संख्या 1/ 186330/VI ( 1 ) /2024- शासन द्वारा सम्यक विचारोपरान्त वाईब्रेन्ट विलेज योजानान्तर्गत सीमान्त गांव जादुंग उत्तरकाशी, उत्तराखण्ड के पर्यटन विकास हेतु होम स्टे कलस्टर के रूप में विकसित करने हेतु योजना एतदद्वारा प्रख्यापित की जाती है ।
वाईब्रेन्ट विलेज योजानान्तर्गत सीमान्त गांव जादुंग उत्तरकाशी के पर्यटन विकास हेतु होम स्टे कलस्टर के रूप में विकसित करने हेतु योजना
हिमालय पर्वत श्रृंखला की तलहटी में स्थित, उत्तर में चीन (तिब्बत) और पूर्व में नेपाल के साथ अंतर्राष्ट्रीय सीमाओं से घीरे उत्तराखण्ड राज्य में नैसर्गिक छटा एवं सांस्कृ तिक विरासत को समेटे हुये अनेकों पर्यटक स्थल एवं गांव अवस्थित है । उत्तरकाशी जनपद का जादुंग गांव भी एक ऐसा ही सीमावर्ती ग्राम है । सीमान्त गांव जादुंग भारत सरकार द्वारा संचालित "वाईब्रेन्ट विलेज" के अन्तर्गत चिन्हित है जिसमें अवस्थापना सम्बन्धित कार्य कराया जाना नितान्त आवश्यक है ।
जादुंग परिचय
जनपद उत्तरकाशी के विकास खण्ड भटवाड़ी में तिब्बत सीमा पर अवस्थित जादुंग गांव एक सीमान्त गांव है, जो गृह मंत्रालय , भारत सरकार की वाईब्रेन्ट विलेज प्रोग्राम में उत्तराखण्ड के अन्तर्गत चिन्हित 51 गांवों में से एक है ।
जादुंग गांव में 1962 से पूर्व ग्रामवासी तिब्बत के साथ ऊन व नमक का व्यापार कर अपनी आजीविका चलाते थे, किन्तु वर्ष 1962 में भारत चीन युद्ध के कारण यह गांव खाली करवाकर जादुंग गांव के निवासियों को हर्षिल (बगोरी ) व डुण्डा गांव में विस्थापित कर दिया गया तब से गांव में गांववासी अध्यासित नही हैं ।

गांव में स्थानीय लोगो के वर्तमान में भी पुराने घर अभी भी क्षतिग्रस्त स्थिति में खंडहर / अवशेष के रूप में विद्यमान हैं । ज्ञातव्य है कि यहां के निवासियों का वर्ष 1962 से पूर्व तिब्बत के साथ व्यापार होने के दृष्टिगत ऐतिहासिक महत्व है । यहां की जलवायु व प्राकृतिक सौंदर्य भी अत्यन्त मनमोहक है ।
जादुंग गांव तिब्बत बॉर्डर से लगभग 30 कि 0मी0 की दूरी पर अवस्थित है तथा जादुंग गांव इनरलाईन एरिया में आता है तथा वर्तमान में जादुंग गांव में प्रवेश हेतु जिला प्रशासन द्वारा इनर लाइन परमिट केवल ग्राम जादुंग के विस्थापित निवासियों एवं सरकारी कर्मियों को ही Day Visit की अनुमति प्रदान की जाती है ।
उल्लेखनीय है कि पर्यटक स्थल नेलांग वैली से जादुंग ग्राम की दूरी लगभग 16 कि०मी० है । यद्यपि नेलांग वैली भी इनर लाइन एरिया में आता है परन्तु यहां तक पर्यटको को प्रवेश हेतु Day Visit हेतु इनरलाईन परमिट उपजिलाधिकारी उत्तरकाशी द्वारा अनुमति दी जाती है ।
उद्देश्य
1. वाईब्रेन्ट विलेज जादुंग में पर्यटन गतिविधियां प्रारम्भ करना ।
2. जादुंग के खण्डहर रूपी भवनों का निर्माण/पुनर्निमाण करना ।
3. गांव के मूल निवासियों को स्वरोजगार के संसाधन उपलब्ध कराते हुए उनकी आर्थिकी को सबल बनाना ।
4. सीमान्त गांव जादूंग में पर्यटकों की आवाजाही होने के फलस्वरूप इसका सुरक्षा एवं सामरिक दृष्टि से भी महत्व होगा ।
चुनौतियां
1. विषम भौगोलिक एवं वातावरणीय परिस्थितियां ।
2. यद्यपि जादुंग गांव तक पक्की मोटर रोड़ उपलब्ध है, परन्तु यात्रा मार्ग पर दो-तीन स्थानों पर लैण्डस्लाईड एवं जादुंग गांव से लगभग 1 किमी० पहले एक-दो स्थानों पर शीतकाल में यात्रा मार्ग पर Snow Avalanche की सम्भावनायें बनी रहती है ।
3. वर्तमान में गांव पूर्ण रूप से खाली है , क्योंकि वर्ष 1962 के भारत चीन युद्ध के कारण यह गांव खाली करवाकर जादुंग गांव के निवासियों को हर्षिल (बगोरी ) व डुण्डा गांव में विस्थापित कर दिया गया था तथा वर्तमान में स्थानीय गांव वासी बगोरी व डुण्डा गांव में निवासरत है ।
4. जादुंग गांव लगभग 12800 फीट (3900 मी0 ) की ऊंचाई पर स्थित होने के कारण सालभर में मात्र 04 महीने (मई- जून एवं सितम्बर-अक्टूबर) में पर्यटकीय गतिविधियों हेतु उपयोगी हो सकता है ।
अवसर
1. वाईब्रेन्ट विलेज योजनान्तर्गत जादुंग गांव का मॉडल विलेज के रूप में विकास ।
2. 1962 में खाली कराये गये कतिपय भवनों का पर्यटकों के उपयोगार्थ निर्माण/पुननिर्माण करवाने एवं गांव के मूल निवासियों को रोजगार के अवसर उपलब्ध कराना ।
3. सीमान्त गांव जादुंग तक सतत् पर्यटन गतिविधियों का विकास ।
4. नये पर्यटक गन्तव्य स्थल का विकास ।

पात्रता
1. आवेदक सीमावर्ती ग्राम जादूंग का विस्थापित निवासी हो ।
2. - आवेदक की जादुंग गांव में राजस्व अभिलेखों में भूमि/ भवन दर्ज हो ।
3. - आवेदक गृह आवास (होमस्टे)/ भवन के निर्माण हेतु विवाद रहित न्यूनतम अपेक्षित भूमि 500 वर्ग फीट का स्वामी हों ।
4. - किसी बैंक अथवा वित्तीय संस्था का व्यक्तिक्रमी / डिफॉल्टर न हो एवं आवेदक को किसी भी न्यायलय द्वारा दिवालिया, पागल अथवा अपराधी घोषित न किया गया हो ।
5. आवेदक के सगे सम्बन्धी के नाम पर राजस्व अभिलेखों में ग्राम जादुंग में भूमि/ भवन दर्ज होने की दशा में यदि भू/ भवन- स्वामी द्वारा आवेदक के पक्ष में भवन/ होमस्टे निर्माण हेतु शपथ पत्र के माध्यम से अपनी अनापत्ति प्रदान की जाती है तो ऐसी दशा में आवेदक को योजना का लाभ अनुमन्य हो सकेगा।
चयन प्रक्रिया
योजना का लाभ प्राप्त करने हेतु जादुंग ग्राम के राजस्व अभिलेखों में दर्ज 8.054 है० भूमि के भू-स्वामियों द्वारा आवेदन किया जा सकेगा । चयन समिति द्वारा निर्धारित समय-सीमा में प्राप्त आवेदन पत्रों पर बैठक आहूत कर चयन की कार्यवाही सम्पन्न करायी जायेगी ।
(क)- चयन एवं क्रियान्वयन तथा अनुश्रवण समिति की संरचनाः-
आवेदकों के चयन एवं योजना के क्रियान्वयन व अनुश्रवण हेतु जनपद स्तर पर निम्नवत् चयन /क्रियान्वयन/ अनुश्रवण समिति का गठन किया जाता है:-

(ख)- चयन एवं कियान्वयन तथा अनुश्रवण समिति के कर्तव्य एवं उत्तरादायित्वः-
1. - समिति जनपद उत्तरकाशी के जादुंग गांव के अर्ह आवेदकों के चयन , योजना की भौतिक प्रगति का क्रियान्वयन व अनुश्रवण करेगी ।
2. - चयन समिति द्वारा आवेदकों का चयन किया जायेगा, जिसमें प्रथम चरण में 06 खंडहर भवनों का विकास/ पुनर्निर्माण कार्य किया जाना ।
3. - चयन समिति प्रत्येक आवेदन पत्र का परीक्षण करेगी और भवन / होम स्टे निर्माण हेतु पूर्व निर्धारित भवन मानचित्र के अनुरूप आवेदकों का चयन करेगी ।
4. - चयन समिति द्वारा भूमि की उपलब्धता एवं साईट की स्थिति व अन्य तथ्यों के आधार पर भवन/ होम स्टे का चयन किया जायेगा, उसी के अनुरूप चयनित कार्यदायी संस्था द्वारा पारम्परिक पहाड़ी शैली के भवन का मानचित्र तैयार किया जायेगा ।

