती दिनांक १५ ेब्रुवारी १९९३ पासून अंमलात आली आहे (यात यापुढे "उक्त विकास योजनाˮ असे संबोधिले आहे) ;

आणि ज्याअर्थी, उक्त विकास योजनेमध्ये सोबतच्या परिशिष्टामध्ये वर्णन केलेली मौजे मेहरुण येथील सव्ह क्रमांक ४७५-अ, भूखंड क्रमांक ३९ मधील एकूण ३८०.८९ चौरस मीटर जागेवर (यात यापुढे "उक्त आरक्षित जागाˮ असे संबोधिले आहे) "आरक्षण क्रमांक १६५- पाण्याच्या टाकीचा विस्तारˮ (भागश:) (यात यापुढे "उक्त आरक्षणˮ असे संबोधिले आहे) म्हणून आरक्षित असून उक्त आरक्षणाकरिता समुचित प्राधिकरण जळगाव महानगरपालिका (यात यापुढे "उक्त समुचित प्राधिकरणˮ असे संबोधिले आहे) आहे ;

आणि ज्याअर्थी, उक्त समुचित प्राधिकरणाने उक्त आरक्षित जागा, उक्त विकास योजना अंमलात आल्याच्या दिनांकापासून दहा वर्षांच्या कालावधीमध्ये संपादन केली नाही ;

आणि ज्याअर्थी, उक्त आरक्षित जागेच्या मालकाने उक्त अधिनियमाचे कलम १२७ चे उप-कलम (१) नुसार, उक्त समुचित प्राधिकरणावर दिनांक १३ ेब्रुवारी २०१७ रोजीची सूचना (यात यापुढे "उक्त सूचनाˮ असे संबोधिले आहे) बजावून उक्त जागा, उक्त प्राधिकरणाने विहित कालावधीत संपादन केली नसल्याचे कळविले होते ;

आणि ज्याअर्थी, उक्त सूचना बजावल्यानंतरही उक्त समुचित प्राधिकरणाने विहित कालावधीत उक्त आरक्षित जागा संपादन केली नाही अथवा त्या संपादन करण्यासंबंधीची उक्त अधिनियमाचे कलम १२६ (४) सह, भूसंपादन, पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा आणि पारदर्शकतेचा हक्क अधिनियम, २०१३ चे कलम १९ अन्वयेची भूसंपादनाची अधिसूचना विहित कालावधीत प्रसिद्ध केली नाही ;

आणि ज्याअर्थी, उक्त जागेच्या मालकांनी मा. मुंबई उच्च न्यायालय, औरंगाबाद खंडपीठ, त्रपती संभाजीनगर येथे रिट याचिका क्रमांक ८१८९/२०१९ दाखल केली असून सदर प्रकरणी मा. उच्च न्यायालयाने दिनांक २१ ेब्रुवारी २०२३ रोजी अंतिम निर्णय पारित केलेला आहे ;

आणि ज्याअर्थी, उक्त सूचना बजावल्यापासून, उक्त समुचित प्राधिकरणाने विहित कालावधीत उक्त जागा संपादन केली नाही अथवा उक्त जागा संपादन करण्यासंबंधीची, उक्त अधिनियमाचे कलम १२६ (४) सह, भूसंपादन, पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा आणि पारदर्शकतेचा हक्क अधिनियम, २०१३ चे कलम १९ अन्वये भूसंपादनाची अधिसूचना विहित कालावधीत प्रसिद्ध केलेली नाही. त्यामुळे या परिस्थितीत उक्त अधिनियमाचे कलम १२७ (१) मधील तरतुदीनुसार उक्त आरक्षित जागेवरील उक्त आरक्षण व्यपगत झाले असल्याचे शासनाचे मत झाले आहे.

