2- सुश्री माधवी भट्ट डॉ रघुनन्दन सिंह टोलिया उत्तराखण्ड प्रशासन अकादमी, नैनीताल / उत्तराखण्ड ग्रामीण विकास संस्थान , रूद्रपुर, ऊधमसिंहनगर/ पंडित दीनदयाल उपाध्याय वित्तीय प्रशासन प्रशिक्षण एवं अनुसंधान केन्द्र, देहरादून में दिनांक 18 नवम्बर, 2024 से प्रारम्भ होने वाले " आधारभूत प्रशिक्षण कार्यक्रम " में योगदान आख्या प्रस्तुत करेंगे ।
3- यह नियुक्ति पूर्णतः अस्थाई एवं औपबन्धिक है तथा यदि अभ्यर्थी के स्वास्थ्य परीक्षण, चरित्र एवं पूर्ववृत्त के सत्यापन , शैक्षिक अर्हता अथवा आरक्षण श्रेणी संबंधी प्रमाण- पत्रों आदि के सत्यापन में कोई प्रतिकूल तथ्य प्रकाश में आता है तो उक्त नियुक्ति को स्वतः ही समाप्त समझा जायेगा ।
4- एतद्वारा नियुक्त अभ्यर्थी की सेवायें उत्तराखण्ड (उत्तर प्रदेश उद्योग सेवा नियमावली , 1993) अनुकूलन एवं उपान्तरण आदेश 2002 एवं समय- समय पर यथासंशोधित तथा राजकीय सेवकों की सेवा शर्तों के संबंध में सामान्य रूप से लागू व सरकार द्वारा समय- समय पर प्रख्यापित किये जाने वाले अन्य संगत विनियमों / आदेशों में विहित प्राविधानों के अधीन रहेंगी ।
5- अभ्यर्थी के स्वास्थ्य परीक्षण की कार्यवाही डॉ रघुनन्दन सिंह टोलिया उत्तराखण्ड प्रशासन अकादमी, नैनीताल/ उत्तराखण्ड ग्रामीण विकास संस्थान, रूद्रपुर, ऊधमसिंहनगर/ पंडित दीनदयाल उपाध्याय वित्तीय प्रशासन प्रशिक्षण एवं अनुसंधान केन्द्र, देहरादून में महानिदेशक, चिकित्सा, स्वास्थ्य तथा परिवार कल्याण विभाग द्वारा की जायेगी । अभ्यर्थी के चरित्र एवं पूर्ववृत्त के सत्यापन की कार्यवाही नियुक्ति आदेश निर्गत होने के 06 माह की अवधि के अंतर्गत सम्पन्न कर ली जाएगी ।
6- इस नियुक्ति के क्रम में अभ्यर्थी को संबंधित प्रशिक्षण संस्थान में उपस्थित होने हेतु किसी भी प्रकार का यात्रा व्यय अथवा अन्य भत्ते अनुमन्य नहीं होंगे ।
7- संबंधित प्रशिक्षण संस्थान में योगदान प्रस्तुत करते समय अभ्यर्थी द्वारा निम्न प्रमाण-पत्र/घोषणा-पत्र प्रस्तुत किये जाने होंगे:-
1. शैक्षिक योग्यता, आयु तथा आरक्षित श्रेणी संबंधी मूल प्रमाण- पत्र , उनकी एक - एक प्रमाणित छायाप्रतियों के साथ ।
2. अभ्यर्थी द्वारा केन्द्र अथवा राज्य सरकार के अधीन अब तक की गयी सेवा (यदि कोई हो) से संबंधित घोषणा व संबंधित विभाग / प्रतिष्ठान द्वारा जारी अनापत्ति प्रमाण- पत्र ।

3. दो ऐसे राजपत्रित अधिकारियों द्वारा प्रदत्त चरित्र प्रमाण-पत्र जो सेवारत हो तथा अभ्यर्थी के संबंधी/ रिश्तेदार न हों ।
4. अभ्यर्थी द्वारा धारित चल एवं अचल सम्पत्ति का घोषणा- पत्र ।
5. इस आशय की घोषणा कि यदि अभ्यर्थी के चरित्र एवं पूर्ववृत्त का सत्यापन, शैक्षिक अर्हता अथवा आरक्षण श्रेणी संबंधी प्रमाण-पत्रों आदि के सत्यापन पर उसके संबंध में कोई प्रतिकूल तथ्य प्रकाश में आता है तो इस नियुक्ति को स्वतः ही समाप्त समझा जाएगा ।
6. अभ्यर्थी के विवाहित होने की दशा में एक से अधिक जीवित पति / पत्नी न होने के संबंध में घोषणा ।

9- संबंधित अभ्यर्थी से अपेक्षा की जाती है कि वे उपरोक्त शर्तों के अधीन सहायक निदेशक, उद्योग / प्रबन्धक के पद पर संबंधित प्रशिक्षण संस्थान में प्रस्तावित "आधारभूत प्रशिक्षण कार्यक्रम " में अपनी योगदान आख्या प्रस्तुत करेगे । यदि उपरोक्तानुसार योगदान आख्या प्रस्तुत करने में असमर्थ रहते हैं तो यह समझा जायेगा कि अभ्यर्थी उक्त पद पर नियुक्ति हेतु इच्छुक नहीं हैं । तद्नुसार उनके अभ्यर्थन को निरस्त करने की कार्यवाही की जायेगी ।

सामान्य
संक्षिप्त 1.
नाम और
प्रारम्भः
(1) इस नियमावली का संक्षिप्त नाम उत्तराखण्ड कारागार प्रशासन एवं सुधार सेवा विभाग (लिपिक वर्गीय) सेवा नियमावली, 2024 है ।
(2) यह तुरन्त प्रवृत्त होगी ।

प्रास्थिति
2. उत्तराखण्ड कारागार प्रशासन एवं सुधार सेवा विभाग (लिपिक वर्गीय) सेवा एक ऐसी सेवा है जिसमें समूह ' ख' एवं "ग " के पद समाविष्ट हैं ।
परिभाषाएं 3. जब तक कि विषय या संदर्भ में कोई बात प्रतिकूल न हो , इस नियमावली में:-
(क) 'नियुक्ति प्राधिकारी' से महानिरीक्षक, कारागार प्रशासन एवं सुधार सेवा विभाग , उत्तराखण्ड अभिप्रेत है;
(ख) 'भारत का नागरिक' से ऐसा व्यक्ति अभिप्रेत है जो भारत के संविधान के भाग-दो के अधीन भारत का नागरिक हो, या समझा जाता है;
(ग) 'आयोग' से उत्तराखण्ड अधीनस्थ सेवा चयन आयोग अभिप्रेत है;
(घ) 'संविधान' से भारत का संविधान अभिप्रेत है,
(3) 'विभाग' से कारागार प्रशासन एवं सुधार सेवा विभाग उत्तराखण्ड अभिप्रेत है;
(च) 'मुख्यालय' से उत्तराखण्ड कारागार प्रशासन एवं सुधार सेवा विभाग का मुख्यालय अभिप्रेत है;
'राज्यपाल' से उत्तराखण्ड का राज्यपाल अभिप्रेत है :
(छ)
(ज) 'सरकार' से उत्तराखण्ड राज्य की सरकार अभिप्रेत है;
(झ) 'भर्ती का वर्ष' से किसी कैलेण्डर वर्ष के जुलाई माह के प्रथम दिवस से प्रारम्भ होने वाली बारह मास की अवधि अभिप्रेत है ;
( স) 'सेवा के सदस्य' से इस नियमावली से या इससे पूर्व नियमावली या आदेशों के अधीन स्थायी रूप से मौलिक पद पर नियुक्त व्यक्ति अभिप्रेत है;
(ट) 'सेवा' से उत्तराखण्ड कारागार प्रशासन एवं सुधार सेवा विभाग लिपिक वर्गीय सेवा अभिप्रेत है;
( 8) 'अधीनस्थ कार्यालयों से उत्तराखण्ड कारागार प्रशासन एवं सुधार सेवा विभाग के मुख्यालय के नियन्त्रणाधीन समस्त कारागारें / कार्यालय अभिप्रेत है ।
(ड) ' अधीनस्थ पदों से कनिष्ठ सहायक, वरिष्ठ सहायक, प्रधान सहायक , प्रशासनिक अधिकारी एवं वरिष्ठ प्रशासनिक अधिकारी में से किन्हीं पदों पर की गयी सेवा अभिप्रेत है;

