संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेश कारागार प्रशासन और सुधार कार्यपालक अधीनस्थ (अराजपत्रित) सेवा नियमावली, 1980 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं।

उत्तर प्रदेश कारागार प्रशासन और सुधार कार्यपालक अधीनस्थ (अराजपत्रित) सेवा (तृतीय संशोधन) नियमावली, 2020

1-(1) यह नियमावली उत्तर प्रदेश कारागार प्रशासन और सुधार कार्यपालक अधीनस्थ संक्षिप्त नाम और प्रारम्भ (अराजपत्रित) सेवा (तृतीय संशोधन) नियमावली, 2020 कही जायेगी।

(2) यह तत्काल प्रवृत्त होगी।

नियम 5 का संशोधन 2-उत्तर प्रदेश कारागार प्रशासन और सुधार कार्यपालक अधीनस्थ (अराजपत्रित) सेवा नियमावली 1980, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिए गए विद्यमान नियम 5 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जाएगा, अर्थात्‌ः-

सेवा में उप जेलर के पद

सेवा में उप जेलर के पद पर भर्ती निम्नलिखित स्रोतों से की जाएगी :-

पर भर्ती, निम्नलिखित स्रोतों से की जाएगी :-

(एक) साठ प्रतिशत आयोग के माध्यम

(एक) साठ प्रतिशत आयोग के माध्यम से

से सीधी भर्ती द्वारा;

सीधी भर्ती द्वारा;

स्तम्भ-1 स्तम्भ-2 (दो) चालीस प्रतिशत आयोग के माध्यम से मौलिक रूप से नियुक्त हेड जेल वार्डरों में से, जिन्होंने भर्ती वर्ष के प्रथम दिवस को हेड जेल वार्डर के रूप में पाँच वर्ष की सेवा पूर्ण कर ली हो तथा भर्ती वर्ष 2018-19 से माध्यमिक शिक्षा परिषद, उत्तर प्रदेश की इण्टरमीडिएट परीक्षा या सरकार द्वारा उसके समकक्ष मान्यता प्राप्त कोई परीक्षा उत्तीर्ण कर ली हो, अनुपयुक्त को अस्वीकार करते हुए, ज्येष्ठता के आधार पर आयोग के माध्यम से पदोन्नति द्वारा :

(दो) चालीस प्रतिशत आयोग के माध्यम से मौलिक रूप से नियुक्त अन्तर्कारा मुख्य वार्डरों, रिजर्व गार्ड मुख्य वार्डरों और महिला मुख्य वार्डरों में से, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में पाँच वर्ष की सेवा पूर्ण कर ली हो और भर्ती वर्ष 2011-12 से माध्यमिक शिक्षा परिषद, उत्तर प्रदेश की इण्टरमीडिएट परीक्षा या सरकार द्वारा उसके समकक्ष मान्यता प्राप्त कोई परीक्षा उत्तीर्ण कर ली हो, अनुपयुक्त को अस्वीकार करते हुए, ज्येष्ठता के आधार पर आयोग के माध्यम से पदोन्नति द्वारा निम्नलिखित अनुपात में ही जायेगी :-

(क) अन्तर्कारा मुख्य वार्डर-70 प्रतिशत; (ख) रिजर्व गार्ड मुख्य वार्डर-15 प्रतिशत; (ग) महिला मुख्य वार्डर-15 प्रतिशत।

परन्तु यह कि भर्ती वर्ष 2018-19 से उप जेलर के पद पर पदोन्नति के प्रयोजनार्थ हेड जेल वार्डर की एक पृथक ज्येष्ठता सूची तैयार की जाएगी, जिसमें उनके नाम जेल वार्डर पद पर उनकी नियुक्ति के क्रम में रखे जाएंगे। ः- शासनादेश संख्या-1300/ 22-1-2011-133/2008, दिनांक 23 जून, 2011 के द्वारा मुख्य प्रधान वार्डर के 12 पदों को उप कारापाल के पद में संविलीन किया गया हैः

परन्तु यह कि भर्ती वर्ष 1987-88 से भर्ती वर्ष 2010-11 तक उप जेलर के पद निम्नलिखित रीति से भरे जायेंगे :-

(क) पचहत्तर प्रतिशत आयोग के माध्यम से सीधी भर्ती द्वारा; (ख) पच्चीस प्रतिशत मौलिक रूप से नियुक्ति अन्तर्कारा मुख्य प्रधान वार्डरों, रिजर्व गार्ड मुख्य प्रधान वार्डरों, अन्तर्कारा प्रधान वार्डरों, रिजर्व गार्ड प्रधान वार्डरों तथा महिला प्रधान वार्डरों में से, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को मुख्य वार्डर और प्रधान मुख्य वार्डर के रूप में पाँच वर्ष की सेवा पूर्ण कर ली हो तथा भर्ती वर्ष 2005-06 से 2010-11 तक, जिन्होंने माध्यमिक शिक्षा परिषद, उत्तर प्रदेश की इण्टरमीडिएट परीक्षा या सरकार द्वारा उसके समकक्ष मान्यता प्राप्त कोई परीक्षा उत्तीर्ण कर ली हो, अनुपयुक्त को अस्वीकार करते हुए, ज्येष्ठता के आधार पर आयोग के माध्यम से पदोन्नति द्वारा की जाएगी :

