mRrj çns'k 'kklu fpfdRlk vuqHkkx-10 ———— la[;k 1366/पाँच-10–2018-एफ-116-15 लखनऊ, 21 दिसम्बर, 2018 ———— अधिसूचना संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके और उत्तर प्रदेश चिकित्सा, स्वास्थ्य एवं परिवार कल्याण विभाग स्वास्थ्य कार्यकर्ता और स्वास्थ्य पर्यवेक्षक (पुरूष और महिला) सेवा नियमावली, 1997 और इस विषय पर समस्त विद्यमान नियमों और आदेशों का अधिक्रमण करके राज्यपाल उत्तर प्रदेश चिकित्सा, स्वास्थ्य एवं परिवार कल्याण विभाग स्वास्थ्य कार्यकर्ता और स्वास्थ्य पर्यवेक्षक (पुरूष और महिला) अराजपत्रित सेवा में नियुक्त व्यक्तियों की भर्ती और सेवा शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं।

भाग-एक-सामान्य

संक्षिप्त नाम और प्रारम्भ

1-(1) यह नियमावली उत्तर प्रदेश चिकित्सा, स्वास्थ्य एवं परिवार कल्याण विभाग स्वास्थ्य कार्यकर्ता और स्वास्थ्य पर्यवेक्षक (पुरूष और महिला) अराजपत्रित सेवा नियमावली, 2018 कही जायेगी;

(2) यह तुरन्त प्रवृत्त होगी।

सेवा की प्रास्थिति 2-उत्तर प्रदेश चिकित्सा, स्वास्थ्य एवं परिवार कल्याण विभाग स्वास्थ्य कार्यकर्ता और स्वास्थ्य पर्यवेक्षक (पुरूष और महिला) अराजपत्रित सेवा है जिसमें समूह ''ग'' के पद समाविष्ट हैं।472 RPh 2021 (Chikitsa anu-10) data 4e 2 उत्तर प्रदेश असाधारण गजट, 21 दिसम्बर, 2018 परिभाषायें 3-जब तक विषय या संदर्भ में कोई प्रतिकूल बात न हो, इस नियमावली में,-

(क) ''अधिनियम'' का तात्पर्य उत्तर प्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों के लिए आरक्षण) अधिनियम, 1994 से हैै;

(ख) ''नियुक्ति प्राधिकारी'' का तात्पर्य जिले के मुख्य चिकित्सा अधिकारी से है;

(ग) '''भारत का नागरिक'' का तात्पर्य ऐसे व्यक्ति से है जो संविधान के भाग-दो के अधीन भारत का नागरिक हो या समझा जाय;

(घ) ''आयोग'' का तात्पर्य उत्तर प्रदेश अधीनस्थ सेवा चयन आयोग से है;

(ड.) '' संविधान'' का तात्पर्य ''भारत का संविधान'' से है;

(च) ''महानिदेशक'' का तात्पर्य महानिदेशक, परिवार कल्याण, उत्तर प्रदेश से है;

(छ) ''सरकार'' का तात्पर्य उत्तर प्रदेश की राज्य सरकार से है;

(ज) ''राज्यपाल'' का तात्पर्य उत्तर प्रदेश के राज्यपाल से है;

(झ) ''स्वास्थ्य कार्यकर्ता (पुरूष)'' का तात्पर्य दिनांक 23 जुलाई, 1981 को या इसके पश्चात, और सदैव से इस रूप में नियुक्त व्यक्ति से तात्पर्यित समझा जायेगा और इसमें उक्त दिनांक को (एक) बेसिक स्वास्थ्य कार्यकर्ता, (दो) हाउस विजिटर, (तीन) वैक्सीनेटर और (चार) ट्रेकोमा स्वास्थ्य सहायक के रूप में कार्य करने वाला व्यक्ति सम्मिलित है;

(ञ) ''स्वास्थ्य कार्यकर्ता (महिला)'' का तात्पर्य दिनांक 23 जुलाई, 1981 को या इसके पश्चात, और सदैव से इस रूप में नियुक्त व्यक्ति से तात्पर्यित समझा जायेगा और इसमें उक्त दिनांक को (एक) सहायक नर्स धात्री और (दो) परिवार कल्याण कार्यकत्री के रूप में कार्य करने वाली व्यक्ति सम्मिलित है;

(ट) ''स्वास्थ्य पर्यवेक्षक (पुरूष)'' का तात्पर्य दिनांक 23 जुलाई, 1981 को या इसके पश्चात, और सदैव से इस रूप में नियुक्त व्यक्ति से तात्पर्यित समझा जायेगा और इसमें उक्त दिनांक को (एक) परिवार कल्याण स्वास्थ्य सहायक, (दो) स्वास्थ्य निरीक्षक, (तीन) चेचक पर्यवेक्षक (इम्यूनाइजेशन आफिसर) और (चार) सर्वेलेन्स इंस्पेक्टर के रूप में कार्य करने वाला व्यक्ति सम्मिलित है;

(ठ) ''स्वास्थ्य पर्यवेक्षक (महिला)'' का तात्पर्य दिनांक 23 जुलाई, 1981 को या उसके पश्चात, और सदैव से इस रूप में नियुक्त व्यक्ति से तात्पर्यित समझा जायेगा और इसमें उक्त दिनांक को महिला स्वास्थ्य निरीक्षिका के रूप में कार्य करने वाली व्यक्ति सम्मिलित है;

(ड़) ''सेवा का सदस्य'' का तात्पर्य सेवा के संवर्ग में किसी पद पर इस नियमावली या इस नियमावली के प्रारम्भ होने के पूर्व प्रवृत्त नियमों या आदेशों के अधीन मौलिक रूप से नियुक्त व्यक्ति से है;

(ढ़) ''नागरिकों के अन्य पिछड़े वर्गों'' का तात्पर्य समय-समय पर यथा संशोधित उक्त अधिनियम की अनुसूची एक में विनिर्दिष्ट नागरिकों के पिछड़े वर्गों से है;

(ण) ''सेवा'' का तात्पर्य उत्तर प्रदेश चिकित्सा, स्वास्थ्य एवं परिवार कल्याण विभाग, स्वास्थ्य कार्यकर्ता और स्वास्थ्य पर्यवेक्षक (पुरूष और महिला) सेवा से है;

(त) ''मौलिक नियुक्ति'' का तात्पर्य सेवा के संवर्ग में किसी पद पर ऐसी नियुक्ति से है जो तदर्थ नियुक्ति न हो और नियमों के अनुसार चयन के पश्चात की गयी हो और यदि कोई नियम न हो तो सरकार द्वारा जारी किये गये कार्यपालक अनुदेशों द्वारा तत्समय विहित प्रक्रिया के अनुसार की गयी हो;