(ण) 'मौलिक नियुक्ति' से सेवा के संवर्ग में किसी पद पर ऐसी नियुक्ति अभिप्रेत है, जो तदर्थ नियुक्ति न हो और नियमों के अनुसार चयन के पश्चात की गयी हो और यदि कोई नियम न हो तो सरकार द्वारा जारी किये गये कार्यपालक अनुदेशों द्वारा तत्समय विहित प्रक्रिया के अनुसार चयन के पश्चात की गई हो;

सेवा का 4.
संवर्ग
(1) सेवा में कर्मचारियों / अधिकारियों तथा उसमें प्रत्येक श्रेणी के पदों की संख्या उतनी होगी जो समय -समय पर सरकार द्वारा निर्धारित की जाये ।
(2) सेवा में कर्मचारियों / अधिकारियों तथा उसमें प्रत्येक श्रेणी के पदों की संख्या जब तक उपनियम (1 ) के पारित आदेशों द्वारा परिवर्तन न किया जाये , उतनी होगी जो परिशिष्ट-'क' में दी गयी है ;
परन्तु उपबन्ध यह है कि-
(क) नियुक्ति प्राधिकारी किसी रिक्त पद या पदों के किसी वर्ग को बिना भरे हुए छोड़ सकता है या राज्यपाल उसे आस्थगित रख सकते हैं, जिससे कोई व्यक्ति प्रतिकर / प्रतिपूर्ति का हकदार नहीं होगा,
(ख) सरकार का प्रशासनिक विभाग , कार्मिक विभाग और वित्त विभाग के परामर्श से समय-समय पर ऐसे स्थाई या अस्थाई पदों का सृजन कर सकता है , जिन्हें आवश्यक समझा जाय ।
(ग) उत्तराखण्ड शासन, कार्मिक अनुभाग-2 के शासनादेश संख्या-90 /xXx(2)/2016-30(51) 15 दिनांक 26 . 07.2016 तथा समय- समय पर यथासंशोधित में लिपिक वर्गीय सेवा/मिनिस्ट्रीयल संवर्ग के लिए प्राविधानित स्टाफिंग पैटर्न के पद प्रतिशत के अनुसार पदों को पुर्नगठित किया जा सकेगा ।

5. उत्तराखण्ड कारागार प्रशासन एवं सुधार सेवा विभाग (लिपिक वर्गीय) सेवा में विभिन्न श्रेणियों के पदों पर भर्ती निम्नलिखित स्रोतों से की जायेंगीः-
(1) मुख्य मौलिक रूप से नियुक्त ऐसे वरिष्ठ प्रशासनिक अधिकारी, प्रशासनिक जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम् अधिकारी 01 वर्ष की सेवा पूर्ण कर ली हो तथा अधीनस्थ पदों पर कम से कम 22 वर्ष की सेवा पूर्ण की हो, में से 'अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता' के आधार पर पदोन्नति द्वारा ।

(2) वरिष्ठ प्रशासनिक अधिकारी
मौलिक रूप से नियुक्त ऐसे प्रशासनिक अधिकारी , जिन्होंनें भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम 2 वर्ष की सेवा पूर्ण कर ली हो अथवा अधीनस्थ पदों पर कम से कम 20 वर्ष की सेवा पूर्ण की हो , में से अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर पदोन्नति द्वारा ।
(3) प्रशासनिक अधिकारी
मौलिक रूप से नियुक्त ऐसे प्रधान सहायक, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम 3 वर्ष की सेवा पूर्ण कर ली हो अथवा अधीनस्थ पदों पर कम से कम 17 वर्ष की सेवा पूर्ण की हो, में से अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर पदोन्नति द्वारा ।
(4) प्रधान सहायक
मौलिक रूप से नियुक्त ऐसे वरिष्ठ सहायक , जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम 3 वर्ष की सेवा पूर्ण कर ली हो तथा अधीनस्थ पदों पर कम से कम 10 वर्ष की सेवा पूर्ण की हो, में से अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर पदोन्नति द्वारा ।
(5) वरिष्ठ सहायक
मौलिक रूप से नियुक्त ऐसे कनिष्ठ सहायक, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में न्यूनतम 6 वर्ष की सेवा पूर्ण कर ली हो, में से अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर पदोन्नति द्वारा ।
(एक)
सहायक (6) कनिष्ठ
70 प्रतिशत पदों पर सीधी भर्ती नियम 8 में यथा उपबंधित शैक्षिक अर्हता और अन्य उपबन्धों के आधार पर नियम 16 में निर्दिष्ट चयन प्रक्रिया/ उत्तराखण्ड अधीनस्थ सेवा चयन आयोग के माध्यम से सीधी भर्ती द्वारा की जायेगी ।
(
दो) सेवा में कनिष्ठ सहायक के कुल पदों के 25 प्रतिशत रिक्तियां नियुक्ति. प्राधिकारी द्वारा समय- समय पर जारी किए गए सरकारी आदेशों के अनुसार समूह 'घ' के ऐसे कर्मचारियों में से 15 प्रतिशत, जो हाईस्कूल की परीक्षा उत्तीर्ण हों तथा 10 प्रतिशत, जो इण्टरमीडिएट की परीक्षा उत्तीर्ण हों , पदोन्नति द्वारा भरी जायेंगी ;
परन्तु यह कि यदि समूह 'घ' में नियमित पात्र कर्मचारी कार्यरत उपलब्ध न हों, तो उस सीमा तक लिपिक वर्गीय कर्मचारी वर्ग के कनिष्ठ सहायक पद में समूह 'घ' से पदोन्नति हेतु चिन्हित रिक्त पदों को सीधी भर्ती के माध्यम से भरा जा सकेगा ।
(तीन
) लिपिक संवर्ग के कनिष्ठ सहायक के कुल पदों के 05 प्रतिशत रिक्तयां नियुक्ति प्रांधिकारी द्वारा वाहन चालकों, जो हाईस्कूल की परीक्षा अथवा उससे उच्चतर परीक्षा उत्तीर्ण हों, में से पदोन्नति द्वारा ;

परन्तु यह कि यदि वाहन चालकों में नियमित पात्र कर्मचारी कार्यरत उपलब्ध न हों, तो उस सीमा तक लिपिक वर्गीय कर्मचारी वर्ग के कनिष्ठ सहायक पद में वाहन चालक से पदोन्नति हेतु चिन्हित रिक्त पदों को उस कार्यालय के समूह 'घ' के कर्मचारियों से पदोन्नति द्वारा भरा जा सकेगा ।

आरक्षण 6. उत्तराखंण्ड राज्य की अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्ग , आर्थिक रूप से कमजोर वर्ग तथा अन्य श्रेणियों के अभ्यर्थियों के लिये आरक्षण भर्ती के समय प्रवृत्त उत्तराखण्ड सरकार के आदेशों के अनुसार प्रदान किया जायेगा ।
भाग- चार अर्हताएं
7. सेवा में किसी पद पर सीधी भर्ती के लिये यह आवश्यक है कि अभ्यर्थी- राष्ट्रीयता
(क) भारत का नागरिक हो, या
(ख) तिब्बती शरणार्थी हो, जो भारत में स्थायी निवास के अभिप्राय से 01 जनवरी , 1962 के पूर्व भारत आया हो , या
(ग) भारतीय मूल का ऐसा व्यक्ति हो जिसने भारत में स्थायी निवास के अभिप्राय से पाकिस्तान, बर्मा , श्रीलंका या किसी पूर्वी अफ्रीकी देश केन्या, युगाण्डा या यूनाइटेड रिपब्लिक ऑफ तन्जानिया (पूर्ववर्ती तांगनिका और जंजीबार) से प्रवर्जन किया हो:
परन्तु, उपर्युक्त श्रेणी (ख) या (ग) के अभ्यर्थी को ऐसा व्यक्ति होना चाहिए जिसके पक्ष में सरकार द्वारा पात्रता का प्रमाण- पत्र जारी किया गया हो ,
परन्तु, उपयुक्त श्रेणी (ख) के अभ्यर्थी से यह भी अपेक्षां की जायेगी कि वह पुलिस महानिदेशक, अभिसूचना शाखा उत्तराखण्ड से पात्रता का प्रमाण-पंत्र प्राप्त कर लें :
परन्तु, यह भी कि यदि कोई अभ्यर्थी उपर्युक्त श्रेणी (ग) का हो, तो पात्रता का प्रमाण - पत्र एक वर्ष से अधिक अवधि के लिए जारी नहीं किया जायेगा और ऐसे अभ्यर्थी को एक वर्ष की अवधि के आगे सेवा में इस शर्त पर रहने दिया जायेगा कि वह भारत की नागरिकता प्राप्त कर लें ।
टिप्पणीः ऐसे अभ्यर्थी को जिसके मामले में पात्रता का प्रमाण-पत्र आवश्यक हो, किन्तु वह न तो जारी किया गया हो और न ही देने से इन्कार किया गया हो, किसी परीक्षा या साक्षात्कार में सम्मिलित किया जा सकता है और उसे इस शर्त पर अनन्तिमं रूप से नियुक्त किया जा सकता है कि आवश्यक प्रमाण-पत्र उसके द्वारा प्राप्त कर लिया जाय या उसके पक्ष में जारी कर दिया जाये ।
8. सेवा में विभिन्न पदों पर सीधी भर्ती के लिए निम्नलिखित अर्हताएं होनी शैक्षिक अर्हताएं
चाहिए:-