5. - चयनित आवेदकों के खण्डहर रूपी भवन का निर्माण / पुनर्निर्माण कार्य पूर्व निर्धारित भवन मानचित्र /प्लान के अनुरूप उत्तराखण्ड पर्यटन विकास परिषद् द्वारा निर्धारित समयावधि के भीतर निर्माण कार्य पूर्ण कराया जायेगा ।
6. योजनाओं की मासिक भौतिक / वित्तीय प्रगति से उत्तराखण्ड पर्यटन विकास परिषद् मुख्यालय को अवगत कराया जायेगा ।
7. - समिति द्वारा समय - समय पर योजना की सार्थकता एवं उपादेयता को सुनिश्चित करने के उद्देश्य से वर्ष में त्रैमासिक आधार पर प्रत्येक लाभार्थी/ उद्यमी की परियोजना का भौतिक सत्यापन, एवं वाणिज्यिक सफलता का मूल्यांकन किया जायेगा । दुरूपयोग / दुर्विनियोग की अवस्था में, विधिक कार्यवाही सुनिश्चित की जायेगी ।
8. - समिति, उत्तराखण्ड पर्यटन विकास परिषद को निर्माणदायी संस्था को अवमुक्त की गयी धनराशि के उपयोगिता प्रमाण पत्र एवं संस्तुति सहित मांग प्रेषित करेगी ।
9.- जिन प्रकरणों पर समिति निर्णय लेने में असमर्थ हो उन्हें उत्तराखण्ड पर्यटन विकास परिषद्/ शासन को संदर्भित करेगी । आवश्यकता पड़ने पर जिलाधिकारी द्वारा क्षेत्र विशेष की परिस्थितियों तथा आवेदनकर्ताओं की समस्याओं को दृष्टिगत रखते हुये विषय विशेषज्ञों/ सम्बन्धित अधिकारियों को भी बैठक हेतु विशेष आमंत्री के रूप में जिलाधिकारी द्वारा आमंत्रित किया जा सकता है ।
होम स्टे संचालक के कर्तव्य एवं उत्तरदायित्वः-
1.- होम स्टे का बीमा (संचालन अवधि हेतु), फर्नीशिंग, साज- सज्जा, क्राकरी, फर्नीचर एवं अनुरक्षण आदि की व्यवस्था सम्बन्धित संचालन द्वारा स्वयं के संसाधनों से करनी अनिवार्य होगी ।
2. - अतिथियों के खान- पान की व्यवस्था होम स्टे संचालक द्वारा किया जाना अनिवार्य होगा ।
3.- होम स्टे भवन का उचित रख-रखाव एवं विधिवत् संचालन की सम्पूर्ण जिम्मेदारी सम्बन्धित संचालक की होगी ।
4. - होम स्टे संचालक द्वारा पंजीकृत होम स्टे इकाई का उपयोग पर्यटन गतिविधियों के अलावा किसी अन्य व्यावसायिक उद्देश्य के लिए नहीं किया जायेगा ।
5.- होम स्टे संचालक को चयन मानदंड के अनुसार बुनियादी ढांचे और गुणवत्ता मानकों को बनाए रखते हुए निर्धारित नियमों, दिशा निर्देशों का पालन करना होगा ।
6. - लाभार्थी को होम स्टे संचालन हेतु कौशल विकास एवं आतिथ्य सत्कार गतिविधयों के संचालनार्थ प्रशिक्षण प्राप्त करना होगा । निःशुल्क प्रशिक्षण कार्यक्रम प्रदान करने की व्यवस्था पर्यटन विभाग द्वारा करायी जायेगी ।
7.- होम स्टे संचालक को विभाग द्वारा निर्मित होम स्टे का संचालन 10 वर्षों के लिए अनिवार्य होगा । 10 वर्ष के भीतर, इस प्रकार सृजित आस्तियों का न तो निस्तारण किया जायेगा और न ही उसका उपयोग उस प्रयोजन से जिसके लिए दी गयी है, से भिन्न किसी प्रयोजन के लिए किया जायेगा । किसी अन्य प्रयोजन हेतु भवन उपयोग में लाये जाने की दशा में इस भवन के निर्माण पर हुये शासकीय व्यय की धनराशि मय ब्याज सम्बन्धित आवेदक से वसूली जायेगी ।
8. विभाग द्वारा निर्मित भवन में आवश्यक मरम्मत के अलावा भवन की मूल संरचना में किसी भी प्रकार का अतिरिक्त निर्माण अनुमन्य नही होगा ।
उत्तराखण्ड पर्यटन विकास परिषद् के कर्तव्य एवं उत्तरादायित्वः-
1. यह योजना पर्यटन विभाग उत्तराखण्ड द्वारा संचालित की जायेगी ।

2.- योजना में होम स्टे निर्माण हेतु Ecologicaly Sustainable Parameter के अनुरूप भिज्ञ संस्था से डिजायन/ मानचित्र एवं आगणन तैयार कराया जायेगा।
3.- भवन/होम स्टे निर्माण , निर्माण संस्था/ विभाग के निर्धारण , लाभार्थियों के कौशल विकास/ प्रशिक्षण,, एवं Market linking आदि हेतु नोडल विभाग के रूप में कार्य करेगा
4. यथासंभव पारम्परिक वास्तुकला एवं उत्तराखण्डी निर्माण शैली के भवन/ गृह आवास (होमस्टे) का निर्माण करवाया जायेगा ।
5.- होम स्टे निर्माण एवं संचालन हेतु लाभार्थी, निर्माण इकाई एवं उत्तराखण्ड पर्यटन विकास परिषद् के मध्य एक त्रिपक्षीय (Tripartite ) अनुबन्ध निष्पादित कर होम- स्टे निर्माण एवं संचालन कराया जायेगा ।
6. - उत्तराखण्ड पर्यटन विकास द्वारा जिला चयन एवं अनुश्रवण समिति द्वारा की गई संस्तुति के आधार पर लाभार्थियों के गृह आवास (होमस्टे) निर्माण हेतु चरणबद्ध रूप से धनराशि निर्माणदायी संस्था को उपलब्ध करायेगी ।
7. - फैसिलिटेशन एवं मार्केटिंग की व्यवस्था की जायेगी ।
निर्माणदायी संस्था के कृत्य एवं वित्तीय उपादानः-
1. - निर्माण हेतु नामित संस्था / विभाग द्वारा सम्बन्धित लाभार्थी की योजना स्वीकृत होने की तिथि से निर्धारित समयाविधि के भीतर होमस्टे का निर्माण कार्य पूर्ण कराया जायेगा ।
2. - निर्माण संस्था/ विभाग द्वारा पूर्व निर्धारित स्वीकृत भवन मानचित्र/डिजायन एवं आगणन में इंगित विशिष्टियों के अनुसार ही निर्माण किया जायेगा ।
3. निर्माण संस्था / विभाग द्वारा प्रत्येक माह की भौतिक प्रगति जिला चयन समिति एवं उत्तराखण्ड पर्यटन विकास परिषद्, मुख्यालय को उपलब्ध करानी अनिवार्य होगी ।
4. - निर्माण इकाई द्वारा यथासंभव स्थानीय सामग्री/ उत्पादों का प्रयोग निर्माण कार्यों में किया जायेगा ।
गृह आवास (होम-स्टे) विकास / निर्माण हेतु निधि का सृजनः-
पर्यटन विभाग के आय- व्ययक में योजना हेतु एकमुश्त धनराशि का प्राविधान किया जायेगा, जिसका उपयोग चयन समिति द्वारा होम स्टे संचालन हेतु चयनित आवेदकों के होम स्टे निर्माण हेतु किया जायेगा । आय व्ययक की धनराशि निदेशक पर्यटन/ मुख्य कार्यकारी अधिकारी , उत्तराखण्ड पर्यटन विकास परिषद् देहरादून के निवर्तमान पर रखी जायेगी ।
रियायतें/छूट ( Exemptions ) :-
1.- होम स्टे से प्राप्त आय पर प्रथम 03 वर्षों तक SGST की धनराशि की प्रतिपूर्ति विभाग द्वारा की जायेगी ।
2. विद्युत / पानी/ भवन कर आदि जैसे शुल्क/ कर को अव्यवसायिक दरों पर सम्बन्धित विभागों द्वारा वसूला जा सकेगा ।
3. - भवन निर्माण हेतु भू- उपयोग परिवर्तन किये जाने की आवश्यकता नहीं होगी ।
फैसिलिटेशन एवं मार्केटिंग:-
1. - उत्तराखण्ड पर्यटन विकास परिषद् द्वारा पंजीकृत होम स्टे के लिए पृथक से पोर्टल/ वेब- साइट तथा विकसित किया जायेगा, जिसमें होम स्टे से सम्बन्धित समस्त जानकारियां विद्यमान होंगी ।

2. ऑन-लाईन एवं ऑफलाईन व्यवसायिक मार्केटिंग की सुविधा भी निःशुल्क होम स्टे मालिकों को प्रदान की जायेगी ।
3.- होम स्टे संचालन हेतु आवश्यकतानुसार Aggregator की व्यवस्था/ सुविधा लाभार्थी को उपलब्ध कराने में सहयोग प्रदान किया जायेगा ।
4. होम स्टे के फैडरेशन बनवाकर उनके प्रतिनिधियों द्वारा होम स्टे के प्रचार- प्रसार हेतु विभाग द्वारा जिन राष्ट्रीय एवं अन्र्तराष्ट्रीय ट्रैवल मार्टस् में प्रतिभाग किया जाता है, में निःशुल्क प्रतिभाग किये जाने का अवसर प्रदान किया जायेगा ।
5.- पर्यटकों की सुविधार्थ होम स्टे की रेटिंग व्यवस्था होगी जिससे किसी होम स्टे के बारे में पर्यटकों को उनके स्तर की जानकारी के साथ ही होम स्टे मालिकों के मध्य भी प्रतिस्पर्धा की भावना विकसित होगी ।
लेखा परीक्षाः-
इस योजना हेतु शासन से प्राप्त होने वाली धनराशि मुख्य कार्यकारी अधिकारी, उत्तराखण्ड पर्यटन विकास परिषद् के कोषागार स्थित पी०एल०ए० में जमा की जायेगी । योजना की लेखा परीक्षा महालेखाकार, उत्तराखण्ड देहरादून द्वारा की जायेगी ।
राजकीय सहायता के भुगतान की स्वीकृति के समस्त आदेशों की एक प्रति महालेखाकार , उत्तराखण्ड देहरादून, वित (व्यय नियंत्रण) अनुभाग , उत्तराखण्ड शासन, पर्यटन अनुभाग और वित (आय-व्ययक) अनुभाग को पृष्ठांकित की जायेगी ।

संख्या 179929/2024 - राज्यपाल , उत्तर प्रदेश श्री बदरीनाथ तथा श्री केदारनाथ मन्दिर अधिनियम , 1939 (उत्तराखण्ड राज्य में यथाप्रवृत्त) की संगत धारा 26 (2) (घ) द्वारा प्रदत्त शक्ति का प्रयोग तथा इस विषय के विद्यमान समस्त नियमों और आदेशों का अधिक्रमण करते हुए 'श्री बदरीनाथ तथा श्री केदारनाथ मन्दिर सेवा' में नियुक्त व्यक्तियों की भर्ती तथा सेवा शर्ते विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं:-

भाग 1 -सामान्य
1.
संक्षिप्त नाम और प्रारम्भ
(1 ) इस नियमावली का संक्षिप्त नाम श्री बदरीनाथ तथा श्री केदारनाथ मन्दिर सेवा नियमावली , 2023 है। (2) यह तुरन्त प्रवृत्त होगी ।