(थ) ''भर्ती का वर्ष'' का तात्पर्य किसी कलेण्डर वर्ष की पहली जुलाई से प्रारम्भ होने वाली बारह मास की अवधि से है।472 RPh 2021 (Chikitsa anu-10) data 4e उत्तर प्रदेश असाधारण गजट, 21 दिसम्बर, 2018 3

भाग-दो-संवर्ग

सेवा का संवर्ग 4-(1) सेवा की सदस्य संख्या और उसमें प्रत्येक श्रेणी के पदों की संख्या उतनी

होगी जितनी सरकार द्वारा समय-समय पर अवधारित की जाय;

(2) जब तक कि उप नियम (1) के अधीन परिवर्तन करने के आदेश न दिये जायें, सेवा की सदस्य संख्या और उसमें प्रत्येक श्रेणी के पदों की संख्या उतनी होगी जितनी नीचे दी गयी हैंः-

परन्तु यह कि :-

(एक) नियुक्ति प्राधिकारी किसी रिक्त पद को बिना भरे हुए छोड़ सकता है या राज्यपाल उसे आस्थगित रख सकते हैं, जिससे कोई व्यक्ति प्रतिकर का हकदार न होगा; या

(दो) राज्यपाल ऐसे अतिरिक्त स्थायी या अस्थायी पदों का सृजन कर सकते हैं,

जिन्हें वह उचित समझें।

भाग-तीन-भर्ती

भर्ती का स्रोत 5-सेवा में विभिन्न श्रेणियों के पदों पर भर्ती निम्नलिखित स्रोतों से की जायेगीः- (1) स्वास्थ्य कार्यकर्ता (पुरूष)-ऐसे पुरूष अभ्यर्थियों में से जिन्होंने विभागीय मण्डलीय प्रशिक्षण केन्द्रों (जो पूर्व में क्षेत्रीय स्वास्थ्य एवं परिवार कल्याण केन्द्र के रूप में जाने जाते थे) अथवा महानिदेशक के विनिर्दिष्ट आदेश द्वारा अस्थायी रूप से सृजित राजकीय प्रशिक्षण केन्द्र द्वारा संचालित एक वर्ष का बहु उद्‌देश्यीय स्वास्थ्य कार्यकर्ता प्रशिक्षण पाठ्‌यक्रम सफलतापूर्वक पूर्ण कर लिया हो, आयोग के माध्यम से लिखित परीक्षा से सीधी भर्ती द्वारा।

(2) स्वास्थ्य कार्यकर्ता (महिला)-ऐसी महिला अभ्यर्थियों में से जिन्होंने भारतीय परिचर्या परिषद के सन्नियमों के अनुसार एक वर्ष छः माह/दो वर्ष का सहायक नर्सेज एण्ड मिडवाइब्ज प्रशिक्षण पाठ्‌यक्रम (प्रसूति से संबंधित 6 माह का प्रशिक्षण सहित) पूर्ण कर लिया हो, आयोग के माध्यम से लिखित परीक्षा से सीधी भर्ती द्वारा।

(3) स्वास्थ्य पर्यवेक्षक (पुरूष) (क) मौलिक रूप से नियुक्त स्वास्थ्य कार्यकर्ताओं (पुरूष) में से, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में दस वर्ष की सेवा पूरी कर ली हो और सरकार द्वारा विहित स्वास्थ्य पर्यवेक्षक (पुरूष) का छः मास का प्रशिक्षण सफलतापूर्वक पूरा कर लिया हो, विभागीय चयन समिति के माध्यम से पदोन्नति द्वारा।

(ख) महानिदेशक, स्वास्थ्य पर्यवेक्षक (पुरूष) के पद पर पदोन्नति द्वारा भर्ती के लिए चयन समिति को उनके नाम अग्रसारित करने के पूर्व स्वास्थ्य कार्यकर्ताओं (पुरूष) की ज्येष्ठता के क्रम में, खण्ड (क) में निर्दिष्ट प्रशिक्षण समय-समय पर आयोजित करेगा और प्रदान करेगा।

(4) स्वास्थ्य पर्यवेक्षक (महिला) (क) मौलिक रूप से नियुक्त स्वास्थ्य कार्यकर्ता (महिला) में से, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में दस वर्ष की सेवा पूरी कर ली हो और सरकार द्वारा विहित स्वास्थ्य पर्यवेक्षक (महिला) का छः मास का प्रशिक्षण सफतलापूर्वक पूरा कर लिया हो, विभागीय चयन समिति के माध्यम से पदोन्नति द्वारा।

(ख) महानिदेशक, स्वास्थ्य पर्यवेक्षक (महिला) के पद पर पदोन्नति द्वारा भर्ती के लिए चयन समिति को उनके नाम अग्रसारित करने के पूर्व स्वास्थ्य कार्यकर्ताओं (महिला) की ज्येष्ठता के क्रम में, खण्ड (क) में निर्दिष्ट प्रशिक्षण समय-समय पर आयोजित करेगा और प्रदान करेगा।472 RPh 2021 (Chikitsa anu-10) data 4e 4 उत्तर प्रदेश असाधारण गजट, 21 दिसम्बर, 2018 आरक्षण 6-अनुसूचित जातियों, अनुसूचित जन-जातियों और अन्य श्रेणियों के अभ्यर्थियों के लिए आरक्षण समय-समय पर यथासंशोधित उक्त अधिनियम और उत्तर प्रदेश लोक सेवा शारीरिक रूप से विकलांग, स्वतंत्रता संग्राम सेनानियों के आश्रितों और भूतपूर्व सैनिकों के लिए आरक्षण अधिनियम, 1993 और भर्ती के समय प्रवृत्त शासनादेशों के अनुसार किया जायेगा।

भाग-चार-अर्हताएं

राष्ट्रीयता 7- सेवा में किसी पद पर सीधी भर्ती के लिए आवश्यक है कि अभ्यर्थीः-

(क) भारत का नागरिक हो; या

(ख) तिब्बती शरणार्थी हो, जो भारत में स्थायी निवास के अभिप्राय से पहली जनवरी, 1962 के पूर्व भारत आया हो, या

(ग) भारतीय उद्‌भव का ऐसा व्यक्ति हो, जिसने भारत में स्थायी निवास के अभिप्राय से पाकिस्तान, वर्मा, श्रीलंका या किसी पूर्वी अफ्रीकी देश केनिया, युगांडा और यूनाइटेड रिपब्लिक आफ तन्जानिया (पूर्ववर्ती तांगानिका और जंजीवार) से प्रव्रजन किया हो :