आता त्याअर्थी, उक्त अधिनियमाचे कलम १२७ (२) नुसार प्राप्त अधिकारात राज्य शासन, जळगाव शहर महानगरपालिकेच्या मूळ हद्दीच्या विकास योजनेतील मौजे मेहरुण येथील सव्ह क्रमांक ४७५-अ, भूखंड क्रमांक ३९ मधील खालील परिशिष्टात नमूद केल्यानुसार बाधित क्षेत्रावरील "आरक्षण क्रमांक १६५-पाण्याच्या टाकीचा विस्तारˮ (भागश:) व्यपगत झाल्याचे अधिसूचित करीत आहे व अशाप्रकारे उक्त आरक्षणामधून मुक्त झालेली जमीन या संबंधित जमीनमालकास उक्त विकास योजनेतील लगतच्या अनुोय भूवापराप्रमाणे अन्यथा अनुोय असलेल्या विकासाकरिता उपलब्ध होईल.

ORDER

The Maharashtra Regional Planning and Town Planning Act, 1966

No. TPS-3523/778/CR-159/2026/UD-9.– Whereas, the Development Plan of the Original Limits of the Jalgaon City Municipal Corporation has been sanctioned by the Government under the provisions of Section 31 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Mah. Act No. XXXVII of 1966) (hereinafter referred to as "the said Act") vide Notiﬁ cation No. TPS-3588/194/CR-97/UD-9, dated the 6th January 1993 and has come into force with eﬀect from dated the 15th February 1993 (hereinafter referred to as "the said Development Plan") ;

and whereas, in the said Development Plan, the land bearing Survey No. 475-A, Plot No. 39 of Mauje Mehrun (hereinafter referred to as "the said Reserved Land") is reserved as "Site No.165- Extension to Water Tank" (Part) (hereinafter referred to as "the said Reservation") and the Jalgaon City Municipal Corporation is Appropriate Authority for the said Reservation (hereinafter referred to as "the said Appropriate Authority") ;

and whereas, the said Reserved Land has not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force ;

and whereas, the Owner of the land aﬀ ected by the said Resevation bearing Survey No. 475-A of Mauje Mehrun had served a Notice dated the 13th February 2017 under Section 127 (1) of the said Act to the said Appropriate Authority (hereinafter referred to as "the said Notice") ;

and whereas, even after service of the said Notice as aforesaid, the said Reserved Land had neither been acquired, within prescribed time period nor the Notiﬁ cation of land acquisition required under Section 126 (4) of the said Act read with Section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, has been published by the said Appropriate Authority within prescribed time period from the date of the service of the said Notice under sub-section (1) of Section 127 of the said Act ;

and whereas, the Owner of the said Reserved Land has ﬁ led Writ Petition No. 8189/2017 before the Hon'ble Bombay High Court, Aurangabad Bench, Chhatrapati Sambhajinagar and the ﬁ nal order is passed on dated the 21st February 2023 by the Hon'ble High Court ;

and whereas, it is observed that, the said Land had neither been acquired, within prescribed time period from the date of the service of Notices, nor Notiﬁ cation of land acquisition required under Section 126 (4) of the said Act, read with Section 19 of the Right to fair Compensation of Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 been published within prescribed time period by the said Appropriate Authority and, in consequence thereof, the Government of Maharashtra is of opinion that, the said Reservation, on the said Land stands lapsed as per the provisions of Section 127 (1) of the said Act.

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra, as mentioned in the Annexure below, hereby notiﬁ es that "Site No. 165- Extension to Water Tank" (Part) as speciﬁ ed in the Sanctioned Development Plan of the Original Limits of Jalgaon City Municipal Corporation, stands lapsed to the extent of area aﬀected by the Reservation bearing Survey No. 475-A, Plot No. 39 of Mauje Mehrun and the area so realeased will be available to the Owner for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan.

(१) विशेष कार्यकारी अधिकारी यांना त्यांचे कार्यक्षेत्रातील नागरिकांचे शासकीय कामासाठी आवश्यकतेनुसार ओळखीचे व रहिवासाचे प्रमाणपत्र देता येईल.