सेवा की प्रास्थिति
श्री बदरीनाथ तथा श्री केदारनाथ मन्दिर सेवा ऐसी सेवा है , जिसमें समूह 'क' , 'ख', 'ग' एवं 'घ' के पद सम्मिलित हैं ।
परिभाषाएं
3. जब तक कि विषय या संदर्भ में कोई बात प्रतिकूल न हो, इस नियमावली में- 131 उत्तराखण्ड गजट , 17 फरवरी, 2024 ई० (माघ 28, 1945 शक सम्वत्)
भाग 1]
(क ) 'अधिनियम' से उत्तर प्रदेश श्री बदरीनाथ तथा श्री केदारनाथ मन्दिर अधिनियम, 1939 (उत्तराखण्ड राज्य में यथाप्रवृत्त) अभिप्रेत है;
(ख) ' नियुक्त्ति प्राधिकारी' से अध्यक्ष श्री बदरीनाथ तथा श्री केदारनाथ मंदिर समिति अभिप्रेत है;
(ग) 'भारत का नागरिक' से ऐसे व्यक्ति अभिप्रेत है, जो "भारत का संविधान" के भाग- II के अधीन भारत का नागरिक हो या भारत का नागरिक समझा जाए;
(घ) 'समिति' से अधिनियम की धारा 5 के अधीन स्थापित/ गठित श्री बदरीनाथ तथा श्री केदारनाथ मन्दिर समिति अभिप्रेत है;
(ड़) 'संविधान' से "भारत का संविधान" अभिप्रेत है;
(च) 'सरकार " से उत्तराखण्ड राज्य की सरकार अभिप्रेत है:
(छ) ' राज्यपाल ' से उत्तराखण्ड के राज्यपाल अभिप्रेत है;
(ज) 'हिन्दु धर्म' से हिन्दुओं का ऐसा सम्प्रदाय, जो सनातन धर्म को मानते हैं या उसमें विश्वास रखते हैं , अभिप्रेत है;
(झ) 'सेवा का सदस्य' से सेवा के संवर्ग में किसी पद पर हिन्दू धर्म का अनुयायी और इस नियमावली या इस नियमावली के प्रारम्भ होने के पूर्व प्रवृत्त नियमों या इस नियमावली आदेशों के अधीन स्थायी रूप से / मूल पद पर नियुक्त व्यक्ति अभिप्रेत है;
(ञ) 'अध्यक्ष' से अधिनियम की धारा 5 की उपधारा (1 ) के खण्ड (छ) के तहत राज्य सरकार द्वारा नामित श्री बदरीनाथ तथा श्री केदारनाथ मन्दिर समिति के अध्यक्ष अभिप्रेत है;
(ट) 'सेवा' से श्री बदरीनाथ तथा श्री केदारनाथ मन्दिर समिति सेवा अभिप्रेत है;
(ठ) मौलिक नियुक्ति' से सेवा के संवर्ग में किसी पद पर ऐसी नियुक्त्ति अभिप्रेत है, जो तदर्थ नियुक्ति न हो और नियमानुसार चयन के पश्चात् की गयी हो और यदि कोई नियम न हो, तो सरकार द्वारा जारी किये गये कार्यपालक अनुदेशों अथवा अधिनियम की संगत धारा/ निहित प्राविधान द्वारा तत्समय विहित प्रक्रिया के अनुसार की गई हो; तथा
(ड) 'भर्ती का वर्ष' से कैलेण्डर वर्ष के जुलाई के प्रथम दिवस से आरम्भ होने वाली बारह मास की अवधि अभिप्रेत है;
भाग 2-संवर्ग
4.
सेवा संवर्ग
(1) सेवा में कर्मचारियों / अधिकारियों तथा उसमें प्रत्येक श्रेणी के पदों की संख्या उतनी होगी, जो समय- समय पर अधिनियम की 132

संगत धारा / विहित प्रावधान के अनुसार मंदिर समिति द्वारा राज्य सरकार के अनुमोदन से निर्धारित की जाय ।
(2) सेवा में कर्मचारियों/ अधिकारियों तथा उसमें प्रत्येक श्रेणी के पदों की संख्या जब तक कि उप नियम (1 ) के अधीन पारित आदेशो द्वारा परिवर्तन न किया जाय , उतनी होगी जो परिशिष्ट 'क' में दी गयी है:
परन्तु यह कि-
(i) नियुक्त प्राधिकारी किसी खाली पद को रिक्त छोड सकेंगे अथवा राज्यपाल अधिनियम, की संगत धारा / विहित प्रावधानानुसार किसी पद को इस प्रकार प्रास्थागित रख सकेंगे , कि कोई व्यक्ति प्रतिपूर्ति का हक़दार नहीं होगा ।
(ii) अध्यक्ष, मंदिर समिति अधिनियम की संगत धारा/विहित प्रावधानानुसार ऐसे अतिरिक्त स्थायी अथवा अस्थायी पद राज्य सरकार के अनुमोदन से सृजित कर सकते है, जैसा वे उचित समझे । भाग 3-भती

5. सेवा में विभिन्न श्रेणियों के पदों की भर्ती निम्नलिखित स्रोतों से की जायेगीः-

मौलिक रूप से नियुक्त ऐसे मुख्य प्रशासनिक अधिकारी एवं अन्य समकक्ष ग्रेड वेतन के पदों में से जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम एक वर्ष की सेवा पूर्ण कर 133 उत्तराखण्ड गजट , 17 फरवरी , 2024 ई० (माध 28, 1945 शक सम्वत्)

ली हो तथा अधीनस्थ पदों पर कम से कम 25 वर्ष की सेवा पूर्ण की हो, योग्यता, उपयुक्तता एवं अनुभव के आधार पर मन्दिर अधिनियम के प्रावधानों के अनुसार अध्यक्ष, मंदिर समिति के अनुमोदनोपरान्त पदोन्नति द्वारा ।

मौलिक रूप से नियुक्त ऐसे मुख्य प्रशासनिक अधिकारी एवं अन्य समकक्ष ग्रेड वेतन के पदों में से जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम एक वर्ष की सेवा पूर्ण कर ली हो तथा अधीनस्थ पदों पर कम से कम 25 वर्ष की सेवा पूर्ण की हो, योग्यता, उपयुक्तता एवं अनुभव के आधार पर अध्य क्ष, मंदिर समिति के अनुमोदनोपरान्त पदोन्नति द्वारा ।

(घ) लिपिक सेवा संवर्ग-(लिपिक उप सेवा संवर्ग-1 )
1. मुख्य प्रशासनिक अधिकारी मौलिक रूप से नियुक्त ऐसे वरिष्ठ प्रशासनिक अधिकारी जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम 01 वर्ष की सेवा पूर्ण कर ली हो तथा अधीनस्थ पदों पर कम से कम 25 वर्ष की सेवा पूर्ण कर ली हो, मे से अनुपयुक्त अस्वीकार करते हुये ज्येष्ठता के आधार पर पदोन्नति द्वारा ।
2. वरिष्ठ प्रशासनिक अधिकारी मौलिक रूप से नियुक्त ऐसे प्रशासनिक अधिकारी जिन्होने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम 02 वर्ष की सेवा पूर्ण कर ली हो अथवा अधीनस्थ पदों पर कम से कम 20 वर्ष की सेवा पूर्ण कर ली हो, में से अनुपयुक्त को अस्वीकार करते हुये ज्येष्ठता के आधार पर चयन समिति के माध्यम से पदोन्नति द्वारा ।
प्रशासनिक अधिकारी

मौलिक रूप से नियुक्त ऐसे प्रधान सहायक, जिन्होने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम 03 वर्ष की सेवा पूर्ण कर ली हो अथवा अधीनस्थ पदों पर कम से कम 17 वर्षी की सेवा पूर्ण कर ली हो, में से अनुपयुक्त को अस्वीकार करते हुये ज्येष्ठता के आधार पर चयन समिति के माध्यम से पदोन्नति द्वारा ।
प्रधान सहायक
4.
मौलिक रूप से नियुक्त ऐसे वरिष्ठ सहायक, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम 03 वर्ष की सेवा पूर्ण कर ली हो तथा अधीनस्थ पदों पर कम से कम 10 वर्षी की सेवा पूर्ण कर ली हो , में से अनुपयुक्त को अस्वीकार करते हुये ज्येष्ठता के आधार पर चयन समिति के माध्यम से पदोन्नति द्वारा ।
5.
वरिष्ठ सहायक
मौलिक रूप से नियुक्त ऐसे कनिष्ठ सहायक, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम 06 वर्ष की सेवा 134

पूर्ण कर ली हो , में से अनुपयुक्त को अस्वीकार करते हुये ज्येष्ठता के आधार पर चयन समिति के माध्यम से पदोन्नति द्वारा ।
6.
(1 ) 60 प्रतिशत पद सीधी भर्ती/ संविलियन द्वारा ।
कनिष्ठ सहायक / कम्प्यूटर आपरेटर/ डाटा आपरेटर एण्ट्री

(2) समूह 'घ' के ऐसे कर्मचारियों में से , 15 प्रतिशत जो हाईस्कूल की परीक्षा उत्तीर्ण हों तथा 10 प्रतिशत जो इण्टरमीडिएट की परीक्षा उत्तीर्ण हों , पदोन्नति द्वारा भरी जायेगी;
परन्तु यह कि यदि समूह 'घ' में नियमित पात्र कर्मचारी कार्यरत उपलब्ध न हों तो उस सीमा तक लिपिक वर्गीय कर्मचारी वर्ग की निम्नतम श्रेणी में, समूह 'घ' से पदोन्नति हेतु चिन्हित रिक्त पदों को सीधी भर्ती/ संविलियन के माध्यम से भरा जा सकेगा ।
(3) लिपिक संवर्ग के निम्नतम श्रेणी के कुल पदों के 05 प्रतिशत रिक्तियां वाहन चालकों जो हाईस्कूल की परीक्षा अथवा उससे उच्चतर परीक्षा उत्तीर्ण हों, में से पदोन्नति द्वारा ।
परन्तु यह कि यदि वाहन चालकों में नियमित पात्र कर्मचारी कार्यरत उपलब्ध न हों तो उस सीमा तक लिपिक वर्गीय कर्मचारी वर्ग की निम्नतम श्रेणी में , वाहन चालक से पदोन्नति हेतु चिन्हित रिक्त पदों को समूह 'घ' के कर्मचारियों से पदोन्नति द्वारा भरा जा सकेगा ।
(4) 10 प्रतिशत ऐसे सीजनल लिपिकों में से जिन्होंने इस रूप में न्यूनतम 05 वर्ष की सेवा पूर्ण कर ली हो तथा न्यूनतम हाईस्कूल परीक्षा अथवा उसके समकक्ष मान्यता प्राप्त कोई परीक्षा उत्तीर्ण करने की शैक्षिक अर्हता धारित करते हों,
परन्तु यह कि यदि सीजनल लिपिक में नियमित पात्र कर्मचारी कार्यरत उपलब्ध न हों तो उस सीमा तक लिपिक वर्गीय कर्मचारी वर्ग की निम्नतम श्रेणी में, सीजनल लिपिक वर्गीय कर्मचारी वर्ग से पदोन्नति हेतु चिन्हित रिक्त पदों को सीधी भर्ती/ संविलियन द्वारा भरा जा सकेगा ।
टिप्पणीः- लिपिक वर्ग के न्यूनतम पद पर भर्ती हेतु कार्यालय में कार्यरत श्रेणी 'घ' एवं वाहन चालक जो 05 वर्ष की नियमित सेवा पूर्ण कर चुके हों, तथा कार्यालय में कार्यरत ऐंसे सीजनल लिपिक जिनकी 05 वर्ष की सेवा पूर्ण हो गयी हो , पात्रता क्षेत्र में आयेंगे । समूह 'घ' एवं वाहन चालक तथा सीजनल लिपिक से पदोन्नति हेतु, लिपिक वर्ग के पदों पर भर्ती के लिये , आरक्षित रिक्तियों पर चयन, श्रेष्ठता के आधार पर एक साधारण परीक्षा लेकर किया जायेगा । परीक्षा में केवल एक प्रश्नपत्र होगा, जिसमें सामान्य भाग 1]