परन्तु उपर्युक्त श्रेणी (ख) या (ग) के अभ्यर्थी को ऐसा व्यक्ति होना चाहिए जिसके पक्ष में राज्य सरकार द्वारा पात्रता का प्रमाण-पत्र जारी किया गया हो :

परन्तु यह और कि श्रेणी (ख) के अभ्यर्थी से यह भी अपेक्षा की जायेगी कि वह पुलिस उप महानिरीक्षक, अभिसूचना शाखा, उत्तर प्रदेश से पात्रता का प्रमाण-पत्र प्राप्त कर ले :

परन्तु यह भी कि यदि कोई अभ्यर्थी उपर्युक्त श्रेणी (ग) का हो तो पात्रता का प्रमाण-पत्र एक वर्ष से अधिक अवधि के लिए जारी नहीं किया जायेगा और ऐसे अभ्यर्थी को एक वर्ष की अवधि के आगे सेवा में इस शर्त पर रहने दिया जायेगा कि वह भारत की नागरिकता प्राप्त कर ले।

टिप्पणी-ऐसे अभ्यर्थी को, जिसके माामले में पात्रता का प्रमाण-पत्र आवश्यक हो, किन्तु वह न तो जारी किया गया हो और न देने से इन्कार किया गया हो, किसी परीक्षा या साक्षात्कार में सम्मिलित किया जा सकता है और उसे इस शर्त पर अनन्तिम रूप से नियुक्त भी किया जा सकता है कि आवश्यक प्रमाण-पत्र उसके द्वारा प्राप्त कर लिया जाये या उसके पक्ष में जारी कर दिया जाय।

शैक्षिक अर्हताएं 8-स्वास्थ्य कार्यकर्ता (पुरूष और महिला) के पदों पर सीधी भर्ती के लिए निम्नलिखित अर्हताएं होना आवश्यक हैः-

(1) स्वास्थ्य कार्यकर्ता (पुरूष)-

(क) अभ्यर्थी ने माध्यमिक शिक्षा परिषद, उत्तर प्रदेश की इण्टरमीडिएट परीक्षा या उसके समकक्ष सरकार द्वारा मान्यता प्राप्त कोई परीक्षा अवश्य उत्तीर्ण कर ली हो;

(ख) विभागीय मण्डलीय प्रशिक्षण केन्द्रों (जो पूर्व में क्षेत्रीय स्वास्थ्य एवं परिवार कल्याण केन्द्र के रूप में जाने जाते थे) अथवा महानिदेशक के विनिर्दिष्ट आदेशों द्वारा अस्थायी रूप से सृजित राजकीय प्रशिक्षण केन्द्र द्वारा संचालित एक वर्ष का बहुउद्‌देश्यीय स्वास्थ्य कार्यकर्ता प्रशिक्षण पाठ्‌यक्रम सफलतापूर्वक पूर्ण किया हो। (2) स्वास्थ्य कार्यकर्ता (महिला)-

(क) अभ्यर्थी ने माध्यमिक शिक्षा परिषद, उत्तर प्रदेश की इण्टरमीडिएट परीक्षा या उसके समकक्ष सरकार द्वारा मान्यता प्राप्त कोई परीक्षा अवश्य उत्तीर्ण कर ली हो;

(ख) अभ्यर्थी ने भारतीय परिचर्या परिषद के सन्नियमों के अनुसार एक वर्ष छः माह/दो वर्ष का सहायक नर्सेज एण्ड मिडवाइब्ज (ए.एन.एम.) प्रशिक्षण पाठ्‌यक्र्रम (प्रसूति से संबंधित छः माह का प्रशिक्षण सहित) सफलतापूर्वक अवश्य पूर्ण कर लिया हो और जो उत्तर प्रदेश नर्सेज एण्ड मिडवाइफ काउन्सिल, लखनऊ में विधिवत्‌ पंजीकृत हो।472 RPh 2021 (Chikitsa anu-10) data 4e उत्तर प्रदेश असाधारण गजट, 21 दिसम्बर, 2018 5 अधिमानी अर्हताएं 9-अन्य बातों के समान होने पर सीधी भर्ती के मामले में ऐसे अभ्यर्थी को अधिमान

दिया जायेगा जिसने-

(एक) प्रादेशिक सेवा में न्यूनतम दो वर्ष की अवधि तक सेवा की हो, या

(दो) राष्ट्रीय कैडेट कोर का ''बी'' प्रमाण-पत्र प्राप्त किया हो।

आयु

10-सीधी भर्ती के लिए यह आवश्यक है कि अभ्यर्थी ने उस कैलेन्डर वर्ष की, जिसमें आयोग द्वारा सीधी भर्ती के लिए रिक्तियॉ विज्ञापित की जाय, पहली जुलाई को अठारह वर्ष की आयु प्राप्त कर ली हो और चालीस वर्ष से अधिक आयु प्राप्त न की हो :

परन्तु अनुसूचित जातियों, अनुसूचित जन-जातियों और ऐसी अन्य श्रेणी के, जो सरकार द्वारा समय-समय पर अधिसूचित की जाय, अभ्यर्थियों की दशा में उच्चतर आयु सीमा उतने वर्ष अधिक होगी जितनी विनिर्दिष्ट की जाय :

परन्तु यह और कि ऐसे अभ्यर्थियों, जो चिकित्सा स्वास्थ्य एवं परिवार कल्याण विभाग, उत्तर प्रदेश सरकार में संविदा के आधार पर सहायक नर्स मिडवाइफ के रूप में कार्यरत हो और इस नियमावली के नियम 8 (2) में विहित अर्हता धारण करते हों की ऊपरी आयु सीमा, सीधी भर्ती के लिए उन्हें पात्रता योग्य बनाये जाने हेतु अधिकतम पांच वर्ष के अध्यधीन उतनी पूर्ण की गयी सेवा वर्षों, जितनी वे संविदा के आधार पर किये हो, तक अधिक होगी।

चरित्र

11-सेवा में किसी पद पर सीधी भर्ती के लिए अभ्यर्थी का चरित्र ऐसा होना चाहिये कि वह सरकारी सेवा में सेवायोजन के लिए सभी प्रकार से उपयुक्त हो सके। नियुक्ति प्राधिकारी इस संबंध में अपना समाधान कर लेगा।

टिप्पणी- संघ सरकार या किसी राज्य सरकार या किसी स्थानीय प्राधिकारी द्वारा, या संघ सरकार या किसी राज्य सरकार के स्वामित्वाधीन या नियंत्रणाधीन किसी निगम या निकाय द्वारा पदच्युत व्यक्ति सेवा में किसी पद पर नियुक्ति के लिए पात्र नहीं होंगे। नैतिक अधमता के किसी अपराध के लिए दोष सिद्ध व्यक्ति भी पात्र नहीं होंगे।

