(जैसाकि राजस्थान विधान सभा में परु :स्थापित किया गया)

राजस्थान राज्य में गीतांजली ग्लोबल विश्ववि(cid:217)यालय, जयपरु की स्थापना और निगमन के लिए और उससे संसक्त और आनषंगिक विषयों के लिए उपबंध करने के लिए विधेयक।

यतः, विश्व और देश में ज्ञान के सभी क्षेत्रों में तीव्र विकास के साथ-साथ कदम मिलाने के उ(cid:217)देश्य से यवाओं कोु उनके निकटतम स्थान पर अधनातन शैक्षिक सविधाओं का उपबंध करने के लिए राज्य में विश्वस्तरीय आधनिक अनसंधान और अध्ययन सविधाओं का सजन करना आवश्यक है जिससे उन्हें विश्व की उदार आर्थिक और सामाजिक व्यवस्था में मानव संसाधनों से संगत बनाया जा सके ;

और यतः, ज्ञान के क्षेत्र में तीव्र प्रगति और मानव संसाधनों की परिवर्तनशील अपेक्षाओं से यह आवश्यक हो गया है कि शैक्षिक अनसंधान और विकास की ऐसी संसाधनपर्ण और त्वरित और उत्तरदायी प्रणाली सजित की जाये जो एक आवश्यक विनियामक व्यवस्था के अधीन उ(cid:217)यमितापर्ण उत्साह से कार्य कर सके और ऐसी प्रणाली, उच्चतर शिक्षा में कार्यरत पर्याप्त संसाधन और अनभव ुभाग 3(क) राजस्थान राज-पत्र, अगस्त 20, 2026 599 रखने वाली प्राइवेट संस्थाओं को विश्ववि(cid:217)यालयों की स्थापना करने के लिए अनज्ञात करने से और ु

ऐसे विश्ववि(cid:217)यालयों को ऐसे विनियामक उपबंधों से, जो ऐसी संस्थाओं के कशल कार्यकरण को ु

रजिस्ट्रीकरण सं. 32-देव-उदय-2007, दिनांक 01.12.2007 पर रजिस्ट्रीकत एक न्याृ स है और विगत कई वर्षों से शिक्षा के क्षेत्र में लगा हआ है

के लिए एक विश्ववि(cid:217)यालय में उक्त अवसंरचना का विनिधान करने के लिए सहमत हो गया है;

और यतः, उपर्यक्त अवसंरचना की पर्याप्तता की जांच राज्य सरकार (cid:217)वारा इस निमित्त

ु , वधर्मान महावीर खला विश्वु वि(cid:217)यालय, नियक्त समिति (cid:217)वारा कर ली ु गयी है जिसके सदस्य कलगरूु

कोटा, आचार्य और विभागाध्यक्ष, आपात चिकित्सा विभाग, एस.एम.एस. चिकित्सा महावि(cid:217)यालय, जयपरु , आचार्य, रोग विज्ञान विभाग, एस.एम.एस. चिकित्सा महावि(cid:217)यालय, जयपर और एसडीएमु , सांगानेर, जयपर थे

ु ;

वि(cid:217)यालय के रूप में निगमन में और यतः, यदि उपर्यक्त अवसंरचना का उपयोजन विश्वु

किया जाता है और उक्त फॉच्र्य ून फाउं डेशन, उदयपर को विश्वु वि(cid:217)यालय चलाने के लिए अनज्ञात ु किया जाता है तो इससे राज्य की जनता के शैक्षणिक विकास में योगदान होगा;

भारत गणराज्य के सतहत्तरवें वर्ष में राजस्थान राज्य विधान-म(cid:214)डल निम्नलिखित अधिनियम बनाता है:-

1. संक्षिप्त नाम, प्रसार और प्रारम्भ.- (1) इस अधिनियम का नाम गीतांजली ग्लोबल विश्ववि(cid:217)यालय, जयपर अधिनियमु , 2026 है।

(2) इसका प्रसार सम्पर्ण राजस्थान राज्य में है। ू

(3) यह तरन्तु प्रवत्त होगा। ृ

2. परिभाषाएं.- इस अधिनियम में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) ''अ.भा.त.शि.प.'' से अखिल भारतीय तकनीकी शिक्षा परिषद् अधिनियम, 1987 (1987 का के न्द्रीय अधिनियम सं. 52) के अधीन स्थापित अखिल भारतीय तकनीकी शिक्षा परिषद् अभिप्रेत है;

(ख) ''वै.औ.अ.प.'' से के न्द्रीय सरकार की वित्तपोषण एजेन्सी-वैज्ञानिक और औ(cid:217)योगिक अनसंधान परिषद्ु , नई दिल्ली अभिप्रेत है;

, 2019 (2019 का के न्द्रीय (ग) ''आयोग'' से राष्ट्रीय आयर्विज्ञान आयोग अधिनियमु

अधिनियम सं. 30) की धारा 3 के अधीन गठित राष्ट्रीय आयर्विज्ञान आयोग अभिप्रेत ु

है;

(घ) ''दू.शि.ब्यू.'' से विश्ववि(cid:217)यालय अनदान आयोग (cid:217)वारा भारत में दरस्थु

ू शिक्षा विनियमित

ूरो अभिप्रेत है;

करने के लिए स्थापित दरस्थ शिक्षा ब्यू

(ङ) ''दरस्थ शिक्षाू '' से संचार अर्थात ् प्रसारण, टेलीकास्टिंग, पत्राचार पाठ्यक्रमों, सेमिनारों, संपर्क कार्यक्रमों और ऐसी ही किसी अन्य कार्यप(cid:217)धति के किन्हीं भी दो या अधिक साधनों के संयोजन (cid:217)वारा दी गयी शिक्षा अभिप्रेत है;

(च) ''वि.प्रौ.वि.'' से के न्द्रीय सरकार का विज्ञान और प्रौ(cid:217)योगिकी विभाग अभिप्रेत है;

(छ) ''कर्मचारी'' से विश्ववि(cid:217)यालय में कार्य करने के लिए विश्ववि(cid:217)यालय (cid:217)वारा नियक्त कोई ु

व्यक्ति अभिप्रेत है और इसमें विश्ववि(cid:217)यालय के अध्यापक, अधिकारी तथा अन्य कर्मचारी सम्मिलित हैं;

(ज) ''फीस'' से विश्ववि(cid:217)यालय (cid:217)वारा छात्रों से किया गया संग्रहण, जिसे चाहे किसी भी नाम से जाना जाये, अभिप्रेत है और जो वि.अ.आ. (cid:217)वारा समय-समय पर जारी मार्गदर्शक सि(cid:217)धांतों के अनसार प्रतिदेय होगी

(झ) ''सरकार'' से राजस्थान की राज्य सरकार अभिप्रेत है;

(ञ) ''उच्चतर शिक्षा'' से 10+2 स्तर से ऊपर ज्ञान के अध्ययन के लिए पाठ्यचर्या या पाठ्यक्रम का अध्ययन अभिप्रेत है;

(ट) ''छात्रावास'' से विश्ववि(cid:217)यालय या उसके महावि(cid:217)यालयों, संस्थाओं या के न्द्रों के छात्रों के लिए विश्ववि(cid:217)यालय (cid:217)वारा इस रूप में संधारित या मान्यता प्राप्त निवास स्थान अभिप्रेत है;

(ठ) ''भा.कृ .अ.प.'' से सोसाइटी रजिस्ट्रीकरण अधिनियम, 1860 (1860 का के न्द्रीय

ु अधिनियम सं. 21) के अधीन रजिस्ट्रीकत सोसाइटीृ , भारतीय कषि अनसंधान परिषद्ृ

अभिप्रेत है;

(ड) ''रा.नि.प्र.प.'' से विश्ववि(cid:217)यालय अनदान आयोग की एक स्वायत्त संस्था , राष्ट्रीय निर्धारण और प्रत्यायन परिषद् , बंगलौर अभिप्रेत है;

(ढ) ''रा.अ.शि.प.'' से राष्ट्रीय अध्यापक शिक्षा परिषद् अधिनियम, 1993 (1993 का के न्द्रीय अधिनियम सं. 73) की धारा 3 के अधीन गठित राष्ट्रीय अध्यापक शिक्षा परिषद् अभिप्रेत है;

(ण) ''निवेश बाह्य के न्द्र'' से विश्ववि(cid:217)यालय (cid:217)वारा मख्यु निवेश के बाहर स्थापित उसका, उसकी घटक इकाई के रूप में प्रचालित और संधारित कोई के न्द्र अभिप्रेत है जिसमें विश्ववि(cid:217)यालय की परक सविधाएं

ु , संकाय और कर्मचारिवंद होंृ ;

(त) ''भा.भे.प.'' से भेषजी अधिनियम, 1948 (1948 का के न्द्रीय अधिनियम सं. 8) की धारा 3 के अधीन गठित भारतीय भेषजी परिषद् अभिप्रेत है;

(थ) ''विहित'' से इस अधिनियम के अधीन बनाये गये परिनियमों (cid:217)वारा विहित अभिप्रेत है;

(द) ''विनियमन निकाय'' से उच्चतर शिक्षा के शैक्षणिक मानक सनिश्चित करने के लिए ु

मानद(cid:214)ड और शर्तें अधिकथित करने के लिए तत्समय प्रवत्त किसी भी विधि (cid:217)वारा या ृ

अधीन स्थापित या गठित कोई निकाय जैसे वि.अ.आ., अ.भा.त.शि.प., रा.अ.शि.प., आयोग, भा.भे.प., रा.नि.प्र.प., भा.कृ .अ.प., दू.शि.ब्यू., वै.औ.अ.प. आदि अभिप्रेत हैं और इसमें राज्य सरकार सम्मिलित है;

(ध) ''नियम'' से इस अधिनियम के अधीन बनाये गये नियम अभिप्रेत हैं;

(न) ''अनसचीु ू '' से इस अधिनियम की अनसची अभिप्रेत है

(प) ''प्रायोजक निकाय'' से फॉच्र्य ून फाउं डेशन, उदयपरु राजस्थान लोक न्यास अधिनियम, 1959 (1959 का अधिनियम सं. 42) के अधीन सहायक आयक्तु , देवस्थान विभाग, उदयपर के कार्यालय में ु रजिस्ट्रीकरण सं. 32-देव-उदय-2007, दिनांक 01.12.2007 पर रजिस्ट्रीकत एक न्याृ स अभिप्रेत है;

(फ) ''परिनियम'', ''आडि र्नेन्स' और ''विनियम'' से इस अधिनियम के अधीन बनाये गये विश्ववि(cid:217)यालय के क्रमशः परिनियम, आर्डिनेन्स और विनियम अभिप्रेत हैं;

(ब) ''विश्ववि(cid:217)यालय का छात्र'' से ऐसा व्यक्ति अभिप्रेत है जो विश्ववि(cid:217)यालय (cid:217)वारा सम्यक् रूप से संस्थित किसी उपाधि, डिप्लोमा या अन्य वि(cid:217)या संबंधी उपाधि के लिए, जिसमें602 राजस्थान राज-पत्र, अगस्त 20, 2026 भाग 3(क) अनसंधान उपाधि सम्मिलित है , पाठ्यक्रमानसार अध्ययन करने हेत विश्वु

ु वि(cid:217)यालय में नामांकित हो;

(भ) ''अध्ययन के न्द्र'' से दरस्थ शिक्षा के संदर्भ

ू में सलाह देने, परामर्श करने या छात्रों (cid:217)वारा अपेक्षित कोई अन्य सहायता देने के प्रयोजन के लिए विश्ववि(cid:217)यालय (cid:217)वारा स्थापित और संधारित या मान्यता प्राप्त कोई के न्द्र अभिप्रेत है;

(म) ''अध्यापक'' से विश्ववि(cid:217)यालय के पाठ्यक्रम का अध्ययन करने के लिए छात्रों को शिक्षा देने या अनसंधान में मार्गदर्शन करने या किसी भी अन्य रूप में मार्गदर्शन करने के लिए अपेक्षित कोई आचार्य, सह-आचार्य, सहायक आचार्य या कोई अन्य व्यक्ति अभिप्रेत है;

, 1956 (1956 का के न्द्रीय (य) ''वि.अ.आ.'' से विश्ववि(cid:217)यालय अनदान आयोग अधिनियमु

अधिनियम सं.3) की धारा 4 के अधीन स्थापित विश्ववि(cid:217)यालय अनदान आयोग ु

अभिप्रेत है; और

(यक) ''विश्ववि(cid:217)यालय'' से गीतांजली ग्लोबल विश्ववि(cid:217)यालय, जयपरु अभिप्रेत है।

3. निगमन.- (1) विश्ववि(cid:217)यालय के प्रथम चेयरपर्सन और प्रथम प्रेसीडेन्ट और प्रबंध बोर्ड और वि(cid:217)या परिषद् के प्रथम सदस्य और ऐसे सभी व्यक्तियों, जो इसके पश्चात ऐसे अधिकारी या ्

सदस्य हो जाते हैं, जब तक वे ऐसा पद या सदस्यता धारण किये रहते हैं, से एत(cid:217)(cid:217)वारा गीतांजली ग्लोबल विश्ववि(cid:217)यालय, जयपर के नाम से एक निगमित निकाय गठित किया जाता है।

(2) अनुसचीू -1 में विनिर्दिष्ट जंगम और स्थावर संपत्ति विश्ववि(cid:217)यालय में निहित की जायेगी और प्रायोजक निकाय इस अधिनियम के प्रारंभ होने के ठीक पश्चात ऐसा निहित करने के लिए ्

कदम उठायेगा।

(3) विश्ववि(cid:217)यालय का शाश्वत उत्तराधिकार और एक सामान्य मद्रा होगी और वह उक्तु नाम से वाद ला सके गा और उस पर वाद लाया जा सके गा।

(4) विश्ववि(cid:217)यालय भांकरोटा, तहसील सांगानेर, जिला जयपर ु (राजस्थान) में अवस्थित होगा और वहीं उसका मख्याु लय होगा।

4. विश्ववि(cid:217)यालय के उ(cid:217)देश्य.- विश्ववि(cid:217)यालय के उ(cid:217)देश्य अनसचीु ू -2 में विनिर्दिष्ट शाखाओं में और ऐसी अन्य शाखाओं में, जो विश्ववि(cid:217)यालय, राज्य सरकार के पर्व अनमोदन से

ु , समय-समय पर अवधारित करे, अनसंधान और अध्ययन हाथ में लेना तथा उक्त शाखाओं में उत्कष्टता प्राप्त करना और ज्ञान देना और प्रसारित करना हैं।

5. विश्ववि(cid:217)यालय की शक्तियां और कत्यृ .- विश्ववि(cid:217)यालय की निम्नलिखित शक्तियां और कत्य होंगे