हिन्दी, सामान्य ज्ञान एवं सामान्य अध्ययन से सम्बन्धित वस्तुनिष्ठ प्रकार के प्रश्न होंगे । लिखित परीक्षा अधिकतम 40 अंक की होगी तथा पात्र कर्मचारी की वार्षिक चरित्र पंजिका हेतु 10 अंक होंगे । चतुर्थ श्रेणी सीजनल लिपिक एवं वाहन चालक पद पर कार्य अनुभव हेतु प्रत्येक वर्ष के लिये 02 अंक दिये जायेंगे तथा कार्य अनुभव के लिये अधिकतम 50 अंक निर्धारित किये जायेंगे । इस प्रकार चयन परीक्षा कुल 100 अकों की होगी ।
उपरोक्त के अतिरिक्त 50 अंकों की हिन्दी टंकण परीक्षा भी ली जायेगी । टंकण परीक्षा में 2400 की-डिप्रेशन प्रति घण्टा की गति से कम टंकण करने वाले अभ्यर्थी अर्ह नहीं होंगी । इस प्रकार चयन परीक्षा कुल 150 अंको की होगी ।
लेखा सेवा संवर्ग
1.
वित्त अधिकारी
राज्य सरकार द्वारा तत्समय विहित यथा प्रकिया के अनुसार नियुक्त।
2. लेखाधिकारी
मौलिक रूप से नियुक्त ऐसे लेखाकार/ कोषाध्यक्ष / खंजाची में से, जिन्होंने भर्ती वर्ष के प्रथम दिवस को इस रूप में 12 वर्ष की सेवा पूर्ण करते हुये, विभागीय परीक्षा, यदि कोई हो, उत्तीर्ण कर ली हो, अनुपयुक्त को अस्वीकार करते हुये ज्येष्ठता के आधार पर पदोन्नति द्वारा ।
3. लेखाकार/कोषाध्यक्ष/ खजांची
मौलिक रूप से नियुक्त ऐसे सहायक लेखाकारों में से, जिन्होंने भर्ती वर्ष के प्रथम दिवस को इस रूप में 07 वर्ष की सेवा पूर्ण करते हुये, विभागीय परीक्षा, यदि कोई हो, उत्तीर्ण कर ली हो. अनुपयुक्त को अस्वीकार करते हुये ज्येष्ठता के आधार पर पदोन्नति द्वारा ।

(1 ) 50 प्रतिशत सीधी भर्ती/ संविलियन द्वारा ।
(2) 50 प्रतिशत मौलिक रूप से नियुक्त ऐसे अवर अभियन्ता में से जिन्होंने भर्ती वर्ष के प्रथम दिवस को इस रूप में 07 वर्ष की सेवा पूर्ण कर ली हो, अनुपयुक्त को अस्वीकार करते हुये ज्येष्ठता के आधार पर पदोन्नति द्वारा ।

1. व्यवस्थापक
(1 ) भारत में मान्यता प्राप्त किसी विश्वविद्यालय से स्नातक की उपाधि प्राप्त की हो, तथा सरकार द्वारा मान्यता प्राप्त किसी संस्था से होटल मैनेजमेन्ट एण्ड कैटरिंग टेक्नोलॉजी में तीन वर्षीय डिप्लोमा धारक हो,
अथवा होटल मैनेजमेन्ट में स्नातक उपाधि नेशनल कॉउन्सिल फॉर होटल मैनेजमेन्ट एण्ड कैटरिंग टेक्नोलॉजी या उससे सम्बद्ध संस्थानों अथवा विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त विश्वविद्यालय से प्राप्त की गई हो, 143 भाग 1 ]

(1 ) सीधी भर्ती के लिये यह आवश्यक है। कि अभ्यर्थी ने उत्तर प्रदेश माध्यमिक शिक्षा परिषद अथवा उत्तराखण्ड विद्यालयी शिक्षा परिषद की इण्टरमीडिएट परीक्षा या सरकार द्वारा उसके समकक्ष घोषित कोई अन्य परीक्षा उर्तीण की हो,

हो, के साथ- साथ हिन्दी आशुलेखन में न्यूनतम गति 80 शब्द प्रति मिनट तथा कम्प्यूटर पर हिन्दी टंकण में 4000 की डिप्रेशन प्रति घंटे की गति प्राप्त करना अनिवार्य होगा ।
अधीनस्थ अभियन्त्रण एवं प्राविधिक उप सेवा संवर्ग
1. सहायक अभियन्ता
सहायक अभियन्ता के पद पर सीधी भर्ती हेतु अभ्यर्थी के पास भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय / संस्थान से सिविल अभियंन्त्रण में स्नातक उपाधि या सरकार द्वारा उसके समकक्ष मान्यता प्राप्त कोई उपाधि।
2. अवर अभियन्ता
कनिष्ठ/ अवर अभियन्ता के पद पर सीधी भर्ती हेतु अभ्यर्थी के पास भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त संस्थान/ पालीटेक्निक द्वारा प्रदत्त सिविल अभियन्त्रण में तीन वर्षीय डिप्लोमा आवश्यक होगा।
3. फोटोग्राफर
(1 ) उत्तर प्रदेश माध्यमिक शिक्षा परिषद अथवा उत्तराखण्ड विद्यालयी शिक्षा परिषद की इण्टरमीडिएट परीक्षा या सरकार द्वारा उसके समकक्ष घोषित कोई अन्य परीक्षा उत्तीर्ण की हो,
(2) छायाचित्र और चलचित्र कैमरा परिचालन में 05 वर्ष का अनुभव और भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय या सरकार द्वारा मान्यता प्राप्त किसी संस्था से छायाचित्र या चलचित्र फोटोग्राफी (मूवी मोशन पिक्चर फोटोग्राफी) में डिप्लोमा या उपाधि,
(3) छायाचित्र या चलचित्र फोटोग्राफी (मूवी मोशन पिक्चर फोटोग्राफी) में एक वर्ष का अनुभव।
4. चालक
(1 ) उत्तर प्रदेश माध्यमिक शिक्षा परिषद अथवा उत्तराखण्ड विद्यालयी शिक्षा परिषद की हाईस्कूल परीक्षा या सरकार द्वारा उसके समकक्ष घोषित कोई अन्य परीक्षा उत्तीर्ण की हो ।

टिप्पणी- यह नियम उन कार्मिकों पर लागू नही होगें, जो इस नियम/नियमावली के प्रभाव में आने से पहले समिति में कार्यरत/सेवारत है ।
अधिमानी अर्हता
9. ऐसे अभ्यर्थी की, जिसने-
(एक) प्रादेशिक सेना में कम से कम दो वर्ष की अवधि तक सेवा की हो या
(दो) राष्ट्रीय कैडेट कोर का 'बी' अथवा 'सी' प्रमाण पत्र प्राप्त किया हो, को अन्य बातें समान होने पर सेवा में भर्ती के सम्बन्ध में अधिमान दिया जायेगा ।
अनिवार्य अर्हता
10. 1. अधिनियम, की संगत धारा/नियमों/निहित प्रावधान के अनुसार होगी ।
2. वह हिन्दू धर्म का अनुयायी हो तथा मन्दिर के प्रभावी रीतियों के अनुसार प्रचलित पूजा पद्धति को मानता हो एवं स्वीकार करता हो।
3. वह उत्तराखण्ड राज्य का मूल/ स्थायी निवासी हो ।
4. राज्य सरकार अथवा स्थानीय प्राधिकरण से पदच्यूत हुआ व्यक्ति अर्नह /अयोग्य होगा ।
5. नैतिक पतन के अपराध के लिये कारावास भुगत चुका व्यक्ति अर्नह/ अयोग्य होगा ।

आयु
11. सीधी भर्ती के लिये अभ्यर्थी की आयु जिस कलेण्डर वर्ष में रिक्तियाँ आयोग या किसी अन्य भर्ती करने वाले प्राधिकारी द्वारा सीधी भर्ती के लिये विज्ञापित की जाती है, उस वर्ष की पहली जुलाई को समय- समय पर यथाविहित न्यूनतम आयु का हो जाना चाहिए और अधिकतम आयु का नहीं होना चाहिए:
परन्तु यह कि अधिनियम, की संगत धारा/नियमों /निहित प्रावधानानुसार समय- समय पर मंदिर समिति/ राज्य सरकार द्वारा अधिसूचित किया जाए , अधिकतम आयु उतनी बढ़ाई जायेगी , जैसा कि विहित किया जाए ।
चरित्र 12. सेवा के किसी पद पर सीधी भर्ती के लिये अभ्यर्थी का चरित्र ऐसा होना चाहिए जिससे वह सरकारी सेवा की नौकरी के लिये सर्वथा उपयुक्त हो । नियुक्ति अधिकारी इस विषय में स्वयं समाधान कर लेगा ।
टिप्पणीः-(1 ) संघ सरकार या राज्य सरकार अथवा संघ सरकार या राज्य सरकार के स्वामित्व में अथवा नियंत्रणाधीन किसी स्थानीय प्राधिकरण या निगम या निकाय द्वारा पदच्युत व्यक्ति सेवा में किसी पद पर नियुक्ति के पात्र नहीं होंगे । नैतिक अधमता के अपराध से सम्बद्ध सिद्धदोष व्यक्ति भी नियुक्ति के पात्र नहीं होंगे ।
वैवाहिक प्रास्थिति
13. ऐसा पुरुष अभ्यर्थी पात्र न होगा जिसकी एक से अधिक पत्नियों जीवित हो या ऐसी महिला अभ्यर्थी जिसके एक से अधिक पति जीवित हों, सेवा में किसी पद पर नियुक्ति के पात्र न होंगेः
परन्तु, यदि सरकार का समाधान हो जाय कि ऐसा करने के लिए विशेष कारण विद्यमान हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से मुक्त कर सकेगी ।
शारीरिक योग्यता
14. किसी भी ऐसे अभ्यर्थी को सेवा में किसी पद पर नियुक्त नहीं किया जायेगा यदि वह मानसिक और शारीरिक रूप से स्वस्थ नहीं है और किसी ऐसे शारीरिक दोष से मुक्त न हो, जिसके कारण उसे अपने कर्त्तव्यों को दक्षतापूर्वक निर्वहन में हस्तक्षेप की संभावना हो । किसी अभ्यर्थी को नियुक्ति के लिये अन्तिम रूप से अनुमोदित किये जाने के पूर्व उससे यह अपेक्षा की जायेगी कि वह वित्तीय हस्त 152

पुस्तिका खण्ड- II भाग- III के अध्याय- III में समाविष्ट मूल नियम-10 के अधीन बनाये गये नियमों के अनुसार स्वस्थता प्रमाण- पत्र प्रस्तुत करेः
परन्तु यह कि दिव्यांगजन अधिकार अधिनियम, 2016 (अधिनियम संख्यांक 49 वर्ष 2016 भारत सरकार) की धारा 33 के क्रम में इस हेतु चिन्हित पदों तथा धारा-34 के अधीन चिन्हित श्रेणियों में दिव्यांगों को नियमानुसार नियुक्ति देने से मना नही किया जायेगाः
परन्तु यह और कि पदोन्नति द्वारा नियुक्त अभ्यर्थी के लिए स्वस्थता प्रमाण -पत्र प्रस्तुत करना अपेक्षित नहीं होगा ।
भाग-5 भर्ती प्रक्रिया
रिक्तियों की अवधारणा
15 नियुक्ति प्राधिकारी वर्ष के दौरान भरी जाने वाले रिक्तियों की संख्या अधिनियम, की संगत धारा/नियम/निहित प्रावधान के अधीन रिक्तियों की संख्या भी अवधारित करेगा और सरकार के माध्यम से भरी जाने वाली रिक्तियों की सूचना सरकार को दी जायेगी ।
भर्ती की प्रक्रिया
16 अधिनियम , की संगत धारा/ नियम / निहित प्रावधान के अनुसार सीधी भर्ती के लिए निम्नवत् प्रकिया लागूहोगी:-
(क) सीधी भर्ती के समूह 'ख' एवं 'ग' से संबंधित पदों पर संविलियन के माध्यम से भर्ती की प्रकिया-
(1) नियुक्त प्राधिकारी विभिन्न पदों पर भर्ती/नियुक्ति के लिए आवेदन पत्र आमंत्रित करेगा । आवेदन पत्र नियत प्रपत्र में दिये जायेंगे ।
(2) प्रवेश पत्र के बिना किसी भी अभ्यर्थी को प्रवेश नहीं दिया जायेगा ।
(3) मंदिर समिति विभिन्न केन्द्रीय / राज्याधीन विभागों के राजकीय कार्यालयों एवं निगमों तथा स्वायत्तशासी संस्थाओं/निकायों में संबंधित पदों हेतु अर्ह/योग्य/ पात्र कार्मिकों को प्रतिनियुक्ति पर सेवा/कार्य हेतु आवेदन/ विज्ञप्ति प्रकाशित करेगी तथा तत्कम में नियुक्त प्राधिकारी / इस निमित्त गठित चयन समिति प्राप्त आवेदन पत्रों की संवीक्षा/ परिनिरीक्षण करेगी और ऐसे अभ्यर्थियों को, जो इस नियमावली के अधीन भर्ती/ नियुक्ति के योग्य हों, को यथा नियम/ प्रकिया के अनुसार प्रथमतः प्रतिनियुक्ति पर तैनाती/नियुक्ति प्रदान की जायेगी ।