वैवाहिक प्रास्थिति 12-सेवा में किसी पद पर नियुक्ति के लिए ऐसा पुरूष अभ्यर्थी पात्र न होगा, जिसकी एक से अधिक पत्नियां जीवित हों या ऐसी महिला अभ्यर्थी पात्र न होगी जिसने ऐसे पुरूष से विवाह किया हो जिसकी पहले से एक पत्नी जीवित हो :

परन्तु सरकार किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकती है यदि

उसका यह समाधान हो जाय कि ऐसा करने के लिये विश्ेाष कारण विद्यमान है।

शारीरिक स्वस्थता 13-किसी अभ्यर्थी को सेवा में किसी पद पर नियुक्त नहीं किया जायेगा जब तक कि मानसिक और शारीरिक दृष्टि से उसका स्वास्थ्य अच्छा न हो और वह किसी ऐसे शारीरिक दोष से मुक्त न हो जिससे उसे अपने कर्तव्यों का दक्षतापूर्वक पालन करने में बाधा पड़ने की संभावना हो। किसी अभ्यर्थी को नियुक्ति के लिए अन्तिम रूप से अनुमोदित किये जाने के पूर्व उससे यह अपेक्षा की जायेगी कि वह फाइनेन्शियल हैण्ड बुक, खण्ड दो, भाग तीन के अध्याय तीन में दिये गये फण्डामेन्टल रूल 10 के अधीन बताये गये नियमों के अनुसार स्वस्थता प्रमाण-पत्र प्रस्तुत करे :

परन्तु पदोन्नति द्वारा भर्ती किये गये अभ्यर्थी से स्वस्थता प्रमाण-पत्र की अपेक्षा नहीं

की जायेगी।

भाग-पांच-भर्ती की प्रक्रिया

रिक्तियों का अवधारण 14-नियुक्ति प्राधिकारी भर्ती के वर्ष के दौरान भरी जाने वाली रिक्तियों की संख्या और नियम 6 के अधीन अनुसूचित जातियों, अनुसूचित जन-जातियों और अन्य श्रेणी के अभ्यर्थियों के लिए आरक्षित की जाने वाली रिक्तियों की संख्या भी अवधारित करेगा। आयोग के माध्यम से भरी जाने वाली रिक्तियों की सूचना उसको दी जायेगी।472 RPh 2021 (Chikitsa anu-10) data 4e 6 उत्तर प्रदेश असाधारण गजट, 21 दिसम्बर, 2018 आयोग के माध्यम से सीधी भर्ती की प्रक्रिया

15-(क) स्वास्थ्य कार्यकर्ता (पुरूष) और स्वास्थ्य कार्यकर्ता (महिला) के पदों पर सीधी भर्ती, समय-समय पर यथासंशोधित उत्तर प्रदेश समूह 'ग' के पदों पर सीधी भर्ती (रीति और प्रक्रिया) नियमावली, 2015 के अनुसरण में की जायेगी;

(ख) चिकित्सा स्वास्थ्य एवं परिवार कल्याण विभाग, उत्तर प्रदेश में संविदा के आधार पर सहायक नर्स मिडवाइफ के रूप में कार्यरत व्यक्ति को, अधिकतम पंद्रह अंको के अध्यधीन निम्नलिखित रीति में अधिमानी अंक प्रदान किये जायेंगेः-

(एक) संविदा के आधार पर पूर्ण की गई सेवा के प्रथम वर्ष के लिए......................

(दो) संविदा के आधार पर की गई सेवा के अगले और सेवा के प्रत्येक पूर्ण वर्ष के लिए...................प्रत्येक वर्ष हेतु तीन अंक

(ग) खंड (ख) के अधीन प्रत्येक अभ्यर्थी द्वारा प्राप्त अधिमानी अंको को, जहां पर लागू हो, आयोग द्वारा आयोजित लिखित परीक्षा में प्राप्त अंको में जोड़ दिया जायेगा। स्वास्थ्य पर्यवेक्षक (पुरूष तथा महिला) के पदों पर पदोन्नति द्वारा भर्ती की प्रक्रिया

16-सेवा में स्वास्थ्य पर्यवेक्षक (पुरूष) और स्वास्थ्य पर्यवेक्षक (महिला) के पदों पर पदोन्नति द्वारा भर्ती समय-समय पर यथासंशोधित उत्तर प्रदेश विभागीय पदोन्नति समिति का गठन (लोक सेवा आयोग के क्षेत्र के बाहर के पदों के लिए) नियमावली, 1992 के उपबन्धों के अनुसार गठित चयन समिति के माध्यम से समय-समय पर यथासंशोधित उत्तर प्रदेश सरकारी सेवक पदोन्नति द्वारा भर्ती का मानदण्ड नियमावली, 1994 में निर्धारित मानदण्डों के आधार पर की जायेगी;

टिप्पणी-(1) चयन समिति में अनुसूचित जातियों/अनुसूचित जन-जातियों और नागरिकों के अन्य पिछड़े वर्गों का प्रतिनिधित्व प्रदान करने के लिए अधिकारियों का नाम-निर्देशन, समय-समय पर यथा संशोधित उक्त अधिनियम की धारा 7 के अधीन दिये गये आदेशों के अनुसार किया जायेगा;

(2) नियुक्ति प्राधिकारी अभ्यर्थियों की पात्रता सूची, समय-समय पर यथा संशोधित उत्तर प्रदेश (लोक सेवा आयोग के क्षेत्र के बाहर के पदों पर) चयोन्नति पात्रता सूची नियमावली, 1986 के अनुसार तैयार करेगा और उसे उनकी चरित्र पंजियों और उनसे संबंधित ऐसे अन्य अभिलेखों के साथ, जो उचित समझे जाय, चयन समिति के समक्ष रखेगा;

(3) चयन समिति उप नियम (2) में निर्दिष्ट अभिलेखों के आधार पर अभ्यर्थियों के मामलों पर विचार करेगी और यदि वह आवश्यक समझे तो वह अभ्यर्थियों का साक्षात्कार भी कर सकती है;

(4) चयन समिति, चयन किये गये अभ्यर्थियों की ज्येष्ठता क्रम में जैसी उस संवर्ग में हो, जिससे उसकी पदोन्नति की जाती है, एक सूची तैयार करेगी और उसे नियुक्ति प्राधिकारी को अग्रसारित करेगी।

भाग-छः-नियुक्ति, परिवीक्षा, स्थायीकरण और ज्येष्ठता

नियुक्ति 17 (1)-नियुक्ति प्राधिकारी अभ्यर्थियों के नाम उसी क्रम में लेकर जिसमें वे यथास्थिति, नियम 15 या 16 के अधीन तैयार की गयी सूची में आये हो, नियुक्ति करेगा;

(2) यदि किसी एक चयन के संबंध में नियुक्ति के एक से अधिक आदेश जारी किये जायें तो एक संयुक्त आदेश भी जारी किया जायेगा जिसमें व्यक्तियों के नामों का उल्लेख, ज्येष्ठता क्रम में किया जायेगा जैसी यथा स्थिति चयन, में अवधारित की जाय या जैसी कि उस संवर्ग में हो जिससे उन्हें पदोन्नति किया जाय।

परिवीक्षा 18 (1)-सेवा में किसी पद पर मौलिक रूप से नियुक्त किये जाने पर प्रत्येक व्यक्ति को उत्तर प्रदेश सरकारी सेवक परिवीक्षा नियमावली, 2013 के अनुसार परिवीक्षा पर रखा जायेगा;

(2) यदि परिवीक्षा अवधि या बढ़ायी गयी परिवीक्षा अवधि के दौरान किसी भी समय या उसके अन्त में नियुक्ति प्राधिकारी को यह प्रतीत हो कि परिवीक्षाधीन व्यक्ति ने अपने अवसरों का पर्याप्त उपयोग नहीं किया है या अन्यथा समाधान प्रदान करने में विफल हो गया है, तो उसे उसके मौलिक पद पर, यदि कोई हो, प्रत्यावर्तित किया जा सकता है और यदि उसका किसी पद पर धारणाधिकार न हो, तो उसकी सेवायें समाप्त की जा सकती हैं;

(3) ऐसा परिवीक्षाधीन व्यक्ति, जिसे प्रत्यावर्तित किया जाय या उप नियम (2) के

अधीन जिसकी सेवायें समाप्त की जाय, किसी प्रतिकर का हकदार नहीं होगा;

(4) नियुक्ति प्राधिकारी संवर्ग में सम्मिलित किसी पद पर या किन्हीं अन्य समकक्ष या

उच्च पदों पर स्थानापन्न या अस्थायी रूप में की गयी निरन्तर सेवा को परिवीक्षा अवधि की

संगणना करने के प्रयोजनार्थ गिने जाने की अनुमति दे सकता है।

स्थायीकरण 19 (1)-उप नियम (2) के उपबन्धों के अधीन रहते हुए, किसी परिवीक्षाधीन व्यक्ति को

परिवीक्षा अवधि या बढ़ाई गयी परिवीक्षा अवधि के अन्त में उसकी नियुक्ति में स्थायी कर दिया

जायेगा, यदि-

(क) उसने विहित विभागीय परीक्षा, यदि कोई, उत्तीर्ण कर ली हो;

(ख) विहित प्रशिक्षण, यदि कोई, सफलतापूर्वक पूर्ण कर लिया हो;

(ग) उसका कार्य और आचरण संतोषजनक बताया जाय;

(घ) उसकी सत्यनिष्ठता प्रमाणित हो और

(ङ) नियुक्ति प्राधिकारी का यह समाधान हो जाय कि वह स्थायीकरण हेतु

अन्यथा उपयुक्त है।

(2) जहां उत्तर प्रदेश राज्य के सरकारी सेवकों की स्थायीकरण नियमावली, 1991 के

उपबन्धों के अनुसार स्थायीकरण आवश्यक नहीं है वहां उस नियमावली के नियम 5 के

उपनियम (3) के अधीन यह घोषणा करते हुए आदेश कि सम्बन्धित व्यक्ति ने परिवीक्षा अवधि

सफलतापूर्वक पूरी कर ली है, स्थायीकरण का आदेश समझा जायेगा।

ज्येष्ठता 20-सेवा में किसी श्रेणी के पद पर मौलिक रूप से नियुक्त व्यक्तियों की ज्येष्ठता,

समय-समय पर यथासंशोधित उत्तर प्रदेश सरकारी सेवक ज्येष्ठता नियमावली, 1991 के

अनुसार अवधारित की जायेगी।

भाग-सात-वेतन इत्यादि

वेतनमान 21 (1)-सेवा में विभिन्न श्रेणीयों के पदों पर नियुक्त व्यक्तियों का अनुमन्य वेतनमान

ऐसा होगा, जैसा राज्य सरकार द्वारा समय-समय पर उत्तर प्रदेश स्वास्थ्य कार्यकर्ता और

स्वास्थ्य पर्यवेक्षक (वेतन का विनियमन) अधिनियम, 1996 की धारा-3 की उपधारा (2) के अधीन जारी की गयी अधिसूचना द्वारा अवधारित किया जाय;

(2) इस नियमावली के प्रारम्भ के समय के वेतनमान निम्नलिखित हैंः-

परिवीक्षा अवधि में वेतन 22 (1)-फण्डामेन्टल रूल्स में किसी प्रतिकूल उपबन्ध के होते हुए भी, परिवीक्षाधीन व्यक्ति को, यदि वह पहले से स्थायी सरकारी सेवा में न हो, समयमान में उसकी प्रथम वेतन वृद्धि तभी दी जायेगी जब उसने एक वर्ष की संतोषजनक सेवा पूरी कर ली हो, विभागीय परीक्षा उत्तीर्ण कर ली हो और जहां विहित हो, प्रशिक्षण प्राप्त कर लिया हो, और द्वितीय वेतन वृद्धि दो वर्ष की सेवा के पश्चात तभी दी जायेगी जब उसने परिवीक्षा अवधि पूरी कर ली हो और उसे स्थायी भी कर दिया गया होः

परन्तु यह कि यदि संतोष प्रदान करने में विफलता के कारण परिवीक्षा अवधि बढ़ायी जाती है तो ऐसे विस्तार की गणना वेतनवृद्धि के लिए नहीं की जायेगी जब तक की नियुक्ति प्राधिकारी अन्यथा निदेश न दे;

(2) ऐसे व्यक्ति का, जो पहले से सरकार के अधीन कोई पद धारण कर रहा हो, परिवीक्षा अवधि में वेतन, सुसंगत फन्डामेंटल रूल्स द्वारा विनियमित होगा :

परन्तु यह कि यदि संतोष प्रदान करने में विफलता के कारण परिवीक्षा अवधि बढ़ायी जाती है तो ऐसे विस्तार की गणना वेतनवृद्धि के लिए नहीं की जायेगी जब तक की नियुक्ति प्राधिकारी अन्यथा निदेश न दे;

(3) ऐसे व्यक्ति का, जो पहले से स्थायी सरकारी सेवा में हो, परिवीक्षा अवधि में वेतन राज्य के कार्यकलाप के संबंध में सेवारत सरकारी सेवकों पर सामान्यतया लागू सुसंगत नियमों द्वारा विनियमित होगा।

भाग-आठ-अन्य उपबन्ध

पक्ष समर्थन 23-किसी पद पर या सेवा में लागू नियमों के अधीन अपेक्षित सिफारिशों से भिन्न किन्हीं सिफारिशों पर, चाहे लिखित हो या मौखिक, विचार नहीं किया जायेगा। किसी अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिए प्रत्यक्ष या अप्रत्यक्ष रूप से समर्थन प्राप्त करने का कोई प्रयास उसे नियुक्ति के लिए अनर्ह कर देगा।

अन्य विषयों पर

24-ऐसे विषयों के संबंध में, जो विनिर्दिष्ट रूप से इस नियमावली या विशेष विनियमन

आदेशों के अन्तर्गत न आते हो, सेवा में नियुक्त व्यक्ति, राज्य के कार्यकलापों के संबंध में सेवारत सरकारी सेवकों पर सामान्यतया लागू नियमों, विनियमों और आदेशों द्वारा नियंत्रित होंगे।

सेवा की शर्तों में

25-जहां राज्य सरकार का यह समाधान हो जाय कि सेवा में नियुक्त व्यक्तियों की शिथिलता

सेवा की शर्तों को विनियमित करने वाले किसी नियम के प्रवर्तन से किसी विशिष्ट मामले में अनुचित कठिनाई होती है, वहां वह उस मामले में लागू नियमों में किसी बात के होते हुए भी, आदेश द्वारा उस नियम की अपेक्षाओं को उस सीमा तक औैर ऐसी शर्तो के अधीन रहते हुये, जिन्हें वह मामले में न्याय संगत और साम्यपूर्ण रीति से कार्यवाही करने के लिये आवश्यक समझे, अभिमुक्त या शिथिल कर सकती है।

व्यावृत्ति 26-इस नियमावली में किसी बात का कोई प्रभाव, ऐसे आरक्षण और अन्य रियायतों पर नहीं पड़ेगा, जिनका इस संबंध में सरकार द्वारा समय-समय पर जारी किये गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जन-जातियों और अन्य विशेष श्रेणी के व्यक्तियों के लिये उपबन्ध किया जाना अपेक्षित हो।

IN exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Uttar Pradesh Medical, Health and Family Welfare Department Health Worker and Health Supervisors (Male and female), Service Rules 1997 and all existing rules and orders on the subject, the Governor is pleased to make the following rules regulating recruitment and the conditions of service of persons appointed to the Uttar Pradesh Medical, Health and Family Welfare Department Health Workers and Health Supervisors, (Male and female) Non-Gazetted, Service:

THE UTTAR PRADESH MEDICAL, HEALTH AND FAMILY WELFARE

DEPARTMENT HEALTH WORKERS AND HEALTH SUPERVISORS

(MALE AND FEMALE) NON-GAZETTED, SERVICE RULES, 2018

PART-I- GENERAL

Short title and commencement 1. (1) These rules may be called 'The Uttar Pradesh Medical, Health and Family Welfare Department Health Workers and Health Supervisors (Male and Female), Non-Gazetted Service Rules 2018'.

(2) They shall come into force at once.

Status of the service 2. The Uttar Pradesh Medical, Health and Family Welfare Department Health Workers and Health Supervisors (Male and Female), Non-Gazetted Service is a service comprises Group 'C' Posts.

Definitions 3. In these rules, unless there is anything repugnant in the subject or

context:

(a) 'Act' means the Uttar Pradesh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994;

(b) 'Appointing authority' means the Chief Medical Officer of the

District;

(c) 'Citizen of India' means a person who is or is deemed to be a citizen

of India under Part II of the Constitution;

(d) 'Commission' means the Uttar Pradesh Subordinate Services

Selection Commission ;

(e) 'Constitution' means the Constitution of India;

(f) 'Director General' means the Director General, Family welfare,

Uttar Pradesh;

(g) 'Government' means the State Government of Uttar Pradesh;

(h) 'Governor' means the Governor of Uttar Pradesh;

(i) 'Health Worker (Male)' means and be deemed always to have meant a person appointed as such on or after July 23, 1981 and includes a person working as (i) Basic Health Worker (ii) House visitor (iii) Vaccinator and (iv) Trachoma Health Assistant on the said date;

(j) 'Health Worker (Female)' means and be deemed always to have meant a person appointed as such on or after July 23, 1981 and includes a person working as (i) Auxiliary Nurse Midwife and (ii) Family Welfare Worker on the said date;

(k) 'Health Supervisor (Male)' means and be deemed always to have meant a person appointed as such on or after July 23, 1981 and includes a person working as (i)Family Planning Health Assistant (ii) Health Inspector (iii) Small Pox Supervisor (Immunization Officer) and (iv) Surveillance Inspector on the said date;

(l) 'Health Supervisor (Female)' means and be deemed always to have meant a person appointed as such on or after July 23, 1981 and includes a person working as Lady Health Visitor on the said date;

(m) 'member of service' means a person substantively appointed under these rules or the rules or orders in force prior to the commencement of these rules to a post in the cadre of the service;

(n) 'other backward classes of citizens' means the backward classes of citizens specified in Schedule - I of the Act, as amended from time to time;

(o) 'service' means the Uttar Pradesh Medical, Health and Family Welfare Department, Health Workers and Health Supervisors (Male and Female), Service;

(p)'substantive appointment' means an appointment, not being an ad-hoc appointment, on a post in the cadre of the service, made after selection in accordance with the rules and, if there were no rules, in accordance with the procedure prescribed for the time being by executive instructions issued by the Government;

(q) 'year of recruitment' means a period of twelve months commencing on the first day of July of a calendar year;

PART-II- CADRE

Cadre of service

4. (1) The strength of the service and of each category of posts therein shall be such as may be determined by the Government from time to time.

(2) The strength of the service and of each category of posts therein shall, until orders varying the same are passed under sub-rule (1), be as given below :-

Provided that :- (i) the appointing authority may leave unfilled or the Governor may hold in abeyance any vacant post, without thereby entitling any person to compensation; or

(ii) the Governor may create such additional permanent or temporary posts as he may consider proper.