ृ , अर्थात ् :-

(क) अनसचीु ू -2 में विनिर्दिष्ट शाखाओं में शिक्षण का उपबंध करना और अनसंधान और ज्ञान ु

के अभिवर्धन और प्रसार के लिए उपबंध करना;

(ख) ऐसी शर्तों के अध्यधीन रहते हएु , जो विश्ववि(cid:217)यालय अवधारित करे, व्यक्तियों को परीक्षाओं, मल्यांकन या किसी भी अन्य रीति से परीक्षण के आधार पर डिप्लोमा या प्रमाणपत्र देना और उपाधियां या अन्य शैक्षणिक उपाधियां प्रदान करना, और ठोस और पर्याप्त कारण से किन्हीं भी ऐसे डिप्लोमों, प्रमाणपत्रों, उपाधियों या अन्य शैक्षणिक उपाधियों को वापस लेना;

(ग) निवेश बाह्य अध्ययन और विस्तार सेवा आयोजित करना और हाथ में लेना;

(घ) विहित रीति से मानद उपाधियां या अन्य उपाधियां प्रदान करना;

(ङ) पत्राचार और ऐसे अन्य पाठ्यक्रम सहित शिक्षण, जो अवधारित किये जायें, के उपबंध करना;

(च) विश्ववि(cid:217)यालय (cid:217)वारा अपेक्षित आचार्य पद, सह-आचार्य पद, सहायक आचार्य पद और अन्य अध्यापन या शैक्षणिक पदों को संस्थित करना और उन पर नियक्ति करनाु ;

(छ) प्रशासनिक, लिपिकवर्गीय और अन्य पदों को सजित करना और उन पर नियक्तियां करना

ु ;

(ज) स्थायी रूप से या किसी विनिर्दिष्ट कालावधि के लिए किसी भी अन्य विश्ववि(cid:217)यालय या संगठन में कार्यरत विनिर्दिष्ट ज्ञान रखने वाले व्यक्तियों को नियक्त करनाु ;

(झ) किसी भी अन्य विश्ववि(cid:217)यालय या प्राधिकारी या संस्था के साथ ऐसी रीति से और ऐसे प्रयोजन के लिए सहकार करना, सहयोग करना या सहयक्त होनाु , जो विश्ववि(cid:217)यालय अवधारित करे;

(ञ) अध्ययन के न्द्र स्थापित करना, और अनसंधान और शिक्षण के लिए वि(cid:217)यालयों , संस्थाओं और ऐसे के न्द्रों, विशिष्ट प्रयोगशालाओं या अन्य इकाइयों का संधारण करना, जो विश्ववि(cid:217)यालय की राय में उसके उ(cid:217)देश्य को अग्रसर करने के लिए आवश्यक हैं;

(ट) अध्येतावत्तियां

ृ , छात्रवत्तियां

ृ , अध्ययनवत्तियां

ृ , पदक और परस्कार संस्थित करना और प्रदान करना;

(ठ) विश्ववि(cid:217)यालय के छात्रों के लिए छात्रावासों की स्थापना करना और उनका संधारण करना;

(ड) अनसंधान और परामर्श के लिए उपबंध करना , और उस प्रयोजन के लिए अन्य संस्थानों या निकायों के साथ ऐसे समझौते करना जो विश्ववि(cid:217)यालय आवश्यक समझे;

(ढ) विश्ववि(cid:217)यालय में प्रवेश के लिए मानक अवधारित करना जिसमें परीक्षा, मल्यांकन या ू

परीक्षण की कोई भी अन्य रीति सम्मिलित हो सके गी;

(ण) फीस और अन्य प्रभारों की मांग करना और संदाय प्राप्त करना;

(त) विश्ववि(cid:217)यालय के छात्रों के निवास का पर्यवेक्षण करना और उनके स्वास्थ्य और सामान्य कल्याण की अभिव(िcid:217)ध के लिए व्यवस्था करना ;

(थ) छात्राओं के संबंध में ऐसी विशेष व्यवस्थाएं करना जिन्हें विश्ववि(cid:217)यालय वांछनीय समझे;

(द) विश्ववि(cid:217)यालय के कर्मचारियों और छात्रों में अनशासन का विनियमन और प्रवर्तन करना

वि(cid:217)यालय (cid:217)वारा आवश्यक और इस संबंध में ऐसे अनशासनिक उपाय करना जिन्हें विश्वु

समझा जाये;

(ध) विश्ववि(cid:217)यालय के कर्मचारियों के स्वास्थ्य और सामान्य कल्याण के उन्नयन के लिए व्यवस्था करना;

(न) दान प्राप्त करना और किसी भी जंगम या स्थावर संपत्ति का अर्जन करना, धारण करना, प्रबंध करना और व्ययन करना;

(प) विश्ववि(cid:217)यालय के प्रयोजनों के लिए, प्रायोजक निकाय के अनमोदन से धन उधार लेना ;

(फ) प्रायोजक निकाय के अनमोदन से विश्वु वि(cid:217)यालय की संपत्ति को बंधक या आडमान रखना;

(ब) परीक्षा के न्द्र स्थापित करना;

(भ) यह सनिश्चित करना कि उपाधियों , डिप्लोमों, प्रमाणपत्रों और अन्य वि(cid:217)या संबंधी उपाधियों इत्यादि का स्तर उससे कम नहीं हो जो अ.भा.त.शि.प., रा.अ.शि.प., वि.अ.आ., आयोग, भा.भे.प. और शिक्षा के विनियमन के लिए तत्समय प्रवत्त किसी विधि के (cid:217)वारा या अधीन स्थापित वैसे ही अन्य निकायों (cid:217)वारा अधिकथित किये गये हों;

(म) तत्समय प्रवत्त किसी अन्य विधि के उपबंधों के अध्यधीन रहते हए

ु , राज्य के भीतर निवेश बाह्य के न्द्र स्थापित करना; और

(य) ऐसे सभी कार्य और बातें करना जो विश्ववि(cid:217)यालय के सभी उ(cid:217)देश्यों या उनमें से किसी भी उ(cid:217)देश्य की प्राप्ति के लिए आवश्यक, आनषंगिक या सहायक हों। ु

6. विश्ववि(cid:217)यालय का स्व-वित्तपोषित होना.- विश्ववि(cid:217)यालय स्व-वित्तपोषित होगा और राज्य

करने का हकदार नहीं होगा।

सरकार से कोई भी अनदान या अन्य वित्तीय सहायता प्राप्तु

7. संब(cid:217)ध करने की शक्ति का न होना.- विश्ववि(cid:217)यालय को किसी भी अन्य संस्था को संब(cid:217)ध करने या अन्यथा अपने विशेषाधिकार देने की शक्ति नहीं होगी।

8. साधारण निधि.- विश्ववि(cid:217)यालय एक निधि स्थापित करेगा, जिसे साधारण निधि कहा जायेगा जिसमें निम्नलिखित जमा किया जायेगा, अर्थात ् :-

(क) विश्ववि(cid:217)यालय (cid:217)वारा प्राप्त फीस और अन्य प्रभार;

(ख) प्रायोजक निकाय (cid:217)वारा किये गये कोई अभिदाय;

(ग) विश्ववि(cid:217)यालय (cid:217)वारा उसके उद्देश्यों के अनसरण में दी गयी परामर्शी सेवा और किये गये अन्य कार्य से प्राप्त आय;

(घ) न्यास, वसीयत, दान, विन्यास और कोई अन्य अनदानु ; और

(ङ) विश्ववि(cid:217)यालय (cid:217)वारा प्राप्त समस्त अन्य राशियां।

9. साधारण निधि का उपयोजन.- साधारण निधि का उपयोजन, विश्ववि(cid:217)यालय के मामलों से संबंधित सभी आवर्ती या अनावर्ती व्ययों को परा करने में किया ू जायेगा:

परन्त विश्वु वि(cid:217)यालय (cid:217)वारा कोई भी व्यय वर्ष के लिए कल आवर्ती व्यय और कल अनावर्ती व्यय की सीमाओं, जो प्रबंध बोर्ड (cid:217)वारा नियत की जायें, के बाहर, प्रबंध बोर्ड के पर्व अनमोदन के ू

बिना, उपगत नहीं किया जायेगा।

10. विश्ववि(cid:217)यालय के अधिकारी.- विश्ववि(cid:217)यालय के निम्नलिखित अधिकारी होंगे, अर्थात ् :-

(i) चेयरपर्सन;

(ii) प्रेसीडेन्ट;

(iii) प्रति-प्रेसीडेन्ट;

(iv) प्रोवोस्ट;

ु ;

(v) कलानशासकु

(vi) संकायों के संकायाध्यक्ष;

(vii) कलु -सचिव;

(viii) मख्यु वित्त और लेखा अधिकारी; और

(ix) ऐसे अन्य अधिकारी जो परिनियमों (cid:217)वारा विश्ववि(cid:217)यालय के अधिकारी घोषित किये जायें।

11. चेयरपर्सन.- (1) चेयरपर्सन, राज्य सरकार की सहमति से प्रायोजक निकाय (cid:217)वारा, उसके पद ग्रहण करने की तारीख से पांच वर्ष की कालावधि के लिए नियक्त किया जायेगा

ु :

परन्त चेयरपर्सनु , उसकी पदावधि समाप्त होने पर भी तब तक पद धारित करेगा जब तक कि उसका पदोत्तरवर्ती पद ग्रहण नहीं कर लेता है।

(2) चेयरपर्सन के पद की कोई रिक्ति ऐसी रिक्ति की तारीख से छह मास के भीतर-भीतर भरी जायेगी।

(3) चेयरपर्सन, उसके पदाभिधान से विश्ववि(cid:217)यालय का प्रधान होगा।

(4) चेयरपर्सन, यदि उपस्थित हो, प्रबंध बोर्ड की बैठकों की, और उपाधियां, डिप्लोमे या अन्य वि(cid:217)या संबंधी उपाधियां प्रदान करने के लिए विश्ववि(cid:217)यालय के दीक्षांत समारोह की, अध्यक्षता करेगा।

(5) चेयरपर्सन की निम्नलिखित शक्तियां होंगी, अर्थात ् :-

(क) विश्ववि(cid:217)यालय के कार्यकलापों के संबंध में कोई भी सचना या अभिलेख मांगना ;

(ख) प्रेसीडेन्ट नियक्त करनाु ;

(ग) धारा 12 की उप-धारा (11) के उपबंधों के अनसार प्रेसीडेन्ट को हटाना ; और (घ) ऐसी अन्य शक्तियां जो परिनियमों (cid:217)वारा विहित की जायें।

12. प्रेसीडेन्ट.- (1) प्रेसीडेन्ट की नियक्ति प्रु बंध बोर्ड (cid:217)वारा सिफारिश किये गये तीन से अन्यून और पांच से अनधिक व्यक्तियों के एक पैनल में से चेयरपर्सन (cid:217)वारा की जायेगी।

(2) कोई भी व्यक्ति प्रेसीडेन्ट के रूप में नियक्त किये जाने का पात्र नहीं होगा जब तक कि वह किसी विश्ववि(cid:217)यालय या महावि(cid:217)यालय में आचार्य के रूप में न्यूनतम दस वर्ष का अनभव रखने ु

वाला या किसी प्रतिष्ठित शोध और/या शैक्षणिक प्रशासनिक संगठन में किसी समकक्ष पद पर दस वर्ष का अनभव रखने वाला कोई प्रख्या

ु त शिक्षाविद् नहीं है।

(3) प्रेसीडेन्ट की पदावधि उस तारीख से, जिसको वह अपना पद ग्रहण करता है, तीन वर्ष

, इनमें से जो भी पहले हो, होगी:

या उसके सत्तर वर्ष की आय प्राप्त कर लेने तकु

परन्त वही व्यक्ति पनर्नियक्ति के लिए पात्र होगा :

, उसके पद की अवधि समाप्त होने पर भी तब तक पद धारित परन्त यह और कि प्रेसीडेन्टु

करेगा जब तक कि उसका पदोत्तरवर्ती पद ग्रहण नहीं कर लेता है।

(4) प्रेसीडेन्ट के चयन के प्रयोजन के लिए, प्रबंध बोर्ड किसी लोक सचना के माध्यू म से पात्र व्यक्तियों से आवेदन आमंत्रित करेगा और प्रेसीडेन्ट के रूप में नियक्तु किये जाने वाले व्यक्तियों के नामों पर विचार करते समय, प्रबंध बोर्ड, शैक्षणिक उत्कृ ष्टता, देश में उच्चतर शिक्षा प्रणाली में प्रदर्शन, और शैक्षणिक तथा प्रशासनिक शासन में पर्याप्त अनभव को उचित महत्वु देगा और अपने निष्कर्षों को लेखब(cid:217)ध करेगा और उन्हें चेयरपर्सन को प्रस्तुत किये जाने वाले पैनल के साथ रखेगा।

(5) प्रेसीडेन्ट के पद की कोई रिक्ति ऐसी रिक्ति की तारीख से छह मास के भीतर-भीतर भरी जायेगी।

(6) प्रेसीडेन्ट, विश्ववि(cid:217)यालय का प्रधान कार्यपालक और शैक्षणिक अधिकारी होगा और विश्ववि(cid:217)यालय के कार्यकलापों का साधारण अधीक्षण और नियंत्रण करेगा और विश्ववि(cid:217)यालय के प्राधिकारियों के विनिश्चयों का निष्पादन करेगा।

(7) प्रेसीडेन्ट, चेयरपर्सन की अनपस्थिति में विश्वु वि(cid:217)यालय के दीक्षांत समारोह की अध्यक्षता करेगा।

(8) यदि, प्रेसीडेन्ट की राय में किसी भी ऐसे मामले में तरन्त कार्रवाई करना आवश्यक हो जिसके लिए शक्तियां इस अधिनियम के (cid:217)वारा या अधीन किसी भी अन्य प्राधिकारी को प्रदत्त कीभाग 3(क) राजस्थान राज-पत्र, अगस्त 20, 2026 607 गयी हैं तो वह ऐसी कार्रवाई कर सके गा जो वह आवश्यक समझे और तत्पश्चात ् अपनी कार्रवाई की रिपोर्ट शीघ्रातिशीघ्र ऐसे अधिकारी या प्राधिकारी को करेगा जिसने सामान्य अनक्रम में मामले को ु

निपटाया होता:

परन्त यदिु संबंधित अधिकारी या प्राधिकारी की राय में ऐसी कार्रवाई प्रेसीडेन्ट (cid:217)वारा नहीं की जानी चाहिए थी तो ऐसा मामला चेयरपर्सन को निर्दिष्ट किया जायेगा जिस पर उसका विनिश्चय अंतिम होगा:

परन्त यह और कि जहां प्रेसीडेन्ट (cid:217)वारा की गयी ऐसी कोई भी कार्रवाई विश्व वि(cid:217)यालय की सेवा में से किसी भी व्यक्ति को प्रभावित करती है तो ऐसा व्यक्ति, उसे संसचित ऐसी कार्रवाई की ू

तारीख से तीन मास के भीतर-भीतर प्रबंध बोर्ड को अपील करने का हकदार होगा और प्रबंध बोर्ड, प्रेसीडेन्ट (cid:217)वारा की गयी कार्रवाई को पष्ट या उपांतरित कर सके गा या उु लट सके गा।

(9) यदि, प्रेसीडेन्ट की राय में विश्ववि(cid:217)यालय के किसी प्राधिकारी का कोई भी विनिश्चय इस अधिनियम या तदधीन बनाये गये परिनियमों, आडि र्नेंसों, विनियमों या नियमों (cid:217)वारा प्रदत्त शक्तियों के बाहर है या उससे विश्ववि(cid:217)यालय के हितों पर प्रतिकल प्रभाव पू ड़ने की संभावना है तो वह संबंधित प्राधिकारी को उसके विनिश्चय की तारीख से पन्द्रह दिन के भीतर-भीतर विनिश्चय का पनरीक्षण करने का निदेश दे सके गा और यदि ऐसा प्राधिकारी ऐसे विनिश्चय का पनरीक्षण करने से इंकार करता है या विफल रहता है तो ऐसा मामला चेयरपर्सन को निर्दिष्ट किया जायेगा और उस पर उसका विनिश्चय अंतिम होगा।

(10) प्रेसीडेन्ट ऐसी अन्य शक्तियों का प्रयोग और ऐसे अन्य कर्तव्यों का पालन करेगा जो परिनियमों या आर्डिनेंसों (cid:217)वारा विहित किये जायें।

(11) यदि चेयरपर्सन का, उसको किये गये किसी अभ्यावेदन पर या अन्यथा की गयी या करवायी गयी जांच पर यह समाधान हो जाये कि प्रेसीडेन्ट का उसके पद पर बने रहना विश्ववि(cid:217)यालय के हितों के प्रतिकल है या उस स्थिति में ऐसा अपेक्षित हो तो वह लिखित आदेश (cid:217)वारा, उसमें ऐसा करने के कारणों को वर्णित करते हएु , प्रेसीडेन्ट से ऐसी तारीख से, जो आदेश में विनिर्दिष्ट की जाये, उसका पद छोड़ने के लिए कह सके गा:

परन्त इस उपु -धारा के अधीन कोई कार्रवाई करने के पर्व प्रेसीडेन्ट को सनवाई का अवसर दिया जायेगा।

13. प्रति-प्रेसीडेन्ट.- (1) प्रति-प्रेसीडेन्ट की नियक्ति चेयरपर्सन (cid:217)वारा प्रेसीडेन्ट के परामु र्श से की जायेगी।

(2) प्रति-प्रेसीडेन्ट तीन वर्ष की कालावधि के लिए पद धारित करेगा और दसरी पदावधि के ू

लिए पनर्नियक्ति का पात्र होगा।ु ु608 राजस्थान राज-पत्र, अगस्त 20, 2026 भाग 3(क) (3) प्रति-प्रेसीडेन्ट की सेवा की शर्तें ऐसी होंगी जो परिनियमों (cid:217)वारा विहित की जायें।

(4) यदि चेयरपर्सन का, उसको किये गये किसी अभ्यावेदन पर या अन्यथा की गयी या करवायी गयी जांच पर यह समाधान हो जाये कि प्रति-प्रेसीडेन्ट का उसके पद पर बने रहना विश्ववि(cid:217)यालय के हितों के प्रतिकल है या उस स्थिति में ऐसा अपेक्षित हो तो वह लिखित आदेश (cid:217)वारा, उसमें ऐसा करने के कारणों को वर्णित करते हएु , प्रति-प्रेसीडेन्ट से ऐसी तारीख से, जो आदेश में विनिर्दिष्ट की जाये, उसका पद छोड़ने के लिए कह सके गा:

परन्त इस उपु -धारा के अधीन कोई कार्रवाई करने से पर्व प्रतिू -प्रेसीडेन्ट को सनवाई का ु

(5) प्रति-प्रेसीडेन्ट, ऐसे मामलों में, जो प्रेसीडेन्ट (cid:217)वारा उसे समय-समय पर समनदेशित किये ु

जायें, प्रेसीडेन्ट की सहायता करेगा और ऐसी शक्तियों का प्रयोग और ऐसे कत्यों का पालन करेगा जो ृ

प्रेसीडेन्ट (cid:217)वारा उसे प्रत्यायोजित किये जायें।

14. प्रोवोस्ट.- (1) प्रोवोस्ट की नियक्ति प्रेसीडेन्ट (cid:217)वारा ऐसी का

ु लावधि के लिए और ऐसी रीति से की जायेगी जो परिनियमों (cid:217)वारा विहित की जाये।

(2) प्रोवोस्ट विश्ववि(cid:217)यालय में अनशासन को सनिश्चित करेगा और अध्यापकों और कर्मचारियों के विभिन्न संघों को विश्ववि(cid:217)यालय की विभिन्न नीतियों और प(cid:217)धतियों के बारे में सचित करेगा।ू

(3) प्रोवोस्ट ऐसी अन्य शक्तियों का प्रयोग और ऐसे अन्य कर्तव्यों का पालन करेगा जो परिनियमों (cid:217)वारा विहित किये जायें।

ु .- (1) कलानशासक की नियक्ति प्रेसीडेन्ट (cid:217)वारा ऐसी कालावधि के लिए 15. कलानशासकु

और ऐसी रीति से की जायेगी जो परिनियमों (cid:217)वारा विहित की जाये।

(2) कलानशासक छात्रों में अनशासन बनाये रखने और विभिन्न छात्र संघों को विश्ववि(cid:217)यालय की विभिन्न नीतियों और प(cid:217)धतियों के बारे में सचित करने के लिए उत्तरदायी होगा।

(3) कलानशासक ऐसी अन्य शक्तियों का प्रयोग और ऐसे अन्य कर्तव्यों का पालन करेगा जो परिनियमों (cid:217)वारा विहित किये जायें।

16. संकाय का संकायाध्यक्ष.- (1) प्रत्येक संकाय के लिए एक संकायाध्यक्ष होगा जो प्रेसीडेन्ट (cid:217)वारा तीन वर्ष की कालावधि के लिए ऐसी रीति से नियक्त किया जायेगा जो परिनियमों (cid:217)वारा विहित की जाये।

(2) संकायाध्यक्ष, प्रेसीडेन्ट के परामर्श से, जब कभी भी अपेक्षित हो, संकाय की बैठक बलायेगा और उसकी अध्यक्षता करेगा। वह संकाय की नीतियां और विकास कार्यक्रम बनायेगा और उन्हें समचित प्राधिकारियों को उनके विचारार्थ प्रस्तत करेगा।

(3) संकाय का संकायाध्यक्ष ऐसी अन्य शक्तियों का प्रयोग और ऐसे अन्य कर्तव्यों का पालन करेगा जो परिनियमों (cid:217)वारा विहित किये जायें।

17. कलु -सचिव.- (1) कलु -सचिव की नियक्ति चेयरपर्सन (cid:217)वारा ऐसी रीति से की जायेगी जो परिनियमों (cid:217)वारा विहित की जाये।

(2) विश्ववि(cid:217)यालय की ओर से कलु -सचिव (cid:217)वारा सभी संविदाएं हस्ताक्षरित और सभी दस्तावेज तथा अभिलेख अधिप्रमाणित किये जायेंगे।

(3) कलु -सचिव प्रबंध बोर्ड और वि(cid:217)या परिषद्का सदस्य-सचिव होगा किन्त उसे मत देने का ु

अधिकार नहीं होगा।

(4) कलु -सचिव ऐसी अन्य शक्तियों का प्रयोग और ऐसे अन्य कर्तव्यों का पालन करेगा जो परिनियमों (cid:217)वारा विहित किये जायें।

18. मख्यु वित्त और लेखा अधिकारी.- (1) प्रेसीडेन्ट (cid:217)वारा मख्यु वित्त और लेखा अधिकारी की नियक्ति ऐसी रीति से की जायेगी जो परिनियमों (cid:217)वारा विहित की जाये।

(2) मख्यु वित्त और लेखा अधिकारी ऐसी शक्तियों का प्रयोग और ऐसे कर्तव्यों का पालन करेगा जो परिनियमों (cid:217)वारा विहित किये जायें।

19. अन्य अधिकारी.- (1) विश्ववि(cid:217)यालय इतने अन्य अधिकारियों की नियक्ति कर सके गा ु

जितने उसके कत्यकरण के लिए आवश्यक हों।

(2) ऐसे अधिकारियों की नियक्ति की रीति और शक्तियां और कत्य ऐसे होंगे जो परिनियमों (cid:217)वारा विहित किये जायें।

20. विश्ववि(cid:217)यालय के प्राधिकारी.- विश्ववि(cid:217)यालय के निम्नलिखित प्राधिकारी होंगे, अर्थात ् :-

(i) प्रबंध बोर्ड;

(ii) वि(cid:217)या परिषद् ;

(iii) संकाय; और

(iv) ऐसे अन्य प्राधिकारी, जिन्हें परिनियमों (cid:217)वारा विश्ववि(cid:217)यालय के प्राधिकारी होना घोषित किया जाये।

21. प्रबंध बोर्ड.- (1) विश्ववि(cid:217)यालय के प्रबंध बोर्ड में निम्नलिखित होंगे, अर्थात ् :-

(क) चेयरपर्सन;

(ख) प्रेसीडेन्ट;

(ग) प्रायोजक निकाय (cid:217)वारा नामनिदशित पांच व्यक्ति जिनमें से दो विख्या त शिक्षाविद्या अनसचीु ू -2 में विनिर्दिष्ट शाखाओं के विशेषज्ञ होंगे;

(घ) चेयरपर्सन (cid:217)वारा नामनिदशिर्ते , विश्ववि(cid:217)यालय के बाहर से प्रबंध या सचना ू प्रौ(cid:217)योगिकी का एक विशेषज्ञ;

(ङ) चेयरपर्सन (cid:217)वारा नामनिदशित एक वित्त विशेषज्र्ञे

;

(च) आयक्तु , महावि(cid:217)यालय शिक्षा या उप सचिव से अनिम्न रैंक का उसका नामनिर्देशिती; और

(छ) प्रेसीडेन्ट (cid:217)वारा नामनिदशित दो अध्यापकर्।े

(2) प्रबंध बोर्ड, विश्ववि(cid:217)यालय का प्रधान कार्यपालक निकाय होगा। विश्ववि(cid:217)यालय की समस्त जंगम और स्थावर संपत्ति प्रबंध बोर्ड में निहित होगी। उसकी निम्नलिखित शक्तियां होंगी, अर्थात ् :-

(क) ऐसी सभी शक्तियों का प्रयोग करते हएु , जो इस अधिनियम या तदधीन बनाये गये परिनियमों, आडि र्नेंसों, विनियमों या नियमों (cid:217)वारा उपबंधित हैं, साधारण अधीक्षण और निदेशन का उपबंध करना और विश्ववि(cid:217)यालय के कार्यकरण पर नियंत्रण करना;

(ख) विश्ववि(cid:217)यालय के अन्य प्राधिकारियों (cid:217)वारा किये गये विनिश्चयों का उस दशा में पनरीक्षण करना जब वे इस अधिनियम या तदधीन बनाये गये परिनियमों , आडि र्नेंसों, विनियमों या नियमों के अनरूप न होंु ;

(ग) विश्ववि(cid:217)यालय के बजट और वार्षिक रिपोर्ट का अनमोदन करनाु ;

(घ) विश्ववि(cid:217)यालय (cid:217)वारा अनसरण की जाने वाली ु नीतियां अधिकथित करना;

(ङ) विश्ववि(cid:217)यालय के स्वैच्छिक परिसमापन के बारे में प्रायोजक निकाय को सिफारिशें करना, यदि ऐसी स्थिति उत्पन्न हो जब सभी प्रयासों के बावजद विश्वू वि(cid:217)यालय का सहज कत्यकरण संभव न हो ; और

(च) ऐसी अन्य शक्तियां जो परिनियमों (cid:217)वारा विहित की जायें।

(3) प्रबंध बोर्ड की किसी कलैंडर वर्ष में कम से कम तीन बैठकें होंगी।

(4) प्रबंध बोर्ड की बैठकों की गणपर्ति पांच से होगी।ू

22. वि(cid:217)या परिषद् .- (1) वि(cid:217)या परिषद् में प्रेसीडेन्ट और इतने अन्य सदस्य होंगे जितने परिनियमों (cid:217)वारा विहित किये जायें।

(2) प्रेसीडेन्ट वि(cid:217)या परिषद् का अध्यक्ष होगा।

(3) वि(cid:217)या परिषद् विश्ववि(cid:217)यालय की प्रधान शैक्षणिक निकाय होगी और इस अधिनियम और तदधीन बनाये गये नियमों, विनियमों, परिनियमों या आर्डिनेंसों के उपबंधों के अध्यधीन रहतेभाग 3(क) राजस्थान राज-पत्र, अगस्त 20, 2026 611 हएु , विश्ववि(cid:217)यालय की शैक्षणिक नीतियों में समन्वय रखेगी और उन पर साधारण अधीक्षण का प्रयोग करेगी।

(4) वि(cid:217)या परिषद् की बैठकों के लिए गणपर्ति ऐसी होगी जो परिनियमों (cid:217)वारा विहित की जाये।

23. अन्य प्राधिकारी.- विश्ववि(cid:217)यालय के अन्य प्राधिकारियों की संरचना, गठन, शक्तियां और कत्य ऐसे होंगे जोृ परिनियमों (cid:217)वारा विहित किये जायें।

24. प्राधिकारी की सदस्यता के लिए निरर्हता.- कोई व्यक्ति विश्ववि(cid:217)यालय के किन्हीं भी प्राधिकारियों का सदस्य होने के लिए निरर्हित होगा, यदि वह-

(क) विकत चित्त है और सक्षम न्यायालय (cid:217)वारा ऐसा घोषित है ;

(ख) अनन्मोचिु त दिवालिया है;

(ग) नैतिक अधमता से अन्तर्वलित किसी अपराध के लिए सि(cid:217)धदोष ठहराया गया है;

