प्रकीर्ण

संविधान के अनुच्छेद 309 के परन्तु क द्वारा प्रदत्त शक्तियों का प्रयोग करके और इस विषय पर समस्त विद्यमान नियमों और आदेशों का अधिक्रमण करके राज्य8पाल, उत्त् र प्रदेश वन सांख्यिकी (समूह 'क') सेवा में भर्ती और उसमें नियुक्तु व्य क्तियों की सेवा की शर्तों को विनियमित करने के लिये निम्नदलिखित नियमावली बनाते हैं ।

भाग-एक-सामान्यव

संक्षिप्त नाम और 1-(1) यह नियमावली उत्तयर प्रदेश वन सांख्यिकी (समूह 'क') सेवा नियमावली ,

प्रारम्भत

2021 कही जायेगी।

(2) यह तुरन्तह प्रवृत्ती होगी।

सेवा की प्रास्थिति 2-उत्त र प्रदेश वन सांख्यिकी (समूह 'क') सेवा, राज्य सेवा है जिसमें समूह 'क' के पद

3-जब तक विषय या संदर्भ में कोई प्रतिकू ल बात न हो इस नियमावली में:-

(क) 'ʼअधिनियम'ʼ का तात्प र्य उत्तलर प्रदेश लोक सेवा (अनुसूचित जातियों , अनुसूचित जनजातियों और अन्य' वर्गों के लिए आरक्षण) अधिनियम, 1994 से है;

(ख) 'ʼनियुक्ति प्राधिकारी'ʼ का तात्पर्य राज्यमपाल से है;

(ग) 'ʼभारत का नागरिक'ʼ का तात्पर्य ऐसे व्ययक्ति से है जो संविधान के भाग दो के अधीन भारत का नागरिक हो या समझा जाय;

(घ) 'ʼसंविधान'ʼ का तात्पकर्य भारत का संविधान से है;

( ) 'ʼसरकार'ʼका तात्पर्य उत्तर प्रदेश की राज्य सरकार से है;

(च) 'ʼराज्यपाल'ʼ का तात्पर्य उत्तर प्रदेश के राज्यपाल से है;

(छ) 'ʼसेवा का सदस्य 'ʼ का तात्पर्य सेवा के संवर्ग में किसी पद पर इस नियमावली या इस नियमावली के प्रारम्भ होने के पूर्व प्रवृत्त नियमों या आदेशों के अधीन मौलिक रूप से नियुक्त व्यक्ति से है;

(ज) 'ʼनागरिकों के अन्य वर्गों'ʼ का तात्पर्य समय- समय पर यथासंशोधित अधिनियम की अनुसूची-एक में विनिदिष्ट नागरिकों के वर्गों से है;

(झ) 'ʼसेवा 'ʼ का तात्पर्य उत्तर प्रदेश वन सांख्यिकी (समूह 'क') सेवा से है;

(ञ) 'ʼमौलिक नियुक्ति'ʼ का तात्पर्य सेवा के संवर्ग में किसी पद पर ऐसी नियुक्ति से है जो तदर्थ नियुक्ति न हो और नियमों के अनुसार चयन के पश्चात की गयी हो और यदि कोई नियम न हों तो सरकार द्वारा जारी किये गये कार्यपालक आदेशों द्वारा तत्समय विहित प्रक्रिया के अनुसार की गयी हो;

(ट) 'ʼभर्ती का वर्ष 'ʼ का तात्पर्य किसी कै लेण्डर वर्ष की पहली जुलाई से प्रारम्भ होने वाली बारह मास की अवधि से है।

भाग-दो-संवर्ग

सेवा का संवर्ग 4-(1) सेवा की सदस्य संख्या और उसमें प्रत्येक श्रेणी के पदों की संख्या उतनी होगी जितनी सरकार द्वारा समय-समय पर अवधारित की जाय।

(2) जब तक कि उप नियम (1) के अधीन परिवर्तन करने के आदेश न दिये जांय सेवा की सदस्य संख्या और उसमें प्रत्येक श्रेणी के पदों की संख्या उतनी होगी जितनी परिशिष्ट में दी गयी है;

परन्तु यह किः-

(क) नियुक्ति प्राधिकारी किसी रिक्त पद को बिना भरे हुए छोड़ सकता है या राज्यपाल उसे आस्थगित रख सकते हैं, जिससे कोई व्यक्ति प्रतिकर का हकदार न होगा; या

(ख) राज्यपाल ऐसे अतिरिक्त स्थायी या अस्थायी पदों का सृजन कर सकते हैं , जिन्हें वह उचित समझें ।