(एक) सीधी भर्ती के लिए आवश्यक है कि अभ्यर्थी ने
कनिष्ठ सहायक
उत्तर प्रदेश माध्यमिक शिक्षा परिषद अथवा उत्तराखण्ड विद्यालयी शिक्षा परिषद से इण्टरमीडिएट परीक्षा उर्तीण की हो या सरकार द्वारा उसके समकक्ष घोषित कोई अन्य परीक्षा उत्तीर्ण की हो ।
(दो) कम्प्यूटर हिन्दी टंकण दक्षता में न्यूनतम 4000 KDPH (की-डिप्रेशन प्रति घण्टा) की गति होनी चाहिए । अधिमानः- अंग्रेजी टंकण दक्षता में ज्ञान रखने वाले अभ्यर्थी को अधिमान दिया जायेगा ।

अनिवार्य/ 9. कनिष्ठ सहायक सीधी भर्ती के पदों पर आवेदन हेतु अनिवार्य /वांछनीय वांछनीय
अर्हता
अर्हताएं उत्तराखण्ड लोक सेवा अयोग की परिधि के अन्तर्गत तथा लोक सेवा आयोग की परिधि के बाहर समूह ' ग' के पदों की भर्ती के लिए अनिवार्य / वांछनीय अर्हता नियमावली, 2010 तथा समय - समय पर यथासंशोधित नियमावलियों के अनुसार होगी ।
अधिमानी अर्हताएं
10. अन्य बातों के समान होने पर सीधी भर्ती के मामले में ऐसे अभ्यर्थी को अधिमान दिया जायेगा, जिसने
(एक) प्रादेशिक सेना में न्यूनतम दो वर्ष की अवधि तक सेवा की हो, या
(दो) राष्ट्रीय कैडेट कोर का 'बी' अथवा ' सी' प्रमाण पत्र प्राप्त किया हो ।
आयु
11. सीधी भर्ती के लिये यह आवश्यक है कि अभ्यर्थी ने उस कैलेण्डर वर्ष की, जिसमें रिक्तियाँ विज्ञापित की जायें, उस वर्ष की पहली जुलाई को न्यूनतम 18 वर्ष की आयु प्राप्त कर ली हो औरं 42 वर्ष से अधिकतम आयु प्राप्त न की हो अथवा सरकार द्वारा समय- समय पर जितनी आयु विनिर्दिष्ट की जाये :
परन्तु अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्ग और ऐसी अन्य श्रेणियों के अभ्यर्थियों जो सरकार द्वारा समय - समय पर अधिसूचित की जाये , उच्चतर आयु सीमा उतने वर्ष बढ़ायी जाये , जितनी राज्य सरकार द्वारा विनिर्दिष्ट की जाये ।
चरित्र 12. सेवा में किसी पद पर सीधी भर्ती के लिये अभ्यर्थी का चरित्र ऐसा होना चाहिए , जिससे वह सरकारी सेवा में सेवायोजन के लिये सर्वथा उपयुक्त हो । नियुक्ति प्राधिकारी इस सम्बन्ध में समाधान कर लेगा । टिप्पणीः संघ सरकार या राज्य सरकार या स्थानीय प्राधिकारी द्वारा या संघ सरकार या राज्य सरकार के स्वामित्व में या नियंत्रणाधीन किसी निगम या निकाय द्वारा पदच्युत व्यक्ति सेवा में किसी पद पर नियुक्ति के पात्र नहीं होगें । नैतिक अधमता के किसी अपराध के लिए दोषसिद्ध व्यक्ति भी पात्र नहीं होंगे ।
वैवाहिक प्रास्थिति
13. सेवा में किसी पद पर नियुक्ति के लिये ऐसा कोई पुरूष अभ्यर्थी पात्र नही होगा जिसकी एक से अधिक पत्नी जीवित हो और ऐसी महिला अभ्यर्थी पात्र नही होगी जिसका एक से अधिक पति जीवित हो:
परन्तु यदि सरकार को समाधान हो जाय कि ऐसा करने के लिये विशेष कारण है , तो वह किसी व्यक्ति को इस नियम के प्रर्वतन से मुक्त कर सकेगी ।
शारीरिक
स्वस्थता
14. किसी भी ऐसे अभ्यर्थी को सेवा में किसी पद पर नियुक्त नहीं किया जायेगा, यदि वह मानसिक और शारीरिक रूप से स्वस्थ नही है और वह किसी ऐसे शारीरिक दोष से मुक्त नही है, जिसके कारण उसे अपने कर्तव्यों का दक्षतापूर्वक पालन करने में बाधा पड़ने की सम्भावना हो । किसी अभ्यर्थी को नियुक्ति के लिये अन्तिम रूप से अनुमोदित किये जाने से पूर्व उससे यह अपेक्षा की जायेगी कि वह वित्तीय हस्तपुस्तिका खण्ड-2 , भाग-3 के अध्याय -3 में समाविष्ट मूल नियम 10 के अधीन बनाये गये नियमों के अनुसार स्वस्थता प्रमाण-पत्र प्रस्तुत करे:
परन्तु यह भी कि निःशक्तजन अधिकार अधिनियम , 2016 की धारा 33 के क्रम में इस हेतु चिन्हित पदों तथा धारा 34 के अन्तर्गत चिन्हित श्रेणियों में दिव्यांगों को नियमानुसार नियुक्ति देने से मना नही किया जायेगा:

परन्तु पदोन्नति द्वारा भर्ती किए गये अभ्यर्थियों से स्वस्थता प्रमाण-पत्र की अपेक्षा नहीं की जायेगी ।
भाग- पाँच
भर्ती की प्रक्रिया
रिक्तियोंकी15. अवधारणा
नियुक्ति प्राधिकारी वर्ष के दौरान भरी जाने वाली रिक्तियों की संख्या और नियम 6 के अधीन उत्तराखण्ड की अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्ग, आर्थिक रूप से कमजोर वर्ग तथा अन्य श्रेणियों के अभ्यर्थियों के लिये आरक्षित की जाने वाली रिक्तियों की संख्या भी अवधारित करेगा और आयोग के माध्यम से भरी जाने वाली रिक्तियों की सूचना आयोग को देगा ।
सीधी भर्ती 16. की प्रक्रिया
इस नियमावली के अधीन सीधी भर्ती के पदों पर भर्ती उत्तराखण्ड (लोक सेवा आयोग क्षेत्र के बाहर) समूह ' ग' के पदों पर सीधी भर्ती की प्रक्रिया नियमावली , 2008 समय- समय पर यथासंशोधित के प्राविधानों के अनुसार उत्तराखण्ड अधीनस्थ सेवा चयन आयोग के माध्यम से सीधी भर्ती द्वारा की जायेगी ।
पदोन्नति द्वारा भर्ती की प्रक्रिया 17. (1 ) पदोन्नति द्वारा भर्ती अनुपयुक्त को अस्वीकार करते हुये ज्येष्ठता के आधार पर उत्तराखण्ड विभागीय पदोन्नति समिति का गठन (लोक सेवा आयोग की परिधि के बाहर के पदों के लिए) नियमावली , 2002 समय-समय पर यथासंशोधित के उपबन्धों के अनुसार निम्नवत विभागीय चयन समिति गठित कर की जायेगीः-
अध्यक्ष
(क) विभागाध्यक्ष/ नियुक्ति प्राधिकारी-
सदस्य
(ख) अपर विभागाध्यक्ष / समकक्ष प्राधिकारी-
(ग) नियुक्ति प्राधिकारी द्वारा नाम निर्दिष्ट दो राजपत्रित अधिकारी-
सदस्य
(एक) नियुक्ति प्राधिकारी अभ्यर्थियों की ज्येष्ठता के आधार पर पांत्रता सूची उत्तराखण्ड (लोक सेवा आयोग की परिधि के बाहर के पदों पर) चयनोन्नति पात्रता सूची नियमावली, 2003 समय- समय पर यथासंशोधित के अनुसार तैयार करेगा और उनकी चरित्र पंजिकाओं और उनसे सम्बन्धित अन्य ऐसे अभिलेखों के साथ, जों उचित समझे जायें , विभागीय चयन समिति के समक्ष रखेगा ।
(दो) विभागीय चयन समिति खण्ड (एक) में निर्दिष्ट अभिलेखों के आधार पर अभ्यर्थियों की भर्ती के समय प्रवृत्त सरकार के आदेशों के अनुसार एक सूची तैयार करेगी और उसे ज्येष्ठता कम में नियुक्ति प्राधिकारी को अग्रसारित करेगी ।
(2) ' कनिष्ठ सहायक' के 30 प्रतिशत पदों पर भर्ती उत्तराखण्डं कारागार प्रशासन एवं सुधार सेवा विभाग के मौलिक रूप से नियुक्त समूह 'घ ' एवं वाहन चालक कार्मिकों में से जैसा कि नियम 5 (6) (दो) व (तीन) में निर्दिष्ट है, की पदोन्नति निम्नलिखित प्रक्रिया से की जायेगीः- भाग 1 ]