(घ) प्राइवेट कोचिंग कक्षाएं संचालित कर रहा है या उसमें स्वयं लग रहा है; या

(ङ) किसी परीक्षा का संचालन करने में किसी भी रूप में कहीं पर भी अनचित आचरण ु

में लिप्त रहने या उसको बढ़ावा देने के लिए द(िcid:214)डत हो चका है।ु

25. रिक्तियों से विश्ववि(cid:217)यालय के किसी भी प्राधिकारी की कार्यवाहियों का अविधिमान्य न होना.- विश्ववि(cid:217)यालय के किसी भी प्राधिकारी का कोई कार्य या कार्यवाही उसके गठन में मात्र किसी रिक्ति या त्रटि के कारण से अु विधिमान्य नहीं होगी।

ु, त्यागपत्र या उसे हटाये जाने 26. आपात रिक्तियों का भरा जाना.- किसी सदस्य की मत्यृ

के कारण या जिस हैसियत से उसे नियक्त या नामनिर्दिष्ट किया गया था , उसमें परिवर्तन होने के कारण विश्ववि(cid:217)यालय के प्राधिकारियों की सदस्यता में हई कोई भीु रिक्तियां यथासंभव शीघ्र ऐसे व्यक्ति या ऐसे निकाय (cid:217)वारा भरी जायेंगी जिसने ऐसे सदस्य को नियक्त या नामनिर्दिष्ट किया था :

परन्त किसी आपात रिक्ति के आधार पर विश्व वि(cid:217)यालय के प्राधिकारी के सदस्य के रूप में नियक्त या नामनिर्दिष्ट व्यक्ति ऐसे सदस्य की , जिसके स्थान पर उसे नियक्त या नामनिर्दिष्ट ु

किया गया है, के वल शेष अवधि के लिए ऐसे प्राधिकारी का सदस्य रहेगा।

27. समिति.- विश्ववि(cid:217)यालय के प्राधिकारी या अधिकारी ऐसे निदर्शे -निबंधनों सहित इतनी समितियां गठित कर सकें गे जो ऐसी समितियों (cid:217)वारा सम्पादित किये जाने वाले विनिर्दिष्ट कार्यों के लिए आवश्यक हों। ऐसी समितियों का गठन और उनके कर्तव्य ऐसे होंगे जो परिनियमों (cid:217)वारा विहित किये जायें।

28. परिनियम.- (1) इस अधिनियम के उपबंधों के अध्यधीन रहते हएु , विश्ववि(cid:217)यालय के परिनियमों में निम्नलिखित सभी या किन्हीं भी मामलों के लिए उपबंध किया जा सके गा, अर्थात ् :-

(क) विश्ववि(cid:217)यालय के प्राधिकारियों, जो समय-समय पर गठित किये जायें, का गठन, शक्तियां और कत्यृ ;

(ख) प्रेसीडेन्ट की नियक्ति के निबंधन और शर्तें और उसकी शक्तियां और कत्य

ृ ;

(ग) कलु -सचिव और मख्यु वित्त और लेखा अधिकारी की नियक्ति की रीति और निबंधन ु

तथा शर्तें और उनकी शक्तियां और कत्यृ ;

(घ) वह रीति जिससे और ऐसी कालावधि जिसके लिए प्रोवोस्ट और कलानशासक नियक्त ु

किये जायेंगे और उनकी शक्तियां और कत्यृ ;

(ङ) वह रीति जिससे संकाय का संकायाध्यक्ष नियक्त किया जायेगा और उसकी शक्तियां और कत्यृ ;

(च) अन्य अधिकारियों और अध्यापकों की नियक्ति की रीति और निबंधन तथा शर्तें और उनकी शक्तियां और कत्यृ ;

(छ) विश्ववि(cid:217)यालय के कर्मचारियों की सेवा के निबंधन तथा शर्तें और उनके कत्यृ ;

(ज) अधिकारियों, अध्यापकों, कर्मचारियों और छात्रों के मध्य विवादों के मामले में माध्यस्थम ् के लिए प्रक्रिया;

(झ) मानद उपाधियों का प्रदान किया जाना;

(ञ) छात्रों को अध्यापन फीस के संदाय से छट देने और उन्हें छात्रवत्तियां और

;

अध्येतावत्तियां प्रदान करने के संबंध में उपबंधृ

(ट) स्थानों के आरक्षण के विनियमन सहित, प्रवेश की नीति से संबंधित उपबंध;

(ठ) छात्रों से प्रभारित की जाने वाली फीस से संबंधित उपबंध;

(ड) विभिन्न पाठ्यक्रमों में स्थानों की संख्या से संबंधित उपबंध;

(ढ) विश्ववि(cid:217)यालय के नये प्राधिकारियों का सजनृ ;

(ण) लेखा नीति और वित्तीय प्रक्रिया;

(त) नये विभागों का सजृ न और वि(cid:217)यमान विभागों का समापन या पनःसंरचनाु ;

(थ) पदक और परस्कार संस्थित करना ;

(द) पदों के सजन और पदों की समाप्ति के लिए प्रक्रिया ;

(ध) फीस का पनरीक्षणु ;

(न) विभिन्न पाठ्य विवरणों में स्थानों की संख्या का परिवर्तन; और

(प) समस्त अन्य मामले जो इस अधिनियम के उपबंधों के अधीन परिनियमों (cid:217)वारा विहित किये जाने अपेक्षित हैं या विहित किये जायें।

(2) विश्ववि(cid:217)यालय के परिनियम प्रबंध बोर्ड (cid:217)वारा बनाये जायेंगे और राज्य सरकार को उसके अनमोदन के लिए प्रस्तत किये जायेंगे।

(3) राज्य सरकार विश्ववि(cid:217)यालय (cid:217)वारा प्रस्तत किये गये परिनियमों पर विचार करेगी और ऐसे उपान्तरणों, यदि कोई हों, सहित, जो वह आवश्यक समझे, उनकी प्राप्ति की तारीख से दो मास के भीतर-भीतर उनका अनमोदन करेगी।ु

(4) विश्ववि(cid:217)यालय राज्य सरकार (cid:217)वारा यथा-अनमोदित परिनियमों पर अपनी सहमति संसचित करेगा और ू यदि वह उप-धारा (3) के अधीन राज्य सरकार (cid:217)वारा किये गये किन्हीं भी या समस्त उपांतरणों को प्रभावी करने का इच्छक नहीं है तो वह उसके लिए कारण दे सके गा और ऐसे कारणों पर विचार करने के पश्चात राज्य सरकार विश्व्

वि(cid:217)यालय (cid:217)वारा दिये गये सझावों को स्वीकार ु

या अस्वीकार कर सके गी।

(5) राज्य सरकार उसके (cid:217)वारा अंतिम रूप से यथा अनमोदित परिनियमों को राजपत्र में प्रकाशित करेगी और तत्पश्चात ् परिनियम ऐसे प्रकाशन की तारीख से प्रवत्तृ होंगे।

29. आडि र्नेन्स.- (1) इस अधिनियम या तदधीन बनाये गये परिनियमों के उपबंधों के अध्यधीन रहते हएु , आर्डिनेन्सों में निम्नलिखित समस्त या किन्हीं भी मामलों के संबंध में उपबंध किया जा सके गा, अर्थात ् :-

(क) विश्ववि(cid:217)यालय में छात्रों का प्रवेश और इस रूप में उनका नामांकन;

(ख) विश्ववि(cid:217)यालय की उपाधियों, डिप्लोमों और प्रमाणपत्रों के लिए अधिकथित किये जाने वाले पाठ्यक्रम;

(ग) उपाधियां, डिप्लोमे, प्रमाणपत्र और अन्य वि(cid:217)या संबंधी उपाधियां प्रदान करना, उनके लिए न्यनतम अर्हताएं और उनके प्रदान किये जाने और अभिप्राप्त किये जाने के संबंध में किये जाने वाले उपाय;

(घ) अध्येतावत्तियां

;

ृ , छात्रवत्तियां

ृ , वत्तिृ काएं, पदक और परस्कार प्रदान किये जाने की शर्तें (ङ) परीक्षा निकायों, परीक्षकों और अनसीमकों की पदावधि और नियक्ति की रीति और

;

कर्तव्यों को सम्मिलित करते हए परीक्षाओं का संचालनु

(च) विश्ववि(cid:217)यालय के पाठ्यक्रमों, परीक्षाओं, उपाधियों और डिप्लोमों के लिए प्रभारित की जाने वाली फीस;

(छ) विश्ववि(cid:217)यालय के छात्रों के निवास की शर्तें;

;

(ज) छात्रों के विरु(cid:217)ध अनशासनिक कार्रवाई के संबंध में उपबंधु

(झ) ऐसे किसी अन्य निकाय का सजनृ , संरचना और कत्य जो विश्वृ वि(cid:217)यालय के शैक्षणिक जीवन में सधार करने के लिए आवश्यक समझा जाये;

(ञ) अन्य विश्ववि(cid:217)यालयों और उच्चतर शिक्षा संस्थाओं के साथ सहकार और सहयोग की रीति; और

(ट) समस्त अन्य मामले जो इस अधिनियम या तदधीन बनाये गये परिनियमों (cid:217)वारा आडि र्नेन्सों (cid:217)वारा उपबंधित किये जाने अपेक्षित हों।

(2) विश्ववि(cid:217)यालय के आडि र्नेन्स वि(cid:217)या परिषद् (cid:217)वारा बनाये जायेंगे जिन्हें प्रबंध बोर्ड (cid:217)वारा अनमोदित किये जाने के पश्चा

ु त ्, राज्य सरकार को उसके अनमोदन के लिए प्रस्तत किया जायेगा।

ु (3) उप-धारा (2) के अधीन प्रस्तत आर्डिनेन्सों पर राज्य सरकार , उनकी प्राप्ति की तारीख से दो मास के भीतर-भीतर विचार करेगी और या तो उन्हें अनमोदित करेगी या उनमें उपान्तरण के लिए सझाव देगी।ु

(4) वि(cid:217)या परिषद् , या तो राज्य सरकार के सझावों को सम्मिलित करते हए आडि र्नेन्सों को उपान्तरित करेगी या राज्य सरकार (cid:217)वारा दिये गये किन्हीं भी सझावों को सम्मिलित न करने के कारण देगी और ऐसे कारण, यदि कोई हों, के साथ आर्डिनेन्स राज्य सरकार को वापस भेजेगी और उनकी प्राप्ति पर राज्य सरकार वि(cid:217)या परिषद् की टिप्पणियों पर विचार करेगी और विश्ववि(cid:217)यालय के आर्डिनेन्सों को ऐसे उपान्तरणों सहित या उनके बिना अनमोदित करेगी। ु

30. विनियम.- विश्ववि(cid:217)यालय के प्राधिकारी, प्रबंध बोर्ड के पर्व अनमोदन के अध्यधीन रहते

, इस हएु , अपने स्वयं के और उनके (cid:217)वारा नियक्त समितियों के कारबार के संचालन के लिए अधिनियम और तदधीन बनाये गये नियमों, परिनियमों और आर्डिनेन्सों से संगत विनियम बना सकें गे।

31. प्रवेश.- (1) विश्ववि(cid:217)यालय में प्रवेश सर्वथा योग्यता के आधार पर किये जायेंगे।

(2) विश्ववि(cid:217)यालय में प्रवेश के लिए योग्यता या तो अर्हक परीक्षा में प्राप्त अंकों या ग्रेड और सह-पाठ्यचर्या और पाठ्येतर क्रियाकलापों में उपलब्धियों के आधार पर या राज्य स्तर पर या तो समान पाठ्यक्रम संचालित करने वाले विश्ववि(cid:217)यालयों के संगम (cid:217)वारा या राज्य की किसी एजेन्सी (cid:217)वारा संचालित किसी प्रवेश परीक्षा में अभिप्राप्त अंकों या ग्रेड के आधार पर अवधारित की जा सके गी:

यक्रमों में प्रवेश के वल प्रवेश परीक्षा के माध्यम से परन्त व्यावसायिक और तकनीकी पाठ्ु

होगा।

(3) अनसचित जातियोंु ू , अनसचित जनजातियों

ू , पिछड़े वर्गों, अति पिछड़े वर्गों, आर्थिक रूप से कमजोर वर्गों, महिलाओं और दिव्यांग व्यक्तियों के लिए विश्ववि(cid:217)यालय में प्रवेश के लिए आरक्षण, राज्य सरकार की नीति के अनसार होगा।ुभाग 3(क) राजस्थान राज-पत्र, अगस्त 20, 2026 615 32. फीस संरचना.- (1) विश्ववि(cid:217)यालय समय-समय पर अपनी फीस संरचना तैयार करेगा और उसे इस प्रयोजन के लिए गठित समिति के अनमोदन के लिए भेजेगा।ु

(2) समिति विश्ववि(cid:217)यालय (cid:217)वारा तैयार की गयी फीस संरचना पर विचार करेगी और यदि उसका यह समाधान हो जाता है कि प्रस्तावित फीस-

(क) निम्नलिखित के लिए, अर्थात ् -

(i) विश्ववि(cid:217)यालय के आवर्ती व्यय की पर्ति के लिए स्रोत जटाने के लिएू

ु ; और (ii) विश्ववि(cid:217)यालय के और विकास के लिए अपेक्षित बचतों के लिए पर्याप्त है; और (ख) अयक्तियक्त रूप से अधिक नहीं है ,

तो वह फीस संरचना का अनमोदन कर सके गी

ु ।

(3) उप-धारा (2) के अधीन समिति (cid:217)वारा अनमोदित फीस संरचना तीन वर्ष के लिए प्रवत्त रहेगी और विश्ववि(cid:217)यालय ऐसी फीस संरचना के अनसार फीस प्रभारित करने का हकदार होगा।

(4) विश्ववि(cid:217)यालय ऐसी फीस से भिन्न, जिसके लिए वह उप-धारा (3) के अधीन हकदार है, किसी भी नाम से कोई फीस प्रभारित नहीं करेगा।

33. परीक्षाएं.- प्रत्येक शैक्षणिक सत्र के प्रारम्भ पर और किसी भी दशा में प्रत्येक कलै(cid:214)डर वर्ष की 30 अगस्त के अपश्चात विश्व् वि(cid:217)यालय अपने (cid:217)वारा संचालित प्रत्येक पाठ्यक्रम के लिए परीक्षाओं की अनसची तैयार और प्रकाशिु ू त करेगा और उस अनसची का कड़ाई से पालन करेगा।

ू स्पष्टीकरण.- ''परीक्षाओं की अनसचीु ू '' से प्रत्येक प्रश्न पत्र, जो परीक्षा स्कीम का भाग हो, के प्रारम्भ के समय, दिन और तारीख के बारे में ब्यौरा देने वाली सारणी अभिप्रेत है और इसमें प्रायोगिक परीक्षाओं का ब्यौरा भी सम्मिलित होगा:

परन्त किसी भी प्रकार के किसी भी कारण से यदि विश्व वि(cid:217)यालय इस अनसची का पालन ु

