अधिसूचना
साधारण खंड अधिनियम, 1897 (अधिनियम संख्या 10 सन् 1897) की धारा 21 के साथ पठित उपभोक्ता संरक्षण अधिनियम, 2019 (अधिनियम संख्या 35 सन् 2019) की धारा 102 की उपधारा (1) तथा धारा 102 की उपधारा (2) के खण्ड (ज) एवं (ड) द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल निम्नलिखित नियमावली बनाती हैं, अर्थात् :-
उत्तर प्रदेश उपभोक्ता संरक्षण (राज्य आयोग और जिला आयोग के अध्यक्ष और सदस्यों का वेतन, भत्ते एवं सेवा शर्तें) नियमावली, 2021
संक्षिप्त नाम 1–(1) यह नियमावली उत्तर प्रदेश उपभोक्ता संरक्षण (राज्य आयोग और
और प्रारंभ जिला आयोग के अध्यक्ष और सदस्यों का वेतन, भत्ते एवं सेवा शर्तें) नियमावली, 2021 कही जायेगी ।
परिभाषाएं (2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी । 2–(1) जब तक संदर्भ से अन्यथा अपेक्षित न हो, इस नियमावली में,–
(क) 'अधिनियम' का तात्पर्य उपभोक्ता संरक्षण अधिनियम, 2019
(अधिनियम संख्या 35 सन् 2019) से है;
(ख) 'उपभोक्ता आयोग' का तात्पर्य अधिनियम की धारा 28 के अधीन जिला में स्थापित जिला उपभोक् ता विवाद प्रतितोष आयोग तथा अधिनियम की धारा 42 के अधीन राज्य में स्थापित 2 उत्तर प्रदेश असाधारण गजट, 6 अक्टूबर, 2021 राज्य उपभोक् ता विवाद प्रतितोष आयोग से है;
(ग) 'सदस्य' का तात्पर्य यथास्थिति, जिला आयोग अथवा राज्य आयोग के सदस्य से है;
(घ) 'अध्यक्ष' का तात्पर्य यथास्थिति, जिला आयोग अथवा राज्य आयोग के अध्यक्ष से है l
(2) इस नियमावली में प्रयुक्त और अपरिभाषित किन्तु अधिनियम में परिभाषित शब्दों और पदों के वही अर्थ होंगे जो अधिनियम में क्रमशः उनके लिए समनुदेशित हैं l
3–(1) अध्यक्ष, ऐसे वेतन और भत्तों के लिए हकदार होगा, जैसा कि किसी जिला न्यायाधीश के लिए अतिकाल वेतनमान में अनुज्ञेय हैं l
जिला आयोग के अध्यक्ष एवं सदस्यों के लिये संदेय वेतन एवं भत्ते
(2) सदस्य, राज्य सरकार के किसी उप सचिव के वेतनमान के न्यूनतम वेतन तथा ऐसे अधिकारी के लिए यथा अनुज्ञेय अन्य भत्तों के बराबर वेतन प्राप्त करेगा ।
(3) अध्यक्ष अथवा सदस्य के रूप में नियुक्त कोई ऐसा व्यक्ति, जो पेंशन भोगी हो, के वेतन में उसके द्वारा आहरित पेंशन की सकल राशि की कटौती की जायेगी।
(4) अध्यक्ष और सदस्य के वेतन में 3 प्रतिशत की दर से वाषिक उत्तरोत्तर पुनरीक्षण किया जायेगा।
4–(1) राज्य आयोग का अध्यक्ष वही वेतन तथा भत्ते प्राप्त करेगा जैसा कि राज्य के उच्च न्यायालय के आसीन न्यायाधीश के लिए अनुज्ञेय हैं l
राज्य आयोग के अध्यक्ष एवं सदस्यों के लिये संदेय वेतन एवं भत्ते
(2) राज्य आयोग का सदस्य, राज्य सरकार के विशेष सचिव के वेतनमान के न्यूनतम वेतन तथा ऐसे अधिकारी के लिए यथा अनुज्ञेय अन्य भत्तों के बराबर वेतन प्राप्त करेगा l
(3) अध्यक्ष अथवा सदस्य के रूप में नियुक्त कोई ऐसा व्यक्ति, जो पेंशनभोगी हो, के वेतन में उसके द्वारा आहरित पेंशन की सकल राशि की कटौती की जाएगी l
(4) सदस्य के वेतन में 3 प्रतिशत की दर से वाषिक उत्तरोत्तर पुनरीक्षण किया जायेगा। चिकित्सीय स्वस्थता 5–किसी क्ति को तब तक अध्यक्ष या सदस्य के रूप में नियुक्त नहीं किया जायेगा जब तक कि उसे राज्य सरकार द्वारा इस निमित्त विनिदि किसी प्राधिकारी द्वारा चिकित्सीय रूप से स्वस्थ घोषित नहीं कर दिया जाता है।
आकस्मिक रिक्ति 6–यथास्थिति राज्य आयोग या जिला आयोग में अध्यक्ष के पद पर आकस्मिक रिक्ति के मामले में, मा0 मुख्यमंत्री जी के पास उपलब्ध सदस्यों में से अध्यक्ष के रूप में कार्य करने के लिए प्राधिकृ त करने की शक्ति होगी।
मकान किराया भत्ता 7–अध्यक्ष अथवा सदस्य उसी दर से मकान किराया भत्ता के लिए हकदार होगा जैसा कि राज्य सरकार के तत्समान प्रस्थिति के समूह 'क' के अधिकारी के लिए अनुज्ञेय है ।
अवकाश और 8–राज्य आयोग तथा जिला आयोग के अध्यक्ष और सदस्य किसी एक कै लेंडर वर्ष में चौदह
चिकित्सा उपचार दिवसों के आकस्मिक अवकाश एवं दस दिवसों के चिकित्सा अवकाश के हकदार होंगे और वे
तथा
चिकित्सा उपचार एवं चिकित्सालयीय सुविधाओं के भी हकदार होंगे जैसा कि राज्य सरकार के
चिकित्सालयीय तत्समान प्रस्थिति के समूह 'क'के अधिकारी के लिए अनुज्ञेय है l
सुविधाएं
वित्तीय एवं अन्य 9–अध्यक्ष अथवा सदस्य को अपना पद ग्रहण करने से पूर्व, अपनी आस्तियों,
हितों की घोषणा देनदारियों तथा वित्तीय एवं अन्य हितों की घोषणा करनी होगी l
अन्य सेवा शर्तें 10–(1) अध्यक्ष अथवा सदस्य, यथास्थिति, राज्य आयोग अथवा जिला
आयोग की सेवा से सेवानिवृत्त होने के पश्चात् राष्ट्रीय आयोग, राज्य आयोग अथवा
जिला आयोग के समक्ष विधि-व्यवसाय नहीं करेगा l उत्तर प्रदेश असाधारण गजट, 6 अक्टूबर, 2021 3 (2) अध्यक्ष अथवा सदस्य, यथास्थिति, राज्य आयोग अथवा जिला आयोग,
में इन हैसियतों से कार्य करते समय कोई मध्यस्थता कार्य नहीं करेगा ।
(3) यथास्थिति राज्य आयोग अथवा जिला आयोग का अध्यक्ष अथवा सदस्य
पद धारण करने से प्रविरत हो जाने के दिनांक से दो वर्ष की अवधि तक के लिये
किसी ऐसे व्यक्ति, जो राज्य आयोग अथवा जिला आयोग के समक्ष किसी कार्यवाही में
कोई पक्षकार रहा हो, के प्रबंधन या प्रशासन में या उससे संबंधित किसी नियोजन को
स्वीकार नहीं करेगा :
परन्तु यह कि इस नियमावली में अंतविष्ट कोई बात, कें द्रीय सरकार अथवा किसी राज्य
सरकार अथवा किसी स्थानीय प्राधिकरण अथवा किसी सांविधिक प्राधिकरण या किसी कें द्रीय,
राज्य या प्रांतीय अधिनियम द्वारा या तद्धीन स्थापित किसी निगम अथवा कं पनी अधिनियम,
2013 (अधिनियम संख्या 18 सन् 2013) की धारा 2 के खंड (45) में यथा परिभाषित किसी
सरकारी कं पनी के अधीन किसी नियोजन पर लागू नहीं होगी।
पद और 11–अध्यक्ष अथवा सदस्य नियुक्त किये जाने वाले प्रत्येक व्यक्ति को अपना पद ग्रहण
गोपनीयता की करने से पूर्व, इस नियमावली से अनुलग्न प्रपत्र एक में पद की शपथ तथा प्रपत्र दो में गोपनीयता की
शपथ
शपथ ग्रहण करेगा तथा उन पर हस्ताक्षर करेगा।
वेतन,
12–वेतन, पारिश्रमिक एवं अन्य भत्तों की अदायगी, राज्य सरकार की संचित

IN exercise of the powers conferred by sub-section (1) of section 102 and clauses (h) and (m) of sub-section (2) of section 102 of the Consumer Protection Act, 2019 (Act no. 35 of 2019) read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor is pleased to make the following rules, namely :-
THE UTTAR PRADESH CONSUMER PROTECTION (SALARY, ALLOWANCES
AND CONDITIONS OF SERVICE OF PRESIDENT AND MEMBERS OF THE
STATE COMMISSION AND DISTRICT COMMISSION) RULES, 2021
Short title and 1. (1) These rules may be called the Uttar Pradesh Consumer Protection (Salary,
commencement Allowances and Conditions of Service of President and Members of the State
Commission and District Commission) Rules, 2021.
(2) They shall come into force on the date of their publication in the Gazette.
Definitions 2. (1) In these rules, unless the context otherwise requires, —
(a) 'Act' means the Consumer Protection Act, 2019 (Act no. 35 of 2019);
(b) 'Consumer Commission' means a District Consumer Disputes Redressal
Commission established in a district under section 28 of the Act, and a State
Consumer Disputes Redressal Commission established in a State under
section 42 of the Act;
(c) 'Member' means a Member of the District Commission or the State
Commission, as the case may be;
(d) 'President' means the President of the District Commission or the State
Commission, as the case may be.

Salaries and 3. (1) The President shall be entitled to the salary and allowances as are
allowances payable admissible to a District Judge in the super time scale of pay.

allowances payable allowances as are admissible to a sitting judge of the High Court of the State.

other allowances as are admissible to such officer.
(3) The pay of a person appointed as President or Member, who is in receipt of
any pension, shall be reduced by the gross amount of pension drawn by him.
(4) There shall be an annual upward revision of the pay of a Member at the rate
of 3%.
Medical fitness 5. No person shall be appointed as President or Member unless he is declared medically fit by an authority specified by the State Government in this behalf.
Casual vacancy 6. In case of casual vacancy in the office of President in the State Commission or District Commission, as the case may be, the Chief Minister shall have the power to authorize from amongst the available members to act as the President.
House rent
7. The President or Member shall be entitled to house rent allowance at the allowance
same rate as is admissible to Group 'A' Officer of the State Government of a corresponding status.
Leave and medical
8. The President and Members of the State Commission and the District treatment and
Commission shall be entitled to fourteen days of casual leave and ten days of medical hospital facilities
leave in a calendar year, and they shall also be entitled for medical treatment and hospital facilities as are admissible to Group 'A' Officer of the State Government of a corresponding status.

9. The President or Member shall, before entering upon his office, declare his financial and other
assets, and his liabilities and financial and other interests.

Other conditions of
10. (1) The President or Member shall not practice before the National service
Commission, the State Commission or the District Commission after retirement from the service of the State Commission or the District Commission, as the case may be.
(2) The President or Member shall not undertake any arbitration work while functioning in these capacities in the State Commission or the District Commission, as the case may be.
(3) The President or Member of the State Commission or the District Commission, as the case may be, shall not, for a period of two years from the date on 6 उत्तर प्रदेश असाधारण गजट, 6 अक्टूबर, 2021 which they cease to hold office, accept any employment in, or be connected with the management or administration of, any person who has been a party to a proceeding before the State Commission or the District Commission :
Provided that nothing contained in this rule shall apply to any employment under the Central Government or a State Government or a local authority or in any statutory authority or any corporation established by or under any Central, State or Provincial Act or a Government company as defined in clause (45) of section 2 of the Companies Act, 2013 (Act no. 18 of 2013).

11. Every person appointed to be the President or Member shall, before secrecy
entering upon his office, make and subscribe an oath of office in Form-I and oath of secrecy in Form-II annexed to these rules.

12. The salary, remuneration and other allowances shall be defrayed out of the salary, remuneration