(एक) लिपिक वर्ग कनिष्ठ सहायक के पदों पर भर्ती उत्तराखण्ड कारागार प्रशासन एवं सुधार सेवा विभाग में कार्यरत श्रेणी 'घ एवं वाहन चालक जो 05 वर्ष की नियमित सेवा पूर्ण कर चुके हों, पात्रता क्षेत्र में आयेंगे । समूह 'घ' एवं वाहन चालक से पदोन्नति हेतु, लिपिक वर्ग कनिष्ठ सहायक के पदों पर भर्ती के लिए आरक्षित रिक्तियों पर चयन, श्रेष्ठता के आधार पर एक साधारण परीक्षा लेकर किया जायेगा । परीक्षा में केवल एक प्रश्नपत्र होगा, जिसमें सामान्य हिन्दी, सामान्य ज्ञान एवं सामान्य अध्ययन से सम्बन्धित वस्तुनिष्ठ प्रकार के प्रश्न होंगे । लिखित परीक्षा अधिकतम 40 अंक की होगी तथा पात्र कर्मचारी की वार्षिक चरित्र पंजिका हेतु 10 अंक होंगे । चतुर्थ श्रेणी एवं वाहन चालक पद पर कार्य अनुभव हेतु प्रत्येक वर्ष के लिए 02 अंक दिए जायेंगे तथा कार्य अनुभव के लिए अधिकतम 50 अंक निर्धारित किए जायेंगे । इस प्रकार चयन परीक्षा कुल 100 अंको की होगी ।
(दो) उपरोक्त उपरोक्त के अतिरिक्त 50 अंकों की हिन्दी में टंकण परीक्षा भी ली जाएगी । टंकण परीक्षा में 2400 की डिप्रेशन प्रति घण्टा की गति से कम टंकण करने वाले अभ्यर्थी अर्ह नहीं होंगे । इस प्रकार चयन परीक्षा कुल 150 की होगी;
परन्तु यह कि उत्तराखण्ड सरकारी सेवक (पदोन्नति द्वारा भर्ती के लिए मानदण्ड) नियमावली 2004 के उपबंध इस नियमावली के अधीन की जाने वाली पदोन्नति पर लागू नहीं होंगे ।
भाग - छः नियुक्ति, परिवीक्षा, स्थायीकरण और ज्येष्ठता
नियुक्ति 18. (1 ) नियुक्ति प्राधिकारी अभ्यर्थियों के नाम उसी क्रम में लेकर, जिसमें वे यथास्थिति, नियम 16 या 17 के अधीन तैयार की गई सूची में आये हों, नियुक्तियां करेगा ।
(2) यदि किसी एक चयन के सम्बन्ध में नियुक्ति के एक से अधिक आदेश जारी किये जायें , तो एक संयुक्त आदेश भी जारी किया जायेगा, जिसमें चयनित व्यक्तियों के नामों का उल्लेख ज्येष्ठता क्रम में किया जायेगा, जैसे यथास्थिति चयन में अवधारित की जाय या जैसे कि उस संवर्ग में हो जिसमें उन्हें पदोन्नत किया गया हो ।
परिवीक्षा 19. (1) सेवा या किसी स्थायी पद पर या उसके विरूद्ध रिक्त पद पर नियुक्त व्यक्ति एक वर्ष की अवधि के लिए परिवीक्षा पर रखा जायेगा ।
(2) नियुक्ति प्राधिकारी पृथक- पृथक मामले में परिवीक्षा का दिनांक विनिर्दिष्ट करते हुये , जब तक अवधि बढ़ायी गयी है , अवधि बढ़ा सकता है , जिसके कारण अभिलिखित करने होंगे :
परन्तु उपबन्ध यह है कि अपवादिक परिस्थितियों के सिवाय परिवीक्षा अवधि एक वर्ष से अधिक और किसी भी 1424

परिस्थिति में दो वर्ष से अधिक नहीं बढ़ायी जायेगी ।
(3) यदि नियुक्ति प्राधिकारी को प्रतीत होता है कि परिवीक्षा अवधि के दौरान किसी समय या परिवीक्षा अवधि की समाप्ति अथवा परिवीक्षा की बढ़ाई गयी अवधि में किसी परिवीक्षाधीन द्वारा अपने अवसरों का पर्याप्त उपयोग नहीं किया गया है या अन्यथा समाधान प्रदान करने में असफल रहा है, तो उसे उसके मूल पद पर यदि कोई है , प्रत्यावर्तित किया जा सकेगा या यदि उसका किसी पद पर धारणाधिकार नहीं है , तो उसकी सेवाएं समाप्त की जा सकेगी ।
(4) ऐसे परिवीक्षाधीन व्यक्ति जिसे उपनियम (3) के अधीन प्रत्यावर्तित कर दिया गया हो या जिसकी सेवाएं समाप्त कर दी गई है, किसी प्रतिकर का हकदार नहीं होगा ।
(5) नियुक्ति प्राधिकारी परिवीक्षा अवधि की संगणना के प्रयोजन हेतु उस निरन्तर सेवा को गिने जाने की अनुमति दे सकेगा, जो उस विशिष्ट संवर्ग में शामिल किये गये पद पर या किसी समान अथवा उच्चतर पद पर स्थानापन्न या अस्थाई रूप में प्रदान की गयी हो ।
स्थायीकरण 20. किसी परिवीक्षाधीन व्यक्ति को परिवीक्षा अवधि या बढ़ाई गयी परिवीक्षा अवधि की समाप्ति पर उसकी नियुक्ति में स्थायी कर दिया जायेगा, यदि-
(क) उसका कार्य और आचरण सतोषजनक बताया गया हो,
(ख) उसकी सत्यनिष्ठा अभिप्रमाणित हो, और
(ग) नियुक्ति प्राधिकारी को यह समाधान हो जाये कि वह स्थायी किये जाने हेतु अन्यथा उपयुक्त है ।
(घ) विहित विभागीय परीक्षा यदि कोई है, उत्तीर्ण कर ली गयी हो ,
ज्येष्ठता 21. मौलिक रूप से नियुक्त व्यक्तियों की ज्येष्ठता उत्तराखण्ड सरकारी सेवक ज्येष्ठता नियमावली , 2002 समय- समय पर यथासंशोधित में निहित प्राविधानों के अनुसार अवधारित की जायगी ।
भाग - सात
वेतन इत्यादि
वेतनमान 22. (1) सेवा में विभिन्न श्रेणियों के पदों पर नियुक्त व्यक्तियों का अनुमन्य वेतनमान ऐसा होगा, जैसा सरकार द्वारा समय - समय पर अवधारित किया जाय ।
(2) इस नियमावली के प्रारम्भ होने के समय विभिन्न श्रेणियों के पदों के प्रवृत्त वेतनमान संलग्न परिशिष्ट- 'ख ' के अनुसार होंगे ।
परिवीक्षा अवधि में
23. (1) मूल नियमों में किसी प्रतिकूल उपबन्ध के होते हुए भी परिवीक्षाधीन व्यक्ति को यदि वह पहले से स्थायी सरकारी सेवा भाग 1 ]