करने में असमर्थ रहा हो तो वह यथासंभव एक रिपोर्ट, उसमें प्रकाशित अनसची का अनसरण न ु

करने के कारण सम्मिलित करते हएु , राज्य सरकार को प्रस्तत करेगा। राज्यु सरकार उस पर ऐसे निदेश जारी करेगी जो वह अनसची के अनपालन के लिए उचित समझे।

ु

34. परिणामों की घोषणा.- (1) विश्ववि(cid:217)यालय अपने (cid:217)वारा संचालित प्रत्येक परीक्षा के परिणामों की घोषणा उस विशिष्ट पाठ्यक्रम की परीक्षा की अंतिम तारीख से तीस दिन के भीतर- भीतर करने का प्रयास करेगा और किसी भी दशा में ऐसा परिणाम ऐसी तारीख से ज्यादा से ज्यादा पैंतालीस दिन के भीतर-भीतर घोषित करेगा:

की कालावधि के भीतर-भीतर किसी भी परीक्षा के परिणामों की अंतिम रूप से घोषणा करने में616 राजस्थान राज-पत्र, अगस्त 20, 2026 भाग 3(क) असमर्थ है तो विश्ववि(cid:217)यालय एक रिपोर्ट, उसमें विलम्ब के कारण सम्मिलित करते हएु , राज्य सरकार को प्रस्तत करेगा। राज्य सरकार उस पर ऐसे निदेश जारी करेगी जो वह उचित समझे।

(2) कोई भी परीक्षा या किसी परीक्षा के परिणाम के वल इस कारण से अविधिमान्य नहीं ठहराये जायेंगे कि विश्ववि(cid:217)यालय ने धारा 33 या, यथास्थिति, इस धारा में यथा-नियत समय- अनसची का पालन नहीं किया है। ु ू

35. दीक्षांत समारोह.- विश्ववि(cid:217)यालय का दीक्षांत समारोह प्रत्येक शैक्षणिक वर्ष में उपाधियां, डिप्लोमा प्रदान करने हेत या किसी भीु अन्य प्रयोजन के लिए परिनियमों (cid:217)वारा यथाविहित रीति से आयोजित किया जायेगा।

36. विश्ववि(cid:217)यालय का प्रत्यायन.- विश्ववि(cid:217)यालय, राष्ट्रीय निर्धारण और प्रत्यायन परिषद् (रा.नि.प्र.प.) के मानकों के अनरूप राु .नि.प्र.प. से प्रत्यायन अभिप्राप्त करेगा और राज्य सरकार और ऐसे अन्य विनियमन निकायों को, जो विश्ववि(cid:217)यालय (cid:217)वारा चलाये गये पाठ्यक्रमों से संब(cid:217)ध हैं,

वि(cid:217)यालय रा.नि.प्र.प. (cid:217)वारा विश्ववि(cid:217)यालय को दिये गये ग्रेड के बारे में सचित करेगा। विश्वू

रा.नि.प्र.प. के मानकों के अनरूप समयु -समय पर ऐसे प्रत्यायन को नवीकत करवायेगा।ृ

37. विश्ववि(cid:217)यालय (cid:217)वारा विनियमन निकायों के नियमों, विनियमों, मानकों इत्यादि का पालन किया जाना.- इस अधिनियम में अंतर्विष्ट किसी बात के होने पर भी, विश्ववि(cid:217)यालय विनियमन निकायों के समस्त नियमों, विनियमों, मानकों इत्यादि का अनपालन करने

ु के लिए आब(cid:217)ध होगा और ऐसे निकायों को ऐसी सभी सविधाएं और सहायता उपलब्ध करायेगा जिनकी उनके (cid:217)वारा उनके कत्यों का निर्वहन और उनके कर्तव्यों का पालन करने के लिए अपेक्षा की जाये।

38. वार्षिक रिपोर्ट.- (1) विश्ववि(cid:217)यालय की वार्षिक रिपोर्ट प्रबंध बोर्ड (cid:217)वारा तैयार की जायेगी जिसमें अन्य मामलों के साथ-साथ विश्ववि(cid:217)यालय (cid:217)वारा अपने उद्देश्यों की पर्ति के लिए उठाये गये ू

कदम सम्मिलित होंगे और उसकी प्रति प्रायोजक निकाय को प्रस्तत की जायेगी।ु

(2) उप-धारा (1) के अधीन तैयार की गयी वार्षिक रिपोर्ट की प्रतियां राज्य सरकार को भी प्रस्तत की जायेंगी।ु

39. वार्षिक लेखे और संपरीक्षा.- (1) विश्ववि(cid:217)यालय के तलनपत्र सहित वार्षिक लेखे प्रबंध बोर्ड के निदेशों के अधीन तैयार किये जायेंगे और वार्षिक लेखे विश्ववि(cid:217)यालय (cid:217)वारा इस प्रयोजन के लिए नियक्त संपरीक्षकों (cid:217)वारा प्रु त्येक वर्ष में कम से कम एक बार संपरीक्षित किये जायेंगे।

(2) संपरीक्षा रिपोर्ट सहित वार्षिक लेखों की एक प्रति प्रबंध बोर्ड को प्रस्तत की जायेगी।ु (3) प्रबंध बोर्ड के संप्रेक्षणों सहित वार्षिक लेखे और संपरीक्षा रिपोर्ट की एक प्रति प्रायोजक निकाय को प्रस्तुत की जायेगी।

(4) उप-धारा (1) के अधीन तैयार किये गये वार्षिक लेखों और तलनपत्र की प्रतियां राज्य ु

सरकार को भी प्रस्तत की जायेंगी। विश्वु

वि(cid:217)यालय के लेखों और संपरीक्षा रिपोर्ट से उद्भत राज्य ू

सरकार की राय, यदि कोई हो, प्रबंध बोर्ड के समक्ष रखी जायेगी। प्रबंध बोर्ड ऐसे निदेश जारी करेगा जो वह उचित समझे और अनपालन के बारे में राज्य सरकार को रिपोर्ट की जायेगी।

40. राज्य सरकार की विश्ववि(cid:217)यालय का निरीक्षण करने की शक्तियां.- (1) अध्यापन, परीक्षा और अनसंधान या विश्वु वि(cid:217)यालय से संबंधित किसी भी अन्य विषय से संबंधित मानकों को अभिनिश्चित करने के प्रयोजन के लिए राज्य सरकार ऐसी रीति से, जो विहित की जाये, ऐसे व्यक्ति या व्यक्तियों से, जिन्हें वह उचित समझे, निरीक्षण करवा सके गी।

(2) राज्य सरकार सधार कार्रवाई के लिए ऐसे निरीक्षण के परिणाम के संबंध में अपनी सिफारिशों से विश्ववि(cid:217)यालय को संसचित करेगी। विश्वू वि(cid:217)यालय ऐसे सधारात्मु क उपाय और प्रयास करेगा, जिससे सिफारिशों का अनपालन सनिश्चित हो।ु

ु

(3) यदि विश्ववि(cid:217)यालय उप-धारा (2) के अधीन की गयी सिफारिशों का अनपालन ु यक्तियक्त समय के भीतरु ु -भीतर करने में विफल रहा है तो राज्य सरकार ऐसे निदेश दे सके गी जो वह ऐसे अनपालन के लिए उचित समझे।

41. राज्य सरकार की सचना मांगने की शक्तियां .- (1) राज्य सरकार, विश्ववि(cid:217)यालय से उसके कार्यकरण, कत्योंृ , उपलब्धियों, अध्यापन के स्तर, परीक्षा और अनसंधान या ऐसे किन्हीं भी ु

अन्य मामलों के संबंध में, जो वह विश्ववि(cid:217)यालय की दक्षता के निर्णयन के लिए आवश्यक समझे, ऐसे प्ररूप में और ऐसे समय के भीतर, जो नियमों (cid:217)वारा विहित किया जाये, सचना मांग सके गी।ू (2) विश्ववि(cid:217)यालय, राज्य सरकार (cid:217)वारा उप-धारा (1) के अधीन यथा-अपेक्षित सचना विहित ू

समय के भीतर देने के लिए आब(cid:217)ध होगा।

42. प्रायोजक निकाय (cid:217)वारा विश्ववि(cid:217)यालय का विघटन.- (1) प्रायोजक निकाय, विश्ववि(cid:217)यालय का विघटन, राज्य सरकार और विश्ववि(cid:217)यालय के कर्मचारियों और छात्रों को विहित रीति से इस प्रभाव का कम से कम एक वर्ष का अग्रिम नोटिस देकर, कर सके गा:

परन्त विश्वु वि(cid:217)यालय का विघटन राज्य सरकार के अनमोदन और नियमित पाठ्ु यक्रम वाले छात्रों के अंतिम बैचों (cid:217)वारा अपना पाठ्यक्रम पर्ण किये जाने और उन्हें उपाधियां , डिप्लोमे या, यथास्थिति, परस्कार प्रदान किये जाने , के पश्चात ही प्रभावी होगा।्

(2) विश्ववि(cid:217)यालय के विघटन पर विश्ववि(cid:217)यालय की समस्त आस्तियां और दायित्व प्रायोजक निकाय में निहित हो जायेंगे।

43. कतिपय परिस्थितियों में राज्य सरकार की विशेष शक्तियां.- (1) यदि राज्य सरकार को यह प्रतीत हो कि विश्ववि(cid:217)यालय ने इस अधिनियम या तदधीन बनाये गये नियमों, परिनियमों या618 राजस्थान राज-पत्र, अगस्त 20, 2026 भाग 3(क) आर्डिनेन्सों के किन्हीं भी उपबंधों का उल्लंघन किया है या इस अधिनियम के अधीन उसके (cid:217)वारा जारी किये गये किन्हीं भी निदेशों का अतिक्रमण किया है या उसके (cid:217)वारा राज्य सरकार को दिये गये किन्हीं भी परिवचनों का पालन करना बंद कर दिया है या विश्ववि(cid:217)यालय में वित्तीय कप्रबंध या ु

कप्रशासन की स्थिति उत्पन्न हो गयी है तो वह विश्व वि(cid:217)यालय को, पैंतालीस दिन के भीतर कारण दर्शित करने की अपेक्षा करते हए इस बारे में नोटिस जारी करेगी कि क्यों नहीं उसके परिसमापन का आदेश किया जाना चाहिए।

(2) यदि उप-धारा (1) के अधीन जारी किये गये नोटिस पर विश्ववि(cid:217)यालय का जवाब प्राप्त होने पर राज्य सरकार का यह समाधान हो जाता है कि इस अधिनियम या तदधीन बनाये गये नियमों, परिनियमों या आडि र्नेन्सों के किन्हीं भी उपबंधों के उल्लंघन का या इस अधिनियम के अधीन उसके (cid:217)वारा जारी किये गये निदेश के अतिक्रमण का या उसके (cid:217)वारा दिये गये परिवचनों का पालन बंद करने का या वित्तीय कप्रबंध या कप्रशासन का प्रथमदृष्ट्ु

ु या मामला है तो वह ऐसी जांच का आदेश करेगी जो वह आवश्यक समझे।

(3) राज्य सरकार, उप-धारा (2) के अधीन किसी जांच के प्रयोजनों के लिए किन्हीं भी अभिकथनों की जांच करने और उन पर रिपोर्ट करने के लिए किसी जांच अधिकारी या अधिकारियों की नियक्ति करेगी।ु

(4) उप-धारा (3) के अधीन नियक्त जांच अधिकारी या अधिकारियों को वही शक्तियां होंगी जो सिविल प्रक्रिया संहिता, 1908 (1908 का के न्द्रीय अधिनियम सं. 5) के अधीन सिविल न्यायालय में निम्नलिखित विषयों के संबंध में वाद का विचारण करते समय निहित होती हैं, अर्थात ् :-

(क) किसी व्यक्ति को समन करना और हाजिर कराना और शपथ पर उसकी परीक्षा करना;

(ख) कोई ऐसा दस्तावेज या कोई अन्य सामग्री जो साक्ष्य में पोषणीय हो, के प्रकटीकरण और उसे पेश किये जाने की अपेक्षा करना; और

(ग) किसी न्यायालय या कार्यालय से लोक अभिलेख की अपेक्षा करना।

(5) इस अधिनियम के अधीन जांच कर रहे जांच अधिकारी या अधिकारियों को भारतीय नागरिक सरक्षा संहिताु , 2023 (2023 का के न्द्रीय अधिनियम सं. 46) की धारा 215 और अध्याय 28 के प्रयोजनों के लिए सिविल न्यायालय समझा जायेगा।

(6) उप-धारा (3) के अधीन नियक्त अधिकारी या अधिकारियों से जांच रिपोर्ट प्राप्त होने पर , यदि राज्य सरकार का यह समाधान हो जाता है कि विश्ववि(cid:217)यालय ने इस अधिनियम या तदधीन बनाये गये नियमों, परिनियमों या आर्डिनेन्सों के किन्हीं भी उपबंधों का उल्लघंन किया है या इस अधिनियम के अधीन उसके (cid:217)वारा जारी किन्हीं भी निदेशों का अतिक्रमण किया है या उसके (cid:217)वाराभाग 3(क) राजस्थान राज-पत्र, अगस्त 20, 2026 619 दिये गये परिवचनों का पालन करना बंद कर दिया है या विश्ववि(cid:217)यालय में वित्तीय कप्रबंध और ु

कप्रशासन की स्थिति ु उत्पन्न हो गयी है जिससे विश्ववि(cid:217)यालय के शैक्षणिक स्तर को खतरा है तो वह विश्ववि(cid:217)यालय के परिसमापन के आदेश करेगी और एक प्रशासक नियक्त करेगी और ु तत्पश्चात ् विश्ववि(cid:217)यालय के प्राधिकारी और अधिकारी उस प्रशासक के आदेश और निदेश के अध्यधीन होंगे।

(7) उप-धारा (6) के अधीन नियक्त प्रशासक को इस अधिनियम के अधीन प्रबंध बोर्ड की समस्त शक्तियां होंगी और वह प्रबंध बोर्ड के समस्त कर्तव्यों के अध्यधीन होगा और विश्ववि(cid:217)यालय के कार्यकलापों का तब तक प्रशासन करेगा जब तक कि नियमित पाठ्यक्रम के छात्रों का अंतिम बैच अपना पाठ्यक्रम पर्ण न कर ले और उन्हें उपाधियां , डिप्लोमे या, यथास्थिति, परस्कार प्रदान न कर ु

दिये जायें।

(8) नियमित पाठ्यक्रम के छात्रों के अंतिम बैचों को उपाधियां, डिप्लोमा या, यथास्थिति, परस्कार प्रदान किये जाने के पश्चा