परन्तु अग्रतर यह कि भर्ती वर्ष 2004-05 तक उप जेलर पद पर पदोन्नति हेतु शैक्षिक योग्यता माध्यमिक शिक्षा परिषद्‌, उत्तर प्रदेश से हाईस्कूल परीक्षा या सरकार द्वारा उसके समकक्ष मान्यता प्राप्त कोई परीक्षा उत्तीर्ण की होगी। -(1) उप जेलर के पद पर पदोन्नति के प्रयोजनार्थ अन्तर्कारा प्रधान मुख्य वार्डरों, रिजर्व गार्ड प्रधान मुख्य वार्डरों तथा महिला मुख्य वार्डरों की एक संयुक्त प्रदेश स्तरीय ज्येष्ठता सूची तैयार की जाएगी, जिसमें उनके नाम वार्डर पद पर उनकी मौलिक नियुक्ति के दिनांक के क्रम में रखे जाएंगे :

परन्तु यह भी कि भर्ती वर्ष 2011-12 से उप जेलर के पद पर पदोन्नति के प्रयोजनार्थ निम्नलिखित रीति में नामों को रखते हुए प्रत्येक पोषक संवर्ग के लिए पृथंक ज्येष्ठता सूची तैयार की जाएगी :-

(एक) अन्तर्कारा मुख्य वार्डरों को अन्तर्कारा जेल वार्डर के पद पर उनकी मौलिक नियुक्ति के क्रम में रखा जाएगा; ः

(दो) रिजर्व गार्ड मुख्य वार्डरों को रिजर्व गार्ड जेल वार्डर के पद पर उनकी मौलिक नियुक्ति के क्रम में रखा जाएगा;

(तीन) महिला मुख्य वार्डरों को महिला जेल वार्डर के पद पर उनकी मौलिक नियुक्ति के क्रम में रखा जाएगा।

3-उक्त नियमावली में नीचे स्तम्भ-1 में दिए गए विद्यमान नियम 23 के स्थान पर नियम 23 का संशोधन

स्तम्भ-2 में दिया गया नियम रख दिया जाएगा, अर्थात्‌ः-

23(1) सेवा में किसी पद पर नियुक्त व्यक्तियों का अनुमन्य वेतनमान ऐसा होगा, जैसा कि सरकार द्वारा समय-समय पर अवधारित किया जाय।

IN exercise of the powers conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Prison Administration and Reforms Executive Subordinate (Non-Gazetted) Service Rules, 1980.

TTHHEE UUTTTTAARR PPRRAADDEESSHH PRISON ADMINISTRATION AND REFORMS EXECUTIVE SUBORDINATE (NON-GAZETTED) SERVICE

(THIRD AMENDMENT) RULES, 2020

Short title and

1. (1) These rules may be called the Uttar Pradesh Prison Administration and commencement

Reforms Executive Subordinate (Non-Gazetted) Service (Third Amendment) Rules, 2020.

(2) They shall come into force at once.

2. In the Uttar Pradesh Prison Administration and Reforms Executive Amendment of rule 5

Subordinate (Non-Gazetted) Service Rules, 1980, hereinafter referred to as the said rules, for existing rule 5 set-out in column-1 below, the rule as set out in column-2 shall be substituted, namely:-

Rule as hereby substituted COLUMN-1 Existing rule NOTE-Twelve posts of Chief Head Warders have been merged with the posts of Deputy Jailor vide Government order no. 1300/22-1- 2011-133/2008, dated June 23, 2011:

Provided that from the recruitment year 1987-1988 to the recruitment year 2010-2011, the post of Deputy Jailor shall be filled in the following manner:–

(A) Seventy five per cent by direct recruitment through the Commission;

(B) Twenty five per cent by promotion through the Commission from amongst substantively appointed Intra-Mural Chief Head Warders, Reserve Guard Chief Head warders, Intra-Mural Head Warders, Reserve Guard Head Warders and Female Head Warders who have completed five years of service as Head Warder and Chief Head Warder on the first day of the year of recruitment and who have passed the Intermediate Examination of the Board of High School and Intermediate Education, Uttar Pradesh or an Examination recognised by the Government as equivalent thereto with effect from recruitment year 2005-06 to 2010- 2011, on the basis of seniority subject to rejection of the unfit :

Provided further that till the recruitment year 2004-05 the educational qualification for promotion to the post of Deputy Jailor shall be High School Examination passed from the Board of High School and Intermediate Education, Uttar Pradesh or an Examination recognised by the Government as equivalent thereto.

NOTE-For the purpose of the promotion to the post of Deputy Jailor, a combined State Level Seniority list of Intra-Mural Chief Head Warders, Reserve Guard Chief Head Warders, Intra-Mural Head Warders, Reserve Guard Head Warders and Female Head Warders shall be prepared by arranging their names in the order of their appointment to the post of warder:

Rule as hereby substituted Provided that from the recruitment year 2011-2012 for the purpose of the promotion to the post of Deputy Jailor, the seniority list shall be prepared separately for each feeding cadre by arranging the names in the following manner:– (1) Intra-Mural Head Warders arranged in order of their date of substantive appointment to the post of Intra-Mural Warder;

(2) Reserve Guard Head Warders arranged in order of their date of substantive appointment to the post of Reserve Guard Warder; (3) Female Head Warders arranged in order of their date of substantive appointment to the post of Female Warder.

3. In the said rules, for existing rule 23 set out in column-1 below, the rule as set Amendment of rule 23

out in column-2 shall be substituted, namely :-