(4) विभिन्न पदों पर प्रतिनियुक्ति पर तैनात कार्मिकों की 01. वर्ष की संतोषजनक सेवा के उपरान्त समिति इच्छुक / योग्य कार्मिकों की मंदिर समिति की सेवा में संविलयन किये जाने हेतु बनाये गये संविलियन नियमावली में निर्धारित/ विहित/प्रकिया / सेवा-शर्तों के अनुसार/ कम में संबंधित पद/ सेवा पर कार्मिक का संविलयन किया जायेगा ।
(ख ) सीजनल लिपिक/ सीजनल चतुर्थ श्रेणी के समस्त पद एवं समूह- घ से संबंधित समस्त सामान्य पदों पर सीधी भर्ती के माध्यम से भर्ती की प्रकिया-
(1 ) नियुक्त प्राधिकारी विभिन्न पदों पर भर्ती/नियुक्ति के लिए आवेदन पत्र आमंत्रित करेगा । आवेदन पत्र नियत प्रपत्र में दिये जायेंगे ।
(2) प्रवेश पत्र के बिना किसी भी अभ्यर्थी को प्रवेश नहीं दिया जायेगा ।
(3) समूह-घ के पदों पर सीधी भर्ती से चयन निम्नांकित सिद्धान्तों के आधार पर आधारित होगी-सीधी भर्ती से चयन अभ्यर्थी द्वारा प्राप्त शैक्षिक योग्यता, अनुभव इत्यादि के लिए निर्धारित गुणवत्ता अंकों के आधार पर श्रेष्ठता क्रमानुसार किया जायेगा, जो निम्नानुसार होगा-

पदोन्नति द्वारा भर्ती
की प्रक्रिया
(1 ) पदोन्नति द्वारा भर्ती अधिनियम, की संगत धारा / निहित प्राविधान/सरकार द्वारा समय - समय पर विहित प्रक्रिया के अनुसार गठित निम्नलिखित रूप से गठित चयन समिति के माध्यम से की जायेगी गठन निम्नवत् किया जायेगाः-
अध्यक्ष (एक)नियुक्ति प्राधिकारी-
(दो) अध्यक्ष द्वारा राज्य सरकार के नियमों के अनुसार श्रेणी का कोई राजपत्रित अधिकारी का नाम जायेगा- सदस्य संबंधित/ चिन्हित निर्दिष्ट किया

(तीन) मुख्य कार्याधिकारी-
सदस्य
(चार) विशेष कार्याधिकारी/वित्त अधिकारी-
( 2) नियुक्ति प्राधिकारी ज्येष्ठता के क्रम में पात्र अभ्यर्थियों की एक सूची तैयार करेगा और उसे उनकी चरित्र पंजिकाओं और उनसे संबंधित ऐसे अन्य अभिलेखों के साथ , जो उचित समझे जायें, चयन समिति के समक्ष प्रस्तुत करेगा ।
(3) चयन समिति, उपनियम (2) में निर्दिष्ट अभिलेखों के आधार पर, अभ्यर्थियों का साक्षात्कार कर सकेगी ।
(4) चयन समिति चयनित अभ्यर्थियों की एक सूची तत्समय प्रवृत्त सरकार के आदेशों के अनुसार तैयार करेगी और उसे नियुक्ति प्राधिकारी को अग्रसारित करेगी;
परन्तु यह कि उपनियम (2) के अधीन या इस नियम के अधीन पात्रता सूची तैयार करते समय, जहां चयन भिन्न-भिन्न पोषक संवर्गों से किया जाना हो वहाँ;
(क) भिन्न-भिन्न वेतनमानों के संबंध में उच्चतर वेतनमान वाले संवर्ग के अभ्यर्थियों को पात्रता सूची में ऊपर रखा जायेगा ।
(ख) समान वेतनमानों के संबंध में पात्रता सूची में अभ्यर्थियों के नाम उनके अपने-अपने संवर्गों में मौलिक नियुक्ति के दिनांक के क्रम में रखे जायेंगे ।
संयुक्त चयन सूची 18. यदि किसी वर्ष नियुक्त्ति सीधी भर्ती और पदोन्नति दोनों प्रकार से की जाती है तो संगत सूचियों से नाम लेकर एक संयुक्त चयन सूची इस प्रकार तैयार की जायेगी जिससे विहित प्रतिशत बना रहे । सूची में पहला नाम पदोन्नति द्वारा नियुक्त व्यक्ति का होगा ।
भाग-6 नियुक्ति, परिवीक्षा, स्थायीकरण, ज्येष्ठता
19.
नियुक्ति
(1) उपनियम (2) के उपबन्धों के अधीन रहते हुए नियुक्त्ति प्राधिकारी. अभ्यर्थियों के नामों को उसी क्रम में, जिसमें उनके नाम यथास्थिति भाग 1 ]

नियम 15, 16, 17 एवं 18 के अधीन तैयार की गयी सूची में आये हो, नियुक्त करेगा।
(2) जहाँ भर्ती के किसी वर्ष में नियुक्तियाँ सीधी भर्ती और पदोन्नति दोनों प्रकार से की जानी हो, वहाँ नियमित नियुक्तियाँ तब तक नहीं की जायेगी जब तक दोनों स्रोतों से चयन न कर लिया जाय , और नियम-18 के अनुसार एक संयुक्त चयन सूची तैयार न कर ली जाय ।
(3) यदि किसी एक चयन के संबंध में नियुक्ति के एक से अधिक आदेश जारी किये जाय तो एक संयुक्त आदेश भी जारी किया जायेगा जिसमें चयनित व्यक्तियों के नामों का उल्लेख चयन में अवधारित ज्येष्ठता के क्रम में किया जायेगा । जैसा कि यथास्थित, चयन में अवधारित की जाय, या जैसी कि उस संवर्ग में हो, जिससे उन्हें पदोन्नत किया जाय ।
यदि नियुक्तियों सीधी भर्ती और पदोन्नति दोनों प्रकार से की जाय तो नाम नियम-18 के अधीन तैयार की गई सूची के अनुसार चकीय कम में रखे जायेंगे ।
(4) नियुक्ति प्राधिकारी अस्थायी या स्थानापन्न रूप में भी उपनियम (1 ) के अधीन तैयार की गयी सूची में नियुक्ति कर सकेगा । यदि सूचियों का कोई अभ्यर्थी उपलब्ध न हो तो वह इन नियमों के अधीन पात्र अभ्यर्थियों में से ऐसी रिक्तियों पर नियुक्ति कर सकेगा । ऐसी नियुक्तियां एक वर्ष से अधिक अवधि के लिए या इन नियमों के अधीन अगले चयन के बाद तक, इनमें जो भी पहले हो, नहीं की जाएगी और जहां पद सरकार के क्षेत्र के अन्तर्गत आता हो, वहां राज्य सरकार द्वारा समय - समय पर प्रवृत्त उपबन्ध लागू होंगे ।
परिवीक्षा
20. (1) सेवा में सीधी भर्ती के माध्यम से किसी पद पर मौलिक रूप से नियुक्त किये जाने पर एवं भर्ती के स्रोतों में से एक यदि सीधी भर्ती है, तो पदोन्नति द्वारा किसी पद पर मौलिक रूप से नियुक्त किसी व्यक्ति को दो वर्ष की अवधि के लिए परिवीक्षा पर रखा जायेगा ।
(2) नियुक्ति प्राधिकारी ऐसे कारणों से, जो अभिलिखित किये जायेंगे अलग-अलग मामलों में परिवीक्षा अवधि को बढ़ा सकता है, जिसके कारण अभिलिखित करने होंगे:
परन्तु यह कि आपवादिक परिस्थितियों के सिवाय परिवीक्षा अवधि एक वर्ष से अधिक और किसी भी परिस्थिति में दो वर्ष से अधिक नहीं बढ़ायी जायेगी ।
(3) यदि नियुक्ति प्राधिकारी को प्रतीत होता है कि परिवीक्षा अवधि के दौरान या किसी भी समय या उसके अन्त अथवा परिवीक्षा की बढ़ायी गयी अवधि में किसी परिवीक्षाधीन व्यक्ति ने अपने अवसरों का पर्याप्त उपयोग नहीं किया है या उसका कार्य या आचरण सन्तोषजनक नहीं रहा है, तो उसे उसके मौलिक पद पर यदि कोई हो, प्रत्यावर्तित किया 156

जा सकता है और यदि उसका किसी पद पर धारणाधिकार न हो तो उसकी सेवायें समाप्त की जा सकेगी ।
(4) ऐसा परिवीक्षाधीन व्यक्ति, जिसे उप नियम (3) के अधीन प्रत्यावर्तित कर दिया गया हो या जिसकी सेवायें समाप्त कर दी गई हैं, किसी प्रतिकर का हकदार नहीं होगा ।
(5) नियुक्ति प्राधिकारी परिवीक्षा अवधि की संगणना के प्रयोजन हेतु उस निरन्तर सेवा को गिने जाने की अनुमति दे सकेगा, जो उस विशिष्ट संवर्ग में शामिल किये गये पद पर या किसी समान अथवा उच्चतर पद पर स्थानापन्न या अस्थाई रूप में प्रदान की गयी हो ।