सरकार को करेगा।

ु त प्रशासक इस आशय की एक रिपोर्ट राज्य्

(9) उप-धारा (8) के अधीन रिपोर्ट की प्राप्ति पर राज्य सरकार, राजपत्र में अधिसचना (cid:217)वाराू , विश्ववि(cid:217)यालय को विघटित करने का आदेश जारी करेगी और ऐसी अधिसचना के प्रकाशन की तारीख ू

से विश्ववि(cid:217)यालय विघटित हो जायेगा और विश्ववि(cid:217)यालय की समस्त आस्तियां और दायित्व ऐसी तारीख से प्रायोजक निकाय में निहित हो जायेंगे।

44. नियम बनाने की शक्ति.- (1) राज्य सरकार, इस अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए, राजपत्र में अधिसचना (cid:217)वाराू , नियम बना सके गी।

(2) इस अधिनियम के अधीन बनाये गये समस्त नियम, उनके इस प्रकार बनाये जाने के पश्चात यथाशक्य शीर्घ् , राज्य विधान-म(cid:214)डल के सदन के समक्ष, जब वह सत्र में हो, चौदह दिन से

, जो एक सत्र में या दो उत्तरोत्तर सत्रों में समाविष्ट हो सके गी, रखे अन्यन की कालावधि के लिएू

जायेंगे और यदि, उस सत्र की, जिसमें वे इस प्रकार रखे गये हैं या ठीक अगले सत्र की समाप्ति के पर्व राज्य विधानू -म(cid:214)डल का सदन ऐसे किन्हीं भी नियमों में कोई भी उपान्तरण करता है या यह संकल्प करता है कि ऐसे कोई नियम नहीं बनाये जाने चाहिएं तो तत्पश्चात ्ऐसे नियम के वल ऐसे उपान्तरित रूप में प्रभावी होंगे या, यथास्थिति, उनका कोई प्रभाव नहीं होगा, तथापि, ऐसा कोई भी उपान्तरण या बातिलकरण उनके अधीन पर्व में की गयी किसी बात की विधिमान्यता पर कोई प्रतिकल प्रभाव नहीं डालेगा।ू

45. कठिनाइयों के निराकरण की शक्ति.- (1) यदि इस अधिनियम के उपबंधों को क्रियान्वित करने में कोई कठिनाई उत्पन्न हो तो राज्य सरकार, राजपत्र में प्रकाशित आदेश (cid:217)वारा, ऐसे उपबंध कर सके गी जो इस अधिनियम के उपबंधों से असंगत न हों और जो उसे ऐसी कठिनाई का निराकरण करने के लिए आवश्यक या समीचीन प्रतीत हों:

परन्त इस धारा के अधीन कोई भी आदेश इस अधिनियम के प्रा रम्भ की तारीख से दो वर्ष की कालावधि की समाप्ति के पश्चात नहीं किया जायेगा।्620 राजस्थान राज-पत्र, अगस्त 20, 2026 भाग 3(क) (2) इस धारा के अधीन किया गया प्रत्येक आदेश उसके इस प्रकार किये जाने के पश्चात ् यथाशक्य शीघ्र, राज्य विधान-म(cid:214)डल के सदन के समक्ष रखा जायेगा।

46. अधिनियम का अध्यारोही प्रभाव होना.- इस अधिनियम और तदधीन बनाये गये नियमों, परिनियमों, आडि र्नेन्सों के उपबंध, उन मामलों के संबंध में जिनके बारे में राज्य विधान-म(cid:214)डल को विधि बनाने की अनन्य शक्ति है, तत्समय प्रवत्त किसी भी अन्य विधि में अन्तर्विष्ट किसी प्रतिकल बात के होने पर भी प्रभावी होंगे।

विश्व और देश में ज्ञान के सभी क्षेत्रों में तीव्र विकास के साथ-साथ कदम मिलाने के उ(cid:217)देश्य से यवाओं को उनके निकटतम स्थान पर अधनातन शैक्षिक स ुविधाओं का उपबंध करने के लिए राज्य में विश्वस्तरीय आधनिक अनसंधान और अध्ययन सविधाओं का सजन करना आवश्यक है जिससे उन्हें विश्व की उदार आर्थिक और सामाजिक व्यवस्था में मानव संसाधनों से संगत बनाया जा सके ।

समिति की सिफारिश के अनसारु , एक निजी विश्ववि(cid:217)यालय स्थापित करने के लिए न्यास की वित्तीय स्थिति ठोस प्रतीत होती है। यह उल्लिखित करने योग्य है कि प्रायोजक निकाय अभी चिकित्सा महावि(cid:217)यालय और चिकित्सालय चला रहा है। न्यास से संब(cid:217)ध अधिकांश सदस्यों की शैक्षणिक और प्रशासनिक पष्ठृ भमि अच्छीू है।

वि(cid:217)यालय के राज्य सरकार की यह राय है कि यदि उपर्यक्त अवसंरचना का उपयोजन विश्वु

रूप में निगमन में किया जाता है और उक्त फॉच्र्य ून फाउं डेशन, उदयपरु को विश्ववि(cid:217)यालय चलाने के लिए अनज्ञात किया जाता है तो इससे राज्य की जनता के शैक्षणिक विकास में योगदान होगा।

यह विधेयक पर्वोक्त उ(cid:217)देश्योंू की प्राप्ति के लिए ईप्सित है।

A

Bill

to provide for establishment and incorporation of the Geetanjali Global University, Jaipur in the State of Rajasthan and matters connected there with and incidental thereto.

Whereas, with a view to keep pace with the rapid development in all spheres of knowledge in the world and the country, it is essential to create world level modern research and study facilities in the State to provide state of the art educational facilities to the youth at their door steps so that they can make out of them human resources compatible to liberalized economic and social order of the world;

And whereas, rapid advancement in knowledge and changing requirements of human resources makes it essential that a resourceful and quick and responsive system of educational research and development be created which can work with entrepreneurial zeal under an essential regulatory set up and such a system can be created by allowing the private institutions engaged in higher education having sufficient resources and experience to establish universities and by incorporating such universities with such regulatory provisions as ensure efficient working of such institutions;

And whereas, the Fortune Foundation, Udaipur is a Trust registered under the Rajasthan Public Trusts Act, 1959 (Act No. 42 of 1959) at Registration No. 32-Dev-Udai- 2007, dated 01.12.2007 in the office of the Assistant Commissioner, Devasthan, Udaipur and engaged in the field of education for last several years;

And whereas, the said Fortune Foundation, Udaipur has set up educational

infrastructures, both physical and academic, as specified in Schedule-I, at Khasra No. 3144/1849, 1850/2922, 1930/2923, 1933, 1921, 1944, 1947, 1950, 1952, 1953, 1954, 1954/2920, 1955, 1973/1, 1980, 1980/1, 3130/2118, 3142/2120, 1905, 1905/1, 1908, 1931, 1951, 2119, 3147/2117, 1956, 3191/1924, 3193/2126, 3195/2132, 3197/2133, 3199/2135, 1960, 1980/2715, 1961, 1962, 3192/1924, 3194/2126, 3196/2132, 3198/2133, 3200/2135, 1923, 1925, 2125, 2129, 2130, 2134, 1922, 2127, 2128, 2131, 1957 of village- Bhankrota Kalan, Tehsil- Sanganer, District- Jaipur and in Plot no. F-2, F-3(PART), G-19, C-40, C-41, C-44, C-45, C-46, C-47, C-49 of West Way Heights, Keshopura, Bhankrota, Tehsil- Sanganer, District - Jaipur and has agreed to invest the said infrastructure in a University for research and studies in the disciplines specified in Schedule-II;

And whereas, the sufficiency of the above infrastructure has been got enquired into by a committee appointed in this behalf by the State Government consisting of the Vice- Chancellor, Vardhman Mahaveer Open University, Kota, Professor and Head, Department of Emergency Medicine, SMS Medical College, Jaipur, Professor, Department of Pathology, SMS Medical College, Jaipur and SDM, Sanganer, Jaipur;

And whereas, if the aforesaid infrastructure is utilized in incorporation as a University and the said Fortune Foundation, Udaipur is allowed to run the University, it would contribute in the academic development of the people of the State;

Be it enacted by the Rajasthan State Legislature in the Seventy-seventh Year of the Republic of India, as follows:-

1. Short title, extent and commencement.- (1) This Act may be called the Geetanjali Global University, Jaipur Act 2026.

(2) It extends to the whole of the State of Rajasthan.

(3) It shall come into force at once.

2. Definitions.- In this Act, unless the context otherwise requires,

(a) "AICTE" means All India Council for Technical Education established under All India Council for Technical Education Act, 1987 (Central Act No. 52 of 1987);

(b) "CSIR" means the Council of Scientific and Industrial Research, New Delhi- a funding agency of the Central Government;

(c) "Commission" means the National Medical Commission constituted under section 3 of the National Medical Commission Act, 2019 (Central Act No. 30 of 2019);

(d) "DEB" means the Distance Education Bureau established by the University Grants Commission for regulating Distance Education in India;

(e) "distance education" means education imparted by combination of any two or more means of communication, viz. broadcasting, telecasting, correspondence courses, seminars, contact programmes and any other such methodology;

(f) "DST" means the Department of Science and Technology of the Central Government;

(g) "employee" means a person appointed by the University to work in the University and includes teachers, officers and other employees of the University;

(h) "fee" means collection made by the University from the students by whatever name it may be called and which may be refundable as per the guidelines issued by the UGC from time to time;

(i) "Government" means the State Government of Rajasthan;

(j) "higher education" means study of a curriculum or course for the pursuit of knowledge beyond 10+2 level;

(k) "hostel" means a place of residence for the students of the University, or its colleges, institutions or centers, maintained or recognized to be as such by the University;

(l) "ICAR" means the Indian Council of Agricultural Research, a society registered under the Societies Registration Act, 1860 (Central Act No. 21 of 1860);

(m) "NAAC" means the National Assessment and Accreditation Council, Bangalore, an autonomous institution of the UGC;

(n) "NCTE" means the National Council for Teacher Education constituted under section 3 of the National Council for Teacher Education Act, 1993 (Central Act No. 73 of 1993);

(o) "off campus centre" means a centre of the University established by it outside the main campus operated and maintained as its constituent unit, having the University's complement of facilities, faculty and staff;

(p) "PCI" means Pharmacy Council of India constituted under section 3 of the Pharmacy Act, 1948 (Central Act No. 8 of 1948);

(q) "prescribed" means prescribed by Statutes made under this Act;

(r) "regulating body" means a body established or constituted by or under any law for the time being in force laying down norms and conditions for ensuring academic standards of higher education, such as UGC, AICTE, NCTE, Commission, PCI, NAAC, ICAR, DEB, CSIR etc. and includes the State Government;

(s) "rules" means the rules made under this Act;

(t) "Schedule" means the Schedule to this Act; (u) "Sponsoring Body" means the Fortune Foundation, Udaipur is a Trust registered under the Rajasthan Public Trusts Act, 1959 (Act No. 42 of 1959) at Registration No. 32-Dev-Udai-2007, dated 01.12.2007 in the office of the Assistant Commissioner, Devasthan, Udaipur;

(v) "Statutes", "Ordinances" and "Regulations" mean respectively, the Statutes, Ordinances and Regulations of the University made under this Act;

(w) "student of the University" means a person enrolled in the University for taking a course of study for a degree, diploma or other academic distinction duly instituted by the University, including a research degree;

(x) "study centre" means a centre established and maintained or recognized by the University for the purpose of advising, counselling or for rendering any other assistance required by the students in the context of distance education;

(y) "teacher" means a Professor, Associate Professor, Assistant Professor or any other person required to impart education or to guide research or to render634 राजस्थान राज-पत्र, अगस्त 20, 2026 भाग 3(क) guidance in any other form to the students for pursuing a course of study of the University;

(z) "UGC" means the University Grants Commission established under section 4 of the University Grants Commission Act, 1956 (Central Act No. 3 of 1956);

and

(za) "University" means the Geetanjali Global University, Jaipur.

3. Incorporation.- (1) The first Chairperson and the first President of the University and the first members of the Board of Management and the Academic Council and all persons who may hereafter become such officers or members, so long as they continue to

hold such office or membership, are hereby constituted a body corporate by the name of the Geetanjali Global University, Jaipur.

(2) The movable and immovable property specified in the Schedule-I shall be vested in the University and the Sponsoring Body shall, immediately after the commencement of this Act, take steps for such vesting.

(3) The University shall have perpetual succession and a common seal and shall sue and be sued by the said name.

(4) The University shall situate and have its headquarters at Bhankrota, Tehsil

Sanganer, District Jaipur (Rajasthan).

4. The objects of the University.- The objects of the University shall be to undertake research and studies in the disciplines specified in Schedule-II and such other disciplines as the University may, with the prior approval of the State Government, determine from time to time and to achieve excellence and impart and disseminate knowledge in the said disciplines.

5. Powers and functions of the University.- The University shall have the following powers and functions, namely:-

(a) to provide for instruction in the disciplines specified in Schedule-II and to make provisions for research and for the advancement and dissemination of knowledge;

(b) to grant, subject to such conditions as the University may determine, diplomas or certificates, and confer degrees or other academic distinctions on the basis of examinations, evaluation or any other method of testing on persons, and to withdraw any such diplomas, certificates, degrees or other academic distinctions for good and sufficient cause;

(c) to organize and to undertake extramural studies and extension service;

(d) to confer honorary degrees or other distinctions in the manner prescribed;

(e) to provide instruction, including correspondence and such other courses, as it may determine;

(f) to institute Professorships, Associate Professorships, Assistant Professorships and other teaching or academic posts required by the University and to make appointment thereto;

(g) to create administrative, ministerial and other posts and to make appointments thereto;

(h) to appoint persons working in any other university or organization having specific knowledge permanently or for a specified period;

(i) to cooperate, collaborate or associate with any other university or authority or institution in such manner and for such purpose as the University may determine;

(j) to establish study centres and maintain schools, institutions and such centres, specialized laboratories or other units for research and instructions as are in the opinion of the University necessary for the furtherance of its object;

(k) to institute and award fellowships, scholarships, studentships, medals and prizes;

(l) to establish and maintain hostels for students of the University;

(m) to make provisions for research and consultancy, and for that purpose to enter into such arrangements with other institutions or bodies as the University may deem necessary;

(n) to determine standards for admission into the University, which may include examination, evaluation or any other method of testing;

(o) to demand and receive payment of fees and other charges;

(p) to supervise the residences of the students of the University and to make arrangements for the promotion of their health and general welfare;

(q) to make special arrangements in respect of women students as the University may consider desirable;

(r) to regulate and enforce discipline among the employees and students of the University and take such disciplinary measures in this regard as may be deemed necessary by the University;

(s) to make arrangements for promoting the health and general welfare of the employees of the University;

(t) to receive donations and acquire, hold, manage and dispose of any movable or immovable property;

(u) to borrow money with the approval of the Sponsoring Body for the purposes of the University;

(v) to mortgage or hypothecate the property of the University with the approval of the Sponsoring Body;

(w) to establish examination centres;

(x) to ensure that the standard of degrees, diplomas, certificates and other academic distinctions are not lower than those laid down by AICTE, NCTE, UGC, Commission, PCI and other similar bodies established by or under any law for the time being in force for the regulation of education;

(y) to set up off campus centre within the State, subject to the provisions of any other law for the time being in force; and

(z) to do all such other acts and things as may be necessary, incidental or conducive to the attainment of all or any of the objects of the University.

