राज्यपाल, राष्ट्रीय सहबद्ध एवं स्वास्थ्य देख - रेख वृत्ति आयोग अधिनियम , 2021 (2021 का 14) की धारा 68 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उत्तराखण्ड राज्य सहबद्ध और स्वास्थ्य देख - रेख वृत्ति परिषद् के कार्य संचालन हेतु निम्नलिखित नियमावली बनाते हैं: -

अध्याय- 1

सामान्य

संक्षिप्त नाम और प्रारंभ 1. (1 ) इस नियमावली का संक्षिप्त नाम उत्तराखण्ड राज्य सहबद्ध और स्वास्थ्य देख-रेख वृत्ति परिषद् नियमावली , 2025 है ।

(2) यह राजपत्र में प्रकाशन की दिनांक से लागू होगी ।

परिभाषाएँ

(1 ) इस नियमावली में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, 2

(क) " अधिनियम" से राष्ट्रीय सहबद्ध एवं स्वास्थ्य देख- रेख वृत्ति आयोग अधिनियम, 2021 (2021 का 14 ) अभिप्रेत है;

(ख) " अध्यक्ष" से राज्य परिषद् का अध्यक्ष अभिप्रेत है;

(ग) " परिषद्" से अधिनियम की धारा 22 की उपधारा (1 ) के अधीन गठित उत्तराखण्ड राज्य सहबद्ध और स्वास्थ्य देख - रेख वृत्ति परिषद् अभिप्रेत है;

(घ) " प्रपत्र" से इस नियमावली में संलग्न प्रपत्र अभिप्रेत है;

(ङ) " सरकार " से उत्तराखण्ड राज्य की सरकार अभिप्रेत है;

(च) " सदस्य " से राज्य परिषद् के सदस्य अभिप्रेत है;

(छ) " अधिसूचना" से उत्तराखण्ड राज्य सरकार के राजपत्र में प्रकाशित अधिसूचना अभिप्रेत है;

(ज) "सचिव" से अधिनियम की धारा 28 की उपधारा (1 ) के अधीन नियुक्त परिषद् का सचिव अभिप्रेत है;

(झ) "धारा " से अधिनियम की धारा अभिप्रेत है ।

(2) इस नियमावली में प्रयुक्त शब्द और अभिव्यक्तियाँ जो परिभाषित नहीं हैं, किन्तु अधिनियम में परिभाषित हैं, का वही अर्थ होगा जो अधिनियम में इन्हें दिया गया है ।

अध्याय 2

परिषद् का गठन

(1 ) धारा 22 की उपधारा (1 ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सरकार अधिसूचना के माध्यम से परिषद् का गठन करेगी जो उत्तराखण्ड राज्य सहबद्ध एवं स्वास्थ्य देख - रेख वृत्ति परिषद् के नाम से जानी जायेगी जिसमें अध्यक्ष और सात सदस्य होगें ।

(2) परिषद् का मुख्यालय देहरादून मे होगा ।

(3) धारा 22 की उपधारा (3 ) के खण्ड (क) मे संदर्भित योग्यता और अनुभव वाला व्यक्ति परिषद् का अध्यक्ष होगा ।

(4) धारा 22 की उपधारा (3) के खण्ड (ख) से (च) में संदर्भित रीति से परिषद् के सदस्यों की नियुक्ति की जायेगी ।

(5) धारा 22 की उपधारा (3 ) के खण्ड (ङ) और (च) के अधीन नामित सदस्य राज्य सरकार की राय में उत्कृष्ट योग्यता, प्रशासनिक क्षमता और सत्यनिष्ठा वाला व्यक्ति, जिसका नाम राज्य के संबंधित रजिस्टर में 3 उत्तराखण्ड असाधारण गजट, 07 अगस्त, 2025 ई ० (श्रावण 16, 1947 शक सम्वत्)

पंजीकृत है और सहबद्ध एवं स्वास्थ्य देख - रेख वृत्ति के क्षेत्र में प्रतिष्ठित, किसी मान्यता प्राप्त विश्वविद्यालय या संस्थान से सहबद्ध एवं स्वास्थ्य देख- रेख विज्ञान की मान्यता प्राप्त श्रेणी में स्नातकोत्तर उपाधि धारित , सहबद्ध एवं स्वास्थ्य देख- रेख विज्ञान के क्षेत्र में पंद्रह साल के अनुभव वाला व्यक्ति होना चाहिए ।

(6) अध्यक्ष और नामित सदस्य धारा 23 की उपधारा(1 ) में संदर्भित अवधि के लिए नियुक्त किये जाएंगे ।

7) उपनियम (5) में नामित सदस्य चक्रानुक्रम में मान्यता प्राप्त सहबद्ध एवं स्वास्थ्य देख - रेख वृत्ति में से नाम के अनुसार अंग्रेजी वर्णमाला के क्रम मे नियुक्त किये जाएंगे ।

परिषद् के अध्यक्ष का नाम निर्देशन

(1 ) परिषद् का अध्यक्ष, तलाश- सह- चयन समिति की संस्तुति के आधार पर नाम निर्दिष्ट किया जायेगा ।

(2) राज्य सरकार द्वारा गठित तलाश- सह -चयन समिति में निम्नलिखित व्यक्ति होंगे, अर्थात्-

(एक) अपर मुख्य सचिव/ प्रमुख सचिव/ सचिव, चिकित्सा शिक्षा विभाग अध्यक्षः

(दो) कुलपति, हेमवती नन्दन बहुगुणा उत्तराखण्ड चिकित्सा शिक्षा विश्वविद्यालय- सदस्य;

(तीन) एक विशेषज्ञ जिसका स्वयं का उत्तराखण्ड राज्य में न्यूनतम 100 बैड का चिकित्सालय हो - सदस्य;

(चार) एक विशेषज्ञ, उत्तराखण्ड राज्य से बाहर (अखिल भारतीय आयुर्विज्ञान संस्थान) से नाम निर्दिष्ट किया जायेगा-सदस्य;

(पांच) एक विशेषज्ञ, राज्य में स्थित किसी भी राजकीय चिकित्सा महाविद्यालयों में से चक्रानुक्रम में आचार्य संवर्ग से - सदस्यः

(छः) महानिदेशक, चिकित्सा शिक्षा- संयोजक / सदस्य ।

तलाश-सह- चयन

समिति के विशेषज्ञों का नाम निर्देशन

तलाश- सह- चयन समिति के विशेषज्ञों का नाम निर्देशन महानिदेशक , चिकित्सा शिक्षा द्वारा किया जायेगा जो नामों के पैनल को अनुमोदन हेतु चिकित्सा शिक्षा विभाग के मंत्री को प्रेषित करेगा जो (मंत्री) विशेषज्ञों को नामनिर्दिष्ट करने से पूर्वसूची में यथा आवश्यकता संशोधन कर सकेगा ।

6. तलाश- सह- चयन समिति द्वारा परिषद् के अध्यक्ष के नाम निर्दिष्ट करने की प्रक्रिया निम्नानुसार होगी-

परिषद् के अध्यक्ष का नाम निर्दिष्ट करने की प्रक्रिया

(एक) महानिदेशक , चिकित्सा शिक्षा द्वारा कम से कम दो दैनिक समाचार पत्रों ( हिन्दी एवं अंग्रेजी भाषा) में व्यापक प्रकाशन कर और साथ ही साथ वेबसाइट पर अपलोड करके आवेदन पत्र आमंत्रित किये जायेंगे ।

(दो) नियत समय के भीतर प्राप्त आवेदन पत्रों का परीक्षण महानिदेशक , चिकित्सा शिक्षा की अध्यक्षता में गठित तीन सदस्यीय समिति द्वारा वांछित अर्हता धारित करने वाले अभ्यर्थियों को साक्षात्कार हेतु शार्टलिस्ट किया जायेगा ।

(तीन) तलाश- सह- चयन समिति चयन हेतु अपनी स्वयं की कार्यप्रणाली अवधारित करेगी तथा अपनी प्रक्रिया विनियमित करेगी जिससे सुनिश्चित किया जा सके कि चयन पारदर्शी एवं योग्यता आधारित रीति से हो ।

(चार) तलाश- सह- चयन समिति प्रत्येक रिक्ति के लिए पद धारण करने हेतु उपयुक्त कम से कम तीन नामों का एक पैनल तैयार करेगी जिसके साथ एक संक्षिप्त विवरण होगा जिसमें ऐसे पैनल में सम्मिलित प्रत्येक व्यक्ति की शैक्षिक अर्हताएं तथा अन्य विशिष्टताएं दर्शायी जायेगी किन्तु उसमें वरीयता का कोई क्रम नहीं दर्शाया जायेगा । यह पैनल राज्य सरकार के माध्यम से मुख्यमंत्री के अनुमोदन हेतु प्रस्तुत किया जायेगा ।

(पांच ) तलाश- सह - चयन समिति द्वारा किसी व्यक्ति की संस्तुति किये जाने से पूर्व स्वयं यह समाधान कर लिया जायेगा कि ऐसे व्यक्त्ति का कोई ऐसा वित्तीय या अन्य हित नही है , जिससे अध्यक्ष के रूप में उसके कृत्य पर प्रतिकूल प्रभाव पड़ने की सम्भावना हो ।

(छः) कोई नाम निर्देशन , तलाश- सह- चयन समिति में कोई रिक्ति होने अथवा किसी सदस्य के अनुपस्थित होने मात्र से अविधिमान्य नही होगा ।

(सात) मुख्यमंत्री तलाश- सह - चयन समिति द्वारा उनके समक्ष प्रस्तुत नामों के पैनल में से परिषद् के अध्यक्ष का नाम निर्दिष्ट करेंगे ।

(आठ) जहां मुख्यमंत्री तलाश- सह -चयन समिति द्वारा संस्तुत एक या एक से अधिक व्यक्ति को उपयुक्त नही पाते हैं अथवा यदि संस्तुत व्यक्तियों में एक या एक से अधिक व्यक्ति उपलब्ध न हों तो वह समिति से नये नामों की सूची प्रस्तुत करने की अपेक्षा कर सकते हैं ।

5 उत्तराखण्ड असाधारण गजट , 07 अगस्त, 2025 ई० (श्रावण 16, 1947 शक सम्वत्)

(नौ) राज्य सरकार, मृत्यु, त्यागपत्र या पद से हटाये जाने के कारण हुई रिक्ति के दिनांक से तीन माह की अवधि के भीतर अथवा कार्यकाल समाप्त होने के तीन माह पूर्व परिषद् के अध्यक्ष के नाम निर्देशन हेतु तलाश-सह- चयन समिति को निर्दिष्ट करेगी ।

धारा 22 (3 ) खण्ड (ङ) एवं (च) के अधीन परिषद् के सदस्यों का नाम निर्देशन तथा धारा 29(2) के अधीन स्वायत्तशासी बोर्ड के सभापति/ सदस्यों की नियुक्त्ति

(1 ) परिषद् के सदस्यों के नाम निर्देशन तथा स्वायत्तशासी बोर्ड के सभापति एवं सदस्यों की नियुक्त्ति के लिए महानिदेशक , चिकित्सा शिक्षा की अध्यक्षता में गठित तीन सदस्यीय समिति द्वारा प्रत्येक रिक्ति के लिए तीन नामों का पैनल तैयार किया जायेगा और उसे चिकित्सा शिक्षा विभाग के मंत्री को प्रेषित किया जायेगा, जिनके द्वारा पैनल के नामों में यथा आवश्यकता संशोधन किया जा सकेगा ।

(2) महानिदेशक, चिकित्सा शिक्षा पारदर्शी एवं योग्यता आधारित रीति से पैनल तैयार करने हेतु अपनी कार्यप्रणाली अवधारित करेगा तथा अपनी प्रक्रिया स्वयं विनियमित करेगा ।

(3) महानिदेशक, चिकित्सा शिक्षा द्वारा तैयार किये गये नामों के पैनल में ऐसा संक्षिप्त विवरण होगा जिसमें ऐसे पैनल में सम्मिलित प्रत्येक व्यक्ति की शैक्षणिक अर्हताएं तथा अन्य विशिष्टताएं दर्शायी जायेंगी ।

(4) महानिदेशक , चिकित्सा शिक्षा यह सुनिश्चित करेगा कि ऐसा व्यक्ति जिसका नाम पैनल में सम्मिलित है, का ऐसा कोई वित्तीय या अन्य हित न हो जिससे सभापति/ सदस्य के रूप में उसके कृत्य पर प्रतिकूल प्रभाव पड़ने की सम्भावना हो ।

(5) मंत्री, महानिदेशक चिकित्सा शिक्षा द्वारा प्रस्तुत नामों के पैनल में से परिषद् के सदस्यों को नाम निर्दिष्ट करेंगे तथा स्वायत्तशासी बोर्ड के सदस्य की नियुक्त्ति करेंगे ।

(6) राज्य सरकार, मृत्यु, त्यागपत्र या पद से हटाये जाने के कारण हुई किसी रिक्ति के दिनांक से तीन माह के भीतर अथवा कार्यकाल समाप्त होने के तीन माह पूर्व, स्वायत्तशासी बोर्ड / परिषद् के सभापति/ सदस्य की नियुक्ति/ नामनिर्देशन हेतु महानिदेशक, चिकित्सा शिक्षा को निर्दिष्ट करेगी ।

धारा 22(3) (ङ) के अधीन सदस्य की अर्हता

धारा 22 की उपधारा (3 ) के खण्ड (ङ) के अधीन परिषद् का सदस्य उत्कृष्ट योग्यता, सिद्ध प्रशासनिक क्षमता वाला तथा सत्यनिष्ठ व्यक्ति होगा जो किसी विश्वविद्यालय के सहबद्ध और स्वास्थ्य देख- रेख विज्ञान की मान्यता प्राप्त 6 उत्तराखण्ड असाधारण गजट, 07 अगस्त, 2025 ई ० (श्रावण 16, 1947 शक सम्वत्)

श्रेणी में स्नातक अधिमानतः स्नातकोत्तर की उपाधि धारित करता हो और जिसके पास सहबद्ध और स्वास्थ्य देख - रेख विज्ञान में पन्द्रह वर्ष से अन्यून का अनुभव हो, जिसमें से कम से कम पांच वर्ष का अनुभव सहबद्ध और स्वास्थ्य देख - रेख वृत्ति के क्षेत्र में एक नेतृत्वकर्ता के रूप में होः

परन्तु यह कि अनुभव के वर्षों की गणना विज्ञान स्नातक उपाधि पूर्ण होने के पश्चात् की गयी सेवा अवधि के लिए की जायेगी ।

22(3) (च) के

धारा अधीन सदस्य की अर्हता

9. धारा 22 की उपधारा (3) के खण्ड (च) के अधीन परिषद् का सदस्य ऐसा व्यक्त्ति होगा जो अधिमानतः तृतीयक या सुपर स्पेशलिटी अस्पताल सहित स्वास्थ्य देख - रेख प्रणाली में वहनीय स्वास्थ्य सेवा तथा शिक्षा के सीधे परिदान में संलग्न कम से कम पन्द्रह वर्ष से सक्रिय पूर्त संस्थाओं के मध्य से उत्कृष्ट योग्यता, सिद्ध प्रशासनिक क्षमता वाला तथा सत्यनिष्ठ व्यक्ति हो , जिसमें कम से कम पांच वर्ष का अनुभव सहबद्ध और स्वास्थ्य देख - रेख वृत्ति के क्षेत्र में नेतृत्वकर्ता के रूप में होः

परन्तु यह कि 15 वर्ष के अनुभव प्राप्त पात्र व्यक्त्ति न मिलने की दशा में 10 वर्ष के अनुभव प्राप्त व्यक्ति को सदस्य बनाये जाने पर विचार किया जा सकेगाः

परन्तु अग्रेत्तर यह कि किसी संस्थान का प्रतिनिधित्व एक समय में एक से अधिक नाम निर्देशती द्वारा नहीं किया जायेगा ।

स्वायत्तशासी बोर्ड

10. स्वायत्तशासी बोर्ड का सदस्य ऐसा व्यक्ति होगा जो सहबद्ध और स्वास्थ्य देख - रेख विज्ञान की मान्यता प्राप्त श्रेणी की किसी वृत्ति में स्नातकोत्तर उपाधि धारित करता हो और जिसके पास सहबद्ध और स्वास्थ्य देख - रेख क्षेत्र में दस वर्ष से कम का अनुभव न हो , जिसमें से सहबद्ध और स्वास्थ्य देख - रेख वृत्तियों के क्षेत्र में एक नेतृत्वकर्ता के रूप में कम से कम तीन वर्ष का अनुभव हो और उत्कृष्ट योग्यता, सिद्ध प्रशासनिक क्षमता वाला तथा सत्यनिष्ठ हो और जो सम्बधित श्रेणी का रजिस्ट्रीकृत वृत्तिक हो ।

स्वायत्तशासी बोर्ड का गठन

11. (1 ) राज्य परिषद्, अधिसूचना द्वारा, सहबद्ध और स्वास्थ्य देख - रेख वृत्तियों को विनियमित करने के लिए निम्नलिखित स्वायत्तशासी बोर्डों का गठन करेगी , अर्थात्-

(क) अंडर- ग्रेजुएट सहबद्ध और स्वास्थ्य देख - रेख बोर्ड ,

(ख) स्नातकोत्तर सहबद्ध और स्वास्थ्य देख- रेख शिक्षा बोर्ड, (ग) सहबद्ध और स्वास्थ्य देख - रेख वृत्तिक आंकलन और मूल्यांकन बोर्ड, और

(घ) सहबद्ध और स्वास्थ्य देख - रेख वृत्तिक नैतिकता और पंजीकरण बोर्ड ।

7 उत्तराखण्ड असाधारण गजट, 07 अगस्त, 2025 ई ० (श्रावण 16 , 1947 शक सम्वत्)

(2) उपनियम (1 ) के अधीन गठित स्वायत्त बोर्डों में एक सभापति और प्रत्येक मान्यता प्राप्त श्रेणी से उतने सदस्य होंगे जो विनियमों द्वारा निर्दिष्ट किए जाएं तथा जो राज्य सरकार द्वारा नियुक्त किए जाएंगे ।

12. (1 ) अध्यक्ष, राज्य चिकित्सा सेवा चयन बोर्ड के अध्य क्ष/ सभापति के समकक्ष परिलब्धियां और अन्य लाभ पाने का हकदार होगा ।

राज्य स्वास्थ्य सहबद्ध और देख-रेख तथा परिषद् स्वायत्तशासी बोर्ड के अध्यक्ष/ सभापति तथा सदस्य का वेतन और भत्ते

(2) यदि परिषद् का अध्यक्ष केन्द्र सरकार अथवा राज्य सरकार की सेवा में हो , उसका वेतन तथा भत्ते उस पर लागू नियमों के अनुसार विनियमित होंगे । परिषद् में उसका कार्यकाल राज्य सरकार के प्रचलित नियमों के अनुसार प्रतिनियुक्ति पर स्थानांतरण भाना जायेगा ।

(3 ) स्वायत्तशासी बोर्ड एवं परिषद् के सभापति अध्यक्ष एवं सदस्यों को समय समय पर यथाप्रयोज्य नियमों के अनुसार राज्य के वेतन मैट्रिक्स रू 0 1,31,100-2,16,600 लेवल -13 क के समतुल्य यात्रा भत्ते तथा दैनिक भत्ते संदत्त किए जायेंगे ।

(4) अध्यक्ष , सभापति एवं सदस्य परिषद् की होने वाली अधिकतम दो अनिवार्य बैठक हेतु प्रत्येक दिन के लिये रूपया 5000 /- या परिषद् द्वारा समय समय पर यथा विनिश्चित बैठक शुल्क के हकदार होंगे ।

परिषद् के अध्यक्ष एवं सदस्यों की अन्य सेवा शर्ते ।

13. (1 ) परिषद् तथा स्वायत्तशासी बोर्ड के अध्यक्ष तथा सदस्य अपना पदभार ग्रहण करने की दिनांक से दो वर्ष से अनधिक अवधि के लिए पद धारण करेंगे और अधिकतम दो कार्यकाल के लिए पुनः नाम निर्देशन हेतु पात्र होंगे ।

(2) नियमित सरकारी कर्मचारी पर लागू अवकाश नियम, समेकित वेतन पर नियुक्त्त अध्यक्ष पर लागू नहीं होंगे । ऐसा नियुक्त व्यक्ति, एक कैलेण्डर वर्ष में आनुपातिक आधार पर बारह दिन के अवकाश का हकदार होगा ।

(3 ) समेकित वेतन पर नियुक्त व्यक्ति से भिन्न अध्यक्ष के पद पर नामनिर्दिष्ट व्यक्ति के अवकाश तथा अन्य हक, राज्य सरकार के कर्मचारियों हेतु लागू प्रचलित नियमों या मार्गदर्शी सिद्धान्तों के अनुसार होंगे ।

(4) राज्य परिषद् के अध्यक्ष को अवकाश स्वीकृत करने के लिए सक्षम प्राधिकारी राज्य सरकार होगी ।

(5) अध्यक्ष एवं सदस्यगण अपने भत्तो से सम्बंधित देयकों के

संबंध में स्वयं नियंत्रण अधिकारी होंगे ।

(6) परिषद् के अध्यक्ष को , आस्तियों तथा दायित्वों की विवरणी, राज्य सरकार में, समतुल्य स्तर के कर्मचारियों हेतु प्रचलित नियमों या मार्गदर्शी सिद्धान्तों के अनुसार दाखिल करनी होगी ।

(7) अध्यक्ष को अपनी प्रथम नियुक्ति पर तथा पद त्याग के समय इस नियमावली के साथ अनुलग्नक प्रपत्र-1 में दी गयी रीति से अपनी वृत्तिक तथा वाणिज्यिक कार्य स्थिति या सम्बद्धता भी घोषित करनी होगी ।

(8 ) परिषद् के अध्यक्ष/ सदस्य की अधिकतम आयु 65 वर्ष होगी ।

परिषद् से निष्कासन और त्यागपत्र

14. अध्यक्ष / नामित सदस्य / स्वायत्तसाशी बोर्ड के सभापति एवं सदस्य जैसी भी स्थिति हो धारा 24 में संदर्भित रीति से अपने पद से त्यागपत्र दे सकता है या हटाया जा सकता है ।

भरा जाना आकस्मिक रिक्त्तियों का 15. जहां सामान्य क्रम में पद से त्याग पत्र देने या हटाने या मृत्यु के फलस्वरुप परिषद् मे नियुक्त अध्यक्ष या सदस्य जैसी भी स्थिति हो, का पद कार्यकाल समाप्त होने से पूर्व रिक्त हो जाता है तो परिणामिक आकस्मिक रिक्ति सरकार द्वारा धारा 25 की उपधारा (2 ) मे संदर्भित रीति से भरी जायेगी ।

16. परिषद् का कोई भी कार्य या कार्यवाही केवल इस कारण अमान्य नहीं होगीकिः-

रिक्तिया आदि से परिषद् की कार्यवाही आमान्य नही होगी

(क ) परिषद् मे कोई रिक्ति या परिषद् के गठन में कोई त्रुटि है, या

(ख) परिषद् के अध्यक्ष या सदस्य के रुप मे कार्य करने वाले किसी व्यक्ति की नियुक्त्ति मे कोई त्रुटि है, या

(ग) परिषद् की प्रक्रिया में कोई ऐसी अनियमितता है जो मामले की गुण-दोष को प्रभावित नही करती है ।

अध्याय 2

अध्यक्ष और सदस्यों के वेतन, भत्ते तथा सेवा शर्तें

अध्यक्ष द्वारा संपत्ति और वाणिज्यिक भागीदारी की घोषणा

17. (1) अध्यक्ष संपत्ति और देनदारियों की रिटर्न इस तरह फाइल करेगा जैसा सरकार के अपर सचिव स्तर के अधिकारी पर लागू होती है ।

(2 ) अध्यक्ष प्रपत्र-1 में अपनी प्रथम नियुक्ति तथा पद त्याग के समय की वृत्तिक और वाणिज्यिक वचनबद्ध / सम्बद्धता की घोषणा करेगा ।

अवकाश स्वीकृत करने वाला प्राधिकारी

18. (1 ) अध्यक्ष के अवकाश स्वीकृत हेतु सक्षम प्राधिकारी सरकार के अपर मुख्य सचिव / प्रमुख सचिव / सचिव चिकित्सा शिक्षा विभाग होंगे ।

(2) परिषद् के सचिव के अवकाश स्वीकृत हेतु सक्षम प्राधिकारी अध्यक्ष होंगे ।

19.

नामित सदस्य की बैठक में भाग लेने हेतु दैनिक एवं अन्य भत्ता

(1 ) नामित सदस्य परिषद् की बैठक में भाग लेने के लिए पांच हजार प्रतिदिन की दर से दैनिक भत्ते का हकदार होगा।

(2) नामित सदस्य बैठक के स्थान पर आने जाने की यात्रा के लिए सरकार के संयुक्त सचिव स्तर के अधिकारी को अनुमन्य भत्तों के समान यात्रा भत्ता पाने का हकदार होगा।

अध्याय तीन

परिषद् की शक्तियां और बैठक की प्रक्रिया

20.

परिषद् की बैठक की प्रक्रिया

( 1 ) परिषद् की बैठक देहरादून या अध्यक्ष द्वारा निर्धारित किसी उपयुक्त स्थान पर आयोजित की जाएगी ।

(2) परिषद् की एक केलेण्डर वर्ष में कम से कम दो बैठक होगी और दो बैठक के मध्य किसी भी दशा में पांच माह से अधिक का अंतर नहीं होगा ।

(3) परिषद् की बैठक की अध्यक्षता धारा 26 की उपधारा (2) में संदर्भित व्यक्ति द्वारा की जाएगी ।

(4) परिषद् की बैठक की गणपूर्ति अध्यक्ष सहित चार होगी ।

(5) यदि परिषद् की बैठक में किसी समय गणपूर्ति नही है तो बैठक स्वतः आगामी सप्ताह उसी समय, स्थान, दिन के लिए , या यदि उस दिन राष्ट्रीय अवकाश है तब अगले दिन, उसी समय , स्थान पर जब राष्ट्रीय अवकाश नही है, के लिए स्थगित हो जाएगी ।

(6) बैठक का समय , स्थान और कार्य सूची अध्यक्ष द्वारा तय किया जायेगा ।

(7) सचिव, अध्यक्ष के पूर्व अनुमोदन से परिषद् की बैठक आयोजित करेगा ।

(8) बैठक की सूचना कार्यसूची सहित साधारण बैठक के मामले में सात दिन और आवश्यक या विशेष बैठक के मामले में कम से कम तीन दिन पूर्व परिषद् के सदस्यों को रजिस्ट्रीकृत पते पर प्रेषित कर दी जायेगी ।

(9) बैठक की सूचना और कार्यसूची दस्ती या डाक द्वारा या इलेक्ट्रानिक माध्यम से दी जायेगी ।

(10) परिषद् की प्रत्येक बैठक में की गयी प्रक्रिया के कार्यवृत्त सचिव द्वारा तैयार किये जायेगा और अध्यक्ष या अध्यक्षता करने वाले सदस्य द्वारा अनुमोदित और हस्ताक्षरित किया जायेगा ।

(11) उपनियम ( 10) के अधीन हस्ताक्षरित और अनुमोदित कार्यवृत्त की प्रति परिषद् के प्रत्येक सदस्य को सचिव द्वारा उपलब्ध करायी जाएगी ।

(12) अध्यक्ष किसी आवश्यक या विशेष मामले से निपटने के लिए तीन दिन का नोटिस देने के पश्चात् अत्यावश्यक या विशेष बैठक बुला सकेगाः

परन्तु यह कि अत्यावश्यक या विशेष बैठक में उन्हीं विषय /विषयों पर चर्चा होगी जिनके लिए बैठक बुलाई गयी है ।

(13) एक सदस्य जो किसी ऐसे प्रस्ताव को प्रस्तुत करने का आशय रखता है जो परिचालित कार्यसूची में सम्मिलित नहीं है या किसी प्रस्ताव में संशोधन को कार्यसूची में सम्मिलित किया गया है, वह सचिव को अपने आशय की सूचना साधारण बैठक के मामले में कम से कम चार स्पष्ट दिन पूर्व और अत्यावश्यक या विशेष बैठक के मामले में ऐसी बैठक के लिए निर्धारित दिनांक से एक स्पष्ट दिन पूर्व देगा । जिन संशोधनों की सूचना दी गयी है सचिव यथाशीघ्र अध्यक्ष और प्रत्येक सदस्य को उपनियम (9 ) में निर्दिष्ट रीति से उन सभी संशोधनों को उपलब्ध कराएंगेः

परन्तु यह कि अध्यक्ष, लिखित रूप में दर्ज किए जाने वाले कारणों से और बैठक में उपस्थित सभी सदस्यों की सहमति से, किसी प्रस्ताव को भी इस तथ्य के बावजूद अनुमति दे सकता है, उसकी सूचना देर से प्राप्त हुई थी या कोई सूचना नहीं दी गई थी ।

प्रस्ताव की ग्राह्यता 21. (1 ) अध्यक्ष ऐसे किसी प्रस्ताव को अस्वीकृत कर देगा

(क) यदि वह मामला जिससे यह संबंधित है, परिषद् के कार्यों या शक्तियों के दायरे में नहीं है ;

(ख) यदि वह मौलिक रूप से प्रस्ताव या संशोधन के रूप में वही प्रश्न उठाता है , जिसे उस बैठक जिसमें इसे प्रस्तावित किया जाना था, की दिनांक से ठीक पूर्व छह माह के दौरान किसी भी समय परिषद् की अनुमति से पेश या वापस ले लिया गया हो;

(ग) अगर इसमें वितर्क, अनुमान, व्यंग्यात्मक अभिव्यक्ति , लांछन या मानहानिकारक कथन सम्मिलित हैं:

परन्तु यदि किसी प्रस्ताव को संशोधन द्वारा ग्राह्य बनाया जा सकता है तो अध्यक्ष प्रस्ताव को अस्वीकार करने के स्थान पर संशोधित रूप में स्वीकार कर सकता है ।

(2) जब अध्यक्ष ने किसी प्रस्ताव को नामंजूर कर दिया हो तो सचिव ऐसी अस्वीकृति के कारणों को बताते हुए संबंधित सदस्य को सूचित करेंगे ।

22.

सहबद्ध और स्वास्थ्य देख-रेख वृत्ति में विशेष ज्ञान या अनुभव रखने वाले व्यक्ति को आमंत्रित करने के लिए परिषद् की शक्ति

(1 ) परिषद्, यदि आवश्यक समझे , सहबद्ध और स्वास्थ्य देख- रेख वृत्ति में विशेष ज्ञान या अनुभव रखने वाले किसी भी व्यक्ति को अपनी बैठक में आमंत्रित कर सकती है । ऐसे व्यक्ति को विषय पर चर्चा में भाग लेने का अधिकार होगा, किन्तु परिषद् की बैठक में वोट देने का अधिकार नहीं होगा ।

(2) उपनियम (1 ) के अंतर्गत आमंत्रित व्यक्ति बैठक में भाग लेने के लिए ऐसे भत्ते प्राप्त करने के हकदार होंगे जो नियम 19 के अंतर्गत परिषद् के नामित सदस्य के लिए स्वीकार्य हैं ।

परिषद् की शक्तियाँ 23. (1 ) इस नियमावली एवं अधिनियम की धारा 30 के प्रावधानों के अध्यधीन परिषद् अपने मामलों के सामान्य अधीक्षण निर्देशन और नियंत्रण के लिए उत्तरदायी होगी ।

(2) धारा 30 के प्रावधानों के अनुसार, परिषद्-

(क) अपने प्रशासन और कामकाज से संबंधित नीतिगत मामलों पर निर्णय लेगी;

(ख) प्रत्येक वित्तीय वर्ष के लिए अपने वार्षिक खातों और बजट अनुमानों पर विचार करेगी और प्रस्तावों को पारित करेगी;

(ग) अनुसंधान , सेमिनार , सम्मेलनों और कार्यशालाओं के प्रयोजनों के लिए अपने पैसे का निवेश करेगी;

(घ) संस्थान द्वारा वसूले जाने वाले ट्यूशन और अन्य शुल्क हेतु मानदंड और दिशानिर्देश तय करने के लिए सरकार को सिफारिश करेगी;

(ङ) नए संस्थान की स्थापना की योजना, प्रवेश क्षमता में वृद्धि और धारा 40 में संदर्भित नए बैच के प्रवेश को स्वी कृत या अस्वीकृत करेगी;

(च) आयोग द्वारा विनियमों द्वारा निर्दिष्ट शिक्षा के मानकों के कार्यान्वयन की निगरानी करेगी और किसी भी कमी के पाये जाने पर धारा 30 के खंड (क) के प्रावधानों के अनुसार कार्रवाई करेगी;

(छ) सहबद्ध और स्वास्थ्य देख - रेख वृत्तिकों के राज्य रजिस्टर बनाएगी;

(ज) नए सहबद्ध और स्वास्थ्य देख- रेख विषयों के आरम्भ में नवाचार, अनुसंधान और विकास को बढ़ावा देगी , 12

पाठ्यक्रम, पाठ्यचर्या , भौतिक और निर्देशात्मक सुविधाएं, स्टाफ पैटर्न , स्टाफ योग्यता , गुणवत्ता निर्देश, मूल्यांकन , संकाय विकास कार्यक्रम और सतत् सहबद्ध और स्वास्थ्य देख - रेख शिक्षा के लिए मानदंड, मानक और परिषद् के द्वारा उचित समझे जाने वाले अन्य मामले निर्धारित करेगी; और

(झ) किसी भी सहबद्ध और स्वास्थ्य देख - रेख संस्था का निरीक्षण / मूल्यांकन करेगी ।

(3 ) जहां परिषद् धारा 30 के खंड (झ) में निर्दिष्ट प्रावधानों के अनुसार उपनियम (2 ) के खंड (च ) के अंतर्गत कार्रवाई करने का प्रस्ताव करती है , मामला परिषद् की बैठक के समक्ष लाया जाएगा और धारा 26 की उपधारा (3 ) में निर्दिष्ट रीति से निर्णय लिया जाएगा ।

परिषद् के आदेशों और अन्य लिखतों का प्रमाणीकरण

24. परिषद् के सभी आदेशों और निर्णयों और उसके द्वारा जारी किए गए अन्य सभी विलेखों को धारा 54 में निर्दिष्ट सचिव या किसी अन्य अधिकारी के हस्ताक्षर द्वारा प्रमाणित किया जाएगा ।

अध्याय 4

सचिव की नियुक्ति, सेवा की शर्तें और कार्य

सचिव की नियुक्ति के 25 . लिए योग्यताएं और

अनुभव.

सरकार अधिसूचना द्वारा स्वास्थ्य, सहबद्ध और स्वास्थ्य देख - रेख वृत्ति, शैक्षणिक, कानून या प्रशासन के क्षेत्र में केंद्रीय सेवाओं, राज्य सेवाओं, निगम या सार्वजनिक उपक्रम की सेवा में पंद्रह वर्ष का अनुभव रखने वाले प्रतिष्ठित व्यक्तियों को परिषद् का सचिव नियुक्त कर सकती है:

परन्तु यह कि उपरोक्त योग्यता वाले व्यक्ति की अनुपलब्धता की स्थिति में राज्य सरकार सचिव के पद पर प्रतिनियुक्ति के आधार पर संयुक्त सचिव स्तर के किसी अधिकारी को नियुक्त कर सकेगी , किन्तु किसी भी दशा में परिषद् का सचिव उप सचिव से न्यून स्तर का नहीं होगा ।

सचिव के कार्य और कर्तव्य

26. (1 ) सचिव , परिषद् का प्रधान कार्यकारी अधिकारी और प्रशासनिक प्रमुख होगा, अध्यक्ष के समस्त पर्यवेक्षण के अधीन कृत्य करेगा और वह,

(क) परिषद् के निर्देशन और मार्गदर्शन के अधीन शक्तियों का प्रयोग करेंगे,

(ख) परिषद् के मामलों के प्रशासन के लिए उत्तरदायी होगा ,

(ग) परिषद् की सभी गतिविधियों पर समन्वय और सामान्य पर्यवेक्षण का प्रयोग करेगा;

(घ) परिषद् या उसके अधिकारियों या कर्मचारियों द्वारा या उसके विरूद्ध या अन्यथा परिषद् के मामलों से संबंधित किसी भी न्यायालय या अर्ध-न्यायिक प्राधिकरण में वाद, अपील , समीक्षा, पुनर्विलोकन, पुनरीक्षण, रिट याचिका या अन्य कार्यवाही को संस्थित करने, संचालित करने, अंतः क्षेप करने, बचाव करने , परित्याग करने या समझौता करने के लिए सक्षम होगा;

(ङ) परिषद् द्वारा या उसके विरूद्ध किसी भी दावे या मांग को मध्यस्थता के लिए संदर्भित करने और वादी के लिखित बयान पर हस्ताक्षर करने और सत्यापित करने के लिए अधिनिर्णय का निरीक्षण करने और निष्पादित करने के लिए सक्षम होगा ,

(च) वह याचिका, आवेदन, शपथपत्र, आपत्ति, अपील का ज्ञापन या किसी न्यायिक या अर्ध- न्यायिक प्राधिकरण या मध्यस्थ के समक्ष दायर की जाने वाली अन्य दलील देने और वकालतनामा पर हस्ताक्षर करने के लिए सक्षम होगा,

(छ) किसी न्यायिक या अर्द्ध न्यायिक प्राधिकारी के किसी निर्णय को लागू करना या किसी डिक्री या आदेश को निष्पादित करना या उसको संतुष्ट करना और ऐसी डिक्री या आदेश के निष्पादन में किसी भी न्यायालय, व्यक्ति या अन्य प्राधिकरण से धन प्राप्त करना या निकालना;

(ज) ऐसे सामान्य वित्तीय नियमों और मौलिक नियमों के प्रावधानों के अधीन निर्दिष्ट सभी वित्तीय शक्तियों का प्रयोग करेगा जो परिषद् के मामलों के संचालन के लिए लागू होते हैं;

(झ) सरकार या परिषद्, के पूर्व अनुमोदन से परिषद् में जैसा भी मामला हो, सभी नियुक्तियां में सहायता करेगा, प्रशासनिक, तकनीकी और गैर - तकनीकी अधिकारी और कर्मचारी और कर्तव्यों को निर्दिष्ट करेगा;

(ञ) बिक्री, पट्टा, लाइसेंस , बंधक, दृष्टिबंधक , गिरवी, या विधिक स्वरूप के अन्य विलेख के संबंध में अनुबंध , सहयोग करार , सामान्य या विशेष लिखत, सेवा करार या करार में मध्यस्थता खंड, क्षतिपूर्ति बांड और विलेख निष्पादित करेगा;

(ट) कानूनी खर्च उठाना और परिषद् से संबंधित किसी भी मामले में , परिषद् के अभिकर्ता के रूप में कार्य करना;

(ठ) वार्षिक रिपोर्ट और सरकार द्वारा अपेक्षित, ऐसे अन्य विवरण या परिषद् की विवरणियां सरकार को प्रस्तुत करना;

(ड) परिषद् के सदस्य सचिव के रूप में कार्य करेगा और इसके समक्ष ऐसी सभी जानकारी और दस्तावेज रखने के लिए उत्तरदायी होगा जो इसके कार्य के संचालन के लिए आवश्यक हों , अध्यक्ष के परामर्श से इसकी बैठक बुलाना, बैठक बुलाने के लिए नोटिस जारी कर सभी बैठकों के कार्यवृत्त रखना, परिषद् के आधिकारिक पत्राचार का संचालन करना और इसके दस्तावेजों को प्रमाणित करना;

(ढ) परिषद् के अभिलेख (रिकॉर्ड) , सामान्य मुहर, धन तथा संपत्तियों की अभिरक्षा के लिए उत्तरदायी होगा ।

(2) सचिव की लम्बी छुट्टी पर अनुपस्थिति पर , भारत या विदेश में प्रतिनियुक्ति या पद छोड़ने पर, इस नियमावली के प्रावधानों के अधीन कार्यों को करने की व्यवस्था और सचिव के कर्तव्यों की देख - रेख अध्यक्ष द्वारा की जाएगी ।

27.

सचिव के पद के लिए चयन प्रक्रिया

(1 ) सचिव के पद के लिए किसी व्यक्ति के चयन के प्रयोजन के लिए , सरकार एक तलाश - सह - चयन समिति का गठन करेगी जिसमें स्वास्थ्य, सहबद्ध और स्वास्थ्य देख - रेख वृत्ति, शिक्षा, प्रशासन या कानून के क्षेत्र से चुने गए तीन प्रतिष्ठित व्यक्ति सम्मिलित होंगे ।

(2) तलाश- सह- चयन समिति उत्कृष्टता अनुभव तथा क्षमता के आधार पर तीन नामों के एक पैनल की सरकार से सिफारिश करेगी ।

सचिव का वेतन

28. सचिव वेतन मैट्रिक्स रूपया 1,23,100-2,15,900 वेतन लेवल-13 (सातवें वेतन आयोग) के समकक्ष वेतन और अन्य भत्तों का हकदार होगाः

परन्तु यह कि किसी ऐसे व्यक्ति के सचिव के रूप में नियुक्ति के मामले में जो केंद्र सरकार या राज्य सरकार या सार्वजनिक क्षेत्र के उपक्रम के अधीन सेवा से सेवानिवृत्त हो गया है और जो कोई भी सेवानिवृत्ति लाभ प्राप्त कर रहा है या प्राप्त कर चुका है या प्राप्त करने का हकदार हो गया है । अंशदायी भविष्य निधि या सेवानिवृत्ति लाभों के अन्य रूपों में पेंशन या ग्रेच्युटी या नियोक्ता के योगदान के माध्यम से , वेतन को पेंशन की सकल राशि या सेवा ग्रेच्युटी के बराबर पेंशन या अंशदायी भविष्य निधि में नियोक्ता के योगदान या सेवानिवृत्ति के किसी अन्य लाभ, यदि कोई हो, किन्तु सेवानिवृत्ति ग्रेच्युटी के बराबर उसके द्वारा आहरित या आहरित की जाने वाली पेंशन को छोड़कर कम किया जाएगा ।

मंहगाई भत्ता

29. सचिव , वेतन मैट्रिक्स रूपया 1,23,100-2,15,900- वेतन लेवल 13 या उससे ऊपर का वेतन आहरित करने वाले 15 उत्तराखण्ड असाधारण गजट, 07 अगस्त, 2025 ई० (श्रावण 16, 1947 शक सम्वत्)

सरकार के समूह ' क' अधिकारी को अनुमन्य दरों पर अपने वेतन के उपयुक्त मंहगाई भत्ता पाने का हकदार होगा ।

नगर प्रतिपूरक भत्ता

30. सचिव वेतन मैट्रिक्स रूपया 1,23,100-2,15,900- वेतन लेवल 13 या उससे ऊपर के सरकार के श्रेणी ' क' अधिकारी को अनुमन्य वेतन आहरित करने वाली दरों पर अपने वेतन के लिए उपयुक्त नगर प्रतिपूर्ति भत्ता पाने का हकदार होगा ।

सचिव के रूप में नियुक्ति पर मौलिक सेवा से सेवानिवृत्ति

31. (1 ) जहां सचिव के रूप में नियुक्त किया जा रहा व्यक्ति, परिषद् में अपनी नियुक्ति की दिनांक पर, केंद्र सरकार या राज्य सरकार या सार्वजनिक क्षेत्र के उपक्रम के अधीन सेवा में हो , परिषद् में अपनी नियुक्ति से पूर्व ऐसी सेवा से सेवानिवृत्ति लेगा ।

(2) उपनियम (1 ) में निर्दिष्ट ऐसी सेवानिवृत्ति पर, सचिव,

(क) सेवानिवृत्ति से पूर्व उस पर लागू सेवानिवृत्ति के नियमों के उपबंधों के अनुसार पेंशन और ग्रेच्युटी प्राप्त करने का हकदार होगा;

(ख) उसको अर्जित अवकाश को अग्रेनीत करने की अनुमति नहीं दी जाएगी , लेकिन उसकी सेवानिवृत्ति से पूर्व, लागू नियमों के प्रावधानों के अनुसार अवकाश वेतन के बराबर नकद प्राप्त करने का हकदार होगा, यदि कोई हो।

अवकाश की पात्रता 32. (1 ) एक व्यक्ति, परिषद् में सचिव के रूप में नियुक्ति पर निम्नानुसार अवकाश का हकदार होगाः-

(क) सेवा के प्रत्येक पूर्ण कैलेंडर वर्ष के लिए पंद्रह दिनों की दर से अर्जित अवकाश,

(ख) सक्षम चिकित्सा अधिकारी के चिकित्सा प्रमाण पत्र पर या निजी मामलों में अवकाश पर सेवा के प्रत्येक पूर्ण वर्ष के संबंध में बीस दिनों की दर से अर्द्ध वेतन अवकाश हेतु अवकाश तथा अर्जित अवकाश के दौरान स्वीकार्य अवकाश वेतन के आधे के बराबर होगाः

परन्तु यह कि अर्द्ध वेतन पर अवकाश को सचिव के विवेक पर पूर्ण वेतन अवकाश में परिवर्तित किया जा सकता है, यदि इसे चिकित्सा आधार पर लिया जाता है और सक्षम चिकित्सा अधिकारी से चिकित्सा प्रमाण पत्र द्वारा समर्थित है;

(ग) एक कार्यकाल में एक सौ अस्सी दिनों की अधिकतम अवधि तक वेतन और भत्तों के बिना असाधारण अवकाश ।

(2) जहां सचिव परिषद् में अपने अध्यासन के कारण पूर्ण अवकाश का उपभोग करने में असमर्थ है, वहां वह अवकाश खाते में अवकाश की अनुपयोगी अवधि को जोड़ने का हकदार होगा ।

(3) सचिव उपनियम (3) के अधीन अवकाश वेतन पर अनुमन्य मंहगाई भत्ता परिषद् में पद छोड़ने की दिनांक को लागू दरों पर प्राप्त करने का हकदार होगा ।

अवकाश प्राधिकारी

स्वीकृति 33. परिषद् के अध्यक्ष, सचिव को अवकाश स्वीकृत करने के लिए सक्षम प्राधिकारी होंगे ।

यात्रा भत्ता

34. यात्रा के दौरान सचिव, यात्रा भत्ते , दैनिक भत्ते, व्यक्तिगत चीजवस्त के परिवहन तथा अन्य समान प्रकरणों के लिए उसी मान और दरों पर हकदार होगा, जो वेतन बैण्ड-14 या उससे ऊपर वेतन पाने वाले सरकार के समूह ' क' अधिकारी को अनुमन्य है ।

आवास

35. ( 1 ) परिषद् में सचिव के रूप में नियुक्त प्रत्येक व्यक्ति सरकारी आवास के उपयोग के लिए सामान्य पूल आवास के प्रकार का सरकार द्वारा निर्धारित दरों पर किराये के भुगतान पर पात्र होगा जो देहरादून में स्थित सरकार के अपर सचिव के स्तर के अधिकारी के लिए अनुमन्य है ।

(2) जब सचिव को उपनियम ( 1 ) में निर्दिष्ट सामान्य पूल आवास प्रदान नहीं किया जाता है या वह स्वयं इसका उपयोग नहीं करता है , तो उसे प्रत्येक माह प्रचलित राज्य सरकार के नियमों के अनुसार भत्ता दिया जा सकता है ।

(3) जहां सचिव अनुमेय अवधि से अधिक एक आधिकारिक निवास पर अधिभोग कर लेता है , वह अतिरिक्त अनुज्ञप्ति शुल्क या दंडात्मक किराए का भुगतान करने के लिए उत्तरदायी होगा , जैसा भी मामला हो और शासन के अपर सचिव पर लागू नियमों के अनुसार बेदखली के लिए पात्र होगा ।

वाहन की सुविधा 36. सचिव, सरकार के स्टाफ कार नियमावली के अनुसार सरकारी और निजी प्रयोजनों के लिए यात्रा के लिए स्टाफ कार की सुविधा के हकदार होंगे ।

चिकित्सा उपचार की सुविधाएं

37. सचिव और उनके आश्रित परिवार के सदस्य राज्य सरकार स्वास्थ्य योजना के अधीन प्रदान की जाने वाली चिकित्सा उपचार और अस्पताल सुविधाओं के हकदार होंगे ।

अवशिष्ट प्रावधान

38. सचिव की सेवा की शर्तें जिनके लिए इस नियमावली में कोई स्पष्ट प्रावधान विनिर्दिष्ट नहीं है, सरकार के अपर सचिव पर तत्समय लागू आदेश और नियमों द्वारा निर्धारित की जायेगी ।

अध्याय-5

राज्य रजिस्टर में वृत्तिक के नाम का पंजीकरण

वृत्तिक का पंजीकरण 39. (1 ) ( क) धारा 33 की उपधारा (1 ) में निर्दिष्ट शर्तों को पूरा करने वाला और योग्यता रखने वाला कोई भी व्यक्ति राज्य रजिस्टर में अपना नाम दर्ज करा सकता है ;

(ख) आवेदक आवेदन प्रपत्र-2 में आवेदन पत्र भरेगा ।

(2) आवेदक को उपनियम (1 ) में निर्दिष्ट पंजीकरण के लिए दो हजार रुपये शुल्क देना होगा ।

(3) धारा 33 की उपधारा (3) के अधीन पंजीकरण का प्रमाण पत्र प्रपत्र-3 में वृत्तिक को दिया जायेगा ।

(4) धारा 34 के अन्तर्गत पंजीयन का डुप्लीकेट प्रमाण पत्र भी प्रपत्र-2 में जारी किया जायेगा परन्तु 'पंजीकरण प्रमाण पत्र' शब्दों के स्थान पर 'डुप्लीकेट पंजीकरण प्रमाण पत्र' शब्द प्रतिस्थापित किया जायेगा ।

(5) उपनियम (4) के अधीन डुप्लीकेट पंजीकरण प्रमाण पत्र प्राप्त करने के लिए शुल्क एक हजार रुपये होगा ।

(6) धारा 35 की उपधारा ( 1 ) के अधीन पंजीकरण प्रमाण पत्र के नवीनीकरण के लिए शुल्क दो हजार रुपये होगा ।

(7) धारा 35 की की उपधारा (1 ) तथा उपधारा (2) के परन्तुक के अधीन रजिस्टर में नाम की पुनः बहाली हेतु शुल्क दो हजार रुपये होगा ।

(8) किसी भी डिग्री या प्रमाण पत्र या किसी अन्य अर्हता को जोड़ने के लिए , वृत्तिक को प्रपत्र-4 में परिषद् को आवेदन करना होगा और एक बार जोड़ने के लिए एक हजार रुपये शुल्क का भुगतान करना होगा ।

(9) उपनियम (2) के अन्तर्गत पंजीयन शुल्क की राशि,

उपनियम (4 ) के अन्तर्गत डुप्लीकेट पंजीयन प्रमाण पत्र प्राप्त करने का शुल्क, उपनियम (6) के अन्तर्गत नवीनीकरण शुल्क, उपनियम (7) के अन्तर्गत नाम की पुनः बहाली शुल्क उपनियम (8 ) के अधीन किसी डिग्री या प्रमाण पत्र या किसी अन्य अर्हता को जोड़ने के शुल्क का भुगतान परिषद् के पक्ष में या तो उचित रसीद के साथ या नकद में या चेक या बैंक ड्राफ्ट द्वारा या डिजिटल लेनदेन द्वारा किया जाएगा ।

(10 ) पंजीकृत वृत्तिक पंजीयन प्रमाण पत्र में किसी भी प्रकार की विसंगति एवं उसके पश्चात् अपने पते में किसी परिवर्तन की सूचना सचिव को देगा ।

(11 ) पंजीकरण प्रमाण पत्र में कोई जोड़ या परिवर्तन या कांट-छांट नहीं की जायेगी और यदि ऐसा कोई जोड़ या परिवर्तन या कांट- छांट परिषद् की जानकारी में आती है या लायी जाती है, तो वृत्तिक अधिनियमों के प्रावधानों के अधीन दंडित होने के लिए उत्तरदायी होगा ।

मान्यता और प्रवेश के लिए अनुमोदन योजना का

40. (1 ) परिषद् धारा 40 की उपधारा (1 ) में निर्दिष्ट उद्देश्योंके लिए इसे प्रस्तुत की गई योजना को इस नियमावली के अध्याय 3 में निर्दिष्ट प्रक्रिया के अनुसार योजना का अनुमोदन करेगी ।

(2) उपनियम (1 ) के अधीन योजना के अनुमोदन के लिए , परिषद् केंद्र सरकार द्वारा धारा 40 की उपधारा (2 ) के खंड (ख) द्वारा प्रदत्त शक्तियाँ का प्रयोग करते हुए बनाये गये नियम में विहित निर्धारित शुल्क के रूप में शुल्क लेगी ।

अध्याय 6

राज्य सहबद्ध और स्वास्थ्य देख - रेख परिषद् निधि

निधि के प्रयोग की रीति 41. (1 ) परिषद् के पास , अधिनियम और इस नियमावली के प्रावधानों के अधीन, ऐसी राशि खर्च करने की शक्ति होगी जो वह परिषद् को अधिनियम द्वारा प्राधिकृत उद्देश्य और प्रयोजन तथा प्रशासनिक खर्चों को पूरा करने के लिए उचित समझे, ऐसी राशि को परिषद् की निधि से व्यय के रूप में माना जाएगा ।

(2 ) परिषद् के खाते में जमा समस्त धनराशि, जिसे उपनियम (1 ) के अनुसार तत्काल उपयोग में नहीं जाया जा सकता, को-

(क) भारतीय स्टेट बैंक या किसी अन्य अनुसूचित बैंक में जमा कर दिया जायेगा, और

(ख) सरकार की प्रतिभूतियों में निवेश किया जाएगा,

स्पष्टीकरण - इस उपनियम में "अनुसूचित बैंक " का वही अर्थ है जो भारतीय रिजर्व बैंक अधिनियम , 1934 (1934 का 2)

की धारा 2 के खण्ड (ङ) में है ।

आरक्षित निधि

42. परिषद् विद्यमान सुविधाओं या सेवाओं के विस्तार या नई सुविधाओं या सेवाओं का सृजन के प्रयोजनों के लिए या राजस्व में किसी अस्थायी कमी या क्षणिक कारणों से व्यय में वृद्धि के सापेक्ष या अधिनियम के अधीन कार्यों के निर्वहन में किसी भी पंजीकृत व्यक्ति के किसी भी कार्य या कृत्य से उत्पन्न होने वाले किसी दायित्व को पूरा करने के लिए निधि या निधियों के रूप में ऐसी राशि की जैसा कि वह उचित समझे, आरक्षित कर सकेगी ।

ऑनलाइन पोर्टल के माध्यम से रूट की जाने वाली परिषद् की प्राप्तियां

43. परिषद् की सभी प्राप्तियों को राष्ट्रीय सहबद्ध और स्वास्थ्य देख - रेख आयोग के एक ऑनलाइन भुगतान पोर्टल के माध्यम से भेजा जाएगा और धारा 51 की उपधारा (2 ) में निर्दिष्ट रीति से लागू किया जाएगा ।

की तैयारी वार्षिक वित्तीय अनुमानों 44. (1 ) परिषद्, प्रत्येक वित्तीय वर्ष की शुरुआत से पूर्व इसके कार्यक्रम का एक विवरण के साथ- साथ आगामी वित्तीय वर्ष के दौरान गतिविधियों के साथ- साथ वित्तीय अनुमान भी तैयार करेगी ।

(2) उपनियम (1 ) के अंतर्गत तैयार किया गया विवरण , प्रत्येक वित्तीय वर्ष के प्रारंभ होने से कम से कम तीन माह पूर्व, सरकार को अनुमोदन के लिए प्रस्तुत किया जाएगा ।

(3) परिषद् के विवरण और वित्तीय अनुमान सरकार के अनुमोदन से परिषद् द्वारा पुनरीक्षित किये जा सकेंगे ।

का रखरखाव लेखों और अभिलेखों 45. परिषद् उचित लेखों और अन्य प्रासंगिक रिकॉर्ड को बनाए रखेगी और सरकार के वित्तीय नियमों के अनुसार लाभ और हानि खाते और बैलेंस शीट सहित लेखों का वार्षिक विवरण तैयार करेगी ।

अध्याय 7

विविध

करना वार्षिक रिपोर्ट प्रस्तुत 46. धारा 53 के प्रावधानों के अधीन, सरकार द्वारा निर्दिष्ट दिनांक को या उससे पूर्व परिषद् प्रत्येक वर्ष सरकार को वार्षिक रिपोर्ट प्रपत्र-5 में प्रस्तुत करेगी, जिसमें अन्य मामलों के साथ- साथ अधिनियम के प्रावधानों और इस नियमावली के प्रावधानों द्वारा निर्धारित उद्देश्यों की पूर्ति की दिशा में उठाये गये कदम, इसके प्रशासन और कामकाज से संबंधित नीतिगत मामलों पर लिए गए निर्णयों, अनुसंधान , सेमिनारों, सम्मेलनों एवं कार्यशालाओं के प्रयोजनों के लिए अपने निधि और निधि निवेश, शुल्क संरचना के संबंध में सरकार को की गयी अनुशंसा , नवीन संस्थान की स्थापना की योजना की स्वीकृति या अस्वीकृति, प्रवेश क्षमता में वृद्धि, नये बैच के प्रवेश, शिक्षा के बुनियादी मामलों की निगरानी के लिए की गई कार्रवाई , राज्य रजिस्टर में दर्ज या हटाये गये पेशेवरों की संख्या और अधिनियम और इस नियमावली के कार्यान्वयन के लिए की गई अन्य कार्रवाई के संबंध में शासन को की गई संस्तुति सम्मिलित होगी ।

शिकायत करने के लिए सक्षम व्यक्ति

47. धारा 60 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते

हुए, सचिव अधिनियम के प्रावधानों के अधीन किसी भी अपराध के संबंध में परिषद् की ओर से परिवाद करने के लिए सक्षम होगा ।

48. परिषद् सरकार को ऐसी रिपोर्ट, विवरणियां और अन्य जानकारी प्रस्तुत करेगी , जो सरकार द्वारा समय - समय पर अपेक्षित हो ।

विद्यमान फैकल्टी एवं 49. परिषद् हेतु प्रावधान

(1 ) उत्तराखण्ड राज्य में विद्यमान स्टेट मेडिकल फैकल्टी एवं परा चिकित्सा परिषद् को भंग किये जाने अथवा क्रियाशील रहने के सम्बंध में पृथक से दिशानिर्देश जारी किये जायेंगे ।

(2) उत्तराखण्ड राज्य सहबद्ध और स्वास्थ्य देख - रेख परिषद् के कार्यों के सम्पादन हेतु मानव संसाधन की उपलब्धता सुनिश्चित होने तक विद्यमान स्टेट मेडिकल फैकल्टी एवं परा चिकित्सा परिषद् में कार्यरत मानव संसाधन द्वारा ही उत्तराखण्ड राज्य सहबद्ध और स्वास्थ्य देख- रेख परिषद् के कार्यों को सम्पादित किया जायेगा ।

50.