वेतन
में न हो, समयमान में उसकी प्रथम वेतन वृद्धि तभी दी जायेगी, जब उसने एक वर्ष की संतोषजनक सेवा पूरी कर ली हो और द्वितीय वेतन वृद्धि दो वर्ष की सेवा के पश्चात् तभी दी जायेगी जब उसने परिवीक्षा अवधि पूरी कर ली हो और उसे स्थायी भी कर दिया गया हो :
परन्तु यह कि यदि संतोषजनक सेवायें प्रदान न कर सकने के कारण परिवीक्षा अवधि बढ़ाई जाय तो इस प्रकार बढ़ायी गयी अवधि की गणना वेतन वृद्धि के लिये तब तक नही की जायेगी, जब तक कि नियुक्ति प्राधिकारी अन्यथा निर्देश न दे ।
(2) ऐसे व्यक्ति जो पहले से सरकार के अधीन कोई पद धारण कर रहा हो , परिवीक्षा अवधि में वेतन, संगत मूल नियमों द्वारा विनियमित होगा;
परन्तु यदि संतोषजनक सेवायें प्रदान न कर सकने के कारण परिवीक्षा अवधि बढ़ाई जाय तो इस प्रकार बढ़ायी गयी अवधि की गणना वेतन वृद्धि के लिये तब तक नहीं की जायेगी , जब तक कि नियुक्ति प्राधिकारी अन्यथा निर्देश न दे ।
(3) ऐसे व्यक्ति जो पहले से स्थायी सरकारी सेवा में हो, का परिवीक्षा अवधि में वेतन, राज्य के कार्यकलाप के सम्बन्ध में सेवारत सरकारी सेवकों पर सामान्यतः लागू सुसंगत नियमों द्वारा विनियमित होगा ।
भाग-आठ
अन्य उपबन्ध
सेवा क्षेत्र 24. उत्तराखण्ड कारागार प्रशासन एवं सुधार सेवा विभाग लिपिक वर्गीय सेवा के कार्मिकों का पदस्थापन / स्थानान्तरण मुख्यालय कार्यालय एवं अधीनस्थ कार्यालयों में कहीं भी किया जा सकेगा ।
पक्ष समर्थन 25. किसी पद पर या सेवा में लागू नियमो के अधीन अपेक्षित सिफारिशों से भिन्न किन्ही सिफारिशों पर चाहे लिखित या मौखिक हो, विचार नहीं किया जायेगा । किसी अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिये प्रत्य क्ष या अप्रत्यक्ष रूप से समर्थन प्राप्त करने के प्रयास का प्रमाण उसे नियुक्ति के लिए अनर्ह कर देगा ।

PART-I -General
1.
Short title and Commencement
(1) These rules may be called the Uttarakhand Prison Administration and Correctional Services Department (Ministerial Cadre) Service Rules , 2024.
(2) It shall come into force at once .
Status of the Service
2. The Uttarakhand Prison Administration and Correctional Service Department (Ministerial Cadre ) service is a service which comprises of Group "B " and "C" posts .
Definitions
3. In these rules , unless there is anything repugnant in the subject or context : -
a. "Appointing Authority " means the Inspector General Prison Administration and Correctional Service Department, Uttarakhand;
b. "Citizen of India " means a person who is or is deemed to be a citizen of India under part II of the Constitution of India;
c. " Commission " means the Uttarakhand Subordinate Selection Service Commission;
d . " Constitution " means the Constitution of India;
e. " Department " means the Prison Administration and Correctional Service Department, Uttarakhand;
f. "Headquarter" means the Headquarter of the 1428

Uttarkhand Prison Administration Correctional Service Department; and
g . "Governor" means the Governor of Uttarakhand;
h . "Government " means the State Government of Uttarakhand;
i. "Year of recruitment " means a period of twelve months commencing from the first day ofJuly of the calendar year .
j. "Member of the Service " means a person substantively appointed under these rules or rules or orders before commencement of this rules;
k. " Service" means the Uttarakhand Prison Administration and Correctional Service Department Ministerial Cadre Service ;
1. " Subordinate offices " means the all the Prisons/ Offices under the control of the Headquarter of the Uttarakhand Prison Administration and Correctional Service Department;
m. "Subordinate posts" means services done on the any of the posts of Junior Assistant , Senior Assistant , Head Assistant , Administrative officer and Senior Administrative officer ;
n. " Substantive appointment" means an appointment, not being an ad-hoc appointment, on a post in the cadre of the service and made after selection in accordance with the rules and , if there were no rules , in accordance with the procedure prescribed for the time being by executive instructions issued by the Government.
PART- II
CADRE
Cadre of Service 4. 1. The strength of the employees / officers in the service and each category of posts therein shall be such as may be determined by the Governor from time to time.

Provided that-
(a) The Appointing Authority may leave unfilled or the Government may hold in abeyance any vacant post, without thereby entitling any person to the compensation;
( b ) Administrative Department of the Government may with the consultation of Personnel Department and the Finance Department, create such permanent or temporary posts, from time to time , as may be required;
(c) The post of staffing pattern to ministerial cadre service in accordance with the Government order No. 90/XXX(2)/2016-30 (51 ) 15 dated 26-07-2016 of Personnel Section-2, Government of Uttarakhand and as amended from time to time posts may be reorganized according to percentage.
PART - III
RECRUITMENT
5.
Source of Recruitment
The recruitment on various categories posts of the Uttarakhand Prison Administration and Correctional Service Department (Ministerial Cadre) Service shall be made from the following sources : -
(1)Chief

By promotion, from amongst such substantively appointed Senior Administrative Officers who have completed minimum one year service and have completed 22 years of service as such on the first day of the year of recruitment , on the basis of seniority, subject to the rejection ofunfit .
(2) Senior

By promotion, from amongst such substantively appointed Administrative Officers who have completed minimum 2 years service or have completed 20 years of service on sub - ordinate posts as such on the first day of the year of recruitment, on the basis of seniority, subject to the rejection of 1430

Officer
By promotion , from amongst such substantively appointed Head Assistant who have completed 3 years service or have completed 17 years of service on sub ordinate posts as such on the first day of the year of recruitment, on the basis of seniority, subject to the rejection of unfit.
(4) Head Assistant
By promotion, from amongst such substantively appointed Senior Assistant who have completed 3 years service and have completed 10 years of service as such on the first day of the year of recruitment, on the basis of seniority, subject to the rejection of unfit .
(5) Senior Assistant
By promotion from amongst such substantively appointed Junior Assistant who have completed 6 years service as such on the first day of the year of recruitment , on the basis of seniority, subject to the rejection of unfit .
(6) Junior Assistant
(i) Direct recruitment on 70 percent post shall be done on the basis of educational qualification and other provision provided in rule 8 in accordance with selection procedure specified in rule 16, through the Uttarakhand Subordinate Service Selection Commission by direct recruitment ;
(ii) Out of 25 percent vacancies of the total posts of Junior Assistant shall be filled by promotion by Appointing Authority in भाग 1 ]

accordance with the Government order issued from time to time, 15 percent from such employees of group "D" who have passed high school and 10 percent from those who have passed intermediate:
Provided that if no regular eligible employees in group "D " is available , then the posts identified from promotion of Junior Assistant posts in ministerial cadre from group "D " may be filled through direct recruitment .
(iii) 5 percent vacancies of Junior Assistant in ministerial cadre shall be filled by promotion from amongst the drivers who have passed high school or higher examination, by the Appointing Authority:
Provided that the if no regular eligible employees are available in the driver, then the posts identified for promotion to Junior Assistant posts ministerial cadre from the drivers may be filled by group "D" employees , by promotion.

Reservation
6. Reservation for the candidates belonging to the Scheduled Castes, Scheduled Tribes , Others Backward Classes , Économically Weaker Sections and other category belonging to the State of Uttarakhand shall be in accordance with the orders of the Government in force at the time of the recruitment.

PART- IV QUALIFICATIONS
Nationality
7. A candidate for direct recruitment to be a post in service mustbe-
(a) A citizen of India; or
(b) A Tibetan refugee who came over to India before the 1st January, 1962 with the intention of permanently settling in India; or
( c) a person of Indian origin who has migrated from Pakistan , Burma, Sri Lanka or any of the east African countries of Kenya, Uganda and the United Republic of Tanzania (formerly Tanganyika and Zanzibar) with the intention of permanently settling in India:
Provided that a candidate belonging to category (b) or (c) mentioned above must be a person in whose favor a certificate of eligibility has been issued by the Government:
Provided further that a candidate belonging to category (b) shall also be required to obtain certificate of eligibility granted by the Inspector General of Police , Intelligence Branch, Uttarakhand:
Provided also that if a candidate belongs to category ( c) mentioned above, no certificate of eligibility shall be issued for a period of more than one year and the retention of such a candidate in service beyond a period of one year, shall be subject to his acquiring Indian citizenship .
Note: - A candidate in whose case certificate of eligibility is necessary but the same has neither been issued nor rejected , may be admitted to an examination or interview and he may also be provisionally appointed subject to the necessary certificate being obtained by him or issued in his favour.
Academic Qualification
8. For direct recruitment on various posts in the service , the candidate must have the following qualifications : -

(i ) For direct recruitment, it is essential that candidate have passed intermediate examination from Board of High School and Intermediate Education, Uttar Pradesh or Board of School Education, Uttarakhand or passed any examination declared equivalent byGovernment ;
(ii) Minimum 4000 KDPH (key depression per hour) in Computer Hindi Typing .

