संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेश राज्य सम्पत्ति विभाग समूह ''क'' सेवा नियमावली, 1998 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाती है :-
उत्तर प्रदेश राज्य सम्पत्ति विभाग समूह ''क'' सेवा (प्रथम संशोधन) नियमावली, 2020
1-(1) यह नियमावली उत्तर प्रदेश राज्य सम्पत्ति विभाग समूह ''क'' सेवा (प्रथम संक्षिप्त नाम और प्रारम्भ संशोधन) नियमावली, 2020 कही जायेगी।
(2) यह तुरन्त प्रवृत्त होगी।
2-उत्तर प्रदेश राज्य सम्पत्ति विभाग समूह 'क' सेवा नियमावली, 1998 जिसे आगे नये नियम का बढ़ाया जाना उक्त नियमावली कहा गया है में, नियम-3 में उपनियम (क) के पश्चात्, नया उपनियम-3 (कक) और उपनियम (च) के पश्चात् नया उपनियम 3(चच) बढ़ा दिया जायेगा, अर्थात् :-
3(कक) ''अधिनियम'' का तात्पर्य उत्तर प्रदेेश लोक सेवा (अनुसूचित जातियों,
अनुसूचित जनजातियों और अन्य पिछड़े वर्गों के लिये आरक्षण) अधिनियम, 1994 से है;
(चच) ''नागरिकों के अन्य पिछड़े वर्गों'' का तात्पर्य समय-समय पर यथा संशोधित
अधिनियम की अनुसूची एक में विनिर्दिष्ट नागरिकों के पिछड़े वर्गों से है। 2 उत्तर प्रदेश असाधारण गजट, 16 दिसम्बर, 2020 नियम-5 का प्रतिस्थापन
3-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये नियम-5 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात् :-

विद्यमान नियम एतद्द्वारा प्रतिस्थापित नियम
सेवा में विभिन्न श्रेणियों के पदों पर भर्ती निम्नलिखित स्रोतों से की जायेगी :-
1-मुख्य व्यवस्था अधिकारी
सेवा में मुख्य व्यवस्थाधिकारी (ज्येष्ठ श्रेणी) के पद पर भर्ती मौलिक रूप से नियुक्त मुख्य व्यवस्था अधिकारियों में से, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में पांच वर्ष की सेवा पूरी कर ली हो, चयन समिति के माध्यम से पदोन्नति द्वारा की जायेगी।
सेवा में मुख्य व्यवस्था अधिकारी के पद पर भर्ती मौलिक रूप से नियुक्त व्यवस्था अधिकारियों में से, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को व्यवस्था अधिकारी के रूप में सात वर्ष की सेवा पूरी कर ली हो, चयन समिति के माध्यम से पदोन्नति द्वारा की जायेगी।
2-मुख्य व्यवस्था अधिकारी (ज्येष्ठ श्रेणी)
सेवा में मुख्य व्यवस्था अधिकारी (ज्येष्ठ श्रेणी) के पद पर भर्ती मौलिक रूप से नियुक्त मुख्य व्यवस्था अधिकारियों में से, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को मुख्य व्यवस्था अधिकारी के रूप में पांच वर्ष की सेवा पूरी कर ली हो, चयन समिति के माध्यम से पदोन्नति द्वारा की जायेगी। नियम-10 का प्रतिस्थापन
4-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-10 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात् :-

विद्यमान नियम एतद्द्वारा प्रतिस्थापित नियम
(1) सेवा में किसी पद पर मौलिक रूप से नियुक्त किये जाने पर प्रत्येक व्यक्ति को दो वर्ष की अवधि के लिये परिवीक्षा पर रखा जायेगा।
(1) सेवा में किसी पद पर मौलिक रूप से नियुक्त किसी व्यक्ति को समय-समय पर यथा संशोधित उत्तर प्रदेश सरकारी सेवक परिवीक्षा नियमावली, 2013 के अनुसार परिवीक्षा पर रखा जायेगा।
(2) यदि परिवीक्षा अवधि या बढ़ाई गई परिवीक्षा अवधि के दौरान किसी भी समय या उसके अन्त में नियुक्ति प्राधिकारी को यह प्रतीत हो कि परिवीक्षाधीन व्यक्ति ने अपने अवसरों का पर्याप्त उपयोग नहीं किया है या संतोष प्रदान करने में अन्यथा विफल रहा है तो उसे उसके मौलिक पद पर, यदि कोई हो, प्रत्यावर्तित किया जा सकता है और यदि उसका किसी पद पर धारणाधिकार न हो तो, उसकी सेवायें समाप्त की जा सकती हैं। (2) नियुक्ति प्राधिकारी ऐसे कारणों से जो अभिलिखित किये जायेंगे अलग-अलग मामलों में परिवीक्षा अवधि को बढ़ा सकता है जिसमें ऐसा दिनांक विनिर्दिष्ट किया जायेगा जब तक अवधि बढ़ाई जायः परन्तु आपवादिक परिस्थितियों के सिवाय परिवीक्षा अवधि एक वर्ष से अधिक और किसी भी परिस्थिति में दो वर्ष से अधिक नहीं बढ़ाई जायेगी।
(3) ऐसा परिवीक्षाधीन व्यक्ति, जिसे उपनियम (2) के अधीन प्रत्यावर्तित किया गया हो या जिसकी सेवायें समाप्त कर दी गई हों, किसी प्रतिकर का हकदार नहीं होगा।
(3) यदि परिवीक्षा अवधि या बढ़ाई गई परिवीक्षा अवधि के दौरान किसी भी समय या उसके अन्त में नियुक्ति प्राधिकारी को प्रतीत हो कि परिवीक्षाधीन व्यक्ति ने अपने अवसरों का पर्याप्त उपयोग नहीं किया है, उत्तर प्रदेश असाधारण गजट, 16 दिसम्बर, 2020 3 तो उसे उसके मौलिक पद पर प्रत्यावर्तित किया जा सकता है।
(4) ऐसा परिवीक्षाधीन व्यक्ति, जिसे उपनियम (3) के अधीन प्रत्यावर्तित किया जाय किसी प्रतिकर का हकदार नहीं होगा।
(4) नियुक्ति प्राधिकारी सेवा के संवर्ग में सम्मिलित किसी पद पर या किसी अन्य समकक्ष या उच्च पद पर स्थानापन्न या अस्थाई रूप में की गई निरन्तर सेवा को परिवीक्षा अवधि की संगणना करने के प्रयोजनार्थ गिने जाने की अनुमति दे सकता है।
(5) नियुक्ति प्राधिकारी संवर्ग में सम्मिलित किसी पद पर या किसी अन्य समकक्ष या उच्च पद पर स्थानापन्न या अस्थाई रूप में की गई निरन्तर सेवा को परिवीक्षा अवधि की संगणना करने के प्रयोजनार्थ गिने जाने की अनुमति दे सकता है।
5-उक्त नियमावली में, नीचे स्तम्भ-1 में दी गई विद्यमान परिशिष्ट के स्थान पर परिशिष्ट का प्रतिस्थापन स्तम्भ-2 में दी गई परिशिष्ट रख दी जायेगी, अर्थात् :-

In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Rajya Sampatti Vibhag Group "A" Service Rules, 1998:-
THE UTTAR PRADESH RAJYA SAMPATTI VIBHAG GROUP "A" SERVICE (FIRST AMENDMENT) RULES, 2020
Short title and
1- (1) These rules may be called The Uttar Pradesh Rajya Sampatti Vibhag Commencement Group "A" Service (First Amendment) Rules, 2020.
(2) They shall come into force at once.
Insertion of
2- In the Uttar Pradesh Rajya Sampatti Vibhag Group 'A' Service Rules 1998, new rule
hereinafter referred to as the said rules, in rule 3, after sub rule(a), new sub-rule 3(aa) and after sub-rule(f) new sub-rule 3(ff) shall be inserted namely :-
3(aa) "Act" means the Uttar Pradesh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act 1994;
(ff) "Other backword classes of citizens" means the backward classes of citizens specified in Schedule I of the Act as amended from time to time;

Recruitment to the various categories of posts in service shall be made from the following sources :-
1-Chief Management Officer
Recruitment to the post of Chief Management Officer (Senior Grade) in the service shall be made by promotion through the Selection Committee from amongst substantively appointed Chief Management Officers who have completed five years service, as such, on the first day of the year of recruitment.
Recruitment to the post of Chief Management Officer in the service shall be made by promotion through the Selection Committee from amongst substantively appointed Management Officers who have completed seven years service, as Management Officer, on the first day of the year of recruitment.
2-Chief Management Officer (Senior Grade)
Recruitment to the post of Chief Management Officer (Senior Grade) in the service shall be made by promotion through the Selection Committee from amongst substantively appointed Chief Management Officers who have completed five years service, as Chief Management Officers, on the first day of the year of recruitment.