स्थायीकरण
परिवीक्षाधीन व्यक्ति को उसकी नियुक्ति में उसकी परिवीक्षा अवधि या बढ़ाई गयी परिवीक्षा अवधि की समाप्ति पर स्थायी किया जा सकेगा यदि-
(क) उसका कार्य और आचरण संतोषजनक बताया गया हो;
(ख) उसकी सत्यनिष्ठा अधिप्रमाणित है ;
(ग) नियुक्ति प्राधिकारी का यह समाधान हो जाय कि वह स्थायीकरण हेतु अन्यथा योग्य है ।
ज्येष्ठता
22. सेवा में किसी श्रेणी के पद पर किसी कार्मिक की ज्येष्ठता का निर्धारण अधिनियम की संगत धारा/ नियम/निहित प्रावधान के अनुसार /उत्तराखण्ड सरकारी सेवक ज्येष्ठता नियमावली, 2002 ( समय- समय पर यथासंशोधित) के अनुसार किया जायेगा। :
भाग 7-वेतन आदि
वेतनमान
23. (1 ) सेवा में विभिन्न श्रेणियों के पदों पर, नियुक्त व्यक्तियों को अनुज्ञेय वेतनमान वह होगा, जो सरकार/ अधिनियम, की संगत धारा/नियम/निहित प्राविधान के अनुसार समय - समय पर अवधारित किया जाय ।
(2) इस नियमावली के प्रारम्भ के समय वेतनमान परिशिष्ट 'क' में दिये गये हैं ।
परिवीक्षा अवधि में24.
वेतन
(1 ) मूल नियम में किसी प्रतिकूल उपबन्ध के होते हुए भी परिवीक्षाधीन व्यक्त्ति , यदि स्थायी सरकारी सेवा में नही है, तो उसे एक वर्ष की संतोषजनक सेवा पूर्ण करने, विभागीय परीक्षा उर्तीण होने और प्रशिक्षण प्राप्त करने पर, जहाँ विहित हो , समयमान में पृथक वेतन वृद्धि की अनुमति प्रदान की जायेगी तथा दूसरी वेतन वृद्धि दो वर्ष की सेवा के पश्चात्परिवीक्षा अवधि पूर्ण किये जाने तथा स्थायी किये जाने पर दी जायेगी:
परन्तु यह कि यदि समाधान प्रदान करने में असफल रहने के कारण परिवीक्षा अवधि बढ़ायी जाय तो इस प्रकार बढाई जाती है, तो जब तक नियुक्ति प्राधिकारी अन्यथा निदेश न दें, ऐसी बढाई गयी अवधि वेतन वृद्धि के लिए नही गिनी जायेगी ।

(2) परीवीक्षा के दौरान ऐसे व्यक्ति का वेतन, जो सरकार के अधीन पहले से ही पद धारण कर रहा है, संगत मूल नियमों द्वारा विनियमित कियाजायेगाः
परन्तु यह कि यदि समाधान प्रदान करने में असफल रहने के कारण परिवीक्षा अवधि बढाई जाती है, तो जब तक नियुक्ति प्राधिकारी अन्यथा निदेश न दे , ऐसी बढाई गयी अवधि वेतन वृद्धि के लिए नही गिनी जायेगी ।
(3) परिवीक्षा के दौरान ऐसे व्यक्ति को वेतन, जो पहले से ही स्थायी सरकारी सेवा में है, राज्य के कार्यों से संबंधित सामान्य सेवारत सेवको पर लागू संगत नियमों द्वारा विनियमित किया जायेगा ।
भाग -अन्य प्राविधान
पक्ष समर्थन 25. किसी पद पर या सेवा में लागू नियमों के अधीन अपेक्षित संस्तुतियों से भिन्न किन्हीं संस्तुतियों पर चाहे लिखित या मौखिक, विचार नहीं किया जायेगा । किसी अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिए प्रत्यक्ष या अप्रत्यक्ष रूप से समर्थन प्राप्त करने को कोई प्रयास उसे नियुक्ति के लिए अयोग्य कर देगा ।
अन्य विनियमन
विषयों को26. ऐसे विषयों के संबंध में, जो इस नियम या विशेष आदेशों के अन्तर्गत नही आते हों, सेवा में नियुक्त ऐसे व्यक्त्ति अधिनियम की संगत धारा /नियम /निहित प्राविधान के अनुसार/ राज्य के कार्यों से संबंधित सेवारत कार्मिको/ सेवकों पर साधारणत लागू नियमों, विनियमों और आदेशों द्वारा विनियमित होगें ।
सेवा की शर्तों शिथिलीकरण
में 27. यदि अधिनियम, की संगत धारा / नियम/ निहित प्रावधान के अनुसार यह समाधान हो जाये कि सेवा में नियुक्त्त व्यक्तियों की सेवा की शर्ते विनियमित करने वाले किसी नियम के प्रवर्तन से किसी विशेष मामलें में अनुचित कठिनाई हो सकती है, तो वे इस मामलें में लागू नियमों में किसी बात के होते हुए भी , आदेश द्वारा इस सीमा तक तथा ऐसी शर्तों के अधीन इस नियम की अपेक्षाओ से सरकार के अनुमोदन से अभिमुक्त कर देगी या शिथिल कर देंगी जो वह मामले के समबन्ध में न्यायोचित तथा साम्यतापूर्वक कार्यवाही करने के लिये उचित समझें ।
व्यावृत्ति
28. इस नियमावली में किसी बात का कोई प्रभाव ऐसे आरक्षण और अन्य रियायतों पर नहीं पड़ेगा जिनका इस संबंध मे अधिनियम, की संगत धारा /नियमों/निहित प्रावधान के द्वारा समय - समय पर जारी किये गये आदेशों के अनुसार विशेष श्रेणियों के व्यक्तियों के लिए उपबंधित किया जाना अपेक्षित हो ।

In pursuance of the provision of Clause (3) of article 348 of the "Constitution of India", theGovernor is pleased to order the publication of the following English translation of Notification No.179931/2024 Dated- February 08, 2024 for general information.

No.179931/2024--In exercise of the power conferred by section 26(2) (d) of the Uttar Pradesh Shri Badrinath and Shri Kedarnath Temple Act , 1939 ( as applicable in the state ofUttarakhand) , and in supersession all the existing rules and orders , the Governor is pleased to make the following Rules to regulate the recruitment and service conditions of the persons appointed in Shri Badrinath and Shri Kedarnath Temple Service: -
The Shri Badrinath and Shri Kedarnath Temple Service Rules , 2023
Part1- General
Short title and 1 . commencement
(1) These rules may be called the Shri Badrinath and Shri Kedarnath Temple Service Rules , 2023
(2) It shall come into force at once.
Status of Service 2 .
This is Shri Badrinath and Shri Kedarnath Temple Service, which includes Group " A" , " B " , " C" and "D " posts.
Definitions 3.
In these rules , unless the subject or context has anything contrary-
(a) "Act" means the Uttar Pradesh Shri Badrinath and Shri Kedarnath Temple Act, 1939 (as applicable to the state of Uttarakhand) ;
(b) "Appointing Authority " means the President of Shri Badrinath and Shri Kedarnath Temple Committee;
(c) "Citizen of India " means a person who is a citizen of India under Part - II of ' the constitution ofIndia' or is considered to be a citizen of India;
(d) " Committee" means Shri Badrinath and Shri Kedarnath Temple Committee established/ constituted under section 5 of the Act .
(e) " Constitution" means ' the Constitution of India' ;
(f) "Government" means the Government of Uttarakhand;
(g) "Governor " means the Governor of Uttarakhand;

(h) "Hindu religion " means a sect of the Hindus professing Sanatan Dharm or having faith in it;
(i) "Member of Service" means a follower of Hindu religion on any post in the cadre of service and under these rules or rules in force before the commencement of these rules or under the orders of these rules , a person permanently appointed / appointed on substantive post;
(j ) "President" means the President of Shri Badrinath and Shri Kedarnath Temple Committee nominated by the Government of Uttarakhand under section 5 (1 ) (g) of the Act;
(k) "Service" means Shri Badrinath and Shri Kedarnath Temple Committee Service;
(1) "Substantive Appointment" means an appointment, not being an ad hoc appointment, on a post in the cadre of the service , made after selection in accordance with the rules and, if there are no rules , in accordance with the procedure prescribed for time being , by executive instructions issued by the Government or made according to the procedure prescribed for time being in accordance with the relevant section/prescribed provision of Shri Badrinath and Shri Kedarnath Temple Act, 1939 (as amended from time to time); and
(m) "Year of Recruitment " means the period of twelve months commencing on the first day of July ofthe calendar year;
Part 2- Cadre
Cadre of Service 4. (1) The number of posts of personnel/ officers and each category in the service shall be as fixed according to the relevant section/prescribed provision of Act by Shri Badrinath and Shri Kedarnath Temple Committee after the approval of State Government;
(2) The number of posts of personnel/ officers and each category in the service shall be, as shown in Appendix ' A' , unless changed by orders under sub rule(1);

Provided that;
(i) The appointing authority may keep a vacant post vacant or the Governor may according to the relevant section/prescribed provision of the Act, defer a post in such a 'way that no person shall be entitled to any compensation.
(ii) The President of the temple committee may according to the relevant section/prescribed provision of the Act, create such additional permanent or temporary posts after the approval of the state government as he deems fit;
Part3- Recruitment
Recruitment in the various categories of posts in service shall be made from the following sources: - Source Recruitment of 5.
Administrative Service Cadre
(A)

Shall be appointed by the State Government as per the procedure prescribed for time being time under section 14 of the Act.

Shall be appointed by the State Government as per the procedure prescribed for time being .
Officer on Special Duty
(B) Legal and Property Service Sub Cadre
1. Law Officer By direct recruitment. 2. Property Inspector By direct recruitment.
(C) Subordinate Service Cadre
1. Deputy Executive Officer Chief By promotion on the basis of merit, suitability and experience after the approval of the President , Temple Committee , from among the substantively appointed such Chief Administrative Officers and posts of equivalent Grade pay who have completed at least 01 year of service in this capacity on the first dayofthe year of recruitment and have completed at least 25 years of service on the subordinate posts .
2. Executive Officer By promotion on the basis of merit, suitability and experience after the approval of the President, Temple Committee according to the provisions of Temple Act, from among the substantively appointed such Chief Administrative Officers and posts of equivalent Grade pay who have completed at least 01 years of service in this capacity on the first day of the year of recruitment and have completed at least 25 years of service on the subordinate posts.

1.
Chief Administrative Officer
Bypromotion on the basis of seniority from among the substantively appointed such Senior Administrative Officers who have completed at least 01 year of service in this capacity on the first day of the year of recruitment and have completed at least 25 years of service on the subordinate posts , subject tothe rejection ofunsuitable.
2.
By promotion on the basis of seniority through Selection Committee , from among the substantively Senior Officer Administrative
appointed such Administrative Officers who have completed at least 02 years of service in this capacity on the first day of the year of recruitment orhave completed at least 20 years of service on the subordinate posts , subject to the rejection of unsuitable.
3 Administrative Officer
By promotion on the basis of seniority through Selection Committee , from among the substantively appointed such Head Assistants who have completed at least 03 years of service in this capacity on the first day of the year of recruitment orhave completed at least 17 years of service on the subordinate posts , subject to the rejection of unsuitable.
4 HeadAssistant By promotion on the basis of seniority through Selection Committee , from among the substantively appointed such Senior Assistants who have completed at least 03 years of service in this capacity on the first day of the year of recruitment and have completed at least 10 years of service on the subordinate posts , subject to the rejection of unsuitable .
Senior Assistant

By promotion on the basis of seniority through Selection Committee , from among the substantively appointed such Junior Assistants who have completed at least 06 years of service in this capacity on the first day of the year of recruitment, subject to the rejection of unsuitable .

Junior Assistant/ Compute r Operator/Data Entry Operator
(2) From among such Group " D" personnel, 15 per cent those who are High School pass and 10 per cent those who are Intermediate pass , shall be filledbypromotion.
Provided that , if regular eligible candidates in Group "D" are not available, then , to that extent, in the lowest class of that Clerical category , vacant posts marked for promotion from Group "D" may be filled by direct recruitment/merger .
(3) 5 per cent vacancies of the total posts of Clerical category by promotion from among the drivers who are High School pass or have passed a higher exam.