Preference : Preference shall be given to candidate having knowledge in English Typing.
Essential/ desirable qualification
9. The Qualification shall be according to the Essential/Desirable Qualification for the Recruitment of Junior Assistant post within the Purview of Uttarakhand Public Service Commission and Outside the Purview of the Public Service Commission Rules , 2010 as per rules amended from time to time .
Preferential Qualification
10. A candidate shall , other things being equal , be given preference in the matter of direct recruitment, who has : -
( i ) Served in the Territorial Army for a minimum period of two years ; or
(ii) Obtained a " B " or " C " certificate of National Cadet Corps,
Age
11. A candidate for direct recruitment, must have attained the age of 18 years and must not have attained the age of more than 42 years on the first day of July of the Calendar year in which vacancies are advertised or the age as specified Government from time to time:
Provided that the upper age limit in the case of candidates belonging to the Scheduled Castes , Scheduled Tribes and such other categories as may be notified by the Government from time to time shall be greater by such number of years as may be specified by State Government .
Character
12. The character of a candidate for direct recruitment to a post in the service should be such that he is suitable in all respects for employment in Government service . The Appointing Authority shall satisfy himself in this regard .
Note-A person dismissed by the Union Government or a State Government or by a local authority or a corporation or Body owned or controlled by the Union Government or State Government shall not be eligible for appointment to any post in the service . A persons convicted of an offence involving moral turpitude shall alsobe ineligible.
Marital Status
13. Amale candidate who has more than one wife living or a female candidate who has more than one husband living shall not be eligible for appointment to a post in the service:

that there exist special ground for doing so, exempt any person from the operation of this rule.
Physical Fitness 14. No candidate shall be appointed to a post in the service unless he be in a good mental and bodily health and free from any physical defect likely to interfere with the efficient performance of his duties . Before a candidate is finally approved for appointment he shall be required to produce a certificate of in accordance with the rules framed under Fundamental Rule 10 contained in Chapter III of the Financial Handbook , Volume II, Part III :
Provided that in order of section 33 , the posts identified for this and the categories identified under section 34 of the Rights of Persons with Disabilities Act, 2016 (Act No. 49 of 2016) , the disabled shall not be denied for appointment as per rules :
Provided further that a medical certificate of fitness shall not be required from a candidate recruited by promotion.
PART -V
PROCEDURE FOR RECRUITIMENT
Determination of vacancies
15. The Appointing Authority shall determine number of vacancies to be filled during the course of the year and also the number of vacancies to be reserved for candidates belonging to Scheduled Castes , Scheduled Tribes , Other Backward Classes , Economically Weaker Sections and Other Categories belonging to State of Uttarakhand under rule 6 and shall intimate to the Commission , the vacancies , to be filled through Commission.
Procedure for direct recruitment
16. Recruitment on the posts of direct recruitment under these rules shall be made by direct recruitment through the commission in accordance with the provisions of the Uttarakhand Procedure for Direct Recruitment For Group "C" Posts (outside the purview of the Uttarakhand Public Service Commission) Rules , 2003 ( as amended from time to time) .
Procedure for recruitment by promotion
17. ( 1) Recruitment by promotion shall be made on the basis of seniority, subject to the rejection of unfit, through the following departmental selection committee constituted under the provisions of the Uttarakhand Constitution of Departmental Promotion Committee (for posts outside the भाग 1 ]

purview of the Public Service Commission) Rules , 2002 (as amended from time to time)-
(a)Head ofdepartment/ Appointing Authority- Chairman ;
(b) Additional Head of Department/Equivalent Authority Member;
(c) Two Gazetted officers nominated by the Appointing Authority- Member ;
(i) The Appointing Authority shall prepare an eligibility list ofthe candidates on the basis of seniority in accordance with the Uttarakhand Promotion by Selection (on the posts outside the purview of the Public Service Commission) Eligibility List Rules, 2003 (as amended from time to time) and present it before the departmental selection committee along with their character rolls and such other records pertaining to them, as may be considered proper.
(ii) The departmental selection committee shall prepare the list of candidates on the basis of records , referred in clause (i) , according to the orders of Government at the time of recruitment and forward the same to Appointing Authority in order of seniority.
(2) Recruitment by promotion on 30 percent posts shall be made from amongst the employees substantively appointed as group "D" and drivers in the Uttarakhand Prison Administration and Correctional Service Department as specified in rule 5 (6) (ii) and (iii) , by the following procedure:-
(i) For the recruitment on the post of ministerial cadre Junior Assistant, the group "D" employees and drivers working in the Uttarakhand Prison administration and Correctional Service Department who have completed 05 years of regular service shall be considered the eligible . The selection on the posts by promotion of ministerial cadre Junior Assistant reserved for group "D " and drivers shall be made in the basis of merit by taking a general examination . There shall be only one question paper in the examination, consisting objective type question relating to General Hindi , General knowledge and General studies .

The written examination shall be of maximum 40 marks and 10 marks shall be for the annual character register of the eligible employee . Two marks per year shall be given for work experience on the posts of IVth class and driver and maximum 50 marks shall be awarded for work experience . Thus the selection examination shall be of 100 marks.
(ii)Apart from the above , Hindi typing test of 50 marks in shall be taken . The candidate typing less than 2400 key depression per hour in typing examination shall be ineligible . Thus the total marks of selection examination of 150 marks:
Provided that the provisions of the Uttarakhand Government Servants (Criterion for Recruitment by Promotion) Rules , 2004 shall not apply for the promotion made under these rules .
PART-VI
ΑΡΡΟΙΝΤΜΕNT, PROBATION , CONFIRMATION AND SENIORITY
Appointment 18.
(1) The Appointing Authority shall make appointments by taking the names of the candidates in the same order in which they appear in the list prepared under rule 16 and 17, as the case may be .
(2) If more them one orders of appointment are issued in respect of any one selection a combined order shall also be issued, mentioning the names of the persons , in order of seniority, as determined , in the selection, or as the case may be , as it stood, in the cadre , from which they are promoted.
Probation 19.
(1) A person on substantive appointment to a post in the service shall be placed on probation for a period of one year.
(2) The Appointing Authority may, for reasons to be recorded, extend the period of probation in individual cases specifying the date up to which the period is extended:

Provided that, save in exceptional circumstances , the period ofprobation shall not be extended beyond one year. and in no circumstances beyond two years .
(3) If it appears to the Appointing Authority at any time during or at the end of the period of probation or extended period of probation that a probationer has not made sufficient use of his opportunities , he may be reverted to his substantive post, if any or if he does not have any lien on any post, his services may be dispensed of.
(4) Aprobationer who is reverted or whose services are dispensed with under sub -rule (3 ) shall not be entitled to any compensation .
(5) The Appointing Authority may allow continuous service, rendered in an officiating or temporary capacity in a post included in the cadre or any other equivalent or higher post, to be taken into account for the purpose of computing the period ofprobation .
20.
Confirmation
Aprobationer shall be confirmed in his appointment at the end of the period of probation or the extended period of probation, if-
a. his work and conduct is reported to be satisfactory;
b. his integrity is certified;
(c) the Appointing Authority is satisfied that he is otherwise fit for confirmation;
(d) have passed prescribed departmental examination, if any.
Seniority
21. The seniority of persons appointed on a substantive post in service shall be determined in accordance with the provisions of Uttarakhand Government Servants Seniority Rules , 2002 (as amended from time to time) .
Part- VII
Pay scale etc.
22.
Pay scale
( 1) The scale of pay admissible to persons appointed to the various categories of posts in the service shall be such as may be determined by the Government from time to time.