भाग-तीन-भर्ती

भर्ती का स्रोत 5-सेवा में विभिन्न श्रेणी के पदों पर भर्ती निम्नलिखित स्त्रोतों से की जायेगीः-

(1) अपर निदेशक- मौलिक रूप से नियुक्त ऐसे संयुक्त निदेशकों में से , जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रुप में चार वर्ष की सेवा पूर्ण कर ली हो, पदोन्नति द्वारा ।

(2) संयुक्त निदेशक- मौलिक रूप से नियुक्त ऐसे उप निदेशकों / मुख्य सांख्यिकी अधिकारियों में से, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में पॉच वर्ष की सेवा पूर्ण कर ली हो, पदोन्नति द्वारा ।

(3) उप निदेशक /मुख्य सांख्यिकी अधिकारी- मौलिक रूप से नियुक्त ऐसे सांख्यिकी अधिकारियों में से , जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में सात वर्ष की सेवा पूर्ण कर ली हो, पदोन्नति द्वारा।

आरक्षण 6-शारीरिक रूप से विकलांग श्रेणी के अभ्यथियों के लिए आरक्षण , भर्ती के समय प्रवृत्त सरकार के आदेशों के अनुसार होगा ।

भाग-चार-भर्ती की प्रक्रिया

रिक्तियों का

7- नियुक्ति प्राधिकारी भर्ती के वर्ष के दौरान भरी जाने वाली रिक्तियों की संख्या अवधारण

भर्ती की प्रक्रिया अधिकारी के पदों पर पदोन्ने ति द्वारा भर्ती समय- समय पर यथासंशोधित उत्तर र प्रदेश विभागीय

पदोन्नीति समिति का गठन (सेवा आयोग के क्षेत्र के बाहर के पदों के लिए ) नियमावली, 1992 के

उपबंधों के अनुसार गठित चयन समिति के माध्यम से, समय-समय पर यथासंशोधित उत्तगर प्रदेश

सरकारी सेवक (पदोन्न ति द्वारा भर्ती के लिए मानदण्डर) नियमावली, 1994 में दिये गये मानदण्डअ के

आधार पर की जायेगी।

टिप्पपणी:- चयन समिति में अनुसूचित जातियों /अनुसूचित जनजातियों और नागरिकों के

अन्यप पिछड़े वर्गों को प्रतिनिधित्व देने के लिए अधिकारियों का नाम निर्देशन समय- समय पर

यथासंशोधित अधिनियम की धारा 07 के अधीन किये गये आदेश के अनुसार किया जायेगा।

(2) नियुक्ति प्राधिकारी अभ्यकथियों की पात्रता सूची समय-समय पर यथासंशोधित उत्त र

प्रदेश (लोक सेवा आयोग के क्षेत्र से बाहर के पदों पर ) चयनोन्न।ति पात्रता सूची नियमावली, 1986

के अनुसार तैयार करेगा और उसे उनकी चरित्र पंजियों और उनसे संबंधित ऐसे अन्यस अभिलेखों के

साथ, जो उचित समझे जायें, चयन समिति के समक्ष रखेगा ।

(3) चयन समिति उप- नियम (2) में निदिष्ट। अभिलेखों के आधा र पर अय्जनिथियों के

मामलों पर विचार करेगी और यदि आवश्यचक समझे तो अभ्यतथियों का साक्षात्का◌ेर भी कर सकती है।

(4) चयन समिति चयनित अभ्यथियों की एक सूची, उस ज्ये ्ष्ठाता क्रम में, जैसी उस संवर्ग

में थी जिससे उनकी पदोन्निति की जानी है, तैयार करेगी और उसे नियुक्ति प्राधिकारी को अग्रसारित

करेगी।

भाग-पॉच-नियुक्ति और ज्येाष्ठकता

नियुक्ति

9-(1) नियुक्ति प्राधिकारी अभ्ययथियों के नाम उ सी क्रम में लेकर जिसमें वे नियम 8 के

अधीन तैयार की गयी सूची में आये हों, नियुक्तियॉ करेगा।

(2) यदि किसी एक चयन के संबंध में नियुक्ति के एक से अधिक आदेश जारी किये जायें

तो एक संयुक्त आदेश भी जारी किया जायेगा जिसमें व्य क्तियों के नामों का उल्ले◌ेख उसी रूप में

किया जायेगा जैसा कि उस संवर्ग में हो जिससे उन्हेंस पदोन्नत किया जाये ।

ज्येरष्ठ ता

10-सेवा में किसी श्रेणी के पदों पर मौलिक रूप से नियुक्त व्याक्तियों की ज्ये।ष्ठिता समय-

समय पर यथासंशोधित उत्ति र प्रदेश सरकारी सेवक ज्येस ष्ठकता नियमावली , 1991 के अनुसार