(2) Other things being equal , Candidate having " B " OR "C" certificate of National Cadet Core shall be given preference.
10.
Essential Qualification
(1) Shall be according to relevant section/rules /prescribed procedure of the Act .
(2) He must be a follower of the Hindu religion and follows and accepts the prevalent method of worship according to the traditions of the temple .
(3) He must be a domicile/permanent resident of the state ofUttarakhand .
(4) A person dismissed from a government or local authority shall be ineligible .
(5) A person who has been imprisoned for a crime of moral turpitude shall be ineligible .

11.
Age
Fordirect recruitment , candidate must have attained the minimum age as prescribed from time to time and should not have crossed the maximum age on the first July of the year in which the vacancies for direct recruitment are published by the Commission or any other appointing authority:
Provided that, according to the relevant section/rules/ prescribed provision of the Act, as notified by the state government, the maximum age may be increased as much as prescribed.
12.
Character
For direct recruitment to any post of service , the character of the candidate must be such that he is completely suitable for the job in government service. The appointing authority shall satisfy itself in this regard . Note- ( 1 ) A person dismissed by the union government or the state government or local authority or corporation or body owned or controlled by the union government or state government shall not be eligible for appointment to any post in the service. A person convicted for a crime related to moral turpitude, shall also not be eligible for appointment .
Marital Status 13 .
A male candidate who has more than one wife alive shall not be eligible or a woman candidate who has more than one husband alive shall not be eligible for appointment to any post in the service.
Provided that, if the government is satisfied that special reasons exist for doing so , it may exempt a person from the operation of this rule .
14.
Physical Fitness
No candidate shall be appointed to a post in the service unless he is in good mental and physical health and free from any physical defect which is likely to interfere with the efficient performance of his duties. Before a candidate is finally approved for appointment, he shall be required to produce a fitness certificate according to the fundamental rule- 10 as mentioned in Lesson Volume III, Part - II of Financial Hand Book . III, of
Provided that appointment to the posts marked for thispurpose under Section 33 and categories marked under section 34 of The Rights of Persons with Disabilities Act , 2016 (Act No. 49 of 2016) shall not be denied to disabled persons:

Part -5 Procedure for Recruitment
Determination 15. ofVacancies
The appointing authority shall also determine the number of vacancies to be filled during the course of the year under relevant section/rule/prescribed provision of Act and information shall be provided to the government about the vacancies to be filled through the government.
Procedure for 16. Recruitment
Procedure for direct recruitment , Accordingto the relevant section/rule/prescribed procedure of the Act shall be as follows:-
(a) Procedure for recruitment through merger on posts ofdirect recruitment related to Group " B " and " C " : -
(1) The appointing authority shall invite applications for recruitment/appointment to various posts.
(2) No candidate shall be given admission without Admit card .
(3) The Temple Committee shall invite applications/publish advertisement for service/work on related posts on deputation from the eligible personnel of various government offices and corporations and autonomous institutions/bodies of departments of central / state government and the appointing authority/ the Selection Committee constituted for this purpose shall scrutinize and inspect the applications received and such candidates who are eligible for recruitment / appointment under these rules, shall according to rules/procedure be recruited/appointed firstly on deputation.
(4) After 01 year of satisfactory service of the personnel recruited on deputation, the Temple Committee shall according to the specified/prescribed/procedure/service conditions of the Merger Rules, merge the willing personnel on the concerned posts .
(b) Procedure for recruitment through direct recruitment on all general posts of Seasonal Clerk/all Seasonal Class IV posts and posts related to Group "D" : -
Note-" Seasonal " means Yatra period.

(1) Recruitment by promotion shall be made through the Selection Committee , constituted according to the relevant section/prescribed provision/procedure prescribed by the government from time to time, the Committee shall be constituted as follows : -

(2) The Appointing Authority shall prepare a list of the eligible candidates in order of seniority and place the list before the Selection Committee along with their character roles and such other documents related to them as may be considered appropriate.
(3) The Selection Committee may take the interview of the candidates on the basis of the documents mentioned in sub rule (2) .
(4) The Selection Committee shall prepare a list of
selected candidates according to the government orders in force for time being and forward it to the appointing authority: Provided that under sub rule (2) or under this rule, while preparing the eligibility list, where selection is to be made from different feeding cadres, there;
(a) With respect to different pay scales , candidates with higher pay scale shall be placedhigher in the eligibility list.
(b) With respect to equal pay scales , names of the candidates shall be placed in the eligibility list in order of the date of substantive appointment in their own cadres .
Joint Selection 18 .
List
If in any year , appointments are made both by direct recruitment and promotion then, taking the names from the relevant lists a joint list will be prepared in such a way that the prescribed percentage is maintained . The first name in the list shall be of the person appointed by promotion.
Part 6 Appointment, Probation, Confirmation, Seniority
19.
Appointment
(1) Subject to sub rule (2) , the appointing authority shall appoint the names of the candidates in the same order in which their names , as the case may be, appeared in the list prepared under rule 15, 16, 17 and18.
(2) Where in any year , appointments are to be made both by direct recruitment and promotion, there, the regular appointments shall not be made unless selection is made from both the sources , and a joint list is prepared according to rule 18 .
(3) If more than one order is issued with respect to a single selection, then a joint order shall also be 183 भाग 1 ]

issued inwhich names of the persons shall be placed in order of seniority determined in selection. As determined in selection, as the case may be, or as is inthat cadre, from which they are promoted.
If the promotion is made from both direct recruitment and promotion, then the names shall be placed in cyclical order according to the list prepared under rule 18 .

(4) The appointing authority may make temporary or substitute appointments from the list prepared under sub rule (1 ) . If no candidate from the lists is available then, under these rules the appointing authority may make appointments on such vacancies . from amongst the eligible candidates . Such appointments shall not be made for more than one year or under these rules after the next selection , whichever is earlier and where the post is within the jurisdiction of the government, in that case, the provisions made by the government from time to time shallapply.
Probation
20. (1) A person on being substantively appointed to any post through direct recruitment and if among the sources of recruitment one is direct recruitment, then, substantively appointed to any post by promotion, shall be placed on probation for a period of two years.
(2) The appointing authority may, for such reasons which shall be recorded , in individual cases , extend the period of probation .
Provided that save in exceptional circumstances , the period of probation shall not be extended beyond one year and in no circumstances beyond two years .
(3) If it appears to the appointing authority that during the period of probation or at any time or at its end or during the extended period of probation , a person under probation has not made sufficient use ofhis opportunities or his work or conduct has not been satisfactory , then he may be reverted to his substantive post, if any, and if does not hold a lien on anypost, his services may be terminated.
(4) Such a probationer, who has been reverted under sub rule (3) or whose services have been terminated, shall not be entitled to any compensation.
(5) For the purpose of computing the period of probation, the appointing authority may allow to compute that continuous service, which may have 184

been rendered in officiating or temporary capacity on the post included in that special cadre or on an equivalent or higherpost.
Confirmation
21. Aprobationer may be confirmed in his appointment at the end of his period of probation or the extended periodofprobation, if---
(1) his work and conduct are reported to be satisfactory;
(2) his integrity is certified;
(c) the appointing authority is satisfied that he isotherwise suitable for confirmation.
22.
Seniority
Seniority of any personnel in any category of posts shall be determined according to the relevant section/rule /prescribed provision of Act. The Uttarakhand Government Servants ' Seniority Rules , 2002.
Part- 7 Pay Etc. ,
23.
Scales ofPay
(1) The scales of pay admissible to persons appointed to various categories of posts in service shall be that which shall be determined from time to the relevant to time according section/rule/prescribed provision ofAct.
(2) At the time of commencement of these rules pay scales are given at Appendix 'A' .
24 .
Pay During Probation Period
(1) Notwithstanding any provision in the fundamental rules to the contrary, a person on probation, if not in permanent government service, shall be allowed first increment in the time scale on completion of one year of satisfactory service after passing departmental exam and training where prescribed and second increment after completion of two years' service on completion of period of probation and confirmation.
Provided that , if the period of probation is extended on account of failure to give satisfaction such extended period shall not be counted for increment unless the appointing authority directs otherwise.
(2) During probation, pay of such person who is already holding a post under the government, shall be regulated by the fundamental rules .
Provided that, if the period of probation is extended on account of failure to give satisfaction such extended period shall not be counted for increment.

(3) During probation, pay of such person who is already in permanent government service, shall be regulated by the relevant rules generally applicable to servants serving in connection with the affairs of the state .
25.
Canvassing
No recommendation, either written or oral other than recommendations required under the rules applicable to service or a post, shall be taken into consideration. Any attempt on part of the candidate for his candidature or direct or indirect support shall disqualify him for appointment.
Regulation other Matters of 26.
In regards to the matters not covered by these rules or specific rules , such persons appointed in service shall be regulated according to the relevant section/specific provision of Act, rules , regulation and orders generally applicable to serving personnel/servants serving in connection with the affairs of the state .
Relaxation from 27. the Conditions of Service
If it is resolved, according to the relevant section/rule/prescribed provision of the Act, that the operation of any rule regulating the conditions of service of persons appointed to the service causes undue hardship in any particular case , it may, notwithstanding anything contained in the rules applicable to the case , by order, dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in just and equitable manner .
28.
Saving
Nothing in these rules shall effect such reservation and other concessions which in this connection , is expected to be provided to persons of special category according to orders issued from time to time by the relevant section/rules/prescribed provision ofthe Act.

Cause list shall be accessible on the official website of each District Court in the form auto generated by CIS Software.
Information about Video Conferencing Link shall be made available in the Cause List or navigable through the official website of each District Court.
Aweekly list, in the form subjoined, of cases fixed for hearing , prepared in legible Hindi or cause list generated through CIS software and signed by the Munsarim of the Court, shall be posted on the last working day of the previous week in some conspicuous place in every Court house . Aprocess should be served with utmost care. One copy is to be delivered to the person named in the summons or to any adult member whether male or female of the family of the person or such other person as may be authorized to receive it for him. On the other copy must be entered the acknowledgment of the person served attested by the neighbours after explaining the contents of the process to him. The process server shall prepare his report on the spot at the time of executing the process.
NOTE
A process should be served with utmost care . One copy is to be delivered to the person named in the summons or to any adult member whether male or female of the family of the person or such other person as may be authorized to receive it for him . On the other copy must be entered the acknowledgment of the person served attested by the neighbours after explaining the contents of the process to him . Provided that when the process is served through NSTEP or through any other similar application prescribed by the High Court, the signature or thumb impression of the party served on the handheld electronic gadget of the serving officer shall constitute the acknowledgement within the meaning of this Rule.

Provided further that the photograph of the party Served/Refused the process along with the geo- tagged photo of the location captured by the process server shall be sufficient proof of service within the meaning of this Rule.