(2) The scale of pay at the time of the commencement of these rules shall be according to Appendix 'B' .
23.
Payduring probation
(1) Notwithstanding any provisions in the Fundamental Rules to the contrary, a person on probation if he is not already, in permanent Government Service , shall be allowed his first increment in the time scale when he has completed one year of satisfactory service and second increment after two years service when he has completed the probation period and is also confirmed;
Provided that if the period of probation is extended of account of failure to give satisfaction such extension shall not count for increment unless the Appointing Authority directs otherwise.
(2) The pay during probation of a person who was already holding a post under the Government shall be regulated by the relevant fundamental rules ;
Provided that if the period of probation is extended on account of failure to give satisfaction such extension shall not count for increment unless the Appointing Authority directs otherwise.
(3 ) The pay during probation of a person already in permanent Government Service shall be regulated by the relevant rules , applicable generally to Government servants serving in connection with the affairs of the State .
PART-VIII OTHER PROVISIONS
Service area
24. The ministerial cadre service employees of the Uttarakhand Prison Administration and Correctional Service Department may be posted/transferred anywhere, in headquarter office and subordinate offices .
Canvassing
25. No recommendation, either written or oral , other than those required under the rules applicable to the Post or Service shall be taken into consideration. Any attempt on the part of a candidate to enlist support directly or indirectly or indirectly for his candidature shall disqualify him for appointment.
Regulation of other matters
26. In relation to such subjects , which do not fall under these rules orspecial orders , the persons employed in the service shall be regulated by the rules , regulations and orders generally भाग 1 ]

applicable to the serving government servants related to the affairs of the state.
Relaxation from the conditions of service
27. Where the State Government is satisfied that the operation of any rule regulating the conditions of service of persons appointed to the service causes undue hardship in any particular case, it may, notwithstanding anything contained inthe rules applicable to the case, by order, dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner .
Saving
28. Nothing in these rules shall affect reservations and other concessions required for the candidates belong to Scheduled Castes , Scheduled Tribes , Other Backward Categories , Economically Weaker Sections and other categories of persons to the State of Uttarakhand in accordance with the orders of the Government issued from time to time in this regard.

संख्या-1477 / IV ( 3 )/ 2024-11 (03 निर्वा 0 )/ 2022 - नगर पालिका परिषद्, नरेन्द्रनगर , जनपद - टिहरी गढ़वाल के वार्डों के परिसीमन के सम्बन्ध में अधिसूचना का निम्नलिखित प्रारूप जिसे श्री राज्यपाल उत्तराखण्ड ( उत्तर प्रदेश नगर पालिका अधिनियम, 1916) (अनुकूलन एवं उपान्तरण आदेश , 2007 ) की धारा -11 क एवं धारा -11 ख में प्रदत्त शक्तियों का प्रयोग करके जारी करने का प्रस्ताव करते है , उक्त धारा की उपधारा (2 ) की अपेक्षानुसार सम्बद्ध व्यक्तियों की सूचना के लिये आपत्तियां आमंत्रित करने के लिये एतद्वारा प्रकाशित किया जाता है ।
प्रस्तावित अधिसूचना के सम्बन्ध में आपत्तियां , यदि कोई हो, तो वह लिखित रूप में जिलाधिकारी , टिहरी गढ़वाल को प्रेषित की जायेगी । केवल उन्हीं आपत्तियों एवं सुझावों पर विचारं किया जायेगा , जो इस अधिसूचना के प्रकाशन के दिनांक से 07 दिनों के भीतर प्राप्त होंगी ।
प्रस्तावित अधिसूचना
उत्तराखण्ड (उत्तर प्रदेश नगर पालिका अधिनियम, 1916) (अनुकूलन एवं उपान्तरण आदेश , 2007 ) की धारा -11 क एवं धारा -11 ख की उपधारा (1 ) के अधीन शक्ति का प्रयोग करके श्री राज्यपाल संलग्न सूची में उल्लिखित नगर पालिका परिषद्, नरेन्द्रनगर, जनपद- टिहरी गढ़वाल क्षेत्र के वार्डों के परिसीमन के सम्बन्ध में निम्नलिखित आदेश जारी करते हैं: - 1441 उत्तराखण्ड गजट , 21 दिसम्बर , 2024 ई० (अग्रहायण 30 , 1946 शक सम्वत्)

(1 ) निर्वाचनं के प्रयोजन के लिये उक्त नगर पालिका परिषद् क्षेत्र को संलग्न अनुसूची में उल्लिखित वार्डों में विभाजित किया जायेगा ।
(2 ) प्रत्येक वार्ड का परिसीमन ऐसा होगा, जैसा संलग्न अनुसूची के स्तम्भ -1 से 6 में उल्लिखित किया गया है ।

RATE CONTRACT OF MEDICINES
December 03, 2024
Letter No. 15 P/Store / 55 / 2023 / 29177 --In exercise of the power delegated in G.O. No 712/XXVIII- 3-2019-15/2019 dated 27-09-2019 the rate contract of medicine mentioned in Annexure ' B ' is made with the firms mentioned in Annexure 'A' for the supply in the state Government in Medical & Health services Department for the period ending on the following terms and conditions:
1. The firms shall made supplies in manufactures original packing as indicated in columri - 3 of Annexure B for name of makes unless
2. otherwise stated. The supplying firms will be required to clearly mention on the label the name of the manufacturer .
3. The firms will have to give a written warranty in accordance with drugs Act 1940 Rule 19 Para3 (8) to the effect that supplies confirm to the approved standard prescribed in the Drugs rule 1940 enforced and as given in this notifications .
4. Indenting Officers may place order direct on these firms as mentioned is attached Annexure A and B.
5. Delivery Schedule
The Purchaser requires that the medicine , surgical items and chemicals under the Rate Contract shall be delivered within six (06) weeks starting from the date of signing of the Purchase order .
6. All the Medicines /surgical items and chemicals to supply, shall not be older than 1 /6th of interval of manufacturing and expiry date i.e. to say, if any medicine expires after 3 years of its manufacturing date , then at the time of supply the manufacturing date should not be more than 6 months old . Vaccines , biological products and imported medicines/surgical items , the remaining life should be 3 /5th (60 %). In special circumstances , with approval of Director General, MH & FW , an exemption of 3 months may be accepted with the condition that if any of the item(s) may not be used before the date of expiry , the Bidder shall replace remaining quantity of such items , but remaining life of such items should be more than 50 % , for which Bidder had submitted an affidavit .
7. Packing of medicines/drugs /vaccines
6.1 Outside the cartons , all other type of packing's , each vials , ampoules , bottles , medicines & capsule's sterilized safe packing's , the supplier should clearly print U.K. GOVT . SUPPLY, NOT FOR SALE " with indelible ink.
6.2 The Supplier shall provide such packing of the Medicine , surgical items and chemicals as is required to prevent their damage or deterioration during transit to their final destination as indicated in the Contract . The packing shall be sufficient to withstand, without limitation, rough handling during transit and exposure to extreme temperatures , salt and precipitation during transit and open storage . Pačking case size and weights shall take into consideration, where appropriate , the remoteness of the Medicine, surgical items and chemicals' final destination and the absence of heavy handling facilities at all points in transit .

6.3 The packing, marking and documentation within and outside the packages shåll comply strictly with such special requirements as shall be provided for in the Contract including additional requirements , if any , and in any subsequent instructions ordered by the Purchaser .
8. Transportation
Where the Supplier is required under the Contract to transport the Medicine , surgical items and chemicals to a specified place of destination i.e. consignee with in Uttarakhand , transport to such place of destination/consignee in Uttarakhand including insurance , as shall be specified in the Contract, shall be arranged by the Supplier, and the related cost shall be included in the Contract Price.
9. Quality of medicines
8.1 The Supplier shall mandatorily submit in house test report at the time of supply of medicine (s ) , surgical item(s ) and chemical (s) for all the batches .
8.2 All medicine, surgical items and chemicals found of below standard shall be the responsibility of the Supplier .
8.3 Samples of all the batches of medicine , surgical items and chemicals supplied under Contract, shall be tested at reputed Government approved laboratories /institution .
8.4 Maximum permissible limit of the size of tablets , capsules, injection, syrup , iv fluids etc shall be up to rupees 1.0 lakh quantity - 2 batches , above 1.0 lakh and up to 3 lakh quantity- 5 batches , above 3.0 lakh and up to 5 lakh quantity - 7 batches and above 5.0 lakh , 1 batch per lakh quantity. The cost incurred on above quality testing shall be borne by the Purchaser . If Supplier supplies medicines beyond above limit, additional cost incurred on the quality testing shall be deducted from the Bills of the Supplier .
8.5 The Supplier supplying vaccines , serum and biological products shall mandatorily submit a quality assurance certificate from Government laboratory.
8.6 If supplied medicine , surgical items and chemicals are found below standard in testing , the supplier shall have to replace the full stocks of Indent / ordered medicine , surgical items and chemicals quantity , with fresh standard quality medicine , surgical items and chemicals , within 60 days , even if some part of the drug from received stock has been consumed .
8.7 Besides this , the Purchaser will be free to take actions against the Supplier for any compensation.
8.8 The Supplier may be blacklisted and/ or debarred, for a product purchased by indenter, is declared SUB STANDARD , for producing wrong documents , non supply of medicine , surgical items and chemicals under contract or any other errors . The duration of blacklist and /or debar shall be for 3 years .
8.9 If supplied medicine , surgical items and chemicals are found of below standard in testing , in such case all the cost incurred in testing will be borne by the Supplier.
10. Payments
Payment for Medicine , surgical items and chemicals and Services shall be made as follows:
9.1 The Supplier's request (s) for payment shall be made to the Purchaser in writing, accompanied by an invoice in triplicate copies describing, as appropriate, the Medicine , surgical items and chemicals delivered and the Services performed, and upon fulfillment of other obligations stipulated in the contract .