(२) वारंवार येणारा दुष्काळ, पूर, चक्रीवादळे आणि भूकंपासारख्या आपत्तीमुळे होणारी जीवितहानी, कोणतीही आकस्मिक घटना जिच्यामुळे होणारी जीवितहानी, स्थावर मालमत्तेचे नुकसान, पुरात / नदीत वाहून गेलेले इत्यादीकरिता शोध व बचाव पथकास "आपदा मित्रासˮ तसेच स्थानिक पातळीवर महसूल, पोलीस, होमगार्ड, अग्निशमन, आरोग्य, शिक्षण व आपत्ती व्यवस्थापन इत्यादी विभागातील अधिकारी / कर्मचारी व इतर शासकीय सदस्यांना पंचनामे तसेच इतर कार्य करणेस मदत करणे.

(३) ग्रामीण भागात चोरी, शांततेचा भंग आणि जनतेस व गावातील समाजास हानी पोहोचविण्याचे कृत्य तसेच सण व उत्सवाच्या काळात अनुसूचित प्रकार घडू नये व सुरक्षेच्या ष्टिकोनातून पोलीस विभागाला मदत करणे.

(४) शासनाच्या विविध योजनांचा प्रचार व प्रसार करणाया ग्रामस्तरीय अधिकारी, नगरपालिका व महानगरपालिका स्तरावरील अधिकारी यांना आवश्यक ते सहकार्य करणे.

(५) निवडणुकीचे कामात मृत मतदारांची नावे, घर सोडून गेलेल्या व इतर कारणामुळे कमी झालेल्या मतदारांची माहिती निवडणूक विभागात देण्याकरिता मतदान केंस्तरीय अधिकारी यांना मदत करणे.

(६) आपले सेवा कें, महा ई-सेवा कें/आधार केंावर विविध कागदपत्रांकरिता नागरिकांना आवश्यक ते सहकार्य करणे.

(७) शिक्षण, आरोग्य, पर्यावरण, स्वच्ता, कृषी, पशुसंवर्धन इ. विषयाबाबत नागरिकांना आवश्यक ते सहकार्य करणे.

(८) हुंडा, व्यसनाधिनता, बालमजुरी, बालविवाह, वेठबिगारी, प्रथा संपविण्यासाठी शासनास सहकार्य करणे.

(९) महिला, मुले व वृद्धांचे सुरक्षेसाठी शासनाचे अधिकारी यांना सहकार्य करणे.

(१०) प्रदूषण नियंत्रणसाठी व वाहतुकीचे नियमन करण्यासाठी शासनास सहकार्य करणे.

(११) पोलिसांकडून दाखल करण्यात येणाया महत्त्वाच्या गुन्ह्यांच्या तपासामध्ये कराव्या लागणाया विविध पंचनाम्यांमध्ये पंच म्हणून काम करणे.

(१२) समाजामध्ये एकोपा तसेच सलोख्याचे व सुरक्षित वातावरण राहावे याकरिता पोलीस विभागाच्या कामामध्ये आवश्यक ते सहकार्य करणे.

(१३) शासनाची विविध सवक्षणे, जनगणना, मोहिमा, अभियान यामध्ये संबंधित विभागाला आवश्यक ती मदत करणे.

(१४) प्रत्येक विशेष कार्यकारी अधिकारी यांनी आपल्या नियुक्तीची वैधता सुस्पष्टपणे दर्शविणारे प्रमाणपत्र आपल्या विशेष कार्यकारी अधिकारी पदाच्या कामाच्या जागी सवाना सहजपणे दिसेल अशा ठिकाणी लावावे व या कामासाठी येणाया व्यक्तीने मागणी केल्यास ते त्या व्यक्तीस दाखवावे.

(१५) ओळख परेड तसेच मृत्युपूर्व जबानी यासाठी विशेष कार्यकारी अधिकायांनी उपस्थित राहू नये.

(१६) उत्पन्नाचे प्रमाणपत्र देण्याचे अधिकार विशेष कार्यकारी अधिकारी यांना नसतील.

(१७) नियुक्तीचा कालावधी संपुष्टात आल्यानंतर विशेष कार्यकारी अधिकारी यांनी साक्षांकन करू नये व सर्व साहित्य जिल्हाधिकारी कार्यालयाकडे तत्काळ जमा करावे अन्यथा अशी व्यक्ती पुनर्नियुक्तीस अपात्र ठरेल.

(१८) नियुक्तीचा कालावधी संपल्यानंतर विशेष कार्यकारी अधिकायाने साक्षांकन केल्याचे निष्पन्न झाल्यास त्याचेविरुद्ध सवणुकीचा गुन्हा नोंदविण्यात येईल.

अधिनियम, २०१३ (२०१३ चा ३०) (यात यापुढे ज्याचा निर्देश सार्वजनिक प्रयोजनाच्या स्वरूपाबाबत विवरण "उक्त अधिनियम" असा केला आहे) त्यांच्या कलम ११ च्या पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून अधिसूचना क्रमांक नाशिक विभागीय पुरवणी, गुरुवार ते बुधवार, १८ - २४ जून २०२६ अन्वये प्रारंभिक अधिसूचना काढली आहे आणि त्याद्वारे असे अधिसूचित केले आहे की, यासोबत जोडलेल्या अनुसूची "एक" मध्ये अधिक तपशीलवार वर्णन केलेल्या जमिनीची, अनुसूची "दोन" मध्ये अधिक तपशीलवार विनिर्दिष्ट केलेल्या सार्वजनिक प्रयोजनासाठी आवश्यकता आहे किंवा तिची आवश्यकता भासण्याची शक्यता आहे ;

आणि ज्याअर्थी, अहिल्यानगर जिल्हाधिकारी यांनी कलम १५ च्या पोट-कलम (२) अन्वये दिलेला अहवाल, कोणताही असल्यास, विचारात घेतल्यानंतर, उक्त सार्वजनिक प्रयोजनासाठी उक्त जमीन संपादित करण्याची आवश्यकता आहे, याबाबत त्यांची प्रकल्पाचे नाव : उध्र्व प्रवरा प्रकल्प (निळवंडे-२), डावा कालवा कि.मी. २२ करिता मौजे कुंभेळ, तालुका अकोले, जिल्हा अहिल्यानगर येथील भूसंपादन.

प्रकल्पाच्या कामाचे वर्णन : उध्र्व प्रवरा प्रकल्प (निळवंडे-२), डावा कालवा कि.मी. २२ करिता मौजे कुंभेळ, तालुका अकोले, जिल्हा अहिल्यानगर येथील एकूण ०.३७ (हे.आर) जमीन संपादित करणे.

"उक्त अधिनियम" असा केला आहे) त्यांच्या कलम ११ च्या सार्वजनिक प्रयोजनाच्या स्वरूपाबाबत विवरण पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून अधिसूचना क्रमांक नाशिक विभागीय पुरवणी, गुरुवार ते बुधवार, १८ - २४ जून २०२६ अन्वये प्रारंभिक अधिसूचना काढली आहे आणि त्याद्वारे असे अधिसूचित केले आहे की, यासोबत जोडलेल्या अनुसूची "एक" मध्ये अधिक तपशीलवार वर्णन केलेल्या जमिनीची, अनुसूची "दोन" मध्ये अधिक तपशीलवार विनिर्दिष्ट केलेल्या सार्वजनिक प्रयोजनासाठी आवश्यकता आहे किंवा तिची आवश्यकता भासण्याची शक्यता आहे ;

आणि ज्याअर्थी, अहिल्यानगर जिल्हाधिकारी यांनी कलम १५ च्या पोट-कलम (२) अन्वये दिलेला अहवाल, कोणताही असल्यास, विचारात घेतल्यानंतर, उक्त सार्वजनिक प्रयोजनासाठी उक्त जमीन संपादित करण्याची आवश्यकता आहे, याबाबत त्यांची खात्री पटली आहे आणि म्हणून उक्त अधिनियमाच्या कलम प्रकल्पाचे नाव : उध्र्व प्रवरा प्रकल्प (निळवंडे-२), उजवा कालवा सा.क्र. १०४०४ मी. वरील रस्ता पुलाच्या पोहोच रस्त्याकरिता मौजे अकोले, तालुका अकोले, जिल्हा अहिल्यानगर येथील जमिनीचे भूसंपादन.

प्रकल्पाच्या कामाचे वर्णन : उध्र्व प्रवरा प्रकल्प (निळवंडे-२), उजवा कालवा सा.क्र. १०४०४ मी. वरील रस्ता पुलाच्या पोहोच रस्त्याकरिता मौजे अकोले, तालुका अकोले, जिल्हा अहिल्यानगर येथील एकूण ०.०३ (हे.आर) जमीन संपादित करणे.

समाजाला होणारे लाभ : उध्र्व प्रवरा प्रकल्प (निळवंडे-२), उजवा कालवा अंतर्गत येणाया गावातील जमिनींना व पिण्यासाठी पाणीपुरवठा (आर्थिक, रोजगार, पायाभूत सुविधा, सोयीसुविधा याबाबत व इतर लाभासंबंधात).

क्रमांक अनगर / मनपा / नगररचना / ८९१ / २०२६.---- ज्याअर्थी, अहिल्यानगर महानगरपालिकेने (यात यापुढे "उक्त नियोजन प्राधिकरण" असे निदशिलेले), तिच्या आधिपत्याखालील क्षेत्राची (यात यापुढे "उक्त क्षेत्र" असे उल्लेखलेले), महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (यात यापुढे "उक्त अधिनियम" असे निदशिलेले) चे कलम २३ (१) व कलम ३८ मधील तरतुदीनुसार प्रारूप विकास योजना, अहिल्यानगर (यात यापुढे "उक्त प्रारूप विकास योजना" असे उल्लेखलेली) तयार करण्याचा इरादा ठराव क्रमांक ३१, दिनांक ७ मार्च २०२४ अन्वये जाहीर करून त्याबाबतची सूचना महाराष्ट्र शासन राजपत्र, नाशिक विभागीय पुरवणी, भाग एक, पृष्ठ ११ मध्ये दिनांक १४-२० मार्च २०२४ रोजी प्रसिद्ध केली आहे, त्यास दिनांक १२-१८ मार्च २०२६ च्या महाराष्ट्र शासन राजपत्रात शुद्धीपत्रक प्रसिद्ध करण्यात आलेले आहे ;

आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम २४ च्या तरतुदीस अनुसरून अहिल्यानगर महानगरपालिकेने उक्त क्षेत्रासाठी उक्त प्रारूप विकास योजना उपसंचालक, नगररचना, विकास योजना विशेष घटक, अहिल्यानगर महानगरपालिका यांची "नगर रचना अधिकारी" म्हणून आदेश क्रमांक १२, दिनांक ६ मे २०२४ अन्वये नेमणूक केली आहे ;

आणि ज्याअर्थी उक्त अधिनियमातील तरतुदीनुसार, नगररचना अधिकारी तथा उपसंचालक, नगररचना, विकास योजना विशेष घटक, अहिल्यानगर महानगरपालिका यांनी उक्त अधिनियमाचे कलम २५ अन्वये विमान जमीन वापर नकाशा तयार केल्यानंतर, उक्त क्षेत्राची उक्त प्रारूप विकास योजना तयार करून ती उक्त नियोजन प्राधिकरणाकडे उक्त अधिनियमाचे कलम २६ (१) अन्वये प्रसिद्ध करण्यासाठी दिनांक १८ मे २०२६ रोजी हस्तांतरित केली आहे ;

आणि ज्याअर्थी, सदरची प्रारूप विकास योजना सर्वसाधारण सभेपुढे विचारार्थ व प्रसिद्धीस मान्यतेस्तव ठेवण्यात आली असता सर्वसाधारण सभेने ठराव क्रमांक २३, दिनांक ३० जुलै २०२६ अन्वये ठरावातील बदलांनुसार प्रारूप विकास योजना प्रसिद्ध करण्यास मंजुरी दिलेली आहे ;

आणि ज्याअर्थी, उक्त ठरावात प्रस्तावित केलेले बदल दर्शवून प्रारूप विकास योजना नकाशे व अहवाल नगररचना अधिकारी यांनी दिनांक ७ सप्टेंबर २०२६ रोजी प्रसिद्ध करण्यासाठी पाठविलेले आहेत.

त्याअर्थी उक्त नियोजन प्राधिकरण, उक्त ठरावातील बदल दर्शवून नगररचना अधिकारी यांचेकडून प्राप्त झालेली उक्त प्रारूप विकास योजना, विकास योजना अहवालासह उक्त अधिनियमाच्या कलम २६ (१) अन्वये, नागरिकांकडून सूचना / हरकती मागविण्यासाठी प्रसिद्ध करण्यात येत आहे. सदरहू योजनेसंबंधीचे नकाशे व अहवाल कामकाजाच्या दिवशी कार्यालयीन वेळेत नागरिकांच्या अवलोकनार्थ, खाली नमूद केलेल्या कार्यालयात उपलब्ध आहेत.

उक्त प्रारूप विकास योजनेतील तरतुदीसंबंधी नागरिकांच्या काही सूचना / हरकती असतील तर त्यांनी ही सूचना महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झालेल्या दिनांकापासून ३० दिवसांच्या आत आयुक्त, अहिल्यानगर महानगरपालिका यांचे कार्यालयाकडे लेखी स्वरूपात कारणांसह पाठवाव्यात. सदरची सूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून ३० दिवसांचे आत महानगरपालिकेकडे प्राप्त झालेल्या सूचना / हरकती विचारात घेतल्या जातील.

उक्त प्रारूप विकास योजनेचे नकाशे व तपशीलाच्या प्रती योग्य शुल्क आकारून महानगरपालिकेच्या कार्यालयात नागरिकांना उपलब्ध होऊ शकतील.

Notice

No. AMC/TP/891/2026.– Whereas, the Ahilyanagar Municipal Corporation, (hereinafter referred to as "the said Planning Authority",) vide Resolution No. 31, dated 7th March 2024 has declared it's intention to prepare a Draft Development Plan of Ahilyanagar Municipal Corporation (hereinafter referred to as the "said Draft Development plan") for the area under it's jurisdiction, (hereinafter referred to as the "said area") as per the provision of Section 23 (1) read with Section 38 of the Maharashtra Regional Planning and Town Planning Act, 1966 (hereinafter referred to as the "said Act") and notice to that eﬀect is published in Maharashtra Government Gazette, Nashik Divisional, Supplement, Part One, Page 11 on 14-20th March, 2024 and Corrigendum to this was published in Gazette dated 12-18th March 2026;

and whereas, as per the provision in Section 24 of the said Act, the Municipal Corporation vide Order No.12, dated 6th May 2024 has appointed Deputy Director, Town Planning, Development Plan Special Unit as "Town Planning Oﬃ cer" to prepare the said Draft Development Plan for the said Area;

and whereas, the Town Planning Oﬃ cer and Deputy Director, Town Planning, Development Plan Special Unit, Ahilyanagar Municipal Corporation after having prepared Existing Land Use Map as per Section 25 of the said Act, has prepared the said Draft Development Plan of the said Area and has handed it over to the said Planning Authority on 18th May 2026 for publication under Section 26 (1) of the said Act;

and whereas, the said Draft Development Plan placed before the General Body for it's consideration and consent to publish under Secion 26 (1) of said Act and whereas the general body of said planning authority has passed Resolution No. 23, dated 30th July 2026 under Section 26 (1) of the said Act to publish Draft Development Plan subject to modiﬁ cations speciﬁ ed therein;

and whereas, the Town Planning Oﬃ cer has submitted the Draft Development Plan incorporating modiﬁ cations suggested in the said resolution, along with the maps and report on 7th September 2026 for publication.

Therefore, the said municipal corporation hereby publishes the said Draft Development Plan modiﬁ ed by Town Planning Oﬃ cer by incorporating the modiﬁ cations from said Resolution along with the Report under Section 26 (1) of the said Act, for inviting suggestions / objections from public. The copy of the said Draft Development Plan and Report thereof are kept open for inspection of the public at the following oﬃ ces on all working days during oﬃ ce hours.

Suggestions and objections received by Municipal Corporation within the period of 30 days from publication of this Notice in Maharashtra Government Gazette shall only be considered.

The copies of the said Draft Development Plan and particulars shall be available to the public at reasonable price in the oﬃ ce of the Commissioner, Municipal Corporation, Ahilyanagar.

क्रमांक नपजा/९३१/सन २०२६.---- ज्याअर्थी, जामनेर शहराची विकास योजना महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ मधील तरतुदीनुसार शासन निर्णय क्रमांक टीपीएस-३५१२/०३/सीआर/५-अ/२०१२/नवि-९, दिनांक ९ मे २०१२ अन्वये मंजूर केलेली असून सदर विकास योजना दिनांक २० जून २०१२ पासून अंमलात आलेली आहे.

तसेच जामनेर शहराच्या वगळलेल्या क्षेत्राची ( -) विकास योजना महाराष्ट्र शासनाने शासन निर्णय क्रमांक टीपीएस-३५१३/१०२/सीआर/३५/२०१३/नवि-९, दिनांक २ एप्रिल २०१८ अन्वये मंजूर केलेली असून ती दिनांक २३ जून २०१८ पासून अंमलात आलेली आहे. जामनेर शहराच्या मंजूर विकास योजनेत खालीलप्रमाणे ेरबदल करण्याच्या प्रस्तावास महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ चे कलम ३७ (१) अन्वये पुढील कार्यवाही करण्यासाठी जामनेर नगरपरिषदेने ठराव क्रमांक ९५, दिनांक २५ ऑगस्ट २०२६ अन्वये मान्यता दिलेली आहे.

कृषी/ना-विकास विभाग गट क्रमांक २०४/१ ही जमीन कृषी/ना-विकास विभागातून वगळून निवासी विभागात समाविष्ट करणे.

गट क्रमांक २०४/१ च्या उत्तरेस असलेल्या बिगरशेती गट क्रमांक २९९ मध्ये रो-हाउसेस/बंगले बांधण्यात आलेले आहेत. तसेच गट क्रमांक २०४/१ च्या उत्तरेस असलेल्या गट क्रमांक ३०२/१ या जमिनीस निवासी वापरासाठी सन २००९ मध्ये बिगरशेती परवानगी देण्यात आलेली आहे. लगतच्या गट क्रमांक २०७/२-ब/२-ब, २०५/२-अ, २०५/२-अ+२-ब तसेच गट क्रमांक २०६ मधील बिगरशेती अभिन्यास मंजूर झालेले असून त्या जमिनींचा बिगरशेती वापर सुरू झालेला आहे. गट क्रमांक २०४/१ या जमिनीस जामनेर-कोडोली रस्ता (ग्राम रस्ता क्रमांक ७३) तसेच लगतच्या मंजूर अभिन्यासातील रस्त्यार्मात प्रवेश उपलब्ध आहे. परिसरातील विमान निवासी विकास मंजूर बिगरशेती अभिन्यास व उपलब्ध प्रवेशमार्ग विचारात घेता गट क्रमांक २०४/१ ही जमीन कृषी / ना-विकास विभागातून वगळून निवासी विभागात समाविष्ट करणे सयुक्तिक ठरते.