अवधारित की जायेगी ।

भाग- छ -वेतन आदि वेतनमान

11- (1) सेवा में विभिन्नक श्रेणी के पदों पर नियुक्ती व्य9क्तियों को अनुमन्य वेतनमान ऐसा

होगा जैसा सरकार द्वारा समय-समय पर अवधारित किया जाय।

(2) इस नियमावली के प्रारम्भ होने के समय पर वेतनमान परिशिष्ट् में दिये गये हैं ।

भाग-सात अन्यि उपबन्धम

पक्ष समर्थन 12-किसी पद पर या सेवा में लागू नियमों के अधीन अपेक्षित सिफारिशों से भिन्नत किन्हीं◌े

सिफारिशों पर चाहे लिखित हो या मौखिक , विचार नहीं किया जायेगा । किसी अभ्यिर्थी की ओर से

अपनी अभ्य थिता के लिए प्रत्यगक्ष या अप्रत्यकक्ष रूप से समर्थन प्राप्तह करने का कोई प्रयास उसे

नियुक्ति के लिए अनर्ह कर देगा ।

अन्यो विषयों का 13-सेवा में नियुक्ता व्यिक्ति ऐसे विषयों के संबंध में, जो विनिदिष्टक रूप से इस नियमावली

विनियमन या विशेष आदेशों के अन्तयर्गत न आते हों , राज्यक के कार्यकलापों के सम्बि न्धट में सेवारत सरकारी

सेवकों पर सामान्यतया लागू नियमों, विनियमों और आदेशों द्वारा नियंत्रित होंगे ।

सेवा की से 14-जहॉ राज्यक सरकार का यह समाधान हो जाये कि सेवा में नियुक्ता व्योक्तियों की सेवा

शिथिलता की शर्तों को विनियमित करने वाले किसी नियम के प्रवर्तन से किसी विशिष्टन मामले में असम्यकक्

कठिनाई होती है , वहॉ वह उस मामले में लागू नियमों में किसी बात के होते हुये भी , आदेश द्वारा

उस नियम की अपेक्षाओं को उस सीमा तक और ऐसी शर्तों के अधीन , जिन्हें वह मामले में

न्या◌ियसंगत और साम्यीपूर्ण रीति से कार्यवाही करने के लिए आवश्यतक समझे, अभिमुक्तं या शिथिल

कर सकती है ।540 RPH 2022 data 4e Paryavan fold.) 4 उत्तर प्रदेश असाधारण गजट, 4 जनवरी, 2022 व्याRवृत्ति 15-इस नियमावली में किसी बात का कोई प्रभाव ऐसे आरक्षण और अन्यल रियायतों पर नहीं , जिन्हेंत इस संबंध में सरकार द्वारा समय- समय पर जारी किये गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और व्यमक्तियों की अन्य- विशेष श्रेणियों के अभ्ये थियों के लिए उपलब्धाकराया जाना अपेक्षित हो ।

IN exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of all existing rules and orders on the subject, the Governor is pleased to make the following rules regulating recruitment and the conditions of service of persons appointed to the Uttar Pradesh Forest Statistics (Group 'A') Service.

THE UTTAR PRADESH FOREST STATISTICS (GROUP 'A')

SERVICE RULES, 2021

PART- I- GENERAL

1. (1) These rules may be called The Uttar Pradesh Forest Statistics Short title and commencement

(Group 'A') Service Rules, 2021.

(2)They shall come into force at once.

2.The Uttar Pradesh Forest Statistics (Group 'A') Service is a State service Status of the Service

comprising Group 'A' posts.

3.In these rules, unless there is anything repugnant in the subject or context: Definitions (a) 'Act' means the Uttar Pradesh Public Services (Reservation for Scheduled

Castes, Scheduled Tribes and Other Backward Classes) Act, 1994;

(b) 'appointing authority' means the Governor;

(c) 'citizen of India' means a person who is or is deemed to be a citizen of

India under Part II of the Constitution;

(d) 'Constitution' means the Constitution of India;

(e)'Government' means the State Government of Uttar Pradesh;

(f)'Governor' means the Governor of Uttar Pradesh;

(g) 'member of the service' means a person substantively appointed under these rules or the rules or orders in force prior to the commencement of these rules to a post in the cadre of the service;

(h) 'other backward classes of citizens' means the backward classes of

citizens specified in Scheduled I of the Act, as amended from time to time;

(i) 'service' means the Uttar Pradesh Forest Statistics (Group 'A') Service;

(j) 'substantive appointment' means an appointment, not being an ad-hoc appointment, on a post in the cadre of the service, made after selection in accordance with the rules and, if there were no rules, in accordance with the procedure prescribed for the time being by executive instructions issued by the Government;

(k) 'year of recruitment' means a period of twelve months commencing on the

first day of July of a calendar year.