यतः, जिला निर्वाचन अधिकारी, टिहरी गढ़वाल , उत्तराखण्ड के द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड द्वारा पत्र सं . 2782 /XXV- 53 /2022 देहरादून के जरिए अग्रेषित दिनांक 22/04/2022 कीरिपोर्ट के अनुसार श्री विजय प्रकाश , जो उत्तराखण्ड विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 09- घनसाली से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और ,
यतः, जिला निर्वाचन अधिकारी , टिहरी गढ़वाल , उत्तराखण्ड, और मुख्य निर्वाचन अधिकारी , उत्तराखण्ड की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 केनियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री विजय प्रकाश, को कारण बताओ नोटिस सं. 76/उत्तराखण्ड-वि.स./09/2022/सी.ई.एम.एस.- III , दिनांक 20 अक्टूबर , 2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप- नियम (6) के अनुसार, दिनांक 20 अक्टूबर , 2022 के उपर्युक्त कारण बताओ नोटिस के जरिए श्री विजय प्रकाश, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और
यतः, जिला निर्वाचन अधिकारी, टिहरी गढ़वाल द्वारा अपने पत्र संख्या 1860/29-23/2021 दिनांक 29.11.2022 जो मुख्य निर्वाचन अधिकारी के पत्र सं0 891 /XXV- 22(II )/2008 दिनांक15.06.2023 के द्वारा अग्रेषित कर आयोग को सूचना दी गई कि उक्त नोटिस अभ्यर्थी के भाई श्री विजय थपलियाल, द्वारा दिनांक 26.11.2022 को प्राप्त किया गया था; और ,
यतः, जिला निर्वाचन अधिकारी, टिहरी गढ़वाल द्वारा अपने पत्र संख्या 947/29-23-( 2)/2023 नई टिहरी, दिनांक12.10.2023 के द्वारा अग्रेषित कर भेजी गई अनुपूरक रिपोर्ट दिनांक 12.10.2023 में यह बताया गया है कि श्री विजय प्रकाश , ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलताके लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और ,
यतः, आयोग का यह समाधान हो गया है कि श्री विजय प्रकाश, निर्वाचन खर्चों का लेखा दाखिल करने मेंविफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है किः-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश कीतारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;
अतः, अब लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा घोषणा करता है कि उत्तराखण्ड राज्य के 09-घनसाली विधान सभा निर्वाचन क्षेत्र से उत्तराखण्ड राज्यमें विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री विजय प्रकाश, निवासी ग्राम एंव पोस्ट- मल्याकोट, पट्टी नैलचामी, घनसाली, टिहरी गढ़वाल, को इस आदेश की तारीख से तीन वर्ष की अवधिके लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

No. 76 /Uttarakhand - LA/09 / 2022 / CEMS - III -- WHEREAS , the General Election to 09-Ghansali Legislative Assembly of Uttarakhand , 2022 was held vide Notification No. 464/Uttarakhand - LA/ 2022 dated 21st January, 2022.
WHEREAS , as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate at an election has to , within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and , WHEREAS , the result of the said election along with 09 -Ghansali Assembly Constituency was declared by the concerned Returning Officer on 10th March , 2022. Hence , the last date for lodging the account of Election Expenses was 09th April , 2022; and, WHEREAS , as per the report submittedby the District Election Officer , Tehri Garhwal , Uttarakhand and forwarded by the Chief Electoral Officer , Uttarakhand vide their letter No. 2782/XXV- 53 /2022 , dated 22th April , 2021 , Sh . Vijay Prakash , a contesting candidate of Uttarakhand from 09 -Ghansali Assembly Constituency of Uttarakhand, has failedto lodge account ofhis election expenses , in the manner, as required under law ; and,
WHEREAS , on the basis of the reports of the District Election Officer Tehri Garhwal , Uttarakhand and the Chief Electoral Officer , Uttarakhand, a Show-Cause notice , 76/Uttarakhand -LA/ 2022/ 09 / CEMS- III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 by the Election Commission of India to Sh . Vijay Prakash, for not lodging the account of Election Expenses ; and ,
WHEREAS , As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show-Cause Notice , dated 20.10.2022 , Sh . Vijay Prakash , was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,
WHEREAS, the said notice was received by the candidate's brother Sh . Vijay Thapliyal on 26.11.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer , Tehri Garhwal , vide its letter No. 1860/29-23 /2021 dated 29.11.2022; forwarded by Chief Electoral Officer, Uttarakhand, letter no.891 /XXV- 22(II )/2008 date15.06.2023; and,
WHEREAS , the District Election Officer, Tehri Garhwal , in his Supplementary Report dated 12.10.2023 vide its letter No. 947/29-23- ( 2 )/2023 New Tehri , dated 12.10.2023 forwarded by has reported that Sh . Vijay Prakash has neither submitted any representation nor any statement of account of election expenses . Further , after receipt of the due notice of the 04

Election Commission of India , he has furnished neither any reason nor explanation for the said failure; and, WHEREAS, the Commission is satisfied that Sh . Vijay Prakash , has failed to lodge the account of election expenses and has no good reason or justification for the failure,
WHEREAS , Section 10 A of the Representation of the People Act , 1951 provides that:-
"Ifthe Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses , within the time and in the manner required by or under this Act, and
(b) has no good reason or justification for the failure,
theElection Commission shall , by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order" ;
NOW, THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh . Vijay Prakash resident of Village& Post- Malyakot , Patti- Nailchami , Ghansali , Tehri Garhwal , a contesting candidate from 09 -Ghansali Assembly Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, जिला निर्वाचन अधिकारी, हरिद्वार, उत्तराखण्ड, और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए मनोरमा त्यागी, को कारण बताओ नोटिस सं. 76/उत्तराखण्ड-वि.स./32/2022/सी.ई.एम.एस.- III , दिनांक 20 अक्टूबर, 2022 जारी किया गया था; और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20 अक्टूबर, 2022 के उपर्युक्त कारण बताओ नोटिस के जरिए मनोरमा त्यागी , को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही , निर्वाचन व्यय का अपना लेखा दाखिल करें; और
यतः, जिला निर्वाचन अधिकारी , हरिद्वार ने अपने पत्र संख्या 1152/29-40 (निर्वा0 व्यय लेखा)/2022 दिनांक 13.12.2023 के जरिए आयोग को सूचना दी गई कि उक्त नोटिस दिनांक 08.11.2022 को दक्षिण मुहाना दुकान पर चस्पा कर दिया एंव अभ्यर्थी के शपथ में अंकित ई- मेल पर जिला निर्वाचन अधिकारी के द्वारा नोटिस दिनांक 27.09.2023 को भेज दिया गया।; और,
यतः, जिला निर्वाचन अधिकारी , हरिद्वार द्वारा अपने पत्र संख्या 1152/29--40 (निर्वाचन व्ययलेखा)/2022 दिनांक 13.12.2023 के द्वारा अग्रेषित कर भेजी गई अनुपूरक रिपोर्ट में यह बताया गया है कि मनोरमा त्यागी, ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है ; और ,
यतः, आयोग का यह समाधान हो गया है कि मनोरमा त्यागी, निर्वाचन खर्चों का लेखा दाखिल करने मेंविफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
यत्तः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क में अनुवंधित किया गया हैकिः- "यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश कीतारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;

अतः, अव लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा घोषणा करता है कि उत्तराखण्ड राज्य के 32-खानपुर, विधान सभा निर्वाचन क्षेत्र से उत्तराखण्ड राज्य में विधान सभा के साधारण निर्वाचन , 2022 में निर्वाचन लड़ने वाले अभ्यर्थी मनोरमा त्यागी, निवासी म०न० एल-88 , ग्राम जलालपुरए दुर्गा कॉलोनी, पो०- टोडा कल्याणपुर , तहसील- रूङकी , जिला- हरिद्वार, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संमद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र कीविधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

No. 76 /Uttarakhand -LA/ 32 / 2022 / CEMS - III --WHEREAS , the General Electionto 32-Khanpur, Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/Uttarakhand - LA/2022 dated 21st January, 2022.
WHEREAS, as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate at an election has to , within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and , '
WHEREAS, the result of the said election along with 32-Khanpur Assembly Constituency was declared by the concerned Returning Officer on 10th March , 2022. Hence , the last date for lodging the account of Election Expenses was 09th April , 2022; and,
WHEREAS , as per the report submitted by the District Election Officer , Haridwar, Uttarakhand and forwarded by the Chief Electoral Officer , Uttarakhand vide their letter No. 2782/XXV- 53 /2022, dated 22th April , 2021 , Manorma Taygi , a contesting candidate of Uttarakhandfrom 32 - Khanpur, Assembly Constituency of Uttarakhand , has failed to lodge account of his election expenses , in the manner, as required under law; and,
WHEREAS, on the basis of the reports of the District Election Officer Haridwar, Uttarakhand and the Chief Electorai Officer , Uttarakhand , a Show - Cause notice , 76/Uttarakhand -LA/ 2022/ 32/CEMS- III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules , 1961by the Election Commission of India to Manorma Taygi , for not lodging the account of Election Expenses ; and, 07 भाग 7]

WHEREAS, As per the sub rule ( 6) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show -Cause Notice, dated 20.10.2022, Manorma Taygi , was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,
WHEREAS, the said notice was pasted at dakshin muhana dukan on 08.11.2022 and an email were also sent on 27.09.2023 by the district election officer at email-id givenby the candidate on affidavit. The acknowledgment receipt has been submitted to the Commissionby the District Election Officer, Haridwar , vide its letter 1152/ 29-40(निर्वा 0 व्यय लेखा)/2022 dated 13.12.2023 , and;
WHEREAS , the District Election Officer, Haridwar , in his Supplementary Report forwarded vide its letter No. 1152/ 29-40(निर्वा0 व्यय लेखा )/2022 दिनांक 13.12.2023 reported that Manorma Taygi , neither submitted any representation nor any statement of account of election expenses . Further , after receipt of the due notice of the Election Commission of India , he neither furnished any reason nor explanation for the said failure ; and,
WHEREAS, the Commission is satisfied that Manorma Taygi , has failed to lodge the account of election expenses and has no good reason or justification for the failure,
WHEREAS, Section 10 A of the Representation of the People Act , 1951 provides that: - "If theElection Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses , within the time and in the manner requiredby or under this Act, and
(b) has no good reason or justification for the failure,
theElection Commission shall , by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order";

NOW, THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Manorma Taygi , resident of H.Ν. L-88 , Village- Jalalpur Durga Colony, PO- Toda Kalyanpur , Tehsil Roorkee, District- Haridwar, a contesting candidate from 32 -Khanpur, Assembly Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

(यू.के.डी. :2004) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए उत्तराखण्ड राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है । 2. श्री बी.वी.आर.सी. पुरुषोत्तम, उत्तराखण्ड सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे , जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे ।
3. श्री बी.वी.आर.सी. पुरुषोत्तम , मुख्य निर्वाचन अधिकारी , उत्तराखण्ड के रूप में कार्य करते हुए उत्तराखण्ड सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी , सरकार के सचिव पदाभिहित किया जाएगा ।

No. 154/UKD/2023 - P.Admn . -In exercise of the powers conferred by sub- section ( 1 ) of section 13A of the Representation of the People Act , 1950 (43 of 1950) , the Election Commission of India in consultation with the Government of Uttarakhand hereby designates Shri B.V.R.C Purushottam , IAS , (UKD:2004) as the Chief Electoral Officer for the State of Uttarakhand with effect from the date he takes over charge and until further orders in place of Shri V. Shanmugam , IAS.
2. Shri B.V.R.C Purushottam , shall cease to hold and hand over forthwith the charge of all or any charges ofwork under the Government of Uttarakhand , which he may be holding before such assumption ofoffice.
3. Shri B.V.R.C Purushottam , while functioning as the Chief Electoral Officer , Uttarakhand shall not hold any additional charge whatsoever under the Government of Uttarakhand except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat .
