राज्यपाल, " भारत का संविधान " के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके " उत्तराखण्ड, लोक निर्माण विभाग, अधीनस्थ अभियन्त्रण (कनिष्ठ अभियन्ता सिविल, प्राविधिक, विद्युत तथा यांत्रिक) सेवा नियमावली , 2007 " के अग्रेत्तर संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं, अर्थातः-

उत्तराखण्ड, लोक निर्माण विभाग , अधीनस्थ अभियन्त्रण (कनिष्ठ अभियन्ता एवं अपर सहायक अभियन्ता सिविल, प्राविधिक, विद्युत तथा यांत्रिक) सेवा (संशोधन) नियमावली,

संक्षिप्त 1- ( 1 ) इस नियमावली का संक्षिप्त नाम उत्तराखण्ड, लोक निर्माण विभाग अधीनस्थ नाम

अभियन्त्रण (कनिष्ठ अभियन्ता सिविल, प्राविधिक, विद्युत तथा यांत्रिक) सेवा ।

नियम 2-

5 में

। संशोधन

उत्तराखण्ड, लोक निर्माण विभाग , अधीनस्थ अभियन्त्रण (कनिष्ठ अभियन्ता सिविल , प्राविधिक , विद्युत तथा यांत्रिक) सेवा (संशोधन) नियमावली 2007 में स्तम्भ एक में दिये गये विद्यमान नियम-5 (क) (1 ) के स्थान पर स्तम्भ-02 में दिया गया नियम रख दिया जायेगा अर्थात्

स्तम्भ-1 ( विद्यमान नियम)

5 -क( 1) सेवा में कनिष्ठ अभियन्ता (सिविल /विद्युत / यांत्रिक) के पदों पर भर्ती निम्नलिखित स्रोतों से की जायेगी, अर्थातः-

स्तम्भ- II ( एतद्वारा प्रतिस्थापित नियम) 5- क( 1) सेवा में कनिष्ठ अभियन्ता (सिविल /विद्युत / यांत्रिक ) के पदों पर भर्ती निम्नलिखित स्रोतों से की जायेगी, अर्थातः-

(अ) पच्चानवे प्रतिशत लोक सेवा आयोग के माध्यम से सीधी भर्ती द्वारा ।

(ब) पांच प्रतिशत विभाग में मौलिक रुप से नियुक्त समूह 'ग ' के कर्मचारियों , जिन्होनें विभाग से अनुज्ञा प्राप्त करने के पश्चात् अथवा सेवा में आने से पूर्व नियम -8 में विहित अर्हताएं अर्जित की हों और भर्ती वर्ष के प्रथम दिवस को विभाग में दस वर्ष की नियमित सेवा पूर्ण कर ली हो , में से अपने-अपने संवर्ग के स्वीकृत पदों की संख्या के अनुपात में लोक सेवा आयोग के माध्यम से पदोन्नति द्वारा ।

(अ) पच्चानवे प्रतिशत लोक सेवा आयोग के माध्यम से सीधी भर्ती द्वारा । (ब) पांच प्रतिशत विभाग में मौलिक रुप से नियुक्त समूह ' ग' के ऐसे कर्मचारियों, जिन्होनें विभाग से अनुज्ञा प्राप्त करने के पश्चात् अथवा सेवा में आने से पूर्व नियम-8 में विहित अर्हताएं अर्जित की हों और भर्ती वर्ष के प्रथम दिवस को विभाग में दस वर्ष की नियमित सेवा पूर्ण कर ली हो , में से लोक सेवा आयोग के माध्यम से पदोन्नति द्वारा ।

टिप्पणीः-अवर अभियन्ता (सिविल ) के पद पर पदोन्नति के लिए संयुक्त पात्रता सूची निम्नलिखित मानकों के अनुसार तैयार की जायेगी:-

टिप्पणीः-कनिष्ठ अभियन्ता ( सिविल/ विद्युत/ यांत्रिक) के पद पर पदोन्नति के लिए संयुक्त पात्रता सूची निम्नलिखित मानकों के अनुसार तैयार कीजायेगी:-

(एक) ऐसे अभ्यर्थी जिसने पूर्वतर शैक्षणिक सत्र में विहित डिप्लोमा उत्तीर्ण किया है , पात्रता सूची में उच्चतर स्थान पर रखा जायेगाः-

(दो) यदि दो या अधिक अभ्यर्थियों ने विहित डिप्लोमा समान शैक्षणिक सत्र में उत्तीर्ण किया हो तो ऐसा अभ्यर्थी जिसकी मौलिक नियुक्ति का दिनांक उसके संवर्ग में पूर्वतर हो , उसे पात्रता सूची में उच्चतर स्थान पर रखा जायेगा;

(दो) यदि दो या अधिक अभ्यर्थियों ने विहित डिप्लोमा समान शैक्षणिक सत्र में उत्तीर्ण किया हो तो ऐसा अभ्यर्थी जिसकी मौलिक नियुक्ति का दिनांक 1 उसके संवर्ग में पूर्वतर हो , उसे पात्रता सूची में उच्चतर स्थान पर रखा 3 उत्तराखण्ड असाधारण गजट, 06 जनवरी , 2026 ई ० ( पौष 16, 1947 शक सम्वत्)

जायेगाः-

(तीन) यदि दो या अधिक अभ्यर्थियों की मौलिक नियुक्ति का दिनांक भी एक समान हो जाये तो ऐसा अभ्यर्थी जिसकी अधिवर्षता का दिनांक पूर्वतर हो, को पात्रता सूची में उच्चतर स्थान पर रखा जायेगा ।

In exercise of the powers conferred by the proviso to Article 309 of the "Constitution of India " the Governor is pleased to make the following rules with a view to further amend the Uttarakhand Public Works Department , Subordinate Engineering (Junior Engineer, Civil , Technical , Electrical and Mechanical ) , Service Rules , 2007 , namely: -

Short title and 1 .

1. These Rules may be called the Uttarakhand Public Works Department Subordinate Engineering ( Junior Engineer Civil , Technical , Electrical and Mechanical ) Service (Amendment ) Rules , 2025.

2. It shall come into force at once .

In the Uttarakhand Public Works Department Subordinate Engineering ( Junior Engineer Civil, Technical, Electrical and Mechanical ) Service Rules , 2007 , for existing rule 5 (A ) ( I) set out in column- I below, the rule as set out in column- II shall be substituted , namely-

5. ( A) ( I ) The Recruitment to the post of Junior Engineer (Civil/Electrical /Mechanical ) shall be made from the following sources namely:

(a) Ninety five percent by direct recruitment Through the Public Service Commission.

(b) Five percent in ratio of their cadre strength against sanctioned posts , by promotion through the Public Service Commission from amongst such substantively appointed Group ' C' employees of the Department who either after obtaining the permission from the department or prior to coming in service , have acquired the qualification as prescribed in Rule 8 and have completed ten years substantive service in the Department on the first day of the recruitment year .

were ( b) Five percent of the vacancies shall be filled by promotion through the Public Service Commission, from amongst such Group ' C' employees who substantively appointed in the department and who , after obtaining permission from the department, or before joining the department , have acquired the qualifications as prescribed under rule 8 and have completed ten years regular service in the Department on the first day of the recruitment year.

NOTE- The combined eligibility list for promotion on the post of Junior Engineer (Civil) shall be made as per the following norms: -

(i) The candidate who has passed the prescribed Diploma in earlier academic session shall be placed higher in the eligibilitylist.

( i ) The candidate who has passed the prescribed Diploma in earlier academic session shall be placed higher in the eligibility list,

( ii ) If two or more candidate have passed the prescribed Diploma in the same academic session , the candidate whose date of substantive appointment is earlier shallbe placed higher in the eligibility list,

(ii) If two or more candidate have passed the prescribed Diploma in the same academic session , the candidate whose date of substantive appointment in his respective cadre is earlier shallbe placed higher in the eligibility list ,

(iii) If the date of substantive appointment of two or more candidate is also same the candidate whose date of superannuation is earlier shallbe placed higher in the eligibility list.

( iii) If the date of substantive appointment of two or more candidate is also same the candidate whose date of superannuation is earlier shallbe placed higher in the eligibility list .