PART-II- CADRE

Cadre of service 4. (1) The strength of the service and of each category of posts therein shall

be such as may be determined by the Government from time to time.

(2) The strength of the service and of each category of posts therein shall,

until orders varying the same are passed under sub-rule (1), be as given in Appendix :

Provided that:-

(a) the appointing authority may leave unfilled or the Governor may hold in

abeyance any vacant post, without thereby entitling any person to compensation; or

(b) the Governor may create such additional permanent or temporary posts as

he may consider proper.

PART-III - RECRUITMENT

5. Recruitment to the various categories of posts in the service shall be made Source of recruitment from the following sources:

Additional Director (1) By promotion from amongst substantively appointed Joint Directors who have completed four years service as such on the first day of the year of recruitment.

Joint Director (2) By promotion from amongst substantively appointed Deputy Directors/ Chief Statistical Officers who have completed five years service as such on the first day of the year of recruitment.

(3) By promotion from amongst substantively appointed Statistical Officers who have completed seven years service as such on the first day of the year of recruitment.

Reservation for the candidates belonging to the category of Physically Handicapped shall be in accordance with the orders of the Government in force at the time of the recruitment.

PART-IV - PROCEDURE FOR RECRUITMENT

7. The appointing authority shall determine the number of vacancies to be Determination of vacancies filled during the course of the year of recruitment

Procedure for recruitment by promotion

8. (1) Recruitment by promotion to the posts of Additional Director, Joint Director and Deputy Director/Chief Statistical Officer in the service shall be made on the basis of the criterion laid down in the Uttar Pradesh Government Servants (Criterion for Recruitment by Promotion) Rules, 1994, as amended from time to time, through the Selection Committee constituted in accordance with the provisions of the Uttar Pradesh Constitution of Departmental Promotion Committee for Posts Outside the Purview of the Service Commission Rules, 1992, as amended from time to time.

NOTE-Nomination of officers for giving representation to the Scheduled Castes/Scheduled Tribes and Other Backward Classes of Citizens in the Selection Committee shall be made in accordance with the order made under section 7 of the Act, as amended from time to time.

(2) The appointing authority shall prepare eligibility list of the candidates in accordance with the Uttar Pradesh Promotion by Selection (on posts outside the purview of the Public Service Commission) Eligibility List Rules, 1986, as amended from time to time, and place the same before the Selection Committee alongwith their character rolls and such other records, pertaining to them, as may be considered proper.

(3) The selection committee shall consider the cases of candidates on the basis of the records, referred to in sub-rule (2), and, if it considers necessary, it may interview the candidates also.

(4) The Selection Committee shall prepare a list of selected candidates in order of seniority as it stood in the cadre from which they are to be promoted and forward the same to the appointing authority.

PART-V- APPOINTMENT AND SENIORITY

Appointment 9. (1) The appointing authority shall make appointment by taking the names of candidates in the order in which they stand in the list prepared under rule 8.

(2) If more than one order of appointment are issued in respect of any one selection, a combined order shall also be issued, mentioning the names of the persons as it stood in the cadre from which they are promoted.

Seniority 10. The seniority of persons substantively appointed in any category of posts in the service shall be determined in accordance with the Uttar Pradesh Government Servants Seniority Rules, 1991, as amended from time to time

PART-VI - PAY ETC.

Scales of pay 11. (1) The scales of pay admissible to persons appointed to the various categories of posts in the service shall be such as may be determined by the Government from time to time.

(2) The scales of pay at the time of the commencement of these rules are given in Appendix.

PART-VII - OTHER PROVISIONS

Canvassing 12. No recommendations, either written or oral, other than those required under the rules applicable to the post or service will be taken into consideration. Any attempt on the part of a candidate to enlist support directly or indirectly for his candidature will disqualify him for appointment.

Regulation of other matters 13. In regard to the matters not specifically covered by these rules or special orders, persons appointed to the service shall be governed by the rules, regulations and orders applicable generally to Government servants serving in connection with the affairs of the State.

Relexation from the conditions of service

14. Where the State Government is satisfied that the operation of any rule regulating the conditions of service of persons appointed to the service causes undue hardship in any particular case, it may, notwithstanding anything contained in the rules applicable to the case, by order, dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner

Savings 15. Nothing in these rules shall affect reservations and other concessions required to be provided for the candidates belonging to the Scheduled Castes, Scheduled Tribes and other special categories of the persons in accordance with the orders of the Government issued from time to time in this regard.