PART-III- RECRUITMENT

Source of recruitment 5. Recruitment to the various categories of posts in the service shall be made from the following sources:–

(1) Health Worker (Male)- by direct recruitment through the Commission by written examination from amongst such male candidates who have successfully completed one year Multipurpose Health Worker Training Course conducted by Departmental Divisional Training Centers (previously known as Regional Health and Family Welfare Training Center) or a Government training center temporarily created by the specific order of the Director General.

(2) Health Worker (Female) - by direct recruitment through the Commission

by written examination from amongst such female candidates who have successfully

completed one and half year/ two year Auxiliary Nurses and Midwives (ANM) Training

Course (including 6 month training related to deliveries) as per Indian Nursing Council

norms and who are duly registered with the Uttar Pradesh Nurses & Midwives Council

Lucknow.

(3) Health Supervisor (Male) (A)- By promotion through the Departmental

Selection Committee from amongst substantively appointed Health Workers (Male)

who have completed ten years service as such and have successfully completed six

months Health Supervisor (Male) Training prescribed by the government on the first

day of the year of the recruitment.

(B)-The Director General shall from time to time organize and impart the

training referred to in clause (A) to Health Workers (Male) in order of seniority before

forwarding their names to the Selection Committee for recruitment by the promotion to

the post of Health Supervisor (Male).

(4) Health Supervisor (Female) (A)- by promotion through the Departmental

Selection Committee from amongst substantively appointed Health Workers (Female)

who have completed ten years service as such and have successfully completed six

months Health Supervisor (Female) Training prescribed by the government on the first

day of the year of the recruitment.

(B)-The Director General shall from time to time organize and impart the training referred to in clause (A) to Health Workers (Female) in order of seniority before forwarding their names to the Selection Committee for recruitment by promotion to the post of Health Supervisor (Female).

Reservation 6. Reservation for the candidates belonging to the Scheduled Castes,

Scheduled Tribes and other categories shall be in accordance with the Act, and the

Uttar Pradesh Public Services (Reservation for Physically Handicapped, Dependents

of Freedom Fighters and Ex Servicemen) Act, 1993, as amended from time to time,

and the orders of the Government in force at the time of the recruitment.

PART-IV-QUALIFICATIONS

Nationality 7. A candidate for direct recruitment to a post in the service must be:

(a) a citizen of India; or

(b) a Tibetan refugee who came over to India before the 1st January,

1962 with the intention of permanently settling in India; or

(c) a person of Indian origin who has migrated from Pakistan, Burma, Sri Lanka or any of the East African countries of Kenya, Uganda and the United Republic of Tanzania (formerly Tanganyika and Zanzibar) with the intention of permanently settling in India:

Provided that a candidate belonging to category (b) or (c) above must be a person in whose favour a certificate of eligibility has been issued by the State Government:

Provided further that a candidate belonging to category (b) will also be required to obtain a certificate of eligibility granted by the Deputy Inspector General of Police, Intelligence Branch, Uttar Pradesh:

Provided also that if a candidate belongs to category (c) above, no certificate of eligibility will be issued for a period of more than one year and the retention of such a candidate in service beyond a period of one year, shall be subject to his acquiring Indian citizenship.

NOTE- A candidate in whose case a certificate of eligibility is necessary but the same has neither been issued nor refused, may be admitted to an examination or interview and he may also be provisionally appointed subject to the necessary certificate being obtained by him or issued in his favour.

8. A candidate for direct recruitment to the post of Health Worker(Male and Academic Qualification

Female) must possess the following qualifications :

(1) Health Worker (Male)-

(a) A candidate must have passed intermediate examination of the Board of High School and Intermediate Education, Uttar Pradesh or an Examination recognized by the Government as equivalent thereto.

(b) Must have successfully completed one year Multipurpose Health Worker Training course conducted by Departmental Divisional Training Centers (previously known as Regional Health and Family Welfare Training Centers) or a Government training center temporarily created by the specific orders of the Director General. (2) Health Worker (Female)-

(a) A candidate must have passed Intermediate Examination of the Board of high School and Intermediate Education, Uttar Pradesh or an Examination recognized by the Government as equivalent thereto;

(b) A candidate must have successfully completed one and half year/two year Auxiliary Nurses and Midwives (ANM) Training Course (including six months training related to deliveries) as per Indian Nursing Council norms and who are duly registered with the Uttar Pradesh Nurses and Midwives Council Lucknow.

Preferential

9. A candidate who has:

qualification

(i) served in the Territorial Army for a minimum period of two years, or

(ii) obtained a `B' certificate of National Cadet Corps, shall, other things being equal, be given preference in the matter of direct recruitment.

Age

10. A candidate for direct recruitment must have attained the age of eighteen years and must not have attained the age of more than forty years on the first day of July of the calendar year in which vacancies for direct recruitment are advertised:

Provided that the upper age limit in the case of candidates belonging to the Scheduled Castes, Scheduled Tribes and such other categories as may be notified by the Government from time to time shall be greater by such number of years as may be specified:

Provided further that the upper age limit for such candidates who was working as auxiliary Nurse Midwife in the medical, Health and Family Welfare Department, by the government, Uttar Pradesh on contract basis and who possess the qualification prescribed in the rule-8(2) of these rule shall be greater by such number of completed years of services as they have rendered on contract basis subject to be maximum of five years for enabling them to become eligible for being considered for direct recruitment.

Character 11. The character of a candidate for direct recruitment to a post in the Service must be such as to render him suitable in all respects for employment in Government service. The appointing authority shall satisfy itself on this point.

NOTE - Persons dismissed by the Union Government or a State Government or by a Local Authority or a Corporation or Body owned or controlled by the Union Government or a State Government shall be ineligible for appointment to any post in the Service. Persons convicted of an offence involving moral turpitude shall also be ineligible.

Marital status 12. A male candidate who has more than one wife living or a female candidate who has married a man already having a wife living shall not be eligible for appointment to a post in the service:

Physical fitness 13. No candidate shall be appointed to a post in the service unless he/she be

in good mental and bodily health and free from any physical defect likely to interfere

with the efficient performance of his/her duties. Before a candidate is finally approved

for appointment he/she shall be required to produce a Medical Certificate of fitness in

accordance with the rules framed under Fundamental rule 10, contained in chapter III

of the Financial Hand-Book, Volume II, Part III:

Provided that a medical certificate of fitness shall not be required from a

candidate recruited by promotion.

PART-V-PROCEDURE FOR RECRUITMENT

Determination of 14. The appointing authority shall determine the number of vacancies to be

Vacancies filled during the course of the year of recruitment as also the number of vacancies to

be reserved for candidates belonging to Scheduled Castes, Scheduled Tribes and other

categories under rule 6. The vacancies to be filled through the commission shall be

intimated to them.

Procedure for 15. (a) Direct recruitment to the Posts of Health Worker (Male) and Health

direct recruitment Worker (Female) shall be made in accordance with the Uttar Pradesh direct

through the recruitment to Group 'C' Posts (Mode and Procedure) Rules, 2015, as amended from

Commission time to time.

(b) The weightage marks to a person who is working as Auxiliary Nurse

Midwife on contract basis in the medical, Health and Family welfare Department,

Uttar Pradesh shall be awarded in following manners subject to be maximum of

fifteen marks:-

(i) For the first completed year of service on contract basis ---------three

marks.

(ii) For the next and every completed years of service on contract basis--

------Three marks for each year.

(c) The weightage marks obtained by each candidate under the clause (b)

shall, where applicable, be added to the marks obtained in written examination

conducted by the commision.

Procedure for 16. (1) Recruitment by promotion to the post of Health Supervisor (Male) and

recruitment by Health Supervisor (Female) in the service shall be made on the basis of the criterion

promotion for the laid down in the Uttar Pradesh Government Servants Criterion for Recruitment by

post of Health Promotion Rules, 1994, as amended from time to time, through the Selection Supervisor (Male

and female) Committee constituted in accordance with the provision of the Uttar Pradesh

Constitution of Departmental Promotion Committee for Posts outside the purview of

the Service Commission Rules, 1992, as amended from time to time.

NOTE - (1) Nomination of officers for giving representation to the Scheduled

Castes/Scheduled Tribes and Other Backward Classes of Citizens in the Selection

Committee shall be made in accordance with the order made under section 7 of the

Act, as amended from time to time.

(2) The appointing authority shall prepare eligibility list of the candidates in

accordance with the Uttar Pradesh Promotion by Selection (on posts outside the

purview of the Public Service Commission) Eligibility List Rules, 1986, as amended

from time to time, and place the same before the Selection Committee along with their

character rolls and such other records, pertaining to them, as may be considered

proper.

(3) The Selection Committee shall consider the cases of candidates on the basis of records, referred to in sub-rule (2) and, if it considers necessary, it may interview the candidates also.

(4) The Selection Committee shall prepared a list of selected candidates in order of seniority as it stood in the cadre from which they are to be promoted and forward the same to the appointing authority.

PART-VI-APPOINTMENT, PROBATION, CONFIRMATION AND SENIORITY Appointment 17. (1) The appointing authority shall make appointment by taking the names of candidates in the order in which they stand in the lists prepared under rules, 15 or 16, as the case may be.

(2) If more than one order of appointment are issued in respect of any one selection, a combined order shall also be issued, mentioning the names of the persons in order of seniority as determined in the selection or, as the case may be, as it stood in the cadre from which they are promoted.

Probation 18. (1) A person on substantive appointment to a post in the service shall be placed on probation in accordance with the Uttar Pradesh Government Servants Probation Rules, 2013, as amended from time to time.

(2) If it appears to the appointing authority at any time during or at the end of the period of probation or extended period of probation that a probationer has not made sufficient use of his opportunities or has otherwise failed to give satisfaction, he may be reverted to his substantive post, if any, and if he does not hold a lien on any post his services may be dispensed with.

(3) A probationer who is reverted or whose services are dispensed with under sub-rule (2) shall not be entitled to any compensation.

(4) The appointing authority may allow continuous service, rendered in an officiating or temporary capacity in a Post included in the cadre or any other equivalent or higher posts to be taken in to account for the purpose of computing the period of probation.

Confirmation 19. (1) Subject to the provisions of sub-rule (2), a probationer shall be confirmed in his appointment at the end of the period of probation or the extended period of probation if-

(a) he has passed the prescribed departmental examination, if any,

(b) he has successfully undergone the prescribed training, if any,

(c) his work and conduct is reported to be satisfactory;

(d) his integrity is certified, and

(e) the appointing authority is satisfied that he is otherwise fit for confirmation.

(2) Where, in accordance with the provisions of the Uttar Pradesh State Government Servants Confirmation Rules, 1991 confirmation is not necessary, the order under sub-rule (3) of rule 5 of those rules declaring that the person concerned has successfully completed the probation, shall be deemed to be the order of confirmation.

Seniority 20. The seniority of persons substantively appointed in any category of post in the service shall be determined in accordance with the Uttar Pradesh Government Servants Seniority Rules, 1991, as amended from time to time.

PART—VII—PAY ETC

Scales of pay 21. (1) The scales of pay admissible to persons appointed to the various

categories of posts in the service shall be such as may be determined by the State

Government from time to time by notification issued under sub section (2) of section

(3) of the Uttar Pradesh Health Workers and Supervisors (Regulation of Pay) Act,

1996.

(2) The scales of pay at the time of the commencement of these rules are

given as follows:

Pay during 22. (1) Notwithstanding any provision in the Fundamental Rules to the

probation contrary, a person on probation, if he is not already in permanent Government service,

shall be allowed his first increment in the time scale when he has completed one year

of satisfactory service, has passed departmental examination and undergone training,

where prescribed, and second increment after two years service when he has

completed the probationary period and is also confirmed:

Provided that, if the period of probation is extended on account of failure to

give satisfaction, such extension shall not count for increment unless the appointing

authority directs otherwise.

(2) The pay during probation of a person who was already holding a post

under the Government, shall be regulated by the relevant fundamental rules:

Provided that, if the period of probation is extended on account of failure to

give satisfaction, such extension shall not count for increment unless the appointing

authority directs otherwise.

(3) The pay during probation of a person already in permanent Government

service shall be regulated by the relevant rules, applicable generally to Government

servants serving in connection with the affairs of the State.

PART—VIII—OTHER PROVISIONS

Canvassing 23. No recommendation, either written or oral, other than those required

under the rules applicable to the post or service will be taken into consideration. Any

attempt on the part of a candidate to enlist support directly or indirectly for his

candidature will disqualify him for appointment.

Regulation of 24. In regard to the matters not specifically covered by these rules or special

other matters orders, persons appointed to the service shall be governed by the rules, regulations and

orders applicable generally to Government servants serving in connection with the

affairs of the State.

Relaxation from

25. Where the State Government is satisfied that the operation of any rule the conditions of

regulating the conditions of service of persons appointed to the service causes undue service

hardship in any particular case, it may, notwithstanding anything contained in the rules applicable to the case, by order, dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner.

Savings

26. Nothing in these rules shall affect reservations and other concessions required to be provided for the candidates belonging to the Scheduled Castes, Scheduled Tribes and other special categories of persons in accordance with the orders of the Government issued from time to time in this regard.