6. University to be self-financed.- The University shall be self-financed and shall not be entitled to receive any grant or other financial assistance from the State Government. 7. No power of affiliation.- The University shall have no power to affiliate or otherwise admit to its privileges any other institution.

8. General Fund.- The University shall establish a Fund, which shall be called the General Fund to which following shall be credited, namely:-

(a) fees and other charges received by the University;

(b) any contributions made by the Sponsoring Body;

(c) any income received from consultancy and other work undertaken by the University in pursuance of its objectives;

(d) trusts, bequests, donations, endowments and any other grants; and

(e) all other sums received by the University.

9. Application of General Fund.- The General Fund shall be utilized for meeting all expenses, recurring or non-recurring, in connection with the affairs of the University:

Provided that no expenditure shall be incurred by the University in excess of the limits for total recurring expenditure and total non-recurring expenditure for the year, as may be fixed by the Board of Management, without the prior approval of the Board of Management.

10. Officers of the University.-The following shall be the officers of the University, namely:-

(i) the Chairperson;

(ii) the President;

(iii) the Pro-President;

(iv) the Provost;

(v) the Proctor;

(vi) the Deans of Faculties;

(vii) the Registrar;

(viii) the Chief Finance and Accounts Officer; and

(ix) such other officers as may be declared by the Statutes to be the officers of the University.

11. The Chairperson.- (1) The Chairperson shall be appointed by the Sponsoring Body with the consent of the State Government for a period of five years from the date on which he enters upon his office:

Provided that a Chairperson shall, notwithstanding the expiration of his term, continue to hold office until his successor enters upon the office.

(2) Any vacancy in the office of Chairperson shall be filled within six months from the date of such vacancy.

(3) The Chairperson shall, by virtue of his office, be the head of the University.

(4) The Chairperson shall, if present, preside at the meetings of the Board of Management and at the convocation of the University for conferring degrees, diplomas or other academic distinctions.

(5) The Chairperson shall have the following powers, namely:-

(a) to call for any information or record in connection with the affairs of the University;

(b) to appoint the President;

(c) to remove the President in accordance with the provisions of sub- section (11) of section 12; and

(d) such other powers as may be prescribed by the Statutes.

12. The President.- (1) The President shall be appointed by the Chairperson from a panel of not less than three and not more than five persons recommended by the Board of Management.

(2) No person shall be eligible to be appointed as President unless he is a distinguished academician having a minimum of ten years experience as Professor in a university or college or ten years of experience in an equivalent position in a reputed research and/or academic administrative organization.

(3) The term of the office of the President shall be three years from the date on which he enters upon his office or until he attains the age of seventy years, whichever is earlier:

Provided that the same person shall be eligible for reappointment:

Provided further that a President shall, notwithstanding the expiration of his term, continue to hold office until his successor enters upon the office.

(4) For the purpose of selection of the President, the Board of Management shall invite applications from eligible persons through a public notice and while considering the names of persons to be appointed as President, the Board of Management shall give proper weightage to academic excellence, exposure to the higher education system in the country and adequate experience in academic and administrative governance and record its findings in writing and enclose the same with the panel to be submitted to the Chairperson.

(5) Any vacancy in the office of President shall be filled within six months from the date of such vacancy.

(6) The President shall be the principal executive and academic officer of the University and shall exercise general superintendence and control over the affairs of the University and shall execute the decisions of the authorities of the University.

(7) The President shall preside at the convocation of the University in the absence of the Chairperson.

(8) If, in the opinion of the President, it is necessary to take immediate action on any matter for which powers are conferred on any other authority by or under this Act, he may take such action as he deems necessary and shall at the earliest opportunity thereafter report his action to such officer or authority as would have in the ordinary course dealt with the matter:

Provided that if, in the opinion of the officer or authority concerned, such action should not have been taken by the President then such case shall be referred to the Chairperson, whose decision thereon shall be final:

Provided further that where any such action taken by the President affects any person in the service of the University, such person shall be entitled to prefer, within three months from the date on which such action is communicated to him, an appeal to the Board of Management and the Board of Management may confirm or modify or reverse the action taken by the President.

(9) If, in the opinion of the President, any decision of any authority of the University is outside the powers conferred by this Act or Statutes, Ordinances, Regulations or rules made thereunder or is likely to be prejudicial to the interests of the University, he shall direct the authority concerned to revise its decision within fifteen days from the date of its decision and in case the authority refuses or fails to revise such decision, then such matter shall be referred to the Chairperson and his decision thereon shall be final.

(10) The President shall exercise such other powers and perform such other duties as may be prescribed by the Statutes or the Ordinances.

(11) If the Chairperson is satisfied, on an enquiry made or caused to be made on a representation made to him or otherwise, that the continuance of President in his office is prejudicial to the interests of the University or the situation so warrants, he may, by an order in writing and stating the reasons therein for doing so, ask the President to relinquish his office from such date as may be specified in the order:

Provided that before taking an action under this sub-section, the President shall be given an opportunity of being heard.

13. The Pro-President.- (1) The Pro-President shall be appointed by the Chairperson in consultation with the President.

(2) The Pro-President shall hold office for a period of three years and shall be eligible for re-appointment for a second term.

(3) The conditions of service of the Pro-President shall be such as may be prescribed by the Statutes.

(4) If the Chairperson is satisfied, on an enquiry made or caused to be made on a representation made to him or otherwise, that the continuance of the Pro-President in his office is prejudicial to the interests of the University or the situation so warrants, he may, by an order in writing and stating the reasons therein for doing so, ask the Pro-President to relinquish his office from such date as may be specified in the order:

Provided that before taking an action under this sub-section, the Pro- President shall be given an opportunity of being heard.

(5) The Pro-President shall assist the President in such matters as are assigned to him by the President from time to time and shall exercise such powers and perform such functions as may be delegated to him by the President.

14. The Provost.- (1) The Provost shall be appointed by the President for such period and in such manner as may be prescribed by the Statutes.

(2) The Provost shall ensure discipline in the University and shall keep the various unions of the teachers and employees advised of the various policies and practices in the University.

(3)The Provost shall exercise such other powers and perform such other duties as may be prescribed by the Statutes.

15. The Proctor.- (1) The Proctor shall be appointed by the President for such period and in such manner as may be prescribed by the Statutes.

(2) The Proctor shall be responsible for the maintenance of discipline among the students and keep the various students' unions advised of the various policies and practices in the University.

(3) The Proctor shall exercise such other powers and perform such other duties as may be prescribed by the Statutes.

16. The Dean of Faculty.- (1) There shall be a Dean of each Faculty who shall be appointed by the President for a period of three years in such manner as may be prescribed by the Statutes.

(2) The Dean shall convene meetings of the Faculty, as and when required, in consultation with the President and shall preside over the same. He shall formulate the policies and development programme of the Faculty and present the same to the appropriate authorities for their consideration.

(3) The Dean of Faculty shall exercise such otherpowers and perform such otherduties as may be prescribed by the Statutes.

17. The Registrar.- (1) The Registrar shall be appointed by the Chairperson in such manner as may be prescribed by the Statutes.

(2) All contracts shall be signed and all documents and records shall be authenticated by the Registrar on behalf of the University.

(3) The Registrar shall be the Member-Secretary of the Board of Management and Academic Council but he shall not have a right to vote.

(4) The Registrar shall exercise such other powers and perform such other duties as may be prescribed by the Statutes.

18. The Chief Finance and Accounts Officer.- (1) The Chief Finance and Accounts Officer shall be appointed by the President in such manner as may be prescribed by the Statutes.

(2) The Chief Finance and Accounts Officer shall exercise such powers and perform such duties as may be prescribed by the Statutes.

19. Other officers.- (1) The University may appoint such other officers as may be necessary for its functioning.

(2) The manner of appointment and powers and functions of such officers shall be such as may be prescribed by the Statutes.

20. Authorities of the University.-The following shall be the authorities of the University, namely:-

(i) the Board of Management;

(ii) the Academic Council;

(iii) the Faculties; and

(iv) such other authorities as may be declared by the Statutes to be the authorities of the University.

21. The Board of Management.- (1) The Board of Management of the University shall consist of the following, namely:-

(a) the Chairperson;

(b) the President;

(c) five persons nominated by the Sponsoring Body out of whom two shall be eminent educationists or specialists in disciplines specified in Schedule-II;

(d) one expert of management or information technology from outside the

University, nominated by the Chairperson;

(e) one expert of finance, nominated by the Chairperson;

(f) Commissioner, College Education or his nominee not below the rank of

Deputy Secretary; and

(g) two teachers, nominated by the President.

(2) The Board of Management shall be the principal executive body of the University. All the movable and immovable property of the University shall vest in the Board of Management. It shall have the following powers, namely:-

(a) to provide general superintendence and directions and to control the functioning of the University by using all such powers as are provided by this Act or the Statutes, Ordinances, Regulations or rules made thereunder;

(b) to review the decisions of other authorities of the University in case they are not in conformity with the provisions of this Act or the Statutes, Ordinances, Regulations or rules made thereunder;

(c) to approve the budget and annual report of the University;

(d) to lay down the policies to be followed by the University;

(e) to recommend to the Sponsoring Body about the voluntary liquidation of the University, if a situation arises when smooth functioning of the University does not remain possible, in spite of all efforts; and

(f) such other powers as may be prescribed by the Statutes.

(3) The Board of Management shall meet at least three times in a calendar year.

(4) The quorum for meetings of the Board of Management shall be five.

22. The Academic Council.- (1) The Academic Council shall consist of the President and such other members as may be prescribed by the Statutes.

(2) The President shall be the Chairperson of the Academic Council.

(3) The Academic Council shall be the principal academic body of the University and shall, subject to the provisions of this Act and the rules, Regulations, Statutes or Ordinances made thereunder, co-ordinate and exercise general supervision over the academic policies of the University.

(4) The quorum for meetings of the Academic Council shall be such as may be prescribed by the Statutes.

23. Other authorities.- The composition, constitution, powers and functions of other authorities of the University shall be such as may be prescribed by the Statutes.

24. Disqualification for membership of an authority.- A person shall be disqualified for being a member of any of the authorities of the University, if he-

(a) is of unsound mind and stands so declared by a competent court;

(b) is an undischarged insolvent;

(c) has been convicted of any offence involving moral turpitude;

(d) is conducting or engaging himself in private coaching classes; or

(e) has been punished for indulging in or promoting unfair practice in the conduct of any examination, in any form, anywhere.

25. Vacancies not to invalidate the proceedings of any authority of the University.- No act or proceeding of any authority of the University shall be invalid merely by reason of any vacancy or defect in the constitution thereof.

26. Filling up of emergent vacancies.- Any vacancies occurred in the membership of authorities of the University due to death, resignation or removal of a member or due to change of capacity in which he was appointed or nominated, shall be filled up as early as possible by the person or the body who had appointed or nominated such a member:

Provided that the person appointed or nominated as a member of an authority of the University on an emergent vacancy, shall remain member of such authority for only the remaining period of the member, in whose place he is appointed or nominated.

27. Committee.- The authorities or officers of the University may constitute such committees with such terms of reference as may be necessary for specific tasks to be performed by such committees. The constitution of such committees and their duties shall be such as may be prescribed by the Statutes.

28. The Statutes.- (1) Subject to the provisions of this Act, the Statutes of the University may provide for all or any of the following matters, namely:-

(a) the constitution, powers and functions of the authorities of the University as may be constituted from time to time;

(b) the terms and conditions of appointment of the President and his powers and functions;

(c) the manner and terms and conditions of appointment of the Registrar and Chief Finance and Accounts Officer and their powers and functions;

(d) the manner in which and the period for which the Provost and the Proctor shall be appointed and their powers and functions;

(e) the manner in which the Dean of Faculty shall be appointed and his powers and functions;

(f) the manner and terms and conditions of appointment of other officers and teachers and their powers and functions;

(g) the terms and conditions of service of employees of the University and their functions;

(h) the procedure for arbitration in case of disputes between officers, teachers, employees and students;

(i) the conferment of honorary degrees;

(j) the provisions regarding exemption of students from payment of tuition fee and for awarding to them scholarships and fellowships;

(k) provisions regarding the policy of admissions, including regulation of reservation of seats;

(l) provisions regarding fees to be charged from students;

(m) provisions regarding number of seats in different courses;

(n) creation of new authorities of the University;

(o) accounting policy and financial procedure;

(p) creation of new departments and abolition or restructuring of existing departments;

(q) institution of medals and prizes;

(r) creation of posts and procedure for abolition of posts;

(s) revision of fees;

(t) alteration of the number of seats in different syllabi; and

(u) all other matters which under the provisions of this Act are required to be, or may be, prescribed by the Statutes.

(2) The Statutes of the University shall be made by the Board of Management and shall be submitted to the State Government for its approval.

(3) The State Government shall consider the Statutes submitted by the University and shall give its approval thereon within two months from the date of its receipt with such modifications, if any, as it may deem necessary.

(4) The University shall communicate its agreement to the Statutes as approved by the State Government, and if it desires not to give effect to any or all of the modifications made by the State Government under sub-section (3), it may give reasons therefor and afterभाग 3(क) राजस्थान राज-पत्र, अगस्त 20, 2026 643 considering such reason, the State Government may or may not accept the suggestions made by the University.

(5) The State Government shall publish the Statutes, as finally approved by it, in the Official Gazette, and thereafter, the Statutes shall come into force from the date of such publication.

29. The Ordinances.- (1) Subject to the provisions of this Act or Statutes made thereunder, the Ordinances may provide for all or any of the following matters, namely:-

(a) the admission of students to the University and their enrolment as such;

(b) the courses of study to be laid down for the degrees, diplomas and certificates of the University;

(c) the award of the degrees, diplomas, certificates and other academic distinctions, the minimum qualifications for the same and the measures to be taken relating to the granting and obtaining of the same;

(d) the conditions for award of fellowships, scholarships, stipends, medals and prizes;

(e) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators;

(f) fees to be charged for the courses, examinations, degrees and diplomas of the University;

(g) the conditions of residence of the students of the University;

(h) provision regarding disciplinary action against the students;

(i) the creation, composition and functions of any other body which is considered necessary for improving the academic life of the University;

(j) the manner of co-operation and collaboration with other Universities and institutions of higher education; and

(k) all other matters which by this Act or Statutes made thereunder are required to be provided by the Ordinances.