संस्थानों एवं अभ्यर्थियो के पंजीकरण की वैधता

(1) इस नियमावली के लागू होने से पहले पूर्व परिषद् से सम्बद्ध संस्थानों के पंजीकरण , अंतिम पंजीकरण अथवा नवीनीकरण का दिनांक आगे पांच वर्ष तक वैध रहेगी । इन संस्थानों को नये नियमों के अनुसार अपने संस्थानों का उच्चीकरण एक वर्ष के भीतर करना होगा ।

(2) किसी भी संस्थान का पंजीकरण जो इस नियमावली से आच्छादित है, का पंजीकरण केवल पांच वर्ष के लिए मान्य होगा, उसके पश्चात् यथाप्रक्रिया पुनः पंजीकरण कराना होगा ।

(3 ) जो अभ्यर्थी पूर्व परिषद् में पंजीकृत हैं, वे इस नई परिषद् में स्वतः ही पंजीकृत समझे जायेंगे ।

पाठ्यक्रमों में अभ्यर्थियों का प्रवेश

51. किसी भी संस्थान में संबंधित पाठ्यक्रम में अभ्यर्थियों का प्रवेश विभिन्न नियामक संस्थानों / आयोगों एवं सम्बंधित चिकित्सा शिक्षा विश्वविद्यालय से अनुमोदन प्राप्त किये बिना (जहां आवश्यक हो ) , नहीं किया जायेगा ।

अनापत्ति प्रमाण पत्र निर्गत करने हेतु समय सारणी

52. उत्तराखण्ड़ सरकार से अनिवार्यता प्रमाण पत्र/अनापत्ति प्रमाण पत्र आदि निर्गत किये जाने हेतु समय सारणी का निर्धारण चिकित्सा शिक्षा विश्वविद्यालय से समन्वय स्थापित कर चिकित्सा शिक्षा विभाग द्वारा किया जायेगा ।

संशोधन और निरसन की शक्ति

53 . इस नियमावली में संशोधन अथवा इसका निरसन परिषद् की संस्तुति के आधार पर राज्य सरकार द्वारा किया जायेगा ।

अध्यक्ष, सदस्य, अधिकारियों और कर्मचारी का लोक सेवक होना

54. परिषद् के अध्यक्ष , सदस्य , अन्य अधिकारी और कर्मचारी के बारे में जब वे अधिनियम या इस नियमावली के उपबंधों के अनुसरण में कोई कार्य कर रहे हैं या उनका कार्य करना तात्पर्यत है, यह समझा जाएगा कि वे भारतीय न्याय संहिता, 2023 की धारा 2 (32) के अर्थ के अन्तर्गत लोक सेवक हैं ।

सद्भावनापूर्ण की गई कार्यवाही के लिए संरक्षण

कोई वाद या अन्य विधिक कार्यवाही, किसी ऐसी बात के बारे में, जो अधिनियम या इस नियमावली के उपबन्धों के अनुसार सद्भावनापूर्वक की गई है , या की जाने के लिए आशायित है , परिषद् के किसी अधिकारी या कर्मचारी के विरूद्ध संस्थित नहीं की जायेगी । 55.

In pursuance of the provisions of Clause (3 ) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of Notification No. 164/XXVIII ( 6 ) 2025 ( E- 77484 ) , dated August 07, 2025 for general information:

In exercise of the powers conferred by section 68 of the National Commission for Allied and Healthcare Professions Act , 2021 ( 14 of 2021 ) , for work conduct of the Uttarakhand State Council for Allied and Healthcare Professions , the Governor hereby makes the following rules , namely:

The Uttarakhand State Council for Allied and Healthcare Professions

Rules , 2025

CHAPTER - I

General

Short title and 1 . commencement

( 1 ) These rules may be called the Uttarakhand State Council for Allied and Healthcare Professions Rules , 2025 .

(2) It shall come into force on the date of publication in the Official Gazette .

Definitions

2. (1) In these rules , unless the context otherwise requires , -

(a) " Act " means the National Commission for Allied and Healthcare Professions Act , 2021 ( 14 of 2021 ) ;

(b) " Chairperson " means the Chairperson of the State Council ;

(c) " Council " means the Uttarakhand State Council for Allied and Healthcare Professions constituted 27 उत्तराखण्ड असाधारण गजट , 07 अगस्त, 2025 ई ० (श्रावण 16, 1947 शक सम्वत्)

under sub - section ( 1 ) of section 22 of the Act ;

(d) " Form" means the Form annexed to these rules ;

(e) "Government " means the State Government of Uttarakhand :

(f) "Member " means a Member of the State Council ;

(g) "Notification " means a notification published in the Official Gazette of the State of Uttarakhand ;

(h) " Secretary " means the Secretary of the Council appointed under sub - section ( 1 ) of section 28 of the Act;

(i) " Section " means the section of the Act ;

(2) words and expressions used herein and not defined in these rules but defined in the Act shall have the meaning respectively assigned to them in the Act.

CHAPTER - II

ESTABLISHMENT OF UTTARAKHAND ALLIED AND HEALTHCARE COUNCIL

Establishment of Council

(1) In exercise of the powers conferred by sub- section ( 1 ) of section 22 of Act , the Government shall , by notification , establish a Council to be known as the Uttarakhand State Council for Allied and Healthcare Professions consisting of a Chairperson and seven Members .

(2) The Headquarter of the Council shall be at Dehradun .

(3 ) The Chairperson shall be a person having qualifications and experience referred to in clause (a) of sub - section ( 3 ) of section 22 .

(4) Members of the Council shall be appointed in the manner referred to in clauses (b ) to ( f) of sub- section (3 ) of section 22 .

(5) A Member to be nominated under clauses (e ) and (f) of sub- section (3 ) of section 22 shall be the person, in the opinion of the Government , of 28

good ability , administrative capacity and integrity, having his name registered in the register concerned and renown in the field of allied and healthcare profession , possessing a Post Graduate degree in any profession of recognized category of allied and healthcare sciences from any recognized University or Institution with experience of not less than fifteen years in the field of allied and healthcare sciences .

(6) The Chairperson and nominated Members shall be appointed for term referred to in sub - section (1 ) of section 23 .

(7) Members to be nominated under sub rule (5) shall be appointed by rotation from amongst recognized allied and healthcare professions in english alphabetical order .

Nomination of Chairperson of Council

(1 ) The Chairperson of the Council shall be nominated on the recommendation of a Search Cum Selection Committee .

(2) The Search cum selection committee constituted by the State Government shall consist of the following members , namely- ,

( i) Additional Chief Secretary / Principal Secretary /

Secretary Medical Education Department- Chairperson ;

(ii) Vice Chancellor , H.N.B. Uttarakhand Medical Education University- Member ;

(iii ) One specialist who own's minimum 100 bed hospital in Uttarakhand State- Member;

(iv) One specialist shall nominated from outside the Uttarakhand State ( AIIMS )- Member ;

(v) One specialist from State Medical Colleges situated in the State by rotation from Professor Cadre- Member ;

(vi) Director General , Medical Education- Convener /Member ;

Nomination of expert of the Search Selection Committee cum

5. Nomination of expert of the Search cum Selection Committee shall be done by Director General , Medical Education who shall send a panel of names for approval of the Minister of Medical Education who may as necessary amend the list before nominating the experts .

The procedure for nominating Chairman of the Councilby Search cum Selection Committee shall be as follows:

Procedure for 6. nomination of Chairman of the Council

(i ) The Director General , Medical education will invite application through wide publication in at least 02 daily , newspapers ( English & Hindi ) as well as by uploading on their website .

( ii ) The applications received within stipulated time will reviewed by a three member committee headed by the Director General , Medical Education and the candidate who meet the required qualification will be shortlisted for the interview .

( iii) The Search cum Selection Committee for selection shall determine its own methodology and regulate its own procedure so that it is ensured that selection is done in a transparent and merit based manner .

( iv) The Search cum Selection Committee shall prepare a panel of at least three names for every vacancy to be filled, along with a concise statement showing the academic qualification and other distinctions of each of the persons included in such panel but shall not indicate any order of preference . This panel shall be presented to Chief Minister through State Government for approval .

(v) The Search cum Selection Committee shall . before recommending any person , satisfy itself that such person does not have any financial or other interest, which is likely to affect prejudicially his function as Chairperson .

(vi) No nomination shall be invalid merely by reason of any vacancy or absence of a member in the Search cum Selection Committee .

(vii) The Chief Minister shall nominate the Chairperson of the Council , out of the panel of names submitted to him by the Search cum Selection Committee .

(viii) Where the Chief Minister does not consider any one or more of persons recommended by Search cum Selection Committee to be suitable , or if one or more persons recommended is or are not available , he may require the Committee to submit a list of fresh names .

( ix) The State Government shall , within a period of three months from the date of occurrence of vacancy, by reason of death , resignation or removal or within three months before the end of the tenure , make a reference to Search cum Selection Committee for the nomination of the Chairperson of the Council .

7. ( 1 ) A three - member committee , chaired by the Director General of Medical Education , will prepare a panel of three names for each vacancy for the council members and the President and members of the autonomous board . This panel will be sent to the Minister of Medical Education , who may make necessary revisions to the names in the panel .

Nomination of members of the council under clause (e) and (f) of section 22 (3 ) and appointment of President/ member of the Autonomous Board under section 29 (2): -

(2) Director General of Medical Education shall determine its methodology and regulate its own procedure for preparing the panel of names in a transparent and merit based manner .

(3 ) The panel of names prepared by Director General of Medical Education shall consist of concise statement showing the academic qualifications and other distinctions of each person included in such panel .

in the panel , does not have any financial or other interest which is likely to affect prejudicially his function as President/Member .

(5 ) The Minister shall nominate the members of the Council and appoint the Member of the Autonomous Board , out of the panel of names submitted by Director General of Medical Education .

( 6) The State Government shall, within a period of three months from the date of occurrence of vacancy, by reason of death, resignation or removal or within three months before the end of the tenure make a reference to Director General of Medical Education for appointment/nomination of President/member of Autonomous Board/Council .

Qualification of 8. member under section 22 (3 ) ( c)

Member of the Council under clause ( e) of sub- section ( 3 ) of section 22 shall be a person of outstanding ability , proven administrative capacity and integrity. possessing minimum graduate preferably post- graduate degree in any profession of recognized category of allied and healthcare sciences from any University with experience of not less than fifteen years in the field of allied and healthcare sciences , out of which at least five years experience shall be as a leader in the field of allied and healthcare professions:

Provided that for counting experience , number of years of service post completion of Graduation (B.Sc. ) degree shall be counted

Qualification of member under section 22 ( 3 ) ( 1 )

Member of the Council under clause (f) of sub- section (3 ) of section 22 shall be a person having an outstanding ability , proven administrative capacity and integrity from amongst the charitable institutions which have been in operation for at least fifteen years in the healthcare system , preferably with a tertiary or super specialty hospital engaged in direct delivery of 32

Affordable Healthcare Service and Education, in which atleast five year of experience shall be as a leader in the field of Allied and Health Care profession:

Provided that in case an eligible person of 15 years of experience is not available , a person with 10 years of experience may be considered for appointment :

Provided further that no institution shall be represented by more than one nominee at a time .