9.2 In case the consignee is other than I/ C Central Ware House Dehradun , then the invoice/bill , in triplicate should have receiving from the consignee (s) , along with stock book page entry , duly verified, signed and stamped by consignee(s).
9.3 Ninety percent (90 %) of the contract price shall be paid within one month of receipt of Invoice as described above of Medicine , surgical items and chemicals from the consignee ( s)
9.4 The invoice shall be raised after complete supply of the Medicines , Surgical Items and Chemicals etc. as per the Purchase Order. Part payment will not be done for a Purchase Order .
9.5 From the supplied product the purchaser will collect samples of all batches on random basis and these samples shall be sent to the State government approved testing center Laboratories . After receiving the successful test results i.e. found of standard quality , the balance payment of 10 % shall be released within 30 days .
9.6 After opening of each Bid and up to the Contract Period, any change in the tax rates shall be applicable as per the Government Orders .
9.7 Those manufacturer or supplier who does not have Depot/ C& F in Uttarakhand , they can supply their product only after they enter into a contract with a local distributor , and will supply their product through such distributor. The bill will be accepted from distributor of Uttarakhand State only.
11. Delays in Supplier's performance
10.1 Delivery of the Medicine , surgical items and chemicals and performance of the Services shall be made by the Supplier in accordance with the time schedule specified by the Purchaser in the Schedule of Requirements/ purchase order .
10.2 If at any time during performance of the Contract , the Supplier or its sub- contractor(s) should encounter conditions impeding timely delivery of the Medicine , surgical items and chemicals and performance of Services , the Supplier shall promptly notify the Purchaser in writing about the fact of the delay , it's likely duration and its cause(s) . As soon as practicable after receipt of the Supplier's notice , the Purchaser shall evaluate the situation and may , at its discretion, extend the Supplier's time for performance with or without liquidated damages , but to a maximum of 21 days .
12. Liquidated damages
If the Supplier fails to deliver any or all of the Medicine , surgical items and chemicals or to perform the Services within the period(s) specified in the Contract, the Purchaser shall, without prejudice to its other remedies under the Contract , 0.5 % per week shall be deducted of the cost of Medicine, surgical items and chemicals on unperformed Services which are not supplied / performed as per the time schedule. Maximum deduction shall be 10 % of total cost of Contract amount and DG, Medical Health shall be intimated for , further actions which may be termination of the Contract and the Performance Security of the Bidder may be forfeited whole or proportionate.
13. Force majeure
(A) The Supplier shall not be liable to forfeit its performance security, liquidated damages or termination for default, if and to the extent that , it's delay in performance or other failure to perform its obligations under the Contract is the result of an event of Force Majeure .
(B) For purposes of this Clause , "Force Majeure " means an event beyond the control of the Supplier and not involving the Supplier's fault or negligence and not foreseeable . Such भाग 1 -क]

events may include , but are not limited to , acts of the Purchaser either in its sovereign or contractual capacity , wars or revolutions , fires , floods , epidemics , quarantine restrictions and freight embargoes .
(C) If a Force Majeure situation arises , the Supplier shall promptly notify the Purchaser in writing of such conditions and the cause thereof. Unless otherwise directed by the Purchaser in writing, the Supplier shall continue to perform its obligations under the Contract as far as is reasonably practical , and shall seek all reasonable alternative means for performance not prevented by the Force Majeure event.
14. The supplying firms will Emboss/Print U.K.G Supply Not for Sale will be printed on each label of the Bottle/Vials/ Strips /Boxes or Cartons etc. No supplies should be accepted if such embossing & Printing is not done on the supplies .
15. Every care has been taken to see that rates quoted and approved have been correctly notified in the Notification but in case of any discrepancy either in rates or in specification or any nature in other details , it will be the duty of the firm that they should intimate to the C.M.S.D. DG Medical Health under registered cover latest within a month so that necessary action may be taken .
16. The Firms while sending the bills will certify that the rates charged are applicable and have also been approved by the CMSD and in case of any default they are prepared to make adjustments.
17. The firms should also certify on the bills that the supplies are according to specification and the makes approved by the Director General Medical Health & F.W. Uttarakhand and are in accordance with the latest DRUG ACT .
18. The attention of the Indenting Officers is drawn to the various lists of items published by the firms. It has been found that in some cases the firms includes unapproved items in their lists of approved items . It is responsibility of the Indenting Officers to consult the Gazette Notification before placing the actual order and see that the order for only approved items is placed . Such cases of misrepresentation should immediately be brought to the notice of Director General of Medical Health & F.W. Uttarakhand ( CMSD) Dehradun sending copy of the list printed, by the particular firms . In case any firm is found doing so , strict action will be taken against them and their names will be deleted from Rate Contract without any notice to them and in addition they may be debarred.
19. No Assistance will be provided for release of the raw material or procurement of import license .
20. The Director General Medical Health & F.W. Uttarakhand CMSD Dehradun reserves the right to call Tender for Quantity Contract or parallel Rate contract and also to finalize them at any time during the period of the rate contract.
21. It will be condition of the contract that although during the currency of the contract the price approved in this rate Contract arrangement will remain firm but however in the event of prices going down the contractor will promptly furnish such information to enable this office to amend the contracted rates for supplies at Rate lower than the rate contract , the attention of the firm is drawn to it .
22. Director General Medical Health & F.W. Uttarakhand Dehradun or his authorized representative may inspect the premises of the manufacturing units to assess and verify that the item quoted as own made are actually manufactured by them .
23. All supplies shall have to be made strictly confirming to approved specification in accordance with the latest drug Act and Drug Act 1940 .
24. If, during the Contract period , the Firm under Contract supplies any Medicine(s) , Surgical Item(s) or Chemical ( s) , to any individual , institution, organization , state or any department or organization of 1648

Gol and/or State at the rate lesser than the rate under Rate Contract, in such case the Firm shall immediately inform the Director General Medical Health &F.W . Uttarakhand Dehradun and supply at the same reduced rate . The above stipulation will not however apply
a . Exports by the Contractor.
b. Sale of goods as original goods at a price lower than the price charged for normal replacement .
25. Supplies must be completed within six weeks (42 days ) from the date of issue of the Purchase Order from the Indenting Officers . If the Firm does not supply within six weeks (42 days) time from the date of issue of the Purchase Order from indenting officer , a further period can be extended up to three weeks if the firm apply for such extension before the expiry of six weeks (42 days) time giving valid satisfactory reasons . In case of non supply , the names of such defaulting firms should be intimated to CMSD section of the Directorate by registered post so that the necessary action against the firm .
26. All supplies shall be made as per IP/ BP or USP / BPC whenever this has been Omitted due to printing error wise it shall be or other as per IP and in its absence BP taken for all purpose that supplies are to make as per IP .
27. Director General Medical Health & F.W. Uttarakhand Dehradun authorizes the Drug controller of the State his access him to prosecute and take suitable action against firms defaulting as per drug act or per terms of contract.
28. During the pendency of contract if the license is withdrawn or any other action is taken by Drug Controller or his agent etc. the contract shall automatically come to a close with the firm . Against whom the action is being taken, firms shall see that they have valid drug license for the products approved in their favour and which they may supply during its pendency else they themselves shall be responsible for the same .
29. In the event of the prices being gone dawn the contracting firm may please intimate the same to the Director General Medical of Health services Uttarakhand Dehradun immediately for issuing necessary corrigendum in this regards and they will also charge the reduced rates from the Indenting Officers of the State . In case such information is received from the contracting firm that they are selling items approved in their favour at reduce rates either in open market or anywhere else . The Director General Medical Health & F.W. Uttarakhand Dehradun reserves the right to cancel the items of entire contract finalized with them and to debar the firm from further tendering .
30. This contract shall exclusively be governed by the terms and conditions mentioned in this notification the relevant conditions mentioned in the tender notice CMSD , tender form and relevant conditions mentioned in the agreement form (sent to the firm along with acceptance letter separately)
31. The Indenting Officers are advised to report the damages /defects notice in supplies to suppliers for notification repair replacement as the case may be , within fifteen days of the receipt / of the material .
32. In case of any complaint against the supplier for delay in supplies or defective supplies etc. The Indenting Officers are advised to report the matter under registered post to the Director General Medical Health & F.W. Uttarakhand Dehradun (CMSD ) Section promptly for necessary action by registered post/e -mail .