हरकती / सूचना मागविण्याबाबत

वरील प्रस्तावित ेरबदल दर्शविणारा विकास योजनेचा भाग नकाशा, मुख्याधिकारी, जामनेर नगरपरिषद यांनी विधिवत प्रमाणित केलेला असून नागरिकांच्या अवलोकनासाठी जामनेर नगरपरिषद कार्यालयात कामकाजाच्या दिवशी कार्यालयीन वेळेत उपलब्ध ठेवण्यात आलेला आहे.

महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ चे कलम ३७ (१) अन्वये याद्वारे जाहीर करण्यात येते की, वरील प्रस्तावित ेरबदलासंदर्भात कोणत्याही व्यक्तीस काही हरकत / सूचना असल्यास त्यांनी ती, ही जाहीर नोटिस महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून एक महिन्याच्या आत लेखी स्वरूपात मुख्याधिकारी, जामनेर नगरपरिषद, जामनेर यांचेकडे सादर करावी.

निर्धारित मुदतीत प्राप्त होणाया हरकती व सूचनांचा सदर अधिनियमातील तरतुदीनुसार विचार करून त्यानंतर सदर ेरबदलाचा प्रस्ताव शासनाच्या मंजुरीसाठी सादर करण्यात येईल.

Proposed modiﬁ cation to the sanctioned Development Plan of Jamner Town under Section 37 (1) of the

Maharashtra Regional Planning and Town Planning Act, 1966

PUBLIC NOTICE

No. MCJ/931/2026.---- Whereas, the Development Plan of Jamner Town has been sanctioned by the State Government under the provisions of the Maharashtra Regional Planning and Town Planning Act, 1966 vide Government Resolution No. TPS-3512/03/CR-05A/2012/UD-9, dated 9th May 2012 and the same has come into force with eﬀect from 20th June 2012.

The Development Plan of the Excluded Part (EP) of Jamner Town has also been sanctioned by the State Government vide Government Resolution No. TPS-3513/102/CR-35/2013/UD-9, dated 2nd April 2018 and the same has come into force with eﬀect from 23rd June 2018.

The proposal for modiﬁ cation of the Development Plan has been approved by the Jamner Municipal Council vide Resolution No. 95, dated 25th August 2026 for taking further action under Section 37 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966.

Agriculture / No-Development Zone

To delete Gat No. 204/1 from the Agriculture / No Development Zone and include the said land in Residential Zone.

Row houses / bungalows have been constructed in Non- Agricultural Gat No. 299 situated to the north of Gat No. 204/1. Further, N.A. permission for residential use in respect of Gat No. 302/1, situated to the north of Gat No. 204/1 was granted in the year 2009. Demarcated N.A. layouts in respect of adjoining lands bearing Gat Nos. 207/2-B/2-B, 205/2-A, 205/2-A+2-B and Gat No. 206 have been approved and their non-agricultural use has already commenced. Gat No. 204/1 has access from the Jamner-Kodoli Road (Village Road No. 73) as well as through the layout road of the adjoining sanctioned layout. Considering the existing development, sanctioned N.A. layouts and availability of approach/access, it is considered appropriate and justiﬁ able to delete Gat No. 204/1 from the Agriculture / No Development Zone and include the said land in Residential Zone.

Notice for objections / suggestions

The plan showing the above proposed modiﬁ cation, duly authenticated by the Chief Oﬃ cer, Jamner Municipal Council is kept open for inspection by the public at the oﬃce of the Jamner Municipal Council on all working days during oﬃ ce hours.

Notice is hereby given under Section 37 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 that any person having any objection or suggestion in respect of the aforesaid proposed modiﬁ cation may submit the same in writing to the Chief Oﬃ cer, Jamner Municipal Council, Jamner, within one month from the date of publication of this Notice in the Maharashtra Government Gazette.

The objections and suggestions received within the prescribed period shall be considered in accordance with the provisions of the said Act before submitting the proposal to the State Government for sanction.