Autonomous Board

10. The members of Autonomous Board shall be a person possessing Post graduate degree in any profession of recognized category of allied and healthcare science with experience of not less than 10 years in the field . out of which at least three years shall be as a leader in the allied and healthcare professions and having an outstanding ability , proven administrative capacity and integrity and shall be a registered professional of respective category.

11.

Constitution of Autonomous Boards

( 1) The State Council shall , by notification , constitute the following Autonomous Boards for regulating the allied and healthcare professionals , namely ,

( a) Under - graduate Allied and Healthcare Education Board,

( b ) Post -graduate Allied and Healthcare Education Board,

(d) Allied and Healthcare Professions Ethics and Registration Board .

(2) The Autonomous Boards constituted under sub- rule ( 1 ) shall consist of a President and such number of members from each recognised çate- gory as may be specified by the regulations and shall be appointed by the State Government .

12. ( 1 ) The Chairperson shall be entitled to emoluments to and other benefits equivalent Chairperson/President of the state Medical Service Selection Board .

Member of the

Salaries , and Allowances of Chairperson, President and State Allied and Healthcare Council and Autonomous Board

a (2) If the Chairperson of Council is in service of the Central Government or State Government , his salary and allowances shallbe regulated in accordance with the rules applicable to him . His tenure in the Council shall be treated as transfer on deputation . in terms of prevalent rules of the State Government.

(3) The Chairperson , President and Members of the Autonomous Board and Council shall be paid travelling allowances and daily allowances in accordance with the rules as applicable from time to time as equivalent in Level - 13 A in the Pay matrix ( 131100-216600) of the State Government .

(4) The Chairperson , President and members shall also be entitled to a meeting fee of Rs . 5,000/- (Rupees five Thousand only) for each day for a maximum of two mandatory meeting of the council or as decided by the Council from time to time .

13.

Other Conditions of Service Chairperson, Member

( 1) The Chairperson and Member of the Council and Autonomous Board shall hold office for a term not exceeding two years from the date on which they enter upon their office and shall be eligible for re - nomination for a maximum period of two terms .

(2) Leave rules applicable to a regular Government employee will not be applicable to the Chairperson who is appointed on consolidated pay. Such appointee will be entitled to 12 days leave on Pro - rata basis in a calendar year .

(3) Leave and other entitlement of Chairperson other than appointee on consolidated pay, shall be as per prevalent rules or guidelines applicable to the State government employees .

(4) The State Government shall be the authority competent to grant leave to the Chairperson' of State Council .

(5) The Chairperson and members shall be own controlling officer in respect of bills relating to their allowances .

(6) The Chairperson of the council must submit the statement of assets and liabilities in accordance with the rules or guiding principles applicable to employees of the equivalent level in the State Government .

(7) The Chairperson shall also declare their professional and commercial engagement or involvement on their first appointment and at the time of demitting office in Form - 1 of the schedule annexed with these rules .

( 8 ) The maximum age of the Chairperson/ members of the council shall be 65 years .

Resignation and removal from Council

14. The chairman/nominated member President and member of the autonomous body , or any such position , may resign from his office or be removed as per the procedure referred to in Section 24 .

Filling up of casual vacancy

15. Where the office of the Chairperson or a Member , as the case may be , appointed to the Council is vacated before his term of office expires in the normal course due to resignation or removal or death , the resultant casual vacancy shall be filled by the Government in the manner referred to in sub- section (2) of section 25 .

16. No act or proceedings of the Council shall be Vacancies, etc. not to invalidate proceedings of Council

(b) any defect in the appointment of a person acting as a Chairperson or a Member of the Council ; or

CHAPTER - 2

SALARY , ALLOWANCES AND SERVICE CONDITIONS OF CHAIRPERSON AND MEMBER

17 .

Declaration of assets and commercial engagement by Chairperson.-'

( 1 ) The Chairperson shall file a return of assets and liabilities in such manner as is applicable to an officer of the rank of an Additional Secretary to the Government; and

(2) The Chairperson shall also declare his professional and commercial engagement or involvement on his first appointment and at the time of demitting office in Form- 1.

18.

Leave sanctioning authority

(1 ) The Additional Chief Secretary /Principal Secretary/ Secretary Medical Education Department to the Government shall be the authority competent to sanction leave to the Chairperson .

(2) The Chairperson shall be the authority competent to sanction leave to the Secretary of the Council

19. ( 1 ) A nominated Member shall be entitled to a daily allowance at the rate of INR Five thousand per day for attending the meeting of the Council .

(2) A nominated Member shall be entitled to such travelling allowance for his to- and- fro journey to the place of meeting as may be admissible to an officer of the rank of a Joint Secretary to the Government .

CHAPTER - 3

POWERS OF COUNCIL AND PROCEDURE IN ITS MEETINGS

20.

Procedure in Council meetings

( 1 ) The meeting of the Council shall be held at Dehradun or any appropriate place as decided by the Chairperson .

(2) The Council shall meet at least two times in a calendar year and the interval between any two meetings shall not , in any case , be longer than five months .

(3 ) A meeting of the Council shall be presided over by the person referred to in sub- section ( 2) of section 26 .

(4) The quorum for the meeting of the Council shall be four including the Chairperson.

(5) If any time in a meeting of the Council there is no quorum , then , meeting shall automatically stand adjourned to the same day at the same time and place in the next week or if that day is a national holiday , till the next succeeding day, which is not a national holiday , at the same time and place.

(6) The time , place and agenda of meeting shall be decided by the Chairperson .

(7) The Secretary, with the prior approval of the Chairperson , shall convene the meeting of the Council .

(8) The meeting notice along with the agenda shall be delivered at the address of the registered Members at least , seven days before the date of the meeting in the case of ordinary meeting and at least three days before the date of meeting in the case of urgent or special meeting .

(9 ) The meeting notice and the agenda shall be delivered by hand or by post or by electronic means .

meeting of the Council shall be prepared by the Secretary and approved and signed by the Chairperson or the Member presiding at such meeting .

(11 ) A copy of the minutes signed and approved under sub - rule ( 10) shall be made available by the Secretary to each Member of the Council .

( 12) The Chairperson may also call an urgent or special meeting of the Council at any time after giving three days ' notice to deal with any urgent or special matter .

Provided that at an urgent or special meeting, the subject or subjects for the consideration of which the meeting has been convened shall only be discussed .

(13 ) A Member who intend to move any motion not included in the circulated agenda or an amendment to any motion so included in the agenda shall give notice of his intention to the Secretary , not less than four clear days in the case of ordinary meeting and one clear day in the case of urgent or special meeting , before the date fixed for such meeting . The Secretary shall make available the amendments of which notice has been given to the Chairperson and every Member at the earliest in the manner referred to in sub - rule (9) :

Provided that the Chairperson may , for the reasons to be recorded in writing and with the consent of all the Members present in the meeting , allow a motion , notwithstanding the fact that notice thereof was received late or no notice was given.

( 1 ) The Chairperson shall disallow any motion ,

Admissibility of 21. motion

(a) if the matter to which it relates , is not within the scope of the Council's functions or powers;

(b) if it raises substantially the same question as a motion or amendment which has been moved or withdrawn with the leave of the Council at any time during six months immediately preceding the date of the meeting at which it is proposed to be moved;

Provided that if a motion can be made admissible by amendment , the Chairperson may , in lieu of disallowing the motion, admit it in the amended form .

(2) When the Chairperson has disallowed any motion , the Secretary shall inform the concerned Member stating the reasons for such rejection .

22 . (1) The Council may , if it thinks necessary , invite any person having special knowledge or experience in allied and healthcare profession to its meeting . Such person shall have right to take part in the discussion on the subject but shall not have the right to vote in the meeting of the Council .

(2) The person invited under sub -rule ( 1 ) shall be entitled to receive such allowances for attending the meeting as are admissible to a nominated Member of the Council under rule19 .

23.

Powers Council of

( 1 ) Subject to the provisions of section 30 of the Act and these rules , the Council shall be responsible for the general superintendence , direction and control of its affairs .

(2) In pursuance to the provisions of section 30 , the Council shall , -

(a) take decisions on policy matters relating to its administration and working;

(b) consider and pass resolutions on its annual accounts and budget estimates for every financial year ;

(d) recommend to the Government to fix norms and guidelines for tuition and other fees to be charged by the institutions ;

(e) approve or disapprove the scheme of establishment of new institution , increasing admission capacity and admission of a new batch re

ferred to in section 40 ;

(f) monitor implementation of standards of education as specified by regulations by the Commission and on observation of any deficiency take action in accordance with the provisions of clause (a) of section 30 ,

(g) maintain State Register of allied and healthcare professionals .

(h) promote innovation , research and development in the introduction of new allied healthcare disciplines , lay down norms and minimum standards for courses , curriculum , physical and instructional facilities , staff pattern , staff qualifications , quality instructions , assessment , faculty development program and continuing allied and healthcare education and determine other matters deemed to fit as per the council ; and

(i ) inspection/Assessment of any allied and healthcare institution .

(3 ) Where the Council proposes to take action under clause ( g ) of sub- rule (2) in pursuance to the provisions referred to in clause (i) of section 30 , the matter shall be brought before a meeting of the Council and decided in the manner referred to in sub - section (3 ) of section 26.

24. All orders and decisions of, and all other instruments issued by, the Council shall be authenticated by the signature of the Secretary or any other officer referred to in section 54 .

CHAPTER -4

APPOINTMENT , SERVICE CONDITIONS AND FUNCTIONS OF SECRETARY Qualifications and experience for appointment of Secretary

25. The Government may appoint, by notification , a Secretary of the Council from amongst the persons of eminence in the field of health , allied and healthcare profession , academic , law or administration possessing fifteen years ' experience in the Central services , State services , in the service of corporation or public undertaking : Provided that in case of non availability of person with aforesaid qualification the State Government may appoint an officer of the level of Joint Secretary on the basis of deputation basis to the post of Secretary , but in no case the Secretary of the

council shall be below the rank of Deputy Secretary .

Functions and 26. duties Secretary of

( 1 ) The Secretary shall be the Chief Executive Officer and Administration head of the Council , will function under overall supervision of the Chairperson , and he shall-

(a) exercise powers under the direction and guidance of the Council;

(b) be responsible for the administration of the affairs of the Council ;

(d) be competent to institute , conduct , intervene, defend , abandon or compound any suit, appeal , review , revision, writ petition or other proceedings by or against the Council or its officers or employees or otherwise concerning the affairs of the Council in any court or quasi -judicial authority ;

(e) be competent to refer any claim or demand by or against the Council to arbitration and observe and perform the awards , to sign and verify plaint's written statement ;

(f) be competent to make petition , application , affidavit , objection , memorandum of appeal or other pleading to be filed before any judicial or quasi -judicial authority or arbitrator and sign vakalatnama ;

(g) enforce any judgment , execute any decree or order of any judicial or quasi -judicial authority or to satisfy the same and to realise or withdraw moneys from any court , person or other authority in execution of such decree or order ;

(h) exercise all financial powers as specified under the provisions of such General Financial Rules and the Fundamental Rules which are made applicable to the conduct of the affairs of the Council ;

(i) assist in all appointment process of the Council with the prior approval of the Government or the Council , as the case may be , and assign duties to the administrative , technical and non - technical officers and employees ;

(j ) execute contracts , collaboration agreement , general or special instrument , service agreement Or agreement containing arbitration clauses , indemnity bond and deed in respect of or connected with sale , lease , license , mortgage , hypothecation , pledge , or other deed of a legal character ;

(k) incur legal expenses and act as agent of the Council for purpose whatsoever relating to the affairs of the Council ;

(1) submit the annual report and such other statements or returns of the Council to the Government as may be required by that Government ;

(m) function as the Member Secretary of the Council and be responsible for placing before it all such information and documents which may be necessary for transaction of its business, convene its meetings in consultation with its Chairperson ; issue notice for convening meetings , keep minutes of all the meetings , conduct the official correspondence of the Council and authenticate it's documents ;

(n) be responsible for custody of records , common seal , the funds and properties of the Council.

