Declaration under Sub-Section (1) of 19 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013)

Appropriate Government / Collector of Chennai after considering the recommendation and record of proceedings u/s 15(1)&(2) of the RFCTLARR Act, 2013 submitted by the Land Acquisition Officer/Revenue Divisional Officer is satisfied that the acquisition of lands mentioned in the schedule below are needed for the public purpose that is to convert the land and buildings of former Chief Minister of Tamil Nadu Selvi J Jayalalithaa (late) "Veda Illam" at Poes Garden as Government Memorial. This project does not involve any displacement of families /relocation. There are no Project Affected Families(PAFs) and hence no question of relocation , resettlement and rehabilitation. Therefore it is declared that no area was identified as "resettlement area for the purpose of rehabilitation and resettlement of the affected families."

The plan of the land under acquisition kept in the Office of the Land Acquisition Officer /Revenue Divisional Officer, South Chennai Revenue Division, Guindy, Chennai-32 and may be inspected at any time during office hours.

2013 ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமான சரியீடு பெறுவதற்கும் மற்றும் ஒளிவுமறைவின்மைக்கும், மறுவாழ்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச்சட்டம் (மத்திய சட்டம் 30/2013) உட்பிரிவு 19(1) ன் கீழான அறிவிக்கை நில எடுப்பு அலுவலர் / வருவாய் கோட்டாட்சியரால் 2013 ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமான சரியீடு பெறுவதற்கும் மற்றும் ஒளிவுமறைவின்மைக்கும், மறுவாழ்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச்சட்டம் (மத்திய சட்டம் 30/2013) பிரிவு 15(1) மற்றும் (2) ன் கீழ் செய்யப்பட்ட பரிந்துரைகள் மற்றும் செயல்முறைகளை கவனமுடன் பரிசீலனை செய்து அட்டவணையில் குறிப்பிட்டுள்ளதுமான நிலங்கள் ஒரு பொது நோக்கத்திற்காக அதாவது தமிழக முன்னாள் முதல்வர் செல்வி ஜெ. ஜெயலலிதா (லேட்) அவர்களின் இல்லமான போயஸ் தோட்டத்தில் உள்ள வேதா இல்லத்தினை அரசு நினைவிடமாக மாற்றம் செய்வதற்கு நில எடுப்பு செய்வது அவசியம் என தீர்மானித்து உரிய அரசு / சென்னை மாவட்ட ஆட்சியரால் இதனால் அறிவிக்கை செய்யப்படுகிறது.

இந்த நில எடுப்பினால் பாதிப்புக்குள்ளாகும் குடும்பங்கள் எதுவும் இல்லை. எனவே அவர்களை அப்புறப்படுத்தவோ, மறு குடியமர்த்துவதோ மறுவாழ்வுக்கான நடவடிக்கைகள் மேற்கொள்ளவோ எந்த அவசியமும் ஏற்படவில்லை. எனவே மறுகுடியமர்விற்கும் மறுவாழ்விற்குமான மாற்றிடம் ஏதும் கண்டறியப்படவில்லை என இதனால் தெரிவிக்கப்படுகிறது.

நில எடுப்பஜ அலுவலர்/ வருவாய் டீகாட்டாட்சியர்இ டிதன் டிசன்னை வருவாய் டீகாட்டம்இ கிண்ழஇ டிசன்னை-32 அலுவலகத்தில் அலுவலக டீநரயு்களில் எப்டீபாது டீவண்டுமானாலும் பார்வையிடலாம்.

Date :04.05.2020 whereas, it appears to the Government that a total of 00 Hectares 22 Ares 60.0 Sq.mts of land is required in the Mylapore Village in Mylapore Taluk in Chennai District for a public purpose, namely, in to convert the land and buildings of former Chief Minister of Tamil Nadu Selvi J Jayalalithaa (late) " Veda Illam " at Poes Garden as Government Memorial.