(2) The Ordinances of the University shall be made by the Academic Council which after being approved by the Board of Management, shall be submitted to the State Government for its approval.

(3) The State Government shall consider the Ordinances submitted under sub-section (2) within two months from the date of their receipt and shall either approve them or give suggestions for modifications therein.

(4) The Academic Council shall either modify the Ordinances incorporating the suggestion of the State Government or give reasons for not incorporating any of the suggestions made by the State Government and shall return the Ordinances along with such reasons, if any, to the State Government and on receipt of the same, the State Government shall consider the comments of the Academic Council and shall approve the Ordinances of the University with or without such modifications.

30. Regulations.- The authorities of the University may, subject to the prior approval of the Board of Management, make regulations, consistent with this Act and the rules, Statutes and the Ordinances made thereunder, for the conduct of their own business and that of the committees appointed by them.

31. Admissions.- (1) Admission in the University shall be made strictly on the basis of merit.

(2) Merit for admission in the University may be determined either on the basis of marks or grade obtained in the qualifying examination and achievements in co-curricular and extra-curricular activities or on the basis of marks or grade obtained in the entrance test conducted at the State level either by an association of the universities conducting similar courses or by any agency of the State:

Provided that admission in professional and technical courses shall be made only through entrance test.

(3) Reservation in admission to the University for scheduled castes, scheduled tribes, backward classes, more backward classes, economically weaker sections, women and handicapped persons shall be provided as per the policy of the State Government.

32. Fees structure.- (1) The University may, from time to time, prepare its fees structure and send it for approval of the committee constituted for the purpose.

(2) The committee shall consider the fees structure prepared by the University and if it is satisfied that the proposed fees is -

(a) sufficient for -

(i) generating resources for meeting the recurring expenditure of the University; and

(ii) the savings required for the further development of the University; and (b) not unreasonably excessive,

it may approve the fees structure.

(3) The fees structure approved by the committee under sub-section (2) shall remain in force for three years and the University shall be entitled to charge fees in accordance with such fees structure.

(4) The University shall not charge any fees, by whatever name called, other than that for which it is entitled under sub-section (3).

33. Examinations.- At the beginning of each academic session and in any case not later than 30th of August of every calendar year, the University shall prepare and publish a schedule of examinations for each and every course conducted by it and shall strictly adhere to the schedule.

Explanation.- "Schedule of Examination" means a table giving details about the time, day and date of the commencement of each paper which is a part of a scheme of examinations and shall also include the details about the practical examinations:

Provided that if, for any reason whatsoever, the University has been unable to follow this schedule, it shall, as soon as practicable, submit a report to the State Governmentभाग 3(क) राजस्थान राज-पत्र, अगस्त 20, 2026 645 incorporating the reasons for making a departure from the published schedule. The State Government may, thereon, issue such directions as it may deem fit for the compliance of the schedule.

34. Declaration of results.- (1) The University shall strive to declare the results of every examination conducted by it within thirty days from the last date of the examination for that particular course and shall in any case declare the results latest within forty-five days from such date:

Provided that if, for any reason whatsoever, the University is unable to finally declare the results of any examination within the aforesaid period of forty-five days, it shall submit a report incorporating the reasons for such delay to the State Government. The State Government may, thereon, issue such directions as it may deem fit.

(2) No examination or the results of an examination shall be held invalid only for the reasons that the University has not followed the time schedule as stipulated in section 33 or, as the case may be, in this section.

35. Convocation.- The convocation of the University shall be held in every academic year in the manner as may be prescribed by the Statutes for conferring degrees, diplomas or for any other purpose.

36. Accreditation of the University.- The University shall obtain accreditation from the NAAC, as per the norms of the NAAC and inform the State Government and such other regulating bodies which are connected with the courses taken up by the University about the grade provided by the NAAC to the University. The University shall get renewed such accreditation from time to time as per the norms of the NAAC.

37. University to follow rules, regulations, norms, etc. of the regulating bodies.- Notwithstanding anything contained in this Act, the University shall be bound to comply with all the rules, regulations, norms, etc. of the regulating bodies and provide all such facilities and assistance to such bodies as are required by them to discharge their duties and carry out their functions.

38. Annual report.- (1) The annual report of the University shall be prepared by the Board of Management which shall include among other matters, the steps taken by the University towards the fulfillment of its objects and copy of the same shall be submitted to the Sponsoring Body.

(2) Copies of the annual report prepared under sub-section (1) shall also be presented to the State Government.

39. Annual accounts and audit.- (1) The annual accounts including balance sheet of the University shall be prepared under the directions of the Board of Management and the annual accounts shall be audited at least once in every year by the auditors appointed by the University for this purpose.

(2) A copy of the annual accounts together with the audit report shall be submitted to the Board of Management.

(3) A copy of the annual accounts and audit report along with the observations of the Board of Management shall be submitted to the Sponsoring Body.

(4) Copies of annual accounts and balance sheet prepared under sub-section (1) shall also be presented to the State Government. The advice of the State Government, if any, arising out of the accounts and audit report of the University shall be placed before the Board of Management. The Board of Management shall issue such directions, as it may deem fit and compliance shall be reported to the State Government.

40. Powers of the State Government to inspect the University.- (1) For the purpose of ascertaining the standards of teaching, examination and research or any other matter relating to the University, the State Government may cause an inspection, to be made in such manner as may be prescribed, by such person or persons as it may deem fit.

(2) The State Government shall communicate to the University its recommendations in regard to the result of such inspection for corrective action. The University shall adopt such corrective measures and make efforts so as to ensure the compliance of the recommendations.

(3) If the University has failed to comply with the recommendations made under sub-section (2) within a reasonable time, the State Government may give such directions as it may deem fit for such compliance.

41. Powers of the State Government to call for information.- (1) The State Government may call for information from the University relating to its working, functions, achievements, standard of teaching, examination and research or any other matters as it may consider necessary to judge the efficiency of the University in such form and within such time as may be prescribed by rules.

(2) The University shall be bound to furnish the information as required by the State Government under sub-section (1) within the prescribed time.

42. Dissolution of the University by the Sponsoring Body.- (1) The Sponsoring Body may dissolve the University by giving a notice to the effect in the prescribed manner to the State Government and the employees and the students of the University at least one year in advance:

Provided that dissolution of the University shall have effect only after the approval of the State Government and the last batches of students of the regular courses have completed their courses and they have been awarded degrees, diplomas or awards, as the case may be.

(2) On the dissolution of the University all the assets and liabilities of the University shall vest in the Sponsoring Body.

43. Special powers of the State Government in certain circumstances.- (1) If it appears to the State Government that the University has contravened any of the provisions of this Act or the rules, Statutes or Ordinances made thereunder or has violated any of the directions issued by it under this Act or has ceased to carry out any undertakings given by it to the State Government or a situation of financial mismanagement or mal-administration hasभाग 3(क) राजस्थान राज-पत्र, अगस्त 20, 2026 647 arisen in the University, it shall issue notice requiring the University to show cause within forty-five days as to why an order of its liquidation should not be made.

(2) If the State Government, on receipt of reply of the University on the notice issued under sub-section (1), is satisfied that there is a prima facie case of contravening any of the provisions of this Act or the rules, Statutes or Ordinances made thereunder or of violating directions issued by it under this Act or of ceasing to carry out the undertakings given by it or of financial mismanagement or mal-administration, it shall make an order of such enquiry as it may consider necessary.

(3) The State Government shall, for the purposes of any enquiry under sub-section (2), appoint an inquiry officer or officers to inquire into any of the allegations and to make report thereon.

(4) The inquiry officer or officers appointed under sub-section (3) shall have the same powers as are vestedina civil court under the Code of Civil Procedure,1908 (Central Act No. 5 of 1908) while trying a suit in respect of the following matters, namely:-

(a) summoning and enforcing the attendance of any person and examining him on oath;

(b) requiring the discovery and production of any such document or any other material as may be predicable in evidence; and

(c) requisitioning any public record from any court or office.

(5) The inquiry officer or officers inquiring under this Act shall be deemed to be a civil court for the purposes of section 215 and Chapter XXVIII of the Bhartiya Nagrik Surksha Sanhita, 2023 (Central Act No. 46 of 2023).

(6) On receipt of the enquiry report from the officer or officers appointed under sub- section (3), if the State Government is satisfied that the University has contravened any of the provisions of this Act or the rules, Statutes or Ordinances made thereunder or has violated any of the directions issued by it under this Act or has ceased to carry out the undertakings given by it or a situation of financial mismanagement and mal-administration has arisen in the University which threatens the academic standard of the University, it shall make orders for liquidation of the University and appoint an administrator and thereupon the authorities and officers of the University shall be subject to the order and direction of the administrator.

(7) The administrator appointed under sub-section (6) shall have all the powers and be subject to all the duties of the Board of Management under this Act and shall administer the affairs of the University until the last batch of the students of the regular courses have completed their courses and they have been awarded degrees, diplomas or awards, as the case may be.

(8) After having been awarded the degrees, diplomas or awards, as the case may be, to the last batches of the students of the regular courses, the administrator shall make a report to the effect to the State Government.

(9) On receipt of the report under sub-section (8), the State Government shall, by a notification in the Official Gazette, issue an order dissolving the University and from the date of publication of such notification the University shall stand dissolved and all the assets and liabilities of the University shall vest in the Sponsoring Body from such date.

44. Power to make rules.- (1) The State Government may, by notification in the Official Gazette, make rules to carry out the purposes of this Act.

(2) All rules made under this Act shall be laid, as soon as may be, after they are so made, before the House of the State Legislature, while it is in session, for a period of not less than fourteen days which may be comprised in one session or in two successive sessions and if before the expiry of the session in which they are so laid or of the session immediately following, the House of the State Legislature makes any modification in any such rules or resolves that any such rules should not be made, such rules shall thereafter have effect only in such modified form or be of no effect, as the case may be, so however, that any such modification or annulment shall be without prejudice to the validity of anything previously done thereunder.

45. Power to remove difficulties.- (1) If any difficulty arises in giving effect to the provisions of this Act, the State Government may, by order published in the Official Gazette, make provisions, not inconsistent with the provisions of this Act, as appear to it to be necessary or expedient for removing the difficulty:

Provided that no order under this section shall be made after the expiry of a period of two years from the date of commencement of this Act.

(2) Every order made under this section shall, as soon as may be after it is made, shall be laid before the House of the State Legislature.

46. The Act to have overriding effect.- The provisions of this Act and the rules, Statutes, Ordinances made thereunder shall have effect notwithstanding anything to the contrary contained in any other law, for the time being in force, relating to the matters in respect of which the State Legislature has exclusive power to make laws.

STATEMENT OF OBJECTS AND REASONS

With a view to keep pace with the rapid development in all spheres of knowledge in the world and the Country, it is essential to create world level modern research and study facilities in the State to provide state of the art educational facilities to the youth at their door steps so that they can make out of them human resources compatible to liberalized economic and social order of the world.

Rapid advancement in knowledge and changing requirements of human resources makes it essential that a resourceful and quick and responsive system of educational research and development be created which can work with entrepreneurial zeal under an essential regulatory setup and such a system can be created by allowing the private institutions engaged in higher education having sufficient resources and experience to establish universities and by incorporating such universities with such regulatory provisions as to ensure efficient working of such institutions.

The Fortune Foundation, Udaipur is a Trust registered under the Rajasthan Public Trusts Act, 1959 (Act No. 42 of 1959) at Registration No. 32-Dev-Udai-2007, dated 01.12.2007 in the office of the Assistant Commissioner, Devasthan, Udaipur and engaged in the field of education for last several years.

The said Fortune Foundation, Udaipur has set up educational infrastructures, both physical and academic, as specified in Schedule-I, at Khasra No. 3144/1849, 1850/2922, 1930/2923, 1933, 1921, 1944, 1947, 1950, 1952, 1953, 1954, 1954/2920, 1955, 1973/1, 1980, 1980/1, 3130/2118, 3142/2120, 1905, 1905/1, 1908, 1931, 1951, 2119, 3147/2117, 1956, 3191/1924, 3193/2126, 3195/2132, 3197/2133, 3199/2135 ,1960, 1980/2715, 1961, 1962, 3192/1924, 3194/2126, 3196/2132, 3198/2133, 3200/2135, 1923, 1925, 2125, 2129, 2130, 2134, 1922, 2127, 2128, 2131, 1957 of village- Bhankrota Kalan, Tehsil - Sanganer, District - Jaipur and in Plot no. F-2, F-3(PART), G-19, C-40, C-41, C-44, C-45, C-46, C-47, C-49 of West Way Heights, Keshopura, Bhankrota, Tehsil- Sanganer, District - Jaipur (Rajasthan)and has agreed to invest the said infrastructure in a University for research and studies in the disciplines specified in Schedule-II.

The sufficiency of the above infrastructure has been got enquired into by a committee, appointed in this behalf by the State Government consisting of the Vice-Chancellor, Vardhman Mahaveer Open University, Kota, Professor and Head, Department of Emergency Medicine, SMS Medical College, Jaipur, Professor, Department of Pathology, SMS Medical College, Jaipur and SDM, Sanganer, Jaipur.

As per recommendation of the Committee, the financial position of the Trust seems to be sound for establishment of a private university. It is worth mentioning that the sponsoring body is running medical college and hospital currently. Most of the members associated with the Trust have good academic and administrative background.

The State Government is of the view that if the aforesaid infrastructure is utilized in incorporation as a University and the said Fortune Foundation, Udaipur is allowed to run the University, it would contribute in the academic development of the people of the State.

The Bill seeks to achieve the aforesaid objectives.

MEMORANDUM REGARDING DELEGATED LEGISLATION

Clause 28 of the Bill, if enacted, shall empower the University to make, with the approval of the State Government, Statutes with regard to matters enumerated therein.

Clause 29 of the Bill, if enacted, shall empower the University to make, with the approval of the State Government, Ordinances with regard to matters enumerated therein.

Clause 30 of the Bill, if enacted, shall empower the authorities of the University to make, with the prior approval of the Board of Management, regulations for conduct of their own business.

Clause 40 of the Bill, if enacted, shall empower the State Government to make rules, with respect to the manner in which inspection of the University may be made.

Clause 41 of the Bill, if enacted, shall empower the State Government to make rules with respect to the manner in which the information relating to the University may be called from the University.

The proposed delegation is of normal character and relates to the matters of details.