(2) In the absence of the Secretary on long leave , deputation in India or abroad or at the time of laying down office , subject to the provisions of these rules , arrangements to perform the functions and look after the duties of the Secretary shall be made by the Chairperson .

27.

Selection procedure for of post Secretary

( 1 ) For the purposes of selection of a person for the post of the Secretary , the Government shall constitute a Search- cum- Selection Committee comprising of three eminent persons chosen from health, allied and healthcare profession , education , administration or law .

(2) The Search- cum-Selection Committee shall recommend a panel of three persons to the Government on the basis of excellence , experience and competency .

Pay of Secretary 28. The Secretary shall be entitled to pay and other provisions equivalent to pay matrix Rs . 123100- 215900 level - 13 (Seventh Pay Commission) :

Provided that in the case of appointment as a Secretary of a person who has retired from service under the Central Government or a State Government or a public sector undertaking and who is receiving or has received or has become entitled to receive any retirement benefits by way of pension or gratuity or employer's contribution to the contributory provident fund or other forms of retirement benefits , the pay shall be reduced by the gross amount of pension or pension equivalent to service gratuity or employer's contribution to contributory provident fund or any other form of retirement benefits , if any , but excluding pension equivalent to retirement gratuity , drawn or to be drawn by him .

Dearness allowance

29. The Secretary shall be entitled to dearness allowance appropriate to his pay at the rates admissible to Group 'A ' officer of the Government drawing a pay in the pay matrix Rs . 123100-215900 pay level 13 .

City compensatory allowance

30. The Secretary shall be entitled to city compensatory allowance appropriate to his pay at the rates drawing a pay admissible to Group 'A' officer of the Government in the pay matrix Rs . 123100-215900 pay level 13 .

31.

from parent service on Retirement appointment as Secretary

( 1 ) Where the person being appointed as the Secretary is , on the date of his appointment to the Council, in service under the Central Government or a State Government or a Public Sector Undertaking , shall seek retirement from such service before his appointment to the Council .

(2) On such retirement referred to in sub - rule ( 1 ) , the Secretary, -

(a) shall be entitled to receive pension and gratuity in accordance with the provisions of the retirement rules applicable to him prior to his retirement;

(b) shall not be allowed to carry forward his earned leave but shall be entitled to receive cash equivalent to leave salary, if any , in accordance with the provisions of the rules applicable to him prior to his retirement .

Entitlement of 32. leave

( 1 ) A person , on appointment to the Council as the Secretary shall be entitled to leave as follows :

(a) earned leave at the rate of fifteen days for every completed calendar year of service ;

(b) half pay leave on medical certificate from a competent medical officer or on private affairs at the rate of twenty days in respect of each completed year of service and the leave salary for half pay leave equivalent to half of the leave salary admissible during the earned leave:

Provided that leave on half pay can be commuted to full pay leave at the discretion of the Secretary , if it is taken on medical grounds and is supported by a medical certificate from the competent medical officer ;

(c) extra ordinary leave without pay and allowances up to a maximum period of one hundred eighty days in one term of office.

(2) Where the Secretary is unable to enjoy full leave on account of his occupation with the Council , he shall be entitled to add the un - enjoyed period to the leave account .

(3 ) The Secretary shall be entitled to receive the dearness allowance as admissible on the leave salary under sub - rule (3 ) at the rates in force on the date of the relinquishment of the office in the Council.

33. The Chairperson of the Council shall be the authority competent to sanction leave to the Secretary .

Travelling allowance

same scales and the same rates as are admissible to a Group 'A ' officer of the Government drawing a pay in the pay band level 14 or above .

Accommodation 35. ( 1 ) Every person appointed to the Council as the Secretary shall be entitled to the use of an official residence from the general pool accommodation of the type admissible to an officer of the rank of an Additional Secretary to the Government stationed at Dehradun on the payment of the rent at the rates determined by the Government .

(2) When the Secretary is not provided with or does not avail himself of the general pool accommodation referred to in sub - rule ( 1 ) , he may be paid every month an allowance as per the prevailing State Government rules .

(3 ) Where the Secretary occupies an official residence beyond the permissible period he shall be liable to pay additional license fee or penal rent , as the case may be , and liable to eviction in accordance with the rules applicable to the Additional Secretary to the Government .

Facility conveyance

of 36. The Secretary shall be entitled to the facility of staff car for journeys for official and private purposes in accordance with the Staff Car Rules of the Government .

Facilities medical treatment for 37. The Secretary and his dependent family members shall be entitled to medical treatment and hospital facilities as provided in the State Government Health scheme .

Residuary provision

38. The conditions of service of the Secretary for which no express provision is specified in these rules shall be determined by the rules and orders for the time being applicable to an Additional Secretary to the Government .

CHAPTER - 5

REGISTRATION OF NAME OF PROFESSIONALS IN STATE REGISTER Registration of 39 . professionals

( 1 ) ( a) Any person fulfilling conditions and having qualifications referred to in sub- section ( 1 ) of . section 33 may get his name entered in the State Register;

(b) the applicant shall fill the application form as perForm - 2 .

(2) The applicant shall have to pay a fee of rupees two thousand for registration referred to in sub- rule ( 1 ) .

(3 ) The certificate of registration under sub - section (3) of section 33 shall be issued to the professional in Form - 3 .

(4) A duplicate certificate of registration under section 34 shall also be issued in Form - 2 but for the words ' Certificate of Registration ' , the words ' Duplicate Certificate of Registration ' shall be substituted .

(5) For obtaining a duplicate registration certificate under sub - rule (4) the fee shall be rupees one thousand.

(6) For the renewal of a registration certificate under sub - section ( 1 ) of section 35 , the fee shall be rupees two thousand .

(7) For the restoration of name to the register under the proviso to sub- section ( 1 ) and sub section (2) of section 35 , the fee shall be rupees two thousand .

(8) For making any addition of any degree or certificate or any other qualification , the professional shall have to make an application in Form -4 to the Council and pay a fee of rupees one thousand for one time addition .

(9) The amount of registration fee under sub - rule (2) , fee for obtaining a duplicate registration 47 उत्तराखण्ड असाधारण गजट , 07 अगस्त, 2025 ई० (श्रावण 16 , 1947 शक सम्वत्)

certificate under sub - rule (4) , the renewal fee under sub - rule (6) , the restoration of name fee under sub - rule (7) and addition of degree or certificate or any other qualification fee under sub - rule ( 8 ) shall be paid either in cash against a proper receipt or by cheque or bank draft or by digital transaction in favour of the Council .

( 10) The Registered Practitioner shall intimate to the Secretary any discrepancy in the registration certificate and any subsequent change in his address .

( 11) No addition or alteration or erasing shall be made in the registration certificate and if any such addition or alteration or erasing comes to , or brought to , the notice of the Council the Practitioner shall be liable to be punished under the provisions of the Act .

40.

Approval of for scheme recognition and admission

( 1 ) The Council shall approve the scheme submitted to it for the purposes referred to in sub- section ( 1) of section 40 in accordance with the procedure referred to in Chapter 3 of these rules .

(2) For approval of the scheme under sub - rule ( 1 ) , the Council shall charge such fee as may be prescribed by rules made by the Central Government in exercise of the powers conferred by clause ( b) of sub- section (2) of section 40 .

CHAPTER 6 STATE ALLIED AND HEALTHCARE COUNCIL FUND

of 41.

Manner application of Fund

( 1 ) The Council shall have power, subject to the provisions of the Act and these rules , to spend such sums as it thinks fit to cover all administrative expenses of the Council and on objects and for purposes authorized by the Act and such sums shall be treated as expenditure out of the Fund of the Council .

(2) All moneys standing at the credit of the Council which cannot immediately be applied as provided in sub - rule ( 1 ) , shallbe , -

(a) deposited in the State Bank of India or any other Scheduled bank; and (b) invested in the securities of the Government .

Explanation . In this sub- rule " Scheduled bank " has the same meaning as in clause ( e) of section 2 of the Reserve Bank of India Act , 1934 ( 2 of 1934) .

Reserved Fund 42. The Council may set apart such amounts as it thinks fit as a reserve fund or funds for the purposes of expanding existing facilities or services or creating new facilities or services or for the purposes of providing against any termporary decrease of revenue or increase of expenditure from transient causes or for meeting any liability arising out of any act or commission of any registered person discharge of functions under the Act .

Bill Receipts of Council to be routed through online portal

43. All receipts of the Council shall be routed through an online payment portal of the National Allied and Healthcare Commission and applied in the manner referred to in sub- section ( 2) of section 51 .

44.

Preparation of annual financial estimates

( 1 ) The Council shall , before the commencement of each financial year , prepare a statement of the program of its activities during the forthcoming financial year as well as financial estimate in respect thereof.

(2) The statement prepared under sub - rule ( 1 ) shall , not less than three months before the commencement of each financial year , be submitted for approval to the Government .

(3) The statement and the financial estimates of the Council may, with the approval of the Government , be revised by the Council .

45. The Council shall maintain proper accounts and other relevant record and prepare an annual statement of accounts including the profit and loss account and the balance - sheet in accordance with the financial rules of the Government .

CHAPTER -7

MISCELLANEOUS

Submission Annual report

of 46. Subject to the provisions of section 53 , on or before such date as may be specified by the Government , the Council shall submit to the Government every year the annual report in Form - 5 which shall include , among other matters , the steps taken by it towards the fulfillment of objects laid down by the provisions of the Act and these rules indicating the decisions taken on policy matters relating to its administration and working , investment of its moneys and funds for the purposes of research , seminars , conferences , and workshops , recommendation made to the Government regarding fee structure , approval or disapproval of scheme of establishment of new institution , increasing admission capacity and admission of a new batches , action taken to monitor basic standards of education , number of professionals entered in or removed from the State Register and any other action taken for implementation of the provisions of the Act and these rules .

Person competent to make complaint

47. In exercise of the powers conferred by sub - section ( 1 ) of section 60 , the Secretary shall be competent to make a complaint on behalf of the Council with regard to any offence under the provisions of the Act .

Returns and information

48. The Council shall furnish to the Government such reports , returns and other information as the Government may require from time to time .

49.

Provision for existing faculty and council

( 1 ) Separate guidelines shall be issued regarding requisitioning and functioning of the existing State Medical Faculty and Para Medical council in the State of Uttarakhand .

(2) Till the availability of Human resources to perform the function of the Uttarakhand State Allied and Health Care Council shall be performed by the human resources working in the existing State Medical Faculty and Para Medical council .

Validity Registration of candidates and institutions

( 1 ) Before commencement of these rules date of registration , Final Registration or renewal date of institution affiliated to previous council shall be valid further for five years . These institution have to upgrade their institutions within one year as per new rules .

(2) Registration of any institution which are covered by these rules shall be valid for only five years after that as per procedure again registration is to be done .

(3) Those candidate who are registered with previous council shall be deemed to be registered itself with new council .

candidate curriculum in Admission of 51. Admission of candidates in concerned curriculum in any institutions shall not be done without approval (wherever necessary) of different regulatory institution/ commission and related Medical Education University.

Time table for issuing non- objection certificate

52. Determination of time table for issuing no- objection certificate/ compulsory certificate from Uttarakhand Government shall be done be Medical Education Department in coordination with University .

Power of repeal and amendment

53. Repeal of or amendment in these rules shall be done by State Government on the basis of recommendation ofcouncil .

pursuance of any of the provisions of this Act and these rules , to be Public Servant within the meaning of section 2 (32 ) of the Bhartiya Nyaya Sanhita , 2023 .

Protection of action taken in good faith

55. No suit , prosecution or other legal proceeding shall lie against any officer or employee of the Council for anything which is in good faith done or intended to be done under the Act or the rules made thereunder .