Now, therefore, a declaration is made hereby that a piece of land measuring 00 Hectares 22 Ares 60.0 Sq.mts is under acquisition for the above said project in the Mylapore Village in Mylapore Taluk in Chennai District whose detailed description is as follows:

This declaration is made after hearing of objections of persons interested and due enquiry as provided under section 15 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013). This project does not involve any displacement of families /relocation. There are no Project Affected Families(PAFs) and hence no question of relocation , resettlement and rehabilitation. Therefore it is declared that no area was identified as "resettlement area for the purpose of rehabilitation and resettlement of the affected families." Mines of coal, iron-stone, slate or other minerals lying under the said land or any particular portion of the said land, except such parts of the mines and minerals which may be required to be dug or removed or used during the construction phase of the project for the purpose of which the land is being acquired, are not needed.

A plan of the land may be inspected in the office of the Land Acquisition Officer and Revenue Divisional Officer, South Chennai Revenue Division, Guindy, Chennai-32 on any working day.

நாள்: 04.05.2020 பொதுத்தேவைக்காக அதாவது தமிழக முன்னாள் முதல்வர் செல்வி ஜெ ஜெயலலிதா (லேட்) அவர்களின் இல்லமான போயஸ் தோட்டத்தில் உள்ள வேதா இல்லத்தினை அரசு நினைவிடமாக மாற்றம் செய்வதற்கு, சென்னை மாவட்டத்தில் மயிலாப்பூர் வட்டத்தில் உள்ள மயிலாப்பூர்; கிராமத்தில் இருக்கும் மொத்த பரப்பளவான 00 ஹெக்டேர் 22 ஏர்ஸ் 60 சதுர மீட்டர் நிலம் தேவைப்படுகிறது என அரசு கருதுவதால், சென்னை மாவட்டத்தில் மயிலாப்பூர் வட்டத்தில் மயிலாப்பூர் கிராமத்தில் மேற்சொன்ன அரசுத் திட்டத்திற்காக கையகப்படுத்துதலின் கீழ் 00 ஹெக்டேர் 22 ஏர்ஸ் 60 சதுர மீட்டர் நிலம் குறித்து விளம்புகை செய்வது குறித்தான விவரங்கள் பின்வருமாறு.

2013 ஆம் ஆண்டு நிலம் கையகப்படுத்துதலில் நியாயமான சரியீடு பெறுவதற்கும் மற்றும் ஒளிவுமறைவின்மைக்கும், மறுவாழ்வு மற்றும் மறுகுடியமர்விற்கான உரிமைச்சட்டத்தின் (மத்திய சட்டம் 30/2013) பிரிவு 15 ஆம் பிரிவின் கீழ் வகை செய்யப்பட்டவாறு பற்றுள்ள நபரின் மறுப்புரைகளைக் கேட்ட பின்னரும் உரிய விசாரணைக்குப் பின்னரும் இந்த விளம்புகை தயாரிக்கப்பட்டுள்ளது. இந்த நில எடுப்பினால் பாதிப்புக்குள்ளாகும் குடும்பங்கள் எதுவும் இல்லை. எனவே அவர்களை அப்புறப்படுத்தவோ, மறு குடியமர்த்துவதோ மறுவாழ்வுக்கான நடவடிக்கைகள் மேற்கொள்ளவோ எந்த அவசியமும் ஏற்படவில்லை. எனவே மறுகுடியமர்விற்கும் மறுவாழ்விற்குமான மாற்றிடம் ஏதும் கண்டறியப்படவில்லை என இதனால் தெரிவிக்கப்படுகிறது.

கையகப்படுத்தப்பட்டுள்ள நிலத்தில் மேற்சொன்ன திட்டத்தின் நோக்கத்திற்காக கட்டுமான நிலையின் போது அத்தகைய நிலப்பரப்பை தோண்டும் போது (அ) அகற்றும் போது அல்லது பயன்படுத்தக்கூடிய சுரங்கங்கள் (அ) கனிமங்கள் நீங்கலாக, மேற்சொன்ன நிலப்பகுதியில் படிந்துள்ள நிலக்கரி, இரும்பு (அ) ஏனைய கனிமங்கள் தேவையில்லை.

யாதொரு வேலை நாட்களிலும் நிலம் கையகப்படுத்தும் அலுவலர் / வருவாய் கோட்டாட்சியர், தென் சென்னை வருவாய் கோட்டம், கிண்டி, சென்னை--32 அலுவலகத்தில் திட்ட வரைபடத்தை பார்வையிடலாம்.
